<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>2d Session</session><legis-num>S. 4059</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20220407">April 7, 2022</action-date><action-desc><sponsor name-id="S153">Mr. Grassley</sponsor> (for himself, <cosponsor name-id="S253">Mr. Durbin</cosponsor>, and <cosponsor name-id="S311">Ms. Klobuchar</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSFR00">Committee on Foreign Relations</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require the Secretary of Defense to replace equipment provided to Ukraine by certain member countries of the North Atlantic Treaty Organization.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Replacement of defense equipment, support capabilities, and articles provided to Ukraine by certain member countries of the North Atlantic Treaty Organization</header><subsection id="id44A0607DA5D74B018D3C6EB4FBEFC3D2"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to subsection (d), as soon as practicable, the Secretary of Defense shall, pursuant to the authority provided in the Arms Export Control Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2751">22 U.S.C. 2751 et seq.</external-xref>), section 362 of title 10, United States Code, and the Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2151">22 U.S.C. 2151 et seq.</external-xref>), transfer to covered NATO allies equipment, defense support capabilities, and relevant defense articles that have been authorized, procured, and contracted by, and are available to, the Department of Defense.</text></subsection><subsection id="id8AD317139C5A4928B3D6281DC246BB16"><enum>(b)</enum><header>Purpose</header><text display-inline="yes-display-inline">The purpose of the transfers required by subsection (a) is to replace equipment provided by covered NATO allies to Ukraine during the covered period to defend Ukraine against aggression and other malign influence by the Russian Federation.</text></subsection><subsection id="id9065E2F09EC54CE8B455928D44BD978C"><enum>(c)</enum><header>Inclusions</header><text display-inline="yes-display-inline">The equipment, defense support capabilities, and relevant defense articles referred to in subsection (a) shall include— </text><paragraph id="id8E618F97E2A54935B2F7B8D0A417EF96"><enum>(1)</enum><text display-inline="yes-display-inline">air defense systems;</text></paragraph><paragraph id="id2D2A7B0C0101472499C8377F6CE04F63"><enum>(2)</enum><text>unmanned aerial vehicles;</text></paragraph><paragraph id="id50897C0D880945D1B6C0FDE024B66604"><enum>(3)</enum><text>anti-ship missiles; </text></paragraph><paragraph id="id6702ED30F0544A49B056E58DF3C289C0"><enum>(4)</enum><text>military vehicles;</text></paragraph><paragraph id="id6A8B7240A3A64C7C9A65E4507C206771"><enum>(5)</enum><text>ammunition; and</text></paragraph><paragraph id="idE22025899AC94040828F2F1C6B23D8E0"><enum>(6)</enum><text>weapons.</text></paragraph></subsection><subsection id="id5F186CDDC4104010A06BB39AEBB043AC"><enum>(d)</enum><header>Consultation</header><text>Before making a transfer under subsection (a), the Secretary of Defense shall consult with the Secretary of State with respect to whether the transfer—</text><paragraph id="id1AF78672286A431C900C894528BA6E46"><enum>(1)</enum><text>aligns with United States foreign policy goals; and </text></paragraph><paragraph id="id5B7582DC8ED94F66AB9CB5643357E144" commented="no"><enum>(2)</enum><text>would result in any significant gap with respect to United States national security. </text></paragraph></subsection><subsection id="id9D85F1C36AD74B72B00E02528C82FF2A"><enum>(e)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="id9DC205DBD0744630B09F9FE8511AF323"><enum>(1)</enum><header>Covered NATO ally defined</header><text>The term <term>covered NATO ally</term> means any member country of the North Atlantic Treaty Organization with a gross domestic product per capita that is less than $30,000, as of April 1, 2022.</text></paragraph><paragraph id="id0FD41C1D8B4A493688FC0D69E2F4652A"><enum>(2)</enum><header>Covered period</header><text>The term <term>covered period</term> means the period beginning on January 1, 2022, and ending on the date on which military hostilities by the Russian Federation in Ukraine cease. </text></paragraph></subsection></section></legis-body></bill>
