<congress display="yes">117th CONGRESS</congress><session display="yes">2d Session</session><legis-num display="yes">S. 4205</legis-num><current-chamber display="no">IN THE SENATE OF THE UNITED STATES</current-chamber><legis-type display="yes">AN ACT</legis-type><official-title display="yes">To require the Administrator of the Federal Emergency Management Agency to establish a working group relating to best practices and Federal guidance for animals in emergencies and disasters, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" style="OLC"><section id="idb1648854-a4af-4012-abb8-ba76c2651870" section-type="section-one" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Planning for Animal Wellness Act</short-title></quote> or the <quote><short-title>PAW Act</short-title></quote>.</text></section><section id="id5975ddb2-86f4-4617-bc40-fa7e55038ba5" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Working group guidelines</header><subsection id="id82e5204c-58c2-42f4-9bb3-e6ed3371dd11" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="idb6114a01-ef1a-4e9a-89bb-d4796c57eca9" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">Administrator</header><text display-inline="yes-display-inline">The term <term>Administrator</term> means the Administrator of the Federal Emergency Management Agency.</text></paragraph><paragraph id="id3017a637-099b-4cbf-bdce-7169a99002d5" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Working group</header><text display-inline="yes-display-inline">The term <term>working group</term> means the advisory working group established under subsection (b).</text></paragraph></subsection><subsection id="id372d9511-df0c-4155-862e-3460266cb0e0" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Working group</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Administrator shall establish an advisory working group.</text></subsection><subsection id="id1e07ab26-f1ba-49b8-94a3-92e18684fcb9" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Membership</header><text display-inline="yes-display-inline">The working group shall consist of—</text><paragraph id="id41bed868-26ed-4a32-bdd3-7e50fa869d89" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">not less than 2 representatives of State governments with experience in animal emergency management;</text></paragraph><paragraph id="idc30ac183-a9ba-4966-af8d-352b8d2a06b0" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">not less than 2 representatives of local governments with experience in animal emergency management;</text></paragraph><paragraph id="id884ce1ab-57ef-4ae8-b820-540a23dd2f53" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">not less than 2 representatives from academia;</text></paragraph><paragraph id="id63171c27-14d4-4c8c-90a0-f5883d0a1142" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(4)</enum><text display-inline="yes-display-inline">not less than 2 veterinary experts;</text></paragraph><paragraph id="id42d86211-b04c-40fb-8ad4-ef9eed7ba470" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(5)</enum><text display-inline="yes-display-inline">not less than 2 representatives from nonprofit organizations working to address the needs of households pets and service animals in emergencies or disasters;</text></paragraph><paragraph id="id3e1e4957-2eff-485a-a52a-ff69e5e81c14" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(6)</enum><text display-inline="yes-display-inline">representatives from the Federal Animal Emergency Management Working Group; and</text></paragraph><paragraph id="idd766264f-2800-4641-806a-863e39cabb6a" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(7)</enum><text display-inline="yes-display-inline">any other members determined necessary by the Administrator.</text></paragraph></subsection><subsection id="idab1c1bfc-9dc7-43f4-a23e-b4b1574c1219" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(d)</enum><header display-inline="yes-display-inline">Duties</header><text display-inline="yes-display-inline">The working group shall—</text><paragraph id="ide61fc129-f8ea-49a8-b5cb-2bcdb70ced5b" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">encourage and foster collaborative efforts among individuals and entities working to address the needs of household pets, service and assistance animals, and captive animals, as appropriate, in emergency and disaster preparedness, response, and recovery; and</text></paragraph><paragraph id="id0dcd15b3-a5c2-48ee-b16e-ca08e1413fc0" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">review best practices and Federal guidance, as of the date of enactment of this Act, on congregate and noncongregate sheltering and evacuation planning relating to the needs of household pets, service and assistance animals, and captive animals, as appropriate, in emergency and disaster preparedness, response, and recovery.</text></paragraph></subsection><subsection id="idFE5B1279311E491FAF78E760D23BCC85" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(e)</enum><header display-inline="yes-display-inline">No compensation</header><text display-inline="yes-display-inline">The members of the working group shall serve on the working group on a voluntary basis.</text></subsection><subsection id="ide2d16002-445b-4fd2-b885-7e42208603ee" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(f)</enum><header display-inline="yes-display-inline">Guidance determination</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the working group shall determine whether the best practices and Federal guidance described in subsection (d)(2) are sufficient.</text></subsection><subsection id="id1181873e-2b0b-4bb3-be3b-2e9ffb25cbcd" commented="no" display-inline="no-display-inline" changed="not-changed"><enum>(g)</enum><header display-inline="yes-display-inline">New guidance</header><text display-inline="yes-display-inline">Not later than 540 days after the date of enactment of this Act, if the Administrator, in consultation with the working group, determines that the best practices and Federal guidance described in subsection (d)(2) are insufficient, the Administrator, in consultation with the working group, shall publish updated Federal guidance.</text></subsection><subsection display-inline="no-display-inline" commented="no" id="id4CBD470004B145B8BCE09F7A4D1BF2C0" changed="not-changed"><enum>(h)</enum><header display-inline="yes-display-inline">Sunset</header><paragraph display-inline="no-display-inline" commented="no" id="idADF94A3ACA0F4C83887336997AE19827" changed="not-changed"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subject to paragraph (2), the working group shall terminate on the date that is 4 years after the date of enactment of this Act.</text></paragraph><paragraph display-inline="no-display-inline" commented="no" id="id9AA2B2F098E6432AB6D6527E98AFA991" changed="not-changed"><enum>(2)</enum><header display-inline="yes-display-inline">Extension</header><text display-inline="yes-display-inline">The Administrator may extend the date described in paragraph (1) if the Administrator determines an extension is appropriate.</text></paragraph></subsection></section></legis-body><attestation><attestation-group><attestation-date date="20220806" chamber="Senate">Passed the Senate August 6, 2022.</attestation-date><attestor display="no"></attestor><role>Secretary</role></attestation-group></attestation><endorsement display="yes"></endorsement></bill>
