which was read twice and referred to the <committee-name committee-id="SSGA00" added-display-style="italic" deleted-display-style="strikethrough">Committee on Homeland Security and Governmental Affairs</committee-name></action-desc></action><action stage="Reported-in-Senate"><action-date date="20220803">August 3, 2022</action-date><action-desc>Reported by <sponsor name-id="S380">Mr. Peters</sponsor>, with an amendment</action-desc><action-instruction>Strike out all after the enacting clause and insert the part printed in italic</action-instruction></action><legis-type>A BILL</legis-type><official-title>To develop a comprehensive, strategic plan for Federal electric vehicle fleet battery management, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one" changed="deleted" reported-display-style="strikethrough" committee-id="SSGA00"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Strategic EV Management Act of 2022</short-title></quote>.</text></section><section id="id2d44727972084b0f91d79da87dea8c9e" changed="deleted" reported-display-style="strikethrough" committee-id="SSGA00"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id9e5c14fd74d446cab93341f2d12819aa"><enum>(1)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of the General Services Administration.</text></paragraph><paragraph id="id9ED65ABBD1CB40D590CE54E6855C9EC0"><enum>(2)</enum><header>Agency</header><text>The term <term>agency</term> has the meaning given the term in section 551 of title 5, United States Code. </text></paragraph><paragraph id="id964be203a94449c0a43dae5f41d3343a"><enum>(3)</enum><header>Appropriate congressional committees</header><text>The term <term>appropriate congressional committees</term> means—</text><subparagraph id="id58d2fa38f73a40ffbb42bc59243f3048"><enum>(A)</enum><text>the Committee on Homeland Security and Governmental Affairs of the Senate; and</text></subparagraph><subparagraph id="idff45ce4f21364ccc80359e4f29ee1e36"><enum>(B)</enum><text>the Committee on Oversight and Reform of the House of Representatives. </text></subparagraph></paragraph><paragraph id="id59ac8059c3634731b8d7740e776b9c54"><enum>(4)</enum><header>Director</header><text>The term <term>Director</term> means the Director of the Office of Management and Budget.</text></paragraph></section><section id="id4a40e7a1618240db84b42b86752191bf" changed="deleted" reported-display-style="strikethrough" committee-id="SSGA00"><enum>3.</enum><header>Strategic guidance</header><subsection id="id6a91584a862e4febbcf47b56b5cb69e9"><enum>(a)</enum><header>In general</header><text>Not later than 2 years after the date of enactment of this Act, the Administrator, in consultation with the Director, shall coordinate with the heads of agencies to develop a comprehensive, strategic plan for Federal electric vehicle fleet battery management.</text></subsection><subsection id="id2612ba2199654f14a1f6435d729d6bd7"><enum>(b)</enum><header>Contents</header><text>The strategic plan required under subsection (a) shall—</text><paragraph id="idC47C256220374E828019CE4288B0B435"><enum>(1)</enum><text>seek to maximize both environmental and cost efficiencies; and</text></paragraph><paragraph id="idCE584227988E4D529383CCF7332435F8"><enum>(2)</enum><text>incorporate—</text><subparagraph id="id9bf308867d054f7c948864222e225379"><enum>(A)</enum><text>guidelines for optimal charging practices that will maximize battery longevity and prevent premature degradation; </text></subparagraph><subparagraph id="idb04f3f5a31b248d7ba08dfa7a4e2f737"><enum>(B)</enum><text>guidelines for reusing and recycling the batteries of retired vehicles; and</text></subparagraph><subparagraph id="ida262e1b6c3454bc7adb345f2d070a9ab"><enum>(C)</enum><text>any other considerations determined appropriate by the Administrator and Director.</text></subparagraph></paragraph></subsection><subsection id="id1a5606c8c9244c00ada4aa09e44d6a7c"><enum>(c)</enum><header>Modification</header><text>The Administrator, in consultation with the Director, may periodically modify the strategic plan required under subsection (a) as the Administrator and Director may determine necessary.</text></subsection><subsection id="id2ab8b149a7da4aeda9424a04448ac096"><enum>(d)</enum><header>Consultation</header><text>In developing the strategic plan required under subsection (a) the Administrator, in consultation with the Director, may consult with appropriate entities, including—</text><paragraph id="idE014C8A3D4BA41D88A59C5659BC4188A"><enum>(1)</enum><text>the Secretary of Energy; </text></paragraph><paragraph id="idF6AA0828F74942F39DE0434B0B74DC65"><enum>(2)</enum><text>the Chair of the Council on Environmental Quality;</text></paragraph><paragraph id="id6f3d5b985a3d4dfb912cb0f85fb33396"><enum>(3)</enum><text>scientists who are studying electric vehicle batteries and reuse and recycling solutions;</text></paragraph><paragraph id="id77d88725c7fe44ac982783f8bffd9a8c"><enum>(4)</enum><text>laboratories, companies, or start-ups engaged in battery use, reuse, and recycling research; </text></paragraph><paragraph id="idbafb0d4043c74bd5bba28c83fbe15f23"><enum>(5)</enum><text>industries interested in electric vehicle battery reuse and recycling; </text></paragraph><paragraph id="id9c2c6a235dc044909edc72e5b5fc5f70"><enum>(6)</enum><text>electric vehicle equipment manufacturers and recyclers; and</text></paragraph><paragraph id="id808c9a305962466b9a8ee5cc6e87fe7f"><enum>(7)</enum><text>any other relevant entities, as determined by the Administrator and Director.</text></paragraph></subsection><subsection id="id5bfedc0d059e485baf1f0383fdaf5fdc"><enum>(e)</enum><header>Report</header><paragraph id="ide999a1ee8a1e451880222d21700727c0"><enum>(1)</enum><header>In general</header><text>Not later than 3 years after the date of enactment of this Act, the Administrator and the Director shall submit to the appropriate congressional committees a report that describes the strategic plan required under subsection (a).</text></paragraph><paragraph id="id6fda2604831b46f994bfd36b283d5344"><enum>(2)</enum><header>Briefing</header><text>Not later than 4 years after the date of enactment of this Act, the Administrator and the Director shall brief the appropriate congressional committees on the implementation of the strategic plan required under subsection (a) across agencies. </text></paragraph></subsection></section></legis-body><legis-body display-enacting-clause="no-display-enacting-clause"><section id="id89777748-5cf7-42c2-9a02-008a80dc119d" section-type="section-one" changed="added" reported-display-style="italic" committee-id="SSGA00"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Strategic EV Management Act of 2022</short-title></quote>.</text></section><section id="idd64fd407-468f-46ad-9b8d-451a39a27e49" changed="added" reported-display-style="italic" committee-id="SSGA00"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="id960a8d2b-370b-421f-adef-dd43da1ffc13"><enum>(1)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of General Services.</text></paragraph><paragraph id="id62c5f9c6-7957-42d4-bc35-1e9c583739f8"><enum>(2)</enum><header>Agency</header><text>The term <term>agency</term> has the meaning given the term in section 551 of title 5, United States Code. </text></paragraph><paragraph id="id4add58c8-91b9-41c3-8f35-5bfe9c8b3481"><enum>(3)</enum><header>Appropriate congressional committees</header><text>The term <term>appropriate congressional committees</term> means—</text><subparagraph id="ida130b2ce-03b6-4af2-be21-3892e4ede08e"><enum>(A)</enum><text>the Committee on Homeland Security and Governmental Affairs of the Senate; and</text></subparagraph><subparagraph id="id02d0e7a7-9fb1-489a-84c7-1b4ddb1b57a6"><enum>(B)</enum><text>the Committee on Oversight and Reform of the House of Representatives. </text></subparagraph></paragraph><paragraph id="id8f8db399-33bc-4a0b-8eca-fd85d446a3a5"><enum>(4)</enum><header>Director</header><text>The term <term>Director</term> means the Director of the Office of Management and Budget.</text></paragraph></section><section id="id69adb46e-5966-4ce8-a0cb-00cd7495592c" changed="added" reported-display-style="italic" committee-id="SSGA00"><enum>3.</enum><header>Strategic guidance</header><subsection id="id387f8c57-2922-4372-a929-9ef8d1caed7e"><enum>(a)</enum><header>In general</header><text>Not later than 2 years after the date of enactment of this Act, the Administrator, in consultation with the Director, shall coordinate with the heads of agencies to develop a comprehensive, strategic plan for Federal electric vehicle fleet battery management.</text></subsection><subsection id="idc93302da-a24c-4821-b210-308825ea24b7"><enum>(b)</enum><header>Contents</header><text>The strategic plan required under subsection (a) shall—</text><paragraph id="ided921471-4779-4bbb-89d5-7eea49dd8319"><enum>(1)</enum><text>maximize both cost and environmental efficiencies; and</text></paragraph><paragraph id="id115a6a6e-b97b-421b-ace6-bdd1c3b74ece"><enum>(2)</enum><text>incorporate—</text><subparagraph id="id2aeced7c-e9f4-4f96-ad99-b89e84db7e57"><enum>(A)</enum><text>guidelines for optimal charging practices that will maximize battery longevity and prevent premature degradation; </text></subparagraph><subparagraph id="idaf4a5db1-d808-4d28-8b8d-a6a46cfa81e8"><enum>(B)</enum><text>guidelines for reusing and recycling the batteries of retired vehicles; and</text></subparagraph><subparagraph id="ide5bf00ef-74c0-4173-830d-73c190630d69"><enum>(C)</enum><text>any other considerations determined appropriate by the Administrator and Director.</text></subparagraph></paragraph></subsection><subsection id="id4402af6d-6725-408e-8590-a03b6173b7ec"><enum>(c)</enum><header>Modification</header><text>The Administrator, in consultation with the Director, may periodically update the strategic plan required under subsection (a) as the Administrator and Director may determine necessary based on new information relating to electric vehicle batteries that becomes available.</text></subsection><subsection id="id7ba2d7e2-3991-4a02-86e8-4f3cc28c1edd"><enum>(d)</enum><header>Consultation</header><text>In developing the strategic plan required under subsection (a) the Administrator, in consultation with the Director, may consult with appropriate entities, including—</text><paragraph id="id9bee16cd-42ec-415e-888f-404e3ace966e"><enum>(1)</enum><text>the Secretary of Energy; </text></paragraph><paragraph id="id4A436E251D6B430899E67E1BC3B2ACE9"><enum>(2)</enum><text>the Administrator of the Environmental Protection Agency;</text></paragraph><paragraph id="id1bc616ab-4fda-461a-a22f-2d676a169ce8"><enum>(3)</enum><text>the Chair of the Council on Environmental Quality;</text></paragraph><paragraph id="id3cf15902-08a2-4fe8-8a72-bcfc01761a95"><enum>(4)</enum><text>scientists who are studying electric vehicle batteries and reuse and recycling solutions;</text></paragraph><paragraph id="idbfcadc97-388e-4187-a174-a1455caba821"><enum>(5)</enum><text>laboratories, companies, colleges, universities, or start-ups engaged in battery use, reuse, and recycling research; </text></paragraph><paragraph id="id6fdd269b-6fd4-47fe-a3ec-2c02db9e9a03"><enum>(6)</enum><text>industries interested in electric vehicle battery reuse and recycling; </text></paragraph><paragraph id="ida0333b7e-eb48-4c9c-84e6-88d06db2f72b"><enum>(7)</enum><text>electric vehicle equipment manufacturers and recyclers; and</text></paragraph><paragraph id="id2988d5d1-cc58-453c-8a02-87ccc0ffddfc"><enum>(8)</enum><text>any other relevant entities, as determined by the Administrator and Director.</text></paragraph></subsection><subsection id="id08c83a5c-ce12-435c-ba09-81874afcb725"><enum>(e)</enum><header>Report</header><paragraph id="idf91f4729-9011-4d06-a04e-7289372bc3ef"><enum>(1)</enum><header>In general</header><text>Not later than 3 years after the date of enactment of this Act, the Administrator and the Director shall submit to the appropriate congressional committees a report that describes the strategic plan required under subsection (a).</text></paragraph><paragraph id="idcfc6c889-07a6-4af3-9702-b2d8c1a0d165"><enum>(2)</enum><header>Briefing</header><text>Not later than 4 years after the date of enactment of this Act, the Administrator and the Director shall brief the appropriate congressional committees on the implementation of the strategic plan required under subsection (a) across agencies. </text></paragraph></subsection></section><section id="idF66F98F707C442589BFA18A7127ADEAC" commented="no" display-inline="no-display-inline" section-type="subsequent-section" changed="added" reported-display-style="italic" committee-id="SSGA00"><enum>4.</enum><header display-inline="yes-display-inline">Study of Federal fleet vehicles</header><text display-inline="no-display-inline">Not later than 2 years after the date of enactment of this Act, the Comptroller General of the United States shall submit to Congress a report on how the costs and benefits of operating and maintaining electric vehicles in the Federal fleet compare to the costs and benefits of operating and maintaining internal combustion engine vehicles.</text></section></legis-body><endorsement><action-date date="20220803">August 3, 2022</action-date><action-desc>Reported with an amendment</action-desc></endorsement></bill>
