which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Personal Responsibility and Work Opportunity Reconciliation Act of 1996 to provide certain benefits to noncitizens, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H882DAEE6982E41B7BEB141AB8D5E4503"><section section-type="section-one" id="H37869DE9DF7D46D18744F4EA0AC3C4E4"><enum>1.</enum><header>Short titles</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Lifting Immigrant Families Through Benefits Access Restoration Act of 2022</short-title></quote> or the <quote><short-title>LIFT the BAR Act of 2022</short-title></quote>. </text></section><section id="HF6FCA177698042CFB816A19D614011E0"><enum>2.</enum><header>Availability of basic assistance to lawfully present noncitizens</header><subsection id="HACF70871C442440989ECA9A3C7B2DC31"><enum>(a)</enum><header>Elimination of arbitrary eligibility restrictions</header><paragraph id="id7284F38E92114C0290DAD924153ECDF6"><enum>(1)</enum><header>In general</header><text>Sections 402, 403, 411, 412, 421, and 422 of the Personal Responsibility and Work Opportunity Reconciliation Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/8/1612">8 U.S.C. 1612</external-xref>, 1613, 1621, 1622, 1631, and 1632) are repealed.</text></paragraph><paragraph id="id3DE34FB0C7EF41EE8A0836E1C4D4B790"><enum>(2)</enum><header>Conforming amendments</header><text>Title IV of the Personal Responsibility and Work Opportunity Reconciliation Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/8/1601">8 U.S.C. 1601 et seq.</external-xref>) is amended—</text><subparagraph id="id20C74232A4A44B459754BE5D88AB66DA"><enum>(A)</enum><text>in section 401(b)(5) (<external-xref legal-doc="usc" parsable-cite="usc/8/1611">8 U.S.C. 1611(b)(5)</external-xref>), by striking <quote>the program defined in section 402(a)(3)(A) (relating to the supplemental security income program)</quote> and inserting <quote>the Supplemental Security Income Program under title XVI of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1381">42 U.S.C. 1381 et seq.</external-xref>)</quote>;</text></subparagraph><subparagraph id="id6146C265F1874BF6A5D3C2FE6B8E9AC8"><enum>(B)</enum><text>in section 404(a) (<external-xref legal-doc="usc" parsable-cite="usc/8/1614">8 U.S.C. 1614(a)</external-xref>), by striking <quote>, 402, or 403</quote>;</text></subparagraph><subparagraph id="id409BB631B899432E8309B85234B50A80"><enum>(C)</enum><text>in section 413 (<external-xref legal-doc="usc" parsable-cite="usc/8/1625">8 U.S.C. 1625</external-xref>)—</text><clause id="id38E23CCCA9F1461DBC7EB0286C35E7CA"><enum>(i)</enum><text>by striking <quote>A State</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idCE1C1C9CF084403FBE5737C8A8D688CA"><subsection commented="no" display-inline="no-display-inline" id="ID0681DF9E82364A0EB8B150522861A4D9"><enum>(a)</enum><header display-inline="yes-display-inline">State or local public benefit defined</header><text>In this section, except as provided in paragraphs (2) and (3), the term <term>State or local public benefit</term>—</text><paragraph commented="no" display-inline="no-display-inline" id="id4B32E6D0A0CD40F3A0949391A2563072"><enum>(1)</enum><text>means—</text><subparagraph id="IDEFDE04989C7C4451B7F47359C259FCBB"><enum>(A)</enum><text>any grant, contract, loan, professional license, or commercial license provided by an agency of a State or local government or by appropriated funds of a State or local government; and</text></subparagraph><subparagraph id="ID770F944815484087B1637A73383A3F2A"><enum>(B)</enum><text>any retirement, welfare, health, disability, public or assisted housing, postsecondary education, food assistance, unemployment benefit, or any other similar benefit for which payments or assistance are provided to an individual, household, or family eligibility unit by an agency of a State or local government or by appropriated funds of a State or local government;</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDBD1A68C5D72C4897B9084019C9A2AB75"><enum>(2)</enum><text>shall not apply—</text><subparagraph id="ID50CD7D01DF27483BA3F2974B4BCAB81D"><enum>(A)</enum><text>to any contract, professional license, or commercial license for a nonimmigrant whose visa for entry is related to such employment in the United States, or to a citizen of a freely associated state, if section 141 of the applicable compact of free association approved in <external-xref legal-doc="public-law" parsable-cite="pl/99/239">Public Law 99–239</external-xref> or 99–658 (or a successor provision) is in effect;</text></subparagraph><subparagraph id="IDD08DEA07906A4AD1BC97B1548EEE395A"><enum>(B)</enum><text>with respect to benefits for an alien who as a work authorized nonimmigrant or as an alien lawfully admitted for permanent residence under the Immigration and Nationality Act qualified for such benefits and for whom the United States under reciprocal treaty agreements is required to pay benefits, as determined by the Secretary of State, after consultation with the Attorney General; or</text></subparagraph><subparagraph id="ID92032720A00540659A1B6E90E748B2E4"><enum>(C)</enum><text>to the issuance of a professional license to, or the renewal of a professional license by, a foreign national not physically present in the United States; and</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID928B4BBCF58E46519892A52DEF42711C"><enum>(3)</enum><text>does not include any Federal public benefit.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id046192DEB7964C8E90F02BA5AAFAAB9A"><enum>(b)</enum><header>Proof of eligibility requirement</header><text>A State</text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></clause><clause id="id779F3351D85540BAA421AFAA2EA55D33"><enum>(ii)</enum><text>in subsection (b), as redesignated, by striking <quote>(as defined in section 411(c))</quote>;</text></clause></subparagraph><subparagraph id="idAA91E42C22354D2BA511549396137F2E"><enum>(D)</enum><text>in section 432(d) (<external-xref legal-doc="usc" parsable-cite="usc/8/1642">8 U.S.C. 1642(d)</external-xref>), by striking <quote>(as defined in section 411(c))</quote> and inserting <quote>(as defined in section 413(a))</quote>;</text></subparagraph><subparagraph id="idF3EC2E6920504A7796688FF610B40995"><enum>(E)</enum><text>in section 435 (<external-xref legal-doc="usc" parsable-cite="usc/8/1645">8 U.S.C. 1645</external-xref>), by striking <quote>(as provided under section 403)</quote>; and</text></subparagraph><subparagraph id="idF7959A2BC2AA48849E7155D34F777D64"><enum>(F)</enum><text>in section 436 (<external-xref legal-doc="usc" parsable-cite="usc/8/1646">8 U.S.C. 1646</external-xref>)—</text><clause id="id862DEEF000F04DF2BEB4ECA324EB9860"><enum>(i)</enum><text>by striking <quote>the food stamp program (as defined in section 402(a)(3)(B))</quote> and inserting <quote>the supplemental nutrition assistance program established under the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2011">7 U.S.C. 2011 et seq.</external-xref>)</quote>; and</text></clause><clause id="id4717F00AE62C4DF7B957B14D9F32EC53"><enum>(ii)</enum><text>by striking <quote>the supplemental security income program (as defined in section 402(a)(3)(A))</quote> and inserting <quote>the Supplemental Security Income Program under title XVI of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1381">42 U.S.C. 1381 et seq.</external-xref>)</quote>.</text></clause></subparagraph></paragraph></subsection><subsection id="H5B33FC4436E64BC682D32719941AC299"><enum>(b)</enum><header>Qualified noncitizens</header><text>Title IV of the Personal Responsibility and Work Opportunity Reconciliation Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/8/1601">8 U.S.C. 1601 et seq.</external-xref>) is amended—</text><paragraph id="HAC5D58B0F3C2464E9E8EABA2C41A9655"><enum>(1)</enum><text>in the title header, by striking <quote><header-in-text level="title" style="OLC">Aliens</header-in-text></quote> and inserting <quote><header-in-text level="title" style="OLC">Noncitizens</header-in-text></quote>; </text></paragraph><paragraph id="H6E5220CB88824DB2A3349F3F9A00D225"><enum>(2)</enum><text>in the header of section 401—</text><subparagraph id="id1D1121BAE3E941ACABD59C8205A15F54"><enum>(A)</enum><text>by striking <quote><header-in-text style="OLC" level="section">Aliens</header-in-text></quote> and inserting <quote><header-in-text style="OLC" level="section">Noncitizens</header-in-text></quote>; and</text></paragraph><paragraph id="HF5F7FD3721CB420B8387299F4BD7F9FB"><enum>(9)</enum><text>by striking <quote>alien’s</quote> each place such term appears and inserting <quote>noncitizen’s</quote>.</text></paragraph></subsection><subsection id="H1D0B0382D7D54366821BAE4E72095599"><enum>(c)</enum><header>Access to basic services for lawfully residing noncitizens</header><text>Section 431 of the Personal Responsibility and Work Opportunity Reconciliation Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/8/1641">8 U.S.C. 1641</external-xref>) is amended—</text><paragraph id="H6CC9730AEA3B4B2CA426621BE8713C8A"><enum>(1)</enum><text>in subsection (b)—</text><subparagraph id="H0D1FCC8620B24E1D9F80C6E13C021D48"><enum>(A)</enum><text>in the header, by striking <quote><header-in-text level="subsection" style="OLC">qualified alien</header-in-text></quote> and inserting <quote><header-in-text level="subsection" style="OLC">qualified noncitizen</header-in-text></quote>; </text></subparagraph><subparagraph id="HEAD0C833C9E74DF29268491B9BFDEA4D"><enum>(B)</enum><text>by striking <quote>qualified alien</quote> and inserting <quote>qualified noncitizen</quote>;</text></subparagraph><subparagraph id="HF7A474CE2EB84EC3906883F5DADAA768"><enum>(C)</enum><text>by striking <quote>alien</quote> and inserting <quote>noncitizen</quote>;</text></subparagraph><subparagraph id="H36A8E4F864104EBD8C12FF77426BF315"><enum>(D)</enum><text>by striking <quote>an alien</quote> and inserting <quote>a noncitizen</quote>; and</text></subparagraph><subparagraph id="H2CE0F79AA2BB486585281800D8BCB7DF"><enum>(E)</enum><text>by striking <quote>benefit</quote> and all that follows through the period at the end of the subsection and inserting <quote>benefit, is lawfully present in the United States.</quote>;</text></subparagraph></paragraph><paragraph id="H655F148DFEE343A1A1D64F0336768411"><enum>(2)</enum><text>in subsection (c)—</text><subparagraph id="HD4516C0ACEFF405E9D64CBC119C6CF31"><enum>(A)</enum><text>in the header, by striking <quote><header-in-text level="subsection" style="OLC">qualified aliens</header-in-text></quote> and inserting <quote><header-in-text level="subsection" style="OLC">qualified noncitizens</header-in-text></quote>; </text></subparagraph><subparagraph id="H8CC7B3004069424D9F5E62F0E58C76EC"><enum>(B)</enum><text>in paragraph (3), by striking <quote>or</quote> after the semicolon;</text></subparagraph><subparagraph id="H1A639EC12A7E4EEC90EA924CB378B083"><enum>(C)</enum><text>in paragraph (4), by striking the period at the end and inserting <quote>; or</quote>; and</text></subparagraph><subparagraph id="H9D54EB13A4134DFAB390C06B6958BC3C"><enum>(D)</enum><text>by inserting after paragraph (4) the following:</text><quoted-block style="OLC" id="H2BE21B2FA07941539CD3A79335A13E6A"><paragraph id="H4BB14CE3AF544D05A4CD4B29B8AA234D"><enum>(5)</enum><text>a noncitizen—</text><subparagraph id="H446536A957644F76992DB87CEB3B4878"><enum>(A)</enum><text>in a category that was treated as lawfully present for purposes of section 1101 of the Patient Protection and Affordable Care Act of 2010 (<external-xref legal-doc="usc" parsable-cite="usc/42/18001">42 U.S.C. 18001</external-xref>);</text></subparagraph><subparagraph id="H71EEF7CBA78F40ACB337BA1E6893936E"><enum>(B)</enum><text>who met the requirements of section 402(a)(2)(D) of the Personal Responsibility and Work Opportunity Reconciliation Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/8/1612">8 U.S.C. 1612(a)(2)(D)</external-xref>) on or before January 1, 2021;</text></subparagraph><subparagraph id="HE830BC98294243E7BDEC7E0E43EE82BC"><enum>(C)</enum><text>who is granted special immigrant juvenile status as described by section 101(a)(27)(J) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(27)(J)</external-xref>);</text></subparagraph><subparagraph id="H1E2BBBC767FA4E689C860B6495857CAC"><enum>(D)</enum><text display-inline="yes-display-inline">who has a pending, bona fide application for nonimmigrant status under section 101(a)(15)(U) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(1)(15)(U)</external-xref>); </text></subparagraph><subparagraph id="H269242E439E54A8ABB3751D71B7FCF72"><enum>(E)</enum><text>who was granted relief under the Deferred Action for Childhood Arrivals program; or</text></subparagraph><subparagraph id="H777D919E83014E3197215C97F8B0A2F6"><enum>(F)</enum><text>any other person who is not a citizen of the United States but who resides in a State or territory of the United States and is federally authorized to be present in the United States.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H60FD672532D849E6A428DBFAFE4A2149"><enum>(3)</enum><text>by adding at the end the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="HB63BBFD671A2449295764171CD1DE804"><subsection id="H4A446284FD5E448DAE90A47B5C3AFAC9"><enum>(d)</enum><header>Noncitizen</header><text display-inline="yes-display-inline">In this title, the term <term>noncitizen</term> means any individual who is not a citizen of the United States.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HD506445AB06D43FF98971A475268F385"><enum>(d)</enum><header>Child nutrition programs</header><text>Section 742 of the Personal Responsibility and Work Opportunity Reconciliation Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/8/1615">8 U.S.C. 1615</external-xref>) is amended—</text><paragraph id="HB7ACA618DE754970AE2EF87646C5AB26"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="H1680946655724D12A9223C75D4A28F72"><enum>(A)</enum><text>in the header by striking <quote><header-in-text level="subsection" style="OLC">School lunch and breakfast programs</header-in-text></quote> and inserting <quote><header-in-text level="subsection" style="OLC">Child nutrition programs</header-in-text></quote>;</text></subparagraph><subparagraph id="HE2BAB663612F41789BE1BDB2E74A97BC"><enum>(B)</enum><text>by striking <quote>the school lunch program</quote> and inserting <quote>any program</quote>; and</text></subparagraph><subparagraph id="H876B1623606044A1A14953C36DAF3413"><enum>(C)</enum><text>by striking <quote>the school breakfast program under section 4 of the</quote> and inserting <quote>any program under</quote>; and</text></subparagraph></paragraph><paragraph id="H3C65EF01D93249AC98589E02475E75DD"><enum>(2)</enum><text>in subsection (b)(1)—</text><subparagraph id="HF8D27E58C8CE4B6AAC56AD9ECB56CBAB"><enum>(A)</enum><text>by striking <quote>Nothing in this Act shall prohibit or require a State to provide to an individual who is not a citizen or a qualified alien, as defined in section 431(b),</quote> and inserting <quote>A State shall not deny</quote>; and</text></subparagraph><subparagraph id="HBC3BB2E70E714A6BB743495552963E67"><enum>(B)</enum><text>by striking <quote>paragraph (2)</quote> and inserting <quote>paragraph (2) on the basis of an individual’s citizenship or immigration status</quote>. </text></subparagraph></paragraph></subsection><subsection commented="no" id="HC2CC1403025C4FFA8C2F658FC02A1AF3"><enum>(e)</enum><header>Exclusion of medical assistance expenditures for citizens of freely associated States</header><text>Section 1108(h) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1308">42 U.S.C. 1308(h)</external-xref>) is amended—</text><paragraph commented="no" id="HD077D456A2E24D5F871979C41A6FDB3F"><enum>(1)</enum><text>by striking <quote>Expenditures</quote> and inserting:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H89CDF7C170934C7A97DB087B927530A2"><paragraph commented="no" id="H6570E70BB0464BEA971422FFE2F0937F"><enum>(1)</enum><text display-inline="yes-display-inline">Expenditures</text></paragraph><after-quoted-block>; and </after-quoted-block></quoted-block></paragraph><paragraph commented="no" id="H74536CEEB7CB4EB381524102B4690B5B"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H0F4D77ABF77049428B10C169FCB1CBE9"><paragraph commented="no" id="H57DB79123B2F4A64A14E0129642F5600"><enum>(2)</enum><text display-inline="yes-display-inline">With respect to eligibility for benefits for the designated Federal program defined in paragraph (3)(C) (relating to the Medicaid program), paragraph (1) shall not apply to any individual who lawfully resides in 1 of the 50 States or the District of Columbia in accordance with the Compacts of Free Association between the Government of the United States and the Governments of the Federated States of Micronesia, the Republic of the Marshall Islands, and the Republic of Palau and shall not apply, at the option of the Governor of Puerto Rico, the Virgin Islands, Guam, the Northern Mariana Islands, or American Samoa as communicated to the Secretary of Health and Human Services in writing, to any individual who lawfully resides in the respective territory in accordance with such Compacts.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H1BFAF47BB6D044DF89C634D269F47921"><enum>(f)</enum><header>Child health insurance program</header><text display-inline="yes-display-inline">Section 2107(e)(1) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1397gg">42 U.S.C. 1397gg(e)(1)</external-xref>) is amended—</text><paragraph id="HA440996233B04535B98C9003B70D29F3"><enum>(1)</enum><text>by striking subparagraph (O); and </text></paragraph><paragraph id="HC88E951D3BE940BF9640E825E213978B"><enum>(2)</enum><text display-inline="yes-display-inline">by redesignating subparagraphs (P), (Q), (R), (S), (T), and (U) as subparagraphs (O), (P), (Q), (R), (S), and (T). </text></paragraph></subsection><subsection id="H9D01DD3491404296862F850A09C0F340"><enum>(g)</enum><header>Conforming amendments</header><paragraph id="H59F7EC37DF504FAEA46CB7026A8ABC4E"><enum>(1)</enum><header>Supplemental food assistance program</header><text>The Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2011">7 U.S.C. 2011 et seq.</external-xref>) is amended—</text><subparagraph id="H798106E2C7674D1DA9761C9FDFE5A9B1"><enum>(A)</enum><text>in section 5 (<external-xref legal-doc="usc" parsable-cite="usc/7/2014">7 U.S.C. 2014</external-xref>)—</text><clause id="HBDDDE9E7B54C418098F46CDBEE7305DD"><enum>(i)</enum><text>by striking subsection (i); and </text></clause></subparagraph><subparagraph commented="no" id="HE56C9E14E2A945E1839617B1192A5C02"><enum>(C)</enum><text display-inline="yes-display-inline">in section 11(e)(2)(B)(v)(II) by striking <quote>aliens</quote> each place it appears and inserting <quote>noncitizens</quote>. </text></subparagraph></paragraph><paragraph id="HCDA2DB99E99F4BC49ACEA5DE85450F93"><enum>(2)</enum><header>Medicaid</header><text>Section 1903(v) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396b">42 U.S.C. 1396b(v)</external-xref>) is amended—</text><subparagraph id="HD418D89B682B477482B15718CE7824D6"><enum>(A)</enum><text>in paragraph (1), by striking <quote>admitted for</quote> and all that follows through the end of the paragraph and inserting <quote>present in the United States.</quote>; and</text></subparagraph><subparagraph id="H99055CE9111D4402A7189D1D312CDE53"><enum>(B)</enum><text>striking paragraph (4).</text></subparagraph></paragraph><paragraph id="HCF7ED6DC6088429BAFA8CA9E719112E0"><enum>(3)</enum><header>Housing assistance</header><text>Section 214(a) of the Housing and Community Development Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/1436a">42 U.S.C. 1436a(a)</external-xref>) is amended by—</text><subparagraph id="H48FF3E6EFDB842049C4A9EB94982540B"><enum>(A)</enum><text>redesignating paragraphs (6) and (7) as paragraphs (7) and (8), respectively; and</text></subparagraph><subparagraph id="H5653CB156E3E40F4ABFA22E1D446DD58"><enum>(B)</enum><text>inserting after paragraph (5):</text><quoted-block style="OLC" id="H0174B86641C84C80A4180F0E4367F0F1"><paragraph id="H5E835BBBD7724E448340A9D201ECB1D3"><enum>(6)</enum><text>a qualified noncitizen as defined in section 431 of the Personal Responsibility and Work Opportunity Reconciliation Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/8/1641">8 U.S.C. 1641</external-xref>);</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HD4380F459B524015A3D73D4E7B45A507"><enum>(4)</enum><header>Assistance not treated as debt absent fraud</header><text>Section 213A of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1183a">8 U.S.C. 1183a</external-xref>) is amended—</text><subparagraph id="idF6CDCDF133CA42B7936D98517BCFA46C"><enum>(A)</enum><text>in subsection (a)(3)—</text><clause id="id5FFDF7B2A54546CFBDE7C93AF539D6C1"><enum>(i)</enum><text>in subparagraph (A), by striking <quote>(as provided under section 403 of the Personal Responsibility and Work Opportunity Reconciliation Act of 1996)</quote>; and</text></clause><clause id="id703ADC9CBD69434A81B3C866A0A47FD5"><enum>(ii)</enum><text>in subparagraph (B), in the undesignated matter following clause (ii), by striking <quote>(as provided under section 403 of the Personal Responsibility and Work Opportunity Reconciliation Act of 1996)</quote>; and</text></clause></subparagraph><subparagraph id="idBC214002874C471FA2FDC028D32E8BDF"><enum>(B)</enum><text>in subsection (b)(1)(A) is amended by striking <quote>benefit,</quote> and inserting <quote>benefit by fraud,</quote>.</text></subparagraph></paragraph></subsection><subsection commented="no" id="HD7C96510F1E948299283DAA2760E7DB0"><enum>(h)</enum><header>Preserving access to health care</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/36B">Section 36B(c)(1)(B)</external-xref> of the Internal Revenue Code of 1986 is amended to read as follows: </text><quoted-block style="OLC" display-inline="no-display-inline" id="H370DA5A037D24AC989124337ECEF899D"><subparagraph commented="no" id="HBF503BFD4EEF4E4DA48645BF1E5E3FA8"><enum>(B)</enum><header>Special rule for certain individuals lawfully present in the United States</header><text display-inline="yes-display-inline">If—</text><clause commented="no" id="HF4904005EFF045FF97654873167FAC24"><enum>(i)</enum><text display-inline="yes-display-inline">a taxpayer has a household income which is not greater than 100 percent of an amount equal to the poverty line for a family of the size involved,</text></clause><clause commented="no" id="H49955887B91E4088A4885792858DD66F"><enum>(ii)</enum><text display-inline="yes-display-inline">the taxpayer is a noncitizen lawfully present in the United States,</text></clause><clause commented="no" id="HD28E23A5B8054E73B3FC48C79E97BB35"><enum>(iii)</enum><text display-inline="yes-display-inline">the taxpayer is ineligible for minimum essential coverage under section 5000A(f)(1)(A)(ii), and</text></clause><clause commented="no" id="H3A827FADB10649F49F4B44EE1C18F8D0"><enum>(iv)</enum><text display-inline="yes-display-inline">under the Medicaid eligibility criteria for noncitizens in effect on December 26, 2020, the taxpayer would be ineligible for such minimum essential coverage by reason of the taxpayer’s immigration status, </text></clause><continuation-text commented="no" continuation-text-level="subparagraph">the taxpayer shall, for purposes of the credit under this section, be treated as an applicable taxpayer with a household income which is equal to 100 percent of the poverty line for a family of the size involved.</continuation-text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section commented="no" id="H9B54FB2901B7423AB158490BDF7BF6A8"><enum>3.</enum><header>Federal agency guidance</header><text display-inline="no-display-inline">Not later than 180 days after the date of the enactment of this Act, each Federal agency affected by any of the amendments made by this Act shall issue guidance with respect to the implementation of such amendments.</text></section><section id="H5B5B75E2B9874A17A629F2854591C042"><enum>4.</enum><header>Effective date</header><text display-inline="no-display-inline">The amendments made by this Act—</text><paragraph id="idB16F6E0A3A1447BE93DA9633F00C3B37"><enum>(1)</enum><text display-inline="yes-display-inline">shall take effect on the date of the enactment of this Act; and </text></paragraph><paragraph id="id2C78BE04BF214886AA44240D8695145A"><enum>(2)</enum><text display-inline="yes-display-inline">shall apply to services furnished on or after the date that is 180 days after the date on which any guidance is issued pursuant to section 3.</text></paragraph></section></legis-body></bill>
