which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To authorize the Secretary of Health and Human Services, acting through the Administrator of the Health Resources and Services Administration, to award grants for providing evidence-based caregiver skills training to caregivers of children with autism spectrum disorder and other developmental disabilities, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HFB7719E164654CA9990EB2374F78C6EF"><section section-type="section-one" id="HB1FE15DC4B8D4425A916F02F7BED6424"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Autism Family Caregivers Act of 2022</short-title></quote>.</text></section><section id="HA960B38A10B0447DA90509AC1DA7D0F4"><enum>2.</enum><header>Caregiver Skills Training Pilot Program</header><subsection id="H56E37139FDCF4C45969F791A1D5FD56A"><enum>(a)</enum><header>Authorization</header><text display-inline="yes-display-inline">The Secretary, acting through the Administrator of the Health Resources and Services Administration, shall carry out a program, to be known as the Caregiver Skills Training Pilot Program, under which the Secretary shall award grants to eligible entities to provide evidence-based caregiver skills training to caregivers, including family caregivers, of children<italic></italic> with autism spectrum disorder and other developmental disabilities, for the purposes of—</text><paragraph id="H2C3150F2324E4DB3BED988DBD26164AD"><enum>(1)</enum><text>improving the health outcomes and quality of life of such children and their caregivers; and</text></paragraph><paragraph id="H2C8FA3FEB62E481DA883B6BEA01A1B38"><enum>(2)</enum><text>teaching caregivers of such children evidenced-based intervention strategies to promote—</text><subparagraph id="HDF1CC9C2C75149BA8589E1C8E72EC58D"><enum>(A)</enum><text>improvement in the mental and physical well-being of such children and their caregivers; and</text></subparagraph><subparagraph id="H4D0E21851EE2489A9DECDCF7D6EBE1AA"><enum>(B)</enum><text>the greater inclusion of such children in family and community life.</text></subparagraph></paragraph></subsection><subsection id="HA11A33C53C4D46FAA254A070BE95C1F9"><enum>(b)</enum><header>Eligibility</header><text>To be eligible to receive an award under subsection (a), an entity shall be—</text><paragraph id="H9EE575C50200484ABC051C908CB1C7A2"><enum>(1)</enum><text>a nonprofit or other community-based organization;</text></paragraph><paragraph id="HB1A5EF23A9574F57A3E63A9D681FFBA4"><enum>(2)</enum><text>a Federally qualified health center;</text></paragraph><paragraph id="HB7F1067B403B471CA813404E26F3BD31"><enum>(3)</enum><text>an academic health center;</text></paragraph><paragraph id="H80D006136154404F92599CF535A4D713"><enum>(4)</enum><text>a health system; or</text></paragraph><paragraph id="H6B6912E920CF451EBCB5EB758737B349"><enum>(5)</enum><text>a collaboration or consortium of 2 or more entities listed in paragraphs (1) through (4).</text></paragraph></subsection><subsection id="H1F236FDD81D84FA4B5E703E63A2BE21B"><enum>(c)</enum><header>Application</header><text>An eligible entity wishing to receive a grant under this section shall submit to the Secretary an application that includes—</text><paragraph id="HBD5A6AF604CC4693BB819F298DE1AEF6"><enum>(1)</enum><text>a description of—</text><subparagraph id="HBA3C09C221934EBCA6E52C90D5362A04"><enum>(A)</enum><text display-inline="yes-display-inline">the applicant’s experience delivering evidence-based caregiver skills training to caregivers, including family caregivers, of children with autism spectrum disorder and other developmental disabilities;</text></subparagraph><subparagraph id="HFE7D37E61C444DDA819C31DE2FC082C4"><enum>(B)</enum><text>the activities that the applicant proposes to carry out through the grant; and</text></subparagraph><subparagraph id="HB082B47AE11B48E8BA3A33ECBAB28F07"><enum>(C)</enum><text>how such activities will achieve the purposes described in subsection (a); and</text></subparagraph></paragraph><paragraph id="HF4236A9B2E724B5899572026E6E3AF00"><enum>(2)</enum><text>a plan for—</text><subparagraph id="HE5CB8D7675664FA2A18B9D00068E6963"><enum>(A)</enum><text>coordination with community-based organizations, State and local early intervention providers, State Medicaid systems, schools, and other providers of early intervening services;</text></subparagraph><subparagraph id="HDE3A5D4074354119B1B3A9580D9DA275"><enum>(B)</enum><text>collaboration with health care payors (including public and private insurance), State departments of insurance, health plans, and other relevant payors;</text></subparagraph><subparagraph id="H2BBE08D591CE417381ADC3918F8B55EF"><enum>(C)</enum><text>expanding the skills training program proposed to be carried out through the grant; and</text></subparagraph><subparagraph id="H21C8102248054222BE52D028F596073D"><enum>(D)</enum><text>achieving sustainability of such program.</text></subparagraph></paragraph></subsection><subsection id="H482E1A33F9D145E5B6F804FABC8343ED"><enum>(d)</enum><header>Selection of grantees</header><paragraph id="H8EA92FB063E04636977D2A81A37310DA"><enum>(1)</enum><header>Selection criteria</header><text display-inline="yes-display-inline">In awarding a grant to an eligible entity or a collaboration or consortium of 2 or more entities described in subsection (b), the Secretary shall require at least one of the recipients to—</text><subparagraph id="HC6CC3999132D42F69E835FF4D68C2E81"><enum>(A)</enum><text>have at least 3 years of demonstrated experience—</text><clause id="H772415B27F0C41FE8ED50EFAFAF7DC50"><enum>(i)</enum><text>delivering evidence-based, culturally competent caregivers skills training programs described in subsection (a), including in medically underserved communities;</text></clause><clause id="H8C2C0AA7BB76470C876452968ED15F39"><enum>(ii)</enum><text>providing services to children with autism spectrum disorder and other developmental disabilities, and collaborating directly with their families;</text></clause><clause id="H96BA25752DE844E4A90B700CAE627344"><enum>(iii)</enum><text display-inline="yes-display-inline">providing individual caregiver coaching as part of skills training to caregivers of children with autism spectrum disorder and other developmental disabilities; and</text></clause><clause id="H57459B90735B4D14BBE1FF3B54B9C75B"><enum>(iv)</enum><text display-inline="yes-display-inline">working with self-advocates or adults with autism spectrum disorder and other developmental disabilities; and </text></clause></subparagraph><subparagraph id="HB7BA19B675C744E59B86C07C1CA11A2F"><enum>(B)</enum><text>demonstrate the ability to access resources from and collaborate with—</text><clause id="H9968F6270D2E4A4AA63742588BD59240"><enum>(i)</enum><text>health care providers;</text></clause><clause id="H15FB1595452E4C23A60E50393DE793B0"><enum>(ii)</enum><text>allied health professionals;</text></clause><clause id="H97642CCD5E19414CA6DE8F5FE78853FB"><enum>(iii)</enum><text>educators;</text></clause><clause id="H05AA0905B2B1479E946A5A2807131E73"><enum>(iv)</enum><text>social workers; and</text></clause><clause id="H09FEF9BD3C564B92803A8434A6536E8E"><enum>(v)</enum><text display-inline="yes-display-inline">nonprofessional family caregivers who assist with daily living and developmental activities, including for children with autism spectrum disorder and other developmental disabilities.</text></clause></subparagraph></paragraph><paragraph id="HF4154B4D013F4FDB866F8C38FC9F1028"><enum>(2)</enum><header>Reducing disparities</header><text display-inline="yes-display-inline">In awarding grants under this section, the Secretary may consider, as appropriate, the extent to which an eligible entity can deliver evidence-based, culturally competent caregivers skills training programs for children with autism spectrum disorder and other developmental disabilities from diverse racial, ethnic, geographic, or linguistic backgrounds.</text></paragraph></subsection><subsection id="HB6858E2B4E6B44BFBD5ADEA1A99C1A31"><enum>(e)</enum><header>Use of funds</header><text display-inline="yes-display-inline">The recipient of a grant under this section shall use the grant to provide—</text><paragraph id="H2BCF9AD2C3874A80B174F979E6373494"><enum>(1)</enum><text display-inline="yes-display-inline">evidence-based caregiver skills training to caregivers of children with autism spectrum disorder and other developmental disabilities; and</text></paragraph><paragraph id="HA99A86D046FC4B6080A4384663D2450D"><enum>(2)</enum><text>such training in areas related to children’s learning and development, including—</text><subparagraph id="H083395B0645F4C5FA3923F67EA001B6F"><enum>(A)</enum><text>communication skills;</text></subparagraph><subparagraph id="HF60008A07B484C8DB8EC3BD71B0189C9"><enum>(B)</enum><text>social engagement;</text></subparagraph><subparagraph id="H0B9A01A8A1F04D75BF2E997F36E580F3"><enum>(C)</enum><text>daily living skills; and</text></subparagraph><subparagraph id="H598A0E108EAD43D0AEF978DB5D6CE432"><enum>(D)</enum><text>caregiver response strategies to aggressive behavior.</text></subparagraph></paragraph></subsection><subsection id="H25FAADA159EB4366B1E01E373F92FE8C"><enum>(f)</enum><header>Requirements</header><paragraph id="HA8A141B49784451EA444C9509FD09AE7"><enum>(1)</enum><header>Number of recipients and States</header><text display-inline="yes-display-inline">The Secretary shall award grants under subsection (a) to not fewer than 25 eligible entities in not fewer than 15 States.</text></paragraph><paragraph id="H9D85BC55AD9C4F70BD7C7860CABE65A4"><enum>(2)</enum><header>Amount</header><text>The total amount of each grant awarded under subsection (a) shall be not less than $500,000 over a 5-year period.</text></paragraph></subsection><subsection id="H91413CEDCF9E4D4F843E4964AE7DB9D0"><enum>(g)</enum><header>Supplement not supplant</header><text>Amounts made available to carry out this section shall be in addition to amounts made available to provide for—</text><paragraph id="H3AD466767953432D9418BD9851838073"><enum>(1)</enum><text>behavioral, medical, habilitative, and other services covered by the Medicaid program or private health insurance;</text></paragraph><paragraph id="HC5CC388EEF5D47E6B447D5AF1F3CC5D7"><enum>(2)</enum><text>services provided under the Individuals with Disabilities Education Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1400">20 U.S.C. 1400 et seq.</external-xref>); or</text></paragraph><paragraph id="H4C49D073FFEE462EBE7CC11134F9B11C"><enum>(3)</enum><text>adaptations of a training program using evidence-based approaches to serve children of different ages, communities, and underrepresented groups.</text></paragraph></subsection><subsection id="H8B6FA7C8916947D4A3120A1399754113"><enum>(h)</enum><header>Activities of the Secretary</header><text display-inline="yes-display-inline">The Secretary, acting through the Administrator of the Health Resources and Services Administration, shall—</text><paragraph id="H1F34F006D1884C29B1D0E11C831CE02B"><enum>(1)</enum><text>assist recipients of grants under subsection (a)—</text><subparagraph id="id4FF08FE0C9284A83B3BA00005C3CA133"><enum>(A)</enum><text>in the implementation of caregiver skills training programs using lessons learned from other evidenced-based activities or caregiver programs conducted or supported by the Health Resources and Services Administration;</text></subparagraph><subparagraph id="H93D0F1C815864C4382F95F6C77E35B4B"><enum>(B)</enum><text>in ensuring their programs assist medically underserved communities, when possible; and</text></subparagraph><subparagraph id="H564C2B8D756743E8A8DF1C8D62E450F0"><enum>(C)</enum><text>in developing plans for achieving sustainability of their programs;</text></subparagraph></paragraph><paragraph id="idE8010FCCB886472C9BC89A45DE302C4D"><enum>(2)</enum><text>conduct an annual evaluation of activities funded through grants under subsection (a), in consultation with the grant recipients, including evaluation of the effectiveness of such grants at improving health outcomes and quality of life for children with autism spectrum disorder and other developmental disabilities and their family caregivers; and</text></paragraph><paragraph id="H8465B547DD6E40F7B20AC11E35A903A2"><enum>(3)</enum><text>convene at least one national or regional meeting of grant recipients to discuss best practices.</text></paragraph></subsection><subsection id="H16F9770649CD47F0857C5F4A9785CCFD"><enum>(i)</enum><header>Reports</header><paragraph id="H0A73ED6FD5574DC2B59D26BA9BED6437"><enum>(1)</enum><header>Initial report</header><text display-inline="yes-display-inline">Not later than 6 months after awarding the first grant under subsection (a), the Secretary shall submit to the Committees on Appropriations of the House of Representatives and the Senate, and to other appropriate congressional committees, a report on the implementation of this section. Such report shall include—</text><subparagraph id="H3B603259BFCD4E279A137F96C7A69754"><enum>(A)</enum><text>how many grants have been awarded;</text></subparagraph><subparagraph id="H6798C98B391B4DE8B72886C427B68C55"><enum>(B)</enum><text>the name and location of the grant recipients;</text></subparagraph><subparagraph id="H459BB01E3750423FA3E25831987FE873"><enum>(C)</enum><text>the communities impacted by the grants;</text></subparagraph><subparagraph id="HE3B47BF1B564407A8CB3D14B7208EA5E"><enum>(D)</enum><text>a description of the kind of activities to be carried out with the grants;</text></subparagraph><subparagraph id="H84E8ED6A00FF49838AED9C64834C0B12"><enum>(E)</enum><text display-inline="yes-display-inline">an analysis, conducted by the Health Resources and Services Administration, based on the evaluation under subsection (h)(2), of the effectiveness of such grants at improving health outcomes and quality of life for children with autism or other developmental disabilities or delays and their family caregivers; and</text></subparagraph><subparagraph id="H35F0E81C08E44ABAAF68991D194BE6F1"><enum>(F)</enum><text display-inline="yes-display-inline">best practices to increase access to caregiver skills training programs described in subsection (a) in medically underserved communities.</text></subparagraph></paragraph><paragraph id="H200E16F413CD4E368A4832EF90119A34"><enum>(2)</enum><header>Final report</header><text>Not later than the end of fiscal year 2027, the Secretary shall submit to the Committees on Appropriations of the House of Representatives and the Senate, and to other appropriate congressional committees, a final report on the implementation of this section, including—</text><subparagraph id="HAB85063BD7CE459081F8364FB2FD58B3"><enum>(A)</enum><text>the information, analysis, and best practices listed in subparagraphs (A) through (F) of paragraph (1); and</text></subparagraph><subparagraph id="HBA6A109527114C9C839293F05917109A"><enum>(B)</enum><text>recommendations on how to expand and extend the program under this section.</text></subparagraph></paragraph></subsection><subsection id="H6FB64F8060CB471F803991C4F6860527"><enum>(j)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H564B5F78637F490D8B44715E3D4201FB"><enum>(1)</enum><text>The term <term>family caregiver</term> means an adult family member or other individual who has a significant relationship with, and who provides a broad range of assistance to, a child between the ages of 0 and 9 diagnosed with autism spectrum disorder and other developmental disabilities.</text></paragraph><paragraph id="H11D2B6B143014BF4B31ABE6A017E5A26"><enum>(2)</enum><text display-inline="yes-display-inline">The term <term>Federally qualified health center</term> has the meaning given the term in section 1861(aa) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(aa)</external-xref>).</text></paragraph><paragraph id="H6E38B8C8F0104E10BEE96AF05B751067"><enum>(3)</enum><text>The term <term>Secretary</term> means the Secretary of Health and Human Services.</text></paragraph></subsection><subsection id="H97412197BAF140DCA9EA7EE5D7BC87B1"><enum>(k)</enum><header>Authorization of appropriations</header><text>To carry out this section, there is authorized to be appropriated $10,000,000 for each of fiscal years 2023 through 2027.</text></subsection></section></legis-body></bill>
