<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>2d Session</session><legis-num>S. 4250</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20220518" legis-day="20220517">May 18 (legislative day, May 17), 2022</action-date><action-desc><sponsor name-id="S404">Mr. Scott of Florida</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSBU00">Committee on the Budget</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To create a point of order against legislation making nondefense discretionary appropriations that would increase the deficit during a period of high inflation. </official-title></form><legis-body><section id="id163EFF9531DC4514ADDF84CB461C60E1" section-type="section-one"><enum>1.</enum><header>Point of order in the Senate against legislation making nondefense discretionary appropriations that would increase the deficit during a period of high inflation</header><subsection id="id4aeaa955fae945a690bee41e1f9f1197"><enum>(a)</enum><header>Point of order</header><text>It shall not be in order in the Senate to consider any bill, joint resolution, motion, amendment, amendment between the Houses, or conference report making appropriations for the revised nonsecurity category (as defined in section 250(c) of the Balanced Budget and Emergency Deficit Control Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/2/900">2 U.S.C. 900(c)</external-xref>)) that, if enacted, would increase the deficit over the period of current fiscal year, the budget year, and the ensuing 9 fiscal years following the budget year if the annualized change in the most recently monthly report on the Consumer Price Index for All-Urban Consumers published by the Bureau of Labor Statistics of the Department of Labor is not less than 8 percent. </text></subsection><subsection id="id5123620e95874f8aadc5fbb2bb41df7b"><enum>(b)</enum><header>Waiver and appeal</header><text>Subsection (a) may be waived or suspended in the Senate only by an affirmative vote of two-thirds of the Members, duly chosen and sworn. An affirmative vote of two-thirds of the Members of the Senate, duly chosen and sworn, shall be required to sustain an appeal of the ruling of the Chair on a point of order raised under subsection (a).</text></subsection><subsection id="id45B2949D0DE94F6FA44E6A8AF0354426"><enum>(c)</enum><header>Effective date</header><text>This section shall apply on and after July 1, 2022.</text></subsection></section></legis-body></bill>
