which was read twice and referred to the <committee-name committee-id="SSFR00">Committee on Foreign Relations</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To facilitate the development of a whole-of-government strategy for nuclear cooperation and nuclear exports.</official-title></form><legis-body><section id="idE9128EEF533D47C7A276232905C70B24" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>International Nuclear Energy Act of 2022</short-title></quote>.</text></section><section id="id00D3A0C3CC6342E99CD52F03EEA24229"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="idef602d08dbb44c598bf4e4d64c1a20e6" commented="no"><enum>(1)</enum><header>Advanced nuclear reactor</header><text>The term <term>advanced nuclear reactor</term> has the meaning given the term in section 951(b) of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/16271">42 U.S.C. 16271(b)</external-xref>).</text></paragraph><paragraph id="id86898778F910459EB359BBBA918AF024"><enum>(2)</enum><header>Ally or partner nation</header><text>The term <term>ally or partner nation</term> means the Government of each of the following:</text><subparagraph id="idD5D307F5A2654A1BB07306C77BA4FFE6"><enum>(A)</enum><text>A country that is a member of the North Atlantic Treaty Organization.</text></subparagraph><subparagraph id="id5F0A4DDA4A3B443BBC110797FEDC28CE"><enum>(B)</enum><text>Japan.</text></subparagraph><subparagraph id="id583b5259c2a54ed3a458c29de13527ef"><enum>(C)</enum><text>The Republic of Korea.</text></subparagraph><subparagraph id="id44d21da345d542a8863ef24801116bf3"><enum>(D)</enum><text>Australia.</text></subparagraph><subparagraph id="id82003464ff154c0e81abb590882a7aab"><enum>(E)</enum><text>Switzerland.</text></subparagraph><subparagraph id="idd96c11fbe82d4c8a82b5081de5721a11"><enum>(F)</enum><text>Sweden.</text></subparagraph><subparagraph id="idc316b949fbdf4f95becaa15d61e2a2ac"><enum>(G)</enum><text>Finland.</text></subparagraph><subparagraph id="id643D6A38F96A4B269C8AC2AA827960E2"><enum>(H)</enum><text>Any other country designated as an ally or partner nation by the Secretary of State for purposes of this Act.</text></subparagraph></paragraph><paragraph id="idB009F3A1988747DCAA91F66BBCEA82FB"><enum>(3)</enum><header>Assistant</header><text>The term <term>Assistant</term> means the Assistant to the President and Director for Nuclear Energy Policy described in section 3(a)(3)(A). </text></paragraph><paragraph id="id1CE6049F0B594CBAA83D065BAD80962A"><enum>(4)</enum><header>Associated entity</header><text>The term <term>associated entity</term> means an entity that—</text><subparagraph id="id46eb5f7d55384491a3f9b84c973a66ec"><enum>(A)</enum><text>is owned, controlled, or dominated by—</text><clause id="idD8F34BECAEC5429AB3E7E1DB720EBE0E"><enum>(i)</enum><text>an ally or partner nation; or</text></clause><clause id="id0BCC71AB74944FC88A74398859FB4C85" commented="no"><enum>(ii)</enum><text>an associated individual; or</text></clause></subparagraph><subparagraph id="id71417c1658af4a179c575f950b948d65" commented="no"><enum>(B)</enum><text>is organized under the laws of, or otherwise subject to the jurisdiction of, a country described in any of subparagraphs (A) through (H) of paragraph (2), including a corporation that is incorporated in a country described in any of those subparagraphs.</text></subparagraph></paragraph><paragraph id="idF4362F11A7A246C7A004B5B4C2009D37"><enum>(5)</enum><header>Associated individual</header><text>The term <term>associated individual</term> means an alien who is a national of a country described in any of subparagraphs (A) through (H) of paragraph (2).</text></paragraph><paragraph id="idB748C0C1094A4BB3965373E6388D92AE"><enum>(6)</enum><header>Center</header><text>The term <quote>Center</quote> means the Advanced Reactor Coordination and Resource Center established under section 11.</text></paragraph><paragraph id="id01d944ad6f574425a9718548d7a06881"><enum>(7)</enum><header>Embarking civil nuclear energy nation</header><text>The term <term>embarking civil nuclear energy nation</term> means a country that—</text><subparagraph id="id73CB3D32F0794D77A535D3AD7D81E41A"><enum>(A)</enum><text>does not have a civil nuclear program;</text></subparagraph><subparagraph id="id1AC277DD6AA14D24927A2F2A56F5E6C8"><enum>(B)</enum><text>is in the process of developing or expanding a civil nuclear program, including safeguards and a legal and regulatory framework, for—</text><clause id="id93B0CC0302C54D75B8C930286C1B0699"><enum>(i)</enum><text>nuclear safety; </text></clause><clause id="id51F570AAA0D846BEABFA1704E905A3F8"><enum>(ii)</enum><text>nuclear security; </text></clause><clause id="id5D4ACB625D534AFDA3A02EA046ECAAE2"><enum>(iii)</enum><text>radioactive waste management; </text></clause><clause id="idAE51AB2E11624061BDCC3A1249DD3791"><enum>(iv)</enum><text>civil nuclear energy;</text></clause><clause id="id4000AB0296AF40598D3A63234358FB31"><enum>(v)</enum><text>nuclear liability; or</text></clause><clause id="idD396738B5AE54EB899A64EA3885116A6"><enum>(vi)</enum><text>advanced nuclear reactor licensing; or</text></clause></subparagraph><subparagraph id="idA3D741F361CD4E26897ED202B6D831D2"><enum>(C)</enum><text>is in the process of selecting, developing, constructing, or utilizing advanced light water reactors, advanced nuclear reactors, or advanced nuclear technologies.</text></subparagraph></paragraph><paragraph id="id249FA8C525764157A3CA7ADB1E783486" commented="no"><enum>(8)</enum><header>High-assay low-enriched uranium</header><text>The term <term>high-assay low-enriched uranium</term> has the meaning given the term in section 2001(d) of the Energy Act of 2020 (<external-xref legal-doc="usc" parsable-cite="usc/42/16281">42 U.S.C. 16281(d)</external-xref>).</text></paragraph><paragraph commented="no" id="idC083FCEEA90C4D9981DB301F97D9104E"><enum>(9)</enum><header>Low-enriched uranium</header><text>The term <term>low-enriched uranium</term> means each of—</text><subparagraph commented="no" id="idADBB89ACCE6F4B2898C16FD496FF853A"><enum>(A)</enum><text>low-enriched uranium (as defined in section 3102 of the USEC Privatization Act (<external-xref legal-doc="usc" parsable-cite="usc/42/2297h">42 U.S.C. 2297h</external-xref>)); and</text></subparagraph><subparagraph commented="no" id="id96BB290BB6DA4A5893A686727C6AB691"><enum>(B)</enum><text>low-enriched uranium (as defined in section 3112A(a) of that Act (42 U.S.C. 2297h–10a(a))).</text></subparagraph></paragraph><paragraph id="id84C397B561A54FFA8ECCCFA72C7C05D3"><enum>(10)</enum><header>National Strategic Uranium Reserve</header><text>The term <term>National Strategic Uranium Reserve</term> means the National Strategic Uranium Reserve established under section 16(e)(1)(A).</text></paragraph><paragraph id="idCB6D16E695FD4116AFE78E31F331D8F5"><enum>(11)</enum><header>Nuclear safety</header><text>The term <term>nuclear safety</term> means issues relating to—</text><subparagraph id="id2C14A7DE2C574D888E7FE2983EC0D9E4"><enum>(A)</enum><text>the safe operation of nuclear reactors and other nuclear facilities;</text></subparagraph><subparagraph id="id260D34B0C46845B7A835E098533D16AC"><enum>(B)</enum><text>radiological protection of—</text><clause id="id70734EEFD7604AC78E08BA365452C88F"><enum>(i)</enum><text>members of the public; </text></clause><clause id="idC75C724E5B144446960036C71718A94A"><enum>(ii)</enum><text>workers; and </text></clause><clause id="id97F32CF084D54138A2ACF0EE13E3698B"><enum>(iii)</enum><text>the environment;</text></clause></subparagraph><subparagraph id="id81256C4B16D345629C5299B9B3E77F90"><enum>(C)</enum><text>nuclear waste management; </text></subparagraph><subparagraph id="idA6B3855882C84A46982F22ED19C2675C"><enum>(D)</enum><text>emergency preparedness;</text></subparagraph><subparagraph id="id7256CF978F594B63B55E0CE030549AE4"><enum>(E)</enum><text>nuclear liability; and</text></subparagraph><subparagraph id="id520730485729455A83D23671241BBE2B"><enum>(F)</enum><text>the safe transportation of nuclear materials.</text></subparagraph></paragraph><paragraph id="id32E046F6B5514D8ABEEC898935E5B7D6"><enum>(12)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Energy.</text></paragraph><paragraph id="id1A19BD5BA3DD447C9688D8D5A54082FE" commented="no"><enum>(13)</enum><header>Spent nuclear fuel</header><text>The term <term>spent nuclear fuel</term> has the meaning given the term in section 2 of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10101">42 U.S.C. 10101</external-xref>).</text></paragraph><paragraph id="id17E61ACA9C7045F4B7E79E61D6AFC9AC"><enum>(14)</enum><header>Team USA</header><text>The term <term>Team USA</term> means the interagency initiative to identify opportunities in emerging economies, embarking civil nuclear energy nations, and ally or partner nations for topics such as—</text><subparagraph id="idCF4233951B354A529D3CDF897C3C383C"><enum>(A)</enum><text>nuclear plant construction; </text></subparagraph><subparagraph id="id21C7FEFB64E047F682F4FBACE26A8F6E"><enum>(B)</enum><text>nuclear fuel services; </text></subparagraph><subparagraph id="idE7EFF984682F4AF7A8DEF44C9391251D"><enum>(C)</enum><text>nuclear energy financing;</text></subparagraph><subparagraph id="idD97DF7C2CCF14A1FA660ED67CF4F33AC"><enum>(D)</enum><text>nuclear plant operations;</text></subparagraph><subparagraph id="id81F4BFA213FA44399CC35BC471246C34"><enum>(E)</enum><text>nuclear plant regulation;</text></subparagraph><subparagraph id="idB30AACC5BB5D4F23BB7B8C529A74337B"><enum>(F)</enum><text>nuclear medicine;</text></subparagraph><subparagraph id="idD43A1775A2814AE793F6A6BA725B2D61"><enum>(G)</enum><text>infrastructure support for nuclear energy;</text></subparagraph><subparagraph id="id32711FF34C0348EE8E04E8D65F2D759B"><enum>(H)</enum><text>nuclear plant decommissioning;</text></subparagraph><subparagraph id="id88280394354A4A2F8547FD0064A12B13"><enum>(I)</enum><text>nuclear liability;</text></subparagraph><subparagraph id="id6041E36598BA42A3BE2FCD13713CD52D"><enum>(J)</enum><text>storage and disposal of spent nuclear fuel; and</text></subparagraph><subparagraph id="idD7CEB080B33740A086A504AB51FE4A8D"><enum>(K)</enum><text>technology related to the matters described in subparagraphs (A) through (J).</text></subparagraph></paragraph><paragraph id="id2043DC10F8FA46838C89B65086BB97AE" commented="no"><enum>(15)</enum><header>U.S. nuclear energy company</header><text>The term <term>U.S. nuclear energy company</term> means a company that—</text><subparagraph commented="no" id="id3C5979AD140D47C29A79BF8F87E68682"><enum>(A)</enum><text>is organized under the laws of, or otherwise subject to the jurisdiction of, the United States; and</text></subparagraph><subparagraph commented="no" id="id6F91248CB6BB4E8A87C83787CA45F07F"><enum>(B)</enum><text>is involved in the nuclear energy industry.</text></subparagraph></paragraph></section><section id="idc2cb85966e80448b9e47505d5a6babb1"><enum>3.</enum><header>Civil nuclear coordination and strategy</header><subsection id="id969226045E9C4D4AB7C5346CC8B471B8"><enum>(a)</enum><header>Office of the Assistant to the President and Director for Nuclear Energy Policy</header><paragraph id="idF1F568CD4BC44320BA0D88FDD9BAC0DB"><enum>(1)</enum><header>Establishment</header><text>There is established in the Executive Office of the President an office, to be known as the <quote>Office of the Assistant to the President and Director for Nuclear Energy Policy</quote> (referred to in this subsection as the <term>Office</term>).</text></paragraph><paragraph id="id56E548028D62477198C676327DBBE6AE"><enum>(2)</enum><header>Mission</header><text>The Office shall act as the single coordinating office for—</text><subparagraph id="idAEB58FF65D1E467B94041BB73428BC83"><enum>(A)</enum><text>civil nuclear cooperation; and </text></subparagraph><subparagraph id="idE635F647CD9C493A8C352B987C63366F"><enum>(B)</enum><text>civil nuclear export strategy.</text></subparagraph></paragraph><paragraph id="id3448684C67064B599C4DBFA178627379"><enum>(3)</enum><header>Leadership</header><subparagraph id="id0B3A521BB4F64300B7EF2B0FA6351FCA"><enum>(A)</enum><header>Assistant</header><clause id="idE23EC58519644AB380BCA5CFD4C54153"><enum>(i)</enum><header>In general</header><text>The Office shall be headed by the Assistant to the President and Director for Nuclear Energy Policy, who shall be appointed by the President.</text></clause><clause id="id0C214E6D57304EA5A9B62A8A9C7F1C65" commented="no"><enum>(ii)</enum><header>Reporting</header><text>The Assistant shall report directly to the President.</text></clause></subparagraph><subparagraph id="id31508BC5531245BFA84EB61145336FD1"><enum>(B)</enum><header>Deputy Assistant</header><clause id="idDB9B1E7732DC4A0B84E4FB2DDD61223D"><enum>(i)</enum><header>In general</header><text>The Assistant shall appoint a Deputy Assistant with experience in advising on civil nuclear project development and financing.</text></clause><clause id="idD7EEAC271E28407097F3473911486E95"><enum>(ii)</enum><header>Reporting</header><text>The Deputy Assistant shall report directly to the Assistant.</text></clause></subparagraph></paragraph><paragraph id="id1BB64C69078B444BB55C6F3FF25A30D6"><enum>(4)</enum><header>Duties</header><subparagraph id="idA667E80C48EC4EB98E3B350EA032272A"><enum>(A)</enum><header>In general</header><text>The Assistant, in consultation with the Deputy Assistant, shall—</text><clause id="id0B0E14DB46454002B51732CE602EFFAE"><enum>(i)</enum><text>coordinate the civil nuclear export policy of the United States;</text></clause><clause id="id0984CC0894A748C39217368D85B58D0D"><enum>(ii)</enum><text>develop a cohesive Federal strategy for engagement with foreign governments (including ally or partner nations and the governments of embarking civil nuclear energy nations), associated entities, associated individuals, and international lending institutions with respect to civil nuclear exports; </text></clause><clause id="idFCD558957279494CA0F6675CC0470174"><enum>(iii)</enum><text>coordinate with the officials described in subparagraph (B) to ensure that necessary framework agreements and trade controls relating to civil nuclear materials and technologies are in place for key markets; and</text></clause><clause id="id6C1EE225DA9C41559304387FD020CE48"><enum>(iv)</enum><text>develop—</text><subclause id="idE084E6BE48864CE6AC85EFE6902DB6F6"><enum>(I)</enum><text>a whole-of-government coordinating strategy for civil nuclear cooperation;</text></subclause><subclause id="id968A56899A5F4420BDCC6D46885E4485"><enum>(II)</enum><text>a whole-of-government strategy for civil nuclear exports; and</text></subclause><subclause id="idA38C6B1239C44BA4B28D3211CFC313F6" commented="no" display-inline="no-display-inline"><enum>(III)</enum><text>a whole-of-government approach to support foreign investment in domestic construction projects.</text></subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0BA9D2E693724FBAA09AF60510EC6C2D"><enum>(B)</enum><header>Officials described</header><text>The officials referred to in subparagraph (A)(iii) are—</text><clause commented="no" display-inline="no-display-inline" id="id23B58C0928A045BCB798751E2C0FC1B2"><enum>(i)</enum><text>the appropriate officials of—</text><subclause commented="no" display-inline="no-display-inline" id="id76F7F8CE44B74979AD568E0CA87B1A63"><enum>(I)</enum><text>the Department of State;</text></subclause><subclause display-inline="no-display-inline" commented="no" id="idD2424B83CDD94E08AB876EE679F981BD"><enum>(II)</enum><text>the Department of Energy;</text></subclause><subclause display-inline="no-display-inline" commented="no" id="idF2796EDAF957434199F24BDDC9963AFE"><enum>(III)</enum><text>the Department of Commerce;</text></subclause><subclause display-inline="no-display-inline" commented="no" id="id2D34384B192C463F8FFC295D6833DB6C"><enum>(IV)</enum><text>the Nuclear Regulatory Commission;</text></subclause><subclause display-inline="no-display-inline" commented="no" id="idB08D2551FA3948E5A8B0C5E63DFB4E52"><enum>(V)</enum><text>the Department of Defense;</text></subclause><subclause display-inline="no-display-inline" commented="no" id="idA7CB9E75AC5E41D584C04CC3BDE6454F"><enum>(VI)</enum><text>the National Security Council;</text></subclause><subclause display-inline="no-display-inline" commented="no" id="id1B60A77406874D5482646F9E6B5BCE5C"><enum>(VII)</enum><text>the National Economic Council;</text></subclause><subclause display-inline="no-display-inline" commented="no" id="idC6F586F3F3474B2ABE4D0794752970C7"><enum>(VIII)</enum><text>the Office of the United States Trade Representative;</text></subclause><subclause display-inline="no-display-inline" commented="no" id="idDF3B73E021E74FA894B9886AE3DF991E"><enum>(IX)</enum><text>the Office of Management and Budget;</text></subclause><subclause display-inline="no-display-inline" commented="no" id="id38176FD226444772B73B9D8BE117D8CA"><enum>(X)</enum><text>the Office of the Director of National Intelligence;</text></subclause><subclause display-inline="no-display-inline" commented="no" id="id7A4082529B484EC2A952EA9EFC6D5C74"><enum>(XI)</enum><text>the Export-Import Bank of the United States;</text></subclause><subclause display-inline="no-display-inline" commented="no" id="id9638E6BFBE4A44C088ABF0F538B63692"><enum>(XII)</enum><text>the United States International Development Finance Corporation;</text></subclause><subclause display-inline="no-display-inline" commented="no" id="id042F49295DA3489E88599664A7453662"><enum>(XIII)</enum><text>the United States Trade and Development Agency; and</text></subclause><subclause display-inline="no-display-inline" commented="no" id="id90292C60E96A4E91942246C746A41BF4"><enum>(XIV)</enum><text>the Office of Science and Technology Policy; and</text></subclause></clause><clause display-inline="no-display-inline" commented="no" id="idF8E66B695F38435D8DEDFB2548E370F3"><enum>(ii)</enum><text>appropriate officials representing foreign countries and governments, including—</text><subclause display-inline="no-display-inline" commented="no" id="id514106994408403283B0A2D66F0DF5F4"><enum>(I)</enum><text>ally or partner nations;</text></subclause><subclause display-inline="no-display-inline" commented="no" id="idB15E8E8B61B341268C0D158DC41948E5"><enum>(II)</enum><text>embarking civil nuclear energy nations; and</text></subclause><subclause display-inline="no-display-inline" commented="no" id="id5D9911672C284E78BDD52E33A2A20287"><enum>(III)</enum><text>any other country or government that the Assistant, in consultation with the Deputy Assistant and the officials described in clause (i), determines to be appropriate.</text></subclause></clause></subparagraph></paragraph><paragraph id="id3b4e2beca1564f37bf22e2d23a8b8eac"><enum>(5)</enum><header>Staff</header><subparagraph id="id21259D0B32AC411689CD1854F839B189"><enum>(A)</enum><header>Senior advisors</header><clause id="id492B57652F4B4CD097F2DCAECCF4DFE2"><enum>(i)</enum><header>In general</header><text>The Assistant shall select a staff of not fewer than 4, and not more than 6, Senior Advisors to assist in the mission of the Office.</text></clause><clause id="idC90D097923F94E77B4DF30C2D004F959"><enum>(ii)</enum><header>Requirement</header><text>The Senior Advisors selected under clause (i) shall be composed of individuals with diverse industry and government backgrounds, including individuals with backgrounds in—</text><subclause id="idde36d43635904d1b8aa24c2a6ecd1793"><enum>(I)</enum><text>project financing;</text></subclause><subclause id="idd7bb53b31d164dd9acdc40b2c923a325"><enum>(II)</enum><text>construction development and management;</text></subclause><subclause id="id7369DCAFB63C42B280D24FEA36BA8B1F"><enum>(III)</enum><text>contract structuring, risk allocation, and nuclear liability;</text></subclause><subclause id="id0f6f1c83faac442e9e61723d26f31aaf"><enum>(IV)</enum><text>regulatory, licensing, and safeguards processes;</text></subclause><subclause id="id9ea91a9fe3514a08af289a61715b9fec"><enum>(V)</enum><text>civil nuclear electric and nonelectric applications of nuclear technologies; </text></subclause><subclause id="idf734685c591a4624b6c978572827cd88"><enum>(VI)</enum><text>government-to-government negotiations;</text></subclause><subclause id="idECC99DBD113448BEAE0024DCC0FEBEBB"><enum>(VII)</enum><text>social acceptance and environmental justice;</text></subclause><subclause id="idDC2888C60A0F435E8AA5C333B4124CFB"><enum>(VIII)</enum><text>human infrastructure development;</text></subclause><subclause id="id990abca9ef594abcbe29d11907f169a1"><enum>(IX)</enum><text>major project development;</text></subclause><subclause id="id6ebbd46171844739a1e17aa17521d5e4"><enum>(X)</enum><text>international infrastructure financing; and</text></subclause><subclause id="id43E69D73D6C74551BB023BDC3D09E956"><enum>(XI)</enum><text>nuclear safety and security requirements.</text></subclause></clause></subparagraph><subparagraph id="idD868FB183ECE48A2A20EF431ED30BE25" commented="no"><enum>(B)</enum><header>Other staff</header><text>The Assistant may hire such other additional personnel as may be necessary to carry out the mission of the Office.</text></subparagraph></paragraph><paragraph commented="no" id="id723F769B63D6425CAA268DE5A00259DF"><enum>(6)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this subsection $2,000,000 for each of fiscal years 2023 through 2027.</text></paragraph></subsection><subsection id="idBB34409C82B14DE4B758A6BC754F5B87"><enum>(b)</enum><header>Nuclear Exports Working Group</header><paragraph id="idE5AB43BDCFB442029EFB663DE68AC143"><enum>(1)</enum><header>Establishment</header><text>There is established a working group, to be known as the <quote>Nuclear Exports Working Group</quote> (referred to in this subsection as the <term>working group</term>).</text></paragraph><paragraph id="idA7B8562252544F92B28AFD448D2F3246"><enum>(2)</enum><header>Composition</header><text>The working group shall be composed of—</text><subparagraph id="id251C5BC4B0164E608C42CE944A33F1E4"><enum>(A)</enum><text>senior-level Federal officials, selected internally by the applicable Federal agency or organization, from—</text><clause id="idBCD1C01F5D1F4EBA8ADDF4423AD505A8"><enum>(i)</enum><text>the Department of State; </text></clause><clause id="idDE59209960E1477490917B9A364C1C89"><enum>(ii)</enum><text>the Department of Commerce;</text></clause><clause id="id109137052905405282A106B325CAA4D2"><enum>(iii)</enum><text>the Department of Energy;</text></clause><clause id="id64E48B391ABB42F5A307A4EEDF1261CF"><enum>(iv)</enum><text>the Department of the Treasury;</text></clause><clause id="id84AA5F3598204A5DA9C68DD4A53B0440"><enum>(v)</enum><text>the Export-Import Bank of the United States;</text></clause><clause id="idD17A3FF9703C4F53A5DE8A211FB87296"><enum>(vi)</enum><text>the United States International Development Finance Corporation; and</text></subparagraph><subparagraph id="id78E5D9D29E9E4E00ADE1DD9B381A532E"><enum>(C)</enum><text>any senior-level Federal official selected by the Assistant from any Federal agency or organization.</text></subparagraph></paragraph><paragraph id="id8A20989AEC584C5AA0DCCD1FF7E35BD2"><enum>(3)</enum><header>Reporting</header><text>The working group shall report to the Assistant.</text></paragraph><paragraph id="idD69A76F39D1D425E99DB2A53CAFE0E6F"><enum>(4)</enum><header>Duties</header><text>The working group shall—</text><subparagraph id="idAAF73DE11508481CB4364C13B2718717"><enum>(A)</enum><text>provide direction and advice to the Assistant; and</text></subparagraph><subparagraph id="idAC9E48E3C7E64B59BEE4433171EB986E"><enum>(B)</enum><text>submit to the Civil Nuclear Trade Advisory Committee of the Department of Commerce and the Nuclear Energy Advisory Committee of the Department of Energy quarterly reports on the standing of civil nuclear exports from the United States, including with respect to meeting the targets established as part of the 5-year civil nuclear trade strategy described in paragraph (5)(A).</text></subparagraph></paragraph><paragraph id="id1668400F3B46478E8A8F94835EE3A519"><enum>(5)</enum><header>Strategy</header><subparagraph id="id546ADEA8119441B4B3AFBD3132BFDCFB"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the working group shall establish a 10-year civil nuclear trade strategy, including biennial targets for the export of civil nuclear technologies, including light water and non-light water reactors and associated equipment and technologies, civil nuclear materials, and nuclear fuel that align with meeting international energy demand while seeking to avoid or reduce emissions.</text></subparagraph><subparagraph id="id8BA6E28BB62B4A238B7CAAA87069A1A6"><enum>(B)</enum><header>Collaboration required</header><text display-inline="yes-display-inline">In establishing the strategy under subparagraph (A), the working group shall collaborate with—</text><clause id="id24370A79CE464B67AF90D32C45AD5884"><enum>(i)</enum><text display-inline="yes-display-inline">the Secretary;</text></clause><clause id="id1672DD3CE40440C8A850C769039A1B0D"><enum>(ii)</enum><text display-inline="yes-display-inline">the Secretary of Commerce;</text></clause><clause id="id823B1E86C68C4A8C928DEAD028A13776"><enum>(iii)</enum><text display-inline="yes-display-inline">the Secretary of State;</text></clause><clause id="id1DC004BA521F4820812409597F342873"><enum>(iv)</enum><text>the Secretary of the Treasury;</text></clause><clause id="id384C6810688F4809B85062BC93CD5EDA"><enum>(v)</enum><text>the Nuclear Regulatory Commission;</text></clause><clause id="idFC2556A5300D4A66815C8943DCF092AF"><enum>(vi)</enum><text display-inline="yes-display-inline">the President of the Export-Import Bank of the United States;</text></clause><clause id="id987C950A8B7E44158D92281A491827B4"><enum>(vii)</enum><text display-inline="yes-display-inline">the Chief Executive Officer of the United States International Development Finance Corporation;</text></clause><clause id="id56BAE3DF84DC43EBA6F1335C5FF6148C"><enum>(viii)</enum><text display-inline="yes-display-inline">the United States Trade Representative; and</text></clause><clause id="id35DDB5F5B80A49F7AF74B687877ED72E"><enum>(ix)</enum><text display-inline="yes-display-inline">representatives of private industry.</text></clause></subparagraph></paragraph></subsection></section><section id="idEE1B49BCC1734656891A55B2F3F0746C"><enum>4.</enum><header>Engagement with ally or partner nations</header><subsection id="id2cfae9a781974e3389df0ad8f207564b"><enum>(a)</enum><header>In general</header><text>The Secretary of State, in coordination with the Secretary, the Nuclear Regulatory Commission, Team USA, and the Assistant, shall launch, in accordance with applicable nuclear technology export laws (including regulations), an international initiative to modernize the civil nuclear outreach carried out by the United States for the purpose of establishing cooperative financing relationships for the export of civil nuclear technology, components, materials, and infrastructure to countries in the coalition described in subsection (b).</text></subsection><subsection id="idb6c67ee3c131411395420387b74a9143"><enum>(b)</enum><header>Coalition described</header><text>The coalition referred to in subsection (a) is a coalition of countries that—</text><paragraph id="idE08199FDF1174874B68BFF6DD0B47559"><enum>(1)</enum><text>is developed for purposes of carrying out the initiative described in subsection (a); and</text></paragraph><paragraph id="id84AFFEC7A31F4C1D9627EFA32DFC04D1"><enum>(2)</enum><text>includes each ally or partner nation that is willing to participate in the coalition.</text></paragraph></subsection><subsection id="idbd158a4941ad4c3abcf42355ea71aafe"><enum>(c)</enum><header>Activities</header><text>In carrying out the initiative described in subsection (a), the Secretary of State shall—</text><paragraph id="id6538E3275D4C4C908C1664C7504C1421"><enum>(1)</enum><text>assist nongovernmental organizations and appropriate offices, administrations, agencies, laboratories, and programs of the Department of Energy in providing education and training to foreign governments in nuclear safety, security, and safeguards—</text><subparagraph id="id453E1D5E22474BC29FFB447406533B43"><enum>(A)</enum><text>through engagement with the International Atomic Energy Agency; or</text></subparagraph><subparagraph id="idF47426F2B78C4495B578296F77265F18"><enum>(B)</enum><text>independently, if the applicable entity determines that it would be more advantageous under the circumstances to provide the applicable education and training independently;</text></subparagraph></paragraph><paragraph id="idc1c73f5f774e42b7a1a22696aee47059"><enum>(2)</enum><text>assist the efforts of the International Atomic Energy Agency to expand the support provided by the International Atomic Energy Agency to embarking civil nuclear energy nations for nuclear safety, security, and safeguards;</text></paragraph><paragraph id="id45332948a6814499b4bd9d8cb9715687"><enum>(3)</enum><text>expand outreach by the Assistant to the private investment community to create public-private financing relationships to assist in the export of civil nuclear technology to countries in the coalition described in subsection (b);</text></paragraph><paragraph id="idbf0cb6d79f0e4bc8b47f649706d8f4ae"><enum>(4)</enum><text>seek to coordinate, to the maximum extent practicable, the work carried out by each of—</text><subparagraph id="id7F57712803104C468F6C49DB8205EF6C"><enum>(A)</enum><text>the Nuclear Regulatory Commission;</text></subparagraph><subparagraph id="id87BCCD980D0445DF94FC1DB9327AED09"><enum>(B)</enum><text>the Department of Energy; </text></subparagraph><subparagraph id="idD2DBBBC97403458C81FE33C0D0270FAE"><enum>(C)</enum><text>the Department of Commerce; </text></subparagraph><subparagraph id="id3823D9DD96784B16B925123032AF653D"><enum>(D)</enum><text>the International Atomic Energy Agency;</text></subparagraph><subparagraph id="id40D703DC2B9E4E8B9FDF9CF2F98958A1"><enum>(E)</enum><text>the Nuclear Energy Agency; and</text></subparagraph><subparagraph id="idFA1724A22786424093D360215878A1D5"><enum>(F)</enum><text>the nuclear regulatory agencies and organizations of embarking civil nuclear energy nations and ally or partner nations; and </text></subparagraph></paragraph><paragraph id="idE953B5F94BF34EBE9AC7AA5FFED98935"><enum>(5)</enum><text>improve the regulatory framework to allow for the expeditious exporting and importing of civil nuclear technologies and materials.</text></paragraph></subsection></section><section id="idA69B9734C703441C8970688C7967B8CC"><enum>5.</enum><header>Cooperative financing relationships with ally or partner nations and embarking civil nuclear energy nations</header><subsection id="idA510832C846D4B4D8EDDA479B1D21833"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary, the Secretary of State, the Secretary of Commerce, the President of the Export-Import Bank of the United States, and the Chief Executive Officer of the United States International Development Finance Corporation, in coordination with the Assistant, shall develop cooperative financing relationships with ally or partner nations or embarking civil nuclear energy nations to advance civil nuclear exports from the United States to ally or partner nations or embarking civil nuclear energy nations.</text></subsection><subsection id="idA3A740338688463B9674441DBC1DBBA9"><enum>(b)</enum><header>United States competitiveness clauses</header><paragraph id="idDAB58B4084F441508298B9447BC8C066" commented="no"><enum>(1)</enum><header>Definition of United States competitiveness clause</header><text>In this subsection, the term <term>United States competitiveness clause</term> means any United States competitiveness provision in any agreement entered into by the Department of Energy, including—</text><subparagraph id="idB9365BDC05584912A8E1C12706F85C0E" commented="no"><enum>(A)</enum><text>a cooperative agreement;</text></subparagraph><subparagraph id="idD6D411C9A1DA4628B5EE228C009A862C" commented="no"><enum>(B)</enum><text>a cooperative research and development agreement; and</text></subparagraph><subparagraph id="id73F08283F67245CBA7095AEE1BFEA1BB" commented="no"><enum>(C)</enum><text>a patent waiver.</text></subparagraph></paragraph><paragraph id="idEF201FAEB72F4DD897A82EC210601C8C"><enum>(2)</enum><header>Consideration</header><text>In carrying out subsection (a), the Secretary, the Secretary of State, the Secretary of Commerce, the President of the Export-Import Bank of the United States, and the Chief Executive Officer of the United States International Development Finance Corporation shall consider the impact of United States competitiveness clauses on any cooperative financing relationships entered into or proposed to be entered into under that subsection.</text></paragraph><paragraph id="idFD4461D6D9D54696851F2EC7067874D3"><enum>(3)</enum><header>Waiver</header><text>The Secretary shall facilitate waivers of United States competitiveness clauses as necessary to facilitate cooperative financing relationships with ally or partner nations or embarking civil nuclear energy nations under subsection (a).</text></paragraph></subsection></section><section id="id8F06AA6D9B5142CC85B38B6DC69A7A16"><enum>6.</enum><header>Fast-track procedures and export controls</header><text display-inline="no-display-inline">Not later than 180 days after the date of enactment of this Act, the Secretary shall promulgate a regulation revising part 810 of title 10, Code of Federal Regulations, to establish fast-track procedures for obtaining specific authorizations for exports, which may be similar to existing fast-track procedures in existing Federal export-control regulations—</text><paragraph id="id4d4011e0addb4a6eae3eee1e18147fe5"><enum>(1)</enum><text>for deemed exports to—</text><subparagraph id="id0FB2D431445E45ABAF24D412EBFFE0BF"><enum>(A)</enum><text> a list of countries defined by the Secretary;</text></subparagraph><subparagraph id="id73EFE64550124FB7A86538424B9A0E75"><enum>(B)</enum><text>a list of countries defined by the Secretary of State;</text></subparagraph><subparagraph id="idB4E6E3BCB3874DDC8EC49D7D2B38550B"><enum>(C)</enum><text>a list of countries defined by the Secretary of the Treasury;</text></subparagraph><subparagraph id="id44AF1A0D91294CB3A32446714D2B4525"><enum>(D)</enum><text>a list of countries defined by the Secretary of Commerce; or</text></subparagraph><subparagraph id="idDEB19A4B560F4227B298950BF6C78F03"><enum>(E)</enum><text>destinations based on country criteria defined by the Secretary; or</text></subparagraph></paragraph><paragraph id="id7484b492ee614570b1ae0849382a8d8d"><enum>(2)</enum><text>for widely deployed technologies available from multiple suppliers, such as light water reactor technology.</text></paragraph></section><section id="idF5A2EF66DFCD4DBEA3204CEEA8EB0E01"><enum>7.</enum><header>Cooperation with ally or partner nations on advanced nuclear reactor demonstration and cooperative research facilities</header><subsection id="idf8fa426c8cb0461185c5384c10fb0720"><enum>(a)</enum><header>In general</header><text>Not later than 2 years after the date of enactment of this Act, the Secretary of State, in coordination with the Secretary, the Secretary of Commerce, and the Assistant, shall conduct bilateral and multilateral meetings with not fewer than 5 ally or partner nations, with the aim of enhancing nuclear energy cooperation among those ally or partner nations and the United States, for the purpose of developing collaborative relationships with respect to research, development, licensing, and deployment of advanced nuclear reactor technologies.</text></subsection><subsection id="id1fca5caa27f14e65a0df7c76a5462fd2"><enum>(b)</enum><header>Requirement</header><text>The meetings described in subsection (a) shall include—</text><paragraph id="id1A26386B2AB1489397096F83ACC10555"><enum>(1)</enum><text>a focus on cooperation to demonstrate and deploy advanced nuclear reactors, with an emphasis on U.S. nuclear energy companies, during the 10-year period beginning on the date of enactment of this Act to provide options for addressing climate change by 2050; and</text></paragraph><paragraph id="id848357386AE34E0A99CF7132926D5AD4"><enum>(2)</enum><text>a focus on developing a memorandum of understanding or any other appropriate agreement between the United States and ally or partner nations with respect to—</text><subparagraph id="id5D7E9CE4618243FDBA28F0D3A8F5754B"><enum>(A)</enum><text>the demonstration and deployment of advanced nuclear reactors; and </text></subparagraph><subparagraph id="idC246F317A2B54BB19A6B86CC397ED799"><enum>(B)</enum><text>the development of cooperative research facilities.</text></subparagraph></paragraph></subsection><subsection id="idb8e4ad0fba7c4e229dde721b8ab8ec6c"><enum>(c)</enum><header>Financing arrangements</header><text>In conducting the meetings described in subsection (a), the Secretary of State, in coordination with the Secretary, the Secretary of Commerce, and the Assistant, shall seek to develop financing arrangements to share the costs of the demonstration and deployment of advanced nuclear reactors and the development of cooperative research facilities with the ally or partner nations participating in those meetings.</text></subsection><subsection id="idf462335785434b6dbe8a09ca51611dc5"><enum>(d)</enum><header>Report</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary, the Secretary of State, and the Secretary of Commerce shall jointly submit to Congress a report highlighting potential partners—</text><paragraph id="idA431E7D9063D4ED4A94C1AC12ACAE3A6"><enum>(1)</enum><text>for the establishment of cost-share arrangements described in subsection (c); or </text></paragraph><paragraph id="idCE3E4808A5674303A1347DA2DF21AEE9"><enum>(2)</enum><text>with which the United States may enter into agreements with respect to—</text><subparagraph id="id60E4CE48CCDC4BA487D88C346E14420C" commented="no"><enum>(A)</enum><text>the demonstration of advanced nuclear reactors; or</text></subparagraph><subparagraph id="id128AB31503F24F00823886ADA29B0163" commented="no"><enum>(B)</enum><text>cooperative research facilities.</text></subparagraph></paragraph></subsection></section><section id="idD1466D5A9BF34278BE73D9E77ED1490F"><enum>8.</enum><header>International nuclear energy cooperation</header><text display-inline="no-display-inline">Section 959B of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/16279b">42 U.S.C. 16279b</external-xref>) is amended—</text><paragraph id="idF768503FB04C45C7A62FE1994005CAA5"><enum>(1)</enum><text>in the matter preceding paragraph (1), by striking <quote>The Secretary</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id915435A89EAF46F4BD1FFAAA765C748E"><subsection id="id8D52DB698B45447183AC6E6A68CE5BEC"><enum>(a)</enum><header>In general</header><text>The Secretary</text></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="idECD90BE415A04F679A2856D42D067E8C"><enum>(2)</enum><text>in subsection (a) (as so designated)—</text><subparagraph id="idCEBA931951694EB1AE8A52B8D163F57A"><enum>(A)</enum><text>in paragraph (1)—</text><clause id="id0323106E55FE44EDA64B4605B9266B30"><enum>(i)</enum><text>by striking <quote>financing,</quote>; and</text></clause><clause id="id6EB4E29F6B4F4EE1B79E25482EB4D8D5"><enum>(ii)</enum><text>by striking <quote>and</quote> after the semicolon at the end;</text></clause></subparagraph><subparagraph id="id7B5A70AA0F074123BBF5450D9280D88A"><enum>(B)</enum><text>in paragraph (2)—</text><clause id="idF485B536A0E14837AA0836BF71E0FE78"><enum>(i)</enum><text>in subparagraph (A), by striking <quote>preparations for</quote>; and</text></clause><clause id="id771C9298EE394D81A70209BA4C51FE64"><enum>(ii)</enum><text>in subparagraph (C)(v), by striking the period at the end and inserting a semicolon; and</text></clause></subparagraph><subparagraph id="id0E9D47761C6844B883A9E57866408356"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id729D8D3F02994495AC6412F4A21FAF7E"><paragraph id="id76B11920821A46C7BB4B740720563A3D"><enum>(3)</enum><text>to support, in consultation with the Secretary of State, the safe, secure, and peaceful use of nuclear technology in countries developing nuclear energy programs, with a focus on countries that have increased civil nuclear cooperation with the Russian Federation or the People’s Republic of China; and</text></paragraph><paragraph id="ideb8e9a6bf06c4a1fa273e88430ff0da5"><enum>(4)</enum><text>to promote the fullest utilization of United States reactors, fuel, equipment, services, and technology in nuclear energy programs outside the United States through—</text><subparagraph id="idd2cf715ec8ff487b80d18dd0e2890e86"><enum>(A)</enum><text>bilateral and multilateral arrangements that contain commitments for the utilization of United States reactors, fuel, equipment, services, and technology;</text></subparagraph><subparagraph id="idd88cc1fe811149f78347b2407339c28a"><enum>(B)</enum><text>the designation of 1 or more U.S. nuclear energy companies (as defined in section 2 of the <short-title>International Nuclear Energy Act of 2022</short-title>) to implement an arrangement under subparagraph (A) if the Secretary determines that the designation is necessary and appropriate to achieve the objectives of this section;</text></subparagraph><subparagraph id="idc0634ac5d5df4a409172131c35efc656"><enum>(C)</enum><text>the waiver of any provision of law relating to competition with respect to any activity related to an arrangement under subparagraph (A) if the Secretary, in consultation with the Attorney General and the Secretary of Commerce, determines that a waiver is necessary and appropriate to achieve the objectives of this section; and</text></subparagraph><subparagraph id="idcdd45976853b48eb8a6add591c360e73"><enum>(D)</enum><text>the issuance of loans, loan guarantees, other financial assistance, or assistance in the form of an equity interest to carry out activities related to an arrangement under subparagraph (A), to the extent appropriated funds are available.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id4EA361FFA9464267B58E061CCAAF3D6C"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id0E9EE95F66654B8ABEA4B9CA0BACFB64"><subsection id="id8E5D1FF73CFD4BA39D1BC6B47F239742"><enum>(b)</enum><header>Requirements</header><text>The program under subsection (a) shall—</text><paragraph id="id84683B56A27A481183E1CF5BEA8F8EBF"><enum>(1)</enum><text>with respect to the function described in subsection (a)(3), be modeled after the International Military Education and Training program of the Department of State; and</text></paragraph><paragraph id="id6E689300A9F14C93962942BFD621F3DA"><enum>(2)</enum><text>be carried out—</text><subparagraph id="idAF2D4794CF0D46C4BDAEB36F7705AA02"><enum>(A)</enum><text>to facilitate, to the maximum extent practicable, workshops and expert-based exchanges to engage industry, stakeholders, and foreign governments with respect to international civil nuclear issues, such as—</text><clause id="id585A4D295F1A4FFCA5D520079FE10A55"><enum>(i)</enum><text>training; </text></clause><clause id="id24A196F66BB24A5F8F8EB94B40AA0C43"><enum>(ii)</enum><text>financing; </text></clause><clause id="idC9A1E25413A54AFBA9F304AE1ABE1EDC"><enum>(iii)</enum><text>safety;</text></clause><clause id="id18354D09BC5748E0B296E95510FA7BEC"><enum>(iv)</enum><text>security;</text></clause><clause id="id3B5E80E6E1364E69A75ACF9263D10C65"><enum>(v)</enum><text>safeguards;</text></clause><clause id="idB3E8433053094F95B5CCB9CB51BD198F"><enum>(vi)</enum><text>liability;</text></clause><clause id="id8DA7150C9F16423D9AEA89D058EBA913"><enum>(vii)</enum><text>advanced fuels;</text></clause><clause id="idC57B67032B4E44BE93EB89794A01A35C"><enum>(viii)</enum><text>operations; and</text></clause><clause id="id296FE9C9107645E9AD9A29759C16FD46"><enum>(ix)</enum><text>options for multinational cooperation with respect to the disposal of spent nuclear fuel (as defined in section 2 of the Nuclear Waste Policy Act of 1982 (<external-xref legal-doc="usc" parsable-cite="usc/42/10101">42 U.S.C. 10101</external-xref>)); and</text></clause><clause id="id1B6AD05BEE2F4B2CB365A9749C2D8114"><enum>(iv)</enum><text>the Nuclear Regulatory Commission.</text></clause></subparagraph></paragraph></subsection><subsection id="id668D801254E944EC9E1C0300F8250F76"><enum>(c)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Secretary to carry out subsection (a)(3) $15,500,000 for each of fiscal years 2022 through 2026.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="id13f19b7555574a4c878fbc326baab49d"><enum>9.</enum><header>International civil nuclear program support</header><subsection id="id026486ab446f485aa35a13a0be05fe6c"><enum>(a)</enum><header>In general</header><text>Not later than 120 days after the date of enactment of this Act, the Secretary of State, in coordination with the Secretary and the Assistant, shall launch an international initiative (referred to in this section as the <term>initiative</term>) to provide grants, in accordance with this section—</text><paragraph id="idB84524085D57404A94F515DA709B8CE4"><enum>(1)</enum><text>to embarking civil nuclear energy nations for activities relating to the development of civil nuclear programs; and</text></paragraph><paragraph id="idC63F57223CCB411EB875E01E4BD633F9"><enum>(2)</enum><text>to ally or partner nations for the construction of nuclear reactors and advanced nuclear reactors.</text></paragraph></subsection><subsection id="id159600c6addb4f638f334c5e4307c46c"><enum>(b)</enum><header>Grants</header><paragraph id="idA9885D9B44AA41FEB7AC4C69A62E0E60"><enum>(1)</enum><header>In general</header><text>In carrying out the initiative, the Secretary of State, in coordination with the Secretary and the Assistant, may award not more than 1 grant to each country, including each embarking civil nuclear energy nation, each fiscal year.</text></paragraph><paragraph id="id10131ACF9CB5489DA8A81D77482A9119"><enum>(2)</enum><header>Amount</header><text>The amount of a grant awarded under the initiative shall be not more than $5,500,000.</text></paragraph><paragraph id="id553CF41B85AA4C05A9CA528DEDB0D257"><enum>(3)</enum><header>Limitation</header><text>The Secretary of State, in coordination with the Secretary and the Assistant, may award not more than a total of 5 grants under the initiative to a single country, including each embarking civil nuclear energy nation.</text></paragraph></subsection><subsection id="id4d9e77d6e8f341759930112d84bf66bd"><enum>(c)</enum><header>Senior advisors</header><paragraph id="idE6D17EDB8C6146BFB26D0130D66A00BF"><enum>(1)</enum><header>In general</header><text>In carrying out the initiative, the Secretary of State, in coordination with the Secretary and the Assistant, shall provide a grant to an embarking civil nuclear energy nation with the option for a U.S. nuclear energy company to hire 1 or more senior advisors to assist the embarking civil nuclear energy nation in establishing a civil nuclear program.</text></paragraph><paragraph id="id0cf99c1d74cc4176b205de8c011551d8"><enum>(2)</enum><header>Requirement</header><text>A senior advisor described in paragraph (1) shall seek to advise the embarking civil nuclear energy nation on, and facilitate on behalf of the embarking civil nuclear energy nation, 1 or more of the following:</text><subparagraph id="id1C2D35BD2C7940F882BAC5E86E6AAD0B"><enum>(A)</enum><text>The development of financing relationships.</text></subparagraph><subparagraph id="idde59d80533e14a048011f631985d79f4"><enum>(B)</enum><text>The development of a standardized financing and project management framework for the construction of nuclear power plants.</text></subparagraph><subparagraph id="ideea21e20662348ff8ec26df05581da9a"><enum>(C)</enum><text>The development of a standardized licensing framework for—</text><clause id="id9983DF4F59784DAA8FB5B70E3DDA895F"><enum>(i)</enum><text>light water civil nuclear technologies; and </text></clause><clause id="idB51D861F2CC549B48D20DE13BCF74397"><enum>(ii)</enum><text>non-light water civil nuclear technologies and advanced nuclear reactors.</text></clause></subparagraph><subparagraph id="idb5579491ba3d4a0f993fd54c84024c18"><enum>(D)</enum><text>The identification of qualified organizations and service providers.</text></subparagraph><subparagraph id="idc9807a9389104246aa57976608b6b96a"><enum>(E)</enum><text>The identification of funds to support payment for services required to develop a civil nuclear program. </text></subparagraph><subparagraph id="id8C6025B7A6EC42D49AB19FC80BC5B968"><enum>(F)</enum><text>Market analysis.</text></subparagraph><subparagraph id="id40240f270b1445d5ad506b83403e3960"><enum>(G)</enum><text>The identification of the safety, security, safeguards, and nuclear governance required for a civil nuclear program.</text></subparagraph><subparagraph id="id083E3C398CB349F7A305AA14DF95B377"><enum>(H)</enum><text>Risk allocation, risk management, and nuclear liability.</text></subparagraph><subparagraph id="id4D64D4EA30234B94891FC3F79DCFF2D4"><enum>(I)</enum><text>Technical assessments of nuclear reactors and technologies.</text></subparagraph><subparagraph id="id596949944C874277825EAEFA45B596BF"><enum>(J)</enum><text>The identification of actions necessary to participate in a global nuclear liability regime based on the Convention on Supplementary Compensation for Nuclear Damage, with Annex, done at Vienna September 12, 1997 (TIAS 15–415).</text></subparagraph><subparagraph id="id92982353CCF941D7A822B5FD1FF0BEB8"><enum>(K)</enum><text>Stakeholder engagement.</text></subparagraph><subparagraph id="idFEB4C671102B463BB3D89CFB42DEED6E"><enum>(L)</enum><text>Management of spent nuclear fuel and nuclear waste.</text></subparagraph><subparagraph id="id9D63538E125B476B899964ACA444D038"><enum>(M)</enum><text>Any other major activities to support the establishment of a civil nuclear program, such as the establishment of export, financing, construction, training, operations, and education requirements.</text></subparagraph></paragraph></subsection><subsection id="id39d4c2940db3426983eb52c870a8dea2"><enum>(d)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Secretary of State to carry out the initiative $50,000,000 for each of fiscal years 2023 through 2027.</text></subsection></section><section id="id16331F59564E45F3A1F377A960DE9761"><enum>10.</enum><header>Biennial nuclear safety, security, safeguards, and sustainability summit</header><subsection id="id3e8263f7d84c47038f1d1ea4d52fcce3"><enum>(a)</enum><header>In general</header><text>The Secretary, the Secretary of State, the Secretary of Defense, the Secretary of Commerce, the Nuclear Regulatory Commission, and the Assistant shall hold a biennial nuclear safety, security, safeguards, and sustainability summit (referred to in this section as a <term>summit</term>), the first of which shall be held on the date that is 180 days after the date of enactment of this Act.</text></subsection><subsection id="idF4AAC291B1F841548B095F8821F9D7D9"><enum>(b)</enum><header>Location</header><text>Each summit shall be held in—</text><paragraph id="id446A8BBBE3C3415A9BD3AAF919ABA312"><enum>(1)</enum><text>Washington, DC; or </text></paragraph><paragraph id="id61D142DE5B914E65A7BBB0E98767C867"><enum>(2)</enum><text>a country described in any of subparagraphs (A) through (H) of section 2(2).</text></paragraph></subsection><subsection id="idCB162EC06ECC4F3A9C345BEC7F1A600D"><enum>(c)</enum><header>Requirement</header><text>Each summit shall—</text><paragraph id="idAA58D1902CA0469AA04241EBF1231E9B"><enum>(1)</enum><text>be a forum in which leaders of ally or partner nations may engage with each other for the purpose of reinforcing the commitment to nuclear safety, security, safeguards, and sustainability; and </text></paragraph><paragraph id="idC2D53EF218744AC487409F12DA7E451B"><enum>(2)</enum><text>facilitate the development of—</text><subparagraph id="id0B946A0B1DB14CE4871700CAE95D1C34"><enum>(A)</enum><text>joint commitments and goals to improve nuclear safety, security, safeguards, and sustainability;</text></subparagraph><subparagraph id="id8A75E1CAB31F420E80539F832360E75E"><enum>(B)</enum><text>stronger international institutions that support nuclear safety, security, safeguards, and sustainability; and</text></subparagraph><subparagraph id="id98953DA9F1EE424EA8E4850036C77EA5"><enum>(C)</enum><text>a global nuclear liability regime.</text></subparagraph></paragraph></subsection><subsection id="id5f67c30b0891451885c1e47c2bf74423"><enum>(d)</enum><header>Input from industry and government</header><text>Each summit shall include a meeting that convenes nuclear industry leaders and leaders of government agencies with expertise relating to nuclear safety, security, safeguards, or sustainability to discuss best practices relating to—</text><paragraph id="id62b80b666dc64e0aa404200b4c32d050"><enum>(1)</enum><text>the safe and secure use, storage, and transport of nuclear and radiological materials;</text></paragraph><paragraph id="idb749a6d7b2a94a1a87f7ceb446017a83"><enum>(2)</enum><text>managing the evolving cyber threat to nuclear and radiological security; and</text></paragraph><paragraph id="id1cae557ab2b34270945e6546c03b9e87"><enum>(3)</enum><text>the role that the nuclear industry should play in nuclear and radiological safety, security, and safeguards, including with respect to the safe and secure use, storage, and transport of nuclear and radiological materials, including spent nuclear fuel and nuclear waste.</text></paragraph></subsection><subsection id="id4db05817ec5c43d19bf0806bbe22e6bf"><enum>(e)</enum><header>Report</header><paragraph id="idA3A0491662EC4A52BDD96E9493C2DE43"><enum>(1)</enum><header>In general</header><text>Not later than 120 days after the end of each summit, the Secretary, the Secretary of State, the Secretary of Defense, the Secretary of Commerce, the Nuclear Regulatory Commission, and the Assistant shall jointly submit to Congress a report highlighting—</text><subparagraph id="idB572E402E1184A77B98591A4EEE72709"><enum>(A)</enum><text>any commitments made by the United States or international partners of the United States, including an ally or partner nation, with respect to nuclear safety, security, safeguards, or sustainability; and </text></subparagraph><subparagraph id="id5952577CFF9541E8B5636BC31FA18D0A"><enum>(B)</enum><text>the objectives that the parties to those commitments agreed to meet. </text></subparagraph></paragraph><paragraph id="id34C0108F24B8434B9CA2105A72C1497D"><enum>(2)</enum><header>Requirement</header><text>The report under paragraph (1) shall detail—</text><subparagraph id="id1cdda7aad3f34591890b369a2c02fb6d"><enum>(A)</enum><text>any current and continuing nuclear security threat;</text></subparagraph><subparagraph id="id94e979ba099e4f95b05435949cb77723"><enum>(B)</enum><text>any progress made toward advancing nuclear security-related treaties;</text></subparagraph><subparagraph id="id13a3b193c908401b94307ab9a8b45e38"><enum>(C)</enum><text>any steps taken or needed to be taken—</text><clause id="id732A631B41DD4467BB835AECA0C1108D"><enum>(i)</enum><text>to fulfill any obligations of the United States under existing nuclear security and safeguard treaties; </text></clause><clause id="id858D886B34E74F7CA1F168FC790BFEE9"><enum>(ii)</enum><text>to manage cyber threats; or </text></clause><clause id="idF9E6515EDB984BC4B9597F527237B22D"><enum>(iii)</enum><text>to prevent the theft, sabotage, and illicit trafficking of nuclear materials, facilities, and technology, as applicable;</text></clause></subparagraph><subparagraph id="ide13c15c927a7454bb76c63a13162ab0e"><enum>(D)</enum><text>the role of the nuclear industry in preventing nuclear proliferation; and</text></subparagraph><subparagraph id="idF6F1459381544676B943C66DCE791031"><enum>(E)</enum><text>any other topics discussed during the summit that relate to nuclear safety, security, safeguards, or sustainability.</text></subparagraph></paragraph></subsection></section><section id="id167B153E610148C0B6520219DF3A7873"><enum>11.</enum><header>Advanced Reactor Coordination and Resource Center</header><text display-inline="no-display-inline">The Secretary, in coordination with the Secretary of State, the Secretary of Commerce, the Chairman of the Nuclear Regulatory Commission, the President of the Export-Import Bank of the United States, and the Chief Executive Officer of the United States International Development Finance Corporation, shall establish a center, to be known as the <quote>Advanced Reactor Coordination and Resource Center</quote>, for the purposes of—</text><paragraph id="id8DCE50E3C52D41C9B9FE354777CE2027"><enum>(1)</enum><text>identifying qualified organizations and service providers—</text><subparagraph id="idA5255B42F3D940EF9AACBB0E767710F7"><enum>(A)</enum><text>for embarking civil nuclear energy nations;</text></subparagraph><subparagraph id="id6D566E599D0248739C1D51C8E6828D67"><enum>(B)</enum><text>to develop and assemble documents, contracts, and related items required to establish a civil nuclear program; and</text></subparagraph><subparagraph id="id3363512B1F4841CC988CAA6DA6D4F798"><enum>(C)</enum><text>to develop a standardized model for the establishment of a civil nuclear program that can be used by the International Atomic Energy Agency;</text></subparagraph></paragraph><paragraph id="id02C3AB474A584F278D841225D0762582"><enum>(2)</enum><text>coordinating with countries participating in the Center and with the Nuclear Exports Working Group established under section 3(b)—</text><subparagraph id="id3D8FF8A7D9EF407A8EE33E83AB65269F"><enum>(A)</enum><text>to identify funds to support payment for services required to develop a civil nuclear program;</text></subparagraph><subparagraph id="id63021CE8BF284DF7B0FF51EDA1C58817"><enum>(B)</enum><text>to provide market analysis; and</text></subparagraph><subparagraph id="idFF40AC8EE5F34DC49365A574267361A0"><enum>(C)</enum><text>to create—</text><clause id="idE4DF96E05AD94D53A8DA95E0FFE801B0"><enum>(i)</enum><text>project structure models; </text></clause><clause id="id1792ECFFA4C54F68840CD116D66A5355"><enum>(ii)</enum><text>models for electricity market analysis; </text></clause><clause id="idDCF8337B00A4462D895F62D446CAD7A1"><enum>(iii)</enum><text>models for nonelectric applications market analysis; and </text></clause><clause id="idC3A8EF718AAF4C82B5C432DEF90FD266"><enum>(iv)</enum><text>financial models;</text></clause></subparagraph></paragraph><paragraph id="idE8F2ABCE33944BEFA683B8321CF950C4"><enum>(3)</enum><text>identifying and developing the safety, security, safeguards, and nuclear governance required for a civil nuclear program;</text></paragraph><paragraph id="idB88489B3750249098676991F4A3F52EF"><enum>(4)</enum><text>supporting multinational regulatory standards to be developed by countries with civil nuclear programs and experience;</text></paragraph><paragraph id="idC23B837D6D9A4FEF9C645BA66CCE6592"><enum>(5)</enum><text>developing and strengthening communications, engagement, and consensus-building;</text></paragraph><paragraph id="id64A2B6575391449C89208D3DFCE5D5EF"><enum>(6)</enum><text>carrying out any other major activities to support export, financing, education, construction, training, and education requirements relating to the establishment of a civil nuclear program;</text></paragraph><paragraph id="id9FAC5124F4934D90AFDCE26E9431F737"><enum>(7)</enum><text>developing mechanisms for how to fund and staff the Center; and</text></paragraph><paragraph id="id8B637BA7154F425793EBC496BE9EB47B" commented="no" display-inline="no-display-inline"><enum>(8)</enum><text>determining mechanisms for the selection of the location or locations of the Center.</text></paragraph></section><section id="id5e1a23e2ff624cdf8a65f11c02a590dc"><enum>12.</enum><header>Biennial civil nuclear vendor summit</header><subsection id="id720d79cee7084b8cbfb66bfea34401cb"><enum>(a)</enum><header>In general</header><text>The Secretary, the Secretary of State, the Secretary of Commerce, the President of the Export-Import Bank of the United States, the Chief Executive Officer of the United States International Development Finance Corporation, and the Assistant shall hold a biennial civil nuclear vendor summit (referred to in this section as a <term>summit</term>), the first of which shall be held on the date that is 180 days after the date of enactment of this Act.</text></subsection><subsection id="id5dce2e77a9b8463ebeac41cc02ff9b0d"><enum>(b)</enum><header>Location</header><text>Each summit shall be held in—</text><paragraph id="ida38e768b693c466bb62d1407e20969fb"><enum>(1)</enum><text>Washington, DC; or</text></paragraph><paragraph id="id7d5bf9d305a542cfb88715051945c1ae"><enum>(2)</enum><text>a country described in any of subparagraphs (A) through (H) of section 2(2).</text></paragraph></subsection><subsection id="idde8de732a7514cd686428eb7091d8b1a"><enum>(c)</enum><header>Requirement</header><text>Each summit shall—</text><paragraph id="id88de0835c9ca410bb62915e24e1b6a3a"><enum>(1)</enum><text>be a forum in which leaders of ally or partner nations may engage with each other for the purpose of promoting the peaceful, responsible, and safe use of civil nuclear technologies; and</text></paragraph><paragraph id="id9646eb81d36e408c892305a14b4f8174"><enum>(2)</enum><text>facilitate—</text><subparagraph id="id77C352814D684AC09B9E72CBDBA7FAB7"><enum>(A)</enum><text>the development of—</text><clause id="id1a42c6c8a7ec45d9ae221fd0d89a05ad"><enum>(i)</enum><text>cooperative financing relationships to promote competitive alternatives to Chinese and Russian financing;</text></clause><clause id="idf215c2776b7348ebbb7f32965c3e5e84"><enum>(ii)</enum><text>a standardized financing and project management framework for the construction of nuclear power plants;</text></clause><clause id="id05a81f0811c14a3592fcb5239499f142"><enum>(iii)</enum><text>a standardized licensing framework for civil nuclear technologies;</text></clause><clause id="id0d090364bcdf4ece8ae1c49a031dd321"><enum>(iv)</enum><text>a strategy to change internal policies of multinational development banks, such as the World Bank, to support the financing of civil nuclear projects;</text></clause><clause id="idE78F6E16FF7847EE825990CCAED0071A"><enum>(v)</enum><text>a document containing any lessons learned from countries that have partnered with the Russian Federation or the People’s Republic of China with respect to nuclear power, including any detrimental outcomes resulting from that partnership; and</text></clause><clause id="id4505BDAA03564AB299FBDA56A261F996"><enum>(vi)</enum><text>a global nuclear liability regime;</text></clause></subparagraph><subparagraph id="id8864525A9BE54459993AF0FB42224E53"><enum>(B)</enum><text>cooperation for enhancing the overall aspects of civil nuclear power, such as—</text><clause id="idE3C37C921F4C4D598CDE4B280514B263"><enum>(i)</enum><text>nuclear safety, security, and safeguards; </text></clause><clause id="idC640EF025B454C89892F5A6B82EB653E"><enum>(ii)</enum><text>nuclear laws (including regulations); </text></clause><clause id="idC683DD4C600D4F5EABD70004810E9AD8"><enum>(iii)</enum><text>waste management; </text></clause><clause id="id9BA57D21417D46CDAA1F348783272924"><enum>(iv)</enum><text>quality management systems; </text></clause><clause id="id0F3FBD4B4B8C42D3814DA8DA37A7FE01"><enum>(v)</enum><text>technology transfer; </text></clause><clause id="idA66BDEE43A8B4CCEB9E091FCC75FCC05"><enum>(vi)</enum><text>human resources development; </text></clause><clause id="idEDFFB14A8C634545B3D3058E30229C2E"><enum>(vii)</enum><text>localization;</text></clause><clause id="idA826707DCFD542E785434D747489180B"><enum>(viii)</enum><text>reactor operations; </text></clause><clause id="id9A1C4954AAF24499B26A0340DF6EA041"><enum>(ix)</enum><text>nuclear liability; and</text></clause><clause id="idF7FE9666842A4354987A6782E43E6294"><enum>(x)</enum><text>decommissioning; and </text></clause></subparagraph><subparagraph id="idDED91AA73E954F6E8BE9C03A5222B24F"><enum>(C)</enum><text>the development and determination of the mechanisms described in paragraphs (7) and (8) of section 11.</text></subparagraph></paragraph></subsection><subsection id="id211c7452acfc4817932f2ef4790af88e"><enum>(d)</enum><header>Report</header><paragraph id="id3ede741cffd94e9bb0b52ce8eb5af5bd"><enum>(1)</enum><header>In general</header><text>Not later than 120 days after the end of each summit, the Secretary, the Secretary of State, the Secretary of Commerce, the President of the Export-Import Bank of the United States, the Chief Executive Officer of the United States International Development Finance Corporation, and the Assistant shall jointly submit to Congress a report highlighting—</text><subparagraph id="id4f0a20c1fdc448a09e57b4a04a8b7c63"><enum>(A)</enum><text>any commitments made by the United States or international partners of the United States, including an ally or partner nation, with respect to international civil nuclear export practices; and</text></subparagraph><subparagraph id="id03e42916dc2545eaa0731a4228ce5dfb"><enum>(B)</enum><text>the objectives that the parties to those commitments agreed to meet.</text></subparagraph></paragraph><paragraph id="id46fefe731a0f48adb49ecb1627181030"><enum>(2)</enum><header>Requirement</header><text>The report under paragraph (1) shall detail—</text><subparagraph id="idaa14437148f344c4b2177c4722becc68"><enum>(A)</enum><text>any steps taken to establish common financing relationships;</text></subparagraph><subparagraph id="id82bd5f81c5794b30836dc8d198072c6c"><enum>(B)</enum><text>any progress made toward establishing a standardized financing, project management, and licensing framework;</text></subparagraph><subparagraph id="id37038e43860e47c0b7cf5b01ebcec280"><enum>(C)</enum><text>any changes to the internal policies of multinational development banks, such as the World Bank, to support civil nuclear projects;</text></subparagraph><subparagraph id="id5148705c282d4245ba63cb40a64d9708"><enum>(D)</enum><text>any steps taken or needed to be taken—</text><clause id="ide3527b02c56d42939200c81d44f67c3a"><enum>(i)</enum><text>to rectify any obstacles that were identified after the applicable civil nuclear vendor summit but were unforeseen at the time of, and not discussed at, that summit;</text></clause><clause id="id8bd2bed051ed4f2fbcccff5eaa820930"><enum>(ii)</enum><text>to enable early-stage day-to-day support of embarking civil nuclear energy nations;</text></clause><clause id="id5a5ac5abfd6745089abe3239416bbd09"><enum>(iii)</enum><text>to address any gaps in the whole-of-government approach to international civil nuclear cooperation, exports, and investment developed by the Assistant; or</text></clause><clause id="id409b7ed2b17b417e9e0b74cddaf41fe9"><enum>(iv)</enum><text>to improve the role of the Assistant in international outreach;</text></clause></subparagraph><subparagraph id="id8bb06e1b399341da88a22d39a56f0d2f"><enum>(E)</enum><text>the role of the nuclear industry in establishing cooperative relationships; and</text></subparagraph><subparagraph id="idE3C96004A3394D25BC885C9846EDF0FE"><enum>(F)</enum><text>the competitiveness of available United States financing packages for civil nuclear exports, relative to international competitors.</text></subparagraph></paragraph></subsection></section><section id="id988fdc8276a64b3c874e9751b5d02f65"><enum>13.</enum><header>Strategic Infrastructure Fund Working Group</header><subsection id="id1a1d98a2eb23456f8287b6fc9e18ef93"><enum>(a)</enum><header>Establishment</header><text>There is established a working group, to be known as the <quote>Strategic Infrastructure Fund Working Group</quote> (referred to in this section as the <term>working group</term>).</text></subsection><subsection id="idec3a74f7864946699006727bdc4e4186"><enum>(b)</enum><header>Composition</header><text>The working group shall be—</text><paragraph id="id3FC3C0FF131A4857A289F6E76B9612AE"><enum>(1)</enum><text>led by the Assistant; and</text></paragraph><paragraph id="id18FA27527C674717BD967E954AF6ABF3"><enum>(2)</enum><text>composed of—</text><subparagraph id="id253B32C724314F75B7E3667792B8BB52"><enum>(A)</enum><text>senior-level Federal officials, selected by the head of the applicable Federal agency or organization, from—</text><clause id="id8ef375305ac34ef182d86148e8d265be"><enum>(i)</enum><text>the Department of State;</text></clause><clause id="id1F67D594CF83454E9E19CD8522AD132E"><enum>(ii)</enum><text>the Department of the Treasury;</text></clause><clause id="idf5f6cd24dc1b47bb81e4377ff6cfe56c"><enum>(iii)</enum><text>the Department of Commerce;</text></clause><clause id="idb668845bb3c94cc0a7a17302e14f687c"><enum>(iv)</enum><text>the Department of Energy;</text></clause><clause id="id15de1822361a4e82ae4b9e71c0f718ee"><enum>(v)</enum><text>the Export-Import Bank of the United States;</text></clause><clause id="id0ba8276c4666405db85283776da6e95f"><enum>(vi)</enum><text>the United States International Development Finance Corporation; and</text></subparagraph><subparagraph id="idC68AA80132B24AFCAA6844960621354C" commented="no"><enum>(C)</enum><text>any senior-level Federal official selected by the Assistant from any Federal agency or organization.</text></subparagraph></paragraph></subsection><subsection id="id6bf0c2ea4e00473bb4ca055298eceb97"><enum>(c)</enum><header>Reporting</header><text>The working group shall report to the National Security Council.</text></subsection><subsection id="iddf84b3f2796446cebd842c2477d0e6a0"><enum>(d)</enum><header>Duties</header><text>The working group shall—</text><paragraph id="idf592aff8f5884d14a2f47cb62ec37edf"><enum>(1)</enum><text>provide direction and advice to the Assistant with respect to the establishment of a Strategic Infrastructure Fund (referred to in this subsection as the <term>Fund</term>) to be used—</text><subparagraph id="id5522CA35515B4A85B7B1524ABE531E1D"><enum>(A)</enum><text>to support those aspects of projects relating to—</text><clause id="idA0185DA084894361B483546BB78FFD52"><enum>(i)</enum><text>civil nuclear technologies; </text></clause><clause id="idD9864DA9F3E145B7913C7D24A0C8336B"><enum>(ii)</enum><text>rare earth elements and critical minerals (as defined in section 7002(a) of the Energy Act of 2020 (<external-xref legal-doc="usc" parsable-cite="usc/30/1606">30 U.S.C. 1606(a)</external-xref>)); and</text></clause><clause id="idF5E9922875404CCD8228F66E4E948C67"><enum>(iii)</enum><text>microprocessors; and</text></clause></subparagraph><subparagraph id="idF5F48B76CE33479E9E660D800B66C57C" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text>for strategic investments identified by the working group; and</text></subparagraph></paragraph><paragraph id="ide9f91f046fd540f0b6873a29d22bf29e"><enum>(2)</enum><text>address critical areas in determining the appropriate design for the Fund, including—</text><subparagraph id="id294e04382f18443e8565e365b4d138b1"><enum>(A)</enum><text>transfer of assets to the Fund;</text></subparagraph><subparagraph id="id4e8c7ab9b62340fc8929962c24b3e0a8"><enum>(B)</enum><text>transfer of assets from the Fund;</text></subparagraph><subparagraph id="id6929e253e6cc4f078b527f8455d3eccf"><enum>(C)</enum><text>how assets in the Fund should be invested; and</text></subparagraph><subparagraph id="id160d1eb4eae1476d8277b348f4dd28d8"><enum>(D)</enum><text>governance and implementation of the Fund.</text></subparagraph></paragraph></subsection><subsection id="id3D082B5E3D3E45C0BDB875BCCE422067"><enum>(e)</enum><header>Report required</header><paragraph id="idFFF79F78B3D9472C8DE1E4F52151FA23"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the date of the enactment of this Act, the working group shall submit to the committees described in paragraph (2) a report on the findings of the working group that includes suggested legislative text for how to establish and structure a Strategic Infrastructure Fund.</text></paragraph><paragraph id="id05298741438c47958b911ac75ae47f44"><enum>(2)</enum><header>Committees described</header><text>The committees referred to in paragraph (1) are—</text><subparagraph id="idEAE155F2F0444F45BF2151FE4C4AB5DB"><enum>(A)</enum><text>the Committee on Foreign Relations, the Committee on Commerce, Science, and Transportation, the Committee on Armed Services, the Committee on Energy and Natural Resources, the Committee on Environment and Public Works, and the Committee on Finance of the Senate; or</text></clause><clause id="id6be0c3f15a44406fb4ad84bc500e5828"><enum>(iii)</enum><text>any country that—</text><subclause id="id9fc38fedabc44ce0870676874fdeb8c0"><enum>(I)</enum><text>the Secretary of the Treasury designates as a covered country in a report to the Committee on Banking, Housing, and Urban Development of the Senate and the Committee on Financial Services of the House of Representatives;</text></subclause><subclause id="id9f9197f51302401183be2542c9664e4d"><enum>(II)</enum><text>is not a participant in the Arrangement; and</text></subclause><subclause id="id35dba97aeba14682b51f2c9a34274d93"><enum>(III)</enum><text>is not in substantial compliance with the financial terms and conditions of the Arrangement.</text></subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id461ffaf3f5304fcfa6b930f607f09e52"><enum>(2)</enum><header>Conforming amendment</header><text>Section 8(l) of the Export-Import Bank Act of 1945 (<external-xref legal-doc="usc" parsable-cite="usc/12/635g">12 U.S.C. 635g(l)</external-xref>) is amended—</text><subparagraph id="id3b68ff7d5096469b8ab7e5b6cb73a864"><enum>(A)</enum><text>in the subsection heading, by striking <quote><header-in-text style="OLC" level="subsection">Under the</header-in-text></quote> and all that follows through <quote><header-in-text style="OLC" level="subsection">Exports</header-in-text></quote> and inserting <quote><header-in-text style="OLC" level="subsection">Under the Program on Transformational Exports</header-in-text></quote>; and</after-quoted-block></quoted-block></paragraph><paragraph id="id3a8d6c468181460eb91a7aa369a0deb6"><enum>(5)</enum><text>in subsection (e)(2), in the matter preceding subparagraph (A), by striking <quote>China is</quote> and inserting <quote>the People’s Republic of China and the Russian Federation are</quote>.</text></paragraph></subsection></section><section id="id47FEC9F2C60C48ADA5135FA1A9F00909"><enum>16.</enum><header>U.S. nuclear fuels security initiative to reduce reliance on nuclear fuels from Russia and China</header><subsection id="idd699240e7c164e238e8e75e895018dfb"><enum>(a)</enum><header>Objectives</header><text>The objectives of this section are—</text><paragraph id="idae1bf19d476a4b2390b9e94225b82345"><enum>(1)</enum><text>to expeditiously increase domestic production of low-enriched uranium (referred to in this section as <term>LEU</term>) by an annual amount determined by the Secretary to be appropriate to reduce the reliance of the United States and ally or partner nations on nuclear fuels from—</text><subparagraph id="idC3FA7E993EBA445AB1205A44A14FE738"><enum>(A)</enum><text>the Russian Federation; and</text></subparagraph><subparagraph id="idAAEE0B2D7CED4450B1198A97ACD9EA47" commented="no"><enum>(B)</enum><text>the People’s Republic of China;</text></subparagraph></paragraph><paragraph id="id107341fc1a0f4cf5ab3a9bfccf39e5a6"><enum>(2)</enum><text>to expeditiously increase domestic production of high-assay low-enriched uranium (referred to in this section as <term>HALEU</term>) by an annual amount determined by the Secretary to be sufficient to meet the needs of the consortium established under section 2001(a)(2)(F) of the Energy Policy Act of 2020 (<external-xref legal-doc="usc" parsable-cite="usc/42/16281">42 U.S.C. 16281(a)(2)(F)</external-xref>);</text></paragraph><paragraph id="idd5715486c8f54516a1a65eeaddbb4ecf"><enum>(3)</enum><text>to ensure the availability of domestically produced and converted uranium in an amount determined by the Secretary to be sufficient to address a reasonably anticipated supply disruption;</text></paragraph><paragraph id="id7020f23bf8954ca0a36ddc37257e128e"><enum>(4)</enum><text>to promote the domestic production, conversion, and enrichment of uranium; and</text></paragraph><paragraph id="idef18b00cb78b44c5a1159dd2191f0ae8"><enum>(5)</enum><text>to promote the deployment of United States uranium enrichment technology.</text></paragraph></subsection><subsection id="id49C8E322DD1B42FDAAC95DACA72A8582"><enum>(b)</enum><header>Definition of Programs</header><text>In this section, the term <term>Programs</term> means—</text><paragraph id="idEC522984B5F148C98E9A25F548283236"><enum>(1)</enum><text>the Nuclear Fuel Security Program established under subsection (c)(1);</text></paragraph><paragraph id="id48CEF3B4749F44E187B0198A4F751071"><enum>(2)</enum><text>the National Strategic Uranium Reserve Program established under subsection (c)(2); and</text></paragraph><paragraph id="idFD6484AD3F334F2186C215122CE7475A"><enum>(3)</enum><text>the American Assured Fuel Supply Program of the Department of Energy.</text></paragraph></subsection><subsection id="id18945e50f5464b7687cce7fa11a4bed7"><enum>(c)</enum><header>Establishment</header><text>The Secretary, consistent with the objectives described in subsection (a), shall establish—</text><paragraph id="id4c4fe48324904e0e893c7af25833d911"><enum>(1)</enum><text>a program, to be known as the <quote>Nuclear Fuel Security Program</quote>, to reduce the reliance of the United States and ally or partner nations on nuclear fuels from the Russian Federation and the People’s Republic of China by increasing the amounts of LEU and HALEU produced by U.S. nuclear energy companies; and</text></paragraph><paragraph id="idb51d8a83d261459ab67097cd60249a03"><enum>(2)</enum><text>a program, to be known as the <quote>National Strategic Uranium Reserve Program</quote>, to ensure the availability of domestically produced and converted uranium in the event of a supply disruption. </text></paragraph></subsection><subsection id="id59f4800bdd434f8eb0b1ef125a0ebed4"><enum>(d)</enum><header>Nuclear Fuel Security Program</header><text>In carrying out the Nuclear Fuel Security Program, the Secretary shall—</text><paragraph id="idf3bec8af29b840a68b803f0a26325efe"><enum>(1)</enum><text>not later than 1 year after the date of enactment of this Act, select 1 or more U.S. nuclear energy companies to produce LEU in amounts and timeframes specified by the Secretary;</text></paragraph><paragraph id="id0adf88fbe71248279a95985e8bc61a6d"><enum>(2)</enum><text>not later than 1 year after the date of enactment of this Act, select 1 or more U.S. nuclear energy companies to produce HALEU in amounts and timeframes specified by the Secretary;</text></paragraph><paragraph id="id2063d620bdec47b78857240ec6b3c960"><enum>(3)</enum><text>utilize only uranium produced and converted in the United States or a country described in any of subparagraphs (A) through (H) of section 2(2);</text></paragraph><paragraph id="ida96fe8b7eb2c4e41856e47d4377ffd2b"><enum>(4)</enum><text>coordinate the operations of the Nuclear Fuel Security Program and the National Strategic Uranium Reserve Program as the Secretary determines to be appropriate; and</text></paragraph><paragraph id="idfdea7762c6c7410aa05af9412963a389"><enum>(5)</enum><text>take other actions that the Secretary determines to be necessary or appropriate to reduce the reliance of the United States and ally or partner nations on nuclear fuels from the Russian Federation and the People’s Republic of China. </text></paragraph></subsection><subsection id="idf2566167d26c4991ad6bd31fb297a6a8"><enum>(e)</enum><header>National Strategic Uranium Reserve Program</header><paragraph id="idBF730AA31B4C4589B5BE021CF6FAD1DA"><enum>(1)</enum><header>In general</header><text>In carrying out the National Strategic Uranium Reserve Program, the Secretary shall—</text><subparagraph id="id522adc77497c48de8ad3ce3439faa1a5"><enum>(A)</enum><text>immediately on enactment of this Act, use the funds reallocated by paragraph (2) to initiate the establishment of a National Strategic Uranium Reserve;</text></subparagraph><subparagraph id="id26bc0020332f433c9fafdac39d5132ac"><enum>(B)</enum><text>make the National Strategic Uranium Reserve operational by acquiring uranium in amounts and timeframes specified by the Secretary;</text></subparagraph><subparagraph id="id7d409b2752a84b679cbf0c322f274be5"><enum>(C)</enum><text>maintain, replenish, or increase the amount of uranium in the National Strategic Uranium Reserve in a manner determined by the Secretary to be consistent with the objectives described in subsection (a);</text></subparagraph><subparagraph id="id20de6b6171e14be38a3dfe73959eb0ae"><enum>(D)</enum><text>utilize only uranium produced and converted in the United States;</text></subparagraph><subparagraph id="id0f1d339c50e44bc094fa4932c62940ab"><enum>(E)</enum><text>make uranium available from the National Strategic Uranium Reserve, subject to terms and conditions determined by the Secretary to be reasonable and appropriate;</text></subparagraph><subparagraph id="idaeb5e03a34724070b75cf7fa5f9b8cdb"><enum>(F)</enum><text>coordinate the operations of the Nuclear Fuel Security Program and the National Strategic Uranium Reserve Program as the Secretary determines to be appropriate; and</text></subparagraph><subparagraph id="id390cf4628c364c0b8222fbc97c60e6d5"><enum>(G)</enum><text>take other actions that the Secretary determines to be necessary or appropriate to address a uranium supply disruption.</text></subparagraph></paragraph><paragraph id="ida00cd3a669c84498b29efb87a5d6782f"><enum>(2)</enum><header>Reallocation</header><text>Notwithstanding any other provision of law, amounts made available to the National Nuclear Security Administration for the Uranium Reserve Program by, and described in the first proviso in, the matter under the heading <quote><header-in-text style="OLC" level="appropriations-intermediate">weapons activities</header-in-text></quote> under the heading <quote><header-in-text style="OLC" level="appropriations-major">National Nuclear Security Administration</header-in-text></quote> under the heading <quote><header-in-text style="OLC" level="appropriations-major">atomic energy defense activities</header-in-text></quote> in title III of division D of the Consolidated Appropriations Act, 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/116/260">Public Law 116–260</external-xref>; 134 Stat. 1369), that remain available as of the date of enactment of this Act shall be reallocated, as directed by the Secretary, for the purpose of establishing and initiating operation of the National Strategic Uranium Reserve by—</text><subparagraph id="idc8f69ea78c7142d1a0417cc35c755e47"><enum>(A)</enum><text>continuing the activities initiated by the National Nuclear Security Administration using the amounts described in that proviso;</text></subparagraph><subparagraph id="id0dac3e3abe044e6da9fb8e235bfa3d5a"><enum>(B)</enum><text>carrying out other activities consistent with the purposes for which those amounts were made available under that Act; and</text></subparagraph><subparagraph id="idb7cf5840ee9f4ebb869b970b8b86c604"><enum>(C)</enum><text>carrying out activities in accordance with the objectives described in subsection (a). </text></subparagraph></paragraph></subsection><subsection id="id8bde158d08b74658a6f9b8ea7fe1e639"><enum>(f)</enum><header>Continuation of the American Assured Fuel Supply Program</header><text>In carrying out the American Assured Fuel Supply Program, the Secretary shall—</text><paragraph id="id9980a9b5642241178ba77dab941b2957"><enum>(1)</enum><text>maintain, replenish, or increase the amount of uranium in the National Strategic Uranium Reserve in a manner determined by the Secretary to be consistent with the purposes of that program and the objectives described in subsection (a);</text></paragraph><paragraph id="id8a90239d93f44022a96e04b373a97ebe"><enum>(2)</enum><text>make uranium available from the American Assured Fuel Supply, subject to terms and conditions determined by the Secretary to be reasonable and appropriate;</text></paragraph><paragraph id="id21639dbab6e44b16951f366e2b68e0df"><enum>(3)</enum><text>coordinate the operations of the National Strategic Uranium Reserve Program and the American Assured Fuel Supply Program as the Secretary determines to be appropriate;</text></paragraph><paragraph id="idf00bb49a3300449093028f0366dd8d01"><enum>(4)</enum><text>if determined by the Secretary to be appropriate and consistent with the objectives described in subsection (a), merge the operations of the National Strategic Uranium Reserve Program and the American Assured Fuel Supply Program; and</text></paragraph><paragraph id="id640b687e630d4cf98c0a3f4a5b283289"><enum>(5)</enum><text>take other actions that the Secretary determines to be necessary or appropriate to address the purposes of the American Assured Fuel Supply Program and the objectives described in subsection (a). </text></paragraph></subsection><subsection id="idc4b23d8a27f24f11bff0cdcccf032ab2"><enum>(g)</enum><header>Authority</header><paragraph id="id7A3970CF9EB5439D8F414D9EF151B56E"><enum>(1)</enum><header>In general</header><text>In carrying out the Programs, the Secretary, in coordination with the Secretary of State, may—</text><subparagraph id="iddd91f41528fd41d8a855c8baa6bcfa8e"><enum>(A)</enum><text>in addition to exercising the authority granted to the Secretary under any other provision of law, enter into transactions (other than contracts, cooperative agreements, financial assistance agreements, or the provision of any other financial assistance) with an ally or partner nation, a U.S. energy company, or any other domestic or foreign entity for any activity to carry out the Programs, including the acquisition or provision of uranium, conversion services, enrichment services, LEU, HALEU, and related goods and services, in the same manner as the Secretary of Defense under section 4021 of title 10, United States Code (other than subsections (b) and (f) of that section);</text></subparagraph><subparagraph id="id54ac430ab7f94bd5b39efd488260f201"><enum>(B)</enum><text>make acquisitions for the Programs through the use of competitive selection processes that the Secretary determines to be appropriate to achieve the objectives described in subsection (a) in an expeditious manner;</text></subparagraph><subparagraph id="id16fb46628eed4508b2d7851c7eeb5b91"><enum>(C)</enum><clause commented="no" display-inline="yes-display-inline" id="id48B6F61AE52B4636BD20AEED50D14219"><enum>(i)</enum><text>establish milestones for achieving specified objectives, including the production of LEU and HALEU in amounts and timeframes specified by the Secretary; and </text></clause><clause id="idB1AAF367736144A6AC12B207C23C2636" indent="up1"><enum>(ii)</enum><text>provide awards and other forms of incentives for meeting those milestones;</text></clause></subparagraph><subparagraph id="ide804a62b578049009e627343d4f638ef"><enum>(D)</enum><text>provide loan guarantees, other financial assistance, or assistance in the form of revenue guarantees or similar mechanisms;</text></subparagraph><subparagraph id="id4714ba4e486d47f4b6c4fe353d6d6c63"><enum>(E)</enum><text>charge an amount for the provision of uranium, conversion services, enrichment services, LEU, HALEU, and other goods and services that, in the opinion of the Secretary, provides reasonable compensation, taking into account fair market value and the objectives described in subsection (a); and</text></subparagraph><subparagraph id="id454835302DE845B38AEAE0EBFEDE5B0B"><enum>(F)</enum><text>notwithstanding section 3302 of title 31, United States Code—</text><clause id="id8610A0809F5949039E5967C216C7E5A5"><enum>(i)</enum><text>receive and retain revenues from the sale or transfer of uranium, LEU, or HALEU and from other activities related to the Programs; and </text></clause><clause id="id1052D1ABD5114E8FA4E6D6B68F81566E"><enum>(ii)</enum><text>expend those revenues for purposes related to the program from which the revenues are derived.</text></clause></subparagraph></paragraph><paragraph id="id18FFA7FD5A454F4FBAD839A029F882C1"><enum>(2)</enum><header>Availability of funds</header><text>The revenues described in paragraph (1)(F) shall remain available until expended.</text></paragraph></subsection><subsection id="idA959DF4AC3144F9AB714797382BE1253"><enum>(h)</enum><header>Domestic sourcing considerations</header><paragraph id="idB91AA1F1600B4060B732C74A84C613C0"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), the Secretary may only carry out an activity in connection with 1 or more of the Programs if—</text><subparagraph id="id79F354FD636943E09EBDA061D5F8DC29"><enum>(A)</enum><text>the activity promotes manufacturing in the United States; or</text></subparagraph><subparagraph id="id614BD95B3AED4D7E8C30B52D6A1990C9"><enum>(B)</enum><text>the activity relies on resources, materials, or equipment developed or produced—</text><clause id="id88744620B596489EA495B9068B4CD37E"><enum>(i)</enum><text>in the United States; or</text></clause><clause id="id86FCF22F94E542C29E02896869314E61" commented="no"><enum>(ii)</enum><text>in a country described in any of subparagraphs (A) through (H) of section 2(2) by—</text><subclause commented="no" id="id4641B6535DD147E4AAA7E90BD8310E61"><enum>(I)</enum><text>a U.S. nuclear energy company;</text></subclause><subclause id="id72FA00EB3CC94B309379BE90B230087F"><enum>(II)</enum><text>an ally or partner nation; or</text></subclause><subclause id="id22A1CA30C23546C585198C7B8C3B49AA" commented="no"><enum>(III)</enum><text>an associated entity.</text></subclause></clause></subparagraph></paragraph><paragraph id="id637CA783EB72450688D6733514D1738C"><enum>(2)</enum><header>Waiver</header><text>The Secretary may waive the requirements of paragraph (1) with respect to an activity if the Secretary determines a waiver to be necessary to achieve 1 or more of the objectives described in subsection (a). </text></paragraph></subsection><subsection id="id485686687ac54aa88c9ef8905b8429a7"><enum>(i)</enum><header>Exclusions</header><text>The Secretary may not carry out an activity in connection with the Programs with an entity that is—</text><paragraph id="id226a8f15642146f387dac04e28b09a12"><enum>(1)</enum><text>owned or controlled by the Government of the Russian Federation or the Government of the People’s Republic of China; or</text></paragraph><paragraph id="id5734003d207f4769ad116a2b17e20b7f"><enum>(2)</enum><text>organized under the laws of, or otherwise subject to the jurisdiction of, the Russian Federation or the People’s Republic of China. </text></paragraph></subsection><subsection id="id6c5a65911e9644988bbda6893f2f47fa"><enum>(j)</enum><header>Nuclear regulatory commission</header><text>The Nuclear Regulatory Commission shall prioritize and expedite consideration of any action related to the Programs to the extent permitted under the <act-name parsable-cite="AEA54">Atomic Energy Act of 1954</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/2011">42 U.S.C. 2011 et seq.</external-xref>) and related statutes.</text></subsection><subsection id="idF54FF528FC4540529ED63892A9FF1BE0"><enum>(k)</enum><header>USEC Privatization Act</header><paragraph id="idd3dbf5806f804f0dada37cfbf2fb0504"><enum>(1)</enum><header>In general</header><text>The requirements of section 3112 of the USEC Privatization Act (<external-xref legal-doc="usc" parsable-cite="usc/42/2297h-10">42 U.S.C. 2297h–10</external-xref>) shall not apply to activities related to the Programs.</text></paragraph><paragraph id="id94f63ae3dae94b828ccac44aba32765c"><enum>(2)</enum><header>Amendment</header><text>Section 3112A(c)(2)(A) of the USEC Privatization Act (42 U.S.C. 2297h–10a(c)(2)(A)) is amended—</text><subparagraph id="id0257B7132E5B405D9CE0A46366E2BFE1"><enum>(A)</enum><text>in clause (xii), by inserting <quote>and</quote> after the semicolon at the end;</text></subparagraph><subparagraph id="id54BB484A661F4B49817293716C02B6E6"><enum>(B)</enum><text>by striking clauses (xiii) through (xxvii); and</text></subparagraph><subparagraph id="id1FF1DC79AC204C84AF445F1E81A49A59"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idAE2D17AAE5AF4880BBD10BA81C8C67C4"><clause id="idDBD3DBF2A3D142B0AD3F647927895EE6"><enum>(xiii)</enum><text>in calendar year 2026 and each calendar year thereafter, 0 kilograms.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="id4f3fa1d5b83348598d9dfd4123c7c60e"><enum>(l)</enum><header>Authorization of appropriations</header><text>In addition to amounts otherwise available, there are authorized to be appropriated to the Secretary—</text><paragraph id="idc2410f6f4e5f40588542d64f4c1a0c05"><enum>(1)</enum><text>for the Nuclear Fuel Security Program, $3,500,000,000 for fiscal year 2023, to remain available until September 30, 2031; and</text></paragraph><paragraph id="id4fea3a6714244659a276f462a786be84"><enum>(2)</enum><text>for the National Strategic Uranium Reserve Program and the American Assured Fuel Supply Program, such sums as are necessary for the period of fiscal years 2023 through 2030, to remain available until September 30, 2031.</text></paragraph></subsection></section></legis-body></bill>
