<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>2d Session</session><legis-num>S. 4034</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20220407">April 7, 2022</action-date><action-desc><sponsor name-id="S357">Mrs. Fischer</sponsor> (for herself and <cosponsor name-id="S341">Mr. Blumenthal</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSCM00">Committee on Commerce, Science, and Transportation</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To provide authorization for nonpecuniary damages in an action resulting from a cruise ship voyage occurring on the high seas.</official-title></form><legis-body display-enacting-clause="yes-display-enacting-clause"><section section-type="section-one" id="S1"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Hammers' Law</short-title></quote>.</text></section><section id="id5c68a80e676a40e68040e1cdc4f9e99d"><enum>2.</enum><header>Limitations in certain cases</header><subsection id="idc7cbaf321e6247f5b983017f5384f8c9"><enum>(a)</enum><header>In general</header><text>Section 30307 of title 46, United States Code, is amended—</text><paragraph id="idd8a73762a1a24270a65fb6fb45c3d045"><enum>(1)</enum><text>in the section heading, by striking <quote><header-in-text level="section" style="USC">Commercial aviation accidents</header-in-text></quote> and inserting <quote><header-in-text level="section" style="USC">Limitations in certain cases</header-in-text></quote>;</text></paragraph><paragraph id="ideb14fb88c10a45f5a9fe9fe61b18db08"><enum>(2)</enum><text>by striking subsection (a) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id17510CD097A84FDCA6D5B30D28AEC930"><subsection id="idbac31b8c1c48433caddeff647e25e669"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id758b762fb92342a3b14ce126c637ae75"><enum>(1)</enum><header>Cruise ship</header><text>The term <term>cruise ship</term> means a passenger vessel, other than a vessel of the United States operated by the Federal Government or a vessel owned and operated by a State, that—</text><subparagraph id="ided30b03f7fc8457cac3e55a1f6a1ce84"><enum>(A)</enum><text>is authorized to carry at least 250 passengers;</text></subparagraph><subparagraph id="id3add71989a884bc087eb5955974f9954"><enum>(B)</enum><text>has onboard sleeping facilities for each passenger;</text></subparagraph><subparagraph id="ida4ae591bb7c54b759ced9ef2ac0a1a5f"><enum>(C)</enum><text>is on a voyage that embarks or disembarks passengers in the United States; and</text></subparagraph><subparagraph id="idfa710047809a473c826f8024302a72f0"><enum>(D)</enum><text>is not engaged on a coastwise voyage.</text></subparagraph></paragraph><paragraph id="id85a308efc0c1466fb9059a580ce292eb"><enum>(2)</enum><header>Nonpecuniary damages</header><text>The term <term>nonpecuniary damages</term> means damages for loss of care, comfort, and companionship.</text></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="id4e4f2a54c24743ba8b91086ab9f9117e"><enum>(3)</enum><text>in subsection (b), by inserting <quote>or cruise ship voyage</quote> after <quote>commercial aviation</quote>; and</text></paragraph><paragraph id="idc8b8f47b412b41c5b6d3a676cfaf229c"><enum>(4)</enum><text>in subsection (c), by inserting <quote>or cruise ship voyage</quote> after <quote>commercial aviation</quote>.</text></paragraph></subsection><subsection id="id9f768ac52d354523a5701615c4fddc10"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/303">chapter 303</external-xref> of title 46, United States Code, is amended by striking the item relating to section 30307 and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idAC46A333E25840F983288A6F61398B3B"><toc><toc-entry bold="off" level="section">30307.
