which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To support the lab-embedded entrepreneurship program under the Department of Energy, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Leveraging our National Laboratories to Develop Tomorrow’s Technology Leaders Act of 2022</short-title></quote>.</text></section><section id="id372b5d6458354ce5bdacad4a203d0de0"><enum>2.</enum><header>Lab-embedded entrepreneurship program</header><subsection id="idE216AD5C907D4C60A2EF48CE67CE2743"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="idB15B27D0C3834C2D95FAC9783C8EDF07"><enum>(1)</enum><header>Covered program</header><text>The term <quote>covered program</quote> means a program described in subsection (c).</text></paragraph><paragraph id="idd88f2e1a515e4c3cbdcb513e04e579f5"><enum>(2)</enum><header>Eligible entity</header><subparagraph id="id93254C4DC2334990B3BB3FBE7C75D34A"><enum>(A)</enum><header>In general</header><text>The term <quote>eligible entity</quote> means—</text><clause id="ida73eba856d4d42d5815ac8ffe8ccecb8"><enum>(i)</enum><text>a National Laboratory; and</text></clause><clause id="idE204597EEF8646909E0544F2262D7307"><enum>(ii)</enum><text>an entity described in subparagraph (B) in partnership with a National Laboratory.</text></clause></subparagraph><subparagraph id="idF81D81F300F3458CBAE5AE5964948C02"><enum>(B)</enum><header>Entity described</header><text>An entity referred to in subparagraph (A)(ii) is—</text><clause id="id5ba879ba455742e489203556e6e47ab3"><enum>(i)</enum><text>a nonprofit organization;</text></clause><clause id="id3993dace80cb4ed1b90064cae58fd78e"><enum>(ii)</enum><text>an institution of higher education; and</text></clause><clause commented="no" display-inline="no-display-inline" id="id8efbeaa45b1244738506f12dc0cd9b14"><enum>(iii)</enum><text>any other entity that the Secretary determines appropriate. </text></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5E7DD276F6654C86868ED31698F4E698"><enum>(3)</enum><header>Entrepreneurial fellow</header><text>The term <quote>entrepreneurial fellow</quote> means an individual participating in a covered program. </text></paragraph><paragraph id="id4d2c842e07474fb2b7ca547daeab78b0"><enum>(4)</enum><header>National laboratory</header><text>The term <term>National Laboratory</term> has the meaning given the term in section 2 of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/15801">42 U.S.C. 15801</external-xref>). </text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idCB530BC61B234A73BFD16F9BAC18EA21"><enum>(5)</enum><header>Program</header><text>The term <quote>program</quote> means the Lab-Embedded Entrepreneurship Program authorized under subsection (b). </text></paragraph><paragraph id="id83724E9CC43B4C929EC0B00FA96C17F8"><enum>(6)</enum><header>Secretary</header><text>The term <quote>Secretary</quote> means the Secretary of Energy.</text></paragraph></subsection><subsection id="ide111ec46af10491f97bb2d61405e17a7"><enum>(b)</enum><header>Program</header><text>The Secretary shall establish a program, to be known as the <quote>Lab-Embedded Entrepreneurship Program</quote>, under which the Secretary shall award grants to eligible entities for the purpose of establishing or maintaining a covered program. </text></subsection><subsection id="idc5c9aa3435d347e3abd46514d07f7d75"><enum>(c)</enum><header>Covered programs</header><text>An eligible entity receiving a grant under the program shall use the grant funds to establish or maintain a lab-embedded entrepreneurship program to provide entrepreneurial fellows with access to National Laboratory research facilities, expertise, and mentorship—</text><paragraph id="idFBB6B734135749199CE934716F0B85FE"><enum>(1)</enum><text>to perform research and development; and</text></paragraph><paragraph id="idEB6FA9B6E8784E80B94591D4B37677E3"><enum>(2)</enum><text>to gain expertise that may be required or beneficial for the commercial application of research ideas.</text></paragraph></subsection><subsection id="idaba4c10feb354b52be32ba2889a006a4"><enum>(d)</enum><header>Entrepreneurial fellows</header><paragraph id="idA764FC20F31C4F16A52A941822B2AE44"><enum>(1)</enum><header>In general</header><text>In participating in a covered program, an entrepreneurial fellow shall be provided by an eligible entity with—</text><subparagraph id="idbc0aa5d0e8124a7a838a64df74006b2c"><enum>(A)</enum><text>opportunities for entrepreneurial training, professional development, and exposure to leaders from academia, industry, government, and finance, who may serve as advisors to or partners of an entrepreneurial fellow;</text></subparagraph><subparagraph id="id1c9ee2e8cd7545088fbe4254632ea32b"><enum>(B)</enum><text>financial and technical support for research, development, and commercial application activities;</text></subparagraph><subparagraph id="id8def8107a28247f699da396efdd9c719"><enum>(C)</enum><text>fellowship awards to cover costs of living, health insurance, and travel stipends for the duration of the fellowship; </text></subparagraph><subparagraph id="id282b4c86a2604d7d910492c6fa36242a"><enum>(D)</enum><text>market and customer discovery opportunities; </text></subparagraph><subparagraph id="id998320AA44B9464B979B82F3669AD7D7"><enum>(E)</enum><text>engagement with external stakeholders; and</text></subparagraph><subparagraph id="id38e547678a2c49fb87de58f79360b622"><enum>(F)</enum><text>any other resources determined appropriate by the Secretary.</text></subparagraph></paragraph><paragraph id="idD3C6C10FA80C4467B357B43B87805023"><enum>(2)</enum><header>Priority</header><text>In carrying out a covered program, an eligible entity shall give priority to supporting entrepreneurial fellows with respect to professional development and development of a relevant technology. </text></paragraph><paragraph id="id4ab272e537994dee85d601e7637dfa27"><enum>(3)</enum><header>Intellectual property</header><text>In participating in a covered program, an entrepreneurial fellow shall retain all rights relating to intellectual property developed by the entrepreneurial fellow through activities carried out under the covered program. </text></paragraph></subsection><subsection id="id16a50bc2593a44e99ef113793bdad7cc"><enum>(e)</enum><header>Partnerships</header><text>An eligible entity described in subparagraph (A)(i) of subsection (a)(2) that receives a grant under the program may carry out a covered program in partnership with 1 or more entities described in subparagraph (B) of that subsection.</text></subsection><subsection id="iddac0076274ac4faaaf10ee5338fd9206"><enum>(f)</enum><header>Metrics</header><text>The Secretary shall develop metrics to assess the effectiveness of each covered program in achieving the purposes of the program.</text></subsection><subsection id="idf0bc10bf30624a0e9718217cb0597f79"><enum>(g)</enum><header>Coordination; interagency collaboration</header><text>The Secretary shall—</text><paragraph id="idC19C3F9A94074B3A9F5F010A703DFC23"><enum>(1)</enum><text>oversee the planning and coordination of grants awarded under the program; and</text></paragraph><paragraph id="id7ABE6917C8C8478D955D0A1AF52F58CF"><enum>(2)</enum><text>collaborate with other Federal agencies, including the Department of Defense, regarding opportunities for Federal agencies to partner with covered programs.</text></paragraph></subsection><subsection id="id3A6C8A9114A34FBDADA01339DEC27A65"><enum>(h)</enum><header>Best practices</header><text>The Secretary shall identify and disseminate to eligible entities best practices for achieving the purposes of the program. </text></subsection><subsection id="id28841c876fb744088e22a83ea92a3927"><enum>(i)</enum><header>Assessments; reports</header><text>Not later than 4 years after the date of enactment of this Act, and not less frequently than biennially thereafter, the Secretary shall—</text><paragraph id="id1a4895c57e7e4aedacb9c8e1b7337d75"><enum>(1)</enum><text>conduct an assessment of each covered program based on the metrics developed under subsection (f); and</text></paragraph><paragraph commented="no" id="id87699cac4a3d4a03afd3ee7fdd75841a"><enum>(2)</enum><text>submit to the Committee on Energy and Natural Resources of the Senate and the Committee on Science, Space, and Technology of the House of Representatives a report summarizing the findings of those assessments.</text></paragraph></subsection><subsection id="id3dd52d47e4bd4f43a94f150a3cb5975b"><enum>(j)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Secretary to carry out this section $25,000,000 for each of fiscal years 2023 through 2027. </text></subsection></section></legis-body></bill>
