which was read twice and referred to the <committee-name committee-id="SSFI00">Committee on Finance</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend part A of title XI of the Social Security Act to provide grants to States, units of local government, and Indian Tribes to establish, expand, or maintain Drug Overdose Fatality Review Teams.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Overdose Review Team Act</short-title></quote>.</text></section><section id="idFAB9029349B84936B07CD0AC834BC9DB"><enum>2.</enum><header>Funding to establish drug overdose fatality review teams</header><text display-inline="no-display-inline">Part A of title XI of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1301">42 U.S.C. 1301 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id13D16DC3C8C24C33BDC9CA46E55FC149"><section id="idF5DE2E01A89D4AE58C476E3547BDF3BB"><enum>1150D.</enum><header>Grants to establish drug overdose fatality review teams</header><subsection id="idd1b2e87eb116467294dfb28762ebb7ba"><enum>(a)</enum><header>Grants</header><text>The Secretary shall, using amounts appropriated under this section, award grants to States, units of local government, and Indian Tribes to establish, expand, or maintain a Drug Overdose Fatality Review Team, which shall—</text><paragraph id="ide0f51a7f19c44716b9c058c0d7fb3697"><enum>(1)</enum><text>promote cooperation and coordination among agencies involved in the investigation of fatal and non-fatal drug overdoses; </text></paragraph><paragraph id="id218b801cbb6d45aca2d9996783458467"><enum>(2)</enum><text>develop an understanding of the causes and incidences of drug overdoses in the jurisdiction where the team operates;</text></paragraph><paragraph id="id78540cc077fa43c48ef6ed5ce681fe5f"><enum>(3)</enum><text>track the total number of drug overdose deaths and identify trends and patterns in fatal and non-fatal drug overdoses in the jurisdiction where the team operates; </text></paragraph><paragraph id="id39876a0c8e55431e8c7556e883c884de"><enum>(4)</enum><text>plan for and recommend changes within the agencies to prevent drug overdose fatalities; </text></paragraph><paragraph id="id6bbe2a1d8a854febb7ef6aeab0b6d4af"><enum>(5)</enum><text>recommend best practices for preventing drug overdoses and drug overdose deaths; and </text></paragraph><paragraph id="idad9001db10e7422ba5b8c6275720eb84"><enum>(6)</enum><text>advise policymakers in the team’s jurisdiction about potential changes to law, policy, funding, or practices to prevent drug overdoses.</text></paragraph></subsection><subsection id="id888764a01af243659404af8ac9743ba8"><enum>(b)</enum><header>Grant recipients</header><text>The Secretary shall not award grant funds under this section to a recipient unless the recipient provides to the Secretary a list of individuals on the drug overdose fatality review team, which shall include—</text><paragraph id="id304A91BF66544BF49862FBF8B4AA2684"><enum>(1)</enum><text>not less than 1 representative each from—</text><subparagraph id="id79469f68d947410b80437b7fa6488336"><enum>(A)</enum><text>the State, local, or Tribal department of health, or similar department; </text></subparagraph><subparagraph id="idC9480A95173A40DB9EED1BEE92EA7EAE"><enum>(B)</enum><text>the State, local, or Tribal governmental entity responsible for alcohol, drug, or other substance addiction treatment and services;</text></subparagraph><subparagraph id="idf0f51ab940134d9397b1c19b4dc3cf84"><enum>(C)</enum><text>the State, local, or Tribal department of social services, or similar department; </text></subparagraph><subparagraph id="idb7b08736cdcc4a2bbc7292c089dd0a1b"><enum>(D)</enum><text>the State, local or Tribal attorney’s office;</text></subparagraph><subparagraph id="id82493175c19342deb6e1e81af2499b89"><enum>(E)</enum><text>law enforcement agencies of the jurisdiction, which may include representatives of law enforcement agencies operating in a high intensity drug trafficking area designated pursuant to section 707(b) of the Office of National Drug Control Policy Reauthorization Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/21/1706">21 U.S.C. 1706(b)</external-xref>); </text></subparagraph><subparagraph id="id26c177ab46dc4caa87acdd0991c736b2"><enum>(F)</enum><text>the State, local, or Tribal department of corrections, or similar department; and</text></subparagraph><subparagraph id="id6fb90bbf637243568bc00ed4d3bea847"><enum>(G)</enum><text>the State, local or Tribal medical examiner or coroner; </text></subparagraph></paragraph><paragraph id="id59e87f1ac6f640a38d29f9fd27fbe5b1"><enum>(2)</enum><text>a health care provider who specializes in the diagnosis and treatment of substance use and misuse and substance use disorders; </text></paragraph><paragraph id="id1a10c77d8f844630b36b29bd67117386"><enum>(3)</enum><text>a health care provider who specializes in treating co-occurring mental health and substance use disorders;</text></paragraph><paragraph id="id6bb915a710d240f78fd321120bdba582"><enum>(4)</enum><text>a representative from emergency medical services;</text></paragraph><paragraph id="id17d61b1a716e4d44b500a6059f6c0ca0"><enum>(5)</enum><text>a patient advocate who has lived experience with substance use and misuse or who has a family member with a history of substance use and misuse;</text></paragraph><paragraph id="idd156456fb52941ca837a8071cb51cfa9"><enum>(6)</enum><text>an emergency department physician;</text></paragraph><paragraph id="id2b299e2c56034db987bef80c4d7dac05"><enum>(7)</enum><text>a toxicologist; and</text></paragraph><paragraph id="id71DF851858A549E1A13E4906A8EFE7D7"><enum>(8)</enum><text>a community-based substance use prevention coalition leader or other community-based substance use prevention professional.</text></paragraph></subsection><subsection id="id7e5fa2a8dda3424aa8ef6f0e1eddffbf"><enum>(c)</enum><header>Appropriation</header><text>In addition to amounts otherwise available, there is appropriated to the Secretary for fiscal year 2023, out of any money in the Treasury not otherwise appropriated, $50,000,000, to remain available until 2027, to carry out this section. </text></subsection><subsection commented="no" id="HEBC1729336CA4998B9C3B2B9DC945B8C"><enum>(d)</enum><header>Definitions</header><text>In this section:</text><paragraph commented="no" display-inline="no-display-inline" id="HD8C6AAD2BF9C42F783B420A3827CAEB7"><enum>(1)</enum><header display-inline="yes-display-inline">Indian tribe</header><text display-inline="yes-display-inline">The term <term>Indian Tribe</term> has the meaning given that term in section 4(e) of the Indian Self-Determination and Education Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/25/5304">25 U.S.C. 5304(e)</external-xref>). </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HEBD224B7FAE04E0FB12FA3DF86C31282"><enum>(2)</enum><header display-inline="yes-display-inline">State</header><text display-inline="yes-display-inline">The term <term>State</term> has the meaning given that term in section 1101(a)(1) for purposes of this title and includes the Commonwealth of the Northern Mariana Islands, and American Samoa.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
