which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To prohibit the Secretary of State from issuing B1 and B2 visas to nationals of the People's Republic of China for periods of more than one year unless certain conditions are met.</official-title></form><legis-body><section id="id853274B0AF9F4EBDA5F52D061E9F2074" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Visa Security Act</short-title></quote>.</text></section><section id="id0E40929BFD3E4FFCBDF21CDCBC4D44E8"><enum>2.</enum><header>Conditions on issuance of certain B1 and B2 visas to nationals of the People's Republic of China</header><subsection id="id29168739EEB0449BA34FEFB289B3BA8E"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of State may not issue to a national of the People's Republic of China a nonimmigrant visa described in section 101(a)(15)(B) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)(B)</external-xref>) that is valid for a period of more than one year unless the Secretary certifies to Congress that the Government of the People's Republic of China has— </text><paragraph id="id03af2384df684ce4bfceea4eb4713eb3"><enum>(1)</enum><text>ceased its—</text><subparagraph id="idF8FA98F5D6A94A4AB8EF93FDDA064610"><enum>(A)</enum><text>campaign of economic and industrial espionage against the United States; and</text></subparagraph><subparagraph id="id6d1d0c7e8eea4492b20253c1a7a2e107"><enum>(B)</enum><text>provocative and coercive behavior towards Taiwan;</text></subparagraph></paragraph><paragraph id="idb3b25709c51b4bbf9db94f45970b0cbd"><enum>(2)</enum><text>withdrawn its national security law with respect to Hong Kong and fully upheld its commitments under the Sino-British Joint Declaration of 1984;</text></paragraph><paragraph id="id1208411868b8478c9c2b524011721001"><enum>(3)</enum><text>ended its systematic oppression of Uighurs, Tibetans, and other ethnic groups;</text></paragraph><paragraph id="id815ca3505ee54f33b76756f59b7e0d8a"><enum>(4)</enum><text>retracted its unlawful claims in the South China Sea; and</text></paragraph><paragraph id="id18311b8bed1046b9ab4bc365644dab89"><enum>(5)</enum><text>released foreign hostages and wrongfully detained individuals in the People's Republic of China. </text></paragraph></subsection><subsection id="id9F35EBF880864672B12D51A93ABA1846"><enum>(b)</enum><header>Rule of construction</header><text>Nothing in this section may be construed to limit the period for which a visa may be issued to an applicant from Taiwan or a bona fide Hong Kong applicant.</text></subsection><subsection id="id7d906251d365423abda82aad35b68b7d"><enum>(c)</enum><header>Definition of bona fide Hong Kong applicant</header><text>In this section, <term>bona fide Hong Kong applicant</term> means an individual who—</text><paragraph id="idfb0b9cc800594b89bc419d6154120109"><enum>(1)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id6b3feb7f452e4e068b109a47c9662222"><enum>(A)</enum><text>was a resident of the Hong Kong Special Administrative Region on December 31, 2018; or</text></subparagraph><subparagraph indent="up1" id="idBDED60B61EE9411CACDBDACD3C0F36CE"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="id5CF50E97F2C8417590C333F26D19080B"><enum>(i)</enum><text>has been a resident of the Hong Kong Special Administrative Region during the entire 60-day period ending on the date on which the individual applies for a visa described in section 101(a)(15)(B) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)(B)</external-xref>); and </text></clause><clause indent="up1" id="id17E609C11F0C49AB981A120ADEF120A1"><enum>(ii)</enum><text>the Secretary of State certifies to Congress that the United States has no reason to believe that the individual is acting on behalf of the Government of the People’s Republic of China, or any entity controlled by the Government of the People’s Republic of China; </text></clause></subparagraph></paragraph><paragraph id="id59168ef693934feab1d22a96bb0a96bf"><enum>(2)</enum><text>is a citizen of the People’s Republic of China; and</text></paragraph><paragraph id="id79bcc548db614c07a9605baab86d7f5c"><enum>(3)</enum><text>is not a citizen of any other country. </text></paragraph></subsection></section></legis-body></bill>
