<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>1st Session</session><legis-num>S. 422</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20210224">February 24, 2021</action-date><action-desc><sponsor name-id="S311">Ms. Klobuchar</sponsor> introduced the following bill; which was read twice, considered, read the third time, and passed</action-desc></action><legis-type>A BILL</legis-type><official-title>To allow Senators, Senators-elect, committees of the Senate, leadership offices, and other offices of the Senate to share employees, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Senate Shared Employee Act</short-title></quote>.</text></section><section id="idB7A92AE8C49D4229BB53B4AA4069A976"><enum>2.</enum><header>Allowing Senators, committees, leadership offices, and other offices of the Senate to share employees</header><subsection id="idCF834A7CF8684E3998DCE3EB3BBABBA6"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 114 of the Legislative Branch Appropriation Act, 1978 (<external-xref legal-doc="usc" parsable-cite="usc/2/4576">2 U.S.C. 4576</external-xref>) is amended—</text><paragraph id="idF677AE36284F45159C9B8B05E5057368"><enum>(1)</enum><text>by inserting <quote>(a)</quote> before <quote>Notwithstanding</quote>;</text></paragraph><paragraph id="idC2364B66FF04448EB7DF54716EA2B77E"><enum>(2)</enum><text>by striking <quote>position, each of</quote> and all that follows through the period at the end and inserting the following:</text><quoted-block style="OLC" display-inline="yes-display-inline" id="id579C6FC4B2C841CDA53933B454D7B88A"><text>qualifying position if the aggregate gross pay from those positions does not exceed—</text><paragraph commented="no" id="id8BC8425C31C440C5ABA0B3E14FECECD5"><enum>(1)</enum><text>the maximum rate specified in section 105(d)(2) of the Legislative Branch Appropriation Act, 1968 (<external-xref legal-doc="usc" parsable-cite="usc/2/4575">2 U.S.C. 4575(d)(2)</external-xref>), as amended and modified; or</text></paragraph><paragraph commented="no" id="id7E5D3413FA4741959DFE5B2BD12A712C"><enum>(2)</enum><text>in a case where 1 or more of the individual's qualifying positions are positions described in subsection (d)(2)(B), the maximum rate specified in section 105(e)(3) of the Legislative Branch Appropriation Act, 1968 (<external-xref legal-doc="usc" parsable-cite="usc/2/4575">2 U.S.C. 4575(e)(3)</external-xref>), as amended and modified.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id1A34B2F73F6F45D096CF95D93E277AE6"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id83E3679931334A19B69B2D2618F42421"><subsection id="ide14d084ef6a6442f8eeadb18dd4ad69f"><enum>(b)</enum><paragraph commented="no" display-inline="yes-display-inline" id="id1B13431BC0894539A376A95DC4709CD3"><enum>(1)</enum><text>For an individual serving in more than 1 qualifying position under subsection (a), the cost of any travel for official business shall be paid by the office authorizing the travel.</text></paragraph><paragraph id="id39FF79C97EA5417B95FD718AA36080A1" indent="up1"><enum>(2)</enum><text>Messages for each electronic mail account used in connection with carrying out the official duties of an individual serving in more than 1 qualifying position under subsection (a) may be delivered to and sent from a single handheld communications device provided to the individual for purposes of official business.</text></paragraph><paragraph id="id325C87E02C2E4674B1145A2A0C24781B" indent="up1"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idACA2AA630CC54313BD93E2A905255B28"><enum>(A)</enum><text>For purposes of the Ethics in Government Act of 1978 (5 U.S.C. App.), the rate of basic pay for an individual serving in more than 1 qualifying position under subsection (a) shall be the total basic pay received by the individual from all such positions.</text></subparagraph><subparagraph id="id16f228decd234d5c8eb0c9f3bde936d5" indent="up1"><enum>(B)</enum><text>For an individual serving in more than one qualifying position under subsection (a), for purposes of the rights and obligations described in, or described in the provisions applied under, title II of the Congressional Accountability Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1311">2 U.S.C. 1311</external-xref> et seq.) related to practices used at a time when the individual is serving in such a qualifying position with an employing office, the rate of pay for the individual shall be the individual rate of pay received from the employing office. </text></subparagraph></paragraph></subsection><subsection id="id636fb0a1477d4397b368301b38de2bc9"><enum>(c)</enum><paragraph commented="no" display-inline="yes-display-inline" id="id6E7C81CCA23148559C5537DFB5D06B45"><enum>(1)</enum><text>If the duties of a qualifying position under subsection (a) include information technology services and support, an individual may only serve in the qualifying position and 1 or more additional qualifying positions under such subsection if the individual is in compliance with each information technology standard and policy established for Senate offices by the Office of the Sergeant at Arms and Doorkeeper of the Senate. </text></paragraph><paragraph id="id429ab6de1e2540fb96f13913d5ca9317" indent="up1"><enum>(2)</enum><text>Notwithstanding subsection (a), an employee serving in a qualifying position in the Office of the Secretary of the Senate or the Office of the Sergeant at Arms and Doorkeeper of the Senate may serve in an additional qualifying position only if—</text><subparagraph id="idBB88DB12060C46E5827C6D1BEC0DB8CE"><enum>(A)</enum><text>the other qualifying position is with the other Office; or</text></subparagraph><subparagraph id="id53E40C1A14184EDF8AE2BA1064168313"><enum>(B)</enum><text>the Committee on Rules and Administration of the Senate has approved the arrangement.</text></subparagraph></paragraph></subsection><subsection id="id02BE7CA4F0AC46B8A017C0B4BD6B6546"><enum>(d)</enum><text>In this section, the term <term>qualifying position</term> means a position that—</text><paragraph id="id2CB29F39F7994F13B7419F49441F5C49"><enum>(1)</enum><text>is designated as a shared position for purposes of this section by the Senator or other head of the office in which the position is located; and</text></paragraph><paragraph id="id5351B00D9EA54CA2BFAC50362E00DB5B"><enum>(2)</enum><text>is one of the following:</text><subparagraph id="id453781CC50704C9F9694EEAE9D16E6B2"><enum/></subparagraph><subparagraph commented="no" display-inline="yes-display-inline" id="id83A815319C00446D9FE6D4AF3CAFF3D9"><enum>(A)</enum><text>A position—</text><clause id="id5C20F45CB6B64024A3598DE77A05554E"><enum>(i)</enum><text>that is in the office of a Senator; and</text></clause><clause id="id14F1FBFE1B834D94860C6FE2E951772A"><enum>(ii)</enum><text>the pay of which is disbursed by the Secretary of the Senate.</text></clause></subparagraph><subparagraph id="idF3C9AAE0A3B4475AB12A8663943EE046"><enum>(B)</enum><text>A position—</text><clause id="id864743BF9D034D91BA6DF16209666847"><enum>(i)</enum><text>that is in any committee of the Senate (including a select or special committee) or a joint committee of Congress; and</text></clause><clause id="id8E6C7479A1A2497CAA3738D78613C05F"><enum>(ii)</enum><text>the pay of which is disbursed by the Secretary of the Senate out of an appropriation under the heading <quote><header-in-text level="appropriations-small" style="OLC">Inquiries and investigations</header-in-text></quote> or <quote><header-in-text level="appropriations-intermediate" style="OLC">Joint economic committee</header-in-text></quote>, or a heading relating to a Joint Congressional Committee on Inaugural Ceremonies.</text></clause></subparagraph><subparagraph id="id3FDEAAC3D393403DA27BFDACEC0CDD44"><enum>(C)</enum><text>A position—</text><clause id="id46745035D9244F05A78B1159822BDAA2"><enum>(i)</enum><text>that is in another office (excluding the Office of the Vice President and the Office of the Chaplain of the Senate); and</text></clause><clause id="idE14A4AD0FCD3470FACA3AFB0F7FFABCD"><enum>(ii)</enum><text>the pay of which is disbursed by the Secretary of the Senate out of an appropriation under the heading <quote><header-in-text level="appropriations-intermediate" style="OLC">Salaries, Officers and Employees</header-in-text></quote>.</text></clause></subparagraph><subparagraph id="id177B0FE288184D3AB6CFD5E2708E8571"><enum>(D)</enum><text>A position—</text><clause id="id5426F0E14406438587579CFB9ADBA434"><enum>(i)</enum><text>that is filled pursuant to section 105 of the Second Supplemental Appropriations Act, 1978 (<external-xref legal-doc="usc" parsable-cite="usc/2/6311">2 U.S.C. 6311</external-xref>); and</text></clause><clause id="idB7B2F28F631847F684B1D436FFE2E070"><enum>(ii)</enum><text>the pay of which is disbursed by the Secretary of the Senate out of an appropriation under the heading <quote><header-in-text level="appropriations-small" style="appropriations">Miscellaneous Items</header-in-text></quote>.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id1D7A71F97E9F4A8C94AA0195C490FE92"><enum>(b)</enum><header>Effective date</header><text>The amendments made by subsection (a) shall take effect beginning on the day that is 6 months after the date of enactment of this Act.</text></subsection></section></legis-body></bill>
