<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>2d Session</session><legis-num>S. 4252</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20220518" legis-day="20220517">May 18 (legislative day, May 17), 2022</action-date><action-desc><sponsor name-id="S348">Mr. Paul</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To terminate duties and other restrictions on the importation of infant formula, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Freedom to Import Infant Formula Act of 2022</short-title></quote>.</text></section><section id="idB92179041FC5450C9495581C28E0A408"><enum>2.</enum><header>Termination of duties and other restrictions on importation of infant formula</header><subsection id="id492DAE1EDB93451DBF48F9FFFA171E67"><enum>(a)</enum><header>Duty-Free treatment of infant formula</header><text display-inline="yes-display-inline">On and after the date of the enactment of this Act, infant formula classified under heading 1901.10 of the Harmonized Tariff Schedule of the United States shall enter the United States free of duty and free of quantitative limitation.</text></subsection><subsection id="id2AA0D613191B4E6C9FE588C5FFDD031A"><enum>(b)</enum><header>Importation of infant formula legal for sale in certain countries</header><paragraph id="idE2D04921E9AD43AC8A037DA0A73642AD"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, with respect to infant formula from a country described in paragraph (2)—</text><subparagraph id="idBA741EC64632479386FA997C2749318A"><enum>(A)</enum><text display-inline="yes-display-inline">U.S. Customs and Border Protection may not seize or otherwise enforce restrictions on the importation of such formula if such formula would meet the legal requirements for sale in that country; and</text></subparagraph><subparagraph id="idC5B3FCFD0FC448F1BC6E736637ACBBC9"><enum>(B)</enum><text>such formula is deemed to be in compliance with the requirements under section 412 of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/350a">21 U.S.C. 350a</external-xref>).</text></subparagraph></paragraph><paragraph id="idE1F5E0D9F29B45FD909E1B7B835C2FD4"><enum>(2)</enum><header>Country described</header><text>A country described in this paragraph is any of the following:</text><subparagraph id="id8D45C08A1E74487DA84DC7AE52E6FB16"><enum>(A)</enum><text>Australia.</text></subparagraph><subparagraph id="idBBD4B72856AB48688EED3DA7BC66E571"><enum>(B)</enum><text>Canada. </text></subparagraph><subparagraph id="id5DC43D2B44704B929548DCF4B57E4C1B"><enum>(C)</enum><text>Israel.</text></subparagraph><subparagraph id="id1942E0F944514A398E9AC7305E11B026"><enum>(D)</enum><text>Japan. </text></subparagraph><subparagraph id="id0DBCFBDF44B6430897B61727A5D1C4D7"><enum>(E)</enum><text>New Zealand.</text></subparagraph><subparagraph id="idecd25ab7488c46e6b12925eaa19c36ad"><enum>(F)</enum><text>The United Kingdom.</text></subparagraph><subparagraph id="id6C86DB9ED0D94842A992B5523E69A7FF"><enum>(G)</enum><text>A member country of the European Union. </text></subparagraph><subparagraph id="idf6d544aaa1b44621a03668cdca8b564c"><enum>(H)</enum><text>A member country of the European Economic Area. </text></subparagraph></paragraph></subsection><subsection id="id5FADD4FF594A433A9A769DBFAE623A4B"><enum>(c)</enum><header>Infant formula defined</header><text display-inline="yes-display-inline">In this section, the term <term>infant formula</term> has the meaning given that term in section 201(z) of the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/321">21 U.S.C. 321(z)</external-xref>). </text></subsection></section></legis-body></bill>
