which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Wild and Scenic Rivers Act to designate certain segments of the Housatonic River in the State of Connecticut as components of the National Wild and Scenic Rivers System, and for other purposes. </official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H4DBB76E27039420FB3395F1AD4468705"><section section-type="section-one" id="HF58CFA34E23842DE8A17D2933DAEF79C"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Housatonic Wild and Scenic River Act of 2022</short-title></quote>.</text></section><section id="HE31B555462E94E0A935A39829AA60D6F"><enum>2.</enum><header>Housatonic Wild and Scenic River, Connecticut</header><subsection id="HADF841BEFDFA4EDC84C477B1C58D639E"><enum>(a)</enum><header>Amendments to Wild and Scenic Rivers Act</header><text display-inline="yes-display-inline">Section 3(a) of the Wild and Scenic Rivers Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1274">16 U.S.C. 1274(a)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="H9589CD442D8C490DB736FA44BBDAB199"><paragraph id="HAD4E8B375BC341C98964A95093CDF256"><enum>(231)</enum><header>Housatonic River, Connecticut</header><subparagraph id="H2537E94E423E4C449C0F213F7ECDFF5D"><enum>(A)</enum><header>In general</header><text>The following segments of the Housatonic River in the State of Connecticut, to be administered by the Secretary of the Interior:</text><clause id="HE25E288ACA5F457C8183121FEA7105DF"><enum>(i)</enum><text>The approximately 14.9-mile segment from the Massachusetts-Connecticut boundary to the covered bridge in West Cornwall, as a scenic river.</text></clause><clause id="H443EE25BAFE9412A90693BCFC0034616"><enum>(ii)</enum><text>The approximately 4.1-mile segment from the covered bridge in West Cornwall to the Cornwall Bridge, as a recreational river.</text></clause><clause id="H81A91F18F69A426F9FB8712BB1C1BBAB"><enum>(iii)</enum><text>The approximately 9.1-mile segment from the Cornwall Bridge to the Route 341 bridge in Kent, as a scenic river.</text></clause><clause id="H1401EE4166ED4488A9553F23F0770E4E"><enum>(iv)</enum><text>The approximately 12.2-mile segment from the Route 341 bridge in Kent to the Boardman Bridge in New Milford, as a recreational river.</text></clause></subparagraph><subparagraph id="H23E69EFA6315465F9B19CE8914FA2995"><enum>(B)</enum><header>Effects on hydroelectric facilities</header><text>The designation of the river segments in subparagraph (A) shall not—</text><clause id="H14389850BF294ABEBB80642CD2C802C9"><enum>(i)</enum><text>impact or alter the existing terms of permitting, licensing, or operation of—</text><subclause id="H6EEF15905FE440178451E5AB2DF25E71"><enum>(I)</enum><text>the Falls Village Hydroelectric Generating Station located in Falls Village, Connecticut (FERC P–2576); or</text></subclause><subclause id="HB1B7CE98D3304FC5B781C601D216563F"><enum>(II)</enum><text>the Bulls Bridge Hydroelectric Generating Station located in New Milford, Connecticut (FERC P–2576); or </text></subclause></clause><clause id="H8D845CB8E7D24C80A793D2FE806CB983"><enum>(ii)</enum><text>preclude the Federal Energy Regulatory Commission from licensing, relicensing, or otherwise authorizing the operation or continued operation of the facilities named in clause (i).</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H5287C8838BDF48D6A72CAB006AEEEFCE"><enum>(b)</enum><header>Management</header><paragraph id="H2CF3FB7A71A04DE0B8BB5C2363FAD1A3"><enum>(1)</enum><header>Process</header><text>The Housatonic River segments shall be managed in accordance with—</text><subparagraph id="HDCAEDBA2F3FB4790908D87DFBD0705B1"><enum>(A)</enum><text>the Management Plan; and</text></subparagraph><subparagraph id="HDDCF35BF6D624BED9D0FCA46FEF4C92E"><enum>(B)</enum><text>such amendments to the Management Plan as the Secretary determines are consistent with this Act and the Wild and Scenic Rivers Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1271">16 U.S.C. 1271 et seq.</external-xref>).</text></subparagraph></paragraph><paragraph id="HAFAB719C8A9E4FEEB530053718418774"><enum>(2)</enum><header>Comprehensive management plan</header><text>The Management Plan shall be considered to satisfy the requirements for a comprehensive management plan under section 3(d) of the Wild and Scenic Rivers Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1274">16 U.S.C. 1274(d)</external-xref>).</text></paragraph><paragraph id="H94810A774C58401E8D25B470DBDB6627"><enum>(3)</enum><header>Cooperative management</header><subparagraph id="HB2FFE50D156E43D3A48D3B15C7BB1D01"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">To provide for long-term protection, preservation, and enhancement of the Housatonic River segments, the Secretary shall coordinate management responsibilities under this Act, and may enter into cooperative agreements pursuant to sections 10(e) and 11(b)(1) of the Wild and Scenic Rivers Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1281">16 U.S.C. 1281(e)</external-xref> and 1282(b)(1)), with—</text><clause id="H3D22A0CA1D2446148B50DF796DF147A5"><enum>(i)</enum><text>the State of Connecticut; </text></clause><clause id="H80C457A7FEF64BAFB285103F2A53B2FC"><enum>(ii)</enum><text>the towns of Sharon, Canaan, Cornwall, Salisbury, New Milford, Kent, and North Canaan, Connecticut; and</text></clause><clause id="HF68D76B0CE08474783F8D37AA15F3043"><enum>(iii)</enum><text>appropriate planning, environmental, and recreational organizations, including—</text><subclause id="HD6CC010C4D2B44E7856A67E1C7B62F7D"><enum>(I)</enum><text>local, regional, State, and multistate organizations; and</text></subclause><subclause id="H8878B8AB2E10466D8B1812EAB1872509"><enum>(II)</enum><text>any other appropriate organizations, as determined by the Housatonic River Commission, or its successor organization, as defined in the Management Plan.</text></subclause></clause></subparagraph><subparagraph id="H25545ED126A24F0DAB93165BFE2B2EFE"><enum>(B)</enum><header>Cooperative agreements</header><text display-inline="yes-display-inline">Each cooperative agreement entered into under this paragraph shall be consistent with the Management Plan and may include provisions for financial or other assistance from the United States.</text></subparagraph></paragraph><paragraph id="HC54550360D7044EE9D25BA8D6B22073F"><enum>(4)</enum><header>Zoning ordinances</header><text>For the purposes of the Housatonic River segments, the zoning ordinances adopted by the municipalities named in paragraph (3)(A)(ii) shall be deemed to satisfy the standards and requirements of section 6(c) of the Wild and Scenic Rivers Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1277">16 U.S.C. 1277(c)</external-xref>). </text></paragraph><paragraph id="HFEC1815FE30C4C308DE7B6B205774103"><enum>(5)</enum><header>Acquisition of lands</header><text display-inline="yes-display-inline">The authority of the Secretary to acquire lands for the Housatonic River segments shall be—</text><subparagraph id="H9AD044C801804C33BA0CCF830C160395"><enum>(A)</enum><text>limited to acquisition by donation or acquisition with the consent of the owner thereof; and</text></subparagraph><subparagraph id="H367BE0415FEE4ADC97811183FE2983E6"><enum>(B)</enum><text>subject to the additional criteria set forth in the Management Plan.</text></subparagraph></paragraph><paragraph id="HA101A27BB56A4FAEB0CEC6B4467AB84B"><enum>(6)</enum><header>No condemnation</header><text>No land or interest in land may be acquired for the Housatonic River segments by condemnation. </text></paragraph><paragraph id="HB9508A131DBD472EBD44C94DEA6CA0BF"><enum>(7)</enum><header>Relation to the National Park System</header><text>Notwithstanding section 10(c) of the Wild and Scenic Rivers Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1281">16 U.S.C. 1281(c)</external-xref>), the Housatonic River segments shall not be—</text><subparagraph id="H23F3CFC5DDA44CE288D99A0C2F7EADC4"><enum>(A)</enum><text>administered as a part or unit of the National Park System; or</text></subparagraph><subparagraph id="H657611FEC6404DF68E6C6B972873FA24"><enum>(B)</enum><text>subject to regulations that govern the National Park System. </text></subparagraph></paragraph><paragraph id="H84D657354ED342178CF6BB0FD2E84D57"><enum>(8)</enum><header>Definitions</header><text>In this subsection:</text><subparagraph id="HC03ADA186DE548EE880E8F4B05FD3439"><enum>(A)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></subparagraph><subparagraph id="H76E36264DB6941E6827B5B2A35B2A5A3"><enum>(B)</enum><header>Management Plan</header><text>The term <term>Management Plan</term> means the Housatonic River Management Plan, dated September 2006.</text></subparagraph><subparagraph id="HF6A93E1A50D34E1EBD52892DD5D32A5D"><enum>(C)</enum><header>Housatonic River segments</header><text>The term <term>Housatonic River segments</term> means the river segments designated by the amendments made by section 2(a). </text></subparagraph></paragraph></subsection></section></legis-body></bill>
