which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><action stage="Reported-in-Senate"><action-date date="20221215">December 15, 2022</action-date><action-desc>Reported by <sponsor name-id="S275">Ms. Cantwell</sponsor>, with an amendment</action-desc><action-instruction>Insert the part printed in italic</action-instruction></action><legis-type>A BILL</legis-type><official-title>To amend the Save Our Seas 2.0 Act to improve the administration of the Marine Debris Foundation, to amend the Marine Debris Act to improve the administration of the Marine Debris Program of the National Oceanic and Atmospheric Administration, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Save Our Seas 2.0 Amendments Act</short-title></quote>. </text></section><section id="id8ABEE05CFE424B9AB202822997FF8A90"><enum>2.</enum><header>Modifications to the Marine Debris Foundation</header><subsection id="id0407103E166C4686B444AD76A8B5E5AE"><enum>(a)</enum><header>Status of Foundation</header><text>Section 111(a) of the Save Our Seas 2.0 Act (<external-xref legal-doc="usc" parsable-cite="usc/33/4211">33 U.S.C. 4211(a)</external-xref>) is amended, in the second sentence, by striking <quote>organization</quote> and inserting <quote>corporation</quote>. </text></subsection><subsection id="id78BE52E828B44822BD6ED54862AF8835"><enum>(b)</enum><header>Board of Directors</header><paragraph id="id33336DCA782E408C8A7FCB5AE8108594"><enum>(1)</enum><header>Appointments and removal</header><text>Section 112(b) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/33/4212">33 U.S.C. 4212(b)</external-xref>) is amended—</text><subparagraph id="id54DE18C428E745849B828C57F9EF665E"><enum>(A)</enum><text>in paragraph (1), in the matter preceding subparagraph (A), by inserting <quote>and such other criteria as the Under Secretary may establish</quote> after <quote>subsection (a)</quote>; </text></subparagraph><subparagraph id="id21069BB8661D4DDD91573CBF725C361A"><enum>(B)</enum><text>in paragraph (5), by inserting <quote>the Administrator of the United States Agency for International Development,</quote> after <quote>Service,</quote>; </text></subparagraph><subparagraph id="idF5002603EE704B4E9A2BC7AD3A2680B6"><enum>(C)</enum><text>by redesignating subparagraphs (2) through (5) as subparagraphs (3) through (6), respectively; and</text></subparagraph><subparagraph id="idAF507B4C028F4EDDB631E7A6CD6F89B8"><enum>(D)</enum><text>by inserting after paragraph (1) the following: </text><quoted-block id="id56CEA53E05A143A6875904367DD30519" style="OLC" act-name=""><paragraph id="id24D59C71BEB840A494F398B6D24CA403"><enum>(2)</enum><header>Recommendations of Board regarding appointments</header><text>For appointments made under paragraph (1) other than the initial appointments, the Board shall submit to the Under Secretary recommendations on candidates for appointment.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="idEE9E72175A3E464CBF46A4658F9ABC16" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header>General powers</header><text>Section 112(g) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/33/4212">33 U.S.C. 4212(g)</external-xref>) is amended—</text><subparagraph commented="no" display-inline="no-display-inline" id="idB0EC5094538D40E898E16BF9B6E1DEC6"><enum>(A)</enum><text>in paragraph (1)(A), by striking <quote>officers and employees</quote> and inserting <quote>the initial officers and employees of the Board</quote>; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id23EA2BEC707D451C947EBBF50B981B25"><enum>(B)</enum><text>in paragraph (2)(B)(i), by striking <quote>chief operating officer</quote> and inserting <quote>chief executive officer</quote>. </text></subparagraph></paragraph><paragraph display-inline="no-display-inline" commented="no" id="id18CA2F22AEA14BF28D08F62698021D58"><enum>(3)</enum><header>Chief executive officer</header><text>Section 112 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/33/4212">33 U.S.C. 4212</external-xref>) is amended by adding at the end the following: </text><quoted-block id="idBDBD19727C2A40698F53050D5A4F675C" style="OLC" act-name=""><subsection id="idA842D0173E384C8280EE2F8CD37B8532"><enum>(h)</enum><header>Chief executive officer</header><paragraph id="idCC05051FDE7648D2842A05DF5D1C68C2"><enum>(1)</enum><header>Appointment; removal; review</header><text>The Board shall appoint and may remove and review the performance of the chief executive officer of the Board.</text></paragraph><paragraph id="id5235AD89E7AF413FB5BACE77D1392D2A"><enum>(2)</enum><header>Powers</header><text>The chief executive officer of the Board may appoint, remove, and review the performance of any officer or employee of the Foundation.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id78A2AD001619431992A7195FBEEA9F90"><enum>(c)</enum><header>Powers of Foundation</header><text>Section 113(c)(1) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/33/4213">33 U.S.C. 4213(c)(1)</external-xref>) is amended, in the matter preceding subparagraph (A)—</text><paragraph id="id472A7E665E5B49699C0315A6295BF7AF"><enum>(1)</enum><text>by inserting <quote>nonprofit</quote> before <quote>corporation</quote>; and </text></paragraph><paragraph id="id62F0DCBA991E4B6A95F841FCACDD8E4C" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text>by striking <quote>acting as a trustee</quote> and inserting <quote>formed</quote>. </text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id49CB2827677B4D4B9AC242890DF4020A"><enum>(d)</enum><header>Principal office</header><text>Section 113 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/33/4213">33 U.S.C. 4213</external-xref>) is amended by adding at the end the following: </text><quoted-block id="id5BC2862687AF4381B38B65B96A64D00E" style="OLC" act-name=""><subsection id="idC9130FAA063844BA88BDFD813EDE107E"><enum>(g)</enum><header>Principal office</header><text>The Board may locate the principal office of the Foundation outside the District of Columbia and is encouraged to locate that office in a coastal State.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idA6806916AFE442AC961A4DCA5A7C2F6D"><enum>(e)</enum><header>Use of funds</header><text>Section 118 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/33/4218">33 U.S.C. 4218</external-xref>) is amended—</text><paragraph id="id1EC6C8A2E2464DEB9016A488A15562AC"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="idC9492522EE5B47B881DC95AF9D853E8E"><enum>(A)</enum><text>in paragraph (2), by striking <quote>and State and local government agencies</quote> and inserting <quote>, State and local government agencies, United States and international nongovernmental organizations, regional organizations, and foreign government entities</quote>; and</text></subparagraph><subparagraph id="idA0E35A20673440A6BBC2382AC6D78297"><enum>(B)</enum><text>in paragraph (3)—</text><clause id="idF3F1AB3E00614CDD8AF75BF8211902BE"><enum>(i)</enum><text>in the paragraph heading, by striking <quote><header-in-text style="OLC" level="paragraph">Prohibition</header-in-text></quote> and inserting <quote><header-in-text style="OLC" level="paragraph">Limitation</header-in-text></quote>; and</text></clause><clause id="id3AABE427CA264CC19B15AFA631EE48BE"><enum>(ii)</enum><text>by striking subparagraph (B) and inserting the following: </text><quoted-block id="id418E3D5FBCE04EDE8227254704712FE5" style="OLC" act-name=""><subparagraph id="id1184387788E7488381F256492A9039CB"><enum>(B)</enum><header>Salaries</header><text>The Foundation may use Federal funds described in subparagraph (A) to pay for salaries only during the 24-month period beginning on the date of the enactment of this Act. The Secretary shall not require reimbursement from the Foundation for any such Federal funds used to pay for such salaries.</text></subparagraph><after-quoted-block>; and </after-quoted-block></quoted-block></clause></subparagraph></paragraph><paragraph id="id3300BCD9AA534CCAB2FB180A2CD03E19"><enum>(2)</enum><text>in subsection (b)(2), by striking <quote>and State and local government agencies</quote> and inserting <quote>, State and local government agencies, United States and international nongovernmental organizations, regional organizations, and foreign government entities</quote>. </text></paragraph></subsection></section><section id="id6FC93A3D973B4785B355DE5CDBE0035A"><enum>3.</enum><header>Modifications to the Marine Debris Program of the National Oceanic and Atmospheric Administration</header><subsection id="id04398AD5C7184BD78B68C8A6B8BD45FA"><enum>(a)</enum><header>Grants, cooperative agreements, contracts, and other agreements</header><text>Section 3(d) of the Marine Debris Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1952">33 U.S.C. 1952(d)</external-xref>) is amended—</text><paragraph id="id8898F94648B140D09BC736217DC5B339"><enum>(1)</enum><text>in the subsection heading, by striking <quote><header-in-text style="OLC" level="subsection">and contracts</header-in-text></quote> and inserting <quote><header-in-text style="OLC" level="subsection">contracts, and other agreements</header-in-text></quote>; </text></paragraph><paragraph id="idA291456A204D41F6AC50C807647812E8"><enum>(2)</enum><text>in paragraph (1), by striking <quote>and contracts</quote> and inserting <quote>, contracts, and other agreements</quote>; </text></paragraph><paragraph id="id34D0AE79B4B84318918FAD729957DA6D"><enum>(3)</enum><text>in paragraph (2)—</text><subparagraph id="idAECA4689E9494EE487519D076388C8E3"><enum>(A)</enum><text>in subparagraph (B)—</text><clause id="idEC6FE7F1AAD441CB8745F0B419439597"><enum>(i)</enum><text>by striking <quote>part of the</quote> and inserting <quote>part of a</quote>; and </text></clause><clause id="id2930A8401B6B4F239682545D96D02C70"><enum>(ii)</enum><text>by inserting <quote>or (C)</quote> after <quote>subparagraph (A)</quote>; and </text></clause></subparagraph><subparagraph id="idFD6A2DC3AD4345CEAD930A2366C24497"><enum>(B)</enum><text>in subparagraph (C), in the matter preceding clause (i), by inserting <quote>and except as provided in subparagraph (B)</quote> after <quote>subparagraph (A)</quote>; and </text></subparagraph></paragraph><paragraph id="idFA28E521A8C94542900F99928DDDF251"><enum>(4)</enum><text>by adding at the end the following: </text><quoted-block id="id0CAF3F4093B545099E61573FCF4DE8C6" style="OLC" act-name=""><paragraph id="id47643BF401ED48F59B0BD77E0A2EED7B"><enum>(7)</enum><header>In-kind contributions</header><text>With respect to any project carried out pursuant to a contract or other agreement entered into under paragraph (1) that is not a cooperative agreement or an agreement to provide financial assistance in the form of a grant, the Administrator may contribute on an in-kind basis the portion of the costs of the project that the Administrator determines represents the amount of benefit the National Oceanic and Atmospheric Administration derives from the project.</text></paragraph><after-quoted-block>. </after-quoted-block></quoted-block></paragraph></subsection><subsection id="id6EE4D481042F44B5A0C2FA927657AF92"><enum>(b)</enum><header>Receipt and expenditure of funds; use of resources</header><text>Section 3 of the Marine Debris Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1952">33 U.S.C. 1952</external-xref>) is amended by adding at the end the following: </text><quoted-block id="id826FF1407F77471BB4FD5585E4AFAE1B" display-inline="no-display-inline" style="OLC" act-name=""><subsection id="id8B08D228C894495CA27672F1524879E5"><enum>(e)</enum><header>Receipt and expenditure of funds</header><text>In order to accomplish the purpose set forth in section 2, the Administrator, acting through the Program, may receive and, only to the extent provided in advance in appropriations Acts, expend funds made available by—</text><paragraph id="id03A83E3C9A3E40E897AD9107D9633119"><enum>(1)</enum><text>any department, agency, or instrumentality of the United States;</text></paragraph><paragraph id="id8E9B816693A142ABAEA54F6E98383769"><enum>(2)</enum><text>any State, local, or tribal government (or any political subdivision thereof);</text></paragraph><paragraph id="idA46CBCDF3C964038BE8CA7E95E2E310D"><enum>(3)</enum><text>any foreign government or international organization; </text></paragraph><paragraph id="idCAE7CF4D036E4E8FAAA6C12984D51D62"><enum>(4)</enum><text>any public or private organization; or </text></paragraph><paragraph id="id6217758917F543BCB1AF27C7BAF22E3B"><enum>(5)</enum><text>any individual. </text></paragraph></subsection><subsection id="idEC08F1276F4D4D3E8BC60610483901AD"><enum>(f)</enum><header>Use of resources</header><text>In order to accomplish the purpose set forth in section 2, the Administrator, acting through the Program, may use, with consent, with reimbursement, and subject to the availability of appropriations, the land, services, equipment, personnel, and facilities of—</text><paragraph id="idA39960FF6F7A47B884A27045CFC9D21E"><enum>(1)</enum><text>any department, agency, or instrumentality of the United States;</text></paragraph><paragraph id="id618215CC856649FE89B1A04ABE50F9E8"><enum>(2)</enum><text>any State, local, or tribal government (or any political subdivision thereof); </text></paragraph><paragraph id="id20467EB4592A436B98BA77B2AB1BCE6C"><enum>(3)</enum><text>any foreign government or international organization; </text></paragraph><paragraph id="id88608F98C61048E7B389F4705C471A03"><enum>(4)</enum><text>any public or private organization; or </text></paragraph><paragraph id="id8EF8D4F3D8B44FF38FA236E2EF63692A" commented="no" display-inline="no-display-inline"><enum>(5)</enum><text>any individual.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="id9209069B261443329F2ADB8D7679CAA8" changed="added" reported-display-style="italic"><enum>4.</enum><header>Best practices</header><text display-inline="no-display-inline">Section 113 of the Save Our Seas 2.0 Act (<external-xref legal-doc="usc" parsable-cite="usc/33/4213">33 U.S.C. 4213</external-xref>) (as amended by section 2(d)) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idA5F064C9D6B0430CAEC4A6A2E5DE6EE9" changed="added" reported-display-style="italic"><subsection id="idDE10615B837F4F04A920EE59692A6688"><enum>(h)</enum><header>Best practices</header><paragraph id="id2b28431dab3849b8b209431283a3d6dc"><enum>(1)</enum><header>Tribal government</header><text> In this paragraph, the term <term>Tribal government</term> means the recognized governing body of any Indian or Alaska Native tribe, band, nation, pueblo, village, community, component band, or component reservation individually identified (including parenthetically) in the list published most recently as of the date of enactment of the <short-title>Save Our Seas 2.0 Amendments Act</short-title> pursuant to section 104 of the Federally Recognized Indian Tribe List Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/5131">25 U.S.C. 5131</external-xref>).</text></paragraph><paragraph id="id8BC21E27204549DA82C84836339AD491"><enum>(2)</enum><header>Best practices</header><text>The Foundation shall develop and implement best practices for conducting outreach to Tribal governments and Indian Tribes. </text></paragraph><paragraph id="idC4E782BE49BC4B44AB693EE2A35981AE"><enum>(3)</enum><header>Requirements</header><text>The best practices developed under paragraph (2) shall—</text><subparagraph id="idD706DC35062B4E069CD58478269E70AD"><enum>(A)</enum><text>include a process to support technical assistance and capacity building to improve outcomes; and</text></subparagraph><subparagraph id="id91DA9DB797BE4E3D8C5C0FC67B9D2F62"><enum>(B)</enum><text>promote an awareness of programs and grants available under this Act.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body><endorsement><action-date date="20221215">December 15, 2022</action-date><action-desc>Reported with an amendment</action-desc></endorsement></bill>
