</text></paragraph><paragraph id="idc8d733117faa4084ae0057223a74aaac"><enum>(2)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior. </text></paragraph></section><title id="id77b47c532435486b9ac0636a62da8dac"><enum>I</enum><header>Water data</header><section id="idef69a94b707747fbb9d9e8af67b4607e"><enum>101.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text><paragraph id="id0679e69c352c4cd19edcb2726cd86e54"><enum>(1)</enum><header>Advisory committee</header><text>The term <term>Advisory Committee</term> means the Advisory Committee on Water Information established by section 104(a).</text></paragraph><paragraph id="id015ed1a894f44680a2b52b2fbdfb7313"><enum>(2)</enum><header>Council</header><text>The term <term>Council</term> means the Water Data Council established under section 103(a).</text></paragraph><paragraph id="id624e20143fde44c59bf9fe19f5ba8da1"><enum>(3)</enum><header>Data standards</header><text>The term <term>data standards</term> means standards relating to the manner in which data are to be structured, populated, and encoded in machine-readable formats, and made interoperable for data exchange.</text></paragraph><paragraph id="id739d855ed28e415cb28620d229545d61"><enum>(4)</enum><header>Departments</header><text>The term <term>Departments</term> means each of the following:</text><subparagraph id="id68ad3bdb90ad4e5b91182e116a96ead5"><enum>(A)</enum><text>The Department of Agriculture.</text></subparagraph><subparagraph id="id025c2d66102f473b815ce84a480498e5"><enum>(B)</enum><text>The Department of Commerce.</text></subparagraph><subparagraph id="idf4e1f5b79b474045af896b0ecf410b74"><enum>(C)</enum><text>The Department of Defense.</text></subparagraph><subparagraph id="id8ed0b6dfce07453b872f2f5bac89d496"><enum>(D)</enum><text>The Department of Energy.</text></subparagraph><subparagraph id="id8c1f80867d154c72bf679e1afe168192"><enum>(E)</enum><text>The Department of Health and Human Services.</text></subparagraph><subparagraph id="id88727dd0777f4d0a9c2fd577b3071e28"><enum>(F)</enum><text>The Department of Homeland Security.</text></subparagraph><subparagraph id="id9ae9e4a4065f4827bb751a2096202989"><enum>(G)</enum><text>The Department of the Interior.</text></subparagraph><subparagraph id="id8f1e517837754845a103c945343e4038"><enum>(H)</enum><text>The Environmental Protection Agency.</text></subparagraph><subparagraph id="id1f8ecdac5b5344ccbadd7672037ead30"><enum>(I)</enum><text>The National Aeronautics and Space Administration. </text></subparagraph></paragraph><paragraph id="ide2ad561b56e4405c851f64fa1648f463"><enum>(5)</enum><header>National Water Data Framework</header><text>The term <term>National Water Data Framework</term> means the national water data framework developed under section 102.</text></paragraph><paragraph id="idd659c6ff87e84288817b9f178899263c"><enum>(6)</enum><header>Water data</header><text>The term <term>water data</term> means measurements of basic properties relating to the planning and management of water resources, including streamflow, precipitation, groundwater, soil moisture, snow, evaporation, water quality, and water use in agriculture, industry, natural systems, and municipal uses.</text></paragraph><paragraph id="id6a00e7620ce545a4b91c36d630b98d16"><enum>(7)</enum><header>Water Data Grant Program</header><text>The term <term>Water Data Grant Program</term> means the water data grant program established under section 105(a). </text></paragraph><paragraph id="id56c84714bc2643b0a5957ec7b7c74bf2"><enum>(8)</enum><header>Water data infrastructure</header><text>The term <term>water data infrastructure</term> means an integrated system of information technologies that includes common standards, formats, and tools to make water data easy to find, access, and share online.</text></paragraph></section><section id="idfdffd4a775db47c6b599b7c5845cffb5"><enum>102.</enum><header>National Water Data Framework</header><subsection id="ide3a53b41cdbf48659794d5b43101b953"><enum>(a)</enum><header>In general</header><text>For the purpose of improving water resources management and access across the United States, including addressing drought, floods, and other water management challenges, the heads of the Departments shall jointly develop and implement a national water data framework for integrating, sharing, and using water data.</text></subsection><subsection id="id64867a406d254a0e9d69eb6e9cd11e48"><enum>(b)</enum><header>Requirements</header><text>In developing and implementing the National Water Data Framework, the Departments shall—</text><paragraph id="idf05504bb72b54b288ef32617a2c72e35"><enum>(1)</enum><text>identify and prioritize key water data needed to support water resources management and planning, including—</text><subparagraph id="id673f7f884d254f8680f2d775126faa19"><enum>(A)</enum><text>water data sets, types, and associated metadata; and</text></subparagraph><subparagraph id="id52c06d9fe2ba429e9b5e85c1ff3e83b7"><enum>(B)</enum><text>water data infrastructure, technologies, and tools;</text></subparagraph></paragraph><paragraph id="id1f5d37d896224105b9cc577dec3557ff"><enum>(2)</enum><text>develop and adopt common national water data standards for collecting, sharing, and integrating water data, infrastructure, technologies, and tools in consultation with States, Indian Tribes, local governments, and relevant bodies;</text></paragraph><paragraph id="idaa4ce83487a14c0e88b1da12d78dc77d"><enum>(3)</enum><text>ensure that Federal water data are made findable, accessible, interoperable, and reusable in accordance with the standards developed and adopted pursuant to this title;</text></paragraph><paragraph id="id3ad986d4a4464967ad3514f23d9d390c"><enum>(4)</enum><text>integrate water data and tools through common approaches to data infrastructure, platforms, models, and tool development;</text></paragraph><paragraph id="id4d9840c3185941978842e4f656e9fbda"><enum>(5)</enum><text>establish a common, national geospatial index for publishing and linking water data from Federal, State, Tribal, and other non-Federal sources for online discovery;</text></paragraph><paragraph id="idc2308c2c98b3484da5721c3c316d57a9"><enum>(6)</enum><text>harmonize and align policies, programs, protocols, budgets, and funding programs relating to water data to achieve the purposes of this title to the maximum extent practicable;</text></paragraph><paragraph id="id77d2307d0ca24df2959cce15140b3558"><enum>(7)</enum><text>participate in and coordinate water data activities with the Council; and</text></paragraph><paragraph id="id258143ed6e6745939fa8fb6163aa8395"><enum>(8)</enum><text>support the adoption of new technologies and the development of tools for water data collection, sharing, and standardization by Federal, State, Tribal, local, and other entities.</text></paragraph></subsection></section><section id="id1c8f946d88de490aa38ce1cc98e7d4c4"><enum>103.</enum><header>Water Data Council</header><subsection id="id2263044184694977970e81a7b9a0f3f3"><enum>(a)</enum><header>In general</header><text>The heads of the Departments shall establish an interagency Council, to be known as the <quote>Water Data Council</quote>, to support the development and implementation of the National Water Data Framework.</text></subsection><subsection id="id740c8030c9c54dababb68ad0620e8e3e"><enum>(b)</enum><header>Membership</header><paragraph id="id4ecef8b530f743c7bb48bde67a9c5b47"><enum>(1)</enum><header>Duties of Secretary</header><text>The Secretary shall—</text><subparagraph id="id5e2a8718c3db478dbbb9c88d43497327"><enum>(A)</enum><text>serve as the Chair of the Council;</text></subparagraph><subparagraph id="id8ae71cf8d6fa40d9ab41475a3f006338"><enum>(B)</enum><text>in collaboration with the Office of Science and Technology Policy, convene the Council not less frequently than 4 times each year; and</text></subparagraph><subparagraph id="id8d6f4d4bd5de4aae9a121d497dffe85b"><enum>(C)</enum><text>provide staff support for the Council through the United States Geological Survey.</text></subparagraph></paragraph><paragraph id="id7642cc26a00541198975adf1e0f1bf6a"><enum>(2)</enum><header>Members</header><text>Council Members shall include the heads of the following entities:</text><subparagraph id="id412ffbdfd6b840b2b9dd474ea9e63e7d"><enum>(A)</enum><text>The Departments.</text></subparagraph><subparagraph id="id3f6ff89c6f5446a587485fc57827974b"><enum>(B)</enum><text>Bureaus and offices of the Departments that have a significant role or interest in water data, including—</text><clause id="id514f0d503395443cab78b69a4f78466e"><enum>(i)</enum><text>the Corps of Engineers;</text></clause><clause id="id5aee03b189624ba2b9f20e8272b49fbb"><enum>(ii)</enum><text>the Bureau of Indian Affairs;</text></clause><clause id="id3b35573e54dc4fa4a2fb53dfdcc274a3"><enum>(iii)</enum><text>the Bureau of Reclamation;</text></clause><clause id="id8b542d65c00748aabdf0dfd069da80b9"><enum>(iv)</enum><text>the Federal Emergency Management Agency;</text></clause><clause id="id5e2425afe5e246a39f71c6b8de6bf793"><enum>(v)</enum><text>the Federal Energy Regulatory Commission;</text></clause><clause id="id04399e98bded4426b0ac45d4b7097a8c"><enum>(vi)</enum><text>the United States Fish and Wildlife Service;</text></clause><clause id="id3f0ad210e1f5449397fdda7f14d4ca50"><enum>(vii)</enum><text>the Indian Health Service;</text></clause><clause id="id1ee7b4ce2411460893bcc84190b9ff68"><enum>(viii)</enum><text>the Forest Service;</text></clause><clause id="id70dbd2053d8041b69dea1886639746fe"><enum>(ix)</enum><text>the National Laboratories;</text></clause><clause id="id7819ea7710a3428f9ca2ddb9dda9dc51"><enum>(x)</enum><text>the Natural Resources Conservation Service;</text></clause><clause id="id818aaae85a454f619df3ccb00888e15a"><enum>(xi)</enum><text>the National Oceanic and Atmospheric Administration;</text></clause><clause id="id43716484e2064328ad4fbe8fd39c700c"><enum>(xii)</enum><text>the Rural Development program of the Department of Agriculture; and</text></clause><clause id="idaf032a17e85648719e7e22f867a2495f"><enum>(xiii)</enum><text>the United States Geological Survey.</text></clause></subparagraph><subparagraph id="id027f4a9f14e248788276bb618a638a0e"><enum>(C)</enum><text>Offices of the Executive Office of the President, including—</text><clause id="id44de0d52720d4d7bb3d45d37f93e2384"><enum>(i)</enum><text>the Council on Environmental Quality;</text></clause><clause id="id715e82364dfc4a54948c585f8f23b91f"><enum>(ii)</enum><text>the Office of Management and Budget; and</text></clause><clause id="id5e714290ccef480d84c915f7163c0acc"><enum>(iii)</enum><text>the Office of Science and Technology Policy.</text></clause></subparagraph><subparagraph id="id80e8bad9c4484f6b8482a328ccb34404"><enum>(D)</enum><text>Other Federal entities that the Chair and a majority of the members of the Council described in subparagraphs (A) through (C) determine to be appropriate.</text></subparagraph></paragraph></subsection><subsection id="id358b3237690442ec826a3beb5fc6589c"><enum>(c)</enum><header>Duties</header><text>The Council shall—</text><paragraph id="id8b58ca31f9fb418da21b9b473f288378"><enum>(1)</enum><text>support the development and implementation of the National Water Data Framework; and</text></paragraph><paragraph id="id2c96888e68d14b7f85c305454453a14f"><enum>(2)</enum><text>facilitate communication and collaboration among members of the Council—</text><subparagraph id="id924bc15660a24580b9ccf943581b9928"><enum>(A)</enum><text>to establish, adopt, and implement common national water data standards;</text></subparagraph><subparagraph id="id11b857d04ab444568257376c7771413b"><enum>(B)</enum><text>to promote water data sharing and integration across Federal departments and agencies, including—</text><clause id="idada23021b0e94bc696837ce45219963f"><enum>(i)</enum><text>water data collection, documentation, maintenance, distribution, and preservation strategies; and</text></clause><clause id="id4ff4e311c9dc41bfa76d737dc6141bbd"><enum>(ii)</enum><text>development and use of water data infrastructure, tools, and technologies to support water management and planning;</text></clause></subparagraph><subparagraph id="id01af7e914a3240a9b2ed5c8d3fd02c7e"><enum>(C)</enum><text>to align the policies, programs, protocols, budgets, and funding programs relating to water data of the members of the Council; and</text></subparagraph><subparagraph id="id13aedd54f1fb41b1a65f517a21ca8426"><enum>(D)</enum><text>to promote partnerships across Federal entities and non-Federal entities—</text><clause id="id29513e70c1c646c6880cf9fb4a025d23"><enum>(i)</enum><text>to advance innovation and solutions in water data, technology, tools, planning, and management; and</text></clause><clause id="id6f9b66a49b494c61bd3d705cd3d81f91"><enum>(ii)</enum><text>to develop guidelines for data sharing and protecting data privacy.</text></clause></subparagraph></paragraph></subsection><subsection id="idf527ee4544c2467a9b5cba8e57fa2373"><enum>(d)</enum><header>Water Data Council reports</header><text>Not later than 180 days after the date of enactment of this Act, and annually thereafter, in conjunction with the annual budget submission of the President to Congress under section 1105(a) of title 31, United States Code, the Secretary, acting on behalf of the Council, shall submit to members of the Council and the appropriate committees of Congress and make available publicly online a report that describes—</text><paragraph id="id77f90cd6bef4447995c786bf6dae245c"><enum>(1)</enum><text>the National Water Data Framework;</text></paragraph><paragraph id="id7052dd1ed3924e749f14095f5c2c4e22"><enum>(2)</enum><text>the actions undertaken by the Departments to implement this title pursuant to section 102;</text></paragraph><paragraph id="id4fac5b6b270749fd86d6e7505623f396"><enum>(3)</enum><text>key water data sets, types, and infrastructure needed to support water management and planning;</text></paragraph><paragraph id="id53d0ef2279f84228b78395a9798a94bf"><enum>(4)</enum><text>goals, targets, and actions to carry out the National Water Data Framework in the subsequent fiscal year;</text></paragraph><paragraph id="id4aea0d0e5e6843ae9ece514481ed28c3"><enum>(5)</enum><text>a summary and evaluation of the progress of the Departments in achieving any prior goals, targets, and actions to carry out the National Water Data Framework;</text></paragraph><paragraph id="idba2caa1331d942849d91e49615ea51dc"><enum>(6)</enum><text>actions needed to align policies, programs, and budgetary resources to carry out the National Water Data Framework in the subsequent fiscal year;</text></paragraph><paragraph id="idf0c4f5c3eca74de4a5cc92c25f43760b"><enum>(7)</enum><text>grants and assistance provided to State, Tribal, and local entities toward the development and adoption of new technologies and tools;</text></paragraph><paragraph id="id1123613da3ad465b96f0911325992328"><enum>(8)</enum><text>opportunities to develop and incentivize the deployment of promising next-generation technologies, including new water data technologies and tools, in partnership with the private sector and others to accomplish the purposes of this title; and</text></paragraph><paragraph id="id0bc67bbfc916473f9ce131e086723b62"><enum>(9)</enum><text>metrics for achieving the National Water Data Framework.</text></paragraph></subsection></section><section id="id1e402092be6c4a329a27f8d6fb1f9597"><enum>104.</enum><header>Advisory Committee on Water Information</header><subsection id="id794a606a4d8147e29d92cf73d18e29dd"><enum>(a)</enum><header>Establishment</header><text>There is established within the Department of the Interior an advisory committee, to be known as the <quote>Advisory Committee on Water Information</quote>, to advise the Secretary, Departments, and Council on the development and implementation of the National Water Data Framework.</text></subsection><subsection id="id547f2554dc1c4e56abf01694363bb58c"><enum>(b)</enum><header>Membership</header><paragraph id="id545392fa8aa341218927daa6a146c08d"><enum>(1)</enum><header>Composition</header><text>The Advisory Committee shall be composed of members, to be appointed by the Secretary in a manner that provides for—</text><subparagraph id="id42b6cdda38bc4499b42694ef5a9ee6e3"><enum>(A)</enum><text>balanced representation among various entities involved in water-related activities; and</text></subparagraph><subparagraph id="id8f8d21ee352642d6b6c2f7fdcd38b143"><enum>(B)</enum><text>consideration for a geographic balance of individuals representing localities across the United States.</text></subparagraph></paragraph><paragraph id="id62cb514ddaae4510813aa2029577d828"><enum>(2)</enum><header>Selection</header><text>Members of the Advisory Committee shall be selected by the Secretary from among entities involved in water-related activities, including—</text><subparagraph id="id62d7c94a23f4489489f21f9a1990094c"><enum>(A)</enum><text>States;</text></subparagraph><subparagraph id="idf665fa853d2448d48ffcd7c78b6d8fe9"><enum>(B)</enum><text>Indian Tribes;</text></subparagraph><subparagraph id="id644441edee72446cb56860215e900897"><enum>(C)</enum><text>local governments;</text></subparagraph><subparagraph id="id7b16e7d53cc544a287650479e4c1c49a"><enum>(D)</enum><text>Federal entities;</text></subparagraph><subparagraph id="idf4328e99b7be43fa9d68e9eba5db7e0a"><enum>(E)</enum><text>water agencies, utilities, conservation districts, irrigation districts, acequias, and other water user associations;</text></subparagraph><subparagraph id="idb9cda0e5f325451688a49a845b6ec434"><enum>(F)</enum><text>organizations that facilitate collaboration across States and multi-state instrumentalities;</text></subparagraph><subparagraph id="id9896c6f420eb452580d545b4db8e4374"><enum>(G)</enum><text>educational institutions;</text></subparagraph><subparagraph id="id767733c5341342518a2826e686938fa7"><enum>(H)</enum><text>professional organizations;</text></subparagraph><subparagraph id="id17e5dffae52f4dc389b2fd93a7f33729"><enum>(I)</enum><text>water data and technology-related experts, professionals, and industries;</text></subparagraph><subparagraph id="id2c2648ca8215442192bed2dc1118f0e6"><enum>(J)</enum><text>private sector entities; and</text></subparagraph><subparagraph id="id2f740bf8e55541039d29f28b4cc50257"><enum>(K)</enum><text>nonprofit organizations.</text></subparagraph></paragraph><paragraph id="id1dbf239bf3c34ff387a88308d2456f86"><enum>(3)</enum><header>Term</header><text>Members of the Advisory Committee shall be appointed by the Secretary for a term not to exceed 4 years.</text></paragraph></subsection><subsection id="idfab499aa2b734915b5b03407ee1baf05"><enum>(c)</enum><header>Chair</header><text>The Secretary shall serve as the Chair of the Advisory Committee.</text></subsection><subsection id="idab0f9c2ef61d4a57a12168de9ef3745a"><enum>(d)</enum><header>Staff support</header><text>The United States Geological Survey shall provide support services for the Advisory Committee.</text></subsection><subsection id="id44c817b11a314a30a6da75e237d9f639"><enum>(e)</enum><header>Meetings</header><text>The Advisory Committee shall meet at the call of the Chair, but not less frequently than 4 times each year.</text></subsection><subsection id="id0fbcda31b4824e5d87bfd4abf2661cb3"><enum>(f)</enum><header>Duties</header><text>The duties of the Advisory Committee are to advise the Secretary, Departments, and Council on—</text><paragraph id="idf9f67e10d9544955ad9d04e3d9299acb"><enum>(1)</enum><text>the development and implementation of the National Water Data Framework;</text></paragraph><paragraph id="id214f1c06d44d4ec2b3eb6d263c87c4f2"><enum>(2)</enum><text>efforts to operate a cost-effective national network of water data collection and analysis that meets the priority water information needs of the Federal Government and, to the extent practicable using available resources, the needs of the non-Federal community that are tied to national interests;</text></paragraph><paragraph id="id486442d63bc94dbb8a47d5f2bc289142"><enum>(3)</enum><text>efforts to develop uniform standards, guidelines, and procedures for the collection, analysis, management, and dissemination of water information to improve quality, consistency, and accessibility nationwide; and</text></paragraph><paragraph id="id2dc199cf605c4b80820727b7a42175bd"><enum>(4)</enum><text>the effectiveness of existing water information programs and recommended modifications needed to respond to changes in legislation, technology, and other conditions.</text></paragraph></subsection><subsection id="idfa1a0aed2ce946d1a5d561729435aed2"><enum>(g)</enum><header>Applicability of FACA</header><paragraph id="ida90f858d82e048699ae4a4f130714b12"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), the Federal Advisory Committee Act (5 U.S.C. App.) shall apply to the Advisory Committee.</text></paragraph><paragraph id="id746f3a80b85b44c79c68bda44442e41c"><enum>(2)</enum><header>No termination</header><text>Section 14(a)(2) of the Federal Advisory Committee Act (5 U.S.C. App.) shall not apply to the Advisory Committee.</text></paragraph></subsection></section><section id="idf8e0565365d247d7834260cdbb3d709d"><enum>105.</enum><header>Water data grant program</header><subsection id="id91b38fa943124c988910c160c01dec71"><enum>(a)</enum><header>In general</header><text>The Secretary shall establish a water data grant program under which the Secretary shall award grants—</text><paragraph id="id79e71e18be2243089fb1eb8ed0389b31"><enum>(1)</enum><text>to support non-Federal entities in making water data sets findable, accessible, interoperable, and reusable in accordance with the water data standards established under this title;</text></paragraph><paragraph id="idc7817954f2294b028852ec3455df729f"><enum>(2)</enum><text>to advance the development of water data infrastructure, tools, and technologies to facilitate the sharing and use of water data;</text></paragraph><paragraph id="id62689a0fc8e4497aadb6ef9f12def10f"><enum>(3)</enum><text>to support programs and projects that facilitate water data sharing and use in water resources management and the implementation of the National Water Data Framework; and</text></paragraph><paragraph id="ida3601d29d98047b0b66ce475915fa055"><enum>(4)</enum><text>to provide a prize for accelerating innovation and developing next-generation water data tools and technologies.</text></paragraph></subsection><subsection id="id225b48aa2aba4c73a8ef8c0e6c0eb124"><enum>(b)</enum><header>Coordination with the Council</header><text>The Secretary shall consult and coordinate with the Council in creating and implementing the Water Data Grant Program to ensure that—</text><paragraph id="ide29b02be1aa346fa8c0fad03e624cb4b"><enum>(1)</enum><text>the Water Data Grant Program is aligned with and carries out the purposes of this title; and</text></paragraph><paragraph id="id31bd5ce75be9488999e3ddb7055cbdf0"><enum>(2)</enum><text>grants and programs are harmonized across the Departments and members of the Council to achieve the purposes of this title.</text></paragraph></subsection><subsection id="id916e784570914adda50c83a8cea5dc2e"><enum>(c)</enum><header>Eligible entities</header><text>An entity eligible for a grant under the Water Data Grant Program—</text><paragraph id="id8aaedd1f4bf240c8be245ab648bb281e"><enum>(1)</enum><text>shall demonstrate significant needs or capabilities for advancing water data sharing and tools with a significant public benefit; and</text></paragraph><paragraph id="id258586ff84434cfab2a8c55aff282cd1"><enum>(2)</enum><text>may include—</text><subparagraph id="id04f36d83401844c9942075c5c66a2e29"><enum>(A)</enum><text>a State, multistate instrumentality, Indian Tribe, or other unit of local government;</text></subparagraph><subparagraph id="idba897600b1ed46ebb5fb49936edae2dd"><enum>(B)</enum><text>a water agency, utility, conservation district, irrigation district, acequia, mutual domestic association, or other entity organized pursuant to Federal, Tribal, or local laws for the purpose of water-related activities;</text></subparagraph><subparagraph id="id1647ac6f2cbd4d45a36246b4a5ec1c6d"><enum>(C)</enum><text>an educational institution or nonprofit organization; and</text></subparagraph><subparagraph id="idd1641427d3cc4f8f88700c4af3d3468e"><enum>(D)</enum><text>in the case of carrying out activities described in subsection (a)(4)—</text><clause id="id600fe02cd5094e38b6feb68c5eca85e3"><enum>(i)</enum><text>an individual who is a citizen or legal resident of the United States; or</text></clause><clause id="id36dcaa121cfd45e8923fedaf13dbcb18"><enum>(ii)</enum><text>an entity that is incorporated and maintains the primary place of business of the entity in the United States.</text></clause></subparagraph></paragraph></subsection><subsection id="id3ad6670628eb47be91f8f3b4e4ea9afa"><enum>(d)</enum><header>Requirements</header><paragraph id="ide546fdbf417145ce85d06118eb71182d"><enum>(1)</enum><header>Data sharing and standards</header><text>Any project funded through the Water Data Grant Program shall be implemented in accordance with the water data standards established under section 102.</text></paragraph><paragraph id="ide257d76764884a0f961d20f5886c77b5"><enum>(2)</enum><header>Use of existing water data infrastructure</header><text>The recipient of a grant shall, to the extent practicable, leverage existing water data and water data infrastructure.</text></paragraph></subsection><subsection id="id68179e25043342caa6ca76e6603f2ddc"><enum>(e)</enum><header>Report</header><text>Not later than 1 year after the date of enactment of this Act, and annually thereafter, in conjunction with the annual budget submission of the President to Congress under section 1105(a) of title 31, United States Code, the Secretary shall submit to Congress a report that describes the implementation of the Water Data Grant Program, including—</text><paragraph id="ided475662c16247fa9ed8640682a647ef"><enum>(1)</enum><text>a description of the use and deployment of amounts made available under the Water Data Grant Program;</text></paragraph><paragraph id="id188c875a096c41d7aabaf4e1e7bc2bd4"><enum>(2)</enum><text>an accounting of all grants awarded under the Water Data Grant Program, including a description of—</text><subparagraph id="idfff78a0809cd4f9a9a8cf3cca2481355"><enum>(A)</enum><text>each grant recipient; and</text></subparagraph><subparagraph id="id236dc0feb62d43038b4dc4018004a145"><enum>(B)</enum><text>each project funded under the Water Data Grant Program;</text></subparagraph></paragraph><paragraph id="idc1dff650ecaf40d1b3a34ab1a66cc055"><enum>(3)</enum><text>an assessment of the success of the Water Data Grant Program in advancing the purposes of this title; and</text></paragraph><paragraph id="id50d68d50796c49f0af601f3a03950fe9"><enum>(4)</enum><text>a plan for the subsequent fiscal year to achieve the purposes of this title.</text></paragraph></subsection><subsection id="idd5d81f1222464a279079a6d2853488de"><enum>(f)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Secretary to carry out the Water Data Grant Program $25,000,000 for each of fiscal years 2023 through 2027, to remain available until expended.</text></subsection><subsection id="id95bb0a86e8f343d98d5d55d54420c362"><enum>(g)</enum><header>Administrative costs</header><text>Of the funds authorized to be appropriated under subsection (f), not more than 3 percent may be used by the Secretary for administrative costs. </text></subsection></section><section id="id6d302b753e17457ab6a7b92582f0c396"><enum>106.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There is authorized to be appropriated to the Secretary to carry out sections 102 through 104 $15,000,000 for each of fiscal years 2023 through 2027, to remain available until expended.</text></section></title><title id="id7b1675db523947af9260326bf3e62bee"><enum>II</enum><header>Rio Grande water security</header><section id="id51fe310d69ae4962a15df8b47ec6c68e"><enum>201.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title:</text><paragraph id="id682b54e550d14c70b95a404b31142174"><enum>(1)</enum><header>Basin Plan</header><text>The term <term>Basin Plan</term> means the integrated water resources management plan for the Rio Grande Basin developed under section 202(a).</text></paragraph><paragraph id="id5b089805d4934dfe86c115666490bbdf"><enum>(2)</enum><header>Basin State</header><text>The term <term>Basin State</term> means each of the following States:</text><subparagraph id="id1a53f5843f8f4489a26482fa532697a5"><enum>(A)</enum><text>Colorado.</text></subparagraph><subparagraph id="id93261c28594d417b890e80f7e933dd8e"><enum>(B)</enum><text>New Mexico.</text></subparagraph><subparagraph id="id7d9713013dfe4f0c9a5415c0fbba26a7"><enum>(C)</enum><text>Texas.</text></subparagraph></paragraph><paragraph id="id52eb600d90124a569b51ced34034fbb4"><enum>(3)</enum><header>Nature-based feature</header><text>The term <term>nature-based feature</term> has the meaning given the term in section 9502 of the Omnibus Public Land Management Act of 2009 (<external-xref legal-doc="usc" parsable-cite="usc/42/10362">42 U.S.C. 10362</external-xref>). </text></paragraph><paragraph id="ide8d0fb40870e456e9afc5e951c86d8ed"><enum>(4)</enum><header>Rio Grande Basin</header><text>The term <term>Rio Grande Basin</term> means the mainstem of the Rio Grande from the headwaters of the Rio Grande in Colorado to the mouth of the Rio Grande in Texas and any hydrologically connected groundwater, aquifers, and tributaries, including tributaries that provide water via basin transfers.</text></paragraph><paragraph id="id95e708351eb445fc9d72565659432696"><enum>(5)</enum><header>Working group</header><text>The term <term>Working Group</term> means the Rio Grande Basin Working Group convened under section 202(a).</text></paragraph></section><section id="id9700b8928e834ff6bd479fa036a401b7"><enum>202.</enum><header>Integrated water resources management plan for the Rio Grande Basin</header><subsection id="id0725bf6c209d406098ac9cfd7c8284e1"><enum>(a)</enum><header>In general</header><text>Not later than 120 days after the date of enactment of this Act, the Secretary shall convene a Federal Working Group, to be known as the “Rio Grande Basin Working Group”, to consult and collaborate with the Basin States, Indian Tribes, units of local government, irrigation districts, conservation districts, acequias, land Grant-Mercedes, and other local partners in the Rio Grande Basin to develop and implement an integrated water resources management plan for the Rio Grande Basin using the best available science, data, and local knowledge.</text></subsection><subsection id="id1424a6d992c44d91a49cbc0e1454791e"><enum>(b)</enum><header>Purpose</header><text>The purpose of the Basin Plan is to improve—</text><paragraph id="idf7d257422d96498fb6381f824523dd70"><enum>(1)</enum><text>water security and quality for communities throughout the Rio Grande Basin;</text></paragraph><paragraph id="id78544b977a364ff2823bd9c035b09842"><enum>(2)</enum><text>river and watershed health for ecosystems, fish, and wildlife in the Rio Grande Basin;</text></paragraph><paragraph id="id95fe6786bf6a46b9bfa1278c76588017"><enum>(3)</enum><text>the resilience of communities and ecosystems in the Rio Grande Basin to drought and hydrologic change; and</text></paragraph><paragraph id="id4c47de04082a4898b955cd826ccf9f62"><enum>(4)</enum><text>consultation, collaboration, and partnerships among Federal agencies, Basin States, Indian Tribes, and local partners within the Rio Grande Basin.</text></paragraph></subsection><subsection id="idadec42dcaa67475d840c60839ac84949"><enum>(c)</enum><header>Requirements</header><text>The Basin Plan shall include—</text><paragraph id="id10d8315e4d484b8e90a9246fc6d5785b"><enum>(1)</enum><text>a list of recommended projects and activities to achieve the purpose described in subsection (b), using the best available science for current and future conditions in the Rio Grande Basin, including recommendations for—</text><subparagraph id="idaf91547c19474e659568928cb2d9d922"><enum>(A)</enum><text>improving infrastructure design, maintenance, repair, planning, management, and operations throughout the Rio Grande Basin;</text></subparagraph><subparagraph id="id9fc652e1b13b49a6ac7ed01251136021"><enum>(B)</enum><text>improving science, data, monitoring, and collaboration to improve understanding of the Rio Grande Basin, including—</text><clause id="id619753adec5c4e76b82d5165cd6f6dbf"><enum>(i)</enum><text>the hydrology and other processes of the Rio Grande Basin; and</text></clause><clause id="id8dce0e38853e4ac1a3370022afa3e5fb"><enum>(ii)</enum><text>the long-term availability of water across the Rio Grande Basin;</text></clause></subparagraph><subparagraph id="idb742e4aa78224590894bf49f8bc052c6"><enum>(C)</enum><text>increasing water conservation in the Rio Grande Basin through partnerships with communities and water users;</text></subparagraph><subparagraph id="idb9edef507b1d4bd5962d2093f915879f"><enum>(D)</enum><text>investments in nature-based features, infrastructure, and habitat improvements to improve river health, resilience, water security, and hazard mitigation in the Rio Grande Basin;</text></subparagraph><subparagraph id="ide93fb7f62b884327b17c55f7d5df7107"><enum>(E)</enum><text>updating reservoir operations authorities and water control manuals; and</text></subparagraph><subparagraph id="idea608c8403724f46ac3b542e6e00a9be"><enum>(F)</enum><text>improving consultation, collaboration, and partnerships throughout the Rio Grande Basin to achieve the objectives described in subparagraphs (A) through (E);</text></subparagraph></paragraph><paragraph id="id93544ce3044b44888f742d516ac97459"><enum>(2)</enum><text>a list of potential changes to existing Federal authorities that may be needed to implement the Basin Plan; and</text></paragraph><paragraph id="id674cbaa420554a4db4bd3d8bed62bed1"><enum>(3)</enum><text>a timeline for implementing the Basin Plan over a 30-year period.</text></paragraph></subsection><subsection id="id6e899ae6950944b08130b697a6dec000"><enum>(d)</enum><header>Report to Congress</header><text>Not later than 2 years after the date of enactment of this Act, the Secretary shall—</text><paragraph id="idf80f90ec8bfb472eb9732f61a4056dce"><enum>(1)</enum><text>submit the Basin Plan to—</text><subparagraph id="id72358b202e7b4718a481422f49957005"><enum>(A)</enum><text>the appropriate committees of Congress; and</text></subparagraph><subparagraph id="ide2dc87f9f0c049cc986bd80d4b4bd67f"><enum>(B)</enum><text>the Basin States, Indian Tribes located within the Rio Grande Basin, and local partners; and</text></subparagraph></paragraph><paragraph id="id2604fa62826347de89fe5383f1a16e60"><enum>(2)</enum><text>make the Basin Plan publicly available online.</text></paragraph></subsection><subsection id="id89394d49e9ed442f8d4c8038c8ea690a"><enum>(e)</enum><header>Implementation</header><paragraph id="idf137042fa1c64f348ed370169d322109"><enum>(1)</enum><header>In general</header><text>On submission of the Basin Plan to Congress under subsection (d)(1)(A), the relevant agencies of the Working Group may implement recommended projects and activities from the Basin Plan to achieve the purposes of this title, including—</text><subparagraph id="idc11cbb0215864c16ba2434f4552767af"><enum>(A)</enum><text>water conservation and restoration projects;</text></subparagraph><subparagraph id="idc0fcc0b18bc9479f85023348850583bf"><enum>(B)</enum><text>streamflow and groundwater recharge improvements;</text></subparagraph><subparagraph id="id1df34a557818487582919a6221f1f34d"><enum>(C)</enum><text>optimization of Federal project management, including—</text><clause id="ida521301823164bc0958c5f90592daa98"><enum>(i)</enum><text>improvements and flexibility in reservoir, irrigation, and flood control project operations; and</text></clause><clause id="id11db78dd51a74da98685609d326715c9"><enum>(ii)</enum><text>updates and amendments to particular reservoir operations authorities, contracts, and water control manuals within the Rio Grande Basin, consistent with the recommendations provided in subsection (c)(1)(E);</text></clause></subparagraph><subparagraph id="idec581d7df898493490cf504de653c064"><enum>(D)</enum><text>studies of relevant projects and activities requiring further authorization;</text></subparagraph><subparagraph id="iddbef18de1b184847a4dc2fc538ab47b0"><enum>(E)</enum><text>the establishment of a collaborative science, data, and monitoring program for the Rio Grande Basin; and</text></subparagraph><subparagraph id="id5754b984de76434ab3bdb4b4aace429f"><enum>(F)</enum><text>the establishment of a coordinated technical assistance program to support Rio Grande Basin stakeholders in accessing resources and programs to achieve the purposes of this title.</text></subparagraph></paragraph><paragraph id="ida61b5ec413c04618bc71d7b90ceb4c6f"><enum>(2)</enum><header>Waiver</header><text>In implementing this subsection, the relevant agencies of the Working Group may waive or reduce Federal cost-share requirements for projects and activities that demonstrate significant public benefits in accordance with the purpose described in subsection (b).</text></paragraph></subsection><subsection id="id39f4ce91d16c4bcaaed566e37a69b28f"><enum>(f)</enum><header>Requirements</header><text>The projects and activities implemented pursuant to subsection (e) shall be—</text><paragraph id="idf4556db40960403585d69abf95f90876"><enum>(1)</enum><text>subject to required authorization and appropriation by Congress;</text></paragraph><paragraph id="idc300807a400d4f0caa072004946631b9"><enum>(2)</enum><text>contingent on the completion of applicable feasibility studies, environmental reviews, and cost-benefit analyses that include favorable recommendations for the proposed projects and activities; and</text></paragraph><paragraph id="id312e4a8d1b274947b89fc26f9f30f088"><enum>(3)</enum><text>implemented—</text><subparagraph id="ida1ac248fa77847aa9589a1fa265c8542"><enum>(A)</enum><text>in accordance with applicable law, including—</text><clause id="id09f7caee0534422f9284a8894167e420"><enum>(i)</enum><text>the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>);</text></clause><clause id="idecd6a941da4a4197b7669f092268a7ab"><enum>(ii)</enum><text>the Endangered Species Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/16/1531">16 U.S.C. 1531 et seq.</external-xref>); and</text></clause><clause id="idd3d979d1edcc4957aeb080ecabd46d96"><enum>(iii)</enum><text>the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1251">33 U.S.C. 1251 et seq.</external-xref>);</text></clause></subparagraph><subparagraph id="idfcbfa7d4000e4d989827245c96f2d2c8"><enum>(B)</enum><text>in consultation with and in accordance with State, Tribal, and local authorities in the Basin States;</text></subparagraph><subparagraph id="id9cace210db064a33906784bf21016bd4"><enum>(C)</enum><text>in accordance with interstate and international agreements applicable to the Rio Grande Basin; and</text></subparagraph><subparagraph id="id95debf0786ef4e2dac7c00f467e8ca86"><enum>(D)</enum><text>in accordance with the water rights of any Indian Tribe or agreements between any Indian Tribe and the United States.</text></subparagraph></paragraph></subsection><subsection id="id9cafb8d5c9be474b99f90833290e4ecc"><enum>(g)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to the heads of the agencies represented on the Working Group such sums as are necessary to carry out this title for each of fiscal years 2023 through 2052. </text></subsection></section><section id="id6f5262d4164d4a6797b1e4fd39143754"><enum>203.</enum><header>Rio Grande Basin Working Group</header><subsection id="idbac308fc72bd454abb47d3e963a59779"><enum>(a)</enum><header>Composition</header><text>The Working Group shall be composed of the following members:</text><paragraph id="id800b1f1859114676ba7fa8b9f0abb615"><enum>(1)</enum><text>The Administrator of the Environmental Protection Agency.</text></paragraph><paragraph id="idea6b55cab0f44f7795807b72ec66ed25"><enum>(2)</enum><text>The Assistant Secretary of the Army for Civil Works.</text></paragraph><paragraph id="idb3ef7bf17fd04f80b642c204e2a727d1"><enum>(3)</enum><text>The Chief of the Forest Service.</text></paragraph><paragraph id="id493f23156b1c495894c1011b7b379ef2"><enum>(4)</enum><text>The Chief of the Natural Resources Conservation Service.</text></paragraph><paragraph id="id43741755604b4c22b0b386bb46fc167d"><enum>(5)</enum><text>The Commissioner of the International Boundary and Water Commission.</text></paragraph><paragraph id="ided3cb91a536e42de9e218344a7e496cd"><enum>(6)</enum><text>The Commissioner of Reclamation.</text></paragraph><paragraph id="id255c70365dc34c69b0b3d4109c2c3137"><enum>(7)</enum><text>The Director of any National Laboratory located in a Basin State.</text></paragraph><paragraph id="id4e486cdaa42c41f79bab6e2386712a9c"><enum>(8)</enum><text>The Director of the Bureau of Indian Affairs.</text></paragraph><paragraph id="idaf100b8b119b47109e151a09192d4cc4"><enum>(9)</enum><text>The Director of the Bureau of Land Management.</text></paragraph><paragraph id="id3f538f07c194424e81a33e72afbe834f"><enum>(10)</enum><text>The Director of the National Park Service.</text></paragraph><paragraph id="id5ff6f1793e12473ab4ae5445678bd4c1"><enum>(11)</enum><text>The Director of the United States Fish and Wildlife Service.</text></paragraph><paragraph id="id14f5ac752459479aa81f6245619218b9"><enum>(12)</enum><text>The Director of the United States Geological Survey.</text></paragraph><paragraph id="idad9266cc01b44886afc391483ac118ad"><enum>(13)</enum><text>The Secretary of Energy.</text></paragraph><paragraph id="idbe3a211bd3974f56a15f8993a1bad9ff"><enum>(14)</enum><text>The Under Secretary for Rural Development.</text></paragraph><paragraph id="id677d6e1e577043ffbf49c34d151adc91"><enum>(15)</enum><text>The heads of any other relevant Federal agencies, as determined to be appropriate by a majority of the members of the Working Group described in paragraphs (1) through (14).</text></paragraph></subsection><subsection id="id131eec93b4f0407c9561431cb7b1e60e"><enum>(b)</enum><header>Duties</header><text>The Working Group shall consult, collaborate, and work with Basin States, Indian Tribes located within the Rio Grande Basin, and local partners—</text><paragraph id="id210645b5c1b6425bbc792da3a585b208"><enum>(1)</enum><text>to develop and implement a Basin Plan; and</text></paragraph><paragraph id="id7e785cf3449849f4a94429cec70c91fb"><enum>(2)</enum><text>on submission of the Basin Plan to Congress under section 202(d)(1)(A), to support ongoing collaboration across the Rio Grande Basin among Federal stakeholders and non-Federal stakeholders within the Rio Grande Basin.</text></paragraph></subsection></section><section id="iddbe69400132e451296a35ca2c95c9300"><enum>204.</enum><header>Effect of title</header><text display-inline="no-display-inline">Nothing in this title—</text><paragraph id="id541d8c38a76343de9065e8c691ee5740"><enum>(1)</enum><text>affects, waives, abrogates, diminishes, defines, or interprets any water right of any Indian Tribe or agreement between any Indian Tribe and the United States;</text></paragraph><paragraph id="id5d09bd30d0e0481eb4239917a922edea"><enum>(2)</enum><text>affects a contract or benefit in existence on the date of enactment of this Act that was executed pursuant to the reclamation laws, unless otherwise agreed to by the parties to the contract or benefit;</text></paragraph><paragraph id="id5bd9842f51cf4acbb5b900a3338e2f0b"><enum>(3)</enum><text>affects any interstate or international agreement regarding the Rio Grande and the waters of the Rio Grande, or any other interstate compact or agreement regarding water;</text></paragraph><paragraph id="id5b0e68b4c14d4ab9875449394529369e"><enum>(4)</enum><text>affects any ongoing treaty obligations; or</text></paragraph><paragraph id="id18cdbc12e53941d3b58e2aca076f0605"><enum>(5)</enum><text>limits or affects any Basin State or Indian Tribe in the management of water quantity or quality in accordance with State or Tribal laws, as applicable.</text></paragraph></section></title><title id="id5b5a0d6625574b809e8354e6a038dae6"><enum>III</enum><header>Pueblo irrigation</header><section id="id41f953f7c8b140a7bda34fa93dfd717e"><enum>301.</enum><header>Reauthorization of Pueblo irrigation infrastructure grants</header><text display-inline="no-display-inline">Section 9106(g)(2) of the Omnibus Public Land Management Act of 2009 (<external-xref legal-doc="public-law" parsable-cite="pl/111/11">Public Law 111–11</external-xref>; 123 Stat. 1309) is amended—</text><paragraph id="id577421257dd24881a45cb469d884948c"><enum>(1)</enum><text>by striking <quote>is authorized</quote> and inserting <quote>are authorized</quote>; and</text></paragraph><paragraph id="id7a8d68f7e9fb4919a4c7211e699f01ff"><enum>(2)</enum><text>by striking <quote>$6,000,000</quote> and all that follows through the period at the end and inserting <quote>such sums as are necessary for each of fiscal years 2022 through 2032.</quote>. </text></paragraph></section></title></legis-body></bill>
