which was read twice and referred to the <committee-name committee-id="SSAS00">Committee on Armed Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend title 10, United States Code, to establish in the Department of Defense a civilian harm investigation coordinator, to improve and make permanent the requirement that the Secretary of Defense submit an annual report on civilian harm in connection with United States military operations, and for other purposes.</official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="HD2970F47C68B464B9F3FF160F3DB097B"><section section-type="section-one" id="H4CA52F470BC147B78B5C95AE7205CEA6"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Department of Defense Civilian Harm Transparency Act</short-title></quote>.</text></section><section id="HD3618EA050E042FDBEC37D26A9F290D8"><enum>2.</enum><header>Annual report on civilian harm in connection with United States military operations</header><subsection id="H680586D52F4D4625BF83230583343EF5"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/23">Chapter 23</external-xref> of title 10, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/10/486">section 486</external-xref> the following new section:</text><quoted-block style="USC" display-inline="no-display-inline" id="H89F82F0597CD42D08CE360018E4F00A4"><section id="HE1BB20BBBA2B463C8FCAA40AF50733DE"><enum>487.</enum><header>Civilian harm in connection with United States military operations.</header><subsection id="H9B3DB0C2D77341FEA18BF3903B6105F7"><enum>(a)</enum><header>Coordinator</header><text display-inline="yes-display-inline">The Secretary of Defense shall—</text><paragraph id="H39DFC9A1CE5D472583E427103CADEB54"><enum>(1)</enum><text>designate a senior official within the Office of the Secretary of Defense to serve as the civilian harm investigation coordinator; and</text></paragraph><paragraph id="H16F2DE3278A3489F8F61A0E3BEB75DB1"><enum>(2)</enum><text>appoint a general counsel to assist the coordinator in carrying out the responsibilities under subsection (b).</text></paragraph></subsection><subsection id="HE72EEC6873164D3D91C21E4EBF641E78"><enum>(b)</enum><header>Responsibilities</header><text> The coordinator designated under subsection (a) shall carry out the following responsibilities:</text><paragraph id="H09D73C0716D441628A039157456FE255"><enum>(1)</enum><text>In the case of each investigation of civilian harm, conducting a review of the investigation and an assessment of whether applicable laws, policies, guidelines, and processes were followed in conducting the investigations.</text></paragraph><paragraph id="HE2CF28842F3A4B5A9FC0E5167CAFE317"><enum>(2)</enum><text>Certifying each annual report submitted under subsection (c).</text></paragraph></subsection><subsection id="HEB643DD61E25414297DCF0B761D3EB05"><enum>(c)</enum><header>Annual report required</header><paragraph commented="no" display-inline="yes-display-inline" id="H3CCFA08A47E34D7BB5DCA5EDAF9AE314"><enum>(1)</enum><text display-inline="yes-display-inline">Not later than May 1 each year, the Secretary of Defense shall submit to the congressional defense committees a report on civilian harm resulting from United States military operations during the preceding year.</text></paragraph><paragraph id="H5A079A8F2DED4AB1B71740A660E061ED" indent="up1"><enum>(2)</enum><text>Each report required under paragraph (1) shall set forth the following:</text><subparagraph id="H13D8BA09B6CD44D7B19418561A454FDC"><enum>(A)</enum><text>A list of all the United States military operations conducted during the year covered by the report as a result of which—</text><clause id="HE782403F29DC446E9447A608B0C4D1B8"><enum>(i)</enum><text>an incident of civilian harm is confirmed or reasonably suspected to have occurred; or</text></clause><clause id="H209CFFC6B5A349A4B30C174BC2BCF19F"><enum>(ii)</enum><text>an incident of civilian harm is alleged to have occurred and for which an investigation into such incident remains open as of the date of the submittal of the report.</text></clause></subparagraph><subparagraph id="HC6499F780F234FBA9DC7EC4E5FFF7148"><enum>(B)</enum><text>For each military operation listed under subparagraph (A), each of the following:</text><clause id="H218A65E4140E44D4BFD3E670573A8D2C"><enum>(i)</enum><text>The date and time.</text></clause><clause id="H322B6C90D7A042C7B09FB6515F078F50"><enum>(ii)</enum><text>The location, including the precise geographic coordinates of any strike occurring as a result of the conduct of the operation.</text></clause><clause id="H9265E96860594A7C8B0407082885618D"><enum>(iii)</enum><text>An identification of whether the operation occurred inside or outside of a declared theater of active armed conflict and a definition of the term <quote>theater of active armed conflict</quote>.</text></clause><clause id="H679ED594A2EE4DC09B01D3CA1634CC0A"><enum>(iv)</enum><text>The type of operation, including for each strike conducted as part of the operation—</text><subclause id="HDD66749CD5BB4832A776DC2F1364E032"><enum>(I)</enum><text>a description of whether the strike was deliberate or dynamic;</text></subclause><subclause id="id73C747423D074C7BB59975D9DB0B2D87"><enum>(II)</enum><text>the Department’s legal and policy justification for the strike, including an explanation of each such justification under domestic law and applicable international law; </text></subclause><subclause id="idDD59E934DD2C49348BCE5A4571F638EC"><enum>(III)</enum><text>the relevant rules and procedures in place to prevent civilian casualties or significant damage to civilian objects, and whether those rules and procedures were followed; and </text></subclause><subclause id="H5ADBF2B609B249E983B6A25B35F1A0E6"><enum>(IV)</enum><text>a description of the type of weapons and ordnance used, including whether there was any weapon malfunction.</text></subclause></clause><clause id="H6B8D6639198D4061B2FEFD5DE32046C8"><enum>(v)</enum><text display-inline="yes-display-inline">An assessment of the estimated number of civilians, civilians directly participating in hostilities, and belligerents killed and injured during the operation, formulated as a range, if necessary, and including—</text><subclause id="H283E848A79924AF49ADA66286F0AEDD7"><enum>(I)</enum><text display-inline="yes-display-inline">details on the number of men, women, and children involved and the estimated ages of such civilians, civilians directly participating in hostilities, and belligerents; and</text></subclause><subclause id="HC93111B23EFC4B5E97310C83D1313DD2"><enum>(II)</enum><text> an explanation of—</text><item id="H4E625E104D1A45979C212846BAF1896C"><enum>(aa)</enum><text display-inline="yes-display-inline">how the Department of Defense determined whether targets were civilians, civilians directly participating in hostilities, and belligerents;</text></item><item id="id0646903622204ABBBA7E31A1E36A3A06"><enum>(bb)</enum><text>the Department’s legal criteria for considering a person to be a civilian, civilian directly participating in hostilities, or a belligerent; and </text></item><item id="H824152C45AC84404B8061F7F4C21F69F"><enum>(cc)</enum><text>the level of epistemic certainty required to make such determination.</text></item></subclause></clause><clause id="HC5131EA0D51A4F36AF363DD864B28748"><enum>(vi)</enum><text>For each strike carried out as part of the operation—</text><subclause id="H93B39DC29C2947A9BE27FFE68D24E513"><enum>(I)</enum><text>an assessment of whether post-strike civilian harm exceeded pre-strike assessments of anticipated harm and, if so, the reasons for this discrepancy;</text></subclause><subclause id="H3CEB15FE4CC0425C85A248E2C50BDC36"><enum>(II)</enum><text>an assessment of whether civilian harm resulted from misidentification of a military objective or the collateral effects of engagement;</text></subclause><subclause id="H1CE1C6673C994FF6833E29DBD9E83108"><enum>(III)</enum><text>an assessment of damage to civilian objects that would ordinarily be placed on a no-strike list, and an explanation if any such object was removed from the list; and</text></subclause><subclause id="H10ACD189330F4CF7B14DB5607931045E"><enum>(IV)</enum><text display-inline="yes-display-inline">a general assessment of reliability of information provided and how such reliability level was determined.</text></subclause></clause><clause id="H768A9095F3FA450D90F57120748AEBDC"><enum>(vii)</enum><text>A summary for all completed civilian harm assessments and investigations.</text></clause><clause id="HCEDE3DEB56E343F4B9026B1009B156AD"><enum>(viii)</enum><text>For any investigation into an incident that has been open for more than 180 days, an update on the status of the investigation in the report table.</text></clause><clause id="H9864307547BD49B2853D9B30E5F08265"><enum>(ix)</enum><text>In the case of any incident where the Secretary determines that credible civilian harm occurred—</text><subclause id="idEDD60DCD4B8F42BB843C380C19E7F7FD"><enum>(I)</enum><text>an assessment of whether the Department has publicly acknowledged the civilian harm or instituted any procedural reforms;</text></subclause><subclause id="id26478E33735F452B9BFA266380D65931"><enum>(II)</enum><text>a description of any other non-monetary consequence management that has occurred, including the provision of medical care, visa assistance, private apologies or explanations, or public affairs statements; and</text></subclause><subclause id="idADF8F07976B0467FBE2BC70F5ABD9D5F"><enum>(III)</enum><text>an analysis on the effectiveness of the Department of Defense response. </text></subclause></clause><clause id="HC44BE719FEB143928D73E7F3D011A5B7"><enum>(x)</enum><text>For each investigation into an incident of civilian harm or alleged civilian harm—</text><subclause id="H49DCC2DEA49E481F8642AEFFEDD40337"><enum>(I)</enum><text>whether witness interviews and site visits occurred, and if not, an explanation for why not;</text></subclause><subclause id="HBB7698F693B948B39794A0A8B7DA981A"><enum>(II)</enum><text>whether civil society documentation or investigations were taken into account in making a final determination in the investigation, and if not, an explanation for why not; and</text></subclause><subclause id="id15DA06E367B74C118240F8BF2F8D7256"><enum>(III)</enum><text>if an incident of alleged civilian harm is deemed not credible, an explanation of the standard and methodology for making that determination. </text></subclause></clause></subparagraph><subparagraph id="id947C830E9DD94707BDFD9CCD8D15BD91"><enum>(C)</enum><text>A description of the process by which the Department of Defense investigates allegations of civilian casualties resulting from United States military operations, including all standards and guidelines applicable to such investigations, the procedures for conducting and reviewing such investigations, the procedures for reviewing external sources of information, the criteria for deeming information credible, and the entities responsible for conducting and reviewing such investigations. </text></subparagraph><subparagraph id="H99C8408B36A340AE9CC51176076CBE44"><enum>(D)</enum><text>A description of steps taken to mitigate harm to civilians in the course of conducting such operations, including any new or updated civilian harm policies and procedures implemented by the Department of Defense or the combatant commands.</text></subparagraph><subparagraph id="H4F5EE97002E94FDCB0023B9C7BF40439"><enum>(E)</enum><text>An assessment of how United States military operations affected or exacerbated humanitarian needs of civilian populations in each theater of military operations.</text></subparagraph><subparagraph id="HC8226A6A564742AEA2444A10237269E7"><enum>(F)</enum><text display-inline="yes-display-inline">For each incident of civilian harm where at least simple negligence was determined to play a contributory role—</text><clause id="H329E4C68CF9F494880F375ADC6CA1668"><enum>(i)</enum><text>a description of any remedial personnel action taken, including administrative, disciplinary, or punitive; or</text></clause><clause id="H3EF174CB73EE43F8912E8657346D2FCF"><enum>(ii)</enum><text>if no disciplinary action was taken, an explanation of why not.</text></clause></subparagraph><subparagraph id="H082EBB906E364663B2D3E9CA1DBDA8E8"><enum>(G)</enum><text>A description of any changes to policies, rules, or procedures as a result of such an incident.</text></subparagraph><subparagraph id="HDE0781D6134F4ABAB45225BC55D7AF64"><enum>(H)</enum><text>Any other matter the Secretary of Defense determines is appropriate.</text></subparagraph></paragraph><paragraph id="H447DA252307B47C18A46BCA8E372ACB6" indent="up1"><enum>(3)</enum><text>In preparing a report under this subsection, the Secretary of Defense shall take into account relevant and credible all-source reporting, with a special emphasis on information from public reports and non-governmental sources.</text></paragraph><paragraph id="HECA8141EC461402BBDA54F7D7C35D040" indent="up1"><enum>(4)</enum><text>Each report required under paragraph (1) shall be—</text><subparagraph id="HCD49CCF57E1143DCBF5BC696700AAE17"><enum>(A)</enum><text>submitted in unclassified form, but may include a classified annex; and</text></subparagraph><subparagraph id="id7695E6312FB44F29A2233E0759736357"><enum>(B)</enum><text>redacted only as necessary to protect legitimately classified information and then made publicly available in a databased and searchable format that includes a table with hyperlinks to individual incidents. </text></subparagraph></paragraph></subsection><subsection id="ide1c27c5b249347b38c73a98969c3b732"><enum>(d)</enum><header>Ex gratia and condolence payments</header><paragraph commented="no" display-inline="yes-display-inline" id="idC9E70F5AF3E64519920D2F121AF08D25"><enum>(1)</enum><text>Not less frequently than once each calendar quarter, the Secretary of Defense shall make publicly available in an electronic format—</text><subparagraph id="idBA9252FE09144D30AF68E7D5691E85CB" indent="up1"><enum>(A)</enum><text>a detailed list of all ex gratia payments and any other payments in response to civilian harm paid by the United States during that quarter, including for each payment, the country where the payment was issued and the type of payment; and</text></subparagraph><subparagraph indent="up1" id="id6DDBBB597B4A4BA3824ED3C6940802E4"><enum>(B)</enum><text>with respect to a calendar quarter in which no ex gratia or other payments were made in response to civilian harm, an explanation of whether any payments were refused along with the reason for such refusal, and any other reason for which no payments were made.</text></subparagraph></paragraph><paragraph indent="up1" id="idCC90E1B31F874D76B1DDEF1AFC37FB06"><enum>(2)</enum><text>Information about specific payments required under paragraph (1) that must be kept confidential to ensure the safety or privacy of payment recipients, based on consultation with such recipients, may be excluded from the publicly available list if the Secretary of Defense—</text><subparagraph id="idEB4E6719AFCE4491AB0A3FF781493B61"><enum>(A)</enum><text>provides such information to the congressional defense committees in a confidential annex;</text></subparagraph><subparagraph id="idF1D30D96DFB64BF09545373EF059C83B"><enum>(B)</enum><text>submits to such committees a certification of the need for confidentiality; and</text></subparagraph><subparagraph id="idA494E787F5D743829E0AA7D92811BE5D"><enum>(C)</enum><text>makes such information publicly available in an aggregated format.</text></subparagraph></paragraph><paragraph indent="up1" id="idD397FA1BB4C24186A6CD778C5E63FA7E"><enum>(3)</enum><text>The Secretary of Defense shall make available an easily accessible electronic method by which individuals or others on their behalf may request ex gratia or other condolence payments.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H3B8EDF273E2743E184C84A8148FA1BDD"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of sections at the beginning of such chapter is amended by inserting after the item relating to section 486 the following new item:</text><quoted-block style="USC" display-inline="no-display-inline" id="HED00CEA036394918A278442D55B3DD27"><toc regeneration="no-regeneration"><toc-entry level="section">487. Annual report on civilian harm in connection with United States military operations.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HABE337726296476392756A1F16D95ACD"><enum>(c)</enum><header>Conforming repeal</header><text>Section 1057 of the National Defense Authorization Act for Fiscal Year 2018 (<external-xref legal-doc="public-law" parsable-cite="pl/115/91">Public Law 115–91</external-xref>) is repealed. </text></subsection></section></legis-body></bill>
