which was read twice and referred to the <committee-name committee-id="SSAS00">Committee on Armed Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the National Defense Authorization Act for Fiscal Year 2022 to modify the limitation on discharge of members of the Armed Forces solely on the basis of failure to obey a lawful order to receive a vaccine for COVID–19, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Allowing Military Exemptions, Recognizing Individual Concerns About New Shots Act of 2022</short-title></quote> or the <quote><short-title>AMERICANS Act</short-title></quote>.</text></section><section id="idD8F856BD98814FDDA5D945122555BFB8"><enum>2.</enum><header>Modification of limitation on actions based solely on failure to obey an order to receive a vaccine for COVID–19</header><text display-inline="no-display-inline">Section 736 of the National Defense Authorization Act for Fiscal Year 2022 (<external-xref legal-doc="public-law" parsable-cite="pl/117/81">Public Law 117–81</external-xref>) is amended—</text><paragraph id="ida2cf022f35684882b8cd1aeac2d195aa"><enum>(1)</enum><text>by amending the section heading to read as follows: <quote><header-in-text style="OLC" level="section">Limitations on punishment solely on basis of failure to obey order to receive COVID–19 vaccine</header-in-text></quote>;</text></paragraph><paragraph id="id781D1522E0234587A1C0DEDB80961CD4"><enum>(2)</enum><text>in subsection (a)—</text><subparagraph id="idF4AE4C4113FF4923AEA85D54BE648E04"><enum>(A)</enum><text>by striking <quote>a lawful</quote> and inserting <quote>an</quote>; and</text></subparagraph><subparagraph id="id4C899E587FAF4AF2B94419006668AE4F"><enum>(B)</enum><text>by striking <quote>shall be</quote> and all that follows through the period at the end and inserting <quote>shall be an honorable discharge</quote>;</text></subparagraph></paragraph><paragraph id="idFE06B2A4809A4597871DE9FED59218AF"><enum>(3)</enum><text>by redesignating subsection (b) as subsection (f); </text></paragraph><paragraph id="id0EF88118F286413EAD882BB293FD4526"><enum>(4)</enum><text>by inserting after subsection (a) the following new subsections:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idbaa64c2a443145048b802bb5dbc369dc"><subsection id="id44095f3efd314752b64466b772cd6884"><enum>(b)</enum><header>Prohibition on adverse action</header><text>The Secretary of Defense may not take any adverse action against a covered member based solely on the refusal of such member to receive a vaccine for COVID–19.</text></subsection><subsection id="id91886a0d27894adab2fd0cd8e989778d"><enum>(c)</enum><header>Remedies available for a covered member discharged or punished based on COVID–19 status</header><text>At the election of a covered member and upon application through a process established by the Secretary of Defense, the Secretary shall— </text><paragraph id="id24ef99ffeb2c40ecabd66f689e053945"><enum>(1)</enum><text>adjust to <quote>honorable discharge</quote> the status of the member if—</text><subparagraph id="id97213D69E1D24202A99F9A57EE730ECB"><enum>(A)</enum><text>the member was separated from the Armed Forces based solely on the failure of the member to obey an order to receive a vaccine for COVID–19; and</text></subparagraph><subparagraph id="id038211D659FF4D8DAE400714CAA7A203"><enum>(B)</enum><text>the discharge status of the member would have been an <quote>honorable discharge</quote> but for the refusal to obtain such vaccine;</text></subparagraph></paragraph><paragraph id="id1a8021036ccf48679c53d18bc16adace"><enum>(2)</enum><text>reinstate the member at the grade held by the member immediately prior to the involuntary separation of the member;</text></paragraph><paragraph id="id058380e9bab5478c87e4729c7e283649"><enum>(3)</enum><text>expunge from the service record of the member any reference to any adverse action based solely on COVID–19 status, including involuntary separation; and</text></paragraph><paragraph id="id054eeb76057244ff883fa3a52c4a0f81"><enum>(4)</enum><text>include the time of involuntary separation of the member reinstated under paragraph (2) in the computation of the retired or retainer pay of the member.</text></paragraph></subsection><subsection id="id3B3FB58BB70840838BC5DD6C0177F97A"><enum>(d)</enum><header>Attempt To avoid discharge</header><text>The Secretary of Defense shall—</text><paragraph id="idA12EA71C3CF14687A7482CA9E1394786"><enum>(1)</enum><text>make every effort to retain members of the Armed Forces who are not vaccinated against COVID–19; </text></paragraph><paragraph id="id191715FB5F7F401E9F76BE468A538610"><enum>(2)</enum><text>create an exemption to the requirement that members of the Armed Forces be vaccinated against COVID–19 for such members with natural immunity; and </text></paragraph><paragraph id="id87b4b8b6951a4a34b937b98ee2e2b373"><enum>(3)</enum><text>recognize an exemption to the requirement that members of the Armed Forces be vaccinated against COVID–19 based on an underlying health condition or the sincerely held religious beliefs of an individual member. </text></paragraph></subsection><subsection id="id08ab31b6f0bd4cd38cf0c27d2edaa210"><enum>(e)</enum><header>Report on religious exemptions to COVID–19 vaccine</header><text>Not later than 90 days after the date of the enactment of the <short-title>Allowing Military Exemptions, Recognizing Individual Concerns About New Shots Act of 2022</short-title>, the Secretary of Defense shall submit to Congress a report on the number of religious exemptions submitted by members of Armed Forces for the requirement that such members be vaccinated against COVID–19, which shall include how many were approved and how many denied, disaggregated by religious denomination.</text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id8a1fe42e28f54c5ca318432bd66d8cd4"><enum>(5)</enum><text>in subsection (f), as redesignated by paragraph (3)—</text><subparagraph id="id933009045ACE4C4AA172AEC6B16F7FE0"><enum>(A)</enum><text>by redesignating paragraphs (1) and (2) as paragraphs (2) and (3), respectively;</text></subparagraph><subparagraph id="id3828BE1ED9FC467C97B30986A742098D"><enum>(B)</enum><text>inserting before paragraph (2) the following new paragraph (1):</text><quoted-block style="OLC" display-inline="no-display-inline" id="idf0b8f1a2cfc34ae084efc2476b9bda7b"><paragraph id="id58e6863c44e04587a26bacfc083c0e33"><enum>(1)</enum><text>The term <term>adverse action</term> includes discharge, punishment, retaliation, disparate treatment, a requirement to wear a mask, or a requirement to reside in sub-standard housing or endure sub-standard conditions.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="id33D649A5A7224777A4AB2D0772C0CC7F"><enum>(C)</enum><text>in paragraph (3), as redesignated by subparagraph (A)—</text><clause id="id562B6F8958BC408A8D19E572DB61D773"><enum>(i)</enum><text>by striking <quote>means a member</quote> and inserting “means—</text><quoted-block style="OLC" display-inline="no-display-inline" id="idBA0D4FFF495B4221ACFFEBECA3F548A7"><subparagraph id="id8389192725434FE0A0131907C17BF4AF"><enum>(A)</enum><text>a member</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></clause><clause id="id2B8E576EC0CB4ABB831489C8A28DD9C2"><enum>(ii)</enum><text>in subparagraph (A), as designated by clause (i), by striking the period at the end and insert a semicolon; and</text></clause><clause id="id7F926F77B92048CCB86C48E973397AF4"><enum>(iii)</enum><text>by adding at the end the following new subparagraphs:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id5A221A04E4644B9FB0908A154020F763"><subparagraph id="id7AA50F82638E453C88A0F354C4CCA6CD"><enum>(B)</enum><text>an individual enrolled at a military service academy; or</text></subparagraph><subparagraph id="id107BB3FAED9C4D0B968218ABAD7582BA"><enum>(C)</enum><text>an individual enrolled in the Junior Reserve Officers’ Training Corps (JROTC) or Senior Reserve Officers’ Training Corps (SROTC) program.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph></paragraph></section></legis-body></bill>
