which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Public Health Service Act, the Employee Retirement Income Security Act of 1974, the Internal Revenue Code of 1986, and the Patient Protection and Affordable Care Act to require coverage of hearing devices and systems in certain private health insurance plans, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H278440C14A804915BB067C3F88FB9E78"><section id="idAA121857F33A4652A727D82B4B31FAE1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as <quote><short-title>Ally's Act</short-title></quote>.</text></section><section id="HA808811C87164C36A9D86728523C1B8B"><enum>2.</enum><header>Coverage of hearing devices and systems in certain private health insurance plans</header><subsection id="H8E22F7CDBDEE4511AFBEF537075F9AE6"><enum>(a)</enum><header>PHSA</header><text display-inline="yes-display-inline">Part A of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300gg">42 U.S.C. 300gg</external-xref> et seq.) is amended by inserting after section 2713 the following new section:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H11218FC440FA49FAB087C72AC53D70C5"><section id="H020CEC97B0B446FEB2BF65436D3FB1DE"><enum>2713A.</enum><header>Coverage of hearing devices and systems</header><subsection display-inline="no-display-inline" id="H0E578E49E540442D82E136AFA62AC1B0"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Beginning with plan years beginning on or after January 1, 2022, a group health plan and a health insurance issuer offering group or individual health insurance coverage shall, at a minimum provide coverage for and may impose cost-sharing requirements in accordance with subsection (b) for an individual that a physician (as defined in section 1861(r) of the Social Security Act) or qualified audiologist (as defined in section 1861(ll)(4)(B) of such Act) determines meets an indication (including unilateral or bilateral hearing loss) for an auditory device as approved by the Food and Drug Administration for—</text><paragraph id="H3E8BB3B161004D4992E5A9266F323595"><enum>(1)</enum><text display-inline="yes-display-inline">auditory implant devices (including auditory osseointegrated (bone conduction) implants and cochlear implants) and external sound processors;</text></paragraph><paragraph id="H46F9503B5B0C401996424B832C2F3C28"><enum>(2)</enum><text display-inline="yes-display-inline">the maintenance of auditory implant devices and external sound processors described in paragraph (1);</text></paragraph><paragraph id="H152D4FD0CD9545EC9BFD30978EA19F13"><enum>(3)</enum><text display-inline="yes-display-inline">every 5 years, the upgrade (or replacement if an upgrade is not available) of auditory implant devices and external sound processors described in paragraph (1);</text></paragraph><paragraph id="H96C34337B3EE4BC8BCD2A8309E7CBFFE"><enum>(4)</enum><text display-inline="yes-display-inline">adhesive adapters and softband headbands;</text></paragraph><paragraph id="H265E6EA6103C42FB80398DF89949BEB7"><enum>(5)</enum><text display-inline="yes-display-inline">the repair of auditory implant devices and external sound processors described in paragraph (1);</text></paragraph><paragraph id="H9FB0BE9531FC4C0AB747FF6223072275"><enum>(6)</enum><text display-inline="yes-display-inline">a comprehensive hearing assessment;</text></paragraph><paragraph id="HF502534E004A4D9AA102285856D9F176"><enum>(7)</enum><text>a preoperative medical assessment;</text></paragraph><paragraph id="H57997AEC741043AC8A7C7ABF6A8A06FD"><enum>(8)</enum><text>surgery (as appropriate);</text></paragraph><paragraph id="HE465D2BD1FE64F7F917E835813E817B0"><enum>(9)</enum><text>postoperative medical appointments for purposes of ensuring appropriate recovery from surgery;</text></paragraph><paragraph id="H208E1E7856064B1AB965AF06C01EA078"><enum>(10)</enum><text display-inline="yes-display-inline">postoperative audiological appointments for activation and fitting of the implant device and external sound processor; and</text></paragraph><paragraph id="H873896851C8841E0A18355B558459FD3"><enum>(11)</enum><text>aural rehabilitation and treatment services (as appropriate).</text></paragraph></subsection><subsection id="H05A471B01B0A40768611E70C9EB94C29"><enum>(b)</enum><header>Cost-Sharing</header><text display-inline="yes-display-inline">Beginning with plan years beginning on or after January 1, 2022, the cost-sharing incurred under a plan or coverage described in subsection (a)—</text><paragraph id="HF3308DAF30C045D69A6DA901ED6D50FF"><enum>(1)</enum><text>for an auditory implant device and external sound processors under this section, shall not exceed a dollar amount that is the highest cost-sharing requirement for the amount of the charges imposed for such device that is provided by a physician or qualified audiologist that has a contractual relationship with such plan or coverage for the providing of such device;</text></paragraph><paragraph id="H17C488980D9449BEBE5C78B51EF16F4D"><enum>(2)</enum><text display-inline="yes-display-inline">for an item or service under this section, shall not exceed a dollar amount that is imposed for similar items and services under that plan that are provided by a physician or qualified audiologist; and</text></paragraph><paragraph id="HC30104C2B5B24C078D0B160A5B77BD90"><enum>(3)</enum><text>that has a contractual relationship with such plan or coverage for the providing of such items and services.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection display-inline="no-display-inline" id="H50066A9CFD8C4D4E9D1681D6EE6EE9F9"><enum>(b)</enum><header>ERISA</header><paragraph id="HB1AA0B99F5334DBFA34ADFE0B9CE2E49"><enum>(1)</enum><header>In general</header><text>Subpart B of part 7 of subtitle B of title I of the Employee Retirement Income Security Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/29/1185">29 U.S.C. 1185</external-xref> et seq.) by adding at the end the following new section:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H552C221ED14F4A08908889593B062D58"><section id="H2288364123324606B682B533B8196D2C"><enum>726.</enum><header>Coverage of hearing devices and systems</header><subsection display-inline="no-display-inline" id="H660FBC1E7514417590DDB8F60BBB1B98"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Beginning with plan years beginning on or after January 1, 2022, a group health plan and a health insurance issuer offering group health insurance coverage shall, at a minimum provide coverage for and may impose cost-sharing requirements in accordance with subsection (b) for an individual that a physician (as defined in section 1861(r) of the Social Security Act) or qualified audiologist (as defined in section 1861(ll)(4)(B) of such Act) determines meets an indication (including unilateral or bilateral hearing loss) for an auditory device as approved by the Food and Drug Administration for—</text><paragraph id="HBE50597740EB4EB6919EBFE90E6612A0"><enum>(1)</enum><text display-inline="yes-display-inline">auditory implant devices (including auditory osseointegrated (bone conduction) implants and cochlear implants) and external sound processors;</text></paragraph><paragraph id="HD9C4348E00CD4D51ABA8A92E1FD7B9C1"><enum>(2)</enum><text display-inline="yes-display-inline">the maintenance of auditory implant devices and external sound processors described in paragraph (1);</text></paragraph><paragraph id="HFD2589580BEA49D484F2F3A44D193D78"><enum>(3)</enum><text display-inline="yes-display-inline">every 5 years, the upgrade (or replacement if an upgrade is not available) of auditory implant devices and external sound processors described in paragraph (1);</text></paragraph><paragraph id="HEE697C832FAE4BD49697824CBAC0F5F8"><enum>(4)</enum><text display-inline="yes-display-inline">adhesive adapters and softband headbands;</text></paragraph><paragraph id="H525099439F0F497286BFC08E795ACADA"><enum>(5)</enum><text display-inline="yes-display-inline">the repair of auditory implant devices and external sound processors described in paragraph (1);</text></paragraph><paragraph id="HE8E2750531F74F1DA63C4BCAA5917964"><enum>(6)</enum><text display-inline="yes-display-inline">a comprehensive hearing assessment;</text></paragraph><paragraph id="H48E257BC492D4A7BBAB2CE5CC2F3CEB0"><enum>(7)</enum><text>a preoperative medical assessment;</text></paragraph><paragraph id="H765F5A29A96942FF81C8F296468D400D"><enum>(8)</enum><text>surgery (as appropriate);</text></paragraph><paragraph id="H47E4600FAFB74D2D9F11F303FC42DB7A"><enum>(9)</enum><text>postoperative medical appointments for purposes of ensuring appropriate recovery from surgery;</text></paragraph><paragraph id="H11A69DC82C854178A7A3F18065B7A78C"><enum>(10)</enum><text display-inline="yes-display-inline">postoperative audiological appointments for activation and fitting of the implant device and external sound processor; and</text></paragraph><paragraph id="HE1E31F7724F5463DBC25C80B36382571"><enum>(11)</enum><text>aural rehabilitation and treatment services (as appropriate).</text></paragraph></subsection><subsection id="HFCC8B23A6BFC46469B6AE1EC8403FF48"><enum>(b)</enum><header>Cost-Sharing</header><text display-inline="yes-display-inline">Beginning with plan years beginning on or after January 1, 2022, the cost-sharing incurred under a plan or coverage described in subsection (a)—</text><paragraph id="H8220DD6613A84AC5BE253B9721EF1BD1"><enum>(1)</enum><text>for an auditory implant device and external sound processors under this section, shall not exceed a dollar amount that is the highest cost-sharing requirement for the amount of the charges imposed for such device that is provided by a physician or qualified audiologist that has a contractual relationship with such plan or coverage for the providing of such device;</text></paragraph><paragraph id="HC64C3E62278E436294556C4050D286A0"><enum>(2)</enum><text display-inline="yes-display-inline">for an item or service under this section, shall not exceed a dollar amount that is imposed for similar items and services under that plan that are provided by a physician or qualified audiologist; and</text></paragraph><paragraph id="H65FF311846E94B0EA7DA8C1ACAB7CEE7"><enum>(3)</enum><text>that has a contractual relationship with such plan or coverage for the providing of such items and services.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H0CD422F13D8E4CE5A86CA62E12EE18F1"><enum>(2)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of contents in section 1 of the Employee Retirement Income Security Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/29/1001">29 U.S.C. 1001</external-xref> et seq.) is amended by inserting after the item relating to section 725 the following new item: </text><quoted-block style="OLC" display-inline="no-display-inline" id="H63CCE0E5512743F4AFC787C000284F7F"><toc regeneration="no-regeneration"><toc-entry level="section">Sec. 726. Coverage of hearing devices and systems.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection display-inline="no-display-inline" id="HE6BEE581D1E74F36B03B7964685D45D0"><enum>(c)</enum><header>IRC</header><paragraph id="H2858A7778793455CB03DC55C8BC6753D"><enum>(1)</enum><header>In general</header><text>Subchapter B of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/100">chapter 100</external-xref> of the Internal Revenue Code of 1986, is amended by adding at the end the following new section:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HCF79DAAED95F4B53BB9618E8CC2A7B0E"><section id="HA7650F74BDCE4BA4A104E5A206EE99D4"><enum>9826.</enum><header>Coverage of hearing devices and systems</header><subsection display-inline="no-display-inline" id="H72A79C91269E4B208DA3D975AF2CD805"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Beginning with plan years beginning on or after January 1, 2022, a group health plan shall, at a minimum provide coverage for and may impose cost-sharing requirements in accordance with subsection (b) for an individual that a physician (as defined in section 1861(r) of the Social Security Act) or qualified audiologist (as defined in section 1861(ll)(4)(B) of such Act) determines meets an indication (including unilateral or bilateral hearing loss) for an auditory device as approved by the Food and Drug Administration for—</text><paragraph id="H495C8187A91E48648162A515002875AC"><enum>(1)</enum><text display-inline="yes-display-inline">auditory implant devices (including auditory osseointegrated (bone conduction) implants and cochlear implants) and external sound processors;</text></paragraph><paragraph id="H2D6694E4B3404304BB5E7E22FC74ACD0"><enum>(2)</enum><text display-inline="yes-display-inline">the maintenance of auditory implant devices and external sound processors described in paragraph (1);</text></paragraph><paragraph id="H7C57D6BD049C47408F9E1CA7006D2294"><enum>(3)</enum><text display-inline="yes-display-inline">every 5 years, the upgrade (or replacement if an upgrade is not available) of auditory implant devices and external sound processors described in paragraph (1);</text></paragraph><paragraph id="H2A4BBEFE49DD44DB869664B962BDDFC1"><enum>(4)</enum><text display-inline="yes-display-inline">adhesive adapters and softband headbands;</text></paragraph><paragraph id="HB179717E27BB4655B3A9426130E45BB3"><enum>(5)</enum><text display-inline="yes-display-inline">the repair of auditory implant devices and external sound processors described in paragraph (1);</text></paragraph><paragraph id="H6BBFAED0BE144D3D84E06F4551FAC76D"><enum>(6)</enum><text display-inline="yes-display-inline">a comprehensive hearing assessment;</text></paragraph><paragraph id="HA054AE6929B74D39ABBDD259F222C0E7"><enum>(7)</enum><text>a preoperative medical assessment;</text></paragraph><paragraph id="H5D509B3104D84227B376F65BAD024E71"><enum>(8)</enum><text>surgery (as appropriate);</text></paragraph><paragraph id="HC470274766624A5FA9FD5FC6C677EB5E"><enum>(9)</enum><text>postoperative medical appointments for purposes of ensuring appropriate recovery from surgery;</text></paragraph><paragraph id="H469DDA8BDB264C728FAF9AD0D733B5A9"><enum>(10)</enum><text display-inline="yes-display-inline">postoperative audiological appointments for activation and fitting of the implant device and external sound processor; and</text></paragraph><paragraph id="HDA05A90F5E9747BFB31FE8062F90602D"><enum>(11)</enum><text>aural rehabilitation and treatment services (as appropriate).</text></paragraph></subsection><subsection id="H12CB2F60C8F34FF9AAC51AD91B726ECF"><enum>(b)</enum><header>Cost-Sharing</header><text display-inline="yes-display-inline">Beginning with plan years beginning on or after January 1, 2022, the cost-sharing incurred under a plan described in subsection (a)—</text><paragraph id="HB2FBF11613594C53ABC20498E0BF9010"><enum>(1)</enum><text>for an auditory implant device and external sound processors under this section, shall not exceed a dollar amount that is the highest cost-sharing requirement for the amount of the charges imposed for such device that is provided by a physician or qualified audiologist that has a contractual relationship with such plan for the providing of such device;</text></paragraph><paragraph id="HD89D2B310F3D479E9364FE13A9180DE6"><enum>(2)</enum><text display-inline="yes-display-inline">for an item or service under this section, shall not exceed a dollar amount that is imposed for similar items and services under that plan that are provided by a physician or qualified audiologist; and</text></paragraph><paragraph id="HE69FCB69F34245F49400431F6F7EC5B7"><enum>(3)</enum><text>that has a contractual relationship with such plan for the providing of such items and services.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H64B72E5B14A347E3A17695F8C7EAFD94"><enum>(2)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of sections for subchapter B of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/100">chapter 100</external-xref> of the Internal Revenue Code of 1986 is amended by inserting after the item relating to section 9825 the following new item:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H92C736FACCFC4A0F8B42E29617FCDB11"><toc regeneration="no-regeneration"><toc-entry level="section">Sec. 9826. Coverage of hearing devices and systems.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H8D848C4C06214ED4BF6C250227D1F642"><enum>(d)</enum><header>Application to grandfathered health plans</header><text display-inline="yes-display-inline">Section 1251(a)(4)(A) of the Patient Protection and Affordable Care Act (<external-xref legal-doc="usc" parsable-cite="usc/42/18011">42 U.S.C. 18011(a)(4)(A)</external-xref>) is amended—</text><paragraph id="H47170C5B9BAD4E7BBF7BBE2A1A0957F1"><enum>(1)</enum><text>by striking <quote>title</quote> and inserting <quote>title, or as added after the date of the enactment of this Act)</quote>; and</text></paragraph><paragraph id="H263AD31C5A984E49BB23C99932648AD4"><enum>(2)</enum><text>by adding at the end the following new clause:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H0D920BC429D24527AC6083815FE12F16"><clause commented="no" id="H55328234945A41D2AF9E107DC9A05B8C"><enum>(v)</enum><text display-inline="yes-display-inline">Section 2713A (relating to hearing devices and systems).</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H8FF68776B9214BB7BFD3B7632FEF0B2E"><enum>(3)</enum><header>Effective date</header><text>The amendments made by this subsection shall apply with respect to plan years beginning on or after January 1, 2022.</text></paragraph></subsection></section></legis-body></bill>
