<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>2d Session</session><legis-num>S. 4056</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20220407">April 7, 2022</action-date><action-desc><sponsor name-id="S306">Mr. Menendez</sponsor> introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSHR00">Committee on Health, Education, Labor, and Pensions</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To promote youth athletic safety, and for other purposes.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Supporting Athletes, Families and Educators to Protect the Lives of Athletic Youth Act</short-title></quote> or the <quote><short-title>SAFE PLAY Act</short-title></quote>.</text></section><section id="id4be0b31ab1b94ef9ab0558ab40c97e62"><enum>2.</enum><header>Education, awareness, and training for pediatric cardiac conditions to increase earlier diagnosis and prevent sudden cardiac death</header><text display-inline="no-display-inline"> Part P of title III of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/280g">42 U.S.C. 280g et seq.</external-xref>) is amended by adding at the end the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="ide7efcbdd203148cc9c55d541b0a02288"><section id="id8a54a7420fb74a6db516bc690d8371a2"><enum>399V–7.</enum><header>Materials and educational resources to increase awareness of cardiomyopathy and other high-risk childhood cardiac conditions among school administrators, educators, school health professionals, coaches, students, and families</header><subsection id="id909627d7ae7248c784f5d626c4175a0a"><enum>(a)</enum><header>Materials and resources</header><text>Not later than 12 months after the date of enactment of the SAFE PLAY Act, the Secretary, acting through the Director of the Centers for Disease Control and Prevention (referred to in this section as the <quote>Director</quote>) and in consultation with national patient advocacy and health organizations with expertise in cardiac health and all forms of pediatric cardiomyopathy, shall develop educational materials and resources to be disseminated to school administrators, educators, school health professionals, coaches, students, families, and other appropriate individuals. The materials and resources shall include—</text><paragraph id="id88525a032dbb45089e7da1777043d2d6"><enum>(1)</enum><text>information on the signs, symptoms, and risk factors associated with high risk cardiac conditions and genetic heart rhythm abnormalities that may cause sudden cardiac arrest in children, adolescents, and young adults, including—</text><subparagraph id="id8C4928E3B04940C2B56FDE98851FCE5E"><enum>(A)</enum><text>cardiomyopathy;</text></subparagraph><subparagraph id="id7708BA4C856643FFB3C0CA1C6EC2E41C"><enum>(B)</enum><text>long QT syndrome, Brugada syndrome, catecholaminergic polymorphic ventricular tachycardia, short QT syndrome, Wolff-Parkinson-White syndrome; and</text></subparagraph><subparagraph id="id77ECC4EA68A741F6A2A102D4B94F11F6"><enum>(C)</enum><text>other high-risk cardiac conditions, as determined by the Secretary;</text></subparagraph></paragraph><paragraph id="id75ef212343d343d1b455a9b10d48477b"><enum>(2)</enum><text>sudden cardiac arrest risk assessment worksheets to help identify higher risk children and adolescents with possible life-threatening cardiac conditions who may need additional medical screening and treatment;</text></paragraph><paragraph id="iddd119faf27ab41cd8cae92d51ad058a2"><enum>(3)</enum><text>guidelines and training materials for schools, childcare centers, and local youth athletic organizations to handle cardiac emergencies, covering cardiopulmonary resuscitation (referred to in this section and section 399V–8 as <quote>CPR</quote>) and ways to obtain certification on CPR delivery; </text></paragraph><paragraph id="id030c5de1dbdf4446b9977e3ccd1bb767"><enum>(4)</enum><text>guidelines and training materials for schools, childcare centers, and local youth athletic organizations to handle cardiac emergencies, on the proper placement, usage, and maintenance of automatic external defibrillators (referred to in this section and section 399V–8 as <quote>AED</quote>) and ways to obtain certification on AED usage; and </text></paragraph><paragraph id="id9e26dfc97fa74ee99ad50463f9086310"><enum>(5)</enum><text>recommendations on developing and implementing a cardiac emergency response plan at schools, childcare centers, and local youth athletic organizations, including recommendations on how local educational agencies (as defined in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>)) can apply such response plans to students enrolled in public schools served by such local educational agencies.</text></paragraph></subsection><subsection id="id073e4277d192435eb1b11c18a2b4076d"><enum>(b)</enum><header>Development of materials and resources</header><text>The Secretary, acting through the Director, shall develop and update, as necessary and appropriate, the materials and resources described in subsection (a) and, in support of such effort, the Secretary is encouraged to establish an advisory panel that includes the following members:</text><paragraph id="id0d2726cda931496b98527f15776b2af2"><enum>(1)</enum><text>Representatives from national patient advocacy organizations, including—</text><subparagraph id="id76242CEB428F47BAB83C874FB3644C9B"><enum>(A)</enum><text>not less than 1 organization dedicated to promoting research, education, and awareness of all forms of pediatric cardiac cardiomyopathy;</text></subparagraph><subparagraph id="id65215BC7A0734BFC9FE846B70E891C22"><enum>(B)</enum><text>not less than 1 organization dedicated to research, and education, and awareness of high-risk cardiac conditions and genetic heart rhythm abnormalities;</text></subparagraph><subparagraph id="idDAC1C32D589444F3910A504D1B8C5459"><enum>(C)</enum><text>not less than 1 organization dedicated to school-based wellness; </text></subparagraph><subparagraph id="idF4AC8154DB7147458DA36291DB1CBB96"><enum>(D)</enum><text>not less than 1 organization dedicated to advocacy and support for individuals with cognitive impairments or developmental disabilities; and</text></subparagraph><subparagraph id="id5E55E9B4C37E4C549948EFBFC0EF377B"><enum>(E)</enum><text>not less than 1 organization dedicated to addressing minority health disparities. </text></subparagraph></paragraph><paragraph id="idb2706d0a0dc947b08ce1d4caa233c604"><enum>(2)</enum><text>Representatives of medical and health care professional societies, including pediatrics, cardiology, emergency medicine, and sports medicine.</text></paragraph><paragraph id="idebf7985c4d8549e59df3c1e156b0d1bf"><enum>(3)</enum><text>A representative of the Centers for Disease Control and Prevention.</text></paragraph><paragraph id="id31d7b291f4b3457298c1caf6b8b793bd"><enum>(4)</enum><text>Representatives of other relevant Federal agencies, including the Department of Education and the National Institutes of Health.</text></paragraph><paragraph id="idd23842bd377a4f1cad74ba8620e51ee6"><enum>(5)</enum><text>Representatives of schools, such as administrators, educators, sports coaches, and nurses.</text></paragraph></subsection><subsection id="id13f54533e7494e6db35845f3647d3962"><enum>(c)</enum><header>Dissemination of materials and resources</header><text>Not later than 24 months after the date of enactment of the SAFE PLAY Act, the Secretary, acting through the Director, shall disseminate the materials and resources described in subsection (a) in accordance with the following:</text><paragraph id="id2c399a6682084b9b8ba42b06cd8be987"><enum>(1)</enum><header>Distribution by local educational agencies</header><text>The Secretary shall make available such materials and resources to local educational agencies (as defined in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>)) to distribute—</text><subparagraph id="ida89ecfe232a34670bed6e05ca9aa9df6"><enum>(A)</enum><text>to school administrators, educators, school health professionals, coaches, students, and parents, guardians, or other caregivers, information on the signs, symptoms, and risk factors of high-risk cardiac conditions;</text></subparagraph><subparagraph id="idfb84efd52738426981b5bb6425a70a7a"><enum>(B)</enum><text>to parents, guardians, or other caregivers, the cardiomyopathy and sudden cardiac arrest risk assessment worksheets described in subsection (a)(2);</text></subparagraph><subparagraph id="idfa266787e6854223b003c40df8adfcb5"><enum>(C)</enum><text>to school administrators, school health professionals, and coaches—</text><clause id="id72dda111df2d49ccaf7d989a291dbf83"><enum>(i)</enum><text>the information and training materials described in subsection (a)(3); and</text></clause><clause id="id844d9a8369f94ebca9de79d18859700f"><enum>(ii)</enum><text>the guidelines and training materials described in subsection (a)(4); and</text></clause></subparagraph><subparagraph id="id697d6a26ec814426bc98be4983642c53"><enum>(D)</enum><text>to school administrators, educators, school health professionals, coaches, and youth sports organizations, the recommendations described in subsection (a)(5).</text></subparagraph></paragraph><paragraph id="id271e3ac1d329440eb2cf117695ff963e"><enum>(2)</enum><header>Dissemination to health departments and professionals</header><text>The Secretary shall make available such materials and resources to State and local health departments.</text></paragraph><paragraph id="id925f240c1b8141cc824086adfee09a85"><enum>(3)</enum><header>Dissemination of information through the internet</header><subparagraph id="id135fbe4f6c39411bb0b34bd1a739ca90"><enum>(A)</enum><header>CDC</header><clause id="id7717c8b542ef4629938450b9a7999e06"><enum>(i)</enum><header>In general</header><text>The Secretary, acting through the Director, shall post the materials and resources developed under subsection (a) on the public Internet website of the Centers for Disease Control and Prevention.</text></clause><clause id="id8c90ac71bf494a86aae97c726f6e6266"><enum>(ii)</enum><header>Maintenance of information</header><text>The Director shall maintain and update when necessary such materials and resources developed under subsection (a) on the public Internet website to ensure such information reflects the latest standards.</text></clause></subparagraph><subparagraph id="idb50dbf6d93054210891eebb952ed5197"><enum>(B)</enum><header>State educational agencies</header><text>State educational agencies are encouraged to work with State Health Departments to create Internet webpages to disseminate the materials and resources developed under subsection (a) to the general public, with an emphasis on targeting students and their families.</text></subparagraph></paragraph><paragraph commented="no" id="iddab8edcd7d6b44d185b7db875395a3ea"><enum>(4)</enum><header>Accessibility of information</header><text>The information regarding the materials and resources developed under subsection (a) shall be made available in a format and in a manner that is readily accessible to individuals with cognitive and sensory impairments.</text></paragraph></subsection><subsection id="id14293f9d63294632bd2bf65dccb46d8f"><enum>(d)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id563b220220414671b2f6281f927b7367"><enum>(1)</enum><header>School administrators</header><text>The term <term>school administrator</term> means a principal, director, manager, or other supervisor or leader within an elementary school or secondary school (as such terms are defined under section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>)), State-based early education program, or childcare center.</text></paragraph><paragraph id="idb50259371b8f47a4a023f795d2d36a18"><enum>(2)</enum><header>Schools</header><text>The term <term>school</term> means an early education program, childcare center, or elementary school or secondary school (as such terms are so defined) that is not an Internet- or computer-based community school.</text></paragraph></subsection><subsection id="id2b31a59fd3494edaa9310097f879b8ae"><enum>(e)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to carry out this section such sums as may be necessary for fiscal years 2023 through 2028.</text></subsection></section><section id="id6B6606F1B7E1435EB8023AF8CDA27DEA"><enum>399V–8.</enum><header>Grants to provide for CPR and AED training and purchase of AED equipment for public childcare centers, elementary, middle, and secondary schools</header><subsection id="id7b7a4f2dfd13473587d6897c514f5cea"><enum>(a)</enum><header>Authority To make grants</header><text>The Secretary, in consultation with the Secretary of Education, shall award grants to eligible local educational agencies—</text><paragraph id="id6269B8A587D447D0903D987579042F62"><enum>(1)</enum><text>to enable such local educational agencies to purchase AEDs and offer CPR and AED training courses that are nationally certified; or</text></paragraph><paragraph id="idE8318494CB984D20BCE8868B99E09C15"><enum>(2)</enum><text>to enable such local educational agencies to award funding to eligible schools that are served by the local educational agency to purchase and maintain AEDs and offer CPR and AED training courses that are nationally certified.</text></paragraph></subsection><subsection commented="no" id="idf20856fe467d4c848d02997e157936db"><enum>(b)</enum><header>Use of funds</header><text>An eligible local educational agency receiving a grant under this section, or an eligible school receiving grant funds under this section through an eligible local educational agency, shall use the grant funds—</text><paragraph commented="no" id="idbd2b87c019934667924350d4e5893bd6"><enum>(1)</enum><text>to pay a nationally recognized training organization, such as the American Heart Association, the American Red Cross, or the National Safety Council, for instruction, materials, and equipment expenses associated with CPR and AED training in accordance with the materials and resources developed under section 399V–7(a)(3); or</text></paragraph><paragraph commented="no" id="id9ddfe9674fa74746a269344d43cda9a9"><enum>(2)</enum><text>if the local educational agency or an eligible school served by such agency meets the conditions described under subsection (c)(2), to purchase AED devices for eligible schools and pay the costs associated with obtaining the certifications necessary to meet the guidelines established in section 399V–7(a)(4).</text></paragraph></subsection><subsection id="id5bb2c302eb4444a2a548c48e88d86b24"><enum>(c)</enum><header>Grant eligibility</header><paragraph id="id1fc357f92a0447e3967e34f8441c27da"><enum>(1)</enum><header>Application</header><text>To be eligible to receive a grant under this section, a local educational agency shall submit an application to the Secretary at such time, in such manner, and containing such information and certifications as such Secretary may reasonably require.</text></paragraph><paragraph commented="no" id="ida2bdbfa629e0498294d5f27630df9158"><enum>(2)</enum><header>AED allocation and training</header><text>To be eligible for grant funding to purchase AED devices as described in subsection (b)(2), an eligible local educational agency shall demonstrate to the Secretary that such local educational agency or an eligible school served by such agency has or intends to implement a CPR and AED training program and has or intends to implement an emergency cardiac response plan as of the date of the submission of the grant application.</text></paragraph></subsection><subsection id="ida87c374fecdb463e9f18cab0f3f99396"><enum>(d)</enum><header>Priority of award</header><text>The Secretary shall award grants under this section to eligible local educational agencies based on 1 or more of the following priorities:</text><paragraph id="idab6a8382896d48d99c032e7d1e3bc9ec"><enum>(1)</enum><text>A demonstrated need for a CPR or AED training program in an eligible school or a community served by an eligible school, which may include—</text><subparagraph id="id19d227f220b3460b811e456751fe53e6"><enum>(A)</enum><text>schools that do not already have an automated AED on school grounds;</text></subparagraph><subparagraph id="id4c95b462d3db494fb240f3d318ad387e"><enum>(B)</enum><text>schools in which there are a significant number of students on school grounds during a typical day, as determined by the Secretary;</text></subparagraph><subparagraph id="id29689a47245e48878ce4dc3e724f582b"><enum>(C)</enum><text>schools for which the average time required for emergency medical services (as defined in section 330J(e)) to reach the school is greater than the average time required for emergency medical services to reach other public facilities in the community; and</text></subparagraph><subparagraph id="idec11dbcd90fe485c87eae0bb7cda80a1"><enum>(D)</enum><text>schools that have not received funds under the Rural Access to Emergency Devices Act (<external-xref legal-doc="usc" parsable-cite="usc/42/254c">42 U.S.C. 254c</external-xref> note).</text></subparagraph></paragraph><paragraph id="id8223293690644bc8989cd9f9a8a21b9e"><enum>(2)</enum><text>A demonstrated need for continued support of an existing CPR or AED training program in an eligible school or a community served by an eligible school.</text></paragraph><paragraph id="id7a692b33ff534420a8ccdb5252de6f1a"><enum>(3)</enum><text>A demonstrated need for expanding an existing CPR or AED training program by adding training in the implementation of an emergency cardiac response plan.</text></paragraph><paragraph id="id3a33cdc1cd5441838fa62d45348d6c90"><enum>(4)</enum><text>Previously identified opportunities to encourage and foster partnerships with and among community organizations, including emergency medical service providers, fire and police departments, nonprofit organizations, public health organizations, parent-teacher associations, and local and regional youth sports organizations to aid in providing training in both CPR and AED usage and in obtaining AED equipment.</text></paragraph></subsection><subsection id="id8336070ffca64865b7c2f34974e08972"><enum>(e)</enum><header>Matching funds required</header><paragraph id="id9476151ce889414e92e5d9531e5f6741"><enum>(1)</enum><header>In general</header><text>To be eligible to receive a grant under this section, an eligible local educational agency shall provide matching funds from non-Federal sources in an amount equal to not less than 25 percent of the total grant amount.</text></paragraph><paragraph id="idad5e97521c104e3e97a877b3ed88af5a"><enum>(2)</enum><header>Waiver</header><text>The Secretary may waive the requirement of paragraph (1) for an eligible local educational agency if the number of children counted under section 1124(c)(1)(A) of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6333">20 U.S.C. 6333(c)(1)(A)</external-xref>) for the local educational agency is 20 percent or more of the total number of children aged 5 to 17, inclusive, served by the eligible local educational agency.</text></paragraph></subsection><subsection id="idfb186730e8f144a393815d9564b097d9"><enum>(f)</enum><header>Definitions</header><text>In this section:</text><paragraph id="idE0AFB2ABE52044BCA51B9A7BFB8C77CD"><enum>(1)</enum><header>Eligible local educational agency</header><text>The term <term>eligible local educational agency</term> means a local educational agency, as defined in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>), that has established a plan to follow the guidelines and carry out the recommendations described under section 399V–7(a) regarding cardiac emergencies.</text></paragraph><paragraph id="id97C13129275541A7A413F08D356E2EDD"><enum>(2)</enum><header>Eligible school</header><text>The term <term>eligible school</term> means a public elementary, middle, or secondary school, including any public charter school that is considered a local educational agency under State law, and which is not an Internet- or computer-based community school.</text></paragraph></subsection><subsection id="id092d9b09efa44a629868934cbd4c398c"><enum>(g)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to carry out this section such sums as may be necessary for each of the fiscal years 2023 through 2028.</text></subsection></section><section id="id8B3219F17DEC4F02B8F19AA595FFF44D"><enum>399V–9.</enum><header>Requirement to include cardiac conditions in existing research and investigations</header><text display-inline="no-display-inline">The Director of the Centers for Disease Control and Prevention shall develop data collection methods, to be included in the School Health Policies and Practices Survey, to determine the degree to which school administrators, educators, school health professionals, coaches, students, families, and other appropriate individuals have an understanding of cardiac issues described in section 399V–7. Such data collection methods shall be designed to collect information about—</text><paragraph id="id395115823803401983C50BD78FDE61C2"><enum>(1)</enum><text>the ability to accurately identify early symptoms of a cardiac condition, such as cardiomyopathy leading to cardiac arrest, and sudden cardiac death;</text></paragraph><paragraph id="idF4DDB1703AD5451694EC880571C3EF78"><enum>(2)</enum><text>the dissemination of training described in section 399V–7(a)(3) regarding the proper performance of cardiopulmonary resuscitation; and</text></paragraph><paragraph id="idC1DC65341554488189251D145E212809"><enum>(3)</enum><text>the dissemination of guidelines and training described in section 399V–7(a)(4) regarding the placement and use of automatic external defibrillators.</text></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id9a4c07d274134fd4980105d82af68361"><enum>3.</enum><header>Prevention and treatment of youth athlete concussions</header><text display-inline="no-display-inline">Title VIII of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idb88e288b215a4ed3bcea1cba9a4b8fb8"><part id="idE73D6DACB05B438CB9B438BC4D00F569" style="OLC"><enum>H</enum><header>Youth athletic safety</header><subpart id="id81d3aec11fdf420184b1ba8d03f39d98"><enum>1</enum><header>State requirements for the prevention and treatment of concussions</header><section id="idc034496d8bfd479384aa37ed2b909f23"><enum>8701.</enum><header>Minimum State requirements</header><subsection id="id87d0b64673284346b158abdf6b625959"><enum>(a)</enum><header>In general</header><text>Beginning for fiscal year 2023, as a condition of receiving funds under this Act for a fiscal year, a State shall, not later than July 1 of the preceding fiscal year, certify to the Secretary in accordance with subsection (b) that the State has in effect and is enforcing a law or regulation that, at a minimum, establishes the following requirements:</text><paragraph id="id74a56782e38c412b836dbb8dafd90e37"><enum>(1)</enum><header>Local educational agency concussion safety and management plan</header><text>Each local educational agency in the State (including each public charter school that is considered a local educational agency under State law), in consultation with members of the community in which the local educational agency is located, and taking into consideration the guidelines of the Centers for Disease Control and Prevention’s Pediatric Mild Traumatic Brain Injury Guideline Workgroup, shall develop and implement a standard plan for concussion safety and management for public schools served by the local educational agency that includes—</text><subparagraph id="id9bee8351f77741af8bbf9f280c216fd6"><enum>(A)</enum><text>the education of students, school administrators, educators, coaches, youth sports organizations, parents, and school personnel about concussions, including—</text><clause id="ideb00f933d76b49469b41412e1af2baf0"><enum>(i)</enum><text>training of school personnel on evidence-based concussion safety and management, including prevention, recognition, risk, academic consequences, and response for both initial and any subsequent concussions; and</text></clause><clause id="idd4f7bcd379434bfcb127a5a18ca15029"><enum>(ii)</enum><text>using, maintaining, and disseminating to students and parents release forms, treatment plans, observation, monitoring, and reporting forms, recordkeeping forms, and post-injury and prevention fact sheets about concussions;</text></clause></subparagraph><subparagraph id="idd6b726de3957467088b119e306ed6e3c"><enum>(B)</enum><text>supports for each student recovering from a concussion, including—</text><clause id="id157c51284a684c83b65d0c8a0c89199f"><enum>(i)</enum><text>guiding the student in resuming participation in school-sponsored athletic activities and academic activities with the help of a multidisciplinary concussion management team, which shall include—</text><subclause id="id9c3001c2d8fc4554a16bc849913b6b7b"><enum>(I)</enum><text>a health care professional, the parents of such student, and other relevant school personnel; and</text></subclause><subclause id="id21d5498688e94b8aad0c9fc3ee944daf"><enum>(II)</enum><text>an individual who is assigned by the public school in which the student is enrolled to oversee and manage the recovery of the student;</text></subclause></clause><clause id="id21898fa6eabe4a01afe3e605ec87b294"><enum>(ii)</enum><text>providing appropriate academic accommodations aimed at progressively reintroducing cognitive demands on such student; and</text></clause><clause id="ided3a045bf8384751b9dc33d20a3ce3d7"><enum>(iii)</enum><text>if the student's symptoms of concussion persist for a substantial period of time—</text><subclause id="id43257dba4ef342b1ba420a7810323d41"><enum>(I)</enum><text>evaluating the student in accordance with section 614 of the Individuals with Disabilities Education Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1414">20 U.S.C. 1414</external-xref>) to determine whether the student is eligible for services under part B of such Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1411">20 U.S.C. 1411 et seq.</external-xref>); or</text></subclause><subclause id="ide8f32d7ff1cb4c8098a3538ebf809f40"><enum>(II)</enum><text>evaluating whether the student is eligible for services under section 504 of the Rehabilitation Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/29/794">29 U.S.C. 794</external-xref>); and</text></subclause></clause></subparagraph><subparagraph id="idfd05580714224cdfb2bb6e7393a49adf"><enum>(C)</enum><text>best practices, as defined by national neurological medical specialty and sports health organizations, designed to ensure, with respect to concussions, the uniformity of safety standards, treatment, and management, including—</text><clause id="id053163a9c01444438f417030038cf49b"><enum>(i)</enum><text>disseminating information on concussion safety and management to the public; and</text></clause><clause id="id2d95c829d26f49af90b72f217137b9eb"><enum>(ii)</enum><text>applying best practice and uniform standards for concussion safety and management to all students enrolled in the public schools served by the local educational agency.</text></clause></subparagraph></paragraph><paragraph id="id5767326e860b4a82aa6547949cd1e6a1"><enum>(2)</enum><header>Posting of information on concussions</header><text>Each public school in the State shall post on school grounds, in a manner that is visible to students and school personnel, and make publicly available on the school website, information on concussions that—</text><subparagraph id="id402adc0507c243afb3d86e8a2bb76f32"><enum>(A)</enum><text>is based on peer-reviewed scientific evidence or consensus (such as information made available by the Centers for Disease Control and Prevention);</text></subparagraph><subparagraph id="id576a1f858cff4cdbb9d7fb4c190e5ef8"><enum>(B)</enum><text>shall include—</text><clause id="id800834537af242a39af963fc63c7029c"><enum>(i)</enum><text>the risks posed by sustaining a concussion or multiple concussions;</text></clause><clause id="id7bfaee7764884e818eb8766a68a150c1"><enum>(ii)</enum><text>the actions a student should take in response to sustaining a concussion, including the notification of school personnel; and</text></clause><clause id="idbb128d7e406f47958fc01393de6afb38"><enum>(iii)</enum><text>the signs and symptoms of a concussion; and</text></clause></subparagraph><subparagraph id="ida8128189b08d45f3abdefebf02a3bd57"><enum>(C)</enum><text>may include—</text><clause id="idad42490b8f5a49e6b03f560d4b7f4bbc"><enum>(i)</enum><text>the definition of a concussion under section 8702(1);</text></clause><clause id="id9c3b4de988f54552b8d39355b3d73043"><enum>(ii)</enum><text>the means available to the student to reduce the incidence or recurrence of a concussion; and</text></clause><clause id="id29bcf33e900d4adab0d5f83fb59c7be1"><enum>(iii)</enum><text>the effects of a concussion on academic learning and performance.</text></clause></subparagraph></paragraph><paragraph id="id660ea36c8e304fc282f38815d68b9ae5"><enum>(3)</enum><header>Response to a concussion</header><text>If any school personnel of a public school in the State suspect that a student has sustained a concussion during a school-sponsored athletic activity or other school-sponsored activity—</text><subparagraph id="idd35b5c5cdcf04c579b1a01592489237f"><enum>(A)</enum><text>the student shall be—</text><clause id="id99f0620bb7ef476eab351da6e105ca42"><enum>(i)</enum><text>immediately removed from participation in such activity; and</text></clause><clause id="idad3a6916672a4151ba99546d22e8703d"><enum>(ii)</enum><text>prohibited from resuming participation in school-sponsored athletic activities—</text><subclause id="idfc10d8fd43394cacb52b3bc0dc4d10b1"><enum>(I)</enum><text>on the day the student sustained the concussion; and</text></subclause><subclause id="id509030854bb7408f8ecb22e118d7f133"><enum>(II)</enum><text>until the day the student is capable of resuming such participation, according to the student's written release, as described in paragraphs (4) and (5);</text></subclause></clause></subparagraph><subparagraph id="id29707eb28f1245269865d31a45d3de50"><enum>(B)</enum><text>the school personnel shall report to the concussion management team described under paragraph (1)(B)(i)—</text><clause id="id488c10bf428b4693835d368e125f0e88"><enum>(i)</enum><text>that the student may have sustained a concussion; and</text></clause><clause id="id108e24ca1522452da569399528d0e26c"><enum>(ii)</enum><text>all available information with respect to the student's injury; and</text></clause></subparagraph><subparagraph id="id56ac24dfc6bc4abb919cb9290fb425b5"><enum>(C)</enum><text>the concussion management team shall confirm and report to the parents of the student—</text><clause id="idaafd0e057f744b15b7251c6463275290"><enum>(i)</enum><text>the type of injury, and the date and time of the injury, suffered by the student; and</text></clause><clause id="idc14be965d3c54dd18ccd40c3feb73686"><enum>(ii)</enum><text>any actions that have been taken to treat the student.</text></clause></subparagraph></paragraph><paragraph id="id2e01b5053b8246da9ebba41c4b82b64e"><enum>(4)</enum><header>Return to athletics</header><text>If a student enrolled in a public school in the State sustains a concussion, before the student resumes participation in school-sponsored athletic activities, the relevant school personnel shall receive a written release from a health care professional, that—</text><subparagraph id="ida764b21f6a184818a3ecd6cf4fb5920e"><enum>(A)</enum><text>may require the student to follow a plan designed to aid the student in recovering and resuming participation in such activities in a manner that—</text><clause id="ide647d3e0741b4206913bf9381d8b9d90"><enum>(i)</enum><text>is coordinated, as appropriate, with periods of cognitive and physical rest while symptoms of a concussion persist; and</text></clause><clause id="id30c03e1f24c6423ca0cf37199deacf1d"><enum>(ii)</enum><text>reintroduces cognitive and physical demands on the student on a progressive basis so long as such increases in exertion do not cause the re-emergence or worsening of symptoms of a concussion; and</text></clause></subparagraph><subparagraph id="id4b97ef21afe046cd85949a2ee1c8c0fb"><enum>(B)</enum><text>states that the student is capable of resuming participation in such activities once the student is asymptomatic.</text></subparagraph></paragraph><paragraph id="id81db809b337d47f08193aac1cba40a75"><enum>(5)</enum><header>Return to academics</header><text>If a student enrolled in a public school in the State has sustained a concussion, the concussion management team (as described under paragraph (1)(B)(i)) of the school shall consult with and make recommendations to relevant school personnel and the student to ensure that the student is receiving the appropriate academic supports, including—</text><subparagraph id="ida3e88035932f40ba8661580df1ea2567"><enum>(A)</enum><text>providing for periods of cognitive rest over the course of the school day;</text></subparagraph><subparagraph id="id7ed77c9f0a824ffe8a07e050964c1742"><enum>(B)</enum><text>providing modified academic assignments;</text></subparagraph><subparagraph id="idfe53a812fea34251b2cfa2d009d6c437"><enum>(C)</enum><text>allowing for gradual reintroduction to cognitive demands; and</text></subparagraph><subparagraph id="idd18853f10d7f440c95c8bb8ed9aa7fc8"><enum>(D)</enum><text>other appropriate academic accommodations or adjustments.</text></subparagraph></paragraph></subsection><subsection id="id6749dfb04fd548c7b2014c6cad5d621d"><enum>(b)</enum><header>Certification requirement</header><text>The certification required under subsection (a) shall be in writing and include a description of the law or regulation that meets the requirements of subsection (a).</text></subsection></section><section id="id873b10b4dfd1403e88eafad16b372d3f"><enum>8702.</enum><header>Definitions</header><text display-inline="no-display-inline">In this part:</text><paragraph id="id3dab55aca30d4ff4b78213b69a979b88"><enum>(1)</enum><header>Concussion</header><text>The term <term>concussion</term> means a type of mild traumatic brain injury that—</text><subparagraph id="id3460cf57eb624986a52b7e256c226728"><enum>(A)</enum><text>is caused by a blow, jolt, or motion to the head or body that causes the brain to move rapidly in the skull;</text></subparagraph><subparagraph id="idfe4df475429049cd91b2a5aca0a5dcba"><enum>(B)</enum><text>disrupts normal brain functioning and alters the physiological state of the individual, causing the individual to experience—</text><clause id="id2b904a82ea1444ee8b18bb8090c25d55"><enum>(i)</enum><text>any period of observed or self-reported—</text><subclause id="idcb161ac0a8c449b39636f432211577d0"><enum>(I)</enum><text>transient confusion, disorientation, or altered consciousness;</text></subclause><subclause id="idd4d4af5ec7e14f6d8ca2edb6f566a0db"><enum>(II)</enum><text>dysfunction of memory around the time of injury; or</text></subclause><subclause id="id874e8b238b7a4b73a28dde3364dfd6b6"><enum>(III)</enum><text>disruptions in gait or balance; and</text></subclause></clause><clause id="idba2fe16ab4da407ebc5ff23b43662a17"><enum>(ii)</enum><text>symptoms that may include—</text><subclause id="id00eb0cb92acc4736b16f6f45585a75e1"><enum>(I)</enum><text>physical symptoms, such as headache, fatigue, or dizziness;</text></subclause><subclause id="id3b132f5fbc9248739479cb4578ff36db"><enum>(II)</enum><text>cognitive symptoms, such as memory disturbance or slowed thinking;</text></subclause><subclause id="id169a531714f64a70a29702c24576d76a"><enum>(III)</enum><text>emotional symptoms, such as irritability or sadness; or</text></subclause><subclause id="id34b816263595447691da57d88abbfa46"><enum>(IV)</enum><text>difficulty sleeping; and</text></subclause></clause></subparagraph><subparagraph id="ided7e19002be94b2f97f13b3ad00243ac"><enum>(C)</enum><text>occurs—</text><clause id="idb78af43e27eb4e5abb166fcb36858b12"><enum>(i)</enum><text>with or without the loss of consciousness; and</text></clause><clause id="id565c177abca14b73b0d290bfb3c66a51"><enum>(ii)</enum><text>during participation—</text><subclause id="idf378ef3579224ea7ae323073fd26474a"><enum>(I)</enum><text>in a school-sponsored athletic activity; or</text></subclause><subclause id="id2917b4d8b8e34e35bc20eaa8d372cbf3"><enum>(II)</enum><text>in any other activity without regard to whether the activity takes place on school property or during the school day.</text></subclause></clause></subparagraph></paragraph><paragraph id="idc74aa97cd19d4a5badb699227618e7c4"><enum>(2)</enum><header>Health care professional</header><text>The term <term>health care professional</term> means a physician (including a medical doctor or doctor of osteopathic medicine), registered nurse, athletic trainer, physical therapist, neuropsychologist, or other qualified individual—</text><subparagraph id="id464506c4a9424fd185a33ff09885eb5b"><enum>(A)</enum><text>who is registered, licensed, certified, or otherwise statutorily recognized by the State to provide medical treatment; and</text></subparagraph><subparagraph id="idcd61d744d28e439dbed7d0e83dc2f999"><enum>(B)</enum><text>whose scope of practice and experience includes the diagnosis and management of traumatic brain injury among a pediatric population.</text></subparagraph></paragraph><paragraph id="id0e3498df8ccf4b8291ae6032f01cbffe"><enum>(3)</enum><header>Parent</header><text>The term <term>parent</term> means biological or adoptive parents or legal guardians, as determined by applicable State law.</text></paragraph><paragraph id="idE7920E41365B46548C666AB9A9B7C772"><enum>(4)</enum><header>Public school</header><text>The term <term>public school</term> means an elementary school or secondary school (as such terms are so defined), including any public charter school that is considered a local educational agency under State law, and which is not an Internet- or computer-based community school.</text></paragraph><paragraph id="id0310507930e046998f1ae3e59822b4e5"><enum>(5)</enum><header>School personnel</header><text>The term <term>school personnel</term> includes teachers, principals, administrators, counselors, social workers, psychologists, nurses, librarians, coaches and athletic trainers, and other support staff who are employed by a school or who perform services for the school on a contractual basis. </text></paragraph><paragraph id="id09190de394dd4b27b68d5d047e8439dc"><enum>(6)</enum><header>School-sponsored athletic activity</header><text>The term <term>school-sponsored athletic activity</term> means—</text><subparagraph id="idf5848a0063fe493d9bbf99ef8dc24a03"><enum>(A)</enum><text>any physical education class or program of a public school;</text></subparagraph><subparagraph id="iddf5d0edb2ad149f6842cdb5f7cf30479"><enum>(B)</enum><text>any athletic activity authorized by a public school that takes place during the school day on the school’s property;</text></subparagraph><subparagraph id="id3c8c19fbe8f64a1d902914767ea63130"><enum>(C)</enum><text>any activity of an extracurricular sports team, club, or league organized by a public school; and</text></subparagraph><subparagraph id="idfb81a2ec37ad470382418881dac2e668"><enum>(D)</enum><text>any recess activity of a public school.</text></subparagraph></paragraph></section></subpart></part><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id9f0cfa0e76984d23874d75c4397c625e"><enum>4.</enum><header>Heat advisory and heat acclimatization guidelines for secondary school athletics</header><text display-inline="no-display-inline">Part H of title VIII of the Elementary and Secondary Education Act of 1965, as added by this Act, is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id279FD7F6A26F419DB4B52B7C8B3B3CDC"><subpart id="idD6624677A3564F28AA36FA2A60ABC49D" style="OLC"><enum>2</enum><header>Heat advisory and heat acclimatization procedures</header><section id="id6731ee3d10bf4ae79d9d187e756bb0c4"><enum>8711.</enum><header>Heat advisory and heat acclimatization procedures</header><subsection id="id8e40a5cb10b14ba0937902893d4cfac2"><enum>(a)</enum><header>Materials and resources</header><text>The Secretary, in consultation with the Secretary of Health and Human Services and the Secretary of Commerce, acting through the Administrator of the National Oceanic and Atmospheric Administration, shall develop public education and awareness materials and resources to be disseminated to school administrators, school health professionals, coaches, families, and other appropriate individuals. The materials and resources shall include—</text><paragraph id="id44179652ed3644e9ab3837b8b180d079"><enum>(1)</enum><text>information regarding the health risks associated with exposure to excessive heat and excessive humidity, as defined by the National Weather Service;</text></paragraph><paragraph id="id82ea3ef018fd4914ac86b9b09525c39f"><enum>(2)</enum><text>tips and recommendations on how to avoid heat-related illness, including proper hydration and access to the indoors or cooling stations; and</text></paragraph><paragraph id="id8161905ffe81414b884334e15d132572"><enum>(3)</enum><text>strategies for <quote>heat-acclimatization</quote> that address the types and duration of athletic activities considered to be generally safe during periods of excessive heat.</text></paragraph></subsection><subsection id="id55120a5bb3ab4681b45a5124a9a99b88"><enum>(b)</enum><header>Implantation of excessive heat action plan</header><text>Public schools shall develop an <quote>excessive heat action plan</quote> to be used during all school-sponsored athletic activities that occur during periods of excessive heat and humidity. Such plan shall—</text><paragraph id="idc2ab4c6816e5418aa6919081fa5e6d02"><enum>(1)</enum><text>be in effect prior to full scale athletic participation by students, including any practices or scrimmages prior to the beginning of the school’s academic year; and</text></paragraph><paragraph id="id52022094df1f4089b0bd6a16a9969161"><enum>(2)</enum><text>apply to days when an Excessive Heat Watch or Excessive Heat Warning or Advisory has been issued by the National Weather Service for the area in which the athletic event is to take place.</text></paragraph></subsection></section></subpart><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id3e487b7101f949d0a85ec32eefc7f2fb"><enum>5.</enum><header>Guidelines for emergency action plans for athletics</header><text display-inline="no-display-inline">The Secretary of Health and Human Services, acting through the Director of the Centers for Disease Control and Prevention, and in consultation with the Secretary of Education, shall work with stakeholder organizations to develop recommended guidelines for the development of emergency action plans for youth athletics. Such plans shall include the following:</text><paragraph id="id1823e0b699344186a9e5c2a16fd695cc"><enum>(1)</enum><text>Identifying the characteristics of an athletic, medical, or health emergency.</text></paragraph><paragraph id="id8e35e134c43b46478dbff024869b56ab"><enum>(2)</enum><text>Procedures for accessing emergency communication equipment and contacting emergency personnel, including providing directions to the specific location of the athletic venue that is used by the youth athletic group or organization.</text></paragraph><paragraph id="id6f909b7aff044b74b1cd8444bb460bfe"><enum>(3)</enum><text>Instructions for accessing and utilizing appropriate first-aid, CPR techniques, and emergency equipment, such as an automatic external defibrillator.</text></paragraph></section><section id="id468f678d30814620b3dfdb7dc7edff42"><enum>6.</enum><header>Guidelines for safe energy drink use by youth athletes</header><subsection id="id485bfed9c3234edba0651b81b31f042d"><enum>(a)</enum><header>Development of guidelines</header><text>Not later than 2 years after the date of enactment of this Act, the Secretary of Health and Human Services, acting through the Commissioner of Food and Drugs, in collaboration with the Director of the Centers for Disease Control and Prevention and other related Federal agencies, may—</text><paragraph id="id8954FF8252CF4E70A78579E701046A76"><enum>(1)</enum><text>develop information about the ingredients used in energy drinks and the potential side effects of energy drink consumption; and</text></paragraph><paragraph id="id46B87DB2771743E5A01D2FA7FF2A1E95"><enum>(2)</enum><text>recommend guidelines for the safe use of energy drink consumption by youth, including youth participating in athletic activities.</text></paragraph></subsection><subsection id="id0ead591e0390413a8d6091b3a20c14cb"><enum>(b)</enum><header>Dissemination of guidelines</header><text>Not later than 6 months after any information or guidelines are developed under subsection (a), the Secretary of Education, in coordination with the Commissioner of Food and Drugs, shall disseminate such information and guidelines to school administrators, educators, school health professionals, coaches, families, and other appropriate individuals.</text></subsection><subsection id="id2a9ea4423e9e4465a18c369e4e763116"><enum>(c)</enum><header>Energy drink defined</header><text>In this section, the term <term>energy drink</term> means a class of products in liquid form, marketed as either a dietary supplement or conventional food under the Federal Food, Drug, and Cosmetic Act (<external-xref legal-doc="usc" parsable-cite="usc/21/301">21 U.S.C. 301 et seq.</external-xref>), for the stated purpose of providing the consumer with added physical or mental energy, and that contains each of the following:</text><paragraph id="id3059E91CDC2D4619A4944FC6DE013F20"><enum>(1)</enum><text>Caffeine.</text></paragraph><paragraph id="id838E4C108913445FAE5FA83A958EBA57"><enum>(2)</enum><text>At least 1 of the following ingredients:</text><subparagraph id="id180777158a09493ebb3a14d09371a5a4"><enum>(A)</enum><text>Taurine.</text></subparagraph><subparagraph id="id800fc1c9d9f24d23b0efff6d45f2dfef"><enum>(B)</enum><text>Guarana.</text></subparagraph><subparagraph id="idd81ca95d134542609de8d8ee2ebd3e31"><enum>(C)</enum><text>Ginseng.</text></subparagraph><subparagraph id="id49ead4094bcc42d49e28fa7622a1deb2"><enum>(D)</enum><text>B vitamins such as cobalamin, folic acid, pyridoxine, or niacin.</text></subparagraph><subparagraph id="idba52a86e08be4b85b95e332036f69b0d"><enum>(E)</enum><text>Any other ingredient added for the express purpose of providing physical or mental energy, as determined during the development of guidelines in accordance with subsection (a).</text></subparagraph></paragraph></subsection><subsection id="id8e25b3a61ba3457bb4f32820b067bef1"><enum>(d)</enum><header>Prohibition on restriction of marketing and sales of energy drinks</header><text>Nothing in this section shall be construed to provide the Commissioner of Food and Drugs with authority to regulate the marketing and sale of energy drinks, beyond such authority as such Commissioner has as of the date of enactment of this Act.</text></subsection></section><section id="idb98d9cb1c0654c2397ca139ea62fe951"><enum>7.</enum><header>Research relating to youth athletic safety</header><subsection id="id3C96C1F2EE3643FDA90D687878EE2D92"><enum>(a)</enum><header>Expansion of CDC Research</header><text>Section 301 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/241">42 U.S.C. 241</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id2A63AC47AE824C6DA06BFEFD0E7F48A9"><subsection id="id93378D578FB441DF99262FA373F65565"><enum>(i)</enum><text>The Secretary, acting through the Director of the Centers for Disease Control and Prevention, shall expand, intensify, and coordinate surveillance activities with respect to cardiac conditions, concussions, and heat-related illnesses among youth athletes.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id0A37C9A1CF3142F4AA8B58915DAD9A38"><enum>(b)</enum><header>Report to Congress</header><text display-inline="yes-display-inline">Not later than 6 years after the date of enactment of this Act, the Director of the Centers for Disease Control and Prevention and the Secretary of Education shall prepare and submit a joint report to Congress that includes information, with respect to the 5-year period beginning after the date of enactment of this Act, about—</text><paragraph id="id0A2C2289776C4B61B94AD31C39C5949E"><enum>(1)</enum><text display-inline="yes-display-inline">the number of youth fatalities that occur while a youth is participating in an athletic activity, and the cause of each of those deaths; </text></paragraph><paragraph id="id6AEA2D03DB6C485FA0893D8809644071"><enum>(2)</enum><text display-inline="yes-display-inline">the number of catastrophic injuries sustained by a youth while the youth is participating in an athletic activity, and the cause of such injury;</text></paragraph><paragraph id="id26A925AAE7F440C083282FA7A11FD445"><enum>(3)</enum><text>demographic information on youth fatalities and catastrophic injury;</text></paragraph><paragraph id="id88D56D6EB2D44C1DA92F17E3CABF3617"><enum>(4)</enum><text>national surveillance data on the incidence and prevalence of cardiomyopathy and other cardiac conditions, concussions, and heat-related illnesses among youth athletes; and</text></paragraph><paragraph id="id13AA3C9FB4B7494E80F2D3B7A7DB7F8C"><enum>(5)</enum><text>effectiveness of CPR and AED usage in cardiac emergency situations among young athletes.</text></paragraph></subsection></section><section id="idc43cacab35e84c60b3f93144f1d7b3c7"><enum>8.</enum><header>Conforming amendments</header><text display-inline="no-display-inline">The table of contents in section 2 of the Elementary and Secondary Education Act of 1965 is amended by inserting after the item relating to section 8601 the following new items:</text><quoted-block style="OLC" id="id7e0a39fc-8d61-4d5b-9dc4-04f89a823fb6"><toc><toc-entry level="part">PART H—Youth athletic safety </toc-entry><toc-entry level="subpart">SUBPART 1—State requirements for the prevention and treatment of concussions </toc-entry><toc-entry level="section" idref="idc034496d8bfd479384aa37ed2b909f23">Sec. 8701. Minimum State requirements. </toc-entry><toc-entry level="section" idref="id873b10b4dfd1403e88eafad16b372d3f">Sec. 8702. Definitions. </toc-entry><toc-entry level="subpart" idref="idD6624677A3564F28AA36FA2A60ABC49D">SUBPART 2—Heat advisory and heat acclimatization procedures </toc-entry><toc-entry level="section" idref="id6731ee3d10bf4ae79d9d187e756bb0c4">Sec. 8711.
