which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend the Energy Act of 2020 to require the Secretary of Energy to establish a program to accelerate the availability of commercially produced high-assay, low-enriched uranium in the United States and to make high-assay, low-enriched uranium produced from Department of Energy inventories available for use in advanced nuclear reactors, and for other purposes. </official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Fueling Our Nuclear Future Act of 2022</short-title></quote>.</text></section><section id="ide884918e704948f6abf779b50e9c602a"><enum>2.</enum><header>Sense of congress</header><text display-inline="no-display-inline">It is the sense of Congress that—</text><paragraph id="id9ac5665d72574679b866dbcd8d43dd32"><enum>(1)</enum><text>the Department of Energy (referred to in this section as the <term>Department</term>) should prioritize activities to establish a domestic high-assay, low-enriched uranium (referred to in this section as <term>HALEU</term>) enrichment capability, consistent with subsection (c) of section 2001 of the Energy Act of 2020 (<external-xref legal-doc="usc" parsable-cite="usc/42/16281">42 U.S.C. 16281</external-xref>);</text></paragraph><paragraph id="iddea100ab5600445485872c5d8ee5b4f6"><enum>(2)</enum><text>domestic HALEU enrichment will not be commercially available at the scale needed in time to meet the needs of advanced nuclear reactor demonstration projects; and</text></paragraph><paragraph id="id77132ffd69d24627919bae228283a96f"><enum>(3)</enum><text>the Department needs to make available HALEU, produced from inventories owned by the Department, for use by advanced nuclear reactors consistent with subsection (d) of section 2001 of the Energy Act of 2020 (<external-xref legal-doc="usc" parsable-cite="usc/42/16281">42 U.S.C. 16281</external-xref>), until such time as commercial HALEU enrichment capability exists consistent with that subsection. </text></paragraph></section><section id="id69C0391FBC64487B9D0A909AE17298F7"><enum>3.</enum><header>HALEU for advanced nuclear reactors</header><text display-inline="no-display-inline">Section 2001 of the Energy Act of 2020 (<external-xref legal-doc="usc" parsable-cite="usc/42/16281">42 U.S.C. 16281</external-xref>) is amended—</text><paragraph id="id37655730858A4420A3916EE700E9D605"><enum>(1)</enum><text>in subsection (a)—</text><subparagraph id="id4DB188D5BDC44C42AC19CAD070687F95"><enum>(A)</enum><text>in paragraph (2)—</text><clause id="id5448CA45FB6A427690030353B077FACA"><enum>(i)</enum><text>in subparagraph (D)—</text><subclause id="id7573B01448A340EB82749DB2C4A00F1A"><enum>(I)</enum><text>in clause (v)(III), by adding <quote>or</quote> after the semicolon at the end;</text></subclause><subclause id="idCBA06CEC348142B2AC9CCDCBA5D9971D"><enum>(II)</enum><text>by striking clause (vi); and</text></subclause><subclause id="idF6710C4BD9D8427C9B0E9C659FFF7998"><enum>(III)</enum><text>by redesignating clause (vii) as clause (vi);</text></subclause></clause><clause id="id2BF416CB1C164AD28806F0D729B40C02"><enum>(ii)</enum><text>in subparagraph (E), by striking <quote>for domestic commercial use</quote> and inserting <quote>to meet the needs of commercial, government, academic, and international entities</quote>; and</text></clause><clause id="id7328931F4FEC44B0A89ABE05547D8082"><enum>(iii)</enum><text>in subparagraph (I), by inserting <quote>nuclear</quote> after <quote>advanced</quote>;</text></clause></subparagraph><subparagraph id="id84533E1F68E2474495056C26E644288E"><enum>(B)</enum><text>in paragraph (5), in the paragraph heading, by striking <quote><header-in-text style="OLC" level="paragraph">HA–LEU</header-in-text></quote> and inserting <quote><header-in-text style="OLC" level="paragraph">HALEU</header-in-text></quote>; and</text></subparagraph><subparagraph id="idE06A1B445BAE45A2A6DA80E20668F3B1"><enum>(C)</enum><text>by redesignating paragraphs (6) and (7) as paragraphs (8) and (6), respectively, and moving the paragraphs so as to appear in numerical order;</text></subparagraph></paragraph><paragraph id="id1CB12191D93748DAAE1A29D7E5BF96DA"><enum>(2)</enum><text>in subsection (b)(2)—</text><subparagraph id="id3038F46A6E4D460081C42C5A39D66FBE"><enum>(A)</enum><text>in the paragraph heading, by striking <quote><header-in-text style="OLC" level="paragraph">HA–LEU</header-in-text></quote> and inserting <quote><header-in-text style="OLC" level="paragraph">HALEU</header-in-text></quote>;</text></subparagraph><subparagraph id="id99D7594B5B2E4DB1887CB8C772322457"><enum>(B)</enum><text>by striking <quote>subsection (a)(1)</quote> each place it appears and inserting <quote>subsection (b)(1)</quote>;</text></subparagraph><subparagraph id="id56974CEF2CBA429AA3930BF9329CD705"><enum>(C)</enum><text>in subparagraph (B)(viii), by striking <quote>subsection (a)(2)(F)</quote> and inserting <quote>subsection (b)(2)(F)</quote>; and</text></subparagraph><subparagraph commented="no" id="id76DE78E9B707432ABAB4E99709CB714B"><enum>(B)</enum><text>a member of the consortium established under subsection (b)(2)(F).</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph><subparagraph id="id64AA6B68117248EDA56D44315282C232"><enum>(D)</enum><text>by inserting after paragraph (4) (as so redesignated) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id4DF9EBD2F4E445CAAF99EA9E308C1495"><paragraph id="id5d0fe49f8fa5419a9d5e6e5414b3e8f5"><enum>(5)</enum><header>Department</header><text>The term <term>Department</term> means the Department of Energy.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="id8A5867A83F5B4DB39BC6D11F11D7B2A7"><enum>(E)</enum><text>by striking paragraph (6) (as so redesignated) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id584B09571CE04CC1B33381DD3C053278"><paragraph id="idEE4EB7BE9EF14231B257F7FD958B2009"><enum>(6)</enum><header>HALEU</header><text>The term <term>HALEU</term> means high-assay, low-enriched uranium.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="idD4EF0D4F815A4FC494A6DAC1BDCF0B72"><enum>(5)</enum><text>by striking <quote>HA–LEU</quote> each place it appears and inserting <quote>HALEU</quote>;</text></paragraph><paragraph id="id25249EDC259D4F6890D88EE3F4BD07CA"><enum>(6)</enum><text>by moving paragraph (7) of subsection (c) (as designated by paragraph (3)(B)(ii)) so as to appear after paragraph (6) of subsection (a) (as redesignated by paragraph (1)(C));</text></paragraph><paragraph id="id5B4CC3D21766491CAF2D2DCA55B1161E"><enum>(7)</enum><text>by striking subsection (c);</text></paragraph><paragraph id="id4D44CB82D8CC4D1CAE9D1383F8ECB7F1"><enum>(8)</enum><text display-inline="yes-display-inline">by redesignating subsections (a), (b), and (d) as subsections (b), (g), and (a), respectively, and moving the subsections so as to appear in alphabetical order;</text></paragraph><paragraph id="id4808D62AB3934C5DA2F1EEF5F32F0748"><enum>(9)</enum><text>by inserting after subsection (b) (as so redesignated) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id0D026AF6E5CC4DCB9B48372970DADA1B"><subsection id="idDA46233FBED9479AB5B9433579D3A883"><enum>(c)</enum><header>Commercial HALEU availability</header><paragraph id="idbae56cdd819d412dbf07eb4f2f62497f"><enum>(1)</enum><header>Establishment</header><text>Not later than 30 days after the date of enactment of the <short-title>Fueling Our Nuclear Future Act of 2022</short-title>, the Secretary, acting through the Assistant Secretary for Nuclear Energy, shall establish a program (referred to in this subsection as the <quote>program</quote>) to accelerate the availability of commercially produced HALEU in the United States in accordance with this subsection.</text></paragraph><paragraph id="id4ba35c5aa86340e9bd5466eb26e68250"><enum>(2)</enum><header>Purposes</header><text>The purposes of the program are—</text><subparagraph id="id7559d430b2c14e6fa6d8e6cb2fee4971"><enum>(A)</enum><text>to provide for the availability of HALEU produced, chemically converted, enriched, chemically deconverted, and suitable for fabrication into final fuel form in the United States;</text></subparagraph><subparagraph id="id6fe538df15374063a0420481b9eed5b9"><enum>(B)</enum><text>to address nuclear fuel supply chain gaps and deficiencies in the United States; and</text></subparagraph><subparagraph id="id390a532a61614183b1b193588c7cf910"><enum>(C)</enum><text>to support strategic nuclear fuel supply chain capabilities in the United States.</text></subparagraph></paragraph><paragraph id="idf0a101b1d0be462e90826f1bd3b55fe0"><enum>(3)</enum><header>Considerations</header><text>In carrying out the program, the Secretary shall consider and, as appropriate, execute—</text><subparagraph id="id4298f3c0699b4bd0936c740ad9e2da8f"><enum>(A)</enum><text>options to establish, through a competitive process, a domestic commercial HALEU production capability of not less than 20 metric tons of HALEU per year, with initial availability by—</text><clause id="idA155076662F446CA9A944970FDE39CA9"><enum>(i)</enum><text>December 31, 2027; or</text></clause><clause id="idF2660C3D1B1D44D889858E14EAB67CED"><enum>(ii)</enum><text>the earliest operationally feasible date thereafter;</text></clause></subparagraph><subparagraph id="idaaaed2574ef9416dbbda25bcf6f80b13"><enum>(B)</enum><text>options that provide for an array of HALEU—</text><clause id="id5EAEA19FFD884FA797614858D38F04F8"><enum>(i)</enum><text>enrichment levels;</text></clause><clause id="id4C6B5E7F181B4DCA94C5863DB7901AFC"><enum>(ii)</enum><text>output levels to meet demand; and</text></clause><clause id="id85EA151DBFF941F780617851719DD138"><enum>(iii)</enum><text>fuel forms; and</text></clause></subparagraph><subparagraph id="idbda8713a203d4d82844b12b81d91a8f4"><enum>(C)</enum><text>options to establish, through a competitive process, a HALEU Bank—</text><clause id="id813c19040f424a06a6f55c0077939285"><enum>(i)</enum><text>to replenish, as necessary, Department stockpiles of uranium used in carrying out activities under subsection (d);</text></clause><clause id="id58A4787847054705889BEDA04F6BDA2D"><enum>(ii)</enum><text>to continue supplying HALEU to meet the needs of the recipients of an award made pursuant to the funding opportunity announcement of the Department numbered DE–FOA–0002271 for Pathway 1, Advanced Reactor Demonstrations; and</text></clause><clause id="id36683026a3f043abb54709b8d2420ece"><enum>(iii)</enum><text>to make HALEU available to members of the consortium established under subsection (b)(2)(F), after addressing the needs described in clauses (i) and (ii).</text></clause></subparagraph></paragraph><paragraph id="id49461D4AF0234337A44F8355B0768102" commented="no" display-inline="no-display-inline"><enum>(4)</enum><header display-inline="yes-display-inline">Authorization of appropriations</header><text display-inline="yes-display-inline">In addition to amounts otherwise made available (other than amounts made available under section 4(b) of the <short-title>Fueling Our Nuclear Future Act of 2022</short-title>), there is authorized to be appropriated to the Secretary to carry out this subsection $150,000,000 for each of fiscal years 2023 through 2032.</text></paragraph></subsection><subsection id="idb22fdee65ded4b6eb61cd85eb487c566"><enum>(d)</enum><header>HALEU for advanced nuclear reactor demonstration projects</header><paragraph id="idEA0340A3C8F843889B8B6239BAF39D43"><enum>(1)</enum><header>Activities</header><text>On enactment of the <short-title>Fueling Our Nuclear Future Act of 2022</short-title>, the Secretary shall immediately accelerate and, as necessary, initiate activities to make available HALEU, produced from inventories owned by the Department, for use by advanced nuclear reactors, with priority given to the awards made pursuant to the funding opportunity announcement of the Department numbered DE–FOA–0002271 for Pathway 1, Advanced Reactor Demonstrations, with additional HALEU to be made available to members of the consortium established under subsection (b)(2)(F), as available.</text></paragraph><paragraph id="idBE44A9DB69394D22A13B474DB6547DFA"><enum>(2)</enum><header>Ownership</header><text>HALEU made available under this subsection—</text><subparagraph id="id7C7DA6CB4C1E4365B0082139D162749E"><enum>(A)</enum><text>shall remain the property of, and title shall remain with, the Department; and</text></subparagraph><subparagraph id="id2CE26CB213D44DF692730205DC2E7F68"><enum>(B)</enum><text>shall not be subject to the requirements of section 3112(d)(2) and 3113 of the USEC Privatization Act (<external-xref legal-doc="usc" parsable-cite="usc/42/2297h-10">42 U.S.C. 2297h–10(d)(2)</external-xref>, 2297h–11).</text></subparagraph></paragraph><paragraph id="idAA2ED9DE5D134D868BDE524ECE1D8C30"><enum>(3)</enum><header>Quantity</header><text>In carrying out activities under this subsection, the Secretary shall make available—</text><subparagraph id="id6CC1ECAC4FB14921B96A31BE99A2C8AF"><enum>(A)</enum><text>by September 30, 2024, not less than 3 metric tons of HALEU;</text></subparagraph><subparagraph id="id5FA63D3760C34840A7499CE583EA986D"><enum>(B)</enum><text>by December 31, 2025, not less than an additional 8 metric tons of HALEU; and</text></subparagraph><subparagraph id="idA30F244326854FB2910D4393B60FD848"><enum>(C)</enum><text>by June 30, 2026, not less than an additional 10 metric tons of HALEU.</text></subparagraph></paragraph><paragraph id="id28C84F0784BF47469FA481884100FC31"><enum>(4)</enum><header>Factors for consideration</header><text>In carrying out activities under this subsection, the Secretary shall take into consideration—</text><subparagraph id="idf446924e66294b69a50d6000401c2909"><enum>(A)</enum><text>options for providing HALEU from a stockpile of uranium owned by the Department (including the National Nuclear Security Administration), including—</text><clause id="idde9cb1a9d7b24fd4a1ae591f8d50842c"><enum>(i)</enum><text>fuel that—</text><subclause id="idad56bd21c29e47418a91f65b47c17760"><enum>(I)</enum><text>directly meets the needs of advanced nuclear reactor end-users; but</text></subclause><subclause id="idc5893546ba3f4fa2ad41a72891823929"><enum>(II)</enum><text>has been previously used or fabricated for another purpose;</text></subclause></clause><clause id="id491027e8e1b042b7bc83f3f58c614de7"><enum>(ii)</enum><text>fuel that can meet the needs of advanced nuclear reactor end-users after removing radioactive or other contaminants that resulted from a previous use or fabrication of the fuel for research, development, demonstration, or deployment activities of the Department (including activities of the National Nuclear Security Administration);</text></clause><clause id="id3756d91765ac43be8f39ae504d628e8c"><enum>(iii)</enum><text>fuel from a high-enriched uranium stockpile, which can be blended with lower assay uranium to become HALEU to meet the needs of advanced nuclear reactor end-users; and</text></clause><clause id="id12baca9b6cf84805b5986f882582962b"><enum>(iv)</enum><text>fuel from uranium stockpiles intended for other purposes, but for which uranium could be swapped or replaced in time in such a manner that would not negatively impact the missions of the Department;</text></clause></subparagraph><subparagraph id="id2e1d604ed6124bd38bcf79964dc7d8fc"><enum>(B)</enum><text>options for providing HALEU from domestically enriched HALEU procured by the Department through a competitive process pursuant to the HALEU Bank established under subsection (c)(3)(C); and</text></subparagraph><subparagraph id="id771884aaab9141e8a437592c36231c5f"><enum>(C)</enum><text>options to replenish, as needed, Department stockpiles of uranium made available pursuant to subparagraph (A) with domestically enriched HALEU procured by the Department through a competitive process pursuant to the HALEU Bank established under subsection (c)(3)(C).</text></subparagraph></paragraph><paragraph id="idb38890dd820440989fc29ffc52a561e8"><enum>(5)</enum><header>Limitation</header><text>The Secretary shall not barter or otherwise sell or transfer uranium in any form in exchange for services relating to—</text><subparagraph id="id41261a7e70c8469eb2135d0108c469b0"><enum>(A)</enum><text>the final disposition of radioactive waste from uranium that is the subject of a contract for sale, resale, transfer, or lease under this subsection; or</text></subparagraph><subparagraph id="id0802f5e7958041e09d50c8c3f885832c"><enum>(B)</enum><text>environmental cleanup activities.</text></subparagraph></paragraph><paragraph id="id5b388b49c6af44ed8cbcdc6ec80033ad"><enum>(6)</enum><header>Authorization of appropriations</header><text>In addition to amounts otherwise made available (other than amounts made available under section 4(b) of the <short-title>Fueling Our Nuclear Future Act of 2022</short-title>), there is authorized to be appropriated to the Secretary to carry out this subsection $200,000,000 for each of fiscal years 2023 through 2027.</text></paragraph><paragraph id="id8f07304bec93471291539a5f7a1cc65f"><enum>(7)</enum><header>Sunset</header><text>The authority of the Secretary to carry out activities under this subsection shall terminate on the date on which the HALEU needs of advanced nuclear reactor end-users can be fully met by commercial HALEU suppliers in the United States, as mutually agreed to by the Secretary and advanced nuclear reactor end-users. </text></paragraph></subsection><subsection display-inline="no-display-inline" commented="no" id="idFE48A1C5A2F74826A734B29418DF5F70"><enum>(e)</enum><header>Cost recovery</header><paragraph display-inline="no-display-inline" commented="no" id="idC48952057A4346CA95B21A6E6DD8E4CE"><enum>(1)</enum><header>In general</header><text>In carrying out activities under subsections (c) and (d), the Secretary shall ensure that any HALEU acquired, provided, or made available under those subsections for advanced nuclear reactor end-users is subject to cost recovery in accordance with subsection (b)(2)(G).</text></paragraph><paragraph display-inline="no-display-inline" commented="no" id="idFE18AC7D023A487086C39607C90943A4"><enum>(2)</enum><header>Availability of certain funds</header><text>Notwithstanding section 3302 of title 31, United States Code, revenues received from the sale or transfer of fuel feed material and other activities related to making HALEU available pursuant to this section—</text><subparagraph display-inline="no-display-inline" commented="no" id="id72A40E44EF9A4DF6A2C80ABFA4E3C785"><enum>(A)</enum><text>shall be available to the Department for carrying out the purposes of this section, to reduce the need for further appropriations for those purposes; and </text></subparagraph><subparagraph display-inline="no-display-inline" commented="no" id="idF483174FBCDC41A79DA9F278D2BB7398"><enum>(B)</enum><text>shall remain available until expended.</text></subparagraph></paragraph></subsection><subsection id="id59f8772a6c2e42ef9fc3f3ea4f91458d"><enum>(f)</enum><header>Exclusion</header><text>In carrying out activities under this section, the Secretary shall not make available, or provide funding for, uranium that is recovered, downblended, produced, chemically converted, enriched, chemically deconverted, or fabricated by an entity that—</text><paragraph id="idbcc462569a244f57bebb8e62bb3c90c1"><enum>(1)</enum><text>is owned or controlled by the Government of the Russian Federation or the Government of the People’s Republic of China; or</text></paragraph><paragraph id="iddbef39eba15c425c8bdd74f9269a8564"><enum>(2)</enum><text>is organized under the laws of, or otherwise subject to the jurisdiction of, the Russian Federation or the People’s Republic of China.</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="idE047D7133062481EB5CD0DA514A2E653"><enum>(10)</enum><text>by adding at the end the following:</text><quoted-block id="id3BA1BD2598E841DAA8C386D835E70D86" display-inline="no-display-inline" style="OLC"><subsection id="idF2BD5DF676494B909AC6FED1C5EC3872"><enum>(h)</enum><header>Briefing</header><text>Not later than 90 days after the date of enactment of the <short-title>Fueling Our Nuclear Future Act of 2022</short-title>, the Secretary shall provide a briefing to the Committee on Energy and Natural Resources of the Senate and the Committee on Energy and Commerce of the House of Representatives that—</text><paragraph id="id96dda853a2ca458c812c7fc69c28cb5b"><enum>(1)</enum><text>summarizes the reports required by subsection (g);</text></paragraph><paragraph id="id11699092b9aa442d84627dfd71a6aa9d"><enum>(2)</enum><text>summarizes the planning of the Department for the storage and disposal of waste products resulting from the production and use of HALEU; and</text></paragraph><paragraph id="ida54caba71c3547e089bf96881da65362"><enum>(3)</enum><text>summarizes the ability of uranium suppliers to provide uranium for advanced nuclear reactor fuel, including—</text><subparagraph id="id35da1f7c44f64769ae84532bcf51920e"><enum>(A)</enum><text>uranium that has been produced prior to the date of enactment of the <short-title>Fueling Our Nuclear Future Act of 2022</short-title>;</text></subparagraph><subparagraph id="id796d235917c14554afc33a945274fe3c"><enum>(B)</enum><text>the sufficiency of existing uranium production to meet the needs described in this section;</text></subparagraph><subparagraph id="idfe61614613a14c53b0a00d2823ee2908"><enum>(C)</enum><text>an assessment of the countries from which the Unites States currently imports uranium, including the form and annual quantity;</text></subparagraph><subparagraph id="id04a277f998494d659db2d62f976f8450"><enum>(D)</enum><text>the impact of increased reliance on domestic uranium production, conversion, and enrichment to sustain the continued operation of existing nuclear reactors; and</text></subparagraph><subparagraph id="idd75e29df06d24bcfba28acff6c3b894c" commented="no" display-inline="no-display-inline"><enum>(E)</enum><text>the need for increased domestic uranium production to meet the needs described this section.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="id5D72167297BD466386752465766D82AB"><enum>4.</enum><header>Transfer of funds from the United States Enrichment Corporation Fund</header><subsection id="id3236E61FEAF44126A52A151A7E6953E6"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id376A8B20D04A4B84A2B5204119A299DE"><enum>(1)</enum><header>Fund</header><text>The term <term>Fund</term> means the United States Enrichment Corporation Fund established by section 1308 of the Atomic Energy Act of 1954 (68 Stat. 921, chapter 1073; 106 Stat. 2929) (repealed by section 3116(a)(1) of the Omnibus Consolidated Rescissions and Appropriations Act of 1996 (<external-xref legal-doc="public-law" parsable-cite="pl/104/134">Public Law 104–134</external-xref>; 110 Stat. 1321–349)).</text></paragraph><paragraph id="id2512531C83EE4C8E9ED8A5789963B18D"><enum>(2)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Energy.</text></paragraph></subsection><subsection id="id15528EB72E654B4598C20F95FF88F78F"><enum>(b)</enum><header>Authorization of transfer of amounts</header><paragraph id="idD2D69AEB1F914D64B7354C13313F9D32"><enum>(1)</enum><header>In general</header><text>All amounts in the Fund as of the date of enactment of this Act are authorized to be transferred and merged with the amounts authorized to be appropriated to the Secretary to carry out subsections (c) and (d) of section 2001 of the Energy Act of 2020 (<external-xref legal-doc="usc" parsable-cite="usc/42/16281">42 U.S.C. 16281</external-xref>).</text></paragraph><paragraph id="idE7E4B596DA314099870652A34F23FEB9"><enum>(2)</enum><header>Allocation</header><text>Of the amounts authorized to be transferred under paragraph (1)—</text><subparagraph id="id8E1E8462078240ACBBBDF58F30312592"><enum>(A)</enum><text>50 percent is authorized to be appropriated to carry out subsection (c) of that section; and</text></subparagraph><subparagraph id="id414B9D0D18BC4F3DAF241A87FF6372FB"><enum>(B)</enum><text>50 percent is authorized to be appropriated to carry out subsection (d) of that section.</text></subparagraph></paragraph><paragraph id="idB58F0A5E5E234AAF811F05115C13F279"><enum>(3)</enum><header>Application</header><text>Any amounts made available to the Secretary under subparagraph (A) or (B) of paragraph (2)—</text><subparagraph id="idD519417EDD4E48669A5B79410FA14517"><enum>(A)</enum><text>shall be considered to be part of the amounts authorized to be appropriated to the Secretary under subsection (c)(4) or (d)(6), respectively, of section 2001 of the Energy Act of 2020 (<external-xref legal-doc="usc" parsable-cite="usc/42/16281">42 U.S.C. 16281</external-xref>); and</text></subparagraph><subparagraph id="idB412133EF5C84CB68DDD933600F1CFC2" commented="no"><enum>(B)</enum><text>shall remain available until expended.</text></subparagraph></paragraph></subsection><subsection id="idFCA72047C99640CC8787F17673BAE521"><enum>(c)</enum><header>Termination of Fund</header><text>The Fund shall terminate on completion of the transfer under subsection (b)(1).</text></subsection></section></legis-body></bill>
