which was read twice and referred to the <committee-name committee-id="SSFR00">Committee on Foreign Relations</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To reauthorize the North Korean Human Rights Act of 2004, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HB82FF757B310403785B01C6AFFE76D76"><section commented="no" section-type="section-one" id="H6DA6675CCA244516BD466E2A309306A4"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>North Korean Human Rights Reauthorization Act of 2022</short-title></quote>.</text></section><section commented="no" id="H651C4EB6BDCF4CBDA178C77B77F7250A"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress makes the following findings:</text><paragraph id="id6e47a827e82a40cca54b94500167b4e2"><enum>(1)</enum><text>The North Korean Human Rights Act of 2004 (<external-xref legal-doc="public-law" parsable-cite="pl/108/333">Public Law 108–333</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/22/7801">22 U.S.C. 7801 et seq.</external-xref>) and subsequent reauthorizations of such Act were the product of broad, bipartisan consensus regarding the promotion of human rights, documentation of human rights violations, transparency in the delivery of humanitarian assistance, and the importance of refugee protection.</text></paragraph><paragraph id="id0f5060f0247147b78c4ac885242239b6"><enum>(2)</enum><text>The human rights and humanitarian conditions within North Korea remain deplorable and have been intentionally perpetuated against the people of North Korea through policies endorsed and implemented by Kim Jong-un and the Workers’ Party of Korea.</text></paragraph><paragraph id="ide490522d9c9747699ddfc0d0c8b91925"><enum>(3)</enum><text>According to a 2014 report released by the United Nations Human Rights Council’s Commission of Inquiry on Human Rights in the Democratic People’s Republic of Korea, between 80,000 and 120,000 children, women, and men were being held in political prison camps in North Korea, where they were subjected to deliberate starvation, forced labor, executions, torture, rape, forced abortion, and infanticide.</text></paragraph><paragraph id="id24cf6605d868470db733d2f3a4c3013c"><enum>(4)</enum><text>North Korea continues to hold a number of South Koreans and Japanese abducted after the signing of the Agreement Concerning a Military Armistice in Korea, signed at Panmunjom July 27, 1953 (commonly referred to as the <quote>Korean War Armistice Agreement</quote>), and refuses to acknowledge the abduction of more than 100,000 South Koreans during the Korean War in violation of the Geneva Convention.</text></paragraph><paragraph id="ida3578a9fe2494e73a566e112b8907005"><enum>(5)</enum><text>Human rights violations in North Korea, which include forced starvation, sexual violence against women and children, restrictions on freedom of movement, arbitrary detention, torture, executions, and enforced disappearances, amount to crimes against humanity according to the United Nations Commission of Inquiry on Human Rights in the Democratic People’s Republic of Korea.</text></paragraph><paragraph id="idc101b9fcd62b4453900de9ca8ddcf97f"><enum>(6)</enum><text>The effects of the COVID–19 pandemic and North Korea’s strict lockdown of its borders and crackdowns on informal market activities and small entrepreneurship have drastically increased food insecurity for its people and given rise to famine conditions in parts of the country.</text></paragraph><paragraph id="id26f5293102364d92898b78e57aea6fd3"><enum>(7)</enum><text>North Korea’s COVID–19 border lockdown measures also include shoot-to-kill orders that have resulted in the killing of—</text><subparagraph id="id3ADD615F4ECD4F7188FC68D8309296CE"><enum>(A)</enum><text>North Koreans attempting to cross the border; and </text></subparagraph><subparagraph id="id5F8EFB4E7714485AA584AE314463F2B4"><enum>(B)</enum><text>at least 1 South Korean citizen in September 2020.</text></subparagraph></paragraph><paragraph id="id97aab5f08e4c48c788f59c3b3abb64f8"><enum>(8)</enum><text>The Chinese Communist Party and the Government of the People’s Republic of China are aiding and abetting in crimes against humanity by forcibly repatriating North Korean refugees to North Korea where they are sent to prison camps, harshly interrogated, and tortured or executed. </text></paragraph><paragraph id="idA1DDDA4190DF4CECA617D23C318A2311"><enum>(9)</enum><text>The forcible repatriation of North Korean refugees violates the People’s Republic of China’s freely undertaken obligation to uphold the principle of non-refoulement, under the Convention Relating to the Status of Refugees, done at Geneva July 28, 1951 (and made applicable by the Protocol Relating to the Status of Refugees, done at New York January 31, 1967 (19 UST 6223)).</text></paragraph><paragraph id="id611940ca1fb34d5385a2c77ce9361f12"><enum>(10)</enum><text>North Korea continues to bar freedom of religion and persecute religious minorities, especially Christians. Eyewitnesses report that Christians in North Korea have been tortured, forcibly detained, and even executed for possessing a Bible or professing Christianity.</text></paragraph><paragraph id="ideb90f2b55abf49c1a73143574790ea3b"><enum>(11)</enum><text>United States and international broadcasting operations into North Korea—</text><subparagraph id="idAF799EE33523491184AE546BC97623BE"><enum>(A)</enum><text>serve as a critical source of outside news and information for the North Korean people; and </text></subparagraph><subparagraph id="id32C7A12599E24F4B8446E8369FC9278F"><enum>(B)</enum><text>provide a valuable service for countering regime propaganda and false narratives.</text></subparagraph></paragraph><paragraph id="id6e7748842f484547b06bf58536ec4c80"><enum>(12)</enum><text>The position of Special Envoy on North Korean Human Rights Issues has been vacant since January 2017, even though the President is required to appoint a Senate-confirmed Special Envoy to fill this position in accordance with section 107 of the North Korean Human Rights Act of 2004 (<external-xref legal-doc="usc" parsable-cite="usc/22/7817">22 U.S.C. 7817</external-xref>). </text></paragraph></section><section id="id19f22ae68f554c7090b1ef762cf09676"><enum>3.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that—</text><paragraph id="id150df6bee0024d3c8d9e9e62ecd9ff45"><enum>(1)</enum><text>promoting information access in North Korea continues to be a successful method of countering North Korean propaganda;</text></paragraph><paragraph id="idCEF69747D8EF430985C6E5343CDA6D2D"><enum>(2)</enum><text>the United States Government should continue to support efforts described in paragraph (1), including by enacting and implementing the <short-title>Otto Warmbier North Korean Censorship and Surveillance Act of 2021</short-title>, which was introduced by Senator Portman on June 17, 2021;</text></paragraph><paragraph id="ide1e4d411b63842f0919a9333a9bd734a"><enum>(3)</enum><text>because refugees among North Koreans fleeing into China face severe punishments upon their forcible return, the United States should urge the Government of the People’s Republic of China—</text><subparagraph id="idd47ffc4f289d4407a0103c164e2a5e2b"><enum>(A)</enum><text>to immediately halt its forcible repatriation of North Koreans;</text></subparagraph><subparagraph id="id13bc1267e682423cb06f3145236cc172"><enum>(B)</enum><text>to allow the United Nations High Commissioner for Refugees (referred to in this section as <quote>UNHCR</quote>) unimpeded access to North Koreans within China to determine whether they are refugees and require assistance;</text></subparagraph><subparagraph id="id7e07ab8be0404a219159ba568b7d5905"><enum>(C)</enum><text>to fulfill its obligations under the Convention Relating to the Status of Refugees, done at Geneva July 28, 1951 (and made applicable by the Protocol Relating to the Status of Refugees, done at New York January 31, 1967 (19 UST 6223), and the Agreement on the upgrading of the UNHCR Mission in the People’s Republic of China to UNHCR branch office in the People’s Republic of China, done at Geneva December 1, 1995;</text></subparagraph><subparagraph id="id40cbfbb291874566bb0d8bbd1a534433"><enum>(D)</enum><text>to address the concerns of the United Nations Committee Against Torture by incorporating into domestic legislation the principle of non-refoulement; and</text></subparagraph><subparagraph id="id0184527ea40341c98bbcdcabab0a2b4a"><enum>(E)</enum><text>to recognize the legal status of North Korean women who marry or have children with Chinese citizens and ensure that all such mothers and children are granted resident status and access to education and other public services in accordance with Chinese law and international standards;</text></subparagraph></paragraph><paragraph id="ideeb55b96221d4d2e9a89c68417c4a0ad"><enum>(4)</enum><text>the United States Government should continue to promote the effective and transparent delivery and distribution of any humanitarian aid provided in North Korea to ensure that such aid reaches its intended recipients to the point of consumption or utilization by cooperating closely with the Government of the Republic of Korea and international and nongovernmental organizations;</text></paragraph><paragraph id="id143b25cab9a64befbb318ddfdf379bc0"><enum>(5)</enum><text>the Department of State should continue to take steps to increase public awareness about the risks and dangers of travel by United States citizens to North Korea, including by continuing its policy of blocking United States passports from being used to travel to North Korea without a special validation from the Department of State;</text></paragraph><paragraph id="idfb2af934147a431ba888e7b0f6fe0ef6"><enum>(6)</enum><text>the United Nations, which has a significant role to play in promoting and improving human rights in North Korea, should press for access for the United Nations Special Rapporteur and the United Nations High Commissioner for Human Rights on the situation of human rights in North Korea;</text></paragraph><paragraph id="idc49848924e4f4a4cbb413282796cb45e"><enum>(7)</enum><text>the Special Envoy for North Korean Human Rights Issues should be appointed without delay—</text><subparagraph id="idA18F56BD92AC47BCB4B6ED05C77EEE5A"><enum>(A)</enum><text>to properly promote and coordinate North Korean human rights and humanitarian issues; and </text></subparagraph><subparagraph id="idEBB629BFE03247C1ACB25ACFDB928A33"><enum>(B)</enum><text>to participate in policy planning and implementation with respect to refugee issues;</text></subparagraph></paragraph><paragraph id="id1c1f6466df7f4846910615a30b496e16"><enum>(8)</enum><text>the United States should urge North Korea to repeal the Reactionary Thought and Culture Denunciation Law and other draconian laws, regulations, and decrees that manifestly violate the freedom of opinion and expression and the freedom of thought, conscience, and religion;</text></paragraph><paragraph id="id2c1af82df0834a9faeea2e411170c1c7"><enum>(9)</enum><text>the United States should urge North Korea to ensure that any restrictions on addressing the COVID–19 pandemic are necessary, proportionate, nondiscriminatory, time-bound, transparent, and allow international staff to operate inside the North Korea to provide international assistance based on independent needs assessments;</text></paragraph><paragraph id="id3475cdb207ab418c9683989c2d1b8ee0"><enum>(10)</enum><text>the United States should expand the Rewards for Justice program to be open to North Korean officials who can provide evidence of crimes against humanity being committed by North Korean officials;</text></paragraph><paragraph id="id8016d7b62e644a0bbca390feabda9308"><enum>(11)</enum><text>the United States should continue to seek cooperation from all foreign governments—</text><subparagraph id="id99BD33C0F8214B67913ED52E8D54D080"><enum>(A)</enum><text>to allow the UNHCR access to process North Korean refugees overseas for resettlement; and </text></subparagraph><subparagraph id="id519E473FD12948CD942DB05664774EAC"><enum>(B)</enum><text>to allow United States officials access to process refugees for possible resettlement in the United States; and</text></subparagraph></paragraph><paragraph id="id2fa0ae7dd7d44fc99791f6fd7ce052b6"><enum>(12)</enum><text>the Secretary of State, through diplomacy by senior officials, including United States ambassadors to Asia-Pacific countries, and in close cooperation with South Korea, should make every effort to promote the protection of North Korean refugees, escapees, and defectors. </text></paragraph></section><section id="H494855A969A341EF9E759A9A211CDF8F"><enum>4.</enum><header>Reauthorizations</header><subsection id="H3CA480A7003C447A8BDCFA9C1DCBF396"><enum>(a)</enum><header>Support for human rights and democracy programs</header><text display-inline="yes-display-inline">Section 102(b)(1) of the North Korean Human Rights Act of 2004 (<external-xref legal-doc="usc" parsable-cite="usc/22/7812">22 U.S.C. 7812(b)(1)</external-xref>) is amended by striking <quote>2022</quote> and inserting <quote>2027</quote>.</text></subsection><subsection id="H500BCF80BB5845E68083C944183A5CC7"><enum>(b)</enum><header>Actions To promote freedom of information</header><text display-inline="yes-display-inline">Section 104 of the North Korean Human Rights Act of 2004 (<external-xref legal-doc="usc" parsable-cite="usc/22/7814">22 U.S.C. 7814</external-xref>) is amended—</text><paragraph id="H21B171F5BF474A5A94B52C27B7A5A2A7"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (b)(1), by striking <quote>2022</quote> and inserting <quote>2027</quote>; and</text></paragraph><paragraph id="H2F0868E644B0492388600D7689D52177"><enum>(2)</enum><text>in subsection (c), by striking <quote>2022</quote> and inserting <quote>2027</quote>.</text></paragraph></subsection><subsection id="H6925228543804A0A904727094EE27ECB"><enum>(c)</enum><header>Report by Special Envoy on North Korean human rights issues</header><text display-inline="yes-display-inline">Section 107(d) of the North Korean Human Rights Act of 2004 (<external-xref legal-doc="usc" parsable-cite="usc/22/7817">22 U.S.C. 7817(d)</external-xref>) is amended by striking <quote>2022</quote> and inserting <quote>2027</quote>.</text></subsection><subsection id="HAB7F2DA9C76F479CAFCF9C26507D5CEF"><enum>(d)</enum><header>Report on United States humanitarian assistance</header><text display-inline="yes-display-inline">Section 201(a) of the North Korean Human Rights Act of 2004 (<external-xref legal-doc="usc" parsable-cite="usc/22/7831">22 U.S.C. 7831(a)</external-xref>) is amended, in the matter preceding paragraph (1), by striking <quote>2022</quote> and inserting <quote>2027</quote>.</text></subsection><subsection id="HB1B948AE16004A3898069142F9D29511"><enum>(e)</enum><header>Assistance provided outside of North Korea</header><text display-inline="yes-display-inline">Section 203(c)(1) of the North Korean Human Rights Act of 2004 (<external-xref legal-doc="usc" parsable-cite="usc/22/7833">22 U.S.C. 7833(c)(1)</external-xref>) is amended by striking <quote>2018 through 2022</quote> and inserting <quote>2023 through 2027</quote>.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="HC14A441CAC3547FFA8CEFC04B277C7A9"><enum>(f)</enum><header>Annual reports</header><text display-inline="yes-display-inline">Section 305(a) of the North Korean Human Rights Act of 2004 (<external-xref legal-doc="usc" parsable-cite="usc/22/7845">22 U.S.C. 7845(a)</external-xref>) is amended, in the matter preceding paragraph (1) by striking <quote>2022</quote> and inserting <quote>2027</quote>.</text></subsection></section><section id="ida265cc446e4a4821905dac7da5b022c2"><enum>5.</enum><header>Actions to promote freedom of information</header><text display-inline="no-display-inline">Title I of the North Korean Human Rights Act of 2004 (<external-xref legal-doc="usc" parsable-cite="usc/22/7811">22 U.S.C. 7811 et seq.</external-xref>) is amended—</text><paragraph id="idA05083E7E1564B27A04D3BC9D0889FEB"><enum>(1)</enum><text>in section 103(a), by striking <quote>Broadcasting Board of Governors</quote> and inserting <quote>United States Agency for Global Media</quote>; and</text></paragraph><paragraph id="id3C8B2A257FC345ABAFCE646DB3DAE350"><enum>(2)</enum><text>in section 104(a)—</text><subparagraph id="id498A4644DB9B4C4CBB8F2C211E95DD90"><enum>(A)</enum><text>by striking <quote>Broadcasting Board of Governors</quote> each place such term appears and inserting <quote>United States Agency for Global Media</quote>; and</text></subparagraph><subparagraph id="id067B71B3B3F44C91BE3A2C1736546F0B"><enum>(B)</enum><text>in paragraph (7)(B)—</text><clause id="id42dfc07328e84fba8c658437d06388ef"><enum>(i)</enum><text>in the matter preceding clause (i), by striking <quote>5 years</quote> and inserting <quote>10 years</quote>;</text></clause><clause id="id3a22ffeb49af4cdaa17351f08ac8c341"><enum>(ii)</enum><text>by redesignating clauses (i) through (iii) as clauses (ii) through (iv), respectively;</text></clause><clause id="id5b9b34b487c74279950e51baa6136d24"><enum>(iii)</enum><text>by inserting before clause (ii) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idf8fcfbf9557d49a092abfa08e07cdc5e"><clause id="idc557a0a475a84afd81da33e403d0a191"><enum>(i)</enum><text>an update of the plan required under subparagraph (A);</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></clause><clause id="idea1ea6e2207344728960b5854fb5edd1"><enum>(iv)</enum><text>in clause (iii), as redesignated, by striking <quote>pursuant to section 403</quote> and inserting <quote>to carry out this section</quote>.</text></clause></subparagraph></paragraph></section><section id="id7d68ce85d60340fb92bab3e636b77b41"><enum>6.</enum><header>Special envoy for North Korean human rights issues</header><text display-inline="no-display-inline"> Section 107 of the North Korean Human Rights Act of 2004 (<external-xref legal-doc="usc" parsable-cite="usc/22/7817">22 U.S.C. 7817</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id51fa2c12b7b243cc9047e7484fdc903e"><subsection id="idead518f10f1a4f96bd6bc144e8aa13f6"><enum>(e)</enum><header>Report on appointment of Special Envoy</header><text>Not later than 180 days after the date of the enactment of this subsection and annually thereafter through 2027 if the position of Special Envoy remains vacant, the Secretary of State shall submit a report to the appropriate congressional committees that describes the efforts being taken to appoint the Special Envoy.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id745225c0b6274eae9706efabf31c46f8"><enum>7.</enum><header>Support for North Korean refugees</header><subsection id="id3bd426a8d0f14b6b95b3a56152a8bf3e"><enum>(a)</enum><header>In general</header><text>The Secretary of State and the Secretary of Homeland Security should collaborate with faith-based and Korean-American organizations to resettle North Korean participants in the United States Refugee Admissions Program in areas with existing Korean-American communities to mitigate trauma and mental health considerations of refugees, as appropriate.</text></subsection><subsection id="id0a4cad822a124b9483907ffd8aae88a9"><enum>(b)</enum><header>Resettlement office for North Korean refugees</header><text>The Secretary of State shall ensure that a program officer in the Bureau of Population, Refugees, and Migration of the Department of State—</text><paragraph id="id0E650FEDC57F41CA8F9BEB7EC1B3B355"><enum>(1)</enum><text>is stationed in a country in Southeast Asia or East Asia; and </text></paragraph><paragraph id="idBAC76DD4D3C047B8960279B0B0225B7D"><enum>(2)</enum><text>is principally responsible for facilitating the processing and onward relocation of North Koreans eligible for the United States Refugee Admissions Program or resettlement in South Korea.</text></paragraph></subsection><subsection id="id1258d2f5fa2b4fbf8f4558b5132ddb62"><enum>(c)</enum><header>Resettlement location assistance education</header><text>The Secretary of State shall publicly disseminate guidelines and information relating to resettlement options in the United States or South Korea for eligible North Korean refugees, with a particular focus on messaging to North Koreans.</text></subsection><subsection id="idde6871359f5249f9b62026bb2eefefad"><enum>(d)</enum><header>Mechanisms</header><text>The guidelines and information described in subsection (c)—</text><paragraph id="idfc0e34e2018f43afb58f09aa597b4941"><enum>(1)</enum><text>shall be published on a publicly available website of the Department of State;</text></paragraph><paragraph id="ida359d86531e849a7a94e4fd0ce0ff7f9"><enum>(2)</enum><text>shall be broadcast into North Korea through radio broadcasting operations funded or supported by the United States Government; and</text></paragraph><paragraph id="id37df3b7ef52340ffbd1df8ad0aed2626"><enum>(3)</enum><text>shall be distributed through brochures or electronic storage devices.</text></paragraph></subsection></section><section id="id13c22472275a4cda8228e7190f9e6455"><enum>8.</enum><header>Authorization of sanctions for forced repatriation of North Korean refugees</header><subsection id="idFA5D1B97A383490DA0BABC417C5DBC6D"><enum>(a)</enum><header>Discretionary designations</header><text display-inline="yes-display-inline">Section 104(b)(1) of the North Korea Sanctions and Policy Enhancement Act of 2016 (<external-xref legal-doc="usc" parsable-cite="usc/22/9214">22 U.S.C. 9214</external-xref>) is amended—</text><paragraph id="id9ea139e7f4474324b99b21ad7822ab08"><enum>(1)</enum><text>in subparagraph (M), by striking <quote>or</quote> after the semicolon;</text></paragraph><paragraph id="id707f68c1b8a14acc94c1ed7e6234ef15"><enum>(2)</enum><text>in subparagraph (N), by striking the period at the end and inserting <quote>; or</quote>; and</text></paragraph><paragraph id="id3095c1681fe845c28616beb18fa82045"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id53974D2411DB470FA6F907B2145F90C5"><subparagraph id="id52196dbdb89549af90b6affb03baa639"><enum>(O)</enum><text>knowingly, directly or indirectly, forced the repatriation of North Korean refugees to North Korea.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="idAF390CD5089C464C99E12489E5EFE1ED"><enum>(b)</enum><header>Exemptions</header><text>Section 208(a)(1) of the North Korea Sanctions and Policy Enhancement Act of 2016 (<external-xref legal-doc="usc" parsable-cite="usc/22/9228">22 U.S.C. 9228(a)(1)</external-xref>) is amended by inserting <quote>, the Republic of Korea, and Japan</quote> before the period at the end.</text></subsection></section></legis-body></bill>
