<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>2d Session</session><legis-num>S. 4150</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20220505">May 5, 2022</action-date><action-desc><sponsor name-id="S287">Mr. Cornyn</sponsor> (for himself, <cosponsor name-id="S057">Mr. Leahy</cosponsor>, <cosponsor name-id="S374">Mr. Cotton</cosponsor>, <cosponsor name-id="S385">Ms. Cortez Masto</cosponsor>, and <cosponsor name-id="S384">Mr. Tillis</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To allow Federal law enforcement officers to purchase retired service weapons, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H3593F55AD0CB4C66931FAFF0739AD191"><section section-type="section-one" id="H1D629BE2830C470C9AD6612781A936FB"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Federal Law Enforcement Service Weapon Purchase Act</short-title></quote>.</text></section><section section-type="subsequent-section" id="idF6423D6A0E554044841B716FC73B8A24"><enum>2.</enum><header>Purchase of retired handguns by Federal law enforcement officers</header><subsection id="idF4BCC201304E495EAB4C91C95E39A175"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id692D95679C4D4E209E3B891A979E4959"><enum>(1)</enum><text>the term <term>Federal law enforcement officer</term> has the meaning given that term in section 115(c)(1) of title 18, United States Code;</text></paragraph><paragraph id="idA65671F9742A4CBDA1AC8B2E8B7E08C1"><enum>(2)</enum><text display-inline="yes-display-inline">the term <term>handgun</term> has the meaning given that term in section 921(a) of title 18, United States Code; and</text></paragraph><paragraph id="id945A978FEDAC46398FA190C670000FE0" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text>the term <term>retired handgun</term> means any handgun that has been declared surplus by the applicable agency.</text></paragraph></subsection><subsection id="HA5ED71F011D443D9A5B1DEF279FFC5DA"><enum>(b)</enum><header>Authorization</header><text display-inline="yes-display-inline">A Federal law enforcement officer may purchase a retired handgun from the Federal agency that issued the handgun to such officer.</text></subsection><subsection id="HEEF5ACAEEE6B4A4FA41D88174A41714B"><enum>(c)</enum><header>Limitations</header><text>A Federal law enforcement officer may purchase a retired handgun under subsection (b) if—</text><paragraph id="H31865F946D5241E3B58FA5D1BAFCCCBC"><enum>(1)</enum><text>the purchase is made during the 6-month period beginning on the date the handgun was so retired; and</text></paragraph><paragraph id="HE4DBBF09B41B4B3F88753AC2045A5319"><enum>(2)</enum><text>the officer is not prohibited from possessing or receiving the handgun under the laws of the United States or the laws of the State, territory, or possession of the United States in which the officer resides.</text></paragraph></subsection><subsection id="H33229E33F655455F8A5F874E50B79782"><enum>(d)</enum><header>Cost</header><text>A handgun purchased under this section shall be sold at the fair market value for such handgun taking into account the age and condition of the handgun.</text></subsection><subsection id="HFC3CF3332A46439994646E239A8453A9"><enum>(e)</enum><header>Policy guidance</header><text>The Administrator of General Services shall develop policies to facilitate the sale and disposition of eligible handguns under this section consistent with section 922 of title 18, United States Code. </text></subsection></section></legis-body></bill>
