which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To support behavioral health integration into primary care practices, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Improving Access to Behavioral Health Integration Act</short-title></quote>.</text></section><section id="idFBD8B121B26549B689A51DA4563BAA90"><enum>2.</enum><header>Program to support behavioral health integration</header><text display-inline="no-display-inline">Section 760 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/294k">42 U.S.C. 294k</external-xref>) is amended—</text><paragraph id="id92CC933C976F429F9573BF1085C2DB05" commented="no"><enum>(1)</enum><text>in the section heading, by striking <quote><header-in-text style="OLC" level="section">Training demonstration program</header-in-text></quote> and inserting <quote><header-in-text style="OLC" level="section">Program to support behavioral health integration</header-in-text></quote>;</text></paragraph><paragraph id="id81524EC125D4465EBCFFFC1CBE7FAEA7"><enum>(2)</enum><text>in subsection (a)—</text><subparagraph id="idBDEC41744571461FA03E3E6BB8D2A1B7"><enum>(A)</enum><text>in paragraph (2), by striking <quote>; and</quote> and inserting a semicolon;</text></subparagraph><subparagraph id="id4B1882B8B81144EF96A679D490283822"><enum>(B)</enum><text>in paragraph (3)(B), by striking the period and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="id05DAD00E638D4CF3852C8230DA36214C"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idA8D7EACF9D364E6EB0A998C72902B815"><paragraph id="id15A4AFD65CBD44A1B1C5B5B023B78D56"><enum>(4)</enum><text>supporting primary care practices in implementing evidence-based behavioral health integration programs that involve professionals whose primary job function is the direct screening, diagnosis, treatment, or recovery support of patients with or in recovery from a behavioral health disorder, such as physicians, psychiatric nurses, social workers, marriage and family therapists, mental health counselors, occupational therapists, psychologists, and peer support specialists.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="idA87887F5DF6A478E9739F4A231289449"><enum>(3)</enum><text>by adding at the end of subsection (b) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id44F837AC0D054D598AE12255F93177F5"><paragraph id="id067657975D614A1187E690208703A4F2"><enum>(4)</enum><header>Behavioral health integration programs</header><text>A recipient of a grant under subsection (a)(4) shall use the grant funds to—</text><subparagraph id="idA1A32DA8B8494679BBB99CF4B3F63057"><enum>(A)</enum><text>hire physicians, psychiatric nurses, social workers, marriage and family therapists, mental health counselors, occupational therapists, psychologists, or peer support specialists to provide behavioral health services; </text></subparagraph><subparagraph id="idC3E37E8AAC854826886ED2AADE9CFA87"><enum>(B)</enum><text>identify and enter into contractual relationships with health care providers or vendors offering care management and behavioral health consultation to facilitate the adoption of behavioral health integration models; or</text></subparagraph><subparagraph id="id31E1ABC82F4D400185B045CAAFFF06F0"><enum>(C)</enum><text>for such other purposes as the Secretary determines appropriate.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="id173626CB8A124EDF972EAE13CE904A69"><enum>(4)</enum><text>by adding at the end of subsection (c) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id69F509F99F834177B35C4813F7C0A720"><paragraph id="idD96EC82D3CEC4B2684101D00F4964F2D"><enum>(4)</enum><header>Behavioral health integration programs</header><text>To be eligible to receive a grant under subsection (a)(4), an entity shall be a primary care practice, including adult primary care practices and pediatric primary care practices.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="id0F1D1049ADA14E86BB24A7D47313FBD5"><enum>(5)</enum><text>by adding at the end of subsection (d) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id02BE0AB96C8848FD85C95194678DCB2F"><paragraph id="id460B954C8C6C40BC8E7B9F5BAB90DD66"><enum>(3)</enum><header>Behavioral health integration programs</header><text>In awarding grants under subsection (a)(4), the Secretary shall give priority to eligible entities that—</text><subparagraph id="id5AD389C2E1274083BF25835B3CF6F3A1"><enum>(A)</enum><text>demonstrate a pathway to financially sustain the behavioral health integration program beyond the initial grant period, such as participation in value-based behavioral health integration models;</text></subparagraph><subparagraph id="id61AE31CABD894824B9B20DC54519F1FF"><enum>(B)</enum><text>have the capacity to expand access to mental health and substance use disorder services in areas with demonstrated need, as determined by the Secretary, such as Tribal, rural, or other medically underserved communities; or</text></subparagraph><subparagraph id="id9C4EC8D097BE4092A2471504DBDA26D5"><enum>(C)</enum><text>are practices that are eligible for technical assistance under section 1848(q)(11) of the Social Security Act on the basis of the number of professionals.</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="id3A6E23CCFD6741A69095557496348D6C"><enum>(6)</enum><text>in subsection (f)—</text><subparagraph id="id25B3BB319D3D4EECB7892E80EC7E12A5"><enum>(A)</enum><text>by striking <quote>demonstration program</quote> each place such term appears and inserting <quote>program</quote>;</text></subparagraph><subparagraph id="id31DD8F477CCD4F8392B62A942020CB85"><enum>(B)</enum><text>in paragraph (2)—</text><clause id="id25BFDBB633AA4E83A731A94618C4B8BC"><enum>(i)</enum><text>in subparagraph (B), by striking <quote>; and</quote> and inserting a semicolon;</text></clause><clause id="id4EFE16FEC0EB466BA5902EED50875E77"><enum>(ii)</enum><text>by redesignating subparagraph (C) as subparagraph (D); and</text></clause><clause id="idDCEC4FEBB8BF439EAB204D63CCCA053D"><enum>(iii)</enum><text>by inserting after subparagraph (B) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idB189F989FE86404AA65779BA4AA18115"><subparagraph id="id2537FCDAAC1D42F6A8ECDF9279EF85C0"><enum>(C)</enum><text>an analysis of the uptake of behavioral health integration models in primary care practices; and</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="id6A2E705BB85A4D40A001A0A2867BE17E"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idEDAFCB7CEAB7491086A5ABB29D495125"><paragraph id="id2081AB7195E049FA802A488DD2990E7D"><enum>(3)</enum><header>Metrics for measuring the uptake of behavioral health integration models</header><text>For purposes of the reporting requirement under paragraph (2)(C), the Secretary shall develop evidence-based metrics and reporting requirements to measure the uptake of behavioral health integration models by primary care practices, including by measuring the increase in provider capacity, patient access to behavioral health care, and patient outcomes. The Secretary shall consult with primary care and behavioral health professionals, and patient advocates when developing measures and performance metrics.</text></paragraph><paragraph id="id7F4839EE49754608BE270A90CC8EC0AC"><enum>(4)</enum><header>Publication of data</header><text>The Secretary shall make public aggregate evaluation results collected through the study under paragraph (1) to facilitate identifying best practices and promising models for scale with respect to behavioral health integration programs.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id2115A9B099724353A31A05212C043EA4"><enum>(7)</enum><text>by amending subsection (g) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id45826F12C0AA4C769C266C602D1DF152"><subsection id="idAAA879A78E674314AD97DE19FCC40087"><enum>(g)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated, for each of fiscal years 2023 through 2027—</text><paragraph id="idD46BE1903ACD41A99B7E827DAEDF29A9"><enum>(1)</enum><text>to carry out the grant programs under paragraphs (1), (2), and (3) of subsection (a), $10,000,000; and</text></paragraph><paragraph id="id274AC2B6B81146E9A0CD2301159A7959"><enum>(2)</enum><text>to carry out the grant program under subsection (a)(4), $30,000,000.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
