<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>2d Session</session><legis-num>S. 4208</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20220512">May 12, 2022</action-date><action-desc><sponsor name-id="S383">Mr. Sullivan</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSVA00">Committee on Veterans' Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Secretary of Veterans Affairs to update the appraisal requirements for certain loans guaranteed by the Department of Veterans Affairs, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H4F91896A7BBF410EAD11ECF61DB0B733"><section section-type="section-one" id="HEF92A2F905EF4A1489B3F74AE4D8C108"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Improving Access to the VA Home Loan Act of 2022</short-title></quote>. </text></section><section id="H9C783281B77446C0B0F5C60B2CA2BB6A"><enum>2.</enum><header>Update of appraisal requirements for certain loans guaranteed by Department of Veterans Affairs</header><subsection id="HC712DFA92597431293B338A5AB576673"><enum>(a)</enum><header>Updated regulations or program requirements required</header><text display-inline="yes-display-inline">Not later than 90 days after the date of the enactment of this Act, Secretary of Veterans Affairs shall prescribe updated regulations or program requirements to clarify when an appraisal is required, how an appraisal is to be conducted, and who is eligible to conduct an appraisal for purposes of a loan that is—</text><paragraph id="idBB15125B820D47EDAC75EBE6FFB361CA"><enum>(1)</enum><text display-inline="yes-display-inline">guaranteed under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/37">chapter 37</external-xref> of title 38, United States Code; and </text></paragraph><paragraph id="id1AADF78F789A481F81E42252BCF16BD0"><enum>(2)</enum><text display-inline="yes-display-inline">for any purpose described in section 3710(a) of such title. </text></paragraph></subsection><subsection id="H1EE67B948D4A4CE0BBF396EAA3709B7B"><enum>(b)</enum><header>Considerations</header><text>In prescribing updated regulations or program requirements under subsection (a), the Secretary shall consider making changes applicable to—</text><paragraph display-inline="no-display-inline" id="HEFE20F619C0E4F3E85807E84DE16857F"><enum>(1)</enum><text>certification requirements for appraisers;</text></paragraph><paragraph id="H8B3A0991D5834640A9EC95861BEF85D2"><enum>(2)</enum><text>minimum property requirements;</text></paragraph><paragraph id="H467F127EDAEE4F99AA8B95534EF9ED51"><enum>(3)</enum><text>the process for selecting and reviewing comparable sales;</text></paragraph><paragraph id="HD2E549C8FCAF4DD5BF4157BA50ADE267"><enum>(4)</enum><text>quality control processes;</text></paragraph><paragraph id="HC4CA884AEC984FE59C4A7E2F9A0B3405"><enum>(5)</enum><text>the assisted appraisal processing program of the Department of Veterans Affairs; and</text></paragraph><paragraph id="HE245278BD51B4199B13A8EFCF5BC9E6A"><enum>(6)</enum><text>the use of waivers or other alternatives to existing appraisal processes.</text></paragraph></subsection><subsection id="H9A9FB39880634CC49D40F8DD42A58C13"><enum>(c)</enum><header>Desk top appraisals</header><text display-inline="yes-display-inline">In prescribing updated regulations or program requirements under subsection (a), the Secretary shall provide guidance for the use of the authority under section 3731(b)(3) of title 38, United States Code, taking into consideration—</text><paragraph id="H9C3BD95FA6D44535B73FE081B92A1B91"><enum>(1)</enum><text>situations in which the use of such authority would provide cost savings for the borrower; and</text></paragraph><paragraph id="H7E32EFDD71594B1D9A69681FEB2D55F2"><enum>(2)</enum><text>situations in which a traditional appraisal requirement could cause a delay substantial enough to jeopardize the ability of a borrower to complete a transaction.</text></paragraph></subsection></section></legis-body></bill>
