<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>2d Session</session><legis-num>S. 4110</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20220428">April 28, 2022</action-date><action-desc><sponsor name-id="S365">Mr. Scott of South Carolina</sponsor> (for himself and <cosponsor name-id="S363">Mr. King</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSBK00">Committee on Banking, Housing, and Urban Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Financial Stability Act of 2010 to include the State insurance commissioner as a voting member of the Financial Stability Oversight Council, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H7239B3A72FD548B7856A72FF1E4F3BDA"><section commented="no" section-type="section-one" id="H56311F4CFB024EA1B10933C8F085C41E"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Primary Regulators of Insurance Vote Act of 2022</short-title></quote>.</text></section><section id="HD783068CB9894B90BD73568792101353"><enum>2.</enum><header>Establishment of State insurance commissioner as a voting member of the Financial Stability Oversight Council</header><text display-inline="no-display-inline">Section 111 of the Financial Stability Act of 2010 (<external-xref legal-doc="usc" parsable-cite="usc/12/5321">12 U.S.C. 5321</external-xref>) is amended—</text><paragraph id="H9BEC156695704D3FA8ADA2721527CF09"><enum>(1)</enum><text>in subsection (b)—</text><subparagraph id="H651C34FA57A9494BB06CBE5F0752892F"><enum>(A)</enum><text>in paragraph (1)—</text><clause id="H84B9DAC217B84F38BB57279839D4AC8E"><enum>(i)</enum><text>by redesignating subparagraph (J) as subparagraph (K);</text></clause><clause id="H0A6FBC62A5E742ADA5C1283C011F86B8"><enum>(ii)</enum><text>in subparagraph (I), by striking <quote>and</quote> at the end; and</text></clause><clause id="HFC3CB466EF324D90AB4F193A724AF758"><enum>(iii)</enum><text>by inserting after subparagraph (I) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H45E2EA2D20F741F9950C3E317AFA2CBD"><subparagraph id="HC5C2CECE7B1049B39C7CD54DE0D6ABC2"><enum>(J)</enum><text display-inline="yes-display-inline">a State insurance commissioner, appointed by the President, by and with the advice and consent of the Senate, as described in paragraph (4); and</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="H61602B6B50E34AE59717C11E9006E675"><enum>(B)</enum><text>by adding at the end the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H8300D3B4522F404C8E66CF009F96871C"><paragraph id="HF037D21994D8470D9702AFC3976D4D53"><enum>(4)</enum><header>State insurance commissioner</header><text display-inline="yes-display-inline">Before making any appointments pursuant to paragraph (1)(J), the President shall request a list of recommended candidates from the States through the National Association of Insurance Commissioners. The President may appoint a member under paragraph (1)(J) that does not appear on such list. If the National Association of Insurance Commissioners fails to submit such list within 15 business days after the date of the request, the President may appoint a member under paragraph (1)(J) without considering the views of the National Association of Insurance Commissioners.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HB528AA49E88644088DE6D1DD23605FF1"><enum>(2)</enum><text>in subsection (c)—</text><subparagraph id="H1724705AF31F4B5BB72A9B7037B0A213"><enum>(A)</enum><text>in paragraph (1), by inserting <quote>, the State insurance commissioner shall serve for a term of 4 years</quote> after <quote>6 years</quote>;</text></subparagraph><subparagraph id="H73C0A2CD7CD4400A988633D7EEBEBAD8"><enum>(B)</enum><text display-inline="yes-display-inline">by striking paragraph (2) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H3291946FB8F142ADAE49562BFF0E2941"><paragraph id="H003D0CA89FD646919C8DBDBD8DBD2A8F"><enum>(2)</enum><header>Vacancies</header><subparagraph id="HDA45BC6214134633BE6416742B741F45"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to subparagraph (B), any vacancy on the Council shall be filled in the manner in which the original appointment was made.</text></subparagraph><subparagraph id="H0D36D543B94C413A9D5B8C316233C6DD"><enum>(B)</enum><header>State insurance commissioner</header><text>With respect to a vacancy in the membership of the State insurance commissioner serving under subsection (b)(1)(J)—</text><clause id="HBCBD4FE55CEC4D8F985266DBC3BD7A29"><enum>(i)</enum><text display-inline="yes-display-inline">the Federal Vacancy Reform Act (<external-xref legal-doc="usc" parsable-cite="usc/5/3345">5 U.S.C. 3345 et seq.</external-xref>) shall not apply; and</text></clause><clause id="H03BEB070F1D1440DB25847E0D2B0863D"><enum>(ii)</enum><text>such vacancy shall be filled by a State insurance commissioner, to be designated by a selection process determined by the State insurance commissioners, who shall serve as a nonvoting member of the Council until a successor is appointed and confirmed.</text></clause></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="HD6D74928AF5843E39A90AA4D59F8BAFE"><enum>(C)</enum><text>in paragraph (4)—</text><clause id="H8950ABD5835446A79A29AA326EE99DDF"><enum>(i)</enum><text>by striking <quote><header-in-text level="paragraph" style="OLC">independent member</header-in-text></quote> in the heading, and inserting <quote><header-in-text level="paragraph" style="OLC">insurance members</header-in-text></quote>; and</text></clause><clause id="HC762A66B6A4344FD98C9FEB499986B77"><enum>(ii)</enum><text>striking <quote>subsection (b)(1)(J)</quote> and inserting <quote>subsection (b)(1)(K) or the State insurance commissioner serving under subsection (b)(1)(J)</quote>.</text></clause></subparagraph></paragraph></section><section id="H3C3CA1A80FC94610836BE3F3B0209507"><enum>3.</enum><header>Repeal of State insurance commissioner as nonvoting member of FSOC</header><subsection id="HAA34002B186A4C2DB92EB6BC03590171"><enum>(a)</enum><header>In general</header><text>Section 111(b)(2) of the Financial Stability Act of 2010 (<external-xref legal-doc="usc" parsable-cite="usc/12/5321">12 U.S.C. 5321(b)(2)</external-xref>) is amended by striking subparagraph (C) and redesignating subparagraphs (D) and (E) as subparagraphs (C) and (D), respectively.</text></subsection><subsection id="H372D3F159999491AA7F8510ADDA68B2C"><enum>(b)</enum><header>Technical and conforming amendment</header><text>Section 111(c)(1) of the Financial Stability Act of 2010 Act (<external-xref legal-doc="usc" parsable-cite="usc/12/5321">12 U.S.C. 5321(c)(1)</external-xref>) is amended by striking by <quote>subparagraphs (C), (D), and (E)</quote> and inserting <quote>subparagraphs (C) and (D)</quote>. </text></subsection></section><section id="HCCF6CA0E18F74FBE89F138148F2F37D0"><enum>4.</enum><header>Temporary service; transition</header><text display-inline="no-display-inline">Notwithstanding the amendments made by this Act, during the period beginning on the date of the enactment of this Act and ending on the date on which the State insurance commissioner is appointed and confirmed pursuant to section 111(b)(1) of the Financial Stability Act of 2010 (<external-xref legal-doc="usc" parsable-cite="usc/12/5321">12 U.S.C. 5321(b)(1)</external-xref>), as amended by section 2 of this Act, section 111(b)(2)(C) of the Financial Stability Act of 2010 (<external-xref legal-doc="usc" parsable-cite="usc/12/5321">12 U.S.C. 5321(b)(2)(C)</external-xref>), as in effect on the day before the date of enactment of this Act, shall continue to apply.</text></section><section id="H8B9C193279564019B9356E08AA83FCF4"><enum>5.</enum><header>Technical and conforming amendments</header><text display-inline="no-display-inline">The Financial Stability Act of 2010 (<external-xref legal-doc="usc" parsable-cite="usc/12/5311">12 U.S.C. 5311 et seq.</external-xref>) is amended—</text><paragraph id="HAEAA47944FF24EB6B18EBA9D375154BB"><enum>(1)</enum><text>in section 102(a) (<external-xref legal-doc="usc" parsable-cite="usc/12/5311">12 U.S.C. 5311</external-xref>), by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HE1FCEF120B5F443EA8C82E0D795F3F2A"><paragraph id="H307C241D6A2E4E7E824260F00D441AE2"><enum>(8)</enum><header>Council</header><text display-inline="yes-display-inline">The term <term>Council</term> means the Financial Stability Oversight Council established in section 111.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="H7364EFC3EE19471BB707597213638197"><enum>(2)</enum><text>in section 112(a)(2)(D) (<external-xref legal-doc="usc" parsable-cite="usc/12/5322">12 U.S.C. 5322(a)(2)(D)</external-xref>), by striking <quote>to monitor</quote> and inserting <quote>monitor</quote>;</text></paragraph><paragraph commented="no" id="HFE237EA90D8F4965A0E82B8E2D75B9EA"><enum>(3)</enum><text>in section 154(c)(1) (<external-xref legal-doc="usc" parsable-cite="usc/12/5344">12 U.S.C. 5344(c)(1)</external-xref>)—</text><subparagraph commented="no" id="HF99CDF2D3B43405A85431C1844171881"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote><header-in-text level="subsection" style="OLC">Center.—</header-in-text></quote> and all that follows through <quote>The Research</quote> and inserting the following: <quote><header-in-text level="subsection" style="OLC">Center.—</header-in-text>The Research</quote>; and</text></subparagraph><subparagraph commented="no" id="H2F95EE8CFCBA4A149E31179F0AFE183F"><enum>(B)</enum><text>by redesignating subparagraphs (A) through (H) as paragraphs (1) through (8), respectively; and</text></subparagraph></paragraph><paragraph commented="no" id="H99400CFF9C35433E8EFEFCEC338A1A46"><enum>(4)</enum><text>in section 155(a)(2) (<external-xref legal-doc="usc" parsable-cite="usc/12/5345">12 U.S.C. 5345(a)(2)</external-xref>), by striking the comma after <quote>subsection (c)</quote>.</text></paragraph></section></legis-body></bill>
