which was read twice and referred to the <committee-name committee-id="SSEV00">Committee on Environment and Public Works</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To direct the Secretary of Transportation to establish a grant program for projects to strengthen and protect vulnerable infrastructure used during mass evacuations, and for other purposes. </official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="id5ec50b78cdf144b2a8f370bdb88b8f03"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Enhancing the Strength and Capacity of America's Primary Evacuation routes Act</short-title></quote> or the <quote><short-title>ESCAPE Act</short-title></quote>.</text></section><section section-type="subsequent-section" id="id56A794D5951B432E9CE97C01937DE9A0"><enum>2.</enum><header>Evacuation route program</header><subsection id="id898c577f259a46b1aea5ee14e3541ca2"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id9e34e199d61a4878a6bcf678b110a543"><enum>(1)</enum><header>Evacuation route</header><text>The term <term>evacuation route</term> means a route that—</text><subparagraph id="idcd0b429a6f324349a07358240c679c79"><enum>(A)</enum><text>is owned, operated, or maintained by a Federal, State, Tribal, or local government or a private entity;</text></subparagraph><subparagraph id="id84704b1748414e8e9bfbbc336edf9dfa"><enum>(B)</enum><text>is used—</text><clause id="idAF794D4BC8864E4EACA5C3EE7C440165"><enum>(i)</enum><text>to transport the public away from an emergency event (as defined in section 667.3 of title 23, Code of Federal Regulations (or successor regulations)) that is anticipated, reasonably likely, ongoing, or past; or</text></clause><clause id="id180A0C317E3D4F5A9370F3DAA45A1ABA"><enum>(ii)</enum><text>to transport emergency responders and recovery resources;</text></clause></subparagraph><subparagraph id="ide4a94fee9b1c4129a8334ef2134ec1fa"><enum>(C)</enum><text>is designated by the State in which the route is located (or in the case of a federally owned route, the head of the Federal agency with jurisdiction over the route) for the purposes described in subparagraph (B); and</text></subparagraph><subparagraph id="id7201BEB95B304C1BA48B2C79073EBEC6"><enum>(D)</enum><text>meets the criteria for a mass evacuation route pursuant to subsection (b)(1).</text></subparagraph></paragraph><paragraph id="idfb4d346d04f842bdb0fbbf632fb14c45"><enum>(2)</enum><header>Program</header><text>The term <term>program</term> means the competitive grant program established under subsection (c)(1).</text></paragraph><paragraph id="idb992373c7e8e4afaaa0ed30015676150"><enum>(3)</enum><header>Resilience project</header><text>The term <term>resilience project</term> means a project—</text><subparagraph id="id08ff3911a59d447196daf14f0b3051a6"><enum>(A)</enum><text>with the ability to anticipate, prepare for, and adapt to changing conditions and withstand, respond to, and recover rapidly from disruptions; and</text></subparagraph><subparagraph id="id2179fdc62b12486693f4295e60112942"><enum>(B)</enum><text>designed and built to address current and future vulnerabilities to an evacuation route due to—</text><clause id="idbc834663cd0943809b7d787fc172401e"><enum>(i)</enum><text>future occurrence or recurrence of emergency events (as defined in section 667.3 of title 23, Code of Federal Regulations (or successor regulations)) that are likely to occur in the geographic area in which the evacuation route is located; or</text></clause><clause id="id5d80ccc45cd348d39248de3280786755"><enum>(ii)</enum><text>projected changes in development patterns, demographics, or extreme events based on the best available evidence and analysis.</text></clause></subparagraph></paragraph><paragraph id="idbc69cb556f994ae0ae6f66e4766c4809"><enum>(4)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Transportation.</text></paragraph></subsection><subsection id="id3FE07750B7394E5F8D1BDAC5D73F7821"><enum>(b)</enum><header>Establishment of mass evacuation route criteria</header><paragraph id="idE1EA3BE8EA9F4927B320B663B9F769F8"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary, in consultation with the Administrator of the Federal Emergency Management Agency, State departments of transportation, metropolitan planning organizations, and other stakeholders, shall establish criteria for eligible entities described in subsection (f) to identify mass evacuation routes.</text></paragraph><paragraph id="idE90CB1B3574E4688B1FB85513008F527"><enum>(2)</enum><header>Requirements</header><text>In carrying out paragraph (1), the Secretary shall—</text><subparagraph id="id71D9F278BFE043169E73F4F7DA362264"><enum>(A)</enum><text>provide a period of not less than 90 days for State departments of transportation, metropolitan planning organizations, other stakeholders, and the public to comment on the criteria proposed by the Secretary under that paragraph; and</text></subparagraph><subparagraph id="idCD00E6C525014C8098CAEC829D3AB28B"><enum>(B)</enum><text>take into consideration any comments received pursuant to subparagraph (A).</text></subparagraph></paragraph></subsection><subsection id="id4a9a85388fbe41e697d82999a07d1e95"><enum>(c)</enum><header>Establishment of program</header><paragraph id="ide46706c72c5142929f5efb151b4717d5"><enum>(1)</enum><header>In general</header><text>The Secretary (in consultation with the Administrator of the Federal Emergency Management Agency for the purposes described in paragraph (2)) shall establish a competitive grant program to provide grants for resilience projects that strengthen and protect evacuation routes that are essential for providing and supporting mass evacuations caused by emergency events (as defined in section 667.3 of title 23, Code of Federal Regulations (or successor regulations)).</text></paragraph><paragraph id="id04A5ACA4D6E54BF1849C5AB595C4A401"><enum>(2)</enum><header>Consultation</header><text>In carrying out the program, the Secretary shall consult with the Administrator of the Federal Emergency Management Agency for the purpose of providing technical assistance to the Secretary and to applicants.</text></paragraph></subsection><subsection id="idadf0b8b158b34a8e975212e36643cab1"><enum>(d)</enum><header>Eligible resilience projects</header><text>The Secretary shall provide grants under this section to resilience projects—</text><paragraph id="idE2B040EBD31C40F0900839914A4B4258"><enum>(1)</enum><text>described in subsection (e); and</text></paragraph><paragraph id="idB052273F9C6D4C15A78328233166C913"><enum>(2)</enum><text>that—</text><subparagraph id="id6208b1016a974c9ca73c3f29d396423e"><enum>(A)</enum><text>ensure the ability of the evacuation route to provide safe passage during a mass evacuation and reduce the risk of damage to evacuation routes as a result of future emergency events (as defined in section 667.3 of title 23, Code of Federal Regulations (or successor regulations)), including—</text><clause id="ida083bae7dddd458698719b7063d182d4"><enum>(i)</enum><text>restoring or replacing existing mass evacuation routes that are classified as being in poor condition or do not meet current geometric standards;</text></clause><clause id="idD2D0610DE7A74725811865200D5956A7"><enum>(ii)</enum><text>protecting, elevating, or relocating assets that are located in a base floodplain;</text></clause><clause id="id0d1e3ad4d5c041cf83982b04b7e7e94e"><enum>(iii)</enum><text>protecting assets vulnerable to high winds;</text></clause><clause id="id8e7b93b14e78457389edbaf840bb1f54"><enum>(iv)</enum><text>installing mitigation measures that prevent the intrusion of floodwaters into transportation systems;</text></clause><clause id="idd7ee941912444e1bb56b986a966932b3"><enum>(v)</enum><text>strengthening systems that remove rainwater from transportation facilities or services; or</text></clause><clause id="id80f02370ca114f84bf8936e7d966b43f"><enum>(vi)</enum><text>other resilience projects that address identified vulnerabilities;</text></clause></subparagraph><subparagraph id="idbb8f3b2d865f4a84a6b3f6cab11177ec"><enum>(B)</enum><text>if the Secretary determines that existing evacuation routes are not sufficient to adequately facilitate mass evacuations, expand the capacity of evacuation routes to swiftly and safely accommodate mass evacuations and provide mobility for emergency responders and recovery resources, including installation of—</text><clause id="id47e180fbe2d54880b4682a2705e281c6"><enum>(i)</enum><text>communications and intelligent transportation system equipment and infrastructure;</text></clause><clause id="idddc5dfe37ddb428f836223fd46af088a"><enum>(ii)</enum><text>counterflow measures; or</text></clause><clause id="idc59a5cbf184e4ea7b74fd00143f0d0aa"><enum>(iii)</enum><text>shoulders;</text></clause></subparagraph><subparagraph id="id54ff4c2a56474c5dba9dec38c4a79fe8"><enum>(C)</enum><text>are for the construction of—</text><clause id="id8D4F9347160244088C293784D87A606E"><enum>(i)</enum><text>new or redundant evacuation routes, if the Secretary determines that existing evacuation routes are not sufficient to adequately facilitate mass evacuations, emergency response, or recovery efforts; or</text></clause><clause id="id86fc9c09b0ff40209a9a8f277bbce439"><enum>(ii)</enum><text>sheltering facilities; or</text></clause></subparagraph><subparagraph id="id895ebd3a83744f34ba7f34e6b24298e5"><enum>(D)</enum><text>involve planning and acquisition, including—</text><clause id="id87d55b9dad80488989aed36f01554cb6"><enum>(i)</enum><text>mass evacuation planning and preparation, such as—</text><subclause id="id15ADD92175484872828C55D93CB984B6"><enum>(I)</enum><text>coordination with Federal agencies and departments, agencies and departments within the State, first responders, and other States;</text></subclause><subclause id="idE94D11F89A0D4B43BB321096D79F2A67"><enum>(II)</enum><text>identification of evacuation routes;</text></subclause><subclause id="idF098B169DC364AD0983E89355A08878F"><enum>(III)</enum><text>evacuation route education and awareness campaigns;</text></subclause><subclause id="id6322BDD7BE5247329A22D3D168839C63"><enum>(IV)</enum><text>traffic analysis and monitoring; or</text></subclause><subclause id="idC6B7C5DC532242E9906EBEC246A726FD"><enum>(V)</enum><text>data sharing;</text></subclause></clause><clause id="id0aac936aadbe4549b7767602fa9bcb06"><enum>(ii)</enum><text>acquisition of evacuation route and traffic incident management equipment and vehicles;</text></clause><clause id="idc2ef7d3a5bcf4cbba1cbd82d078cf0f4"><enum>(iii)</enum><text>evacuation route risk assessment;</text></clause><clause id="idfdc80dc03668409dad7150441f6f3f58"><enum>(iv)</enum><text>development of enhanced mass evacuation response capabilities;</text></clause><clause id="id6BB09063D306488E930FA2FE915A9ABF"><enum>(v)</enum><text>evacuation route signage; or</text></clause><clause id="idf995f6d19ac043d586895b10388ec4f0"><enum>(vi)</enum><text>equipment for pedestrian movement.</text></clause></subparagraph></paragraph></subsection><subsection id="id7b02804764724f27b7cb601fe29c2fe0"><enum>(e)</enum><header>Eligible projects</header><text>The Secretary may make a grant under this section only for a project that is—</text><paragraph id="id44254DFEA8BB49C8BDC84F1745FE7264"><enum>(1)</enum><text>an evacuation route;</text></paragraph><paragraph id="idAFC59C3F8E814D8C8ADAD01AB886E32E"><enum>(2)</enum><text>a project eligible for assistance under title 23, United States Code;</text></paragraph><paragraph id="id00DA535690174866BD0D77896CCE486C"><enum>(3)</enum><text>a public transportation facility or service eligible for assistance under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/53">chapter 53</external-xref> of title 49, United States Code;</text></paragraph><paragraph id="id04865E0E58E840AF9FCECF63529DF850"><enum>(4)</enum><text>a facility or service for intercity rail passenger transportation (as defined in section 24102 of title 49, United States Code);</text></paragraph><paragraph id="idA0D4C5F612C746BC84B2E3E45E36D208"><enum>(5)</enum><text>a port facility, including a facility that—</text><subparagraph id="id8B20838A6EEB440BBDBF7952C5404753"><enum>(A)</enum><text>connects a port to other modes of transportation;</text></subparagraph><subparagraph id="idAE5FC8398C484F5C8644D21D52B8B343"><enum>(B)</enum><text>improves the efficiency of mass evacuations and disaster relief; or</text></subparagraph><subparagraph id="idF165F3F23BC94B4EAFC075396D322C38"><enum>(C)</enum><text>aids transportation;</text></subparagraph></paragraph><paragraph id="id43C93F3ACCD9412BBFCE249AE5C83727"><enum>(6)</enum><text>a public-use airport (as defined in section 47102 of title 49, United States Code) that is included in the national plan of integrated airport systems developed by the Federal Aviation Administration under section 47103 of title 49, United States Code; or</text></paragraph><paragraph id="id0ED0476E1AEE42F6B7F893691E62992E"><enum>(7)</enum><text>a route owned, operated, or maintained by the Corps of Engineers.</text></paragraph></subsection><subsection id="ide67ae0bcbf734f8ea3d5b9deeae1cea4"><enum>(f)</enum><header>Eligible entities</header><text>The Secretary may award a grant under this section to any of the following:</text><paragraph id="ide6ff71d5e5e84ea5bc40535d58714437"><enum>(1)</enum><text>A State.</text></paragraph><paragraph id="id106d7aac7dbd45f3b45410b5eb3aeebf"><enum>(2)</enum><text>A metropolitan planning organization that serves an urbanized area (as defined by the Bureau of the Census) with a population of more than 200,000 individuals.</text></paragraph><paragraph id="id4b8cd75888634a66a105b5aae596c202"><enum>(3)</enum><text>A unit of local government.</text></paragraph><paragraph id="idcfac1fdf223b4216af8c41580ef3202d"><enum>(4)</enum><text>A political subdivision of a State or local government.</text></paragraph><paragraph id="id922710de4576479aaca8b6a84def9837"><enum>(5)</enum><text>A special purpose district or public authority with a transportation function, including a port authority.</text></paragraph><paragraph id="idb906a0609e86482d9891e29aa66e27c0"><enum>(6)</enum><text>A Federal land management agency that applies jointly with a State or group of States.</text></paragraph><paragraph id="id762bdf45bc1942baa29aaa6bce0ba358"><enum>(7)</enum><text>A Tribal government or a consortium of Tribal governments.</text></paragraph><paragraph id="id3d60707685e54a2db5d4fe9fd3e7b411"><enum>(8)</enum><text>A multistate or multijurisdictional group of entities described in paragraphs (1) through (7).</text></paragraph></subsection><subsection id="id6fa26aa26e0c4ce484c41f4fc234131f"><enum>(g)</enum><header>Applications</header><text>To be eligible to receive a grant under this section, an eligible entity shall submit to the Secretary an application in such form, at such time, and containing such information as the Secretary determines to be necessary.</text></subsection><subsection id="id2569fce25b46411880b8e4dab7c7b61d"><enum>(h)</enum><header>Criteria</header><text>In selecting resilience projects to receive grants under the program, the Secretary shall consider—</text><paragraph id="id630cd5f510c243889c39687427a7d175"><enum>(1)</enum><text>the cost of the project compared to the risk of recurring damage and the cost of future repairs, taking into account current and future emergency events (as defined in section 667.3 of title 23, Code of Federal Regulations (or successor regulations)) and extreme events, to the maximum extent practicable;</text></paragraph><paragraph id="ide4532652534b48d99148a6bed7767271"><enum>(2)</enum><text>the extent to which the project reduces the financial risk to the Federal Government; and</text></paragraph><paragraph commented="no" id="id4FA8338586254E1DA071838972BD4258"><enum>(3)</enum><text>such other criteria as the Secretary determines to be appropriate.</text></paragraph></subsection><subsection id="id70711a5a095042a1bf1e1815d1e20a47"><enum>(i)</enum><header>Administration of projects</header><text>A project that receives a grant under this section—</text><paragraph id="idea9849fc26d04f05a7b6e5f4aaa5f937"><enum>(1)</enum><text>may be transferred within the Department of Transportation; and</text></paragraph><paragraph id="ide57dd706e70349cd8a522426c24e28c5"><enum>(2)</enum><text>shall be administered in accordance with—</text><subparagraph id="idB64EB5ECABD44BD9B16AC33F194A994B"><enum>(A)</enum><text>title 23 and title 49, United States Code, as applicable;</text></subparagraph><subparagraph id="id57ff02a9a730484eb3ae07884875956e"><enum>(B)</enum><text>title VI of the Civil Rights Act of 1964 (<external-xref legal-doc="usc" parsable-cite="usc/42/2000d">42 U.S.C. 2000d</external-xref> et seq.);</text></subparagraph><subparagraph id="id4a95386186d14ff299a55a0ba5341de7"><enum>(C)</enum><text>the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321</external-xref> et seq.); and</text></subparagraph><subparagraph id="idb7bc5dfad56a4201b530e065b60d624d"><enum>(D)</enum><text>the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/42/4601">42 U.S.C. 4601</external-xref> et seq.).</text></subparagraph></paragraph></subsection><subsection id="id7a4c1e8acfc34f3d819e084e264e1c43"><enum>(j)</enum><header>Federal cost share</header><paragraph id="id78ABA197560E43B09ACEB3162B7ABCD0"><enum>(1)</enum><header>In general</header><text>The Federal share of the cost of a project carried out under the program shall not exceed 80 percent of the total project cost.</text></paragraph><paragraph id="id79958C054D7B48869ACBFAB1BD5987C8"><enum>(2)</enum><header>Non-Federal share</header><text>The eligible entity may use funds provided from other Federal sources to meet the non-Federal cost share requirement for a project under the program.</text></paragraph></subsection><subsection id="ide3ed4784c444423e9fd53e8ecaa8981c"><enum>(k)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this section for each fiscal year $1,000,000,000, to remain available until expended.</text></subsection></section></legis-body></bill>
