<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>2d Session</session><legis-num>S. 4224</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20220516">May 16, 2022</action-date><action-desc><sponsor name-id="S373">Mr. Cassidy</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the expenditure of an equal amount on border security as on the Ukraine Security Assistance Initiative and to confiscate Russian assets and make such assets available for border security, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Make Border Security a Priority Act of 2022</short-title></quote>.</text></section><section id="id2200075bfa4f442fb236dc96dd09490e" section-type="subsequent-section"><enum>2.</enum><header>Requirement to expend equal amount on border security as on Ukraine Security Assistance Initiative</header><text display-inline="no-display-inline">During fiscal years 2022 and 2023, the Secretary of Homeland Security shall expend on efforts to enhance security along the southern land border of the United States an amount that is equal to the amount appropriated to the Secretary of Defense for the Ukraine Security Assistance Initiative for that fiscal year.</text></section><section id="id3863f8bb19a4427db542793f45d0b00b"><enum>3.</enum><header>Confiscation of assets of Russian persons subject to sanctions; use of funds for border security</header><subsection id="id435a806a5c32408d894b6eda2454c051"><enum>(a)</enum><header>Confiscation</header><paragraph id="idaabd285941454b54af7edbfdd1223957"><enum>(1)</enum><header>In general</header><text>The President—</text><subparagraph id="idd3de934b0b504c27b19eafd7ea3c1b94"><enum>(A)</enum><text>may confiscate and vest, through instructions or licenses or in such other manner as the President determines appropriate, property described in paragraph (2);</text></subparagraph><subparagraph id="id9d09ff43594c4ebf842e14e63f8e633a"><enum>(B)</enum><text>may liquidate or sell any of such property; and</text></subparagraph><subparagraph id="id2ac7859392ca4eef9b3056c278ab595d"><enum>(C)</enum><text>shall deposit any funds confiscated and vested under subparagraph (A) and any funds resulting from the liquidation or sale of property under subparagraph (B) in the account established under subsection (b).</text></subparagraph></paragraph><paragraph id="id60CDF7ED768E4C57A3E40AFB3B65B79F"><enum>(2)</enum><header>Property described</header><text>Property described in this paragraph is funds and other property (including cryptocurrency)—</text><subparagraph id="id8201D1065F0848B6A072B9234EFC5C74"><enum>(A)</enum><text>of Russian persons subject to sanctions imposed by the United States; and </text></subparagraph><subparagraph id="id4757186939A9450A9C822FA88ED95F57"><enum>(B)</enum><text>subject to the jurisdiction of the United States.</text></subparagraph></paragraph><paragraph id="id3bbc68a825a34cd5acacca7324a0f0ed"><enum>(3)</enum><header>Vesting</header><text>All right, title, and interest in funds and other property confiscated under paragraph (1) shall vest in the Government of the United States.</text></paragraph></subsection><subsection id="id550b5a3ff56f496cbbbe29498289e53d"><enum>(b)</enum><header>Establishment of account for confiscated property</header><paragraph id="id2f627954ea774067bb160ea160b0d5bc"><enum>(1)</enum><header>In general</header><text>The President shall establish a non-interest-bearing account to consist of the funds deposited into the account under subsection (a)(1)(C).</text></paragraph><paragraph id="id2e5a467e0b704f7db3e54dbcca9c9900"><enum>(2)</enum><header>Use of funds</header><text>The funds in the account established under paragraph (1) shall be available, without further appropriation, to the Secretary of Homeland Security for physical infrastructure and equipment for U.S. Customs and Border Protection to enhance security along the southern land border of the United States as required by section 2.</text></paragraph></subsection><subsection id="id8a26e2f6ac8948f79dae61decb7ef3bc"><enum>(c)</enum><header>Russian person defined</header><text>In this section, the term <term>Russian person</term> means—</text><paragraph id="idbdc5e8746f2448c88dcc6c0d7d939029"><enum>(1)</enum><text>an individual who is a citizen or national of the Russian Federation; or</text></paragraph><paragraph id="idaace243277ad4f31acc6143b15eb268b"><enum>(2)</enum><text>an entity organized under the laws of the Russian Federation. </text></paragraph></subsection></section></legis-body></bill>
