which was read twice and referred to the <committee-name committee-id="SSAS00">Committee on Armed Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To provide for the independent investigation and prosecution of sexual harassment under the Uniform Code of Military Justice, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H2899979DF7944C20B05E559B41631B0E"><section section-type="section-one" id="H4EB0267DF79446B28AAF5C8ACB0A5B2A"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Sexual Harassment Independent Investigations and Prosecution Act</short-title></quote>.</text></section><section id="H15208753CAB44ABE8C3B5CE39C071B1C"><enum>2.</enum><header>Inclusion of sexual harassment in offenses subject to authority of special trial counsel</header><subsection id="HF624E8E55C4E473999DD64EB583E992B"><enum>(a)</enum><header>Definition of covered offense</header><text display-inline="yes-display-inline">Section 801(17)(A) of title 10, United States Code (article 1(17)(A) of the Uniform Code of Military Justice), as added by section 533 of the National Defense Authorization Act for Fiscal Year 2022 (<external-xref legal-doc="public-law" parsable-cite="pl/117/81">Public Law 117–81</external-xref>), is amended—</text><paragraph id="H905B2DDFE6FF405A8E318B01300C96CA"><enum>(1)</enum><text>by striking <quote>or</quote>; and</text></paragraph><paragraph id="H7EE7D73ACCF147C3AE0505EB20BAF37F"><enum>(2)</enum><text display-inline="yes-display-inline">by striking <quote>of this title</quote> and inserting <quote>, or the standalone offense of sexual harassment punishable under section 934 (article 134) of this title</quote>.</text></paragraph></subsection><subsection id="H62B171CDCBE7422E9022B7B9C4204C37"><enum>(b)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by subsection (a) shall take effect immediately after the coming into effect of the amendments made by section 533 of the National Defense Authorization Act for Fiscal Year 2022 (<external-xref legal-doc="public-law" parsable-cite="pl/117/81">Public Law 117–81</external-xref>) as provided in section 539C of that Act.</text></subsection></section><section id="HC45C02C3777548ABB2A4AB3AED1CCF86"><enum>3.</enum><header>Independent investigation of sexual harassment</header><subsection id="HDE0D6C71276441918E1F6EDC434CD577"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">Section 1561 of title 10, United States Code, as amended by section 543 of the National Defense Authorization Act for Fiscal Year 2022 (<external-xref legal-doc="public-law" parsable-cite="pl/117/81">Public Law 117–81</external-xref>), is amended—</text><paragraph id="HAC30960FE7254D55917D3F85084D9EF8"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="H8ABA6B4EF160409DAC47BA546222D0C8"><enum>(A)</enum><text>by striking <quote>or Space Force</quote> and inserting <quote>Space Force, or Coast Guard</quote>; and</text></subparagraph><subparagraph id="H77234A7731BD464799B4F9B7FAB6D83A"><enum>(B)</enum><text>by inserting <quote>or the Department of Homeland Security (in the case of a matter involving the Coast Guard when not operating as a service in the Navy)</quote> after <quote>Department of Defense</quote>; and</text></subparagraph></paragraph><paragraph id="H46401D3098B14C0AB0B56D70A3E31BD1"><enum>(2)</enum><text>by amending subsection (e) to read as follows:</text><quoted-block style="USC" display-inline="no-display-inline" id="H4E0558C310C2454083E3D65DA31F8D84"><subsection id="H7030587A86F6457284AF060510925E8A"><enum>(e)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="H8C20B1AB8EC942C89AA93600EBCEC674"><enum>(1)</enum><text display-inline="yes-display-inline">The term <term>independent investigator</term> means a member of the armed forces or a civilian employee of the Department of Defense or the Department of Homeland Security (in the case of a matter involving the Coast Guard when not operating as a service in the Navy) who—</text><subparagraph id="H991B301CB644402B976115009B824273"><enum>(A)</enum><text>is outside the chain of command of the complainant and the subject of the investigation; and</text></subparagraph><subparagraph id="HDC38D681208F4ECD80CB529CC2F1A4B8"><enum>(B)</enum><text>is trained in the investigation of sexual harassment, as determined by—</text><clause id="HFB155052FA2442D8AA22D2500C8D48EE"><enum>(i)</enum><text>the Secretary concerned, in the case of a member of the armed forces;</text></clause><clause id="H63F80E790D4B457992CB55286EA2CFC3"><enum>(ii)</enum><text>the Secretary of Defense, in the case of a civilian employee of the Department of Defense; or</text></clause><clause id="HC1D2392E52884909B33F6EA4B5F601EF"><enum>(iii)</enum><text display-inline="yes-display-inline">the Secretary of Homeland Security, in the case of a civilian employee of the Department of Homeland Security.</text></clause></subparagraph></paragraph><paragraph id="H6FA79A5FE90845388FCB1E51E758DC62"><enum>(2)</enum><text display-inline="yes-display-inline">The term <term>sexual harassment</term> means conduct that constitutes the offense of sexual harassment as punishable under section 934 of this title (article 134) pursuant to the regulations prescribed by the Secretary of Defense for purposes of such section (article).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H883654059CF54B6182AF7EBA73CABCD2"><enum>(b)</enum><header>Effective date</header><text>The amendments made by subsection (a) shall take effect immediately after the coming into effect of the amendments made by section 543 of the National Defense Authorization Act for Fiscal Year 2022 (<external-xref legal-doc="public-law" parsable-cite="pl/117/81">Public Law 117–81</external-xref>) as provided in subsection (c) of that section.</text></subsection></section></legis-body></bill>
