which was read twice and referred to the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To provide redress to the employees of Air America.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="id079A30E9758349BC8EB2CD5D813C9FA9"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Air America Act of 2021</short-title></quote>.</text></section><section commented="no" display-inline="no-display-inline" section-type="subsequent-section" id="idB43EB4F802974D6A83007E232AC709E8"><enum>2.</enum><header display-inline="yes-display-inline">Air America</header><subsection id="id0E29F557744F46FC8B7E848F4D9CE305"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline">Congress finds the following:</text><paragraph id="idAB8278C610CF4C5398645413C6DF26ED"><enum>(1)</enum><text>Air America, Incorporated (referred to in this section as <term>Air America</term>) and its related cover corporate entities were wholly owned and controlled by the United States Government and directed and managed by the Department of Defense, the Department of State, and the Central Intelligence Agency from 1950 to 1976.</text></paragraph><paragraph id="idC945C6DBEA71438FB7CEF76C685AFAE7"><enum>(2)</enum><text>Air America, a corporation owned by the Government of the United States, constituted a <quote>Government corporation</quote>, as defined in section 103 of title 5, United States Code.</text></paragraph><paragraph id="idB3E9CE1F30604B64AB33F08A7A6DCA3C"><enum>(3)</enum><text>It is established that the employees of Air America and the other entities described in paragraph (1) were Federal employees.</text></paragraph><paragraph id="idBFDD4844916B4DE298ED6D377AB853F9"><enum>(4)</enum><text>The employees of Air America were retroactively excluded from the definition of the term <term>employee</term> under section 2105 of title 5, United States Code, on the basis of an administrative policy change in paperwork requirements implemented by the Office of Personnel Management 10 years after the service of the employees had ended and, by extension, were retroactively excluded from the definition of the term <term>employee</term> under section 8331 of title 5, United States Code, for retirement credit purposes.</text></paragraph><paragraph id="id8F999DB1F479455397CFB0E3B5547480"><enum>(5)</enum><text>The employees of Air America were paid as Federal employees, with salaries subject to—</text><subparagraph id="id151549D14AED4C818079AC5C29C9FDA0"><enum>(A)</enum><text>the General Schedule under subchapter III of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/53">chapter 53</external-xref> of title 5, United States Code; and</text></subparagraph><subparagraph id="id10842137A43942A28654D4311FA277BC"><enum>(B)</enum><text>the rates of basic pay payable to members of the Armed Forces.</text></subparagraph></paragraph><paragraph id="id159FBB2E69FF4F889067A73E8DB36001"><enum>(6)</enum><text>The service and sacrifice of the employees of Air America included—</text><subparagraph id="id76F399B04642444681478B5943F17B74"><enum>(A)</enum><text>suffering a high rate of casualties in the course of employment;</text></subparagraph><subparagraph id="idEE3DBB53465C4183ADE8ED3CDC935891"><enum>(B)</enum><text>saving thousands of lives in search and rescue missions for downed United States airmen and allied refugee evacuations; and</text></subparagraph><subparagraph id="id7D94182CB2F14AEC91DDCEBD24A99A79"><enum>(C)</enum><text>lengthy periods of service in challenging circumstances abroad.</text></subparagraph></paragraph></subsection><subsection id="id44C6C29FFF33483B9B14CCD537330F2D"><enum>(b)</enum><header>Definitions</header><text>In this section—</text><paragraph id="idA2B7133C70254BA7B3B6B3E6F3189B4C"><enum>(1)</enum><text>the term <term>affiliated company</term>, with respect to Air America, includes Air Asia Company Limited, CAT Incorporated, Civil Air Transport Company Limited, and the Pacific Division of Southern Air Transport; and</text></paragraph><paragraph id="id2DA38CAC63484646A7F5309CBF624276"><enum>(2)</enum><text>the term <term>qualifying service</term> means service that—</text><subparagraph id="id6B8FA73B088240D1A14CBD0E012851D7"><enum>(A)</enum><text>was performed by a United States citizen as an employee of Air America or an affiliated company during the period beginning on January 1, 1950, and ending on December 31, 1976; and</text></subparagraph><subparagraph id="idDE8B93E265F648ABA602579D655DFDB8"><enum>(B)</enum><text>is documented in the attorney-certified corporate records of Air America or any affiliated company.</text></subparagraph></paragraph></subsection><subsection id="id188B1F231AFB41DE91999F045F08EF57"><enum>(c)</enum><header>Treatment as Federal employment</header><text display-inline="yes-display-inline">Any period of qualifying service—</text><paragraph id="id793AF7ED5A824E9D944299CD936D22CC"><enum>(1)</enum><text display-inline="yes-display-inline">is deemed to have been service of an employee (as defined in section 2105 of title 5, United States Code) with the Federal Government; and</text></paragraph><paragraph id="idEE6492186A254826B8D5EAF0B43B4909"><enum>(2)</enum><text display-inline="yes-display-inline">shall be treated as creditable service by an employee for purposes of subchapter III of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/83">chapter 83</external-xref> of title 5, United States Code.</text></paragraph></subsection><subsection id="idC6DEC1096F774D0AA29DEE795A02E9CF"><enum>(d)</enum><header>Rights</header><text display-inline="yes-display-inline">An individual who performed qualifying service, or a survivor of such an individual, shall be entitled to the rights, retroactive as applicable, provided to employees and their survivors for creditable service under the Civil Service Retirement System under subchapter III of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/83">chapter 83</external-xref> of title 5, United States Code, with respect to that qualifying service.</text></subsection><subsection id="id676B99A72FD34761B071E9A92281E644"><enum>(e)</enum><header>Deduction, contribution, and deposit requirements</header><text display-inline="yes-display-inline">The deposit of funds in the Treasury of the United States made by Air America in the form of a lump-sum payment apportioned in part to the Civil Service Disability &amp; Retirement Fund in 1976 is deemed to satisfy the deduction, contribution, and deposit requirements under section 8334 of title 5, United States Code, with respect to all periods of qualifying service.</text></subsection><subsection id="id134678F471364D39927A82A578EEA546"><enum>(f)</enum><header>Application time limit</header><text display-inline="yes-display-inline">Section 8345(i)(2) of title 5, United States Code, shall be applied with respect to the death of an individual who performed qualifying service by substituting <quote>2 years after the effective date under section 2(g) of the <short-title>Air America Act of 2021</short-title></quote> for <quote>30 years after the death or other event which gives rise to title to the benefit</quote>.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id4114A03DE02D4129B14B3A07A1E4F5B1"><enum>(g)</enum><header>Effective date</header><text display-inline="yes-display-inline">This section shall take effect on the date that is 30 days after the date of enactment of this Act.</text></subsection></section></legis-body></bill>
