<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 427</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210224">February 24, 2021</action-date><action-desc><sponsor name-id="S346">Mr. Lee</sponsor> (for himself, <cosponsor name-id="S347">Mr. Moran</cosponsor>, and <cosponsor name-id="S397">Mr. Braun</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require covered entities to implement and disclose information moderation policies, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Promoting Responsibility Over Moderation In the Social-media Environment Act</short-title></quote> or the <quote><short-title>PROMISE Act</short-title></quote>.</text></section><section id="id1FD146AC665D4DEC9E76A85DEF28BCB1"><enum>2.</enum><header>Purpose</header><text display-inline="no-display-inline">The purpose of this Act is to ensure that users of a covered entity have the necessary information regarding such entity's policy on moderating information provided by a user or other information content provider. Access to such a policy enables users to make informed choices regarding the use or purchase of services provided by the covered entity and promotes a competitive marketplace for such services.</text></section><section id="id936C1315A00A441B90955E99CBE1E1B5"><enum>3.</enum><header>Information moderation policies</header><subsection id="id384AE55CCF21497E9009F02CF157F459"><enum>(a)</enum><header>Requirement</header><paragraph id="idC825C48CCA4A4068A69A1375D83E71E5"><enum>(1)</enum><header>In general</header><text>A covered entity—</text><subparagraph id="idC23D1C4AB39441AF9393DA335BA5B62E"><enum>(A)</enum><text>shall implement and operate in accordance with an information moderation policy (as described in paragraph (2));</text></subparagraph><subparagraph id="id1A6DA2171C51400FBE46C1F62B2CD7BF"><enum>(B)</enum><text>shall disclose such information moderation policy in a publicly available and easily accessible manner; and</text></subparagraph><subparagraph id="id70F943072331487BBFFC49E67C22396E"><enum>(C)</enum><text>shall not make a deceptive policy statement with respect to such information moderation policy.</text></subparagraph></paragraph><paragraph id="id87D5969E8D384E1EBB495D9E5931C6CF"><enum>(2)</enum><header>Information moderation policy</header><text>The information moderation policy described in this paragraph is a policy that accurately describes, in plain, easy to understand language, information regarding the business practices of a covered entity with respect to the standards, processes, and policies of the covered entity on moderating information provided by a user or other information content provider, including—</text><subparagraph id="id5262F6EEF84944C1B82C3005977299EB"><enum>(A)</enum><text>any category of information that—</text><clause id="id49B013B6D2F84B60A3B1AA8AD53BDEB8"><enum>(i)</enum><text>the covered entity does not permit on its service; or</text></clause><clause id="idF3B7DD39E2D24301ADFBCE832C294EE2"><enum>(ii)</enum><text>is subject to moderation by users or providers of such covered entity;</text></clause></subparagraph><subparagraph id="idAB7D8E6D921549FEA96B7E59807ADC24"><enum>(B)</enum><text>the process which a user or provider of the covered entity utilizes to moderate information posted, published, or otherwise displayed on the service; and</text></subparagraph><subparagraph id="id4DB97EC501BA49D5928EC90AD6B1E4FB"><enum>(C)</enum><text>the notification process, if any, which the covered entity uses to inform a user—</text><clause id="id972742BF83BC439996FDE02C1D062E42"><enum>(i)</enum><text>that such user's information has been moderated;</text></clause><clause commented="no" display-inline="no-display-inline" id="idDE744C7D9C85428785DC5202BE699D6E"><enum>(ii)</enum><text>of the rationale justifying the moderation decision; and</text></clause><clause commented="no" display-inline="no-display-inline" id="idBEC2B8710E6E4287B116BCAFE6B62D62"><enum>(iii)</enum><text>of the user's options for redress, if any.</text></clause></subparagraph></paragraph></subsection><subsection id="id17C00FD26261478FB6C9DC452AAE032A"><enum>(b)</enum><header>Enforcement by the Federal Trade Commission</header><paragraph id="idef7efb200d814165a2239bab939241aa"><enum>(1)</enum><header>Unfair or deceptive acts or practices</header><text>A violation of subsection (a) shall constitute an unfair or deceptive act or practice in commerce in violation of section 5(a) of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/45">15 U.S.C. 45(a)</external-xref>).</text></paragraph><paragraph id="idba686ba5c11a4bd1b30ed12f7f156f1d"><enum>(2)</enum><header>Powers of commission</header><text>Subject to paragraphs (4) and (5), the Commission shall enforce subsection (a) in the same manner, by the same means, and with the same jurisdiction, powers, and duties as though all applicable terms and provisions of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41</external-xref> et seq.) were incorporated into and made a part of this section. Any person who violates subsection (a) shall be subject to the penalties and entitled to the privileges and immunities provided in such Act.</text></paragraph><paragraph commented="no" id="id386fb0ca66a34ee5896427e682ccb212"><enum>(3)</enum><header>Regulations</header><text>The Commission shall prescribe, in accordance with section 553 of title 5, United States Code, such regulations as are necessary to carry out the purposes of this section, including regulations as may be necessary or appropriate to administer and carry out the purposes and objectives of this section.</text></paragraph><paragraph commented="no" id="idA1A4D2E5FB134A6D8E32289985E9B88C"><enum>(4)</enum><header>Presumption of materiality</header><text>With respect to a violation of subsection (a), there shall be a rebuttable presumption that a deceptive policy statement is material and likely to cause injury.</text></paragraph><paragraph id="idb27fd27fe9f64d02ab2b7ed9effc7a7a"><enum>(5)</enum><header>Application to common carriers</header><text>Notwithstanding the definition of the term <quote>Acts to regulate commerce</quote> in section 4 of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/44">15 U.S.C. 44</external-xref>) and the exception provided by section 5(a)(2) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/15/45">15 U.S.C. 45(a)(2)</external-xref>) for common carriers, the Commission shall enforce subsection (a), in the same manner provided in paragraphs (1) through (4), with respect to covered entities that are common carriers for purposes of such section 5(a)(2).</text></paragraph></subsection><subsection id="idF79BFC870E0D4466A58B3F3AD37C998C"><enum>(c)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id39D9AB2730384A398213BD439D9A5C11"><enum>(1)</enum><header>Commission</header><text>The term <term>Commission</term> means the Federal Trade Commission.</text></paragraph><paragraph id="id261AA9B4B74F4942AFD6C5E12DBF7189"><enum>(2)</enum><header>Covered entity</header><text>The term <term>covered entity</term> means an entity that—</text><subparagraph id="id9454200F716940DFAC938CFD229AC292"><enum>(A)</enum><text>is an interactive computer service;</text></subparagraph><subparagraph id="idB059F870985044B5A54ABA58DA6726FA"><enum>(B)</enum><text>is engaged in interstate or foreign commerce; and</text></subparagraph><subparagraph id="id488926FA44C546AA8A26873DB81C736B"><enum>(C)</enum><text>moderates information provided by a user or other information content provider.</text></subparagraph></paragraph><paragraph id="id53E8266B02D549AA82A52B7F36EF1633"><enum>(3)</enum><header>Deceptive policy statement</header><text>The term <term>deceptive policy statement</term> means an oral or written representation, omission, or practice made by an officer, director, or other authorized agent of a covered entity regarding such covered entity's information moderation policy that—</text><subparagraph id="idBE51FE8E94F84210AA1CA5454047AA04"><enum>(A)</enum><text>misleads or is likely to mislead a reasonable individual regarding the covered entity's service; and</text></subparagraph><subparagraph id="idEDDC78362471410797C5AAC4E73B08EA"><enum>(B)</enum><text>affects or is likely to affect a reasonable individual's choice to use or use of the covered entity's service.</text></subparagraph></paragraph><paragraph id="idCA66769F99574F12B63F25811FE70B37"><enum>(4)</enum><header>Information content provider</header><text>The term <term>information content provider</term> has the meaning given such term in section 230(f) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/230">47 U.S.C. 230(f)</external-xref>).</text></paragraph><paragraph id="id962985DEDC2540468EC2DB642C02B8DC"><enum>(5)</enum><header>Interactive computer service</header><text>The term <term>interactive computer service</term> has the meaning given such term in section 230(f) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/230">47 U.S.C. 230(f)</external-xref>).</text></paragraph><paragraph id="id76005537DFEE495D95948824B07FB9FB"><enum>(6)</enum><header>Moderate</header><text>With respect to information provided by a user or other information content provider, the term <term>moderate</term> means—</text><subparagraph id="id02A8C26378AF41E48FACB0966FEB96A8"><enum>(A)</enum><text>to remove or otherwise restrict access to or the availability of such information;</text></subparagraph><subparagraph id="id8D9C6815927A483DB8466AAC75DFDF2A"><enum>(B)</enum><text>to edit or otherwise alter such information; or</text></subparagraph><subparagraph id="id2202DDD0ED444938A0019493EAEF3DD6"><enum>(C)</enum><text>to post, publish, or otherwise display a warning, fact-check notice, or other label in conjunction with such information.</text></subparagraph></paragraph></subsection></section></legis-body></bill>
