which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To establish the Strength in Diversity Program, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" changed="not-changed" committee-id="HED00" reported-display-style="italic" id="HF5540F365F9B4EAFA939365FCAC2F247"><section section-type="section-one" id="HA4583C9CAFFB4D9C99357865898192C0" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Strength in Diversity Act of 2022</short-title></quote>.</text></section><section id="HB631DD346637444AB73BBAF732386705" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>2.</enum><header>Purpose</header><text display-inline="no-display-inline">The purpose of this Act is to support the development, implementation, and evaluation of comprehensive strategies to address the effects of racial isolation or concentrated poverty by increasing diversity, including racial diversity and socioeconomic diversity, in covered schools.</text></section><section id="H3087920A6AB6480F9F51902EC0A2B41D" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>3.</enum><header>Reservation for national and state activities</header><subsection id="H18ED3EB69BC44234A36A13836B5175E9" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(a)</enum><header>National activities</header><text display-inline="yes-display-inline">The Secretary may reserve not more than 5 percent of the amounts made available under section 9 for a fiscal year to carry out activities of national significance relating to this Act, which may include—</text><paragraph id="H2E9159953751440485DB126F535AC594" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(1)</enum><text display-inline="yes-display-inline">research, development, data collection, monitoring, technical assistance, evaluation, or dissemination activities; and</text></paragraph><paragraph id="H2BFDC0D67EF64954B03DEFEA646AA4F2" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(2)</enum><text display-inline="yes-display-inline">the development and maintenance of best practices for recipients of grants under section 4 and other experts in the field of school diversity.</text></paragraph></subsection><subsection id="HDB9F5336FCEF4DD19D51F5D2FAB14E9D" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(b)</enum><header>State activities</header><text display-inline="yes-display-inline">The Secretary may reserve not more than 10 percent of the amounts made available under section 9 for a fiscal year for planning grants and implementation grants made to State educational agencies under section 4.</text></subsection></section><section id="HA0F93F5D0D494C38A32339836A2BA7BD" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>4.</enum><header>Grant program authorized</header><subsection id="H191158F5090649568C6B3ABEE7B0FA51" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(a)</enum><header>Authorization</header><paragraph id="H640D194BCD624895AFA461C95F532FC7" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">From the amounts made available under section 9 and not reserved under section 3 for a fiscal year, the Secretary shall award grants in accordance with subsection (b) to eligible entities to develop or implement plans to improve diversity and reduce or eliminate racial or socioeconomic isolation in covered schools.</text></paragraph><paragraph id="H0EBCC73AAC094C05B73615B5342AA386" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(2)</enum><header>Types of grants</header><text>The Secretary may, in any fiscal year, award—</text><subparagraph id="H05349E1E4D584DA9A3A5E4A96D426072" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(A)</enum><text>planning grants to carry out the activities described in section 6(a);</text></subparagraph><subparagraph commented="no" id="HA33B9F66C5384F3CAF239F9C4E9EF9FE" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(B)</enum><text>implementation grants to carry out the activities described in section 6(b); or </text></subparagraph><subparagraph id="H2F1438F804604C6BBF2EFA3AD3D67DB6" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(C)</enum><text>both such planning grants and implementation grants.</text></subparagraph></paragraph></subsection><subsection id="HF69F6C0E153743E388A7AFD61033AD45" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(b)</enum><header>Award basis</header><paragraph id="H92F1D577E29C456DB9BDB46E77C9754A" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(1)</enum><header>Criteria for evaluating applications</header><text>The Secretary shall award grants under this section on a competitive basis, based on—</text><subparagraph id="HBB2F45F799B84BF2B52FEC2891D2514A" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(A)</enum><text>the quality of the application submitted by an eligible entity under section 5; </text></subparagraph><subparagraph id="HE2405BBC131443FF898A44C760275A09" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(B)</enum><text>the likelihood, as determined by the Secretary, that the eligible entity will use the grant to improve student outcomes or outcomes on other performance measures described in section 7; and</text></subparagraph><subparagraph id="HAAAF7EFDDFFF479B8C62856658ABD935" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(C)</enum><text display-inline="yes-display-inline">the likelihood that the grant will lead to a meaningful reduction in racial and economic isolation for children in covered schools.</text></subparagraph></paragraph><paragraph commented="no" id="H0C0F6FF9E29C4EB0A0C632BA25BC896D" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(2)</enum><header>Priority</header><text>In awarding grants under this section, the Secretary shall give priority to the following eligible entities:</text><subparagraph id="H3DDED4A6FD134E83B82E6BD157E5EFE7" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(A)</enum><text display-inline="yes-display-inline">First, to an eligible entity that submitted an application for a grant under the Opening Doors, Expanding Opportunities program described in the notice published by the Department of Education in the Federal Register on December 14, 2016 (81 Fed. Reg. 90343 et seq.).</text></subparagraph><subparagraph id="H4CF24C4378F143EDBE015167102CE4F9" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(B)</enum><text>Second, to an eligible entity that proposes, in an application submitted under section 5, to use the grant to support a program that addresses racial isolation.</text></subparagraph><subparagraph id="H0C0E8A6BE771426D82E827E47E9BA093" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(C)</enum><text display-inline="yes-display-inline">Third, to an eligible entity that proposes, in an application submitted under section 5, to use the grant to support a program that extends beyond one local educational agency, such as an inter-district or regional program.</text></subparagraph><subparagraph id="H3CF10785A74741B4B873068B1853655A" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(D)</enum><text display-inline="yes-display-inline">Fourth, to an eligible entity that demonstrates meaningful coordination with local housing agencies to increase access to schools that have a disproportionately low number of low-income students.</text></subparagraph></paragraph></subsection><subsection id="H53E2EB9DDB6F4515B04E4DBB031CE014" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(c)</enum><header>Duration of grants</header><paragraph id="HB9CDDE6E392A4D89814058644AEE8101" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(1)</enum><header>Planning grant</header><text>A planning grant awarded under this section shall be for a period of not more than 1 year.</text></paragraph><paragraph id="H2BE51D769B494F4B98E632031190DA89" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(2)</enum><header>Implementation grant</header><text>An implementation grant awarded under this section shall be for a period of not more than 3 years, except that the Secretary may extend an implementation grant for an additional 2-year period if the eligible entity receiving the grant demonstrates to the Secretary that the eligible entity is making significant progress, as determined by the Secretary, on the program performance measures described in section 7.</text></paragraph></subsection></section><section id="H9675E26B386B4B2AA22CB66FDB4D5E04" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>5.</enum><header>Applications</header><text display-inline="no-display-inline">In order to receive a grant under section 4, an eligible entity shall submit an application to the Secretary at such time and in such manner as the Secretary may require. Such application shall include—</text><paragraph id="H54429A6DB9E14CBC830CFA096AC28F82" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(1)</enum><text>a description of the program for which the eligible entity is seeking a grant, including—</text><subparagraph id="H73F7085BAA214BC0A5922AF6A07518AE" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(A)</enum><text>how the eligible entity proposes to use the grant to improve the academic and life outcomes of students in racial or socioeconomic isolation in covered schools by supporting interventions that increase diversity for students in such covered schools;</text></subparagraph><subparagraph id="HF88AF378F4A64BBC979DA531F8400532" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(B)</enum><text>in the case of an implementation grant, the implementation grant plan described in section 6(b)(1); and</text></subparagraph><subparagraph id="H80D0AE27554C4CD599CE253B07083099" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(C)</enum><text>evidence, or if such evidence is not available, a rationale based on current research, regarding how the program will increase diversity;</text></subparagraph></paragraph><paragraph id="HF9BDB9F00BB04AF5902D3BFCBECDA847" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(2)</enum><text>in the case of an eligible entity proposing to use any of the grant to benefit covered schools that are racially isolated, a description of how the eligible entity will identify and define racial isolation;</text></paragraph><paragraph id="H399C423577A749E696E4461A316F36C3" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(3)</enum><text>in the case of an eligible entity proposing to use any portion of the grant to benefit high-poverty covered schools, a description of how the eligible entity will identify and define income level and socioeconomic status;</text></paragraph><paragraph id="H0930098A345A44068186FC8D357DCD07" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(4)</enum><text>a description of the plan of the eligible entity for continuing the program after the grant period ends;</text></paragraph><paragraph id="HA1A36BBF8AD34499BD3C2E4CB4215E90" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(5)</enum><text>a description of how the eligible entity will assess, monitor, and evaluate the impact of the activities funded under the grant on student achievement and student enrollment diversity, and teacher diversity;</text></paragraph><paragraph id="HA5E6C026BF134C84B48DDC558D655D7A" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(6)</enum><text>an assurance that the eligible entity has conducted, or will conduct, robust parent and community engagement, while planning for and implementing the program, such as through—</text><subparagraph id="HEFAC614B9EE041D7B6CC13AE0FBB1BCB" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(A)</enum><text display-inline="yes-display-inline">consultation with appropriate officials from Indian Tribes or Tribal organizations approved by the Tribes located in the area served by the eligible entity;</text></subparagraph><subparagraph id="H6789216FA64946D8B8A0D04E74F18083" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(B)</enum><text display-inline="yes-display-inline">consultation with other community entities, including local housing or transportation authorities;</text></subparagraph><subparagraph id="H2ECFB31A38C941C1A0C1C2271647A5A8" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(C)</enum><text>public hearings or other open forums to inform the development of any formal strategy to increase diversity; and</text></subparagraph><subparagraph id="HF4D953AABAE6438C949795887A314720" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(D)</enum><text>outreach to parents and students, in a language that parents and students can understand, and consultation with students and families in the targeted district or region that is designed to ensure participation in the planning and development of any formal strategy to increase diversity; </text></subparagraph></paragraph><paragraph id="H7AAB4BE898D947C699B96DC423890503" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(7)</enum><text>an estimate of the number of students that the eligible entity plans to serve under the program and the number of students to be served through additional expansion of the program after the grant period ends;</text></paragraph><paragraph id="HF9580F8E2E024EFAAEC50D68A28E2115" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(8)</enum><text>an assurance that the eligible entity will—</text><subparagraph id="HAA85E134CBA5485FAACB1829E20CFC53" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(A)</enum><text>cooperate with the Secretary in evaluating the program, including any evaluation that might require data and information from multiple recipients of grants under section 4; and</text></subparagraph><subparagraph id="H6604DE7614B34641BA635928EF30D822" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(B)</enum><text>engage in the best practices developed under section 3(a)(2);</text></subparagraph></paragraph><paragraph id="H12F806ADA22E450C9D2026CA949EBEE8" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(9)</enum><text>an assurance that, to the extent possible, the eligible entity has considered the potential implications of the grant activities on the demographics and student enrollment of nearby covered schools not included in the activities of the grant; </text></paragraph><paragraph id="H03FB79F904454DD48A817BDC578A0157" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(10)</enum><text>in the case of an eligible entity applying for an implementation grant, a description of how the eligible entity will—</text><subparagraph id="H4D9F1A668EEA49B296C4A6EA2F28A7DB" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(A)</enum><text>implement, replicate, or expand a strategy based on a strong or moderate level of evidence (as described in subclause (I) or (II) of section 8101(21)(A)(i) of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801(21)(A)(i)</external-xref>)); or</text></subparagraph><subparagraph id="HE375D7B71FEF47C7813ED98168EAFC13" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(B)</enum><text>test a promising strategy to increase diversity in covered schools;</text></subparagraph></paragraph><paragraph id="H01AED04A91CE4A2892DD7BDE560CB37A" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(11)</enum><text>in the case of an application by a consortium of local educational agencies, a specification of which agency is the lead applicant, and how the grant funds will be divided among the school districts served by such consortium; and</text></paragraph><paragraph id="H9CC40E2D5BB94D02B1A25F342CD97D1D" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(12)</enum><text display-inline="yes-display-inline">in the case of an application by a State educational agency, a demonstration that the agency has procedures in place—</text><subparagraph id="HDBDB8A57C30B4610B55BA955D86F1268" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(A)</enum><text>to assess and prevent the redrawing of school district lines in a manner that increases racial or socioeconomic isolation;</text></subparagraph><subparagraph id="HAD9CDE97F727407BB045E50C0BC37A97" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(B)</enum><text>to assess the segregation impacts of new school construction proposals and to prioritize school construction funding that will foreseeably increase racial and economic integration; and</text></subparagraph><subparagraph id="H5DBC10F884944B68A1FB2940D58055A1" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(C)</enum><text>to include progress toward reduction of racial and economic isolation as a factor in its State plan under section 1111 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6311">20 U.S.C. 6311</external-xref>).</text></subparagraph></paragraph></section><section id="HB7D19741FA9F4723983EBD90D6533368" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>6.</enum><header>Uses of funds</header><subsection id="H509A524882E04B408879B2BACDA62029" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(a)</enum><header>Planning grants</header><text display-inline="yes-display-inline">Each eligible entity that receives a planning grant under section 4 shall use the grant to support students in covered schools through the following activities:</text><paragraph id="H9F81F4BEC84948D797EB51EABA770E67" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(1)</enum><text>Completing a comprehensive assessment of, with respect to the geographic area served by such eligible entity—</text><subparagraph id="H663AC21FE9914078812D80C432B08F33" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(A)</enum><text>the educational outcomes and racial and socioeconomic stratification of children attending covered schools; </text></subparagraph><subparagraph id="H2EF114B6E2EF4A1283119C5E599F5BFD" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(B)</enum><text>an analysis of the location and capacity of program and school facilities and the adequacy of local or regional transportation infrastructure; and</text></subparagraph><subparagraph id="HFD35FBDBBFA44F858DC88140F22C0914" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(C)</enum><text display-inline="yes-display-inline">teacher diversity in covered schools, and plans for expanding teacher diversity.</text></subparagraph></paragraph><paragraph id="HAD64B4C743FA4438932A4D656B271D18" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(2)</enum><text>Developing and implementing a robust family, student, and community engagement plan, including, where feasible, public hearings or other open forums that would precede and inform the development of a formal strategy to improve diversity in covered schools.</text></paragraph><paragraph id="H94DA392D8084438D9EEC496B2BE98946" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(3)</enum><text>Developing options, including timelines and cost estimates, for improving diversity in covered schools, such as weighted lotteries, revised feeder patterns, school boundary redesign, or regional coordination.</text></paragraph><paragraph id="HDB3C80D95C734D4C8163B0036C3E524A" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(4)</enum><text>Developing an implementation plan based on community preferences among the options developed under paragraph (3).</text></paragraph><paragraph id="H6B761AB36D084FF0858B8D4FF325DBD9" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(5)</enum><text>Building the capacity to collect and analyze data that provide information for transparency, continuous improvement, and evaluation.</text></paragraph><paragraph id="H2DFE735B7BC84D3CA3C6EFE01B051899" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(6)</enum><text display-inline="yes-display-inline">Developing an implementation plan to comply with a court-ordered school desegregation plan.</text></paragraph><paragraph commented="no" id="H8C0F0B2791C74E9D865FBF6BADB7D456" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(7)</enum><text display-inline="yes-display-inline">Engaging in best practices developed under section 3(a)(2).</text></paragraph><paragraph id="H228E5D7A9BD34D66930DDA2FFD2A7810" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(8)</enum><text display-inline="yes-display-inline">If applicable, developing an implementation plan to replace entrance exams or other competitive application procedures with methods of student assignment to promote racial and socioeconomic diversity.</text></paragraph></subsection><subsection id="H21950709AE2343C99C5FE2BB5E92D992" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(b)</enum><header>Implementation grants</header><paragraph id="HA5208E7E03A84945B6E20BE9BC2FEFC8" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(1)</enum><header>Implementation grant plan</header><text>Each eligible entity that receives an implementation grant under section 4 shall implement a high-quality plan to support students in covered schools that includes—</text><subparagraph id="HB0F668E3D50346E8A0D25DE91B1C4D4D" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(A)</enum><text>a comprehensive set of strategies designed to improve academic outcomes for all students, particularly students of color and low-income students, by increasing diversity in covered schools;</text></subparagraph><subparagraph id="HF89EDF24EBF8484CB8CE597AA8AA5E0E" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(B)</enum><text>evidence of strong family and community support for such strategies, including evidence that the eligible entity has engaged in meaningful family and community outreach activities;</text></subparagraph><subparagraph id="H8B0CC57B3FDF4EDCAA85CB4784201C37" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(C)</enum><text>goals to increase diversity, including teacher diversity, in covered schools over the course of the grant period;</text></subparagraph><subparagraph id="HD8399AAC85AF454B8F661C0EE0D6FB0C" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(D)</enum><text>collection and analysis of data to provide transparency and support continuous improvement throughout the grant period; and</text></subparagraph><subparagraph id="H9706AF5482304E1EB6A5AFCFDB8A2986" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(E)</enum><text>a rigorous method of evaluation of the effectiveness of the program. </text></subparagraph></paragraph><paragraph id="H25A8CF135B354FAE8281C68F6A40A265" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(2)</enum><header>Implementation grant activities</header><text>Each eligible entity that receives an implementation grant under section 4 may use the grant to carry out one or more of the following activities:</text><subparagraph id="H440D3A1E1791442EABC9062AE92623EF" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(A)</enum><text>Recruiting, hiring, or training additional teachers, administrators, school counselors, and other instructional and support staff in new, expanded, or restructured covered schools, or other professional development activities for staff and administrators.</text></subparagraph><subparagraph id="H7104C190B91749D5B22F11D145DBAF7D" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(B)</enum><text>Investing in specialized academic programs or facilities designed to encourage inter-district school attendance patterns.</text></subparagraph><subparagraph id="HEF62755CA8A24F90A47362C18972F11A" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(C)</enum><text>Developing or initiating a transportation plan for bringing students to and from covered schools, if such transportation is sustainable beyond the grant period and does not represent a significant portion of the grant received by an eligible entity under section 4.</text></subparagraph><subparagraph id="H9E87381F733942AA85436E4DB2753915" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(D)</enum><text>Developing innovative and equitable school assignment plans.</text></subparagraph><subparagraph id="H4F9235D8B4CB470B871117FEB3ED903B" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(E)</enum><text display-inline="yes-display-inline">Carrying out innovative activities designed to increase racial and socioeconomic school diversity and engagement between children from different racial, economic, and cultural backgrounds.</text></subparagraph><subparagraph id="H6B6C5F61966940259CC055D6AA693D15" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(F)</enum><text display-inline="yes-display-inline">Creating or improving systems and partnerships to create a one-stop enrollment process for students with multiple public school options, including making school information and data more accessible and easy to understand, in order to ensure access to low poverty or high-performing schools for low-income children and to promote racial and socioeconomic diversity.</text></subparagraph><subparagraph id="H183347A7B140412B9DAEA8B3116167E6" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(G)</enum><text display-inline="yes-display-inline">Increasing teacher diversity in covered schools. </text></subparagraph></paragraph></subsection></section><section id="H12D88A052A4144328719063A3874F117" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>7.</enum><header>Performance measures</header><text display-inline="no-display-inline">The Secretary shall establish performance measures for the programs and activities carried out through a grant under section 4. These measures, at a minimum, shall track the progress of each eligible entity in—</text><paragraph id="HACA473BF642E457A87567ADC0631C5DA" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(1)</enum><text display-inline="yes-display-inline">improving academic and other developmental or noncognitive outcomes for each subgroup described in section 1111(b)(2)(B)(xi) of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6311">20 U.S.C. 6311(b)(2)(B)(xi)</external-xref>) that is served by the eligible entity on measures, including, as applicable, by—</text><subparagraph id="HA64538DB86EE400188BB03B4CF072D5D" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(A)</enum><text>increasing school readiness;</text></subparagraph><subparagraph id="H432848668F8E41C6A829BA10912BDB2C" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(B)</enum><text>increasing student achievement and decreasing achievement gaps;</text></subparagraph><subparagraph id="H14E5715CBC0441EAA1F931F555689F20" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(C)</enum><text>increasing high school graduation rates;</text></subparagraph><subparagraph id="H6B635C5EA895482FB9F1D153FBD44B1B" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(D)</enum><text>increasing readiness for postsecondary education and careers;</text></subparagraph><subparagraph id="H7840A8E8B4CC4218997156A7CF1A8A96" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(E)</enum><text display-inline="yes-display-inline">improving access to mental health and social-emotional learning;</text></subparagraph><subparagraph id="H5164B609EEB44844A15F5DFA62B7EA67" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(F)</enum><text>reducing school discipline rates; and</text></subparagraph><subparagraph id="H289CDF1DE0EF4C999CD6F2AD03090C9C" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(G)</enum><text>any other indicator the Secretary or eligible entity may identify; and</text></subparagraph></paragraph><paragraph id="HECB72645A7F049619ED59EFA065DC39E" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(2)</enum><text>increasing diversity and decreasing racial or socioeconomic isolation in covered schools.</text></paragraph></section><section id="HB371757E06754CEE83744186F27822AD" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>8.</enum><header>Annual reports</header><text display-inline="no-display-inline">An eligible entity that receives a grant under section 4 shall submit to the Secretary, at such time and in such manner as the Secretary may require, an annual report that includes—</text><paragraph id="H4C96F21633CF4F4E8E08A00C6BA6068C" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(1)</enum><text>a description of the efforts of the eligible entity to increase inclusivity;</text></paragraph><paragraph id="H4A3D1D59AD93431BAB12600A447CD474" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(2)</enum><text display-inline="yes-display-inline">information on the progress of the eligible entity with respect to the performance measures described in section 7;</text></paragraph><paragraph id="H4E70582AC1DA4D299774534994399078" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(3)</enum><text display-inline="yes-display-inline">the data supporting such progress; </text></paragraph><paragraph id="H6EEAC063A97647608B95C56AD424CA05" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(4)</enum><text display-inline="yes-display-inline">a description of how the eligible entity will continue to make improvements toward increasing diversity and decreasing racial or socioeconomic isolation in covered schools and sustaining inclusion; and</text></paragraph><paragraph id="HDFFB1C6931C347C496E1B2CF3B71E28D" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(5)</enum><text display-inline="yes-display-inline">information on the progress of regional programs on reducing racial and socioeconomic isolation in covered schools, if applicable.</text></paragraph></section><section id="H848C674B01A84C92AFD1EAAB5A8E8B88" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>9.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There are authorized to be appropriated to carry out this Act such sums as may be necessary for fiscal year 2023 and each of the 5 succeeding fiscal years.</text></section><section id="H097551CDE5F844EDA6E22AF2069C7C57" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>10.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="HC1E119050E3A421CB60C7068D547B1EA" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(1)</enum><header>Covered school</header><text display-inline="yes-display-inline">The term <term>covered school</term> means—</text><subparagraph id="H9875851827544BA084C06F6C4DF7572A" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(A)</enum><text>a publicly-funded early childhood education program;</text></subparagraph><subparagraph id="HEEC36BD1D23B4DE9891AEF9421B70030" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(B)</enum><text>a public elementary school; or</text></subparagraph><subparagraph id="H6DCEEA2C67AF43398B2F5B0F06E5AC72" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(C)</enum><text>a public secondary school.</text></subparagraph></paragraph><paragraph display-inline="no-display-inline" id="H60D8598C74184D09B58ABBDA7801F4D7" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(2)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term> means a State educational agency, a local educational agency, a consortium of such agencies, an educational service agency, or a regional educational agency that at the time of the application of such eligible entity has significant achievement gaps and socioeconomic or racial segregation within or between the school districts served by such entity.</text></paragraph><paragraph id="HC54E958E77634C1C9114CA3B967717A8" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(3)</enum><header>ESEA terms</header><text display-inline="yes-display-inline">The terms <term>educational service agency</term>, <term>elementary school</term>, <term>local educational agency</term>, <term>secondary school</term>, <term>Secretary</term>, and <term>State educational agency</term> have the meanings given such terms in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>). </text></paragraph><paragraph commented="no" id="HA7DDE791E4D742D58BE7E112142D4DF1" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>(4)</enum><header>Publicly-funded early childhood education program</header><text>The term <term>publicly-funded early childhood education program</term> means an early childhood education program (as defined in section 103(8) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1003">20 U.S.C. 1003(8)</external-xref>)) that receives State or Federal funds.</text></paragraph></section><section id="HF9AF5DB6A05B449396FACF2AFD53C378" changed="not-changed" reported-display-style="italic" committee-id="HED00"><enum>11.</enum><header>Prohibition against Federal control of education</header><text display-inline="no-display-inline">No provision of this Act shall be construed to authorize any department, agency, officer, or employee of the United States to exercise any direction, supervision, or control over the curriculum, program of instruction, administration, or personnel of any educational institution, school, or school system.</text></section></legis-body></bill>
