which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 35, United States Code, to establish a competition to award certificates that can be redeemed to accelerate certain matters at the United States Patent and Trademark Office, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H2F03BDE882A04921BE9623CEE5B531C6"><section section-type="section-one" id="H0B4A52DDFF1244B4A08F16F7037C4187"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Patents for Humanity Act of 2022</short-title></quote>. </text></section><section id="HA4ABD0FE80274C4A88D42783668DD97A"><enum>2.</enum><header>Award of certificates to accelerate certain matters at the Patent and Trademark Office</header><subsection id="HFC5C7562A5A84B2CA74128730F78DE65"><enum>(a)</enum><header>Award</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/35/2">Chapter 2</external-xref> of title 35, United States Code, is amended by adding at the end the following: </text><quoted-block style="USC" display-inline="no-display-inline" id="H541CA85B40564641B8A8A7C49CCB1398"><section id="H174E6C2F49FF4874A86A4CA220636117"><enum>28.</enum><header>Award of certificates to accelerate certain matters at the Patent and Trademark Office</header><subsection id="HD5907D79BB3541F2BB1E60820B6BB22F"><enum>(a)</enum><header>Definition</header><text>In this section, the term <term>eligible entity</term> means an entity—</text><paragraph id="id9DD6377ADABA4175B9AAD3120A2C2AA6"><enum>(1)</enum><text>the application of which submitted under subsection (d) is with respect to a patent that addresses a humanitarian issue; and</text></paragraph><paragraph id="idF226F204D7834E41A61386A7344CF390"><enum>(2)</enum><text>that, pursuant to subsection (e)(1), is eligible to receive an award under the competition established under subsection (b). </text></paragraph></subsection><subsection id="id52AE7F6412984E639A4E915EC0ACE4F5"><enum>(b)</enum><header>Establishment</header><text display-inline="yes-display-inline">There is established a competition, to be held not less frequently than biennially, to award eligible entities certificates that can be redeemed to accelerate one of the following matters:</text><paragraph id="H66E28883C26746869CB1430F69A97863"><enum>(1)</enum><text display-inline="yes-display-inline">An ex parte reexamination proceeding, including 1 appeal to the Patent Trial and Appeal Board from that proceeding.</text></paragraph><paragraph id="H9731BC8F6A844A2CA83D8C7CA3751061"><enum>(2)</enum><text display-inline="yes-display-inline">An application for a patent, including 1 appeal to the Patent Trial and Appeal Board from that application.</text></paragraph><paragraph id="HDAAFC4F573D94C9DB61951C52AD46236"><enum>(3)</enum><text display-inline="yes-display-inline">An appeal to the Patent Trial and Appeal Board of a claim twice rejected in a patent application or reissue application or finally rejected in an ex parte reexamination, without accelerating the underlying matter that generated the appeal.</text></paragraph><paragraph id="HC71C4066E3104EE4B7E013EFA35EDC41"><enum>(4)</enum><text>A matter identified under subsection (e)(4).</text></paragraph></subsection><subsection id="HD29A1F8871E14494BBAF47EF03008F57"><enum>(c)</enum><header>Administration</header><text>The Director shall administer the competition established under subsection (b). </text></subsection><subsection id="H03C786ABB6254842BE8C0B17428CA835"><enum>(d)</enum><header>Application</header><text display-inline="yes-display-inline">An eligible entity seeking an award under subsection (b) shall submit to the Director an application, at such time, in such manner, and containing such information as the Director may require.</text></subsection><subsection id="H15DEA4F7612442F69CAD21A47F37AC9F"><enum>(e)</enum><header>Rulemaking authority</header><text display-inline="yes-display-inline">With respect to the competition established under subsection (b), the Director shall conduct a rulemaking proceeding to promulgate rules on the—</text><paragraph id="HE357C2010F774E7AADCA45D9CB1AFFD6"><enum>(1)</enum><text>entities that are eligible to receive an award under the competition;</text></paragraph><paragraph id="H11B5E3367AF4410C949DEE80DEBBB130"><enum>(2)</enum><text display-inline="yes-display-inline">process and metrics by which applications submitted under subsection (d) are judged, including the criteria for selecting judges for the competition;</text></paragraph><paragraph id="HDD602D46B4D84B21A01CDF67B9DFC0BC"><enum>(3)</enum><text>factors that will be considered in selecting the eligible entities that receive awards under the competition; and</text></paragraph><paragraph id="H863737F7E3DD4ABDA545BC9DA5FEDCC8"><enum>(4)</enum><text display-inline="yes-display-inline">additional matters for which a certificate described in subsection (b) may be awarded.</text></paragraph></subsection><subsection id="H7C13AD6B0F2447ECA24CF170AF960E6B"><enum>(f)</enum><header>Promotion of competition</header><text display-inline="yes-display-inline">The Director shall promote the competition established under subsection (b) through the satellite offices established pursuant to section 1(b).</text></subsection><subsection id="HFCBE041C32644D8684D66CDCECB224CF"><enum>(g)</enum><header>Treatment as successor</header><text display-inline="yes-display-inline">The competition established under subsection (b) shall be treated as a successor to the Patents for Humanity Program (established in the notice entitled <quote>Humanitarian Awards Pilot Program</quote>, published at 77 Fed. Reg. 6544 (February 8, 2012)).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H27F81748FF9C408F95CCE72B5AF27D81"><enum>(b)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Nothing in this section, or the amendments made by this section, may be construed as prohibiting the Under Secretary of Commerce for Intellectual Property and Director of the United States Patent and Trademark Office from administering the competition established under section 28 of title 35, United States Code, as added by subsection (a), before the date on which all rules are promulgated under the rulemaking proceeding required by subsection (e) of such section 28. </text></subsection><subsection id="H3F288B048EE34B2899E358711EBAF297"><enum>(c)</enum><header>Technical and conforming amendment</header><text display-inline="yes-display-inline">The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/35/2">chapter 2</external-xref> of title 35, United States Code, is amended by adding at the end the following: </text><quoted-block style="USC" display-inline="no-display-inline" id="HBD627AB220DA438AAE75E7099F876792"><toc regeneration="no-regeneration"><toc-entry level="section">28.
