<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>2d Session</session><legis-num>S. 4243</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20220518" legis-day="20220517">May 18 (legislative day, May 17), 2022</action-date><action-desc><sponsor name-id="S349">Mr. Portman</sponsor> (for himself, <cosponsor name-id="S380">Mr. Peters</cosponsor>, and <cosponsor name-id="S284">Ms. Stabenow</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish the Department of Homeland Security Trade and Economic Security Council and the position of Assistant Secretary for Trade and Economic Security within the Department of Homeland Security, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HB66D6295D53744778C8E7BA2A14B31C3"><section section-type="section-one" id="H8F2DA0EC74FA441A8F35C6FB8AE1759E"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>DHS Trade and Economic Security Council Act of 2022</short-title></quote>.</text></section><section id="H924AB2301D0A44B48492909AE395D066"><enum>2.</enum><header>DHS Trade and Economic Security Council</header><subsection id="H7CAA60F1321F434BB5311C835E8F7F6C"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="id8F318BFB2BC145B4849FA01A1A87998A"><enum>(1)</enum><header>Council</header><text>The term <term>Council</term> means the DHS Trade and Economic Security Council established under subsection (b).</text></paragraph><paragraph id="id979E0CEC7FE54D4197A444674F35BC5E"><enum>(2)</enum><header>Department</header><text>The term <term>Department</term> refers to the Department of Homeland Security.</text></paragraph><paragraph id="id4571045711BE4B0EB0B5CCE06B0D0CDB"><enum>(3)</enum><header>Economic security</header><text display-inline="yes-display-inline">The term <term>economic security</term> means the condition of having secure and resilient domestic production capacity combined with reliable access to the global resources necessary to maintain an acceptable standard of living and protect core national values.</text></paragraph><paragraph id="id623E2C958F4B4E1CBE5F7E771F14F4E7"><enum>(4)</enum><header>Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the Secretary of the Department of Homeland Security.</text></paragraph></subsection><subsection id="id7B5B37981E804830A6EB5B2D6CED31AC"><enum>(b)</enum><header>DHS Trade and Economic Security Council</header><text>In accordance with the mission of the Department under section 101(b) of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/111">6 U.S.C. 111(b)</external-xref>), and in particular paragraph (1)(F) of that subsection, the Secretary shall establish a standing council of component heads or their designees within the Department known as the <quote>DHS Trade and Economic Security Council</quote>.</text></subsection><subsection id="H7EE6B4D261674D8CBFB845BE89695B77"><enum>(c)</enum><header>Duties of the Council</header><text>Pursuant to the scope of the Department's mission as described in subsection (b), the Council shall provide to the Secretary advice and recommendations on matters of trade and economic security, including—</text><paragraph id="H0C1B23D680C046A781B21AF214612928"><enum>(1)</enum><text>identifying concentrated risks for trade and economic security;</text></paragraph><paragraph id="HCC87B4C03D0F431E8AFEE0382487807E"><enum>(2)</enum><text>setting priorities for securing the trade and economic security of the United States;</text></paragraph><paragraph id="H2676D1E260754897833F9B6603EB502B"><enum>(3)</enum><text>coordinating Department-wide activity on trade and economic security matters;</text></paragraph><paragraph commented="no" id="HDC25DEDDB697418EB9CB153B4F5F7AAD"><enum>(4)</enum><text display-inline="yes-display-inline">with respect to the development of the President’s continuity of the economy plan under section 9603 of the William M. (Mac) Thornberry National Defense Authorization Act of Fiscal Year 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/116/283">Public Law 116–283</external-xref>);</text></paragraph><paragraph id="H1534FBBAE8B846C996EED3FD66465790"><enum>(5)</enum><text>proposing statutory and regulatory changes impacting trade and economic security; and</text></paragraph><paragraph id="HEA75D7E4DC4D42338346A6929E5FF1F3"><enum>(6)</enum><text>any other matters the Secretary considers appropriate.</text></paragraph></subsection><subsection id="H204D0416238F4D0BBE145011AA9364FE" commented="no"><enum>(d)</enum><header>Chair and Vice Chair</header><text>The Assistant Secretary for Trade and Economic Security of the Department—</text><paragraph commented="no" id="id9340147F06854FAFB1379D0417CDE9F6"><enum>(1)</enum><text>shall serve as Chair of the Council; and</text></paragraph><paragraph commented="no" id="idE9B7A9B7E04F49738E4167C3965E8E27"><enum>(2)</enum><text>may designate a Council member as a Vice Chair.</text></paragraph></subsection><subsection id="HB8DF99F431824953BC7CCEAADA2DD0F3"><enum>(e)</enum><header>Meetings</header><text>The Council shall meet not less frequently than quarterly, as well as—</text><paragraph id="H7CBEE72F7BE24AF9B5DC1D58A965F460"><enum>(1)</enum><text>at the call of the Chair; or</text></paragraph><paragraph id="H8F9EE77ACDC546D593479313A1AC6936"><enum>(2)</enum><text>at the direction of the Secretary.</text></paragraph></subsection><subsection id="H491457A5C5F143438AE11318E9B2BD6C"><enum>(f)</enum><header>Briefings</header><text>Not later than 180 days after the date of enactment of this Act and every 6 months thereafter for 4 years, the Council shall brief the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Homeland Security of the House of Representatives on the actions and activities of the Council.</text></subsection></section><section id="H0089D621577749EFB3A35E05CC6950DD"><enum>3.</enum><header>Assistant Secretary for Trade and Economic Security</header><text display-inline="no-display-inline">Section 709 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/349">6 U.S.C. 349</external-xref>) is amended—</text><paragraph id="HDEB398EE08FA44749468B0D1053740B3"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating subsection (g) as subsection (h); and</text></paragraph><paragraph id="H2C9E8FA5B6304BE1860F721F83F3CF9A"><enum>(2)</enum><text>by inserting after subsection (f) the following new subsection:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H84BAB9F703D84125A0C120F5867CBD73"><subsection id="HBA1E76116A664931B62E93E6FC1D5146"><enum>(g)</enum><header>Assistant Secretary for Trade and Economic Security</header><paragraph id="HC9AE3404BCE54757A5D8EDE8CE6A2458"><enum>(1)</enum><header>In general</header><text>There is established within the Office of Strategy, Policy, and Plans an Assistant Secretary for Trade and Economic Security.</text></paragraph><paragraph id="H7B8B0E32DF394DFEAF1F7285BB9549C8"><enum>(2)</enum><header>Duties</header><text>The Assistant Secretary for Trade and Economic Security shall be responsible for policy formulation regarding matters relating to economic security and trade, as such matters relate to the mission and the operations of the Department.</text></paragraph><paragraph id="HD18FD7CDCE444E15BD988A5B22B25CE3"><enum>(3)</enum><header>Additional responsibilities</header><text>In addition to the duties specified in paragraph (2), the Assistant Secretary for Trade and Economic Security shall—</text><subparagraph id="HA5D8A7698F9E4D04A1011155B422B2BB"><enum>(A)</enum><text>oversee—</text><clause id="HF11BBBF88F5F4D6DB0C1A310BAA1D5CC"><enum>(i)</enum><text>coordination of supply chain policy; and</text></clause><clause id="H68DD9B92546D4A758B94E89E9664981F"><enum>(ii)</enum><text>assessments and reports to Congress related to critical economic security domains;</text></clause></subparagraph><subparagraph id="H282B12ACCA7347D586F97882BEA40288"><enum>(B)</enum><text>serve as the designee of the Secretary for the purposes of representing the Department on the Committee on Foreign Investment in the United States, and the Committee for the Assessment of Foreign Participation in the United States Telecommunications Services Sector; </text></subparagraph><subparagraph id="H08157974634E49F1AB5FBB2B3B5016FA"><enum>(C)</enum><text>coordinate with stakeholders in other Federal departments and agencies and non-governmental entities with trade and economic security interests, authorities, and responsibilities; and</text></subparagraph><subparagraph id="H2015B7A6B21742B186177C6260FDF067"><enum>(D)</enum><text>perform such additional duties as the Secretary or the Under Secretary of Strategy, Policy, and Plans may prescribe.</text></subparagraph></paragraph><paragraph id="HBCCB6C485A2444449EE2F8C2EA49938A"><enum>(4)</enum><header>Definitions</header><text>In this subsection:</text><subparagraph id="HFAB4E5C0D8CF44BBA28C7E379123A6CF"><enum>(A)</enum><header>Critical economic security domain</header><text>The term <term>critical economic security domain</term> means any infrastructure, industry, technology, or intellectual property (or combination thereof) that is essential for the economic security of the United States.</text></subparagraph><subparagraph id="HF4E4A3546D144207BBA2068A941C403D"><enum>(B)</enum><header>Economic security</header><text>The term <term>economic security</term> has the meaning given that term in section 890B(c)(2).</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
