U.S. Citizenship and Immigration Services access to criminal history records.</toc-entry></toc></subsection></section><section id="idafbcbb0560964d57ac6b3fb6730bc304"><enum>2.</enum><header>Human Rights Violators and War Crimes Center</header><subsection id="idfe5d917d045a4a2c964fad9bd57a8f3f"><enum>(a)</enum><header>Establishment</header><text>The Secretary of Homeland Security shall—</text><paragraph id="idfa1f6da230744ab48e34f96b9c697985"><enum>(1)</enum><text>establish the Human Rights Violators and War Crimes Center (referred to in this section as the <quote>Center</quote>) within U.S. Immigration and Customs Enforcement, Homeland Security Investigations; and</text></paragraph><paragraph id="ida50205b2c15448828e2192e97b28d637"><enum>(2)</enum><text>appoint a Director from Homeland Security Investigations to head the Center.</text></paragraph></subsection><subsection id="id9a25b9ddaab44832ada7517ad67ba122"><enum>(b)</enum><header>Duties</header><text>The Director of the Center (referred to in this section as the <quote>Director</quote>) shall—</text><paragraph id="id289958425ca64593945766cd093f4da2"><enum>(1)</enum><text>coordinate efforts to prevent the admission of foreign war crimes suspects, persecutors, and human rights abusers into the United States;</text></paragraph><paragraph id="id624593618f2f4494bc6ea47e28a3f50c"><enum>(2)</enum><text>identify and investigate individuals who have been involved in, or responsible for, the commission of human rights abuses throughout the world and are within the jurisdiction of the United States;</text></paragraph><paragraph id="id253bc067fd7e4bb198990aa4eaedf20a"><enum>(3)</enum><text>support the Office of the Principal Legal Advisor’s litigation of the removal proceedings of aliens implicated in human rights violations or war crimes;</text></paragraph><paragraph id="id946552fe5d3b431989d2bfe82d8cebd5"><enum>(4)</enum><text>coordinate with the Office of the Principal Advisor and Enforcement and Removal Operations to carry out the removal of individuals referred to in paragraphs (2) and (3), to the extent possible;</text></paragraph><paragraph id="id172252919a044f28a5bcef8bad0fa16e"><enum>(5)</enum><text>represent U.S. Immigration and Customs Enforcement while working with the National Security Council and other relevant government agencies in the development of programs for the prevention of mass atrocities;</text></paragraph><paragraph id="idc40e6314a1bf46e2bbe92da99de631fb"><enum>(6)</enum><text>conduct and coordinate training with other domestic and international law enforcement agencies on investigative best practices to develop and expand the capability of such agencies to identify, investigate, and prosecute individuals who—</text><subparagraph id="id726a811c472a4b179bed6731ad63eb76"><enum>(A)</enum><text>engage in genocide, torture, the recruitment and use of child soldiers, war crimes, female genital mutilation, or severe violations of religious freedom;</text></subparagraph><subparagraph id="idb9294d0944364bb3af6e7d643b5433bd"><enum>(B)</enum><text>provide material support to terrorists or organizations that engage in genocide, torture, or the recruitment and use of child soldiers; or</text></subparagraph><subparagraph id="id2b9282ac55c3454faa74589dd76fd010"><enum>(C)</enum><text>are human rights violators and engage in immigration fraud;</text></subparagraph></paragraph><paragraph id="id0fb5abe73715495a9186387ed86ddf86"><enum>(7)</enum><text>coordinate with other government agencies in the investigation of individuals whose actions should subject them to relevant travel and financial sanctions;</text></paragraph><paragraph id="idf7c3531b51194ff8858a37acf6c74ccc"><enum>(8)</enum><text>collect and integrate information regarding infringement of human rights and war crimes from domestic and international law enforcement agencies and other non-Federal sources;</text></paragraph><paragraph id="idcf7b78d29f9747f58b5a7842071bc6bd"><enum>(9)</enum><text>receive and organize information regarding infringement of human rights and war crimes from agencies and sources referred to in paragraph (8);</text></paragraph><paragraph id="id55f8b244bed3418eafde5bf2ed45129c"><enum>(10)</enum><text>disseminate information regarding the infringement of human rights and war crimes to other Federal agencies, as appropriate, to the extent authorized under relevant United States laws, regulations, directives, and policies;</text></paragraph><paragraph id="idbbbbaa0abb3e451497dc30b4951d1e42"><enum>(11)</enum><text>coordinate with the offices of United States Attorneys to develop expertise in, and assist with the investigation and prosecution of, crimes relating to the abuse of human rights and war crimes; and</text></paragraph><paragraph id="id8b043dfa5140491a87fe8a502c3a63fe"><enum>(12)</enum><text>carry out such other duties as the Secretary of Homeland Security may assign to the Director.</text></paragraph></subsection><subsection id="idc5d21f25b622453aa750e20cea72aea0"><enum>(c)</enum><header>Coordination with other agencies</header><text>In carrying out the duties described in subsection (b), the Director shall coordinate with any Federal, State, local, or international law enforcement agencies that the Secretary of Homeland Security, acting through the Director of U.S. Immigration and Customs Enforcement, considers appropriate.</text></subsection></section><section id="id1A56931C904E4380BBCBD15F9344CDA6"><enum>3.</enum><header>Grounds of inadmissibility and deportability for persecutors and war criminals</header><subsection id="ideacfaab7141544459ef2675eb6ae492e"><enum>(a)</enum><header>Definitions</header><text>Section 101(f) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(f)</external-xref>) is amended—</text><paragraph id="id01b1eb7f46ae43f2bb18d80bf168fa27"><enum>(1)</enum><text>in paragraph (8), by striking <quote>or</quote> at the end;</text></paragraph><paragraph id="id6E069CDB8D734F86908B29068BDD433A"><enum>(2)</enum><text>in paragraph (9), by striking the period at the end and inserting <quote>; or</quote>; and</text></paragraph><paragraph id="ide740d8343d3c42fda9365d8d8cbde46f"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idc3fb77236e13487d91b384ef1e94f12d"><paragraph id="id30f73bee30354f1b9aed81cabfe7e012"><enum>(10)</enum><text>one who, at any time, has ordered, incited, assisted, or otherwise participated in the persecution of any person on account of race, religion, nationality, membership in a particular social group, or political opinion.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="id395EB657EF09463DA9EB8695EB420640"><enum>(b)</enum><header>Grounds of inadmissibility</header><text display-inline="yes-display-inline">Section 212 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182</external-xref>) is amended—</text><paragraph id="id274912ACBCCE4212845F80B3D541F125"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)(3)(E)—</text><subparagraph id="ida38811819733427b84337237377885b3"><enum>(A)</enum><text>in the subparagraph header, by striking <quote><header-in-text level="subparagraph" style="OLC">nazi</header-in-text></quote>;</text></subparagraph><subparagraph id="id74258301A8B6441799FD381048AE8937"><enum>(B)</enum><text>in clause (iii)(II), by striking <quote>of any foreign nation</quote>; and</text></subparagraph><subparagraph id="id2c06c60cc92e46a098169ea137f3e42b"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id54d235616b0c4a05854b1d88123aa004"><clause id="ide4ce5a949b1e4024bdb287bb9b872ef6"><enum>(iv)</enum><header>Color of law</header><text>In this subparagraph and in section 237(a)(4)(D) only, acting under <quote>color of law</quote> includes acts taken as part of an armed group exercising de facto authority over any territory for any period of time.</text></clause><clause id="id944FE8EFCFAF4FD9B341F40AFA03972C"><enum>(v)</enum><header>Persecutors</header><text>Any alien who ordered, incited, assisted, or otherwise participated in the persecution of any person on account of race, religion, nationality, membership in a particular social group, or political opinion is inadmissible.</text></clause><clause id="id8AD08650D2014ADFB043AC42990B64EC"><enum>(vi)</enum><header>War crimes</header><text>Any alien who ordered, incited, assisted, or otherwise participated in war crimes (as defined in subsections (c) and (d)(1) (except subparagraph (A)) of section 2441 of title 18, United States Code), including offenders who have been lawfully admitted for permanent residence, offenders who are present in the United States, and offenders who are stateless persons whose habitual residence is in the United States, is inadmissible</text></clause><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="ida1afe194a7184ed3b282d9f46d9c0687"><enum>(2)</enum><text>in subsection (d)(3)(A), by striking <quote>and clauses (i) and (ii) of paragraph</quote> each place such phrase appears.</text></paragraph></subsection><subsection id="id6984d2d2f0424e0b89837e57ef31b04c"><enum>(c)</enum><header>Grounds of deportability</header><text>Section 237(a)(4)(D) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/237">8 U.S.C. 237(a)(4)(D)</external-xref>) is amended—</text><paragraph id="idf645960dcefc4408b8b3ec492c2e0c02"><enum>(1)</enum><text>in the subparagraph header, by striking <quote><header-in-text level="subparagraph" style="OLC">nazi</header-in-text></quote>; and</text></paragraph><paragraph id="ided4b169fb6454d37a18f09f497cb3b95"><enum>(2)</enum><text>by striking <quote>or (iii)</quote> and inserting <quote>(iii), (v), or (vi).</quote>.</text></paragraph></subsection><subsection id="id738f082e7b024ba09114072d98091e40"><enum>(d)</enum><header>Voluntary departure</header><text>Section 240B of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1229c">8 U.S.C. 1229c</external-xref>) is amended—</text><paragraph id="idb728e02dbff54e4fac90616a16cebeb1"><enum>(1)</enum><text>in subsection (a)(1), by striking <quote>deportable under section 237(a)(2)(A)(iii) or section 237(a)(4)(B)</quote> and inserting <quote>deportable under paragraph (2)(A)(iii) or (4) of section 237(a), or inadmissible under subparagraph (E) or (G) of section 212(a)(3)</quote>; and</text></paragraph><paragraph id="id4cf31785fd3641d091e6df94c1c32f4a"><enum>(2)</enum><text>in subsection (b)(1)(C), by striking <quote>deportable under section 237(a)(2)(A)(iii) or section 237(a)(4)</quote> and inserting <quote>deportable under paragraph (2)(A)(iii) or (4) of section 237(a), or inadmissible under subparagraph (E) or (G) of section 212(a)(3)</quote>.</text></paragraph></subsection><subsection id="id2643e5f44943459f8aafa2ffc170462b"><enum>(e)</enum><header>Adjustment of status</header><text>Section 245(c) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1255">8 U.S.C. 1255(c)</external-xref>) is amended—</text><paragraph commented="no" id="ide43343e8ea864e019bd406df7a201ad8"><enum>(1)</enum><text>in paragraph (6), by striking <quote>(B)</quote>;</text></paragraph><paragraph commented="no" id="id907C384940B14B518B0606B791EECF2E"><enum>(2)</enum><text>in paragraph (7), by striking <quote>or</quote> at the end; and</text></paragraph><paragraph id="id1D98A85D7E3049AB990C2B5E1BF3CCFC"><enum>(3)</enum><text>in paragraph (8), by striking the period at the end and inserting <quote>; (9) any alien who at any time has ordered, incited, assisted, or otherwise participated in the persecution of any person on account of race, religion, nationality, membership in a particular social group, or political opinion; or (10) any alien who is inadmissible under section 212(a)(3)(E)(vi).</quote>.</text></paragraph></subsection><subsection id="id1a320e83bfbc426e9afe831d1c3bb2b7"><enum>(f)</enum><header>Aiding or assisting certain aliens To enter the United States</header><text>Section 277 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1327">8 U.S.C. 1327</external-xref>) is amended by striking <quote>(other than subparagraph (E) thereof)</quote>.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idAAA9D023C6024CD5BA824161D086EFFC"><enum>(g)</enum><header>Applicability</header><text>The amendments made by subsections (a) through (e) shall apply to offenses committed before, on, or after the date of the enactment of this Act. </text></subsection></section><section id="id5e5adbb5ef534087abfada4a8fb07189"><enum>4.</enum><header>Inadmissibility and deportability for participation in female genital mutilation</header><subsection id="id1a845c0f77924b3585609516b1e52d5f"><enum>(a)</enum><header>Inadmissibility</header><text>Section 212(a)(3) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(a)(3)</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id4EE641626EF1433296F2BBB0A9C248D0"><subparagraph id="ide5e7cdaba47947239bd4a3c2e8e36934"><enum>(H)</enum><header>Participation in female genital mutilation</header><text>Any alien who has ordered, incited, solicited, funded, assisted, or otherwise participated in female genital mutilation is inadmissible.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id50f71df26a7f4603a503746ebf8c65db"><enum>(b)</enum><header>Deportability</header><text>Section 237(a)(4) of such Act (8 U.S.C. 1227 (a)(4)) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id667DE49A88244E2694E6CDC31E0E8741"><subparagraph id="id72d3294ddd2643848fa6e238fab9b7a8"><enum>(G)</enum><header>Participation in female genital mutilation</header><text>Any alien who has ordered, incited, solicited, funded, assisted, or otherwise participated in female genital mutilation is deportable.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="idb05c028799de42dba8651dca8fdcfc31"><enum>(c)</enum><header>Savings provision</header><text>Nothing in the amendments made by this section may be construed to limit the applicability of grounds of inadmissibility or removal to conduct occurring before the date of the enactment of this Act. </text></subsection></section><section id="idc0d04f0d2e6a4957b12072d8d5f16baa"><enum>5.</enum><header>Statute of limitations for visa, naturalization, and other fraud offenses involving human rights violations</header><subsection id="id5bf59a8bf5b542fa8ff293e11e8d74d2"><enum>(a)</enum><header>Statute of limitations for visa fraud and other offenses</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/213">Chapter 213</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="id9c63c42d3754468291f4c4d0e4550d30"><section section-type="subsequent-section" id="ida1ae7703b261472e8891a6f51248fe50"><enum>3302.</enum><header>Fraud in connection with certain human rights violations</header><subsection id="idbd305b5c52ce470eb280729bc5941e13"><enum>(a)</enum><header>In general</header><text>A person shall be prosecuted, tried, or punished for violation of any provision of section 1001, 1015, 1425, 1546, 1621, or 3291, or for attempt or conspiracy to violate any provision of such sections, if—</text><paragraph id="id08c8be9a9e784ac2a3d016626a5a3e29"><enum>(1)</enum><text>the fraudulent conduct, misrepresentation, concealment, or fraudulent, fictitious, or false statement concerns the alleged offender’s—</text><subparagraph id="ide805d28a9a4347ff85f787e1ffe1db02"><enum>(A)</enum><text>participation, at any time, at any place, and regardless of the nationality of the alleged offender or any victim, in a human rights violation; or</text></subparagraph><subparagraph id="id3aebd6dcd2d245a8b9e599f176c284a4"><enum>(B)</enum><text>membership in, service in, or authority over a military, paramilitary, or law enforcement organization that participated in such conduct during any part of any period in which the alleged offender was a member of, served in, or had authority over the organization; and</text></subparagraph></paragraph><paragraph id="id2eadea9e16c64487b0e58e34adf8b309"><enum>(2)</enum><text>the indictment is found or the information is instituted not later than 20 years after such conduct.</text></paragraph></subsection><subsection id="id8ecb86a1759640649205084dc3fcbcea"><enum>(b)</enum><header>Definitions</header><paragraph id="id363AB3182AF342ACAF8B9200793904D2"><enum>(1)</enum><header>Human rights violation</header><text>In this section, the term <term>human rights violation</term> means extrajudicial killing, female genital mutilation, genocide, particularly severe violations of religious freedom, persecution, torture, the use or recruitment of child soldiers, or war crimes.</text></paragraph><paragraph id="id5365D1D34DDB413BA6957CFD54667E94"><enum>(2)</enum><header>Related definitions</header><text>In paragraph (1)—</text><subparagraph id="id83ff8333be1c45918738e02f317881fd"><enum>(A)</enum><text>the term <term>extrajudicial killing</term> means conduct described in section 212(a)(3)(E)(iii) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(a)(3)(E)(iii)</external-xref>);</text></subparagraph><subparagraph id="id8d1f20505ff7441d9a442da7b0bac706"><enum>(B)</enum><text>the term <term>female genital mutilation</term> means conduct described in section 116;</text></subparagraph><subparagraph id="id044e967803e44356b9e55ccdccd836a2"><enum>(C)</enum><text>the term <term>genocide</term> means conduct described in subsections (a), (c), and (e) of section 1091;</text></subparagraph><subparagraph id="id1d031b6777104966af15c1e2ab9688ae"><enum>(D)</enum><text>the term <term>particularly severe violation of religious freedom</term> means conduct described in section 3(13) of the International Religious Freedom Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/22/6402">22 U.S.C. 6402(13)</external-xref>);</text></subparagraph><subparagraph id="id12733168d85a4c38be8b9c5f9a577d98"><enum>(E)</enum><text>the term <term>persecution</term> means conduct described in section 212(a)(3)(E)(v) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(a)(3)(E)(v)</external-xref>);</text></subparagraph><subparagraph id="id9137bb42fa414e569836c8971e0a8be3"><enum>(F)</enum><text>the term <term>torture</term> means conduct described in paragraphs (1) and (2) of section 2340;</text></subparagraph><subparagraph id="ida427e2b9f265455a9d0c72ab3b0429a6"><enum>(G)</enum><text>the term <term>use or recruitment of child soldiers</term> means conduct described in subsections (a) and (d) of section 2442; and</text></subparagraph><subparagraph id="id57d58abc8ae340f28faeff7a50d4e509"><enum>(H)</enum><text>the term <term>war crimes</term> means conduct described in subsections (c) and (d)(1) of section 2441.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id49148899d0fc4f37a056401db3335b80"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/213">chapter 213</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" id="id63db0fb5-b0c2-4cca-a27f-5fba973bca34"><toc><toc-entry level="section" idref="ida1ae7703b261472e8891a6f51248fe50">3302. Fraud in connection with certain human rights violations.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection commented="no" display-inline="no-display-inline" id="idffcd20c339644fdd98dc625ab26c386d"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall apply to fraudulent conduct, misrepresentations, concealments, and fraudulent, fictitious, or false statements made or committed on or after the date of the enactment of this Act. </text></subsection></section><section id="idfc9e4705fb89441181d54b7480ceb66a"><enum>6.</enum><header>Visa security and national security fee</header><subsection id="id8739af9e029b48998a1951b7a11b87bb"><enum>(a)</enum><header>In general</header><paragraph id="id89DB81F895FB499286D8BAA136481B1E"><enum>(1)</enum><header>Authorization</header><text>The Secretary of Homeland Security is authorized to charge a visa security and national security fee to nonimmigrant visa applicants. </text></paragraph><paragraph id="idFEB59AD509F549DA9848FFD31829069E"><enum>(2)</enum><header>Collection</header><text>The Secretary of State, at the request of, and in coordination with, the Secretary of Homeland Security, is authorized to collect the fee authorized under paragraph (1) simultaneously with the fees authorized under section 140 of the Foreign Relations Authorization Act, Fiscal Years 1994 and 1995 (<external-xref legal-doc="public-law" parsable-cite="pl/103/236">Public Law 103–236</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/8/1351">8 U.S.C. 1351</external-xref> note) and section 103 of the Enhanced Border Security and Visa Entry Reform Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/8/1713">8 U.S.C. 1713</external-xref>), on behalf of the Secretary of Homeland Security—</text><subparagraph id="ida6711059c23146b6a3fcb7d85b51529c"><enum>(A)</enum><text>to conduct pre-adjudication reviews and screenings of visa applications against appropriate criminal, national security, and terrorism databases maintained by the Federal Government;</text></subparagraph><subparagraph id="id977d332b3ff541529fecb258a3093c3e"><enum>(B)</enum><text>to carry out other support activities authorized under section 428(e) of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/236">6 U.S.C. 236(e)</external-xref>);</text></subparagraph><subparagraph id="idc405fa0ceae74450972f0ee7f94b59d0"><enum>(C)</enum><text>to identify, arrest, and remove terrorists, human rights violators, and national security threats from the United States; and</text></subparagraph><subparagraph id="id7FEF408481BD43C4A00A169EE5D521C8"><enum>(D)</enum><text>for other purposes.</text></subparagraph></paragraph></subsection><subsection id="id7166c5bef4c34c86b189abc973e14337"><enum>(b)</enum><header>Amount of fee</header><text>The total amount of fees charged pursuant to subsection (a)(1) shall be sufficient to cover the annual costs to conduct the activities authorized under subsection (a)(2), the activities authorized under section 428(e) of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/236">6 U.S.C. 236(e)</external-xref>), and related activities.</text></subsection><subsection id="id5bb3ca0abab64b548bdc9fce5ee648da"><enum>(c)</enum><header>Deposit of fees</header><text>Fees collected under subsection (a)(2)—</text><paragraph id="id513c6a08ddaf4e998589ae8578afafc4"><enum>(1)</enum><text>shall be deposited into the Immigration Examinations Fee Account established under section 286(m) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1356">8 U.S.C. 1356(m)</external-xref>) in the Treasury of the United States; and</text></paragraph><paragraph id="idf7ceb4ce807e4290ab5c41f981aaf24f"><enum>(2)</enum><text>shall remain available until expended for the Secretary of Homeland Security to carry out the activities described in subsection (b).</text></paragraph></subsection><subsection id="idc8974fdd78c9497aa78c714b84222020"><enum>(d)</enum><header>Reimbursement</header><paragraph id="id1be659acb3894f9ab9bf78945ae9dedb"><enum>(1)</enum><header>In general</header><text>The Secretary of Homeland Security shall reimburse expenses incurred by the Secretary of State to collect the fee authorized under subsection (a)(1).</text></paragraph><paragraph id="idb06d3ad1c5a9495c81a3957b97dfaae3"><enum>(2)</enum><header>Use of reimbursed funds</header><text>Reimbursements received pursuant to paragraph (1)—</text><subparagraph id="idbd89941ff834442f8b3058f78c4e979d"><enum>(A)</enum><text>shall be deposited into the appropriate Department of State account, as identified by the Secretary of State; and</text></subparagraph><subparagraph id="ida377bb185f8a4293986054816971c3d0"><enum>(B)</enum><text>shall remain available until expended to cover expenses described in paragraph (1).</text></subparagraph></paragraph></subsection><subsection id="idae84350478154ad0ba14fea01ad3c6f6"><enum>(e)</enum><header>Annual report</header><text>Not later than 1 year after the date of the enactment of this Act, and annually thereafter on or before October 1, the Secretary of Homeland Security, after consultation with the appropriate Federal agencies, shall submit a report to the <committee-name committee-id="SSJU00">Committee on the Judiciary of the Senate</committee-name>, the <committee-name committee-id="SSGA00">Committee on Homeland Security and Governmental Affairs of the Senate</committee-name>, the <committee-name committee-id="">Committee on the Judiciary of the House of Representatives</committee-name>, and the <committee-name committee-id="">Committee on Homeland Security of the House of Representatives</committee-name> that identifies, for the reporting period—</text><paragraph id="idd04ad728356d4934acba110f2d623268"><enum>(1)</enum><text>the number of aliens denied visas under Homeland Security Investigation’s Visa Security Program;</text></paragraph><paragraph id="id4d91b57bea704803a482d7cfa31851b2"><enum>(2)</enum><text>the number of aliens inadmissible to or removed from the United States for violating section 116 of title 18, United States Code (relating to female genital mutilation); and</text></paragraph><paragraph id="id36e54db063e445fba2fa64c812b02907"><enum>(3)</enum><text>the number of aliens inadmissible to or removed from the United States as terrorists, human rights violators, persecutors, or national security threats.</text></paragraph></subsection></section><section id="id59962413ba0846088f24b5ec0570c336"><enum>7.</enum><header>U.S. Citizenship and Immigration Services access to criminal history records</header><subsection id="id90e2119e2fd442a7bd4a24bd343695ac"><enum>(a)</enum><header>In general</header><text>In addition to any other access to criminal history records authorized for noncriminal justice purposes under the National Criminal History Access and Child Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/34/40311">34 U.S.C. 40311 et seq.</external-xref>), the Attorney General and the Director of the Federal Bureau of Investigation shall provide the Secretary of Homeland Security, for purposes relating to immigration and naturalization matters, with—</text><paragraph id="id2ad97b846cfd4858b5527e23aa0e4292"><enum>(1)</enum><text>direct access to criminal history records without submission of positive identification, including name check access to the Interstate Identification Index System; and</text></paragraph><paragraph id="id34c78f8005a64915bbbe6d5d690a7f87"><enum>(2)</enum><text>access to sealed record information and any other criminal history information on the same terms as are provided to an agency performing a criminal justice or law enforcement purpose.</text></paragraph></subsection><subsection id="id3d058d8938ae4a32bd5fb511d6e2fddd"><enum>(b)</enum><header>Rule of construction</header><text>Terms used in subsection (a) shall have the meanings provided under section 213 of the National Criminal History Access and Child Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/34/40312">34 U.S.C. 40312</external-xref>).</text></subsection></section></legis-body></bill>
