which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To reauthorize and improve the block grants for prevention and treatment of substance abuse. </official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Substance Use Prevention, Treatment, and Recovery Act</short-title></quote>.</text></section><section id="id95598B6EAA1E4918ABBB2068F584D975"><enum>2.</enum><header>Other amendments to the block Grants for Prevention and Treatment of Substance Abuse</header><subsection id="id9AA12EF35AFF4CE79216B85004015F75"><enum>(a)</enum><header>Certain allocations</header><paragraph id="idEC751957B7684AFF939460E3ED0B25CA"><enum>(1)</enum><header>Allocations regarding recovery</header><text>Section 1922 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300x-22">42 U.S.C. 300x–22</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idAABD80B8C6014D039C4006C464F452FF"><subsection id="id8EF176FA65714A29AFFD756835DA0E30"><enum>(c)</enum><header>Allocations regarding recovery</header><paragraph id="id96D07B0A05C74763968F77945CCBBEEB"><enum>(1)</enum><header>In general</header><text>A funding agreement for this grant under section 1921 is that, in expending the grant, the State involved will expend not less than 10 percent each fiscal year for programs for community-based and peer recovery support services for individuals with a substance use disorder.</text></paragraph><paragraph id="id8EB4E03BC5D9469F9D68A65AE9BED294"><enum>(2)</enum><header>Special rule for 2023</header><text>Notwithstanding paragraph (1), for fiscal year 2023, a State shall expend not less than 7 percent for programs described in such paragraph, provided that, in fiscal year 2024, the State expends for such programs an amount equal to any difference between 10 percent of the grant amount for fiscal year 2023 and the amount actually expended for such programs in fiscal year 2023, in addition to meeting the requirements of paragraph (1) with respect to grant amounts for fiscal year 2024.</text></paragraph></subsection><after-quoted-block>. </after-quoted-block></quoted-block></paragraph><paragraph id="idA0947CD26F1A4E6EAE39A350D7955610"><enum>(2)</enum><header>Technical amendment</header><text>Effective as if included in the enactment of the Children's Health Act of 2000 (<external-xref legal-doc="public-law" parsable-cite="pl/106/310">Public Law 106–310</external-xref>), section 3303(f)(2)(A) of the Children's Health Act of 2000 (<external-xref legal-doc="public-law" parsable-cite="pl/106/310">Public Law 106–310</external-xref>; 114 Stat. 1211) is amended by striking <quote>section 1922(c) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300x-22">42 U.S.C. 300x–22(c)</external-xref>)</quote> and inserting <quote>section 1922(b) of the Public Health Service Act, as amended by section 3303(a),</quote>.</text></paragraph></subsection><subsection id="id9438AB58DBBC4DC88C04D4039C731974" commented="no"><enum>(b)</enum><header>Public health promotion for recovery</header><paragraph commented="no" id="id8F5357CC654B4A17BF382D5A07659268"><enum>(1)</enum><header>Formula grants</header><text>Section 1921(b) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300x-21">42 U.S.C. 300x–21(b)</external-xref>) is amended—</text><subparagraph commented="no" id="idCD2088B6313D4C60A65AC37F53B7C7F8"><enum>(A)</enum><text>by inserting <quote>, including measures for infrastructure, education, or outreach to prevent overdose or other health risks,</quote> after <quote>substance use disorders</quote>; and</text></subparagraph><subparagraph id="id02C29FEC59A647E78D928D1D4716C7A0"><enum>(B)</enum><text>by inserting <quote>evidence-based or evidence-informed</quote> after <quote>evaluating</quote>. </text></subparagraph></paragraph><paragraph id="id1FF7B4D84A7848B69C3F2F6C1370E855"><enum>(2)</enum><header>Certain restrictions on expenditures</header><text>Section 1931(a)(1) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300x-31">42 U.S.C. 300x–31(a)(1)</external-xref>) is amended—</text><subparagraph id="id6C804F29B6C540E3AF8F1192491E70CF"><enum>(A)</enum><text>in subparagraph (E), by striking <quote>; or</quote> and inserting a semicolon;</text></subparagraph><subparagraph id="idF3138C73BAC54FC794014C33D4F59C1C"><enum>(B)</enum><text>in subparagraph (F), by striking the period and inserting <quote>; or</quote>; and</text></subparagraph><subparagraph id="idF84320B21EC34EDF8E1B3F207CFE7E10"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idD96A5DFA28A34A9A825C68162BB2913D"><subparagraph id="idB0AC91B6BC8245D0B5A89FBD256631C5"><enum>(G)</enum><text>in a manner that excludes individuals on the basis that such individuals receive drugs approved by the Food and Drug Administration for the treatment of substance use disorders.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="id0BB16D735CA044CEB664542F19563A4A"><enum>(c)</enum><header>Restrictions on expenditure of grant</header><text>Section 1931(a) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300x-31">42 U.S.C. 300x–31(a)</external-xref>) is amended—</text><paragraph id="id15D8FD753A3847058F4F69FDDE04BCC0"><enum>(1)</enum><text>in paragraph (1)(F), by inserting <quote>, except that the State may use such grant to provide support to programs that include infrastructure, education, or outreach services</quote> before the period; and</text></paragraph><paragraph id="idB4470A2609CD4E698E60D737E043E20F"><enum>(2)</enum><text>by amending paragraph (3) to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id5FC27FA77D414582AF71231471E6B9EF"><paragraph id="idEB497DE0187C4C3EA973886E29CC33F3"><enum>(3)</enum><header>Limitation regarding penal and correctional institutions</header><text>A funding agreement for this grant under section 1921 is that, in expending the grant, the State involved will expend not more than such a percentage of the block grant treatment budget, between 5 and 10 percent, as the Secretary may specify, for the purpose of providing treatment services in penal or correctional institutions of the State.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HFDA8146A8FF84C70A9423A2BAFAE71DA"><enum>(d)</enum><header>Study on assessment for use in distribution of limited State resources</header><paragraph id="H8D89E1BF75D54361B71F7EF5205A8B79"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Health and Human Services (referred to in this section as the <quote>Secretary</quote>), acting through the Assistant Secretary for Mental Health and Substance Use, in consultation with States and other local entities providing prevention, treatment, or recovery support services related to substance use, shall conduct a study to develop a model needs assessment process for States to consider to help determine how best to allocate block grant funding received under subpart II of part B of title XIX of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300x-21">42 U.S.C. 300x–21 et seq.</external-xref>) to provide services to substance use disorder prevention, treatment, and recovery support. The study shall include cost estimates with each model needs assessment process.</text></paragraph><paragraph id="H71ECF273A3E74FEFB914FB43332B7C02"><enum>(2)</enum><header>Report</header><text>Not later than 1 year after the date of the enactment of this Act, the Secretary shall submit to the Committee on Health, Education, Labor, and Pensions of the Senate and the Committee on Energy and Commerce of the House of Representatives a report on the results of the study conducted under paragraph (1). </text></paragraph></subsection><subsection id="idb6279d6db76f4419862eddb76f556e57"><enum>(e)</enum><header>Funding</header><text>Section 1935(a) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300x-35">42 U.S.C. 300x–35(a)</external-xref>) is amended by striking <quote>$1,858,079,000 for each of fiscal years 2018 through 2022.</quote> and inserting <quote>$3,200,000,000 for each of fiscal years 2023 through 2027</quote>.</text></subsection></section><section id="id14D68540D54B4B8A800347E66A6539EC"><enum>3.</enum><header>Eliminating stigmatizing language relating to substance use</header><subsection id="idCD4A593154A44C678517FCF898C0569C"><enum>(a)</enum><header>Block Grants for Prevention and Treatment of Substance Use</header><text display-inline="yes-display-inline">Part B of title XIX of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300x">42 U.S.C. 300x et seq.</external-xref>) is amended—</text><paragraph id="id7C5255CBE5D24FB785D42F05D74940FC"><enum>(1)</enum><text>in the part heading, by striking <quote><header-in-text level="part" style="OLC">Substance Abuse</header-in-text></quote> and inserting <quote><header-in-text level="part" style="OLC">Substance Use</header-in-text></quote>; </text></paragraph><paragraph id="idE73B9F503BDF4E45B62598A3BD624E20"><enum>(2)</enum><text>in section 1922(a) (<external-xref legal-doc="usc" parsable-cite="usc/42/300x-22">42 U.S.C. 300x–22(a)</external-xref>)—</text><subparagraph id="id1F88817FB02F4859A9B883CAC590625E"><enum>(A)</enum><text>in paragraph (1), in the matter preceding subparagraph (A), by striking <quote>substance abuse</quote> and inserting <quote>substance use disorders</quote>; and</text></subparagraph><subparagraph id="idA4EBA6834C46458890FC84114F9A9908"><enum>(B)</enum><text>by striking <quote>such abuse</quote> each place it appears in paragraphs (1) and (2) and inserting <quote>such use</quote>;</text></subparagraph></paragraph><paragraph id="idD185B2598B744D03AA741C47039835BF"><enum>(3)</enum><text display-inline="yes-display-inline">in section 1923 (<external-xref legal-doc="usc" parsable-cite="usc/42/300x-23">42 U.S.C. 300x–23</external-xref>)—</text><subparagraph id="idAC1C5EEC40774F0FA6DFA8F95A53F19B"><enum>(A)</enum><text>in the section heading, by striking <quote><header-in-text level="section" style="OLC">Substance Abuse</header-in-text></quote> and inserting <quote><header-in-text level="section" style="OLC">Substance Use</header-in-text></quote>; and</text></subparagraph><subparagraph id="idAF6F3323B3BE4DD585361A1C14C46649"><enum>(B)</enum><text>by striking <quote>drug abuse</quote> each place it appears in subsections (a) and (b) and inserting <quote>substance use disorders</quote>; </text></subparagraph></paragraph><paragraph id="idCEAFA2184A9D4DDBB9779A7C189AD6DD"><enum>(4)</enum><text>in section 1925(a)(1) (<external-xref legal-doc="usc" parsable-cite="usc/42/300x-25">42 U.S.C. 300x–25(a)(1)</external-xref>), by striking <quote>alcohol or drug abuse</quote> and inserting <quote>alcohol or other substance use disorders</quote>;</text></paragraph><paragraph id="idA97CEE599BEB4D55918453CA2C5B0BF3"><enum>(5)</enum><text display-inline="yes-display-inline">in section 1926(b)(2)(B) (<external-xref legal-doc="usc" parsable-cite="usc/42/300x-26">42 U.S.C. 300x–26(b)(2)(B)</external-xref>), by striking <quote>substance abuse</quote>;</text></paragraph><paragraph id="id17E515615F624ED68A70D4BED5B4A446"><enum>(6)</enum><text display-inline="yes-display-inline">in section 1931(b)(2) (<external-xref legal-doc="usc" parsable-cite="usc/42/300x-31">42 U.S.C. 300x–31(b)(2)</external-xref>), by striking <quote>substance abuse</quote> and inserting <quote>substance use disorders</quote>;</text></paragraph><paragraph id="idC702D054F4C8425CB220F08BDC2EB3CA"><enum>(7)</enum><text>in section 1933(d)(1) (<external-xref legal-doc="usc" parsable-cite="usc/42/300x-33">42 U.S.C. 300x–33(d)</external-xref>), in the matter following subparagraph (B), by striking <quote>abuse of alcohol and other drugs</quote> and inserting <quote>use of substances</quote>; </text></paragraph><paragraph id="idE95047E1AAB64C9AB899B76EB5699DEA"><enum>(8)</enum><text>by amending paragraph (4) of section 1934 (<external-xref legal-doc="usc" parsable-cite="usc/42/300x-34">42 U.S.C. 300x–34</external-xref>) to read as follows: </text><quoted-block style="OLC" id="idE55F162D5E554E3890A24EF2C340800B" display-inline="no-display-inline"><paragraph id="idEF751A4A38CB48598DC1A4FA7FFB7751"><enum>(4)</enum><text display-inline="yes-display-inline">The term <term>substance use disorder</term> means the recurrent use of alcohol or other drugs that causes clinically significant impairment.</text></paragraph><after-quoted-block>; </after-quoted-block></quoted-block></paragraph><paragraph id="id83F3E2AC5FD54865A0D79F37B9E75CCA"><enum>(9)</enum><text>in section 1935 (<external-xref legal-doc="usc" parsable-cite="usc/42/300x-35">42 U.S.C. 300x–35</external-xref>)—</text><subparagraph id="id2C10D919F5104D31BB02C331996B39C7"><enum>(A)</enum><text>in subsection (a), by striking <quote>substance abuse</quote> and inserting <quote>substance use disorders</quote>;
