which was read twice and referred to the <committee-name committee-id="SSJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To amend <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/44">chapter 44</external-xref> of title 18, United States Code, to define <quote>State of residence</quote> and <quote>resident</quote>, and for other purposes.</official-title></form><legis-body><section id="S1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Traveler's Gun Rights Act</short-title></quote>.</text></section><section id="id860262C1DF93480BADEA15D7C6118ADD"><enum>2.</enum><header>State of residence</header><subsection id="id7A29DB78391547E28C48DAC11CA18E85"><enum>(a)</enum><header>Definitions</header><text display-inline="yes-display-inline">Section 921 of title 18, United States Code, is amended—</text><paragraph id="idF8C919F07B0142EDAF416CC25A8D643D"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)—</text><subparagraph id="id5F7E19315CC649009A6833BF53DB13F9"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>(a)</quote> before <quote>As used</quote>; and </text></subparagraph><subparagraph id="id67F96C626A594788871A326EB4BD20C2"><enum>(B)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id471DA4557F8D493DADCA40D3E8B9C078"><paragraph id="id836E73DA74ED4925845B4038DEF3DDAD"><enum>(36)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="idD03A32342D184F87A7C3BC15DCD27E75"><enum>(A)</enum><text>The term <term>State of residence</term> means—</text><clause id="id9432863a3c584ef19bc71eb02f437ff1" indent="up1"><enum>(i)</enum><text>the State in which an individual resides; </text></clause><clause id="id77e6792f8b944b09b4656ced6e2d0c55" indent="up1"><enum>(ii)</enum><text>in the case of an individual, or spouse of an individual, who is an active duty member of the Armed Forces—</text><subclause id="idE431351402EF4E2BBA2C2D553931DEFC"><enum>(I)</enum><text>the State in which the permanent duty station of the member is located; and</text></subclause><subclause id="id3FF8BF71BFCF4F3AB609AA81BB51AF6D"><enum>(II)</enum><text>the State in which the member maintains a place of abode from which the member commutes each day to the permanent duty station of the member; or</text></subclause></clause><clause id="id575e13a158044c1da2fd54841a11ad58" indent="up1"><enum>(iii)</enum><text>in the case of an individual who does not have a physical residence in any State, the State in which an individual maintains a private mailbox or post office box.</text></clause></subparagraph><subparagraph indent="up1" id="idAA97F12D3F9A4BEC9EF5D35B37C0F9B2"><enum>(B)</enum><text>For purposes of subparagraph (A)(i)—</text><clause id="id4B8B9D87993D45008CBF01F911EC6355"><enum>(i)</enum><text>an individual resides in a State if the individual is present in the State with the intention of making a home in that State; and</text></clause><clause id="id0EB88B7DADF04938806E586287FB2A0A"><enum>(ii)</enum><text>an individual who maintains a home in more than 1 State is a resident of each such State during the time when the individual is present in that State.</text></clause></subparagraph></paragraph><paragraph id="id7AE311ED0B314CAFB1696F1D63639EE4"><enum>(37)</enum><text>The term <term>resident</term>, with respect to a State, means an individual who satisfies clause (i), (ii), or (iii) of paragraph (36)(A) with respect to that State.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="id7FC53C22A7ED43D89DCE1AC90D144CF8"><enum>(2)</enum><text>by striking subsection (b).</text></paragraph></subsection><subsection id="idDDB0FB6E13AB41E29C8A27552335927B"><enum>(b)</enum><header>National instant criminal background check system</header><text>Section 922(t)(1)(C) of title 18, United States Code, is amended by striking <quote>transferee containing a photograph of the transferee.</quote> and inserting the following: “transferee—</text><quoted-block style="OLC" display-inline="no-display-inline" id="id5085B1554A95452B850D024B43BB35C4"><clause id="id71B5F37793694393A54DF59F94BCF91F" indent="up1"><enum>(i)</enum><text>containing a photograph of the transferee; and</text></clause><clause id="id73F028F3DA0D429B8C6A971FFD6BE1C9" indent="up1"><enum>(ii)</enum><text>containing—</text><subclause id="id3B6A602AD7CD448881AB72E7D05ECB1F"><enum>(I)</enum><text>the address of the residence of the transferee; or</text></subclause><subclause id="id6A1A857F306A45CEA18686AB64DF33D9"><enum>(II)</enum><text>the address for a private mailbox or post office box maintained by the transferee, if the transferee does not have a physical residence in any State.</text></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
