id="HDDB8EA2F53F44A20BBE0522CE62E3165"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Advanced Aviation Infrastructure Modernization Act</short-title></quote> or the <quote><short-title>AAIM Act</short-title></quote>. </text></section><section id="HFDE574A79D7247058A3DF7D033564793"><enum>2.</enum><header>Advanced air mobility infrastructure pilot program</header><subsection id="H3B3A66C0D761464DB7EA009C1F4B7CF2"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Secretary shall establish a pilot program to provide grants that assist an eligible entity to plan for the development and deployment of infrastructure necessary to facilitate AAM operations, locally and regionally, within the United States.</text></subsection><subsection id="H2029F8117E6F4858AA942765EE647E56"><enum>(b)</enum><header>Planning grants</header><paragraph id="HA2D56E6A08F14C96AD248F75C50533FA"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall provide grants to eligible entities to develop comprehensive plans under paragraph (2) related to AAM infrastructure.</text></paragraph><paragraph commented="no" id="HBDD3B2E48CA44D1C9E36C3A76AD25348"><enum>(2)</enum><header>Comprehensive plan</header><subparagraph commented="no" display-inline="no-display-inline" id="H7F04A1E4082C40339C0878F361955F61"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after receiving a grant under this subsection, an eligible entity shall submit to the Secretary a comprehensive plan<added-phrase reported-display-style="italic">, including the development of potential public use and private vertiport infrastructure,</added-phrase> in a format capable of being published on the website of the Department of Transportation.</text></subparagraph><subparagraph commented="no" id="H857ACF270A3441149F48A49C589682C4"><enum>(B)</enum><header>Plan contents</header><text display-inline="yes-display-inline">The Secretary shall establish content requirements for comprehensive plans submitted under this subsection, which shall include <deleted-phrase reported-display-style="strikethrough">not less than 1 of the following</deleted-phrase><added-phrase reported-display-style="italic">as many of the following</added-phrase>:</text><clause commented="no" id="H200ED639A42C4868844BE65B7565D52B"><enum>(i)</enum><text display-inline="yes-display-inline">The identification of planned or potential <added-phrase reported-display-style="italic">public use and private</added-phrase> vertiport locations.</text></clause><clause commented="no" id="HB70FE6410776455D86DA32D61FDCDABF"><enum>(ii)</enum><text>A description of infrastructure necessary to support AAM operations.</text></clause><clause commented="no" id="H2EEF45561A8442E9A61E0A10E25C9BB8"><enum>(iii)</enum><text display-inline="yes-display-inline">A description of types of planned or potential AAM operations and forecast for proposed vertiport operations, including estimates for initial operations and future growth.</text></clause><clause commented="no" id="HC98A7C343673424182FB50C2CB38C7BB"><enum>(iv)</enum><text display-inline="yes-display-inline">The identification of physical and digital infrastructure required to meet any standards for vertiport design and performance characteristics established by the Federal Aviation Administration (as in effect on the date on which the Secretary issues a grant to an eligible entity), including modifications to existing infrastructure and ground sensors, electric charging or other fueling requirements, electric utility requirements, wireless and cybersecurity requirements, fire safety, perimeter security, and other necessary hardware or software.</text></clause><clause commented="no" id="id5E938DE52F3A4DFF918D510AA947E7A1"><enum>(v)</enum><text>A description of any hazard associated with planned vertiport infrastructure, such as handling of hazardous materials, batteries, or other fuel cells, charging or fueling of aircraft, aircraft rescue and firefighting response, and emergency planning.</text></clause><clause commented="no" id="H38708476788E4680BF917AF3F444FC0F"><enum>(vi)</enum><text display-inline="yes-display-inline">A description of potential environmental effects of planned <added-phrase reported-display-style="italic">or potential</added-phrase> construction or siting of vertiports.</text></clause><clause commented="no" id="HD99860434F6E49DE8785B788C2DC0F0A"><enum>(vii)</enum><text display-inline="yes-display-inline">A description of how planned <added-phrase reported-display-style="italic">or potential</added-phrase> vertiport locations, including new or repurposed infrastructure, fit into State and local transportation systems and networks, including—</text><subclause commented="no" id="HB3E99E2D473D4234988E774D9582A4FF"><enum>(I)</enum><text>connectivity to existing public transportation hubs and intermodal and multimodal facilities;</text></subclause><subclause commented="no" id="H407D9657D1CB4DD6BC87A31986B06AD6"><enum>(II)</enum><text>opportunities to create new service to rural areas and areas underserved by air transportation; <deleted-phrase reported-display-style="strikethrough">or</deleted-phrase></text></subclause><subclause commented="no" id="id7A09AAA0177C4F4C91ADF248425E0371"><enum>(III)</enum><text>opportunities to utilize existing aviation infrastructure, such as airports and heliports, for AAM operations<deleted-phrase reported-display-style="strikethrough">.</deleted-phrase><added-phrase reported-display-style="italic">; or</added-phrase></text></subclause><subclause id="id782B0CE7661F45DC8D07E1FB9DA017EE" changed="added" reported-display-style="italic"><enum>(IV)</enum><text>any potential conflict with existing aviation infrastructure that may arise from the potential location of the vertiport.</text></subclause></clause><clause commented="no" id="H5C491DD3A07B4495BA3BB7E4A02451FC"><enum>(viii)</enum><text display-inline="yes-display-inline">A description of how vertiport planning will be incorporated in State or metropolitan planning documents.</text></clause><clause commented="no" id="HC075337FD246499C8D80C24DC9BEFC69" changed="deleted" reported-display-style="strikethrough"><enum>(ix)</enum><text display-inline="yes-display-inline">The identification of the process an eligible entity will undertake to ensure an adequate level of engagement with any potentially impacted community for each planned vertiport location and planned or anticipated AAM operations, such as engagement with communities in rural areas, underserved communities, individuals with disabilities, or racial and ethnic minorities.</text></clause><clause id="idA03D7C91F6964EB8B4F0D2896AB69FA4" changed="added" reported-display-style="italic"><enum>(ix)</enum><text>The identification of the process an eligible entity will undertake to ensure an adequate level of engagement with any potentially impacted community for each planned or potential vertiport location and planned or anticipated AAM operations, such as engagement with communities in rural areas, underserved communities, Tribal communities, individuals with disabilities, or racial and ethnic minorities. </text></clause><clause commented="no" id="H1F33B1502B854D079C780EAED5E2C98E"><enum>(x)</enum><text display-inline="yes-display-inline">The identification of the actions necessary for an eligible entity to undertake the construction of a vertiport, such as planning studies to assess existing infrastructure or newly identified areas of AAM integration, environmental studies, studies of projected economic benefit to the community, lease or acquisition of an easement or land for new infrastructure, and activities related to other capital costs.</text></clause><clause commented="no" id="HC526AB127B3C421FAC366270FA72A825"><enum>(xi)</enum><text display-inline="yes-display-inline">The identification of State, local, or private sources of funding an eligible entity may use to assist with the construction or operation of a vertiport.</text></clause><clause commented="no" id="idDCF69F804AB64625B986079E5818A47F"><enum>(xii)</enum><text>The identification of existing Federal aeronautical and airspace requirements that must be met for the eligible entity's planned vertiport location.</text></clause><clause commented="no" id="id550A099A2C024ECB966A431A0E3FE2A3"><enum>(xiii)</enum><text>A description of how the eligible entity will include opportunities for small business concerns owned and controlled by socially and economically disadvantaged individuals to compete, on an equal basis, for contracts or subcontracts related to the design, development, construction, or operation of a proposed vertiport.</text></clause></subparagraph></paragraph><paragraph id="H81619C5E3F5E4F7EB02A00EBAA8B9621"><enum>(3)</enum><header>Application</header><text display-inline="yes-display-inline">To apply for a grant under this subsection, an eligible entity shall provide to the Secretary an application in such form, at such time, and containing such information as the Secretary may require.</text></paragraph><paragraph id="H5F695E21BD9F4D8AB054D003BD6B4C39"><enum>(4)</enum><header>Selection</header><subparagraph id="H71E0426190EC45EABB72EABA8DB70AF2"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">In awarding grants under this subsection, the Secretary shall consider the following:</text><clause id="HB72E01FAEC3740D69A6F385767B68100"><enum>(i)</enum><text display-inline="yes-display-inline">Geographic diversity.</text></clause><clause id="idE4DC67D09AFD452AA574C7F927388FA3"><enum>(ii)</enum><text>Diversity of the proposed models of infrastructure financing and management.</text></clause><clause id="id198D057A51434A8483F7370124D52D3E"><enum>(iii)</enum><text>Diversity of anticipated or planned AAM operations.</text></clause><clause id="HD06350B9BA2248BAB56EB053D8ED8078"><enum>(iv)</enum><text display-inline="yes-display-inline">The need for comprehensive plans that—</text><subclause id="H0E3B295CE48C462A9F0333B0EE4AB46C"><enum>(I)</enum><text><deleted-phrase reported-display-style="strikethrough">facilitate</deleted-phrase><added-phrase reported-display-style="italic">ensure</added-phrase> the safe and efficient integration of AAM operations into the National Airspace System;</text></subclause><subclause id="H5446545C62B54EA9AD80F78BF9F93DA7"><enum>(II)</enum><text>improve transportation safety, connectivity, and access in both rural and urban regions in the United States;</text></subclause><subclause id="HE45066B17BA344D6BA6DC28A557E204A"><enum>(III)</enum><text>leverage existing public transportation systems and intermodal and multimodal facilities or newly identified areas of AAM integration;</text></subclause><subclause id="H6B581D4B55C04500A4B1E91D3B81F07B"><enum>(IV)</enum><text>reduce surface congestion and the environmental impacts of transportation;</text></subclause><subclause id="H4DD913A1C71E43F9AD5F6D67E272F2D5"><enum>(V)</enum><text>grow the economy and create jobs in the United States; and</text></subclause><subclause id="H6457B8F99A9D44DC8BD140BB7815C10B"><enum>(VI)</enum><text>encourage community engagement when planning for AAM-related infrastructure.</text></subclause></clause></subparagraph><subparagraph id="H416B3D5629B64273A016581F6ACA514B"><enum>(B)</enum><header>Priority</header><text>The Secretary shall prioritize awarding grants under this subsection <deleted-phrase reported-display-style="strikethrough">to eligible entities that partner</deleted-phrase><added-phrase reported-display-style="italic">to applications that capture as many items in paragraph (2)(B) as possible and to eligible entities that collaborate</added-phrase> with commercial AAM entities, institutions of higher education, research institutions, or other relevant stakeholders to develop and prepare a comprehensive plan.</text></subparagraph><subparagraph id="id93404C5B786F48DD8D0748A13FC9A25C"><enum>(C)</enum><header>Minimum allocation to rural areas</header><text>The Secretary shall ensure that not less than 20 percent of the amounts made available under subsection (c) are used to award grants to eligible entities that submit a comprehensive plan under paragraph (2) that is related to infrastructure located in a rural area.</text></subparagraph></paragraph><paragraph id="H187BAC419CB344738A8CE7B2262FF0C8"><enum>(5)</enum><header>Grant amount</header><text display-inline="yes-display-inline">Each grant made under this subsection shall be made in an amount that is not more than $1,000,000.</text></paragraph><paragraph id="H90E6959551AD42138A5AAE295ABE446E"><enum>(6)</enum><header>Briefing</header><subparagraph id="H09546DAE75FD4FF28B17C07DFFF4A312"><enum>(A)</enum><header>In general</header><text>Not later than 180 days after the first comprehensive plan is submitted under paragraph (2), and every 180 days thereafter through <deleted-phrase reported-display-style="strikethrough">September 30, 2024</deleted-phrase><added-phrase reported-display-style="italic">September 30, 2025</added-phrase>, the Secretary shall provide a briefing to the appropriate committees of Congress <deleted-phrase reported-display-style="strikethrough">on the comprehensive plans</deleted-phrase><added-phrase reported-display-style="italic">on each of the comprehensive plans</added-phrase> submitted to the Secretary under such paragraph.</text></subparagraph><subparagraph id="H2F9C8525047B480CAEE548F3DA8A60E9"><enum>(B)</enum><header>Contents</header><text>The briefing required under subparagraph (A) shall include—</text><clause id="H1BEBB20B64DB4604BD9976F3E4720D67"><enum>(i)</enum><text display-inline="yes-display-inline">an evaluation of all <deleted-phrase reported-display-style="strikethrough">planned or proposed</deleted-phrase><added-phrase reported-display-style="italic">planned or potential</added-phrase> vertiport locations included in the comprehensive plans submitted under paragraph (2) and how such <deleted-phrase reported-display-style="strikethrough">planned or proposed</deleted-phrase><added-phrase reported-display-style="italic">planned or potential</added-phrase> vertiport locations may fit into the overall United States transportation system and network; and</text></clause><clause id="H2493D91C40A946EEAA755D3D27EC9C81"><enum>(ii)</enum><text display-inline="yes-display-inline">a description of lessons or best practices learned through the review of comprehensive plans and how the Secretary will incorporate any such lessons or best practices into Federal standards or guidance for the design and operation of AAM infrastructure and facilities.</text></clause></subparagraph></paragraph></subsection><subsection id="HEAD7F2764EA54CE2B39DBFF6AEA0006A"><enum>(c)</enum><header>Authorization of appropriations</header><paragraph id="H941E9F0B9281454CA0E8136D62F9F450"><enum>(1)</enum><header>Authorization</header><text display-inline="yes-display-inline">There are authorized to be appropriated to the Secretary to carry out this section $12,500,000 for each of <deleted-phrase reported-display-style="strikethrough">fiscal years 2022 and 2023</deleted-phrase><added-phrase reported-display-style="italic">fiscal years 2023 and 2024</added-phrase>, to remain available until expended.</text></paragraph><paragraph id="H2DB13851295440088248A4BFC4469724"><enum>(2)</enum><header>Administrative expenses</header><text display-inline="yes-display-inline">Of the amounts made available under paragraph (1), the Secretary may retain up to 1 percent for personnel, contracting, and other costs to establish and administer the pilot program under this section.</text></paragraph></subsection><subsection commented="no" id="HED2CF00EBD85435CB4C8AF3A186D81B8"><enum>(d)</enum><header>Termination</header><paragraph commented="no" id="H41BFBEC544A045DBAE627A1B69178E1B"><enum>(1)</enum><header>In general</header><text>No grant may be awarded under this section after <deleted-phrase reported-display-style="strikethrough">September 30, 2023</deleted-phrase><added-phrase reported-display-style="italic">September 30, 2024</added-phrase>.</text></paragraph><paragraph commented="no" id="H66A0A18A07DC4EE995CDA1D5EFDAF9C2"><enum>(2)</enum><header>Continued funding</header><text>Funds authorized to be appropriated pursuant to subsection (c) may be expended after <deleted-phrase reported-display-style="strikethrough">September 30, 2023</deleted-phrase><added-phrase reported-display-style="italic">September 30, 2024</added-phrase>—</text><subparagraph commented="no" id="H963E56D9C88549B4ADEA031D8C5ECBB2"><enum>(A)</enum><text>for grants awarded prior to <deleted-phrase reported-display-style="strikethrough">September 30, 2023</deleted-phrase><added-phrase reported-display-style="italic">September 30, 2024</added-phrase>; and</text></subparagraph><subparagraph commented="no" id="HD3CE8C8687D846E2B305532F2B4CC8A7"><enum>(B)</enum><text>for administrative expenses.</text></subparagraph></paragraph></subsection><subsection id="H2A6FB822FD8D430CB7402E4DC89D4EE8"><enum>(e)</enum><header>Definitions</header><text>In this Act:</text><paragraph id="H2D58E91F7F774967B14EFD20EFD4A94F"><enum>(1)</enum><header>Advanced air mobility; AAM</header><text display-inline="yes-display-inline">The terms <term>advanced air mobility</term> and <term>AAM</term> mean a transportation system that transports individuals or property between points in the United States using aircraft with innovative capabilities, including aircraft that use 2 or more lift or thrust units to generate powered lift and control during vertical takeoff or landing, that may be piloted, remotely piloted, or autonomous, including those powered by <deleted-phrase reported-display-style="strikethrough">electric or hybrid driven propulsion</deleted-phrase><added-phrase reported-display-style="italic">alternative propulsion</added-phrase>, in both controlled and uncontrolled airspace.</text></paragraph><paragraph id="H1DC20B55DEC54BDC970D2C98718198F5"><enum>(2)</enum><header>Appropriate committees of Congress</header><text display-inline="yes-display-inline">The term <term>appropriate committees of Congress</term> means the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Commerce, Science, and Transportation of the Senate.</text></paragraph><paragraph id="HA84603FA32FC4A76B1367F316AE29222"><enum>(3)</enum><header>Commercial AAM entities</header><text>The term <term>commercial AAM entities</term> means—</text><subparagraph id="H27F14FC1824A49BC9FB59BF8907290B7"><enum>(A)</enum><text>manufacturers of aircraft, avionics, propulsion systems, and air traffic management systems related to AAM;</text></subparagraph><subparagraph id="H185FF1E956844BABA736B555FF57EF88"><enum>(B)</enum><text>intended commercial operators of AAM aircraft and systems; and</text></subparagraph><subparagraph id="idC73A715932F14B89BD76B8CC4E9647EF"><enum>(C)</enum><text>intended commercial operators and developers of vertiports.</text></subparagraph></paragraph><paragraph display-inline="no-display-inline" id="HBCE9D445377E41C089358E9E293F81E1"><enum>(4)</enum><header>Eligible entity</header><text display-inline="yes-display-inline">The term <term>eligible entity</term> means—</text><subparagraph id="HC145B8D5911F476D866F1CDE3112114D"><enum>(A)</enum><text>a State, local, or Tribal government, including a political subdivision thereof;</text></subparagraph><subparagraph id="HFF5EDD3EF520499FB3312A428C16B2EB"><enum>(B)</enum><text>an airport sponsor;</text></subparagraph><subparagraph id="HE18236F41A0E4AC9AB21BBFD0311A0FF"><enum>(C)</enum><text>a transit agency;</text></subparagraph><subparagraph id="H83BFCC9B31F8452389095223BC5C738C"><enum>(D)</enum><text>a port authority;</text></subparagraph><subparagraph id="HE7E8141B91D341FE8C6B9A893C8C5C74"><enum>(E)</enum><text>a metropolitan planning organization; or</text></subparagraph><subparagraph id="H9F18840618A84250A6EFD1413D115B68"><enum>(F)</enum><text display-inline="yes-display-inline">any combination or consortium of the entities described in subparagraphs (A) through (E).</text></subparagraph></paragraph><paragraph id="H17D1CDB1B77E4B9AA158FEC8B05A9BF0"><enum>(5)</enum><header>Metropolitan planning organization</header><text>The term <term>metropolitan planning organization</term> has the meaning given such term in section 5303(b) of title 49, United States Code.</text></paragraph><paragraph id="H0ABAEEDC3C7648ABA78C964B5C563C57"><enum>(6)</enum><header>Rural area</header><text>The term <term>rural area</term> means an area located outside a metropolitan statistical area (as designated by the Office of Management and Budget).</text></paragraph><paragraph id="idC3597596A6B24F30991F03EA671AC3A9"><enum>(7)</enum><header>Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the Secretary of Transportation.</text></paragraph><paragraph id="idC6E0A528B74F42F19BCC15AD65A79F08"><enum>(8)</enum><header>State</header><text display-inline="yes-display-inline">The term <term>State</term> means a State of the United States, the District of Columbia, Puerto Rico, the Virgin Islands, American Samoa, the Northern Mariana Islands, and Guam. </text></paragraph><paragraph id="id5BA23B06E4F24351908FDB72FC6EDAA5"><enum>(9)</enum><header>Vertiport</header><text>The term <term>vertiport</term> means a designated location used or intended to be used to support AAM operations, including the landing, takeoff, loading, taxiing, parking, and storage of aircraft developed for AAM operations.</text></paragraph></subsection></section><section id="id0C81EDAF6CFD4498AE85E59162BE7AC2" changed="added" commented="no" display-inline="no-display-inline" section-type="subsequent-section" reported-display-style="italic"><enum>3.</enum><header display-inline="yes-display-inline">GAO study and report</header><subsection id="idA80E46153F324B90BE0FCC3030C3E06D" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Comptroller General of the United States shall—</text><paragraph id="ide9ef35e36b98469cb00787b7bb1a0785" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">conduct a study on the interests, roles, and responsibilities of Federal, State, local, and Tribal governments affected by AAM aircraft and operations; and</text></paragraph><paragraph id="idebb49a47bd4a4c76b4a9ccdc5a441376" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">submit to the appropriate committees of Congress a report on the study, including the Comptroller General's findings and conclusions.</text></paragraph></subsection><subsection id="idc667b5e3b087460c85b7b69e82040e5f" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Requirements</header><text display-inline="yes-display-inline">In conducting the study required under subsection (a), the Comptroller General shall review the following:</text><paragraph id="id3879104396c1463b849240ede2bcac59" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">The state of the law as of the enactment of this Act with respect to Federal authority over operations of AAM aircraft systems in the national airspace system.</text></paragraph><paragraph id="id713d845571ec4f429be3a56f090b1f19" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">The state of the law as of the enactment of this Act
