<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>2d Session</session><legis-num>S. 4313</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20220525">May 25, 2022</action-date><action-desc><sponsor name-id="S374">Mr. Cotton</sponsor> (for himself, <cosponsor name-id="S397">Mr. Braun</cosponsor>, and <cosponsor name-id="S350">Mr. Rubio</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To prohibit the use of the digital currency payment system operated by the Government of the People’s Republic of China, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Defending Americans from Authoritarian Digital Currencies Act</short-title></quote>.</text></section><section id="id18ba0ac1ad75409d8f48e7106e6f2436"><enum>2.</enum><header>Prohibition on apps supporting e-CNY financial technology in the United States</header><subsection id="id5ffd7b888a564b01ac47194fadd0b978"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id22002e6f1bff4bf383bf745b0c750964"><enum>(1)</enum><header>App</header><text>The term <term>app</term> means a software application or electronic service that may be run or directed by a user on a computer, a mobile device, or any other general purpose computing device.</text></paragraph><paragraph id="idee1e9212085149409a754a93f48979c9"><enum>(2)</enum><header>App store</header><text>The term <term>app store</term> means a publicly available website, software application, or other electronic service that distributes applications from third-party developers to users of a computer, a mobile device, or any other general purpose computing device.</text></paragraph><paragraph id="id428f9dffd54f47339a9fbbde94a510a3"><enum>(3)</enum><header>Covered company</header><text>The term <term>covered company</term> means any person that owns or controls an app store in the United States.</text></paragraph><paragraph id="idb54e68e2462144049af620c625aa99bf"><enum>(4)</enum><header>e-CNY</header><text>The term <term>e-CNY</term> means the official Digital Currency Electronic Payment system operated by the Government of the People’s Republic of China.</text></paragraph></subsection><subsection id="idbb18bc9db95e4c3f9010354da19667f8"><enum>(b)</enum><header>Prohibition</header><text>A covered company shall not—</text><paragraph id="idE5E2695F547042D9A984ADC6A94222D1"><enum>(1)</enum><text>support or enable transactions in e-CNY on its app store within the United States; or</text></paragraph><paragraph id="id3856889469C44639B7AE4E8EC0E9E0C0"><enum>(2)</enum><text>carry or support any app in its app store within the United States that supports or enables transactions in e-CNY.</text></paragraph></subsection></section></legis-body></bill>
