<distribution-code display="yes">II</distribution-code><congress>117th CONGRESS</congress><session>2d Session</session><legis-num>S. 4028</legis-num><current-chamber>IN THE SENATE OF THE UNITED STATES</current-chamber><action><action-date date="20220407">April 7, 2022</action-date><action-desc><sponsor name-id="S376">Ms. Ernst</sponsor> (for herself and <cosponsor name-id="S153">Mr. Grassley</cosponsor>) introduced the following bill; which was read twice and referred to the <committee-name committee-id="SSBK00">Committee on Banking, Housing, and Urban Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title>To require certain public housing agencies to absorb port-in housing choice vouchers, and for other purposes.</official-title></form><legis-body><section id="id3deb1425891540bf8e1bacb6f7c2df0e" section-type="section-one"><enum>1.</enum><header>Requiring certain public housing agencies to absorb port-in vouchers and limiting billing initial public housing agencies beyond 12 months</header><subsection id="idBD3ED0374C8B4D0F819247EF0B57A7C6"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 8(o) of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f(o)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id4e5bbdf933844283bfb2179f5081ce12"><paragraph id="id5c8f9eab3baa47d1b0284e83e1cc3171"><enum>(21)</enum><header>Portability of vouchers</header><subparagraph id="ide997cedc668f4a069735e0cedd3fcfcd"><enum>(A)</enum><header>Definitions</header><text>In this paragraph—</text><clause id="idc80fc10cb64b44808809cab5b0f14c8f"><enum>(i)</enum><text>the term <term>covered public housing agency</term> means a public housing agency that, in a given fiscal year, utilizes less than 95 percent of the budget authority available to the public housing agency; </text></clause><clause id="id9C20146E694A44CF91FE961788C85D32"><enum>(ii)</enum><text>the term <term>initial public housing agency</term> has the meaning given the term <term>initial PHA</term> in section 982.4 of title 24, Code of Federal Regulations, or any successor regulation; and </text></clause><clause id="id78B03C13E31C46289CD8F3B10BCAFFD5"><enum>(iii)</enum><text>the term <term>portable family</term> means a family holding a voucher under this subsection that seeks to rent a dwelling unit outside of the jurisdiction of the initial public housing agency.</text></clause></subparagraph><subparagraph id="id7c5963136903464facdaddc13140e1d6"><enum>(B)</enum><header>Requirement</header><text>A covered public housing agency that has jurisdiction over the area in which a portable family is seeking to use the voucher received from an initial public housing agency—</text><clause id="ide66fa36ef0384b39a22f456d43e544e9"><enum>(i)</enum><text>shall notify the initial public housing agency whether the covered public housing agency will—</text><subclause id="id22AD7B70595B444C894D0BB667AA515F"><enum>(I)</enum><text>absorb the voucher by using funds of the covered public housing agency; or</text></subclause><subclause id="id8E3EF98902AC41AA972C27CACE151B12"><enum>(II)</enum><text>bill the initial public housing agency for a period of not more than 12 months;</text></subclause></clause><clause id="idFF2F3879356C494ABDDD083A17511B82"><enum>(ii)</enum><text>shall make assistance payments to the portable family under an annual contributions contract entered into between the covered public housing agency and the Secretary; and</text></clause><clause id="id84272CBBB09D4ADFA0CCD9B9160145CD"><enum>(iii)</enum><text>may not bill the initial public housing agency for the assistance payments described in clause (ii) for a period of more than 12 months beginning on the effective date of the initial billing.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idE6681514CD0041129B955874C9A78747"><enum>(b)</enum><header>Technical amendment</header><text>Effective on December 27, 2022, paragraph (21) of section 8(o) of the United States Housing Act of 1937 (<external-xref legal-doc="usc" parsable-cite="usc/42/1437f">42 U.S.C. 1437f(o)</external-xref>), as added by section 101(b)(2)(B) of division Q of the Consolidated Appropriations Act, 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/116/260">Public Law 116–260</external-xref>; 134 Stat. 2462), is redesignated as paragraph (22).</text></subsection></section></legis-body></bill>
