which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Immigration and Nationality Act to require Visa Waiver Program countries to share watch list information about known or suspected terrorists and to fully cooperate with United States law enforcement entities in preventing and combating serious crime.</official-title></form><legis-body><section section-type="section-one" id="id61421A866BB64C1A9BD02BF3A3A26F84"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Securing the Visa Waiver Program Act</short-title></quote>.</text></section><section section-type="subsequent-section" id="idD911DC6F034947FA83CE996E4DC8CA36"><enum>2.</enum><header>Visa Waiver Program information sharing agreements</header><subsection id="idE5EF9D9C6EBE4E6C8E9775408BA39D0A"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 217(c)(2)(F) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1187">8 U.S.C. 1187(c)(2)(F)</external-xref>) is amended to read as follows:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id72A859E6FC054C729262B47576845A08"><subparagraph commented="no" display-inline="no-display-inline" id="ID7DFD7D22E89A426B91AF1A2FD9BA8F8E"><enum>(F)</enum><header display-inline="yes-display-inline">Information sharing agreements</header><clause commented="no" display-inline="no-display-inline" id="id97710C8878434394B252C98E9C76169E"><enum>(i)</enum><header>Security threats</header><text display-inline="yes-display-inline">The government of the country enters into an agreement with the United States to share information regarding whether citizens and nationals of that country traveling to the United States represent a threat to the security or welfare of the United States or its citizens, and fully implements such agreement.</text></clause><clause commented="no" display-inline="no-display-inline" id="id0C78DCCE607D462B86C69D31C219E3AC"><enum>(ii)</enum><header>Terrorist watch lists</header><text display-inline="yes-display-inline">The government of the country enters into an agreement with the United States to share thorough, accurate, and current information about citizens and nationals of that country who are known or appropriately suspected to be or have been engaged in conduct constituting, in preparation for, in aid of, or related to terrorism, and fully implements such agreement.</text></clause><clause commented="no" display-inline="no-display-inline" id="id0E0DF578A352493F937738A81B892884"><enum>(iii)</enum><header>Enhancing cooperation in preventing and combating serious crime</header><text display-inline="yes-display-inline">The government of the country enters into an agreement with the United States to establish frameworks for enhanced law enforcement cooperation, including the exchange of biometric and biographic data relating to citizens and nationals of that country who have engaged in, or are appropriately suspected of engaging in, an aggravated felony, and sharing any relevant underlying information for law enforcement purposes, and fully implements such agreement.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idD30DB9D8EC0C409892DE8CF7F54B2390"><enum>(b)</enum><header>Effect of failure to comply with information sharing agreements</header><text>Section 217(c) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1187">8 U.S.C. 1187(c)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id587D5A558C864360A25A0CB8DF8C32D8"><paragraph id="id093EE207E3304730A4407E3BDA862215"><enum>(13)</enum><header>Effect of failure to comply with information sharing agreements</header><subparagraph id="id2C4A552E905F48AFB7D48AE38AFCB10F"><enum>(A)</enum><header>In general</header><text>The Secretary of Homeland Security shall immediately terminate the designation of a country as a program country if such country fails to comply with the requirements under subparagraph (D) or (F) of paragraph (2) within—</text><clause id="idDB52396A03034E548881CF578C42AFA1"><enum>(i)</enum><text>the three-month period beginning on the date of the enactment of this paragraph, if such country was a program country on such date of enactment; or</text></clause><clause id="id0DB1678F46754158A7ADFA4B1A87D060"><enum>(ii)</enum><text>the six-month period beginning on the date on which such country became a program country.</text></clause></subparagraph><subparagraph id="idCA5373B1C94E4C7DB86F743B82D551CB"><enum>(B)</enum><header>Eligibility to rejoin</header><text>A program country whose participation in the program is terminated pursuant to subparagraph (A) may be permitted to rejoin the program by producing evidence that the country has come into compliance and continuously complied with subparagraphs (D) and (F) of paragraph (2) for a period, as determined by the Secretary of Homeland Security, that is at least as long as the longer of—</text><clause id="idAC53522BDBFB4B1CAC11EB8D3BCB658A"><enum>(i)</enum><text>the period during which the country was out of compliance with such subparagraphs; or</text></clause><clause id="id772613A5765840ED90C668E1C54C1D98"><enum>(ii)</enum><text>the most recent 3-month period.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
