which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To provide standards relating to compensation for the use of the names, images, and likenesses of amateur intercollegiate athletes and to provide protections for amateur intercollegiate athletes, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Amateur Athletes Protection and Compensation Act of 2021</short-title></quote>.</text></section><section id="id71bd807b54d344e98833dd208a479b76"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act: </text><paragraph id="id6AF56C61C0B247239C95E6092C27B010"><enum>(1)</enum><header>Agency contract</header><text>The term <term>agency contract</term> means a written agreement in which an amateur intercollegiate athlete authorizes an amateur athlete representative to act on behalf of the amateur intercollegiate athlete.</text></paragraph><paragraph id="id9E347B25801B4EFF93D4D3F1914BA651"><enum>(2)</enum><header>AIAC</header><text>The term <term>AIAC</term> means the Amateur Intercollegiate Athletics Corporation established by section 8(a).</text></paragraph><paragraph id="idaf10aaa91b0647ffaec7f1b86e413373"><enum>(3)</enum><header>Amateur athlete representative</header><subparagraph id="idB8B709458E884C328479F1F4FA1BF67A"><enum>(A)</enum><header>In general</header><text>The term <term>amateur athlete representative</term> means an individual who—</text><clause id="id26879DC2FC4B45EEAF5204F06076A767"><enum>(i)</enum><text>enters into an agency contract with an amateur intercollegiate athlete; or</text></clause><clause id="id58194438D6A8406282B94E2CA5C9989B"><enum>(ii)</enum><text>directly or indirectly recruits or solicits an amateur intercollegiate athlete for the purpose of—</text><subclause id="id04a044cfd4d14bbb9020632836ebb936"><enum>(I)</enum><text>entering into an agency contract with the amateur intercollegiate athlete;</text></subclause><subclause id="id0851c6d61b47445d85b1a1c45eb34c5d"><enum>(II)</enum><text>representing or attempting to represent the amateur intercollegiate athlete for the purpose of marketing his or her athletics ability or reputation for financial gain; or</text></subclause><subclause id="idd11e2bab24c640109e5aa867abce22ef"><enum>(III)</enum><text>seeking to obtain any type of financial gain or benefit from the potential earnings of the amateur intercollegiate athlete as a professional athlete.</text></subclause></clause></subparagraph><subparagraph id="id6EEBD09BD2FE440A8E93BF9E1A46A840"><enum>(B)</enum><header>Inclusions</header><text>The term <term>amateur athlete representative</term> includes—</text><clause id="id05EE49C0925A4AAF9C9414BCA9D021B5"><enum>(i)</enum><text>a certified contract advisor; </text></clause><clause id="idC9C50B48C686487EA66CA7B92E30FE9D"><enum>(ii)</enum><text>a financial advisor;</text></clause><clause id="id71C6D66C3E4B432D8BFB8DF9E39FA553"><enum>(iii)</enum><text>a marketing representative; </text></clause><clause id="idA5CD3514AECB46A394DFE2D3B01C8438"><enum>(iv)</enum><text>a brand manager; and</text></clause><clause id="id57B3E01589214A01869E59E03C32BB6F"><enum>(v)</enum><text>any individual employed by or associated with an individual described in any of clauses (i) through (iv).</text></clause></subparagraph><subparagraph id="id630B6D59FB7B409E9BC98D0A7706595C"><enum>(C)</enum><header>Exclusions</header><text>The term <term>amateur athlete representative</term> does not include—</text><clause id="idD93EE5549FF145798452AF9EEADFAD72"><enum>(i)</enum><text>the spouse, a parent, a sibling, a grandparent, or a legal guardian of an amateur intercollegiate athlete; or</text></clause><clause id="id723FB724A8224AC19426253285F74783"><enum>(ii)</enum><text>an individual acting solely on behalf of a professional sports team or a professional sports organization.</text></clause></subparagraph></paragraph><paragraph id="id503518fc5b594caca31b4486bf1aa6b0"><enum>(4)</enum><header>Amateur intercollegiate athlete</header><text>The term <term>amateur intercollegiate athlete</term> means an athlete who is or may be recruited to attend, or is enrolled in, a 4-year degree-granting institution of higher education. </text></paragraph><paragraph id="idbc8b7d05aceb464da7533360533a1af3"><enum>(5)</enum><header>Amateur intercollegiate athletic event</header><subparagraph id="id58F3DB092A4B4F8394F1DF30797896BE"><enum>(A)</enum><header>In general</header><text>The term <term>amateur intercollegiate athletic event</term> means a game, meet, competition, banquet, practice, conditioning session, media session, or any other event that has been organized or authorized by an athletics representative of an institution of higher education or by a national amateur athletic association, regardless of whether such event occurs on or off the campus of an institution of higher education or during or outside the season for competition. </text></subparagraph><subparagraph id="id1011F25783224F9AAE97D7797078B545"><enum>(B)</enum><header>Inclusion</header><text>The term <term>amateur intercollegiate athletic event</term> includes travel to and from any event described in subparagraph (A).</text></subparagraph></paragraph><paragraph id="ide4fb353f72354e23883ce0b311a6f6d5"><enum>(6)</enum><header>Amateur intercollegiate athletic competition</header><text>The term <term>amateur intercollegiate athletic competition</term> means any varsity game, meet, or other competition between or among teams sponsored by institutions of higher education.</text></paragraph><paragraph id="id870276e1c7c34b808039ae59f07f62f5"><enum>(7)</enum><header>Athletics booster</header><text>The term <term>athletics booster</term> means any individual or entity that, directly or indirectly, through any other individual or entity or in any other manner—</text><subparagraph id="id89e7317c22cc42f285c583ddea8d5ac1"><enum>(A)</enum><text>has provided 1 or more donations exceeding $5,000, in the aggregate, to obtain season tickets for any sport at an institution of higher education;</text></subparagraph><subparagraph id="id18373ef0184840e28eb6dcdb83fbe76b"><enum>(B)</enum><text>has made 1 or more financial contributions exceeding $5,000, in the aggregate, to the athletics department or other athletics management organization of an institution of higher education; or</text></subparagraph><subparagraph id="idd04f1bccd6dc4a8c92601be03cbf259c"><enum>(C)</enum><text>has assisted, or been requested by an employee of an institution of higher educations to assist, in the recruitment of an amateur intercollegiate athlete. </text></subparagraph></paragraph><paragraph commented="no" id="id2C7EE56166354D8A820AC768614E4204"><enum>(8)</enum><header>Conference</header><text>The term <term>conference</term> means any organization or association that—</text><subparagraph commented="no" id="id8868DC4BE1E8467284E05F128B766A4D"><enum>(A)</enum><text>has as members 2 or more institutions of higher education; </text></subparagraph><subparagraph commented="no" id="idF81D277C358F4CFE8DC3EC2A68162F3B"><enum>(B)</enum><text>arranges championships and sets rules for amateur intercollegiate athletic competition.</text></subparagraph></paragraph><paragraph id="id35A4298FDC79465597D0A08E3540BF32"><enum>(9)</enum><header>Cost of attendance</header><text>The term <term>cost of attendance</term>—</text><subparagraph id="id5BB9AF1719AF4D9E8DE2CA74E20EED0D"><enum>(A)</enum><text>has the meaning given the term in section 472 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1087ll">20 U.S.C. 1087ll</external-xref>); and</text></subparagraph><subparagraph id="id514B1842BA784A68BCE23A6031BDCF2A"><enum>(B)</enum><text>shall be calculated by the financial aid office of an institution of higher education applying the same standards, policies, and procedures for all students. </text></subparagraph></paragraph><paragraph id="id122a1e533eb040bb9e5333096c69a8eb"><enum>(10)</enum><header>Covered compensation</header><subparagraph id="id29844EB2B0AC4C3EA8C5F51EBB6E943E"><enum>(A)</enum><header>In general</header><text>The term <term>covered compensation</term> means any remuneration, in cash or in kind and regardless of the date on which the remuneration is provided, to an amateur intercollegiate athlete.</text></subparagraph><subparagraph id="id8AECE85C24D444D6B99071ADD9F6ABB2"><enum>(B)</enum><header>Exclusion</header><text>The term <term>covered compensation</term> does not include the payment or provision of any of the following—</text><clause id="ide21f481686dd43cfbff21cd6d9080bb2"><enum>(i)</enum><text>grants-in-aid;</text></clause><clause id="id1964d4edd9b94f26a7c3be8df9f45ebd"><enum>(ii)</enum><text>Federal Pell Grants and other State or Federal grants unrelated and not awarded with regard to participation in amateur intercollegiate athletic events;</text></clause><clause id="id9c3b178032304f3d91d6ea2cc8adfae0"><enum>(iii)</enum><text>health insurance and costs of health care, including health insurance and health care costs wholly or partly self-funded by an institution of higher education or a national amateur athletic association;</text></clause><clause id="id08c4c556bb16431ca062e53716b78d8b"><enum>(iv)</enum><text>disability and loss of value insurance, including disability and loss of value insurance that is wholly or partly self-funded by an institution of higher education or a national amateur athletic association;</text></clause><clause id="id2e73b98f32ea4dc2b45650eb953b8ffc"><enum>(v)</enum><text>career counseling, job placement services, and other guidance available to all students at an institution of higher education; and</text></clause><clause id="idc9dd3e816e0a49a69e3ac5e0be4fcc11"><enum>(vi)</enum><text>payment of hourly wages and benefits for work actually performed (and not for participation in amateur intercollegiate athletic event) at a rate commensurate with the going rate in the locality of an institution of higher education for similar work.</text></clause></subparagraph></paragraph><paragraph id="ide5ba0336526c457f91db35ddb24ecddc"><enum>(11)</enum><header>Endorsement contract</header><text>The term <term>endorsement contract</term> has the meaning given the term in section 2 of the Sports Agent Responsibility and Trust Act (<external-xref legal-doc="usc" parsable-cite="usc/15/7801">15 U.S.C. 7801</external-xref>).</text></paragraph><paragraph id="idE0771C9C86294412A03BDF5906BD6490"><enum>(12)</enum><header>Former amateur intercollegiate athlete</header><text>The term <term>former intercollegiate athlete</term> means an amateur intercollegiate athlete who is no longer eligible to participate in amateur intercollegiate athletic competition. </text></paragraph><paragraph id="id222e57f37a2244668daf418dd1815a0e"><enum>(13)</enum><header>Grant-in-aid</header><text>The term <term>grant-in-aid</term>—</text><subparagraph id="id57B0ECC5429E4479BF89C8910E46BA4F"><enum>(A)</enum><text>means a scholarship, grant, stipend, or other form of financial assistance, including the provision of tuition, room, board, books, or funds for fees or personal expenses, that—</text><clause id="id9D211F481D464786800ECBD92C634806"><enum>(i)</enum><text>is paid or provided by an institution of higher education to a student for the student's undergraduate or graduate course of study; and</text></clause><clause id="id37A0EC8B2EBA4D84BCB527EB4452F45E"><enum>(ii)</enum><text>is in an amount that does not exceed the cost of attendance for such student at the institution; and</text></clause></subparagraph><subparagraph id="idBCED44467E454F1F8676365B15FCCEE9"><enum>(B)</enum><text>does not include covered compensation paid to an individual who is an amateur intercollegiate athlete or a former amateur intercollegiate athlete. </text></subparagraph></paragraph><paragraph id="id53F207E0277F405E9B153038D00B88F0"><enum>(14)</enum><header>Image</header><text>The term <term>image</term>, with respect to an amateur intercollegiate athlete, means a photograph, video, or computer-generated representation that identifies, is linked to, or is reasonably linkable to the athlete.</text></paragraph><paragraph id="idae5bd26999124a8786579f8107ea4176"><enum>(15)</enum><header>Institution of higher education</header><text>The term <term>institution of higher education</term> has the meaning given the term under section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>). </text></paragraph><paragraph id="id0365B9C5001F4DC4942976339CB81AAB"><enum>(16)</enum><header>Likeness</header><text>The term <term>likeness</term> means—</text><subparagraph commented="no" id="idA285702896CD48C385CFC1B8EC4868F9"><enum>(A)</enum><text>with respect to an amateur intercollegiate athlete of a sport for which the athlete has a jersey number, the jersey number associated with the athlete and the sport in which the athlete participates at a particular institution of higher education during the period of the participation of the athlete in the sport at the institution of higher education, if the jersey number is accompanied by—</text><clause id="idAD85524E73A64D27B75F61443933296F"><enum>(i)</enum><text>a logo or color scheme that is clearly associated with the institution of higher education; or</text></clause><clause id="idA2D2F4F9DE3C445EA7B520870A284A9A"><enum>(ii)</enum><text>some other means by which the jersey number is clearly associated with the particular athlete; and</text></clause></subparagraph><subparagraph id="id07ee936224a8474a914362ecad17bca9"><enum>(B)</enum><text>with respect to any amateur intercollegiate athlete—</text><clause id="id5a4619d198624a6e97f3cae7879a70b6"><enum>(i)</enum><text>the uniquely identifiable voice or catch phrase of the athlete; or</text></clause><clause commented="no" display-inline="no-display-inline" id="id2d8d3470a4bd43fe8c11177f377db55c"><enum>(ii)</enum><text>any other trademark that identifies or distinguishes the athlete. </text></clause></subparagraph></paragraph><paragraph id="id1E7FD635DDBD4C0EA9B15F95190AD755"><enum>(17)</enum><header>Name</header><text>The term <term>name</term>, with respect to an amateur intercollegiate athlete, means—</text><subparagraph id="id9A7657F6CD10499689D872C8C52D6D9B"><enum>(A)</enum><text>a combination of a first and last or family name that identifies the athlete;</text></subparagraph><subparagraph id="id4EA8CC536E834593945BF959807A2A8C"><enum>(B)</enum><text>a last or family name that identifies the athlete; or</text></subparagraph><subparagraph id="idF41051CCFE73455D801E2B9EECB6416D"><enum>(C)</enum><text>a unique nickname that identifies the athlete.</text></subparagraph></paragraph><paragraph id="idaf6509dacd1f4d6fbb290801c5ae5b2a"><enum>(18)</enum><header>National amateur athletic association</header><subparagraph id="idDFF272D8BDD44F1BBA3746F5C880A8D1"><enum>(A)</enum><header>In general</header><text>The term <term>national amateur athletic association</term> means a not-for-profit corporation, an association, or any other group organized in the United States that—</text><clause id="id3528DF0EEFFB43DF9B965C5867049E30"><enum>(i)</enum><text>sponsors or arranges amateur intercollegiate athletic competition between institutions of higher education; and</text></clause><clause id="id740AF30345E3431784A3A355671B6BCB"><enum>(ii)</enum><text>sets common rules, standards, procedures, or guidelines for the administration of amateur intercollegiate athletic competition at institutions of higher education.</text></clause></subparagraph><subparagraph id="idCF49A7A3E4254C8FBB6C3FE2A49F240B"><enum>(B)</enum><header>Inclusions</header><text>The term <term>national amateur athletic association</term> includes—</text><clause id="id9580E2E1AE364DCBBC83AD2A3EBDD614"><enum>(i)</enum><text>the National Collegiate Athletic Association; and</text></clause><clause id="id6A03A35460364F5F9D0D727221E52622"><enum>(ii)</enum><text>each division and member conference of the National Collegiate Athletic Association, or of any other national amateur athletic association, separately and collectively.</text></clause></subparagraph></paragraph><paragraph id="idc2bb14f4c8184461a6f68a7f0b003b35"><enum>(19)</enum><header>Third party</header><text>The term <term>third party</term> means an individual or entity that—</text><subparagraph id="idE5FFB9A5D5F54FA0B123A1367D34A24A"><enum>(A)</enum><text>is not an athletics department or an athletics booster of an institution of higher education; and</text></subparagraph><subparagraph id="idE12BF1ECB7D24B14BFBD83C494489A27"><enum>(B)</enum><text>is unaffiliated with an athletics department or an athletics booster of an institution of higher education.</text></subparagraph></paragraph><paragraph id="idfee5381f2d5b46f2871ffa99dab03473"><enum>(20)</enum><header>Unaffiliated</header><text>With respect to 2 or more individuals or entities, the term <term>unaffiliated</term> means that the individuals or entities do not share interrelated operations, common management, centralized control of labor relations, or common ownership or financial control.</text></paragraph></section><section id="idd9e97522cdbe4612b25104b4adbdb61b"><enum>3.</enum><header>Covered compensation provided by unaffiliated third parties</header><text display-inline="no-display-inline">The provision of covered compensation to an amateur intercollegiate athlete who is enrolled, or may in the future enroll, in an institution of higher education—</text><paragraph id="idF10ACB5267F54F2CB704F8738EDA77F7"><enum>(1)</enum><text display-inline="yes-display-inline">may only be promised, paid, and permitted if the covered compensation is sourced from, and provided at the discretion of, a third party; and</text></paragraph><paragraph id="id82122ca047f54114a09601c9ad159fe5"><enum>(2)</enum><text>shall not be promised, paid, or permitted to induce—</text><subparagraph id="idc05742547bce47eda61e7cf4e81efeab"><enum>(A)</enum><text>the recruitment of an amateur intercollegiate athlete to any institution of higher education or a group of institutions of higher education; or</text></subparagraph><subparagraph id="idaa08dcd926234ac9a2c37218cb1b3aa6"><enum>(B)</enum><text>an amateur intercollegiate athlete to continue attending a particular institution of higher education. </text></subparagraph></paragraph></section><section id="ide4141972d3f4439b8b5de3aacc622fe8"><enum>4.</enum><header>Protections for amateur intercollegiate athletes</header><subsection id="id189e5051c68f4a1cbf57669389e307fc"><enum>(a)</enum><header>Representation contracts</header><text>A national amateur athletic association or an institution of higher education may not punish or prohibit the participation of an amateur intercollegiate athlete in an amateur intercollegiate athletic event or amateur intercollegiate athletic competition based on the amateur intercollegiate athlete having entered into an agency contract with an amateur athlete representative who has been certified by the AIAC in accordance with section 8(b)(4).</text></subsection><subsection id="id89831a339cb84432bf24278776a0e023"><enum>(b)</enum><header>Endorsement contracts</header><paragraph id="idb5a4829fd70842c59489ac775836135f"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), a national amateur athletic association or an institution of higher education may not punish or prohibit the participation of an amateur intercollegiate athlete in an intercollegiate athletic event or amateur intercollegiate athletic competition based on the amateur intercollegiate athlete having entered into an endorsement contract with a third party.</text></paragraph><paragraph id="id2d678098ed7a4ef8a94640903df1c6ca"><enum>(2)</enum><header>Exceptions</header><text>A national amateur athletic association or an institution of higher education may prohibit the participation of an amateur intercollegiate athlete in an intercollegiate athletic event or amateur intercollegiate athletic competition based on the amateur intercollegiate athlete having entered into an endorsement contract with a third party if the contract violates—</text><subparagraph id="id9F54F4614E8343E6AF3915807FAC6C49"><enum>(A)</enum><text>the code of student conduct of the applicable national amateur athletic association or institution of higher education; or</text></subparagraph><subparagraph id="idC463A063926B413E90DF71DB788C81F2"><enum>(B)</enum><text>a rule established by the AIAC in accordance with section 8(b)(2).</text></subparagraph></paragraph><paragraph id="id604629e0ec9b40b9a67ec42bc7b22b1b"><enum>(3)</enum><header>Limitation</header><text>During and immediately before and after an amateur intercollegiate athletic event, an institution of higher education may prohibit an amateur intercollegiate athlete enrolled at such institution from engaging in promotional or endorsement activities in connection with an endorsement contract. </text></paragraph><paragraph id="id1ca0554b85f842dc943772fc04794338"><enum>(4)</enum><header>Disclosures</header><subparagraph id="idB023D143D9C644108E7D73A75C4293DF"><enum>(A)</enum><header>Enrolled athletes</header><text>With respect to an amateur intercollegiate athlete enrolled in an institution of higher education who enters into an endorsement contract, the amateur intercollegiate athlete shall, not later than 7 days after entering into the endorsement contract, provide to the institution of higher education a copy of the endorsement contract.</text></subparagraph><subparagraph id="idBE792FCCDF124038B16F8A3BA21812D2"><enum>(B)</enum><header>Recruited athletes</header><text>With respect to an amateur intercollegiate athlete who is or may be recruited to attend, but not yet enrolled in, an institution of higher education and who enters into an endorsement contract, the amateur intercollegiate athlete shall, before signing a letter of intent, provide to the institution of higher education a copy of all current and expired endorsement contracts entered into by the amateur intercollegiate athlete.</text></subparagraph></paragraph></subsection><subsection id="idb17133f7b8b34e38b8008eda729445f2"><enum>(c)</enum><header>Rescission of agreements</header><text>An amateur intercollegiate athlete who no longer participates in amateur intercollegiate athletic competitions may rescind an endorsement contract with a remaining term of more than 1 year—</text><paragraph id="idc5c24f6ce3c64ed6b9ac987a198c3919"><enum>(1)</enum><text>without being held liable for breach; and</text></paragraph><paragraph id="id5f5b83e3f67d4a27b234d9bdc0568805"><enum>(2)</enum><text>with no obligation to return payments received before giving notice of the rescission. </text></paragraph></subsection><subsection id="idea1d4ab13e144cc48850b83a527fc380"><enum>(d)</enum><header>Professional sports drafts</header><text display-inline="yes-display-inline">A national amateur athletic association or an institution of higher education may not prohibit the participation of an amateur intercollegiate athlete in an amateur intercollegiate athletic event based on the amateur intercollegiate athlete having entered into a professional sports draft, if the amateur intercollegiate athlete—</text><paragraph id="ida6ebd9ed8f3641d58467bbc9b9350bb6"><enum>(1)</enum><text>does not receive compensation, directly or indirectly, from—</text><subparagraph id="id9396597E98954173B72C7E7855A55DDA"><enum>(A)</enum><text>a professional sports league; </text></subparagraph><subparagraph id="idB345E473453B4B57B19A90A428E94BFD"><enum>(B)</enum><text>a professional sports team; or </text></subparagraph><subparagraph id="idE0C55532540149EFB15155A11290C655"><enum>(C)</enum><text>a sports agent; </text></subparagraph><subparagraph id="idC2B423FF791F42F6BEF86803C7B82B30"><enum>(D)</enum><text>an amateur athlete representative; or</text></subparagraph><subparagraph id="idD3FD2B35A5E444F0A16990D54AE1F46F"><enum>(E)</enum><text>any individual or entity affiliated with an individual or entity described in any of subparagraphs (A) through (D); and</text></subparagraph></paragraph><paragraph id="id1dfb9777281c4c73b079fadb3249809c"><enum>(2)</enum><text>not later than 7 days after the completion of the draft, declares his or her intent to resume participation in amateur intercollegiate athletic competition.</text></paragraph></subsection><subsection id="id532a9e966bc64cec9704de5b4de6694b"><enum>(e)</enum><header>Grant-in-Aid protection</header><paragraph commented="no" id="id0e4e9b65c16f4437a14219477f6bd21b"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), an institution of higher education shall honor the grant-in-aid of an amateur intercollegiate athlete.</text></paragraph><paragraph id="idfabe96a3eaa2434fbc52e54769920988"><enum>(2)</enum><header>Former amateur intercollegiate athletes</header><text>An institution of higher education shall continue to provide a grant-in-aid covering full tuition, books, and fees to any former amateur intercollegiate athlete who—</text><subparagraph id="id6A2B47A4E3BF4486809788979D1777CA"><enum>(A)</enum><text>received a full grant-in-aid while enrolled at the institution of higher education; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idC56D3AA8B0F141619D3D2498EFE3F09D"><enum>(B)</enum><text>has not completed his or her course of study for an undergraduate degree as a result of pursuing a career in professional sports.</text></subparagraph></paragraph><paragraph id="ida476ecb87fca4f828e50304996de142f"><enum>(3)</enum><header>Revocation and reinstatement</header><subparagraph id="idb7be8a64600a49118e334f468eadd28d"><enum>(A)</enum><header>Revocation</header><text>An institution of higher education may revoke the grant-in-aid of an amateur intercollegiate athlete or a former amateur intercollegiate athlete who—</text><clause id="idD0F96998ED9049A1B014FCA777C90DFB"><enum>(i)</enum><text>transfers to another institution of higher education; or</text></clause><clause id="id6D871C8E5514488FBC7948696ADFC5E5"><enum>(ii)</enum><text>does not—</text><subclause id="id25fe722f37f24b69ab8c8ce3401a9d73"><enum>(I)</enum><text>remain in good standing, determined in accordance with—</text><item id="id1E2C7DD752ED474B88F7198D148D0591"><enum>(aa)</enum><text>the rules established by the AIAC under section 8(b)(2); or</text></item><item id="id8262018317BE4148BF4036E87812A2A6"><enum>(bb)</enum><text>in the case of an amateur intercollegiate athlete who is enrolled in an institution of higher education the standards of which are more stringent than the standards described in item (aa), the standards of the institution of higher education;</text></item></subclause><subclause id="id4f1346ac59bf4927bc31a8a26411b5b1"><enum>(II)</enum><text>comply with the code of conduct of the institution of higher education; and</text></subclause><subclause id="id034e8308fec14e9791d4d8e89715225f"><enum>(III)</enum><text>meet athletic program standards and norms for participating in mandatory team athletic activities.</text></subclause></clause></subparagraph><subparagraph id="id190a2cc5f9fc4febb6e9e2519e63e904"><enum>(B)</enum><header>Limitations</header><text>An institution of higher education may not revoke the grant-in-aid of an amateur intercollegiate athlete—</text><clause id="idfb70074fe88840cabdc85d9d99da00c1"><enum>(i)</enum><text>on the basis of the amateur intercollegiate athlete's athletics ability, performance, or contribution to team success; or</text></clause><clause id="id2d505cc672b144ef9d7b315906050a64"><enum>(ii)</enum><text>as a result of an injury or illness or based on a physical or mental medical condition of the amateur intercollegiate athlete.</text></clause></subparagraph><subparagraph id="id6f31f785e31b48939eefe8e885dab2d1"><enum>(C)</enum><header>Reinstatement</header><text>In the case of a revocation under subparagraph (A), an institution of higher education may reinstate grant-in-aid if the amateur intercollegiate athlete concerned reestablishes good standing.</text></subparagraph></paragraph></subsection><subsection id="id408b00506dbf440882d15dad63f15733"><enum>(f)</enum><header>Limitation on transfer penalties</header><text>An amateur intercollegiate athletics association shall allow an amateur intercollegiate athlete in any sport to transfer from one institution of higher education to another not less than once without losing or delaying eligibility for intercollegiate athletics if— </text><paragraph id="iddb1e8c28f0d44d168dd35149ce27b89c"><enum>(1)</enum><text>not less than 7 days before transferring, the amateur intercollegiate athlete provides to his or her athletic director notice of intent to transfer; and</text></paragraph><paragraph id="idb775317fba8f4c06abd5a62a41f19d8b"><enum>(2)</enum><text>the transfer does not occur during—</text><subparagraph id="idE06237E46DA3427EBA34F91CDDDBD6D7"><enum>(A)</enum><text>the season of the sport of the amateur intercollegiate athlete; or</text></subparagraph><subparagraph id="id16C33EE3D00143B1ADBFB7D493120890"><enum>(B)</enum><text>the 60-day period before the commencement of such season.</text></subparagraph></paragraph></subsection><subsection id="idd686f755ada4473bb67d272a2c64e1c2"><enum>(g)</enum><header>Medical expenses</header><text>Except as provided in paragraph (3), the responsibilities of institutions of higher education with respect to the health care coverage and medical expenses of amateur intercollegiate athletes are as follows: </text><paragraph id="id38ce413a457349d8b07d58f94360afaf"><enum>(1)</enum><header>Out-of-pocket expenses</header><subparagraph id="id0b169c4c4b234862b88186d326fc7edc"><enum>(A)</enum><header>Institutions of higher education reporting $20,000,000 or more</header><text>An institution of higher education that reports not less than $20,000,000 in total annual athletics revenue to the Department of Education during the academic year immediately preceding the date of the last amateur intercollegiate athletic competition of an amateur intercollegiate athlete shall, during the 2-year period beginning on the day after such last amateur intercollegiate athletic competition, be financially responsible for all out-of-pocket medical expenses, up to the deductible, of the amateur intercollegiate athlete’s health care coverage for any injury or communicable disease that was incurred or acquired while the amateur intercollegiate athlete was participating in an amateur intercollegiate athletic event or an amateur intercollegiate athletic competition.</text></subparagraph><subparagraph id="ida84fdbb5a7a14568ade015561d628d1f"><enum>(B)</enum><header>Institutions of higher education reporting $50,000,000 or more</header><text>An institution of higher education that reports not less than $50,000,000 in total annual athletics revenue to the Department of Education during the academic year immediately preceding the date of the last amateur intercollegiate athletic competition of an amateur intercollegiate athlete shall, during the 4-year period beginning on the day after such last amateur athletic competition, be financially responsible for—</text><clause id="idA8FA00B60AAD4239B941DA71A0772F24"><enum>(i)</enum><text>providing or procuring the amateur intercollegiate athlete's health care coverage for any injury or communicable disease that was incurred or acquired while the amateur intercollegiate athlete was participating in an amateur intercollegiate athletic event or an amateur intercollegiate athletic competition; and</text></clause><clause id="id6465228529344914B78BBF7CD74A7A7C"><enum>(ii)</enum><text>all out-of-pocket medical expenses, up to the deductible, for medical care for such injury or disease.</text></clause></subparagraph></paragraph><paragraph id="id4af3357a0a494d1b972b88aa358f7d41"><enum>(2)</enum><header>Second opinions</header><text>During the enrollment of an amateur intercollegiate athlete in an institution of higher education and continuing through the 2-year period described in subparagraph (A) of paragraph (1) or the 4-year period described in subparagraph (B) of that paragraph, as applicable, an institution of higher education shall be financially responsible for the expense of obtaining, for amateur intercollegiate athletes and former amateur intercollegiate athletes, medical second opinions independent from the institution of higher education.</text></paragraph><paragraph id="id373fa084f8c44e2783d6c54c330081ba"><enum>(3)</enum><header>Exception</header><text>The responsibilities under paragraphs (1) and (2) shall not apply to an institution of higher education in the case of an amateur intercollegiate athlete who transfers out of the institution of higher education to continue participation in intercollegiate athletics elsewhere. </text></paragraph></subsection></section><section id="idE3E688963D094A839595FE25105C7F54"><enum>5.</enum><header>Employment matters</header><text display-inline="no-display-inline">Notwithstanding any other provision of Federal or State law, an amateur intercollegiate athlete shall not be considered an employee of an institution of higher education, a conference, or a national amateur athletic association based on the amateur intercollegiate athlete’s participation in amateur intercollegiate athletic events or amateur intercollegiate athletic competitions.</text></section><section id="id9ab48b55df8842c2862c655801f0520e"><enum>6.</enum><header>Transparency</header><subsection id="id8F56E2F74AEA4D7D925054B2870A23CF"><enum>(a)</enum><header>Disclosures</header><paragraph id="idBEACBEAB5BFA4AFD83FE2EA6DD81A577"><enum>(1)</enum><header>In general</header><text>An institution of higher education shall make the following legally binding disclosures to each amateur intercollegiate athlete before he or she commits to enroll in or attend the institution of higher education:</text><subparagraph id="id8a2a85982fd84a8eb0a96ce269907f9e"><enum>(A)</enum><text>The amount and duration of grant-in-aid the institution of higher education will provide to the amateur intercollegiate athlete, relative to the most recent cost of attendance, for each academic school year and each summer session.</text></subparagraph><subparagraph id="idc82afcb4d66a4a34b8d0fccd3265661c"><enum>(B)</enum><text>The amount and duration of grant-in-aid the institution of higher education will provide to assist the amateur intercollegiate athlete with undergraduate degree completion and graduate degree completion following the expiration of the intercollegiate athletics eligibility of the amateur intercollegiate athlete.</text></subparagraph><subparagraph id="id65ec9c197f9e4bab898abd2e343d5b47"><enum>(C)</enum><text>The percentage of comprehensive medical coverage required, including any required coverage to participate in intercollegiate athletics or to enroll as a student, that will be paid by the institution of higher education during the period of intercollegiate athletics eligibility of the amateur intercollegiate athlete.</text></subparagraph><subparagraph id="idc7ca412c2d3e4c0683407ccc0e048e25"><enum>(D)</enum><text>The percentage of any out-of-pocket sports-related medical expenses including deductibles, copays, and coinsurance, that the institution of higher education will pay during the period of intercollegiate athletics eligibility of the amateur intercollegiate athlete, and the period for which such expenses will be covered after such eligibility expires. Differences between in-network and out-of-network expenses shall be stated.</text></subparagraph><subparagraph id="id0ef77d4dfe2c41e399e4ad6eeb6005c0"><enum>(E)</enum><text>Whether or not the institution of higher education will pay for a disability insurance policy to cover the maximum available future loss of earnings benefit based on market rates of similarly situated amateur intercollegiate athletes.</text></subparagraph></paragraph><paragraph id="idA65BB7E9DE8C4040BD6873FCFF573203"><enum>(2)</enum><header>Rule of construction</header><text>Nothing in this subsection shall be construed to require an institution of higher education to provide a benefit described in any of subparagraphs (A) through (E) of paragraph (1) unless otherwise required by this Act.</text></paragraph></subsection><subsection id="id18970b5630be43138674e611bd4dd5c0"><enum>(b)</enum><header>Funding transparency</header><text display-inline="yes-display-inline">Section 485(e)(1) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1092">20 U.S.C. 1092(e)(1)</external-xref>) is amended—</text><paragraph id="id1b1193eee4be421184ad13bd293ed927"><enum>(1)</enum><text>in subparagraph (E), by striking <quote>and</quote> after the semicolon;</text></paragraph><paragraph id="ida4deb26c87874d4780f0828392b492cf"><enum>(2)</enum><text>in subparagraph (F), by striking the period and inserting a semicolon; and</text></paragraph><paragraph id="idee45a6f304624f9b9fee8d13dd1499f1"><enum>(3)</enum><text>by adding at the end of the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id485c44c313b64455bbd4bcdb75d9725b"><subparagraph id="idd78f86f0ca9948769d3e58d88ca7d7fd"><enum>(G)</enum><text>the total compensation of—</text><clause id="id3761b01777fd4d7da2c7e4318cb278a2"><enum>(i)</enum><text>the athletic director of the institutions;</text></clause><clause id="idac40add5bcc5421a807ff9b9cffd94b2"><enum>(ii)</enum><text>each head coach and each assistant coach of the institution, by sport;</text></clause></subparagraph><subparagraph id="id33c4ef96ca484899a2b3d8a2df6167af"><enum>(H)</enum><text>the amount of Federal funds received by the institution of higher education; and</text></subparagraph><subparagraph id="idfe3c3f7f1b5541ae8fa6f76759d4d957"><enum>(I)</enum><text>the amount of State funds received by the institution of higher education.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section commented="no" id="idEE6881E477594759A4F46B5924D7398E"><enum>7.</enum><header>Institution requirements for Federal student loan program</header><text display-inline="no-display-inline">Section 487(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1094">20 U.S.C. 1094(a)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id248F9128AA494AE888F796EDB571410F"><paragraph commented="no" id="id473A891B19874E89BE3F19820A315CF4"><enum>(30)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="id5B5DEADF31324F7891A14D4028F9E8EA"><enum>(A)</enum><text>The institution will—</text><clause commented="no" id="id7A2EAA3327904674A499F0E901131A76" indent="up1"><enum>(i)</enum><text>comply with the requirements of sections 3, 4, 5, and 6 of the <short-title>Amateur Athletes Protection and Compensation Act of 2021</short-title>; and</text></clause><clause commented="no" id="idEB3CEBB59CAF47578FEC12493EE0117C" indent="up1"><enum>(ii)</enum><text>refrain from providing (or affecting or influencing any third party to provide)—</text><subclause commented="no" id="idB14C19C88D7B468ABDCA5DDCB341802B"><enum>(I)</enum><text>any covered compensation to any amateur intercollegiate athlete; or</text></subclause><subclause commented="no" id="id9D2CA1DECA274A4B81E7E881AFD5617D"><enum>(II)</enum><text>any financial aid, participation benefit, licensing revenue, or other benefit or payment to an amateur intercollegiate athlete for use of the athlete's name, image, or likeness.</text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id098ACEE4D52C45819C19A4EB50C16BC6" indent="up1"><enum>(B)</enum><text>In this paragraph, the terms <term>amateur intercollegiate athlete</term>, <term>covered compensation</term>, <term>image</term>, <term>likeness</term>, <term>name</term>, and <quote>third party</quote> have the meanings given the terms in section 2 of the <short-title>Amateur Athletes Protection and Compensation Act of 2021</short-title>.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="idc0039d2c30aa4b2791b48cfd4879140d"><enum>8.</enum><header>Establishment of the Amateur Intercollegiate Athletics Corporation</header><subsection commented="no" id="ided2fe64d05f64708969d89cda22c8f4b"><enum>(a)</enum><header>Establishment</header><text>There is established a government corporation, to be known as the <term>Amateur Intercollegiate Athletics Corporation</term>, which shall not for any purpose be an agency or instrumentality of the United States Government and shall be subject to the provisions of this section.</text></subsection><subsection id="id521bf29f92a64a16a5953d1446c17905"><enum>(b)</enum><header>Purposes</header><text>The purposes of the AIAC are as follows:</text><paragraph id="id25a0345dec6d439f9d486e7474157876"><enum>(1)</enum><text>To serve as a clearinghouse for best practices with respect to the rights and protections of amateur intercollegiate athletes who enter into agency contracts and endorsement contracts, including by providing guidance to amateur intercollegiate athletes concerning such contracts.</text></paragraph><paragraph id="id75B2086645E1415EAC79EB2F01051D76"><enum>(2)</enum><text>To establish rules to enforce this Act and impose fines, penalties, and sanctions on amateur athlete representatives, institutions of higher education, conferences, and national amateur athletic associations that violate such rules. </text></paragraph><paragraph id="idbcfe57e95185479db4bec40a48d39824"><enum>(3)</enum><text>To coordinate with the Federal Trade Commission to promulgate, administer, and enforce standards for reviewing and certifying endorsement contracts entered into by amateur intercollegiate athletes, including competency and ethical standards, that apply to—</text><subparagraph id="idfe23f2c679324400874def354d2816c5"><enum>(A)</enum><text>national amateur athletic associations;</text></subparagraph><subparagraph id="id39D06B89300C4E28A9ABF20C816D3113"><enum>(B)</enum><text>conferences;</text></subparagraph><subparagraph id="id94A77635123C45FF8B4A7615A030FC12"><enum>(C)</enum><text>amateur intercollegiate athletes;</text></subparagraph><subparagraph id="iddebfe7fd324a4ed49657258599e3e113"><enum>(D)</enum><text>institutions of higher education; and</text></subparagraph><subparagraph id="ideb18fe364e924f029737af323008ba89"><enum>(E)</enum><text>amateur athlete representatives.</text></subparagraph></paragraph><paragraph id="id39F2AA2B4CB74A4698967BD2670D1929"><enum>(4)</enum><text>To establish a formal certification process for amateur athlete representatives by which the AIAC shall—</text><subparagraph id="id8AC9EB2DF1AE4C1CB7D81959C3FFF7AC"><enum>(A)</enum><text>determine the eligibility of an individual to serve as an amateur athlete representative; </text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idB4F58B4F059A44E2B15029FADA635F5A"><enum>(B)</enum><text>periodically verify an amateur athlete representative's continued eligibility and compliance with this Act and the best practices, rules, and competency and ethical standards established under this subsection; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id5ED9FEFE51E74CB595AFD5D44355AF52"><enum>(C)</enum><text>in the case of noncompliance with this Act or any such best practice, rule, or competency or ethical standard, revoke a certification issued in accordance with this paragraph.</text></subparagraph></paragraph><paragraph id="id6a38258d179f4d97bd20c832d366d6ff"><enum>(5)</enum><text>To provide recommendations to institutions of higher education, national amateur athletic associations, and conferences on protecting amateur intercollegiate athletes from unscrupulous amateur athlete representatives.</text></paragraph><paragraph id="id4ebd888c1e494ed089117ecfe4c5052a"><enum>(6)</enum><text>To investigate disputes with respect to agency contracts and endorsement contracts entered into by amateur intercollegiate athletes, including—</text><subparagraph id="id8311b02c80bc405cad89c37ec1654601"><enum>(A)</enum><text>verifying that amateur athlete representatives involved in the endorsement contract process have acted in the best interests of amateur intercollegiate athletes; and</text></subparagraph><subparagraph id="id45897584ba3d413686066c74e4952636"><enum>(B)</enum><text>monitoring compliance with, and making determinations and findings concerning violations of, this Act.</text></subparagraph></paragraph><paragraph id="idc2a0ab64e8b04842b2be6b1fef577ee8"><enum>(7)</enum><text>To provide to amateur intercollegiate athletes a process for the swift resolution of conflicts concerning agency contracts and endorsement contracts, including by providing a neutral arbitrator for any case in which an amateur intercollegiate athlete is the complaining party.</text></paragraph><paragraph id="id3a95de4a30d94ffc9e5dbe31cdcfbadc"><enum>(8)</enum><text>To ensure institutions of higher education and covered athletic organizations are complying with agency contract and endorsement contract rules set forth by the AIAC in accordance with this section.</text></paragraph></subsection><subsection id="idf7f88e60951f4649b271dd1cd880d34d"><enum>(c)</enum><header>Membership</header><paragraph id="id2422CD3E9D9D445886CADF752EA3E556"><enum>(1)</enum><header>Eligibility</header><text>Eligibility for membership in the AIAC shall be as provided in the constitution and bylaws of the AIAC.</text></paragraph><paragraph id="id40ce191f52d7483d86a1e4e6dc3e5ecc"><enum>(2)</enum><header>Required provisions for representation</header><text>In its constitution and bylaws, the AIAC shall establish and maintain provisions with respect to its governance and the conduct of its affairs for the reasonable representation of—</text><subparagraph id="id06db99321cc64b76b7e505bcdbd81513"><enum>(A)</enum><text>amateur intercollegiate athletes;</text></subparagraph><subparagraph id="id679958c5b43c44d78c25b5a92cdf514a"><enum>(B)</enum><text>administrators of institutions of higher education, including directors of athletics;</text></subparagraph><subparagraph id="idfb66a33f960247458f11849969268471"><enum>(C)</enum><text>administrators of national amateur athletic associations;</text></subparagraph><subparagraph id="id36AD92A772C04342ACBBDCADE9124263"><enum>(D)</enum><text> athletic conference administrators;</text></subparagraph><subparagraph id="id13375ec1047948e092df3c64855a9611"><enum>(E)</enum><text>professionals with expertise in sports marketing, contracting, and public relations; and</text></subparagraph><subparagraph id="ide41bee24b06345409b25840806aca9d3"><enum>(F)</enum><text>individuals unaffiliated with any national amateur athletic association who, in the judgment of the board of directors of the AIAC, represent the interest of providing oversight of the activities of the AIAC.</text></subparagraph></paragraph></subsection><subsection id="id2472213643754019a490692cee4222f3"><enum>(d)</enum><header>Board of directors</header><paragraph id="id42696dd64bcd40e49306a7fc816f3f3d"><enum>(1)</enum><header>In general</header><text>The AIAC shall be governed by a board of directors comprised of 15 voting members.</text></paragraph><paragraph id="id83d0e26b50b24e459b1d97a4eb524e3f" commented="no"><enum>(2)</enum><header>Representation</header><subparagraph commented="no" id="id42ED5C2ADB204F8BB36D5339698E2039"><enum>(A)</enum><header>In general</header><text>Not less than <fraction>1⁄3</fraction> of the membership of the board of directors of the AIAC shall be composed of current or former amateur intercollegiate athletes.</text></subparagraph><subparagraph commented="no" id="id70D8BE99FD12480C9E486F38FB7D5F94"><enum>(B)</enum><header>Current amateur intercollegiate athletes</header><text>Not less than 20 percent of the membership of the board of directors of the AIAC shall be composed of amateur intercollegiate athletes who are—</text><clause commented="no" id="idC0355DE5D0C04ADA8FD3774E4353010F"><enum>(i)</enum><text>enrolled in a 4-year degree-granting institution of higher education; and</text></clause><clause commented="no" id="id1B1F2DB80ACB48F58E04380856AC31BD"><enum>(ii)</enum><text>actively engaged in amateur intercollegiate athletic events.</text></clause></subparagraph></paragraph></subsection><subsection id="id9553ef8705cc4031b0aa2e367fcd0e25"><enum>(e)</enum><header>Powers</header><paragraph id="id0f5366acbe7c4b268cbb248312c517a9"><enum>(1)</enum><header>Constitution and bylaws</header><text>The AIAC shall adopt a constitution and bylaws.</text></paragraph><paragraph id="idbe8acc444b224e23869820cffcafb291"><enum>(2)</enum><header>General corporate powers</header><text>The AIAC may—</text><subparagraph id="id26455b02e6994b59a2002edcded243e0"><enum>(A)</enum><text>establish and maintain offices to conduct the affairs of the AIAC;</text></subparagraph><subparagraph id="id1c6dcb01f7f442bdac9ab9302afd8416"><enum>(B)</enum><text>enter into contracts;</text></subparagraph><subparagraph id="id6a95abd2d76b47d1a723d4180ed331f8"><enum>(C)</enum><text>accept gifts, legacies, and devises in furtherance of its corporate purposes;</text></subparagraph><subparagraph id="ide67c95060f9541b49ea18ef60f732e4a"><enum>(D)</enum><text>acquire, own, lease, encumber, and transfer property as necessary to carry out the purposes of the AIAC;</text></subparagraph><subparagraph id="id3a847c88488546afa4d32a0d124427d7"><enum>(E)</enum><text>borrow money, issue instruments of indebtedness, and secure its obligations by granting security interests in its property;</text></subparagraph><subparagraph id="idda81b94dac3c48a18a05c5ae2ad915ba"><enum>(F)</enum><text>publish a magazine, newsletter, and other publications consistent with its corporate purposes;</text></subparagraph><subparagraph id="idf80091ffa80b4d57b0fe70869bb8970b"><enum>(G)</enum><text>approve and revoke membership in the AIAC; and</text></subparagraph><subparagraph id="ida763f58b48bc43f1b2c25414c7fb5b70"><enum>(H)</enum><text>conduct any other activity necessary and proper to carry out the purposes of the AIAC.</text></subparagraph></paragraph><paragraph commented="no" id="id4a07a08a064b4af1a0458aab9bae6de6"><enum>(3)</enum><header>Subpoena power</header><text>The AIAC shall have subpoena power and shall adopt rules that will result in the AIAC, in response to appropriate requests, issuing subpoenas duces tecum and ad testificandum and compelling deposition testimony at the request of a national amateur athletic association. </text></paragraph></subsection><subsection id="id2372a7ce69884c04968f9fcbfd921219"><enum>(f)</enum><header>Restrictions</header><paragraph id="id75eb7d3a4fd740ebb674cb081014aee6"><enum>(1)</enum><header>Profit and stock</header><text>The AIAC may not engage in business for profit or issue stock.</text></paragraph><paragraph id="ide479de3ea4f8490ab831f9868b61fd27"><enum>(2)</enum><header>Political activities</header><text>The AIAC shall be nonpolitical and may not promote the candidacy of an individual seeking public office.</text></paragraph></subsection><subsection id="id00a1647a24fc42009ec1c337e7f04e07"><enum>(g)</enum><header>Headquarters, principal office, and meetings</header><text>The AIAC shall maintain its principal office and national headquarters in a location in the United States decided by the AIAC. The AIAC may hold its annual and special meetings in the places decided by the AIAC.</text></subsection><subsection id="id6e6f911b26664cea8cf1c6595d250894"><enum>(h)</enum><header>Service of process</header><text>As a condition to the exercise of any power or privilege granted by this chapter, the AIAC shall have a designated agent to receive service of process for the AIAC. Notice to or service on the agent, or mailed to the business address of the agent, is notice to or service on the AIAC.</text></subsection><subsection id="id792900fd237d4e259d3bb6727da9cba1"><enum>(i)</enum><header>Report</header><text>Not less frequently than annually, the AIAC shall submit to the Committee on Commerce, Transportation, and Science of the Senate and the Committee on Energy and Commerce of the House of Representatives a report that includes—</text><paragraph id="id2f7cd8cd89d54518a6c6939c47b6b8a1"><enum>(1)</enum><text>the number of disputes investigated by the AIAC in the preceding year pursuant to subsection (b)(6);</text></paragraph><paragraph id="id9239a1acfe49496ca16c60f303bc54f0"><enum>(2)</enum><text>the number of such disputes filed in the preceding year; and</text></paragraph><paragraph id="id34b075b3aeeb4c6ea55a3f9162c98f36" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text>any recommendations to improve the endorsement contract process.</text></paragraph></subsection></section><section id="id0328D2B7151D4504956F2061FFD3BEEB"><enum>9.</enum><header>Enforcement</header><subsection id="idB298392ADAEC4656966140F94E665403"><enum>(a)</enum><header>Unfair or deceptive act or practice</header><text>A violation of this Act shall be treated as a violation of a rule defining an unfair or deceptive act or practice prescribed under section 18(a)(1)(B) of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/57a">15 U.S.C. 57a(a)(1)(B)</external-xref>). </text></subsection><subsection commented="no" display-inline="no-display-inline" id="idB48D88E143BA4FE4969CA562151E049B"><enum>(b)</enum><header>Actions by the Commission</header><text>The Federal Trade Commission shall enforce this Act in the same manner, by the same means, and with the same jurisdiction, powers, and duties as though all applicable terms and provisions of the Federal Trade Commission Act (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41</external-xref> et seq.) were incorporated into and made a part of this Act. </text></subsection></section><section id="id6f069f31b63c43e28da6cb010126d903"><enum>10.</enum><header>Role of national amateur athletic associations</header><text display-inline="no-display-inline">A national amateur athletic association may establish rules, consistent with this Act and the rules developed under section 8(b)(2), and enforce such rules by—</text><paragraph id="id590413840C6D402291BA823B9FB80169"><enum>(1)</enum><text>declaring ineligible for amateur intercollegiate athlete competition an amateur intercollegiate athlete who receives payments in violation of such rules; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idDE506EF2F716465BB0A99E4A93625986"><enum>(2)</enum><text>withholding 1 or more revenue distributions from an institution of higher education that makes payments in violation of such rules. </text></paragraph></section><section id="ide88f1f4cef5647bf8d85a38bbe998df4"><enum>11.</enum><header>Reporting</header><subsection id="id8037d1594a154d8d9711880e19688a7f"><enum>(a)</enum><header>Biennial report</header><text>Not later than 180 days after the date of enactment of this Act, and biennially thereafter, the head of each national amateur athletic association shall submit to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation of the Senate</committee-name> and the <committee-name committee-id="">Committee on Energy and Commerce of the House of Representatives</committee-name> a report that includes—</text><paragraph id="id12FFEF544B0C429CAE404FE7886FF1D9"><enum>(1)</enum><text>a summary of the systemic issues faced by the national amateur athletic association relating to compliance with this Act;</text></paragraph><paragraph id="id30AF7870986F4791818275D3BDF11EDE"><enum>(2)</enum><text>a summary of the trends that are developing among national amateur athletic associations, conferences, and institutions of higher education in response to the prohibitions under this Act; and</text></paragraph><paragraph id="idE9B1321E0A614EFC8AA3B168B622C138"><enum>(3)</enum><text>recommendations for improvements to intercollegiate athletics that would improve the health, safety, and educational opportunities of amateur intercollegiate athletes.</text></paragraph></subsection><subsection id="idae78bf7a877d43839f7b91ffb8bd9b02"><enum>(b)</enum><header>Investigation and report</header><text>Not later than 5 years after the date of enactment of this Act and once every 5 years thereafter, the Comptroller General of the United States shall—</text><paragraph id="id7196F441CE5A4FF3B44F372E350919B8"><enum>(1)</enum><text>conduct an investigation to assess compliance with this Act; and</text></paragraph><paragraph id="id7352A34A7DE14F9992E1AB4D8F77BD32"><enum>(2)</enum><text>submit to Congress a report that includes—</text><subparagraph id="id80B426D97F7A4770975640157F18A469"><enum>(A)</enum><text>a summary of the investigation conducted under paragraph (1); and</text></subparagraph><subparagraph id="id1BC250BE427A4AF08664AF108F626E5C"><enum>(B)</enum><text>recommendations for improvements to intercollegiate athletics that would improve the health, safety, and educational opportunities of amateur intercollegiate athletes.</text></subparagraph></paragraph></subsection></section><section id="id13e920e029884839909dd127021c2061"><enum>12.</enum><header>Limitation of liability</header><text display-inline="no-display-inline">A national amateur athletic association, a conference, or an institution of higher education that complies with the requirements under this Act shall not be subject to liability, based on action taken by the national amateur athletic association, conference, or institution of higher education before the date of enactment of this Act, under—</text><paragraph id="idb01c846870ef42c7a88dbf6df60ddf9a"><enum>(1)</enum><text>any Federal or State statute relating to trade or competition; or</text></paragraph><paragraph id="idf4068c465fa04a45b9794fea8dbbd0d9"><enum>(2)</enum><text>any Federal or State statute relating to tortious interference based on concepts of unfair competition.</text></paragraph></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="id3c968f8be4764165b3508b7de92e607c"><enum>13.</enum><header>Preemption</header><text display-inline="no-display-inline">No State or political subdivision of a State may establish or continue in effect any law or regulation that governs or regulates the compensation, intellectual property rights, endorsement contracts, employment status, or eligibility for an amateur intercollegiate athletic competition of any amateur intercollegiate athlete, including any provision that governs or regulates the commercial use of the name, image, or likeness of an amateur intercollegiate athlete. </text></section></legis-body></bill>
