<congress display="yes">117th CONGRESS</congress><session display="yes">2d Session</session><legis-num display="yes">S. 407</legis-num><current-chamber display="no">IN THE SENATE OF THE UNITED STATES</current-chamber><legis-type display="yes">AN ACT</legis-type><official-title display="yes">To provide redress to the employees of Air America.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause" style="OLC"><section section-type="section-one" id="id6416cb51-beef-4ebb-b805-fb51c6a128c9" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Air America Act of 2022</short-title></quote>.</text></section><section id="id11ccd129bea742219dc76fc241d7571c" changed="not-changed" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Air America</header><subsection id="id7d379090e9fb4bacb7206176d3d233ec" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header display-inline="yes-display-inline">Findings</header><text display-inline="yes-display-inline">Congress finds the following:</text><paragraph id="id01842954f484474086cc25c222c6f6fa" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">Air America, Incorporated (referred to in this section as <term>Air America</term>) and its related cover corporate entities were wholly owned and controlled by the United States Government and directed and managed by the Department of Defense, the Department of State, and the Central Intelligence Agency from 1950 to 1976.</text></paragraph><paragraph id="id86700b028eb54cffb65942381252dbfa" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">Air America, a corporation owned by the Government of the United States, constituted a <quote>Government corporation</quote>, as defined in section 103 of title 5, United States Code.</text></paragraph><paragraph id="idffd52c94c039474b896ffe22f401ac72" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">The service and sacrifice of the employees of Air America included—</text><subparagraph id="idb9e5c4b29ffc45209b5416b6f2eeb049" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">suffering a high rate of casualties in the course of employment;</text></subparagraph><subparagraph id="id9a2d129340654717ae27377048d83990" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">saving thousands of lives in search and rescue missions for downed United States airmen and allied refugee evacuations; and</text></subparagraph><subparagraph id="idd6d52108aa6841f1b9586318d8fcbf11" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">lengthy periods of service in challenging circumstances abroad.</text></subparagraph></paragraph></subsection><subsection id="idfdac629423274245b410c6d301e83717" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(b)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section—</text><paragraph id="id62611a97a418424f9074850c74ce0655" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">the term <term>affiliated company</term>, with respect to Air America, includes Air Asia Company Limited, CAT Incorporated, Civil Air Transport Company Limited, and the Pacific Division of Southern Air Transport;</text></paragraph><paragraph id="idd35ddaf1b78f4819814efe44cf9b801b" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">the term <term>qualifying service</term> means service that—</text><subparagraph id="ide4e381f7f2bf43059aafa16e2ce2944a" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">was performed by a United States citizen as an employee of Air America or an affiliated company during the period beginning on January 1, 1950, and ending on December 31, 1976; and</text></subparagraph><subparagraph id="id0508e5c8f7304ea9b9e549e1c55250dc" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">is documented in the attorney-certified corporate records of Air America or any affiliated company;</text></subparagraph></paragraph><paragraph id="id99622e3b718a41ff9f630da0b49268bb" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(3)</enum><text display-inline="yes-display-inline">the term <term>survivor</term>, with respect to an individual who performed qualifying service, means—</text><subparagraph id="idC645DB4275DD4B13B824866378A46B3A" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">a widow or widower of the individual who performed qualifying service; or</text></subparagraph><subparagraph id="id9B70A39AB5244A668D74E25552999841" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">an individual who, at any time during or since the period of qualifying service, was a dependent or child of the individual who performed qualifying service; and</text></subparagraph></paragraph><paragraph id="id635C725B889D4638A9570467251BB39D" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(4)</enum><text display-inline="yes-display-inline">the terms <term>widow</term>, <term>widower</term>, <term>dependent</term>, and <term>child</term> have the meanings given those terms in section 8341(a) of title 5, United States Code, except that that section shall be applied by substituting <quote>individual who performed qualifying service</quote> for <quote>employee or Member</quote>.</text></paragraph></subsection><subsection id="idf1d1e3b7b7124d399025d10199194bf1" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header display-inline="yes-display-inline">Creditable service</header><text display-inline="yes-display-inline">Any period of qualifying service shall be treated as creditable service for purposes of subchapter III of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/83">chapter 83</external-xref> of title 5, United States Code.</text></subsection><subsection id="id97aed62c93f0496d9e86a5b73be962b0" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(d)</enum><header display-inline="yes-display-inline">Rights</header><paragraph id="idd6fdbf0bdd014ff4aa29f467a88639e3" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">An individual who performed qualifying service or a survivor of such an individual—</text><subparagraph id="id3C1A064904744A67B47A71A8603CDDC7" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">shall be entitled to the rights, retroactive as applicable, provided to employees and their survivors for creditable service under the Civil Service Retirement System under subchapter III of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/83">chapter 83</external-xref> of title 5, United States Code, with respect to that qualifying service; and</text></subparagraph><subparagraph id="id7E270337D37A429D9BCF2E47C413063E" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">may submit an application for benefits based on the qualifying service to the Office of Personnel Management not later than 2 years after the effective date under section 2(g) of this Act.</text></subparagraph></paragraph><paragraph id="id131fb0115cf1450b8069441cbfc68148" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header display-inline="yes-display-inline">Individuals deceased before date of enactment</header><text display-inline="yes-display-inline">A survivor of an individual who performed qualifying service and became eligible, by reason of this Act, for benefits based on the qualifying service under subchapter III of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/83">chapter 83</external-xref> of title 5, United States Code (but became deceased before the date of enactment of this Act)—</text><subparagraph id="idacb85453f5164314b73d04fb4faec77b" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">may submit an application for benefits based on the qualifying service to the Office of Personnel Management not later than 2 years after the effective date under section 2(g) of this Act, disregarding any requirement that an employee have filed an application while living; and</text></subparagraph><subparagraph id="id767f7e6c48e94899a0cd81a16bc722ea" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">upon submission of the application under subparagraph (A), shall be eligible for a survivor annuity under section 8341 of title 5, United States Code, equal to 55 percent (or 50 percent if the deceased individual retired before October 11, 1962) of the self-only annuity (as defined in section 838.103 of title 5, Code of Federal Regulations (or any successor regulation)) that otherwise would have been paid to the deceased individual.</text></subparagraph></paragraph></subsection><subsection id="idcb231f9cd9dc40febfe0f2f106a634e3" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(e)</enum><header display-inline="yes-display-inline">Deduction, contribution, and deposit requirements</header><text display-inline="yes-display-inline">The deposit of funds in the Treasury of the United States made by Air America in the form of a lump-sum payment apportioned in part to the Civil Service Disability and Retirement Fund in 1976 is deemed to satisfy the deduction, contribution, and deposit requirements under section 8334 of title 5, United States Code, with respect to all periods of qualifying service.</text></subsection><subsection id="idff227d6d8613420687d7d6fdd7fa95d8" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(f)</enum><header display-inline="yes-display-inline">Rule of construction</header><text display-inline="yes-display-inline">Nothing in this Act shall be construed to set any type of precedent for purposes of civil service retirement credit with the Civil Service Retirement and Disability Fund or any successor fund.</text></subsection><subsection id="id7208103613864b529eb3b58208290f61" changed="not-changed" commented="no" display-inline="no-display-inline"><enum>(g)</enum><header display-inline="yes-display-inline">Effective date</header><text display-inline="yes-display-inline">This Act shall take effect on the date that is 30 days after the date of enactment of this Act.</text></subsection></section></legis-body><attestation><attestation-group><attestation-date date="20220614" chamber="Senate">Passed the Senate June 14, 2022.</attestation-date><attestor display="no"></attestor><role>Secretary</role></attestation-group></attestation><endorsement display="yes"></endorsement></bill>
