which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To prohibit data brokers from selling, reselling, trading, licensing, or otherwise providing for consideration lists of military servicemembers to a covered nation.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Military Servicemembers' Data Act of 2022</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id6459bb24-eeb3-4268-8bd6-3c803dbb3d65"><enum>2.</enum><header display-inline="yes-display-inline">Unfair and deceptive acts and practices relating to military servicemember lists</header><subsection commented="no" display-inline="no-display-inline" id="id1ED8CF70B46347958D1A0F5DBDFED649"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">It shall be unlawful for a data broker to sell, resell, license, trade, or otherwise provide or make available for consideration a military servicemember list to any covered nation.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id8B3ABB63EC9C4B05A508192C9925E0EF"><enum>(b)</enum><header>Effective date</header><text>The prohibition under subsection (a) shall take effect on the earlier of—</text><paragraph commented="no" display-inline="no-display-inline" id="id7B638C6D72484DEB8512A24CCDAC822A"><enum>(1)</enum><text>the date the Commission issues the final rule under section 3(a)(3); or</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id79A701EBDE904B12A4A90429D6512C01"><enum>(2)</enum><text>1 year after the date of enactment of this Act.</text></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="idF3E062C487DE4E50A787C36A29D8BAF9"><enum>3.</enum><header>Enforcement</header><subsection commented="no" display-inline="no-display-inline" id="idb31b34d4-b455-4123-a1cf-9b3eda436c8c"><enum>(a)</enum><header display-inline="yes-display-inline">Enforcement by the Federal Trade Commission</header><paragraph commented="no" display-inline="no-display-inline" id="id34895b78-9415-4c33-9c0c-d31ab4641102"><enum>(1)</enum><header display-inline="yes-display-inline">Unfair or deceptive acts or practices</header><text display-inline="yes-display-inline">A violation of section 2 shall be treated as a violation of a rule defining an unfair or a deceptive act or practice under section 18(a)(1)(B) of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/57a">15 U.S.C. 57a(a)(1)(B)</external-xref>).</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2aae6977-256a-4c23-a7e2-8db1300fb35c"><enum>(2)</enum><header display-inline="yes-display-inline">Powers of Commission</header><subparagraph commented="no" display-inline="no-display-inline" id="idbc4b49b3-628b-4811-b9bf-30dee95a0464"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in subparagraphs (D) and (E), the Commission shall enforce section 2 in the same manner, by the same means, and with the same jurisdiction, powers, and duties as though all applicable terms and provisions of the <act-name parsable-cite="FTCA">Federal Trade Commission Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41 et seq.</external-xref>) were incorporated into and made a part of this Act.</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id62badbc8-b144-471b-87c5-8de40c6979bb"><enum>(B)</enum><header display-inline="yes-display-inline">Privileges and immunities</header><text display-inline="yes-display-inline">Any person who violates section 2 shall be subject to the penalties and entitled to the privileges and immunities provided in the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41 et seq.</external-xref>).</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4eb0393a3ce54c0bbfec97e16f6b23e7"><enum>(C)</enum><header display-inline="yes-display-inline">Authority preserved</header><text display-inline="yes-display-inline">Nothing in this Act shall be construed to limit the authority of the Federal Trade Commission under any other provision of law.</text></subparagraph><subparagraph id="id1b6e7a81c6c645f886004d2bcbf9a291"><enum>(D)</enum><header>Nonprofit organizations</header><text>Notwithstanding section 4 of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/44">15 U.S.C. 44</external-xref>) or any jurisdictional limitation of the Commission, the Commission shall also enforce this Act, in the same manner provided in subparagraphs (A) and (B), with respect to organizations not organized to carry on business for their own profit or that of their members. </text></subparagraph><subparagraph id="idd2d8875b20fb4933ae11ca878b9b3d39"><enum>(E)</enum><header>Independent litigation authority</header><text>In any case in which the Commission has reason to believe that a data broker is violating or has violated section 2, the Commission may bring a civil action in an appropriate district court of the United States—</text><clause id="idd0b88165f4aa4e7c917783fa6ac78f09"><enum>(i)</enum><text>to enjoin further violation of such section by such person;</text></clause><clause id="id3fb2297304934f6596635bda872499eb"><enum>(ii)</enum><text>to compel compliance with such section; and</text></clause><clause id="id9e8502fd846944cc892035967579ecad"><enum>(iii)</enum><text>to obtain damages, restitution, or other compensation on behalf of aggrieved consumers.</text></clause></subparagraph></paragraph><paragraph id="idd3f9b89e656446deb20a55ac90287c67"><enum>(3)</enum><header>Rulemaking</header><text>Pursuant to section 553 of title 5, United States Code, the Commission shall promulgate regulations to carry out the provisions of this Act. The Commission shall issue a final rule by not later than 1 year after the date of enactment of this Act.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id342a978d-e8d3-4ed4-9158-aefda3b8e579"><enum>(b)</enum><header display-inline="yes-display-inline">Enforcement by States</header><paragraph commented="no" display-inline="no-display-inline" id="idba9783cd-ff38-4b5b-972d-c4d0db40174f"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In any case in which the attorney general of a State has reason to believe that an interest of the residents of the State has been or is threatened or adversely affected by the engagement of any data broker subject to section 2 in a practice that violates such section, the attorney general of the State may, as parens patriae, bring a civil action on behalf of the residents of the State in an appropriate district court of the United States—</text><subparagraph commented="no" display-inline="no-display-inline" id="idfd962281-273a-4766-a709-6e109e357225"><enum>(A)</enum><text display-inline="yes-display-inline">to enjoin further violation of such section by such person;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7b625a08-aae1-4015-ab75-4b4a55330112"><enum>(B)</enum><text display-inline="yes-display-inline">to compel compliance with such section; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0f5817a0-3efa-44d1-8e52-8ca71f8ddf98"><enum>(C)</enum><text display-inline="yes-display-inline">to obtain damages, restitution, or other compensation on behalf of such residents.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2c0bbc61-ba0e-49fc-ae3c-df51dbafe5de"><enum>(2)</enum><header display-inline="yes-display-inline">Rights of Federal Trade Commission</header><subparagraph commented="no" display-inline="no-display-inline" id="id1546e4ba-664b-4b4d-88e3-d4b6aa3f4341"><enum>(A)</enum><header display-inline="yes-display-inline">Notice to Federal Trade Commission</header><clause commented="no" display-inline="no-display-inline" id="ide25159e6-67fe-4133-b32a-1eb1dfaa6ac3"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in clause (iii), the attorney general of a State shall notify the Commission in writing that the attorney general intends to bring a civil action under paragraph (1) not later than 10 days before initiating the civil action.</text></clause><clause commented="no" display-inline="no-display-inline" id="idefccc8b6-04f8-42ce-a1db-d06b3db86a62"><enum>(ii)</enum><header display-inline="yes-display-inline">Contents</header><text display-inline="yes-display-inline">The notification required by clause (i) with respect to a civil action shall include a copy of the complaint to be filed to initiate the civil action.</text></clause><clause commented="no" display-inline="no-display-inline" id="idf8545e37-45fb-416d-b695-3632b5db5b11"><enum>(iii)</enum><header display-inline="yes-display-inline">Exception</header><text display-inline="yes-display-inline">If it is not feasible for the attorney general of a State to provide the notification required by clause (i) before initiating a civil action under paragraph (1), the attorney general shall notify the Commission immediately upon instituting the civil action.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9c60fa1f-225d-4448-8666-6439e095b5e0"><enum>(B)</enum><header display-inline="yes-display-inline">Intervention by Federal Trade Commission</header><text display-inline="yes-display-inline">The Commission may—</text><clause commented="no" display-inline="no-display-inline" id="id42614303-0f94-4c33-ac49-a5fd2ad6e603"><enum>(i)</enum><text display-inline="yes-display-inline">intervene in any civil action brought by the attorney general of a State under paragraph (1); and</text></clause><clause commented="no" display-inline="no-display-inline" id="id5929a413-d6cc-49b9-a33d-ce57b7c1c88d"><enum>(ii)</enum><text display-inline="yes-display-inline">upon intervening—</text><subclause commented="no" display-inline="no-display-inline" id="idad6c4890-4d67-499d-befc-e28609b9c5af"><enum>(I)</enum><text display-inline="yes-display-inline">be heard on all matters arising in the civil action; and</text></subclause><subclause commented="no" display-inline="no-display-inline" id="idbb931fcb-adaf-4946-9e0d-35caf4ba4d29"><enum>(II)</enum><text display-inline="yes-display-inline">file petitions for appeal of a decision in the civil action.</text></subclause></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id89566779-3d81-477d-9d54-f84623db7db0"><enum>(3)</enum><header display-inline="yes-display-inline">Investigatory powers</header><text display-inline="yes-display-inline">Nothing in this subsection may be construed to prevent the attorney general of a State from exercising the powers conferred on the attorney general by the laws of the State to conduct investigations, to administer oaths or affirmations, or to compel the attendance of witnesses or the production of documentary or other evidence.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ide4cfa5a4-30ef-4f9e-b6b7-7b091f58e8c9"><enum>(4)</enum><header display-inline="yes-display-inline">Preemptive action by Federal Trade Commission</header><text display-inline="yes-display-inline">If the Commission institutes a civil action or an administrative action with respect to a violation of section 2, the attorney general of a State may not, during the pendency of such action, bring a civil action under paragraph (1) against any defendant named in the complaint of the Commission for the violation with respect to which the Commission instituted such action.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idb6a681d1-07b6-45ff-9ab7-bc561ca76579"><enum>(5)</enum><header display-inline="yes-display-inline">Venue; service of process</header><subparagraph commented="no" display-inline="no-display-inline" id="id52b045de-ac01-4b82-a316-00e43d768e0a"><enum>(A)</enum><header display-inline="yes-display-inline">Venue</header><text display-inline="yes-display-inline">Any action brought under paragraph (1) may be brought in—</text><clause commented="no" display-inline="no-display-inline" id="id28fc2525-4c7a-48b7-9972-92207e07e68f"><enum>(i)</enum><text display-inline="yes-display-inline">the district court of the United States that meets applicable requirements relating to venue under section 1391 of title 28, United States Code; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id19e1d9d6-2174-428d-b61c-b3714efcc735"><enum>(ii)</enum><text display-inline="yes-display-inline">another court of competent jurisdiction.</text></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="iddd6bd73e-41f9-4edc-bc0d-1231c7c07872"><enum>(B)</enum><header display-inline="yes-display-inline">Service of process</header><text display-inline="yes-display-inline">In an action brought under paragraph (1), process may be served in any district in which the defendant—</text><clause commented="no" display-inline="no-display-inline" id="id9261f9ca-85a2-4183-8a73-926309b6bbbc"><enum>(i)</enum><text display-inline="yes-display-inline">is an inhabitant; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id0641951c-ecaa-4fc0-b092-1526e35b6ecc"><enum>(ii)</enum><text display-inline="yes-display-inline">may be found.</text></clause></subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="ide7317608-876a-4d79-b9f7-af600d18e204"><enum>4.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph commented="no" display-inline="no-display-inline" id="id2b1138b3-caa2-453e-b9a4-8ffe6f375274"><enum>(1)</enum><header display-inline="yes-display-inline">Commission</header><text display-inline="yes-display-inline">The term <term>Commission</term> means the Federal Trade Commission. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id50179250EB7744A7AC69F8F254E6BF89"><enum>(2)</enum><header>Consumer</header><text>The term <term>consumer</term> means an individual residing in a State.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idEDFD4F439E8B454A8875679E60BB2BCA"><enum>(3)</enum><header>Covered nation</header><text>The term <term>covered nation</term> has the meaning given that term in section 4872(d)(2) of title 10, United States Code.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2E688D6E23DE4388B89C0D4E12CEFF12"><enum>(4)</enum><header>Data broker</header><text>The term <term>data broker</term> means a business that knowingly collects and sells to third parties the personal information of a consumer with whom the business does not have a direct relationship. </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7D12DC03A4CB44B88E46D2D5ADDB224A"><enum>(5)</enum><header>Military servicemember list</header><text>The term <term>military servicemember list</term> means a list that includes personal information (other than public record information) about one or more individuals or households which is created for the express or implied purpose of compiling information about individuals who are current or former servicemembers (as that term is defined in section 3911(1) of title 50, United States Code). </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id934970044B0F4FBEA4611FA150E50F59"><enum>(6)</enum><header>Personal information</header><text>The term <term>personal information</term> means information that is linked or reasonably linkable to any identified or identifiable person or device.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id980A77382CB043ADA1D970777D3206C4"><enum>(7)</enum><header>Public record information</header><text>The term <term>public record information</term> means information that is lawfully made available from Federal, State, or local government records provided that the data broker processes and transfers such information in accordance with any restrictions or terms of use placed on the information by the relevant government entity.</text></paragraph><paragraph id="id25B9315117B7499B8B3C325A5850B798"><enum>(8)</enum><header>State</header><text>The term <term>State</term> means any State of the United States, the District of Columbia, the Commonwealth of Puerto Rico, Guam, American Samoa, the Commonwealth of the Northern Mariana Islands, and the United States Virgin Islands.</text></paragraph></section></legis-body></bill>
