which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To prevent gun trafficking.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Hadiya Pendleton and Nyasia Pryear-Yard Gun Trafficking and Crime Prevention Act of 2022</short-title></quote>.</text></section><section id="idb5f538b8c27746d38599b3a63adf4fe6"><enum>2.</enum><header>Firearms trafficking</header><subsection id="id8e5992b79aa04ee8b6eb9b9bb12ad642"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/44">Chapter 44</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="id978e2bb8a4b9440694956f3558ff7478"><section id="id62e1a3cdff684562be6a15b3afec0823"><enum>932.</enum><header>Trafficking in firearms</header><subsection id="idc7821563b569420381da1882480a9e7f"><enum>(a)</enum><header>Definitions</header><text>In this section—</text><paragraph id="idae6a6a79ec744cf6af8b699593738447"><enum>(1)</enum><text>the term <term>actual buyer</term> means the individual for whom a firearm is being purchased, received, or acquired; and</text></paragraph><paragraph id="ide59aea5f91314a0c82ceb3c598a58302"><enum>(2)</enum><text>the term <term>term of imprisonment exceeding 1 year</term> does not include any offense classified by the applicable jurisdiction as a misdemeanor and punishable by a term of imprisonment of 2 years or less.</text></paragraph></subsection><subsection id="id432b8c9e65b641cda42ea2020b20279d"><enum>(b)</enum><header>Offenses</header><text>It shall be unlawful for any person, regardless of whether anything of value is exchanged—</text><paragraph id="idd114ed9988ef4165bf8145adc5ddc75e"><enum>(1)</enum><text>to ship, transport, transfer, or otherwise dispose to a person, 2 or more firearms in or affecting interstate or foreign commerce, if the transferor knows or has reasonable cause to believe that the use, carrying, or possession of a firearm by the recipient would be in violation of, or would result in a violation of, any Federal, State, or local law punishable by a term of imprisonment exceeding 1 year;</text></paragraph><paragraph id="ide8786f0e55db4ce2ae3866eec8ec5539"><enum>(2)</enum><text>to receive from a person, 2 or more firearms in or affecting interstate or foreign commerce, if the recipient knows or has reasonable cause to believe that such receipt would be in violation of, or would result in a violation of, any Federal, State, or local law punishable by a term of imprisonment exceeding 1 year;</text></paragraph><paragraph id="id50d8e554cf7d4b9e90fb9d02270cd541"><enum>(3)</enum><text>to make a statement to a licensed importer, licensed manufacturer, or licensed dealer relating to the purchase, receipt, or acquisition from a licensed importer, licensed manufacturer, or licensed dealer of 2 or more firearms that have moved in or affected interstate or foreign commerce that—</text><subparagraph id="id0307dd399c2c4a498fa092ab0f97cb97"><enum>(A)</enum><text>is material to—</text><clause id="id10430cb4b5984cb7a9fad401b6ffa894"><enum>(i)</enum><text>the identity of the actual buyer of the firearms; or</text></clause><clause id="id959cbc4b6b6845a7b5c3248a5f5df8a8"><enum>(ii)</enum><text>the intended trafficking of the firearms; and</text></clause></subparagraph><subparagraph id="id8f4345bb131b41a98e3b301f47c8d759"><enum>(B)</enum><text>the person knows or has reasonable cause to believe is false; or</text></subparagraph></paragraph><paragraph id="id3c466f63606b490591428bdc40b334a3"><enum>(4)</enum><text>to direct, promote, or facilitate conduct specified in paragraph (1), (2), or (3).</text></paragraph></subsection><subsection id="id00232ba81c1a4893a5973c23daf1e853"><enum>(c)</enum><header>Gift exceptions</header><text>Subsection (b) shall not apply to a firearm that is—</text><paragraph id="idfb0602aad1614b9bb32c53dfd9e340f9"><enum>(1)</enum><text>lawfully acquired by a person to be given as a gift to another person not prohibited from possessing a firearm under Federal or State law; or</text></paragraph><paragraph id="id3798dfaeeed646d18a1ffcaae08d4a0f"><enum>(2)</enum><text>lawfully received or otherwise acquired—</text><subparagraph id="id2CEAE7812DC5450B8DE060E9A6F3DB63"><enum>(A)</enum><text>by a court-appointed trustee, receiver, or conservator for, or on behalf of, an estate or creditor; or</text></subparagraph><subparagraph id="id172A95E8D7C440E7AA091A08102D7842"><enum>(B)</enum><text>by a person to carry out a bequest, or an acquisition by intestate succession under the laws of the State of residence of the person.</text></subparagraph></paragraph></subsection><subsection id="id46093ff3333447a59cf2401ca0979e88"><enum>(d)</enum><header>Penalties</header><paragraph id="id5d4a7a49e6f94fe8a71ce71779814e23"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), any person who violates, or conspires to violate, subsection (b) shall be fined under this title, imprisoned for not more than 20 years, or both. </text></paragraph><paragraph id="id83308318525344d98828ddde772b28c7"><enum>(2)</enum><header>Organizer enhancement</header><text>If an individual violates subsection (b) in concert with 5 or more other individuals, and the individual planned the violation or recruited or directed one of the other individuals to commit the violation—</text><subparagraph id="idF69F8EF23DB44C1582FDC60EBC8A59DA"><enum>(A)</enum><text>the maximum term of imprisonment shall be 25 years; and </text></subparagraph><subparagraph id="id2A223FBB99194CA88B48AA1552C57710"><enum>(B)</enum><text>if a firearm involved in the violation is a machinegun or destructive device, or is equipped with a firearm silencer or muffler, the maximum term of imprisonment shall be 35 years.</text></subparagraph></paragraph><paragraph id="id880f071a87f24772b3eb840c60479a44"><enum>(3)</enum><header>Licensees</header><subparagraph id="id340e55da54fe4bfb836aa97bb619141c"><enum>(A)</enum><header>Criminal penalties for knowing facilitation of trafficking through sale or delivery of firearms</header><text>If a licensed manufacturer, licensed importer, licensed collector, or licensed dealer knowingly facilitates a violation of subsection (b), the licensee shall be fined $20,000 per trafficked firearm sold or delivered by the licensee, imprisoned for not more than 10 years, or both.</text></subparagraph><subparagraph id="idce767856fa8a4045bff5ecbefaa0fd16"><enum>(B)</enum><header>Civil penalties for sale or delivery of firearms with reckless disregard of trafficking</header><text>In the case of any licensed manufacturer, licensed importer, licensed collector, or licensed dealer who recklessly disregards that a person is acquiring 2 or more firearms from the licensee in violation of or with intent to violate subsection (b), the Attorney General shall, after notice and opportunity for a hearing, impose a civil penalty that is not less than $5,000 and not more than $10,000 per trafficked firearm sold or delivered by the licensee.</text></subparagraph><subparagraph id="id6b25fa32af48482eaeea38392eaf5d15"><enum>(C)</enum><header>License suspension or revocation</header><text>If the Attorney General determines, after notice and opportunity for a hearing, that firearms were acquired by or from a licensed manufacturer, licensed importer, licensed collector, or licensed dealer in violation of subsection (b) and the licensee knew, had reasonable cause to believe, or recklessly disregarded that the firearms were acquired in violation of that subsection, the Attorney General—</text><clause id="idcdc410d8687e4845a5d6f22a97fb93b3"><enum>(i)</enum><text>may suspend or revoke the license issued to the licensee under this chapter for not more than 1 year; and</text></clause><clause id="id9b6aa120705442ca880ae83a2913b5e0"><enum>(ii)</enum><text>if the license issued to the licensee under this chapter has previously been suspended or revoked under clause (i), may revoke the license for not more than 5 years. </text></clause></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id407a501c7f624c69a6fd26c5a299abaf"><enum>(b)</enum><header>Technical and conforming amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/44">chapter 44</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id61FDB753E5A14CCE9F0EFDA9BA4A8019"><toc><toc-entry level="section" bold="off">932. Trafficking in firearms.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idE71A7B4AD0B948CABD96E6F38A61D800"><enum>(c)</enum><header>Directive to sentencing commission</header><paragraph id="id4de6af9a4ea2402891dd57ca7f702f5c"><enum>(1)</enum><header>In general</header><text>Pursuant to its authority under section 994(p) of title 28, United States Code, the United States Sentencing Commission shall review and, if appropriate, amend the Federal sentencing guidelines and policy statements applicable to persons convicted of offenses under section 932 of title 18, United States Code (as added by subsection (a)).</text></paragraph><paragraph id="id7fe4bb375fab4428b687d8768c762ac8"><enum>(2)</enum><header>Requirements</header><text>In carrying out this subsection, the Commission shall—</text><subparagraph id="id5E7A9BC5F2C341DCABFA29CA51BF7145"><enum>(A)</enum><text>review the penalty structure that the Federal sentencing guidelines currently provide based on the number of firearms involved in the offense; and </text></subparagraph><subparagraph id="id67694F7DAC694B0EA50244FC1DADD193"><enum>(B)</enum><text>determine whether any changes to that penalty structure are appropriate in order to carry out the intent of Congress that those penalties reflect—</text><clause id="id87B2B9B9DDF240399F5A5E4A14935A3F"><enum>(i)</enum><text>the gravity of the offense;</text></clause><clause id="id7278F3A4E5304CF997770C7E41DCAF37"><enum>(ii)</enum><text>the number of trafficked firearms purchased by or from the defendant;</text></clause><clause id="idE39B1E74899244F9AB5F3AD6B4889E02"><enum>(iii)</enum><text>the extent of the defendant’s knowledge about the overall scheme to traffic firearms;</text></clause><clause id="id21C07FE892114CD7A09CDE66D6F5F2FC"><enum>(iv)</enum><text>the amount of money or value of nonmonetary compensation provided to the defendant for the defendant’s participation; and </text></clause><clause id="id7A6FB6E6561844D18AF17F9411C075B5"><enum>(v)</enum><text>the defendant’s culpability, including—</text><subclause id="idA4CF504BBF5A4371BB1D4D95E5FDD035"><enum>(I)</enum><text>as mitigating factors, whether the defendant—</text><item id="id18F3EA4C74004A1AB5909C7D20336535"><enum>(aa)</enum><text>is a relative or current or former intimate partner of another individual involved in a conspiracy to traffic firearms;</text></item><item id="idBE906364CD2C498DB632C7475EA68868"><enum>(bb)</enum><text>is a domestic violence survivor; or</text></item><item id="id4FDE025CB78F467C8723E17123E5EDE7"><enum>(cc)</enum><text>has been otherwise exploited by personal affection, fear of reprisals, or economic need to commit an offense under section 932 of title 18, United States Code (as added by subsection (a)); and</text></item></subclause><subclause id="idACBB41CD78CA471FA07D834941AE382C"><enum>(II)</enum><text>as aggravating factors, whether—</text><item id="idB8819570A3CD4E1B9BC8BF060096F599"><enum>(aa)</enum><text>the trafficked firearms were used in additional crimes;</text></item><item id="idAC59B92E572D478DA9E37FEA78652A08"><enum>(bb)</enum><text>a person was injured or killed with the trafficked firearms; or</text></item><item id="id2F3C08378CBA4E16940E2D41348B1A6D"><enum>(cc)</enum><text>the defendant was previously convicted of a firearms-related offense.</text></item></subclause></clause></subparagraph></paragraph></subsection><subsection id="id7168ef76e78b4d8783c9c509a43f12a5"><enum>(d)</enum><header>Directive to the Attorney General</header><text>Not later than 2 years after the date of enactment of this Act, and annually thereafter, the Attorney General shall submit to the Committee on the Judiciary of the Senate and the Committee on the Judiciary of the House of Representatives a report containing the following information:</text><paragraph id="id1ab70c25ecad4cfb89081d1001fc62a0"><enum>(1)</enum><text>For the prior 12-month period—</text><subparagraph id="id8AF981643A2A407BAB4E6ABADC6D3F74"><enum>(A)</enum><text>the number of investigations initiated for violations of section 932 of title 18, United States Code (as added by subsection (a)); </text></subparagraph><subparagraph id="id201BCA118437406FA2ACBA2F6FF2328B"><enum>(B)</enum><text>the number of Federal firearm licensees or other individuals or entities—</text><clause id="id3CA51545FDAD48CE895B9C3067B69FA6"><enum>(i)</enum><text>that were criminally charged with a violation described in subparagraph (A); or</text></clause><clause id="id8FD5E86A97BA41F89F8884BFD482A41B"><enum>(ii)</enum><text>against whom a civil penalty case was initiated for a violation described in subparagraph (A); and</text></clause></subparagraph><subparagraph id="id97866B037CC945AF8CE7F74CAF77622B"><enum>(C)</enum><text>the number of investigations described in subparagraph (A) referred to the Attorney General from the Bureau of Alcohol, Tobacco, Firearms, and Explosives, the Federal Bureau of Investigation, or any other Federal law enforcement agency that did not result in criminal charges or the initiation of a civil penalty case. </text></subparagraph></paragraph><paragraph id="idd39e399e165a40ce9aefc7c21b0c8ffb"><enum>(2)</enum><text>To the extent the information is available, the average length of the sentences of imprisonment and average fines imposed on individuals, entities, and Federal firearm licensees convicted of violations of section 932 of title 18, United States Code, (as added by subsection (a)) during the prior 12-month period.</text></paragraph><paragraph id="idb40b99ed9f794799ac782af1029f8463"><enum>(3)</enum><text>A narrative describing the firearm trafficking schemes prosecuted under section 932 of title 18, United States Code, (as added by subsection (a)) during the prior 12-month period, including—</text><subparagraph id="id3846712C8C124A4FA16BDFDB25C89B8C"><enum>(A)</enum><text>the sources of firearms; </text></subparagraph><subparagraph id="idE7180C252A604D03AF6ABDFBF31EE2A3"><enum>(B)</enum><text>the roles of various defendants in the scheme;</text></subparagraph><subparagraph id="idF7363741DB054365807053CAD7A0C07D"><enum>(C)</enum><text>the number of firearms trafficked; and </text></subparagraph><subparagraph id="idDF1104317EDD44FA9166411B5D21C680"><enum>(D)</enum><text>a description of any trafficking practices or trends common among various firearm trafficking schemes. </text></subparagraph></paragraph></subsection></section><section id="id5d04715b86004ae39a6e667897a969d1"><enum>3.</enum><header>Removing relief from disabilities exception for licensees indicted for firearms trafficking</header><text display-inline="no-display-inline">Section 925(b) of title 18, United States Code, is amended by inserting <quote>other than firearms trafficking under section 932,</quote> after <quote>indicted for a crime punishable by imprisonment for a term exceeding one year,</quote>.</text></section><section id="id346b18702d804929b70ad1297a0fe1e9"><enum>4.</enum><header>Elimination of obligatory stay of effective date of license revocation</header><text display-inline="no-display-inline">Section 923(f)(2) of title 18, United States Code, is amended by striking the period at the end of the second sentence and inserting the following: <quote>unless the revocation is based in whole or in part on a violation of section 932, in which case, the Attorney General may only stay the effective date of the revocation upon a showing by the holder that good cause exists to do so.</quote>.</text></section></legis-body></bill>
