<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>2d Session</session><legis-num>S. 4040</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20220407">April 7, 2022</action-date><action-desc><sponsor name-id="S259">Mr. Reed</sponsor> (for himself and <cosponsor name-id="S316">Mr. Whitehouse</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend subtitle IV of title 46, United States Code, with respect to ship agents, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Ship Agent Licensure Act of 2022</short-title></quote>.</text></section><section id="id460685622396408fa2e71b01743e6892"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 40102 of title 46, United States Code, is amended—</text><paragraph id="id76328f11cf9f43ab818693e0c7a091ff"><enum>(1)</enum><text>by redesignating paragraphs (22) through (26) as paragraphs (23) through (27), respectively; and</text></paragraph><paragraph id="id18f9441c3d4e40f1bb03dbcda9ca4d58"><enum>(2)</enum><text>by inserting after paragraph (21) the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id6f022676a9c543f599fa14a98a812b90"><paragraph id="idf783f835f63e41fcb7129ea642767ea9"><enum>(22)</enum><header>Ship agent</header><text>The term <term>ship agent</term> means a person—</text><subparagraph id="id99b1a5b40b844583af984ca993a6acc1"><enum>(A)</enum><text>engaged in the business of representing a ship’s owner, operator, or charterer (referred to in this paragraph as the <quote>principal</quote>) in performing carriage while in a port of the United States; and</text></subparagraph><subparagraph id="iddc6cc63970d04225ab89025a4324972d"><enum>(B)</enum><text>who is responsible to the principal for—</text><clause id="idf496879ad5d84e67a2d301cf9a308f48"><enum>(i)</enum><text>port entry, berthing, and departure;</text></clause><clause id="id9ee4b6aebafb48328615e13bf744e033"><enum>(ii)</enum><text>port husbandry services;</text></clause><clause id="ide08b84e7e83f42019804489a027f59f0"><enum>(iii)</enum><text>crew changes and repatriations;</text></clause><clause id="id4c62a46ff1c74b5b97d9f07f41833155"><enum>(iv)</enum><text>receiving or releasing cargo on behalf of the principal; or</text></clause><clause id="idb8cf4cd525ab43a18ca2122509875183"><enum>(v)</enum><text>interfacing with various Federal agencies with respect to port safety, supply chain efficiency, maritime security, and the environment; and</text></clause></subparagraph><subparagraph id="idad3ac00cc7a04a9fa4a4d4e589a2837b"><enum>(C)</enum><text>who is not owned or controlled by a common carrier or cruise line.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="idFF86C7517C7343F7B15563B24124796C"><enum>3.</enum><header>Ship agents</header><subsection id="idC6310BE43133400898DA0C16B7F4CC73"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Title 46, United States Code, is amended by inserting after chapter 409 the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="idbc65f392240f43d897a4846f7ffc8a32"><chapter id="idD853A733FA8346FCB4E1542991D2BF9B" style="OLC"><enum>410</enum><header>Ship agents</header><toc container-level="chapter-container" quoted-block="no-quoted-block" lowest-level="section" regeneration="yes-regeneration" lowest-bolded-level="division-lowest-bolded"><toc-entry level="section">Sec.</toc-entry><toc-entry level="section">41001. Definition of Commission.</toc-entry><toc-entry level="section" bold="off">41002. License requirement.</toc-entry><toc-entry level="section" bold="off">41003. Financial responsibility.</toc-entry><toc-entry level="section" bold="off">41004. Suspension or revocation of license.</toc-entry></toc><section id="id25cebad97e7748a881ecaf764add6c5e"><enum>41001.</enum><header>Definition of Commission</header><text display-inline="no-display-inline">In this chapter, the term <term>Commission</term> means the Federal Maritime Commission. </text></section><section id="id67725E5024E04F51BD5F6050FF26C936"><enum>41002.</enum><header>License requirement</header><subsection id="idefd7888c255d4da8be436281731a139d"><enum>(a)</enum><header>In general</header><text>Subject to subsection (b), a person in the United States shall not advertise, hold oneself out, or act as a ship agent or provide ship agent services in the United States unless the person is domiciled in the United States and holds a license issued by the Commission. The Commission shall issue a license to a person that the Commission determines to be qualified by experience and character to act as a ship agent.</text></subsection><subsection id="id2f6692356a7543c485b70b2c092944ca"><enum>(b)</enum><header>Exception</header><text>A person whose primary business is the provision of ocean transportation by water may provide ship agent services for its own account without a ship agent license under this section. </text></subsection><subsection id="id9e764af74f264ee39b64bc46b0471b2b"><enum>(c)</enum><header>Qualifications</header><text>The Commission shall establish such other ship agent qualifications as are necessary. In establishing qualifications, the Commission shall consider recognized national and international standards for ship agency.</text></subsection></section><section id="idca6110ffaeac42499eba87f591ad2377"><enum>41003.</enum><header>Financial responsibility</header><subsection id="id9419fa618d164c9a9be30978caf93f68"><enum>(a)</enum><header>In general</header><text>A person may not advertise, hold oneself out, or act as a ship agent unless the person furnishes a bond, proof of insurance, or other surety in a form and amount determined by the Commission to insure financial responsibility.</text></subsection><subsection id="id9f348623882c4a9d87d5a288f7831191"><enum>(b)</enum><header>Scope of financial responsibility</header><text>A bond, insurance, or other surety obtained under this section—</text><paragraph id="ide42d4f82348a451e8cb099404aa06409"><enum>(1)</enum><text>shall be available to pay any penalty assessed under section 41109 of this title or any order for reparation issued under section 41305 of this title;</text></paragraph><paragraph id="id28e9d1bb4bb84142ae7b6c783e6254b6"><enum>(2)</enum><text>may be available to pay any claim against a ship agent arising from its ship agency services—</text><subparagraph id="id82014565841444eb8d7398f3e68d6e6d"><enum>(A)</enum><text>with the consent of the insured ship agent and subject to review by the surety company; or</text></subparagraph><subparagraph id="idb4126aaa8af742ccb16127c6ce71a7b5"><enum>(B)</enum><text>when the claim is determined valid by the surety company after the ship agent has failed to respond to adequate notice to address the validity of the claim; and</text></subparagraph></paragraph><paragraph id="id1e3fcf7f928c449e882f4b948a959550"><enum>(3)</enum><text>shall be available to pay any judgment for damages against a ship agent arising from its ship agency services, if the claimant has first attempted to resolve the claim under paragraph (2) and the claim has not been resolved within a reasonable period of time.</text></paragraph></subsection><subsection id="id65f7448e3f744128ab29bc3572c306a1"><enum>(c)</enum><header>Regulations on court judgments</header><text>The Commission shall prescribe regulations for the purpose of protecting the interests of claimants, ship agents, and surety companies with respect to the process of pursuing claims against ship agent bonds, insurance, or sureties through court judgments. The regulations shall provide that a judgment for monetary damages may not be enforced except to the extent that the damages claimed arise from the ship agency services of the insured ship agent, as defined by the Commission.</text></subsection></section><section id="idcd31f690131146cb94810c6962fae7a1"><enum>41004.</enum><header>Suspension or revocation of license</header><subsection id="id571fe1df75cd4defb8837abac0f1bd4e"><enum>(a)</enum><header>Failure To maintain qualifications or To comply</header><text>The Commission, after notice and opportunity for a hearing, shall suspend or revoke a ship agent license if the Commission finds that the ship agent—</text><paragraph id="id1f40e63a499b4751bdefe0079968fbc4"><enum>(1)</enum><text>is not qualified to provide ship agency services; or</text></paragraph><paragraph id="ide1808f97abf54f7ab9bc4a0b9d6a47aa"><enum>(2)</enum><text>willfully failed to comply with a provision of this part or with an order or regulation of the Commission.</text></paragraph></subsection><subsection id="idb776a76c6e974a899b7bff70e31ab0a0"><enum>(b)</enum><header>Failure To maintain bond, proof of insurance, or other surety</header><text>The Commission may revoke a ship agent license for failure to maintain a bond, proof of insurance, or other surety as required by section 41002(a) of this title.</text></subsection></section></chapter><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id6FE2C7C0628D48819C1862EB19DA08CC"><enum>(b)</enum><header>Conforming amendments for tables of chapters</header><text>The table of chapters at the beginning of title 46, United States Code, and at the beginning of subtitle IV of such title are each amended by inserting after the item relating to chapter 409 the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idF9EAA87FC8234AE4A4909F5029C4D63A"><toc><multi-column-toc-entry level="chapter" bold="off"><toc-enum>410.</toc-enum><level-header level="chapter"> Ship Agents</level-header><target>41001.</target></multi-column-toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
