which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the CALM Act to include video streaming services, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Commercial Advertisement Loudness Mitigation Modernization Act of 2022</short-title></quote> or the <quote><short-title>CALM Modernization Act of 2022</short-title></quote>.</text></section><section id="id5df0829bfa6d4e72a24e12e3785e31fc"><enum>2.</enum><header>Modernization of the CALM act and rulemaking on loud commercials on streaming video</header><subsection id="idc73c8e805a374b2286b1898919f7986a"><enum>(a)</enum><header>Amendments</header><text>The CALM Act (<external-xref legal-doc="public-law" parsable-cite="pl/111/311">Public Law 111–311</external-xref>; 124 Stat. 3294) is amended—</text><paragraph id="id4f0e8e98d9e143bf945788ef8cf1d6fb"><enum>(1)</enum><text>in section 2 (<external-xref legal-doc="usc" parsable-cite="usc/47/621">47 U.S.C. 621</external-xref>)—</text><subparagraph id="idfea6b2faae6d4b2d91ffc30b54c049ae"><enum>(A)</enum><text>by striking <quote>Federal Communications Commission</quote> each place the term appears and inserting <quote>Commission</quote>;</text></subparagraph><subparagraph id="id09739622da844c74b838c33f02118221"><enum>(B)</enum><text>by striking subsection (c) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id9bfa7dad8a91469e91f903c97e1e9654"><subsection id="id26179b7f66c142a080a814fb9d8fdca7"><enum>(c)</enum><header>Compliance</header><paragraph id="idcd086db3c0f04e19b7abb7d1678f4fa1"><enum>(1)</enum><header>Rebuttable presumption</header><text>There is a rebuttable presumption that any television broadcast station, cable operator, or other multichannel video programming distributor that installs, uses, and maintains in a commercially reasonable manner the equipment and associated software in compliance with the regulations issued by the Commission in accordance with subsection (a) is in compliance with those regulations.</text></paragraph><paragraph id="id9ee8bef0fcec4fb5b8a43b47e9bb045f"><enum>(2)</enum><header>Factors to determine rebuttal</header><text>In determining whether the presumption of compliance under paragraph (1) has been rebutted with respect to a television broadcast station, cable operator, or other multichannel video programming distributor, the Commission shall consider the following:</text><subparagraph id="ida47321816972477bb8ef350bd16dc239"><enum>(A)</enum><text>The number of complaints regarding loud commercials the Commission has received with respect to that station, operator, or other distributor.</text></subparagraph><subparagraph id="id033b210bf81b4a2d9fe1b4b7fca5ad44"><enum>(B)</enum><text>Substantive patterns or trends from complaints on loud commercials the Commission has received.</text></subparagraph><subparagraph id="idcd2dac28cef14627aa1a2bd80397b86e"><enum>(C)</enum><text>Data and conclusions in any report issued by a Federal agency (including the Government Accountability Office) regarding the effectiveness of this Act in moderating the loudness of commercials in comparison with accompanying video programming.</text></subparagraph><subparagraph id="idb527ab2fecd84f4cad68395cea395194"><enum>(D)</enum><text>Any other factor established by the Commission by regulation.</text></subparagraph></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="id71fcfa5b5c6e45d5a37fd6ade324825a"><enum>(C)</enum><text>in subsection (d)—</text><clause id="idc602df9cb9c3464f8b9bbc5e401a238b"><enum>(i)</enum><text>by redesignating paragraph (1) as paragraph (3) and moving it to appear after paragraph (2);</text></clause><clause id="id9757C0FE85564D729A22372D02166B1E"><enum>(ii)</enum><text>in paragraph (3), as so redesignated, by striking <quote>; and</quote> at the end and inserting a period;</text></clause><clause id="idE95CCA6946174D5A9B3959EFAC7F5D24"><enum>(iii)</enum><text>by redesignating paragraph (2) as paragraph (1);</text></clause><clause id="idA7F4A23744D64361B03E4A5125DA2E8C"><enum>(iv)</enum><text>in paragraph (1), as so redesignated—</text><subclause id="id7850CBF5D16C436DB3D8499206419022"><enum>(I)</enum><text>by striking <quote>multi-channel</quote> and inserting <quote>multichannel</quote>; and</text></subclause><subclause id="idA4BA86EF5A0B4A7999F7DDD829971D14"><enum>(II)</enum><text>by striking the period at the end and inserting a semicolon; and</text></subclause></clause><clause id="id22B21B62987B47AB9B1BD94A61737480"><enum>(v)</enum><text>by inserting after paragraph (1), as so redesignated, the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id7fa2bdae232b4131afb693a9773b0e99"><paragraph id="id2c742ae4d4eb4400be060f3045251eb8"><enum>(2)</enum><text>the term <term>Commission</term> means the Federal Communications Commission; and</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph></paragraph><paragraph id="idc818a26d3e244230a5855cb39ca98883"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idb1cae1b06e044e4594e517b62a109520"><section id="id7530f8b3b25541a697ee2624b3b2aead"><enum>3.</enum><header>Rulemaking on loud commercials on streaming video</header><subsection id="idca5905a36a4f49719880d5667fbfec5a"><enum>(a)</enum><header>Rulemaking required for loud streaming video commercials</header><paragraph id="idb3c5d330895e48fc9d53aff68e587350"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this section, the Commission shall prescribe pursuant to the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/151">47 U.S.C. 151 et seq.</external-xref>) a regulation that prohibits video streaming services from transmitting the audio of commercial advertisements louder than the video content the advertisements accompany in a manner that is similar in effect to the regulation prescribed under section 2.</text></paragraph><paragraph id="idc58c985d1d524369bfddf6b7c6e2e84a"><enum>(2)</enum><header>Rebuttable presumption</header><text>In prescribing the regulation under paragraph (1), the Commission may include a rebuttable presumption provision that is similar to the rebuttable presumption under section 2(c) if it is practicable and warranted for effective enforcement of this section.</text></paragraph><paragraph id="idbbdbb7cbd83b4b0cacc696a102567239"><enum>(3)</enum><header>Effective date</header><text>Except as provided in paragraph (4), the regulation required under paragraph (1) shall take effect 180 days after the date on which the regulation is published in the Federal Register.</text></paragraph><paragraph id="id97db20f621724e5180b1fdd38883cc62"><enum>(4)</enum><header>Extension of effective date</header><text>The Commission may extend the effective date described in paragraph (3) for 1 year for any video streaming service that demonstrates that complying with the regulation would result in significant financial hardship.</text></paragraph><paragraph id="id8cce07413ab24ea1a505377ef44903bb"><enum>(5)</enum><header>Updates</header><text>The Commission shall update the regulation prescribed under paragraph (1) as necessary.</text></paragraph></subsection><subsection id="idf4ad3b91ea7d4c1b99d2707ece562685"><enum>(b)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id7b5d32491e4f44f081039bbc45eabf78"><enum>(1)</enum><header>Commission</header><text>The term <term>Commission</term> means the Federal Communications Commission.</text></paragraph><paragraph id="ida34c6514c29d483c975e3bcc53173e23"><enum>(2)</enum><header>Video programming</header><text>The term <term>video programming</term> has the meaning given the term in section 713(h) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/613">47 U.S.C. 613(h)</external-xref>).</text></paragraph><paragraph id="id3ad2127c87cf41e2b479836505d091fc"><enum>(3)</enum><header>Video streaming service</header><text>The term <term>video streaming service</term>—</text><subparagraph id="id842d38e5e2114b79b4473bd8cefe021e"><enum>(A)</enum><text>means an entity that makes available directly to the end user through a distribution method that uses internet protocol—</text><clause id="idaeee8bd65beb44909ee73fccda388b8b"><enum>(i)</enum><text>video programming; or</text></clause><clause id="idf3500bf20e1c453997ac0783a357c315"><enum>(ii)</enum><text>video content the entity makes available for users to view; and</text></clause></subparagraph><subparagraph id="id77042f019d1141cc952ae6a918e957c5"><enum>(B)</enum><text>does not include—</text><clause id="id9d7a5851529949889c90d546885db12e"><enum>(i)</enum><text>a television broadcast station, cable operator, or other multichannel video programming distributor (as those terms are defined in section 2(d)), only with respect to commercial advertisements and video programming subject to section 2; or</text></clause><clause id="idc1dd2a961e4c427da047b75fe42f8399"><enum>(ii)</enum><text>an entity that serves video programming or video content that is served without video commercial advertisements.</text></clause></subparagraph></paragraph></subsection></section><section id="id6b770cab2d3d435d909938da2d5698fa"><enum>4.</enum><header>Enforcement</header><subsection id="idEE8CFDB340EE4AD69999BF7A85CB08C2"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Federal Communications Commission shall implement and enforce this Act as if this Act were a part of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/151">47 U.S.C. 151 et seq.</external-xref>).</text></subsection><subsection id="id2A0D0D71C45E4D4EA9524EEE6800B894"><enum>(b)</enum><header>Violations</header><text display-inline="yes-display-inline">A violation of this Act, or a regulation promulgated under this Act, shall be considered to be a violation of the Communications Act of 1934, or a regulation promulgated under that Act, respectively.</text></subsection><subsection id="idF3EC06ABA5724E2C805F42CF9BDBA301"><enum>(c)</enum><header>No citation required</header><text display-inline="yes-display-inline">Paragraph (5) of section 503(b) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/503">47 U.S.C. 503(b)</external-xref>) shall not apply to a determination of forfeiture liability under that subsection against a person who commits a violation described in subsection (b) of this section.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id4b5a756de65a43f8881aad73736ed30e"><enum>(b)</enum><header>GAO report on CALM Act enforcement</header><paragraph id="id0320CFD379704A37A91E0850380D3C5D"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this Act, the Comptroller General of the United States shall submit to the Committee on Commerce, Science, and Transportation of the Senate and the Committee on Energy and Commerce of the House of Representatives a report on section 2 of the CALM Act (<external-xref legal-doc="usc" parsable-cite="usc/47/621">47 U.S.C. 621</external-xref>), as amended by subsection (a), that—</text><subparagraph id="id71f981b87a3945a9845452a91dd8ea4f"><enum>(A)</enum><text>analyzes the effectiveness of that section in moderating the loudness of commercials in comparison to accompanying video programming;</text></subparagraph><subparagraph id="ide7dce153d2254b039958360bc6b84115"><enum>(B)</enum><text>evaluates the ability of the Federal Communications Commission to effectively moderate the loudness of commercials in comparison to accompanying video programming under subsection (c) of that section; and</text></subparagraph><subparagraph id="idf44fd47e75b14b4a8721a28cec0e691c"><enum>(C)</enum><text>as appropriate, recommends policy solutions that would enable better moderation of the loudness of commercials in comparison to accompanying video programming.</text></subparagraph></paragraph><paragraph id="id4558ff51522b4beb99c8bd71430a521f"><enum>(2)</enum><header>Video programming defined</header><text>In this subsection, the term <term>video programming</term> has the meaning given the term in section 713(h) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/613">47 U.S.C. 613(h)</external-xref>).</text></paragraph></subsection></section></legis-body></bill>
