which was read twice and referred to the <committee-name committee-id="SSEG00">Committee on Energy and Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To increase the production and use of renewable diesel and sustainable aviation fuel, and for other purposes. </official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="id3FB86B74A31F4EA68815615E502212B0"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Renewable Diesel and Sustainable Aviation Fuel Parity Act of 2022</short-title></quote>.</text></section><section id="idf51dfaffb35c4e7cb933889379401fc6"><enum>2.</enum><header>Renewable diesel and sustainable aviation fuel production and imports</header><subsection id="id2A51797A4DFC4B2E950E55F767BE6A75"><enum>(a)</enum><header>Definition of sustainable aviation fuel</header><text>In this section, the term <term>sustainable aviation fuel</term> means liquid that—</text><paragraph id="idd5ca77c76908454ba22101f183f29d12"><enum>(1)</enum><text>meets the requirements of—</text><subparagraph id="id3bfa609bf99f4a96b5528bb1401fb614"><enum>(A)</enum><text>ASTM International Standard D7566; or</text></subparagraph><subparagraph id="idc66cd1b80d364fdb8851bc2965aa6bb1"><enum>(B)</enum><text>the coprocessing provisions of ASTM International Standard D1655, Annex A1;</text></subparagraph></paragraph><paragraph id="id9f1555d235fe438390a41a6cde627a99"><enum>(2)</enum><text>is not derived from palm fatty acid distillates, palm oil, natural gas, coal, or petroleum; and</text></paragraph><paragraph id="id762567b3c080468d92c73bd707f2f11e"><enum>(3)</enum><text>compared to petroleum-based jet fuel, has at least a 50 percent reduction in lifecycle greenhouse gas emissions, as measured in accordance with— </text><subparagraph id="id9EAC622E4B324542A5616AECED518650"><enum>(A)</enum><text>section 211(o)(1)(H) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7545">42 U.S.C. 7545(o)(1)(H)</external-xref>); or</text></subparagraph><subparagraph id="idA05FD3D59B0B44E8AEE63D9E817DB120"><enum>(B)</enum><text>the methodology referenced in the most recent Carbon Offsetting and Reduction Scheme for International Aviation, as adopted by the International Civil Aviation Organization with the agreement of the United States.</text></subparagraph></paragraph></subsection><subsection id="id4a7351ee084f43318d4118f9da2cedda"><enum>(b)</enum><header>Reported data</header><text>Not later than January 1, 2025, the Secretary of Energy, acting through the Administrator of the Energy Information Administration, shall include in the Petroleum Supply Monthly, Petroleum Supply Annual, Annual Energy Outlook, and any other relevant report of the Energy Information Administration, as determined by the Administrator of the Energy Information Administration, data on renewable diesel and sustainable aviation fuel, subject to subsection (c), including—</text><paragraph id="id57bbd143ed8e41f58f9ab3a167b59df8"><enum>(1)</enum><text>the type, origin, and volume of feedstock used in the production of—</text><subparagraph id="idf647cc0b0fdd4defbda94762370f0716"><enum>(A)</enum><text>renewable diesel—</text><clause id="id311fe4408e0f4523bfb955685782dbe7"><enum>(i)</enum><text>in each State or, if appropriate, Petroleum Administration for Defense District, as applicable;</text></clause><clause id="ida14627bcef254ddd800831153ffcfffe"><enum>(ii)</enum><text>in the United States; and</text></clause><clause id="idc19551d8abe14bc895ab6777c68e178e"><enum>(iii)</enum><text>to the maximum extent practicable, in each foreign country, as applicable; and</text></clause></subparagraph><subparagraph id="id323493f43085461881474f31448e5e61"><enum>(B)</enum><text>sustainable aviation fuel—</text><clause id="id8b310e781150482298869902e994af6a"><enum>(i)</enum><text>in each State or, if appropriate, Petroleum Administration for Defense District, as applicable;</text></clause><clause id="id01ed2c48292e4df2addb55aed60df425"><enum>(ii)</enum><text>in the United States; and</text></clause><clause id="id5441d419b7ed42b4b7b504e26d0449f5"><enum>(iii)</enum><text>to the maximum extent practicable, in each foreign country, as applicable;</text></clause></subparagraph></paragraph><paragraph id="id84a674a3f9e34dae97085bc5bad27975"><enum>(2)</enum><text>the total amount of renewable diesel—</text><subparagraph id="id27ea97515cf4403e96f3de1aafef27a0"><enum>(A)</enum><text>produced—</text><clause id="id8ec095cc28a243e498249950a0966774"><enum>(i)</enum><text>in each State, as applicable; and</text></clause><clause id="idc77cbd3297a242f38e2b81442379565c"><enum>(ii)</enum><text>in the United States; and</text></clause></subparagraph><subparagraph id="id649eb0e287ac44d782209193e8788712"><enum>(B)</enum><text>imported from—</text><clause id="id7c44fd5f74024944bf1b9478de9d5bbd"><enum>(i)</enum><text>each foreign country, as applicable; and</text></clause><clause id="id6b73e0879c94473aab89cdaa77e1f999"><enum>(ii)</enum><text>all foreign countries, as applicable; and</text></clause></subparagraph></paragraph><paragraph id="id92ec160958a74c509dd644f49307f45e"><enum>(3)</enum><text>the total amount of sustainable aviation fuel—</text><subparagraph id="ideb3190f09e774e1e909d3a24bb459d30"><enum>(A)</enum><text>produced—</text><clause id="idf1308542c72d4286a72e5bb2b7c51da5"><enum>(i)</enum><text>in each State, as applicable; and</text></clause><clause id="id5a8c345627ef4336a95df95d919795ab"><enum>(ii)</enum><text>in the United States; and</text></clause></subparagraph><subparagraph id="idc3f6cd0231a14a33b317024cdd380fe2"><enum>(B)</enum><text>imported from—</text><clause id="id481e0da5eaf041cebee3354417139a36"><enum>(i)</enum><text>each foreign country, as applicable; and</text></clause><clause id="idb3256daca7ac44f8bf67e5d8ced6bb89"><enum>(ii)</enum><text>all foreign countries, as applicable.</text></clause></subparagraph></paragraph></subsection><subsection id="id441b2d5fad2643d4a323ad6f20a93ee8"><enum>(c)</enum><header>Reporting requirements</header><text>Data published under subsection (b) shall—</text><paragraph id="idEA1BEC382887406F90858A2376888561"><enum>(1)</enum><text>be obtained using an accounting methodology that—</text><subparagraph id="idF8A7D65FADD048AD99E6D677BCA68D62"><enum>(A)</enum><text>is consistent with generally accepted accounting principles; and </text></subparagraph><subparagraph id="idC3EC0A96604747619AAF582D2C7A4CB9"><enum>(B)</enum><text>ensures no double counting of feedstock or fuel; and</text></subparagraph></paragraph><paragraph id="id91B9E150A875402B8ADE25543080753B"><enum>(2)</enum><text>be consistent with restrictions necessary to protect competitively sensitive information, in accordance with—</text><subparagraph id="id41C7F36AF4FE4A76AFBF160F95F289E1"><enum>(A)</enum><text>section 552 of title 5, United States Code;</text></subparagraph><subparagraph id="idB8D6F4EC1871423EA1FBE12A08FB3ED8"><enum>(B)</enum><text>section 1905 of title 18, United States Code; and</text></subparagraph><subparagraph id="id295F523163024638ABE671A7AB2257B8"><enum>(C)</enum><text>section 1004.11 of title 10, Code of Federal Regulations (or a successor regulation).</text></subparagraph></paragraph></subsection></section><section id="ided664c7b203d4f84a375cff3ee5a813b"><enum>3.</enum><header>Amendments to the Energy Policy Act of 2005</header><subsection commented="no" id="idA3B82B99E20149D1AF872F01E3A4B552"><enum>(a)</enum><header>Bioenergy program</header><text display-inline="yes-display-inline">Section 932(b)(5) of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/16232">42 U.S.C. 16232(b)(5)</external-xref>) is amended by inserting <quote>, including regenerative farming practices</quote> after <quote>feedstocks</quote>.</text></subsection><subsection commented="no" id="id85C7FF78BCFC42C0AFB3BF62920DBE4F"><enum>(b)</enum><header>Incentives for innovative technologies</header><text display-inline="yes-display-inline">Section 1703(b)(10) of the Energy Policy Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/42/16513">42 U.S.C. 16513(b)(10)</external-xref>) is amended by striking <quote>at which crude oil is refined into gasoline.</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="yes-display-inline" id="id08B1A4FBE05F4628A1F62AAC9508B596"><text>at which—</text><subparagraph commented="no" id="id4A6A6D260D9D40C0BBCB3A44D735D0C5"><enum>(A)</enum><text>crude oil is refined into gasoline; or</text></subparagraph><subparagraph commented="no" id="idC7C6C09E4AB24EE5B486A4D2AD42688E"><enum>(B)</enum><text>animal fats, vegetable oils, waste streams from materials from biogenic origin, or renewable biomass (as defined in section 211(o)(1) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7545">42 U.S.C. 7545(o)(1)</external-xref>), but excluding palm fatty acid distillates and palm oil) are refined into—</text><clause commented="no" id="idFCAFC24A5CB547EF96E3A5C9E58D9155"><enum>(i)</enum><text>renewable diesel; </text></clause><clause commented="no" id="idE387010A24C5496490EF9F66FF9800D5"><enum>(ii)</enum><text>renewable gasoline;</text></clause><clause commented="no" id="id6D1E714A4A6247DAADD3E927CFC24FED"><enum>(iii)</enum><text>renewable naphtha; or</text></clause><clause commented="no" id="idFB33B774AB694E7B958499BC7D7A0A84"><enum>(iv)</enum><text>sustainable aviation fuel (as defined in section 2(a) of the <short-title>Renewable Diesel and Sustainable Aviation Fuel Parity Act of 2022</short-title>).</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="id6F880BF3E8B742A8862F7322941A6ADE"><enum>4.</enum><header>Amendments to the Energy Independence and Security Act of 2007</header><text display-inline="no-display-inline">Section 205 of the Energy Independence and Security Act of 2007 (<external-xref legal-doc="usc" parsable-cite="usc/42/17021">42 U.S.C. 17021</external-xref>) is amended—</text><paragraph id="idAD62AD62830C48FC98425423B5CF8BD9"><enum>(1)</enum><text>in subsection (b)—</text><subparagraph id="idDFF925BDF2E8479D8A22296209BE354B"><enum>(A)</enum><text>by redesignating paragraphs (1) through (3) as subparagraphs (A) through (C), respectively, and indenting appropriately;</text></subparagraph><subparagraph id="id90D374B004E64D17B1F3F7F6A533303F"><enum>(B)</enum><text>in the matter preceding subparagraph (A) (as so redesignated), by striking <quote>Not later than</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id3DC410F1F99845F7A3313518046CCA17"><paragraph id="id83F8800F911C4529807B2E80E9D45355"><enum>(1)</enum><header>In general</header><text>Not later than</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph><subparagraph id="idEA553C0024F7461997FC7E8A36F7510A"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idC52095D30D8145F18AFBE0EC29C3E7EC"><paragraph id="id21548E0264EF4C8E803DB34DBE8F98C6"><enum>(2)</enum><header>Renewable diesel</header><text>Renewable diesel or renewable diesel blends that meet ASTM D975 diesel specifications shall not require any additional label.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id623E48A408E14729990EA2D8CE245F55"><enum>(2)</enum><text>in subsection (c)—</text><subparagraph id="idBAE396FE6FF7400CB4EA6D74725CA8D6"><enum>(A)</enum><text>by redesignating paragraphs (2) and (3) as paragraphs (3) and (2), respectively, and moving the paragraphs so as to appear in numerical order;</text></subparagraph><subparagraph id="id052C8A1DDA1D4463A23EB21B57A50267"><enum>(B)</enum><text>in paragraph (2) (as so redesignated)—</text><clause id="id164FCD192A014F0ABA0B8D3727AD0307"><enum>(i)</enum><text>by redesignating subparagraphs (A) and (B) as clauses (i) and (ii), respectively, and indenting appropriately;</text></clause><clause id="id4ADD13C554DC4D82B7483665D8EE0AA7"><enum>(ii)</enum><text>in the matter preceding clause (i) (as so redesignated), by striking <quote>The term</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idD4A26C21482F4CA7A4325178B73A8B07"><subparagraph id="id272A95D72CA14AE68C883D7B591905DF"><enum>(A)</enum><header>In general</header><text>The term</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause><clause id="idCFC5273D7A2A495A94028CB9B0A3ACA9"><enum>(iii)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id5C2B96F1CE104F5F8DF18B76A6B5FDE0"><subparagraph id="idC4D8D0DB791C487E9C50480CE86C79FF"><enum>(B)</enum><header>Exclusion</header><text>The term <term>biodiesel</term> does not include renewable diesel that meets or exceeds ASTM D975 diesel specifications.</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="idF489DFCAF204494C95488146B3D10D09"><enum>(C)</enum><text>in paragraph (3) (as so redesignated)—</text><clause id="id5CB4204B1D8F4B6993D745F7F1A3F3AD"><enum>(i)</enum><text>by striking <quote>The term</quote> and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idC80770C1095F440AA7979D17EE945D24"><subparagraph id="id671A32A153304153B5FD2EC644A6CCCB"><enum>(A)</enum><header>In general</header><text>The term</text></subparagraph><after-quoted-block>; and </after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="id2A211E14E6CB4FD69639BB6F880F0A17"><enum>(D)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id2FE646C408AD4EF29980141A99F8901A"><paragraph id="id6EEBAC5845F54AAE8126D2115C49BD84"><enum>(5)</enum><header>Renewable diesel</header><text>The term <term>renewable diesel</term> means diesel produced by refining animal fats, vegetable oils, waste streams from materials from biogenic origin, or renewable biomass (as defined in section 211(o)(1) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7545">42 U.S.C. 7545(o)(1)</external-xref>), but excluding palm fatty acid distillates and palm oil) in a manner that results in a hydrocarbon oil that— </text><subparagraph id="idD9826B764EE44C2389D22F3BBD41EFC9"><enum>(A)</enum><text>has a chemical structure similar to diesel; and</text></subparagraph><subparagraph id="id501E1F7BB0D040538E0557CC94046162"><enum>(B)</enum><text>meets ASTM D975 diesel specifications.</text></subparagraph></paragraph><paragraph id="idE7BE237FA32B435A9D827975EC2FAF62"><enum>(6)</enum><header>Renewable diesel blend</header><text>The term <term>renewable diesel blend</term> means a blend that contains—</text><subparagraph id="id9C02FC7D358E4FA98AB780217A81808B"><enum>(A)</enum><text>renewable diesel; and</text></subparagraph><subparagraph id="idCD6AE196309D461B98EC194E537E68F6"><enum>(B)</enum><text>petroleum-based diesel fuel.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section></legis-body></bill>
