Administration. </text></paragraph><paragraph id="idb837805c85c84af7b14f06268f8ff52e"><enum>(2)</enum><header>Covered mortgage obligation; covered rent obligation; covered supplier cost; covered utility payment; covered worker protection expenditure</header><text>The terms <quote>covered mortgage obligation</quote>, <quote>covered rent obligation</quote>, <quote>covered supplier cost</quote>, <quote>covered utility payment</quote>, and <quote>covered worker protection expenditure</quote> have the meanings given the terms in section 7A(a) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636m">15 U.S.C. 636m(a)</external-xref>). </text></paragraph><paragraph id="id0f9062618f3947668ebe537f50ecb270"><enum>(3)</enum><header>Exchange; issuer; security</header><text>The terms <quote>exchange</quote>, <quote>issuer</quote>, and <quote>security</quote> have the meanings given those terms in section 3(a) of the Securities Exchange Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/15/78c">15 U.S.C. 78c(a)</external-xref>). </text></paragraph><paragraph id="iddea59e6157b84171bfa1186e9022195b"><enum>(4)</enum><header>National securities exchange</header><text>The term <term>national securities exchange</term> means an exchange that is registered in accordance with section 6 of the Securities Exchange Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/15/78f">15 U.S.C. 78f</external-xref>). </text></paragraph><paragraph id="id518ddcd51edb45d88f8705d625f1987f"><enum>(5)</enum><header>Payroll costs</header><text>The term <term>payroll costs</term> has the meaning given the term in section 7(a)(36)(A) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(a)(36)(A)</external-xref>), except that such term shall not include—</text><subparagraph id="idaed20e93f73040fc9469954bccf510c6"><enum>(A)</enum><text>qualified wages (as defined in subsection (c)(3) of section 2301 of the CARES Act (<external-xref legal-doc="usc" parsable-cite="usc/26/3111">26 U.S.C. 3111</external-xref> note)) taken into account in determining the credit allowed under such section 2301; or</text></subparagraph><subparagraph id="id89f7c0ad24e14cee865e8e71c4ae1b71"><enum>(B)</enum><text>premiums taken into account in determining the credit allowed under <external-xref legal-doc="usc" parsable-cite="usc/26/6432">section 6432</external-xref> of the Internal Revenue Code of 1986.</text></subparagraph></paragraph><paragraph id="idb22299ee996844da943401eb37101339"><enum>(6)</enum><header>Private equity fund</header><text>The term <term>private equity fund</term> has the meaning given the term in section 225.173(a) of title 12, Code of Federal Regulations, or any successor regulation.</text></paragraph><paragraph id="id4890e90e772f4d4180f6796d958dca52"><enum>(7)</enum><header>Publicly-traded company</header><text>The term <term>publicly-traded company</term> means an entity that is majority owned or controlled by an entity that is an issuer, the securities of which are listed on a national securities exchange.</text></paragraph><paragraph id="id4b1d6d9acd4048d9a290f09ac0c69c8d"><enum>(8)</enum><header>Tribally-owned concern</header><text>The term <term>Tribally-owned concern</term> has the meaning given the term in section 124.3 of title 13, Code of Federal Regulations, or any successor regulation. </text></paragraph></section><title id="idFCCF3DB50B2149EDB84A0CF9D6F403C2" style="OLC"><enum>I</enum><header>Restaurant Revitalization Fund replenishment and improvements</header><section id="iddfbf77650f8d4767bd32b1ff5450dd03" commented="no"><enum>101.</enum><header>Appropriation</header><text display-inline="no-display-inline">Section 5003 of the American Rescue Plan Act of 2021 (<external-xref legal-doc="usc" parsable-cite="usc/15/9009c">15 U.S.C. 9009c</external-xref>) is amended—</text><paragraph id="ide91db7aca4bb494f9d690e866e287bbc" commented="no"><enum>(1)</enum><text>in subsection (b)(2)—</text><subparagraph id="idF3058F403BD64B91A1AEB37A4EF2BDBF" commented="no"><enum>(A)</enum><text>in subparagraph (A)—</text><clause id="id846e896bbfe04edea0ff3d6856f90582" commented="no"><enum>(i)</enum><text>by striking <quote>$28,600,000,000</quote> and inserting <quote>$68,600,000,000</quote>; and</text></clause><clause id="id896c0be2abb04319ad4f36d6b1441068" commented="no"><enum>(ii)</enum><text>by inserting <quote>, of which not more than $250,000,000 shall be for administrative expenses to carry out this section and of which $20,000,000 shall be for the Inspector General of the Small Business Administration for audits of grants under this section to investigate fraud and to identify improper payments and ineligible recipients, and for other necessary expenses of the Office of the Inspector General</quote> before the period at the end; and </text></clause></subparagraph><subparagraph id="id3f0abd58b52d46d4aa0209fc43ffde35" commented="no"><enum>(B)</enum><text>in subparagraph (B)(i)(II), by striking <quote>$23,600,000,000</quote> and inserting <quote>any remaining amounts not used for a purpose authorized under subparagraph (A) or clause (i) of this subparagraph</quote>; and</text></subparagraph></paragraph><paragraph id="idC452B64145B146928BD5AFE10BEE1161" commented="no"><enum>(2)</enum><text>in subsection (c)—</text><subparagraph id="id6625E2E0A45142649BD005A6EC7EBFC0" commented="no"><enum>(A)</enum><text>in paragraph (1), by striking <quote>and paragraph (3)</quote>; and</text></subparagraph><subparagraph id="id2ae1263189a84d79a45805b9e4e9daef" commented="no"><enum>(B)</enum><text>by striking paragraph (3).</text></subparagraph></paragraph></section><section id="id805B67440B144D0CA73D15BE4DB52228"><enum>102.</enum><header>Insufficient funding</header><text display-inline="no-display-inline">Section 5003 of the American Rescue Plan Act of 2021 (<external-xref legal-doc="usc" parsable-cite="usc/15/9009c">15 U.S.C. 9009c</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="idA7FC34F72CEA496397DD711C19F165BE"><subsection id="idF7FADCBDDF1F4CC0B4376FEE1842D01B"><enum>(d)</enum><header>Insufficient funding</header><paragraph id="idB2BC5170FDA94B8F93B545B1D9EFD2EF"><enum>(1)</enum><header>In general</header><text>If the Administrator determines that the amounts made available to carry out this section are insufficient to make grants in the amount provided in subsection (c)(4) to each eligible entity that has submitted an application in accordance with the program guidelines in effect on the day before the date of enactment of this subsection, but has not received an award as of such date, the Administrator shall make grants with the available amounts to each such eligible applicant— </text><subparagraph id="id70F83BDBE6E54FCD8F4F52D00D0A60E5"><enum>(A)</enum><text>such that the amount of the grant that each such eligible entity would have otherwise received under this section is reduced by an equal percentage; </text></subparagraph><subparagraph id="ida99e772e473240109ce150ac0b7631ef"><enum>(B)</enum><text>by establishing a maximum amount for a grant made under this subsection to ensure that smaller eligible entities still receive grants in the amounts provided under subsection (c)(4); or </text></subparagraph><subparagraph id="id2430776B7F574F889C075C0BC1CCB0A2"><enum>(C)</enum><text>by providing full awards in the amounts provided under subsection (c)(4) below a certain threshold (as the Administrator may establish) and reducing grants above that threshold by an equal percentage.</text></subparagraph></paragraph><paragraph id="id4447d264abfc4b60a6f8953594fd02e6"><enum>(2)</enum><header>Reserving funds</header><text>Nothing in paragraph (1) shall prevent the Administrator from— </text><subparagraph id="idF84AA1ED9D5A46F99F95DD2032475F9B"><enum>(A)</enum><text>reserving funding for applicants that may be determined to be eligible for a grant under this section upon reconsideration; or </text></subparagraph><subparagraph id="id56D2CCF139964676B96AFBA3C267C8BA"><enum>(B)</enum><text>making partial awards to eligible entities on a preliminary basis until the amount of funding required to fund grants to all eligible applicants is established, upon the completion of the reconsideration process.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id41bb6c3a80f14e75a41aff16524d835e"><enum>103.</enum><header>Data transparency and customer service</header><text display-inline="no-display-inline">Section 5003 of the American Rescue Plan Act of 2021 (<external-xref legal-doc="usc" parsable-cite="usc/15/9009c">15 U.S.C. 9009c</external-xref>), as amended by section 102 of this Act, is amended by adding at the end the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="id460855006D8048E49110A2A84725AD2B"><subsection id="id46AC3875FEBE48DCB5871399939DAA2E"><enum>(e)</enum><header>Reports</header><text display-inline="yes-display-inline">The Administrator shall—</text><paragraph id="idfecaa76f978d4a6fb1217cd3b7842ea0"><enum>(1)</enum><text>on a biweekly basis until the amounts made available to carry out this section are fully expended, publish data that shows, for the period beginning on the date on which the Administrator began making grants under this section and ending on the date on which the information is published—</text><subparagraph id="id4cfa7f8f96f844e2a8c22b7151aea801"><enum>(A)</enum><text>with respect to applications for grants under this section, the number of those applications—</text><clause id="id7440ca7918ec48dc96842349739c2b86"><enum>(i)</enum><text>that the Administrator has received;</text></clause><clause id="id6c5a258c1a2f4e02af56397a746d5e57"><enum>(ii)</enum><text>that the Administrator has reviewed or is in the process of reviewing; and</text></clause><clause id="idb01014ed796544d299767d04986ba25f"><enum>(iii)</enum><text>with respect to which the Administrator has made a decision; and</text></clause></subparagraph><subparagraph id="id5d025562013f45babb4aad51793ac472"><enum>(B)</enum><text>the number and dollar amount of grants under this section—</text><clause id="id323EB9CFD31F445BB09DD0C5F1135D88"><enum>(i)</enum><text>that have been awarded; and</text></clause><clause id="idE76337DF91294E2286366FBD760D2851"><enum>(ii)</enum><text>that have been disbursed; </text></clause></subparagraph></paragraph><paragraph id="idab7433673570445b87b30b43cae3a930"><enum>(2)</enum><text>on a weekly basis until the amounts made available to carry out this section are fully expended, publish, with respect to the period beginning on the date of enactment of this subsection and ending on the date on which the information is published—</text><subparagraph id="id1a78babbb99141e998bb04d3758fa9f4"><enum>(A)</enum><text>with respect to each eligible entity to which a grant is made under this section—</text><clause id="id7837e81b0d454479b08024797cda6784"><enum>(i)</enum><text>the name of the eligible entity, including the name or names under which the eligible entity does business if that name is different from the name of the eligible entity; and</text></clause><clause id="idcf0309bb0c2b43c3bf6ce28525b79eef"><enum>(ii)</enum><text>the address of— </text><subclause id="id71946D8FAE5B434F8FEA7CC2262FFC6B"><enum>(I)</enum><text>the eligible entity; and</text></subclause><subclause id="idC24E8540E68749688D18082DFBEDFB01"><enum>(II)</enum><text>the physical location or locations for the eligible entity listed on the application, if different from the address of the eligible entity;</text></subclause></clause></subparagraph><subparagraph id="id6de99372740b44edad9d6525d0222d6e"><enum>(B)</enum><text>the amount of each grant described in subparagraph (A); and</text></subparagraph><subparagraph id="idc9cf2452eaea4229942b0d730f843be2"><enum>(C)</enum><text>the business category listed in subsection (a)(4)(A) to which the eligible entity belongs; and</text></subparagraph></paragraph><paragraph id="id88fc92403f8c4cdf82404ab324f9a9d0"><enum>(3)</enum><text>with respect to an applicant that applies for a grant under this section and is denied by the Administrator—</text><subparagraph id="idd7ee1a2145d84d17ac65f06dd8bd3d5c"><enum>(A)</enum><text>make available to the applicant a brief explanation identifying the reason why the Administrator denied the application of the applicant, which shall include, where applicable, a citation to the statutory, regulatory, or guidance provision with which the applicant failed to comply and that was the basis for the denial; and</text></subparagraph><subparagraph id="id30cf572d08344868bb54a19ae0b0e4b0"><enum>(B)</enum><text>establish a reconsideration process through which the applicant may—</text><clause id="idF36B1AACAF8749CF8327EAD551E3E22B"><enum>(i)</enum><text>submit to the Administrator additional information the applicant determines to be relevant to whether the applicant is eligible for the grant; </text></clause><clause id="id7c7d377903f343bf95d68724382b92f8"><enum>(ii)</enum><text>challenge the decision of the Administrator; and</text></clause><clause id="idc1727f8c4c9741aaa10d1e63dd408c4f"><enum>(iii)</enum><text>receive a second review of the application submitted by the applicant.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id8a73c27b007e4e49ad146f1d99a09920"><enum>104.</enum><header>Oversight and audits</header><text display-inline="no-display-inline">Section 5003 of the American Rescue Plan Act of 2021 (<external-xref legal-doc="usc" parsable-cite="usc/15/9009c">15 U.S.C. 9009c</external-xref>), as amended by section 103 of this Act, is amended by adding at the end the following: </text><quoted-block style="OLC" display-inline="no-display-inline" id="id8330D2899DF84356B03C114E50D2EA8D"><subsection id="id5728B5A020FC4A9EBA7CAB54FCBF1D7F"><enum>(f)</enum><header>Oversight and audits</header><paragraph id="id886a26ef34f94db5b1bc295d912a65ff"><enum>(1)</enum><header>In general</header><text>The Administrator shall institute an oversight and audit plan with respect to eligible entities receiving grants under this section, which shall include—</text><subparagraph id="id41b2f3d482c7428e8909f0566f0d98ae"><enum>(A)</enum><text>documentation requirements that are consistent with the eligibility and other requirements under this section, including by requiring an eligible entity that receives a grant under this section to retain records that demonstrate compliance with those requirements; and</text></subparagraph><subparagraph id="id012801aa0aa84b9a89d14c8b9a8e811c"><enum>(B)</enum><text>reviews of the use, by eligible entities, of grants made under this section to ensure compliance with the requirements of this section, which shall include—</text><clause id="idac5382a3572042878e01fe88b589b71b"><enum>(i)</enum><text>the review and audit, by the Administrator, of grants made under this section; and</text></clause><clause id="id4c02f93328dc49ab94696c1410d4816c"><enum>(ii)</enum><text>in the case of fraud or other material noncompliance with respect to a grant made under this section—</text><subclause id="ida819aaae734c4d6d8c02a0547ded957c"><enum>(I)</enum><text>a requirement that the applicable eligible entity repay to the Administrator the amount of the misspent funds; or</text></subclause><subclause id="idfe1c35d133164ad2b6d181f85e9f956b"><enum>(II)</enum><text>the pursuit, by the Administrator, of legal action to collect the misspent funds.</text></subclause></clause></subparagraph></paragraph><paragraph id="id469ffca133d049e181cb11d3b13796c0"><enum>(2)</enum><header>Submission of plan</header><text>Not later than 30 days after the date of enactment of this subsection, the Administrator shall submit to the Committee on Small Business and Entrepreneurship of the Senate and the Committee on Small Business of the House of Representatives the plan required under paragraph (1), which shall describe—</text><subparagraph id="id54095091cbcc42c7a91a5fc9fef7a17a"><enum>(A)</enum><text>the policies and procedures of the Administrator for conducting oversight and audits of grants made under this section; and</text></subparagraph><subparagraph id="id37535faea9154040aa0af51f47d69300"><enum>(B)</enum><text>the metrics that the Administrator will use to determine which grants made under this section will be audited under that plan.</text></subparagraph></paragraph><paragraph id="id1549821f6e574181935dd96eb1635342"><enum>(3)</enum><header>Reports</header><text>Not later than 60 days after the date of enactment of this subsection, and once every 30 days thereafter until the date that is 180 days after the date on which all amounts made available to carry out this section have been fully expended, and upon request thereafter, the Administrator shall submit to the Committee on Small Business and Entrepreneurship of the Senate and the Committee on Small Business of the House of Representatives a report on the oversight and audit activities of the Administrator under this subsection, which shall include—</text><subparagraph id="id57af9043b13b4145ab5f5a89614b4483"><enum>(A)</enum><text>the total number of grants approved and disbursed under this section;</text></subparagraph><subparagraph id="id2ab18a6f88354b788d96178814214428"><enum>(B)</enum><text>the total amount of each grant received by each eligible entity;</text></subparagraph><subparagraph id="ided718f14276947cea1e739cb6916991e"><enum>(C)</enum><text>the number of active investigations and audits of grants made under this section;</text></subparagraph><subparagraph id="id470b8d34b79d4f648c3126694cbf6e84"><enum>(D)</enum><text>the number of completed reviews and audits of grants made under this section, including a description of—</text><clause id="id6b192b4f40104461bc5658f4f3e92391"><enum>(i)</enum><text>any findings of fraud or other material noncompliance with the requirements of this section; </text></clause><clause id="idb9842e2ceae84f1fa2e11e66fd9c94b8"><enum>(ii)</enum><text>questionable costs identified by the Administrator; and</text></clause><clause id="idFD948C00499A4F40843C4E0DA7A29BC8"><enum>(iii)</enum><text>the total amount recouped from ineligible recipients; and</text></clause></subparagraph><subparagraph id="id76f697aecead40dba77abfab362247cc"><enum>(E)</enum><text>a description of any substantial changes made to the plan required under paragraph (1).</text></subparagraph></paragraph><paragraph id="idafbcbf8c003f443382ac1a066f7516ef"><enum>(4)</enum><header>Retroactive application</header><text>This subsection shall apply to grants and decisions made under this section before, on, or after the date of enactment of this subsection.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="id3d47a92d30604fa6b263f20749d3d167"><enum>105.</enum><header>Requirement of continuing operation</header><text display-inline="no-display-inline">For any application for a grant under section 5003 of the American Rescue Plan Act of 2021 (<external-xref legal-doc="usc" parsable-cite="usc/15/9009c">15 U.S.C. 9009c</external-xref>) that is pending on the date of enactment of this Act or for which the applicant has received an award notice but the Administrator has not disbursed amounts under the grant, the Administrator may not disburse amounts under the grant unless the applicant submits a statement to the Administrator indicating the applicant is still operating, or intends to reopen not later than 180 days after the date on which the statement is submitted, the applicable place of business. </text></section></title><title style="OLC" id="id5132ADF3F3A248E69BEC826A4149E9F3" commented="no"><enum>II</enum><header>Support for additional businesses suffering pandemic-related revenue loss</header><subtitle style="OLC" id="id5B44F587047748D7A5631B3771B487DB" commented="no"><enum>A</enum><header>Support for gyms and fitness facilities</header><section id="id8c2aeef974ae44baa0182eb760c9a172" commented="no"><enum>211.</enum><header>Definitions</header><text display-inline="no-display-inline">In this subtitle:</text><paragraph id="id5434012561af4cd5ad82b79e3ae0e614" commented="no"><enum>(1)</enum><header>Affiliated business</header><subparagraph id="id7c5da9385155415d86a4390b47f31578" commented="no"><enum>(A)</enum><header>In general</header><text>The term <term>affiliated business</term> means a business in which an eligible entity has an equity or right to profit distributions of not less than 50 percent, or in which an eligible entity has the contractual authority to control the direction of the business, provided that such affiliation shall be determined as of any arrangements or agreements in existence as of February 29, 2020.</text></subparagraph><subparagraph id="ida7cd1b1867fa46abbe637c5a56390c42" commented="no"><enum>(B)</enum><header>Regulations</header><text>For purposes of eligibility for covered grants—</text><clause id="id2fba656eb14a4e54ad42c21b1d3bb76a" commented="no"><enum>(i)</enum><text>the provisions applicable to affiliations under section 121.301 of title 13, Code of Federal Regulations, or any successor regulation, are waived for any business concern operating as a franchise that is assigned a franchise identifier code by the Administration; and</text></clause><clause id="id3bcfdadfe15b42cf841f62c5625ce88e" commented="no"><enum>(ii)</enum><text>the exceptions to affiliation noted in section 121.103(b) of title 13, Code of Federal Regulations, or any successor regulation, shall apply to an affiliated business. </text></clause></subparagraph></paragraph><paragraph id="id69deb5c64ab54091a0b8ef451733b231" commented="no"><enum>(2)</enum><header>Covered grant</header><text>The term <term>covered grant</term> means a grant under section 213 made to an eligible entity.</text></paragraph><paragraph id="idE1AAF6ACA84A45AC90D16E99ACC256CF" commented="no"><enum>(3)</enum><header>Covered period</header><text>The term <term>covered period</term> means the period—</text><subparagraph id="id0068fbdf346d4723be97bf10f0549f8a" commented="no"><enum>(A)</enum><text>beginning on March 1, 2020; and</text></subparagraph><subparagraph id="id262cfa266f8f41939db154c31d620d05" commented="no"><enum>(B)</enum><text>ending on March 31, 2023, or a date to be determined by the Administrator that is not later than 2 years after the date of enactment of this Act.</text></subparagraph></paragraph><paragraph id="idefe1bfa927204db5b5b11ea5b9aaa396" commented="no"><enum>(4)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term>—</text><subparagraph id="id2a90f39fd94d4b5e979cd31e6ecd7f6d" commented="no"><enum>(A)</enum><text>means a fitness facility— </text><clause id="idD167B9CB138942DAA69D5FCBCBD5A082" commented="no"><enum>(i)</enum><text>that employs not more than 500 employees, determined on a full-time equivalency basis;</text></clause><clause id="id9c8672940dd04420956b9faecab95459" commented="no"><enum>(ii)</enum><text>that—</text><subclause id="id2BDAFA151E6742E490AC013CD3D24154" commented="no"><enum>(I)</enum><text>provides instruction in a program of in-person physical exercise; or </text></subclause><subclause id="idF0446C71579E4A47A19F5F0267087FF4" commented="no"><enum>(II)</enum><text>offers space for individuals to take part in the preservation, maintenance, encouragement, or development of physical fitness;</text></subclause></clause><clause id="id10fc3f70f267456ba7be53ed0d01a823" commented="no"><enum>(iii)</enum><text>for which the health or fitness component is not incidental to the overall function and purpose of the facility; and</text></clause><clause id="id0165ee1b9ca548c39f67b8e17dd3cb6d" commented="no"><enum>(iv)</enum><text>that derives revenue primarily from membership dues or admission or participation fees; </text></clause></subparagraph><subparagraph id="idf6352bf4bf8a4fe68cbab392aadea697" commented="no"><enum>(B)</enum><text>may include—</text><clause id="idDC63E100A5104B3282829787DC385133" commented="no"><enum>(i)</enum><text>a for-profit entity;</text></clause><clause id="idFC09039EC2F94AA7A541EB99F01D3D3F" commented="no"><enum>(ii)</enum><text>a nonprofit entity; and</text></clause><clause id="id2D51420962994171908744E476632F9D" commented="no"><enum>(iii)</enum><text>a Tribally-owned concern; and</text></clause></subparagraph><subparagraph id="ide9d81bdd162a40828f398c3d9805a3cf" commented="no"><enum>(C)</enum><text>does not include—</text><clause id="id03cd5e38fc514196bbef987c61e4991e" commented="no"><enum>(i)</enum><text>an entity with pandemic-related revenue losses that are not greater than 25 percent;</text></clause><clause id="id2a5e2de2314546ea919f3bbd097fbdef" commented="no"><enum>(ii)</enum><text>an entity described in subparagraph (A) that—</text><subclause id="id21023ec60777415aa022531cd7da643a" commented="no"><enum>(I)</enum><text>is a State or local government-operated business;</text></subclause><subclause id="idc13b82e2b1e04f308437ad7e90eac550" commented="no"><enum>(II)</enum><text>as of March 1, 2020, owns or operates (together with any affiliated business) more than 10 locations, regardless of whether those locations do business under the same or multiple names; </text></subclause><subclause id="id8d6e9cae37dc4821a822dfe8908fd38c" commented="no"><enum>(III)</enum><text>has a pending application for or has received a grant under— </text><item id="id8D1220EC82FF4B4F89668CB8CA71226C" commented="no"><enum>(aa)</enum><text>section 324 of the Economic Aid to Hard Hit Small Businesses, Nonprofits, and Venues Act (<external-xref legal-doc="usc" parsable-cite="usc/15/9009a">15 U.S.C. 9009a</external-xref>); or </text></item><item id="id04C0E8AFF3DE4C7DB97F3C2A4A4FDE2C" commented="no"><enum>(bb)</enum><text>section 5003 of the American Rescue Plan Act of 2021 (<external-xref legal-doc="usc" parsable-cite="usc/15/9009c">15 U.S.C. 9009c</external-xref>); or</text></item></subclause><subclause id="id156b327b27dd466a823bd58fe6490278" commented="no"><enum>(IV)</enum><text>offers golf, hunting, sailing, shooting, or riding facilities; </text></subclause></clause><clause id="idd81190f71af8466baee9815092b30a8b" commented="no"><enum>(iii)</enum><text>a publicly-traded company; </text></clause><clause id="id93DBBE2059584CC9BA3E41DB863BA76D" commented="no"><enum>(iv)</enum><text>an entity that was not in operation before March 1, 2020; or </text></clause><clause id="id3a0027f6a9bc453999a387c3124ec360" commented="no"><enum>(v)</enum><text>an entity that is not in operation on, and does not intend to reopen on or before the date that is 180 days after, the date on which the entity applies for a covered grant. </text></clause></subparagraph></paragraph><paragraph id="id8414e8141c794a5a9bdeb0c2c8a5ac81" commented="no"><enum>(5)</enum><header>Fund</header><text>The term <term>Fund</term> means the Gym and Fitness Center Recovery Fund established under section 212(a)(1).</text></paragraph><paragraph id="idc9cb5b9ed1db4879bc84e85fa9f59db4" commented="no"><enum>(6)</enum><header>Pandemic-related revenue loss</header><subparagraph id="idCB9A4DB609E944448866CDB1F87B0E2C" commented="no"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B), the term <term>pandemic-related revenue loss</term> means, with respect to an eligible entity—</text><clause id="id39bff09cd20c4be7914f6daee5a15929" commented="no"><enum>(i)</enum><text>except as provided in clauses (ii) and (iii), the gross receipts, as established using such verification documentation as the Administrator may require, of the eligible entity during 2020 subtracted from the gross receipts of the eligible entity in 2019, if such amount is greater than zero, except that the Administrator may make adjustments to this formula as needed for seasonal businesses, businesses affected by natural disasters, and to address other circumstances identified by the Administrator requiring accommodation;</text></clause><clause id="id49a496aa8f5142e192b62997987367ad" commented="no"><enum>(ii)</enum><text>if the eligible entity was not in operation for the entirety of 2019—</text><subclause id="id018bf82344474aaba7cfa98ff628dc31" commented="no"><enum>(I)</enum><text>the difference, if greater than zero, between—</text><item id="id344d8a0226c24a8bb8711149c3f8dc9c" commented="no"><enum>(aa)</enum><text>the product obtained by multiplying the average monthly gross receipts of the eligible entity in 2019 by 12; and</text></item><item id="id45bd49f2a61a49fbb7a5ea996284315a" commented="no"><enum>(bb)</enum><text>the product obtained by multiplying the average monthly gross receipts of the eligible entity in 2020 by 12; or</text></item></subclause><subclause id="idaeefdafa9b444e619293df7a9ace8ac3" commented="no"><enum>(II)</enum><text>an amount based on a formula determined by the Administrator; and</text></subclause></clause><clause id="idb615b6e22e2249ea8ed26944e1c8f5bf" commented="no"><enum>(iii)</enum><text>if the eligible entity opened during the period beginning on January 1, 2020 and ending on February 29, 2020, an amount based on a formula determined by the Administrator.</text></clause></subparagraph><subparagraph id="idbb6161709d154ef2aa58c9f1df8bb255" commented="no"><enum>(B)</enum><header>Reduction</header><clause id="idAE86C1E3275B4C6AA5BDD86A5E4DDD76" commented="no"><enum>(i)</enum><header>In general</header><text>The pandemic-related revenue losses for an eligible entity shall be reduced by—</text><subclause id="id98b9e82bcc0a4fdcbe531fa136a7ece9" commented="no"><enum>(I)</enum><text>any amounts received from a covered loan made under paragraph (36) or (37) of section 7(a) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(a)</external-xref>) in 2020 or 2021; and</text></subclause><subclause id="id08C4A461A1CA42E2A8C4DF603C4768A7" commented="no"><enum>(II)</enum><text>the amount by which the total of all remunerative payments made to an individual, including any annual salary paid to an employee, in 2020 exceeds $250,000. </text></subclause></clause><clause id="id87D9060862F14FD58C0EF0CDCB630400" commented="no"><enum>(ii)</enum><header>Administrator authority</header><text>The Administrator may determine the types of payments and individuals to which clause (i)(II) applies.</text></clause></subparagraph></paragraph></section><section id="id732b5320f46b4889a1e897379660aef6" commented="no"><enum>212.</enum><header>Support for gyms and fitness centers</header><subsection id="idcf03bacff6e84adb8085ad3fd4370ed1" commented="no"><enum>(a)</enum><header>Establishment</header><paragraph id="id002FFD9AD65C44109BF45ED9F96569F8" commented="no"><enum>(1)</enum><header>In general</header><text>There is established within the Restaurant Revitalization Fund established under section 5003 of the American Rescue Plan Act of 2021 (<external-xref legal-doc="usc" parsable-cite="usc/15/9009c">15 U.S.C. 9009c</external-xref>) a fund to be known as the Gym and Fitness Center Recovery Fund. </text></paragraph><paragraph id="id5054BA4F192C424EA2A63DB691B019F9" commented="no"><enum>(2)</enum><header>Use of funds</header><text>Subject to section 266, the Administrator may use amounts in the Fund only for the purposes described in this subtitle and not for any purpose described in section 5003 of the American Rescue Plan Act of 2021 (<external-xref legal-doc="usc" parsable-cite="usc/15/9009c">15 U.S.C. 9009c</external-xref>).</text></paragraph></subsection><subsection id="idcb84e3a98d8949ba8fc98be65701cdb7" commented="no"><enum>(b)</enum><header>Appropriations</header><text>In addition to amounts otherwise available, there is appropriated to the Fund for fiscal year 2022, out of any money in the Treasury not otherwise appropriated, $2,000,000,000, to remain available until expended.</text></subsection></section><section id="id9c5b5199fcd146d98243e09572010986" commented="no"><enum>213.</enum><header>Grants from Fund</header><subsection id="id7d56defe83844ca6aef732d2ee9186bc" commented="no"><enum>(a)</enum><header>In general</header><text>Except as provided in subsection (c)(3) of this section, the Administrator shall make covered grants to eligible entities in the order in which applications are received by the Administrator.</text></subsection><subsection id="id1b75719415774f538e76e921e17e069d" commented="no"><enum>(b)</enum><header>Applications</header><paragraph id="ida103bc790ef34b2e8cc018031205941a" commented="no"><enum>(1)</enum><header>Certification</header><text>An eligible entity applying for a covered grant shall make a good faith certification that—</text><subparagraph id="ide2ce41d36aff411e9ae98dc15a0c3a94" commented="no"><enum>(A)</enum><text>the uncertainty of current economic conditions makes necessary the request for the covered grant to support the ongoing operations of the eligible entity;</text></subparagraph><subparagraph id="id9388f6ab0cf5435fb2de3173442456dc" commented="no"><enum>(B)</enum><text>the eligible entity does not have a pending application for, and has not received, a grant under— </text><clause id="id6A5E06F33C564869BFD6044E8663A775" commented="no"><enum>(i)</enum><text>section 324 of the Economic Aid to Hard-Hit Small Businesses, Nonprofits, and Venues Act (<external-xref legal-doc="usc" parsable-cite="usc/15/9009a">15 U.S.C. 9009a</external-xref>); or </text></clause><clause id="idCD72AA77006941F4881568498A6F1E26" commented="no"><enum>(ii)</enum><text>section 5003 of the American Rescue Plan Act of 2021 (<external-xref legal-doc="usc" parsable-cite="usc/15/9009c">15 U.S.C. 9009c</external-xref>); and</text></clause></subparagraph><subparagraph id="ide82aa409339146e7b8188cad8ac22d57" commented="no"><enum>(C)</enum><text>contains any other information that the Administrator may require.</text></subparagraph></paragraph><paragraph id="idE137B7B0FF6A4007BCE55FAF5C2DBFC7" commented="no"><enum>(2)</enum><header>Verification materials</header><text>Subject to section 211(6)(A)(i), the Administrator shall use tax records, and may, in addition, use other reliable sources such as certified accounting statements, with respect to an applicant for a covered grant to determine—</text><subparagraph id="id2657936008EF4A7BA3A973A401BC9118" commented="no"><enum>(A)</enum><text>the eligibility of the applicant for that covered grant; and</text></subparagraph><subparagraph id="id71DF035BC1FB42D19A48BF9D7C4CEE57" commented="no"><enum>(B)</enum><text>the amount of that covered grant to the applicant.</text></subparagraph></paragraph><paragraph id="idCEA0A87FE358469D9AB1C477BBF89E1B" commented="no"><enum>(3)</enum><header>Acceptance of applications</header><text>Not later than 60 days after the date of enactment of this Act, the Administrator shall begin accepting applications for covered grants.</text></paragraph></subsection><subsection id="id45b1e1d40de94a539784e9e8f38e62e8" commented="no"><enum>(c)</enum><header>Amount of grant</header><paragraph id="id7b169ab652a0406ba35a6cb918b008b4" commented="no"><enum>(1)</enum><header>Aggregate maximum amount</header><text>The aggregate amount of covered grants made to an eligible entity and any affiliated businesses of the eligible entity—</text><subparagraph id="id1387702d3bb84f8cac021c4c99ab7eb9" commented="no"><enum>(A)</enum><text>shall not exceed $2,000,000; and</text></subparagraph><subparagraph id="id48d5c779d3ac4bd8a662935fa0df6c4e" commented="no"><enum>(B)</enum><text>shall be limited to $1,000,000 per physical location of the eligible entity.</text></subparagraph></paragraph><paragraph id="id29d20e0a71ea4236a9ac30df00edb151" commented="no"><enum>(2)</enum><header>Determination of amount of grant</header><subparagraph id="ide40e14204b954156825323a8ac5cb252" commented="no"><enum>(A)</enum><header>In general</header><text>Except as provided in this subsection, the amount of a covered grant made to an eligible entity shall be equal to the difference between—</text><clause id="id185BC6ADEC8F4E4897FD23428F46E9B4" commented="no"><enum>(i)</enum><text>the pandemic-related revenue loss of the eligible entity; and</text></clause><clause id="idea7e4f76c65b4a82823ed8b588ccf32e" commented="no"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="id5350B838AC414242B66BD14282A57C87"><enum>(I)</enum><text>the amount equal to the product obtained by multiplying 3 by the average monthly gross receipts of the eligible entity in 2019; or</text></subclause><subclause id="id8f39bdf2737641eb8dc67a4a9891f9c1" indent="up1" commented="no"><enum>(II)</enum><text>for an eligible entity that did not have gross receipts in 2019, because the eligible entity began operating between January 1, 2020 and February 29, 2020 or due to other factors identified by the Administrator, an alternative amount based on a formula to be determined by the Administrator.</text></subclause></clause></subparagraph><subparagraph id="id5d21160193cf4481b74ef3a7846df157" commented="no"><enum>(B)</enum><header>Limitation</header><text>An eligible entity may not receive a covered grant in an amount that is greater than—</text><clause id="id4acd5f21865e41d89a1b1ab1566a8ccb" commented="no"><enum>(i)</enum><text>the amount equal to the product obtained by multiplying 6 by the average monthly gross receipts of the eligible entity in 2019; or</text></clause><clause id="id7e57161889ba4b9d9aee6f40eab6619c" commented="no"><enum>(ii)</enum><text>if the eligible entity was not in operation for the entirety of 2019, if the gross receipts of the eligible entity during 2019 were reduced due to other factors identified by the Administrator, or if the eligible entity opened during the period beginning on January 1, 2020 and ending on February 29, 2020, an amount determined under a formula established by the Administrator.</text></clause></subparagraph><subparagraph id="ida52dea1323ec4f2781bdeead9ee8fc68" commented="no"><enum>(C)</enum><header>Minimum amount</header><text>The Administrator may establish a minimum amount of a covered grant in an amount that is not more than $10,000.</text></subparagraph><subparagraph id="id2e25e1593c074888ab4ea16ff483111b" commented="no"><enum>(D)</enum><header>Return to SBA</header><text>Any amount of a covered grant to an eligible entity based on estimated receipts that is greater than the actual gross receipts of the eligible entity in 2020 shall be returned to the Administrator, who may use those returned funds to make additional covered grants.</text></subparagraph></paragraph><paragraph id="id20eb16a363c84740b6755590ffad4b60" commented="no"><enum>(3)</enum><header>Insufficient funding</header><subparagraph commented="no" id="id627AC1C3E67349DF9F1AB93E724D402E"><enum>(A)</enum><header>In general</header><text>If the Administrator determines that the amounts made available to carry out this subtitle are insufficient to make covered grants to each eligible entity in the amount provided under paragraphs (1) and (2), the Administrator shall— </text><clause id="id706DFFCBBB834A3CA329D4929E9FC1EA" commented="no"><enum>(i)</enum><text>make covered grants with the available amounts—</text><subclause id="id694a5de69daf4278ae01dd03f056035b" commented="no"><enum>(I)</enum><text>such that the amount of the covered grant that each such eligible entity would have otherwise received under those paragraphs is reduced by an equal percentage; </text></subclause><subclause id="id1D0450C62F5C4FB48A0AE116225D6B8B" commented="no"><enum>(II)</enum><text>by establishing a maximum amount for a covered grant made under this clause to ensure that smaller eligible entities still receive covered grants in the amounts provided under those paragraphs; or </text></subclause><subclause id="id985E3D3BA94D480A8784D6E96DFA1B03" commented="no"><enum>(III)</enum><text>by providing covered grants in the amounts provided under those paragraphs below a certain threshold (as the Administrator may establish) and reducing covered grants above that threshold by an equal percentage; and</text></subclause></clause><clause id="idCBA58757FE134182B17EFAA4847703BD" commented="no"><enum>(ii)</enum><text>in a manner that complies with clause (i), make covered grants to each eligible entity that submits an application for a covered grant during the 21-day period beginning on the date on which the Administrator begins accepting those applications.</text></clause></subparagraph><subparagraph id="id16766596DCBD46EF97938ABBF42BC864" commented="no"><enum>(B)</enum><header>Reserving funds</header><text>Nothing in subparagraph (A) shall prevent the Administrator from— </text><clause id="id438065042509477282D2CA2804A382B2" commented="no"><enum>(i)</enum><text>reserving funding for applicants that may be determined to be eligible for a covered grant upon reconsideration; or </text></clause><clause id="id386FB482BE1A4F8A80C670481CAFEA79" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text>making partial awards to eligible entities on a preliminary basis until the amount of funding required to fund covered grants to all eligible entities that submit applications is established, upon the completion of the reconsideration process. </text></clause></subparagraph></paragraph></subsection><subsection id="id4f66d661f30f431bb02c0763b0bc0f60" commented="no"><enum>(d)</enum><header>Use of funds</header><text>During the covered period, an eligible entity that receives a covered grant may use amounts received under the covered grant for the following expenses incurred as a direct result of, or during, the COVID–19 pandemic:</text><paragraph id="idcf864b35e7504ae3809bad6300f9f7e3" commented="no"><enum>(1)</enum><text>Payroll costs. </text></paragraph><paragraph id="id5764D3444A7841FFA1F0225B94CC5E03" commented="no"><enum>(2)</enum><text>Payments to independent contractors, as reported on Form 1099-MISC, except that each payment under this paragraph shall be in an amount that is not more than $100,000.</text></paragraph><paragraph id="id1a4f973ac86d45bb9e840ce8cab479e4" commented="no"><enum>(3)</enum><text>Scheduled payments of interest or principal on any covered mortgage obligation (which may not include any prepayment of principal on a covered mortgage obligation).</text></paragraph><paragraph id="id3f8046a79c364737891d1c3483d33522" commented="no"><enum>(4)</enum><text>Payments on any covered rent obligation and common area maintenance charges under a lease agreement.</text></paragraph><paragraph id="id05b279ba96d94fb4932fe843edc0b0a4" commented="no"><enum>(5)</enum><text>Covered utility payments.</text></paragraph><paragraph id="ide3715f96002a40abae015238afc22035" commented="no"><enum>(6)</enum><text>Maintenance expenses.</text></paragraph><paragraph id="id20ec1a77c31e4eb1a616fbdd2ae1cc80" commented="no"><enum>(7)</enum><text>Covered worker protection expenditures.</text></paragraph><paragraph id="idc738dd308e17446caece79388e6afca9" commented="no"><enum>(8)</enum><text>Supplies, including protective equipment and cleaning materials.</text></paragraph><paragraph id="idae7eb879c24246f5a9fb5ebc3e2e4938" commented="no"><enum>(9)</enum><text>Expenses that were within the scope of the normal business practice of the eligible entity before the covered period.</text></paragraph><paragraph id="idad461954d6f64da1b3213b0a915f404b" commented="no"><enum>(10)</enum><text>Covered supplier costs.</text></paragraph><paragraph id="id514d26c807dc42aeab202d0ef92ce772" commented="no"><enum>(11)</enum><text>Operational expenses.</text></paragraph><paragraph id="idd94f49d7f58742ac904a07f584c4d39d" commented="no"><enum>(12)</enum><text>Paid sick leave.</text></paragraph><paragraph id="id4d71396245c44ccfbb19edb67e8d6403" commented="no"><enum>(13)</enum><text>Capital expenditures (or expenses required under any Federal, State, or local law) relating to implementing social distancing measures.</text></paragraph><paragraph id="id8a8666bf7c2546d1a2c8568a80474a70" commented="no"><enum>(14)</enum><text>Any other expenses that the Administrator determines to be essential to maintaining the eligible entity.</text></paragraph></subsection><subsection id="idc203d86760d84fd4887304afa7debe61" commented="no"><enum>(e)</enum><header>Returning funds</header><text>If an eligible entity that receives a covered grant fails to use all of the amounts received under the covered grant on or before the last day of the covered period or permanently ceases operations on or before the last day of the covered period, the eligible entity shall return to the Treasury any funds that the eligible entity did not use for the allowable expenses under subsection (d).</text></subsection></section></subtitle><subtitle id="id301A5CC397564AAC839E6F7724144FB0" style="OLC" commented="no"><enum>B</enum><header>Support for minor league sports</header><section id="id67e5559d188f46d4be45544a8d970d91" commented="no"><enum>221.</enum><header>Definitions</header><text display-inline="no-display-inline">In this subtitle:</text><paragraph id="idbda2e4d9624b4f2ca8d6b864ce73b7bf" commented="no"><enum>(1)</enum><header>Covered grant</header><text>The term <term>covered <added-phrase>grant</added-phrase></term> means a grant made under section 223 to an eligible entity.</text></paragraph><paragraph id="id0229264d5ea54274a51aec9fc574e937" commented="no"><enum>(2)</enum><header>Fund</header><text>The term <term>Fund</term> means the Save Minor League Sports Fund established under section 222(a)(1). </text></paragraph><paragraph id="id22942278d05f4f58bc9fe80f0b846de2" commented="no"><enum>(3)</enum><header>Eligible entity</header><subparagraph id="id993350748ED14FCEB97F9B6CCAFE9BD8" commented="no"><enum>(A)</enum><header>In general</header><text>The term <term>eligible entity</term> means any minor league sports team that meets the following requirements:</text><clause id="id40b32fdce7e04afe82a8ff8b5032cee2" commented="no"><enum>(i)</enum><text>The minor league sports team was operating in the ordinary course of business on February 29, 2020.</text></clause><clause id="idba2385d3a0be4ad796f8a01b542d0185" commented="no"><enum>(ii)</enum><text>The gross receipts of the minor league sports team—</text><subclause id="idf4910278cb5d47f2aa3f986bd8944435" commented="no"><enum>(I)</enum><text>in calendar year 2020 or the fiscal year ending in 2021 was not more than 50 percent of the gross receipts of the minor league sports team in calendar year 2019 or the fiscal year ending in 2019, respectively; or</text></subclause><subclause id="idb0e311978f664e5ba68647988a5ea804" commented="no"><enum>(II)</enum><text>in calendar year 2020 or the fiscal year ending in 2021 was not more than 50 percent of the gross receipts of the minor league sports team over the 3-year period from calendar year 2016 through calendar 2018 or the fiscal year ending in 2016 through the fiscal year ending in 2018, respectively, if the gross receipts of the minor league sports team was negatively impacted by a natural disaster or weather disruption in calendar year 2019 or the fiscal year ending in 2019.</text></subclause></clause><clause id="id81d17f5b80684c899f303ee0203a6f7c" commented="no"><enum>(iii)</enum><text>The minor league sports team is open on, or intends to reopen on or before the date that is 180 days after, the date on which the minor league sports team submits the certification required under section 223(b)(1), for the primary purpose of conducting sports games.</text></clause></subparagraph><subparagraph id="idd381a06bd2944f5f99b3bc358807e33d" commented="no"><enum>(B)</enum><header>Exclusions</header><text>The term <term>eligible entity</term> does not include a minor league sports team that—</text><clause id="id77296bc07efe482ba6aa02e1f56f7828" commented="no"><enum>(i)</enum><text>has a pending application for or has received a grant under—</text><subclause id="id9C8840465BFA4512920C909A29BA92DB" commented="no"><enum>(I)</enum><text>section 324 of the Economic Aid to Hard-Hit Small Businesses, Nonprofits, and Venues Act (<external-xref legal-doc="usc" parsable-cite="usc/15/9009a">15 U.S.C. 9009a</external-xref>); or</text></subclause><subclause id="id7B69C24687CE4F709FF8E45655E22F8B" commented="no"><enum>(II)</enum><text>section 5003 of the American Rescue Plan Act of 2021 (<external-xref legal-doc="usc" parsable-cite="usc/15/9009c">15 U.S.C. 9009c</external-xref>);</text></subclause></clause><clause id="id6DB2B773FFD44DEEAD6CEE90815BF543" commented="no"><enum>(ii)</enum><text>is owned directly or indirectly by a major league sports league or major league sports team;</text></clause><clause id="idBD90DD6730A249139E509A86C3380ADF" commented="no"><enum>(iii)</enum><text>has an individual owner with—</text><subclause id="id5EE1DA656D1F485E91158316D0374A48" commented="no"><enum>(I)</enum><text>not less than a 20 percent share in the team; and</text></subclause><subclause id="idB77FB75F09A04580AB75D0963CF99AE1" commented="no"><enum>(II)</enum><text>more than a 10 percent ownership interest in a major league sports league or major league sports team; </text></subclause></clause><clause id="id5A3D56BEFEAC42D2A20EF2A31F7BBF51" commented="no"><enum>(iv)</enum><text>is more than 50 percent owned by a private equity fund; or</text></clause><clause commented="no" id="id74DB530DE4364E3096EF1BEF5E10BB6A"><enum>(v)</enum><text>is more than 50 percent owned by a publicly-traded company.</text></clause></subparagraph><subparagraph id="id5508da337b5f45888eb8fe22a1a355c6" commented="no"><enum>(C)</enum><header>Multiple business entities</header><text>The Administrator shall treat each eligible entity as an independent, non-affiliated entity for the purposes of this subtitle. </text></subparagraph></paragraph><paragraph id="id588ca48cbbbd4483bbac3d6dacc86258" commented="no"><enum>(4)</enum><header>Minor league sports team</header><text>The term <term>minor league sports team</term> means a professional sports team—</text><subparagraph id="id7DC19E4D779F467D837062FC9BEEAC95" commented="no"><enum>(A)</enum><text>that may be—</text><clause id="id6FB1DC96E0004EF6BA4AB950E198E0FA" commented="no"><enum>(i)</enum><text>a corporation, limited liability company, partnership, or nonprofit organization;</text></clause><clause id="id2ACA1A977A8744FBB29AA13452CE9A5F" commented="no"><enum>(ii)</enum><text>operated as a sole proprietorship; or</text></clause><clause id="idC2FCD93B2C4B44D09D999F233034C191" commented="no"><enum>(iii)</enum><text>a Tribally-owned concern; </text></clause></subparagraph><subparagraph id="id1f6e5bf35a2a44f896aca59b3578739c" commented="no"><enum>(B)</enum><text>that, as of the date of enactment of this Act— </text><clause id="idc2a710bf7ea04d6596ee07b2e0397a94" commented="no"><enum>(i)</enum><text>is located in the United States;</text></clause><clause id="ide3784e42bfbe4b589398cdf63bfbfc37" commented="no"><enum>(ii)</enum><text>is not owned directly or indirectly by an educational institution;</text></clause><clause id="id5598033f1e03426ab26fc52b02cec807" commented="no"><enum>(iii)</enum><text>derives income primarily from the presence of in-person spectators;</text></clause><clause id="idA4A4655431364A7EA2DAB417A49A52CD" commented="no"><enum>(iv)</enum><text>is not— </text><subclause commented="no" id="id74C2B060519E4BB8BC796AA690826329"><enum>(I)</enum><text>a recreational, intramural, club, or other type of amateur sports team; or</text></subclause><subclause commented="no" id="id5F79591781EC4E4393924F446440CAB1"><enum>(II)</enum><text>a training academy open to athletes under 18 years of age; </text></subclause></clause><clause id="id63f53b1b28af42ab95cedb0e4100442c" commented="no"><enum>(v)</enum><text>does not require players to pay a fee to participate; and </text></clause><clause id="idf4ce3852cbc24659817ce5dd8c8bd5c7" commented="no"><enum>(vi)</enum><text>either has a formal relationship with a major league sports team or major league sports league to develop players to compete in a major league sports league, or competes in a sports league from which a major league sports team or major league sports league scouts for prospective players; and</text></clause></subparagraph><subparagraph id="id7479e76ca771414bb31a7fbb4ade837b" commented="no"><enum>(C)</enum><text>comprised of players paid a salary to play in the games of the team as of—</text><clause commented="no" id="id696BDD4C2A2440FD8CCB8B28DEDFA9E6"><enum>(i)</enum><text>the date of enactment of this Act; or </text></clause><clause id="idEE424B74CDC540BE9C4C7D45122072FC" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text>February 29, 2020.</text></clause></subparagraph></paragraph><paragraph id="id326819e0b9eb4db6a10fc900dcbf7c3a" commented="no"><enum>(5)</enum><header>Major league sports league</header><text>The term <term>major league sports league</term> means a professional sports league consisting of teams competing at the highest professional level of a given sport in the United States, as determined by the Administrator.</text></paragraph><paragraph id="id38b107f60035427795828afbfc31a445" commented="no"><enum>(6)</enum><header>Major league sports team</header><text>The term <term>major league sports team</term> means a team that competes in a major league sports league.</text></paragraph><paragraph id="idd9f971dfbeed434b843f50af07d04e03"><enum>(7)</enum><header>Natural disaster or weather disruption</header><text>The term <term>natural disaster or weather disruption</term> means— </text><subparagraph id="id065194D3298A4F3D87C6E97787D0FD82"><enum>(A)</enum><text>a flooding event, hurricane, earthquake, forest fire, or other disaster that triggers eligibility for Federal aid, including disaster assistance from the Administrator; or </text></subparagraph><subparagraph id="idC41FDAF1719146AAB0349AD55145CD7B"><enum>(B)</enum><text>a series of weather-related events that, individually or collectively, caused more than 20 percent of games to be permanently canceled. </text></subparagraph></paragraph><paragraph id="id143f02e7e1ae4b07bdecb38d80416654" commented="no"><enum>(8)</enum><header>Pandemic-related revenue loss</header><subparagraph id="id10a7c2bfebf5488786fd11b3d34be1bd" commented="no"><enum>(A)</enum><header>In general</header><text>The term <term>pandemic-related revenue loss</term>, with respect to an eligible entity, as established using such verification documentation as the Administrator may require, means, if such amount is greater than zero—</text><clause id="id7a85cf9e233349ea95581d9f58a1ca95" commented="no"><enum>(i)</enum><text>except as provided in clauses (ii), (iii), and (iv), the gross receipts of the eligible entity during calendar year 2020 or the fiscal year ending in 2021 subtracted from the gross receipts of the eligible entity in calendar year 2019 or the fiscal year ending in 2019, respectively;</text></clause><clause id="idae4e278f1f934e119bcc33c4ca1d7f26" commented="no"><enum>(ii)</enum><text>the gross receipts of the eligible entity during calendar year 2020 or the fiscal year ending in 2021 subtracted from the average annual gross receipts of the eligible entity over the 3-year period from calendar year 2016 through calendar year 2018 or the fiscal year ending in 2016 through the fiscal year ending in 2018, respectively, if the gross receipts of the eligible entity were negatively impacted by a natural disaster or weather disruption in calendar year 2019 or the fiscal year ending in 2019;</text></clause><clause id="idb66d9d50813348019d72d06d62894ca5" commented="no"><enum>(iii)</enum><text>if the eligible entity was not in operation for the entirety of 2019—</text><subclause id="idc5cb28acfd0c46ebb6ed33be94baef3d" commented="no"><enum>(I)</enum><text>the difference between—</text><item id="idd2104c4c2b64473e902ad415931e8d8b" commented="no"><enum>(aa)</enum><text>the product obtained by multiplying the average monthly gross receipts of the eligible entity in calendar year 2019 or the fiscal year ending in 2019 by 12; and</text></item><item id="idee2db65a4c654b2a8bff6793c557a57d" commented="no"><enum>(bb)</enum><text>the product obtained by multiplying the average monthly gross receipts of the eligible entity in calendar year 2020 or the fiscal year ending in 2021 by 12; or</text></item></subclause><subclause id="id291bdf7244eb49d6b945bb795b11fd95" commented="no"><enum>(II)</enum><text>an amount based on a formula determined by the Administrator; or </text></subclause></clause><clause id="idc1b9812f0d1243e2b16184ab723437fd" commented="no"><enum>(iv)</enum><text>if the eligible entity opened during the period beginning on January 1, 2020, and ending on February 29, 2020—</text><subclause id="id4046afcf1ab44cd184a5708b137be7b9" commented="no"><enum>(I)</enum><text>the expenses described in section 223(f) that were incurred by the eligible entity minus any gross receipts received; or</text></subclause><subclause id="idc6873967fbb04e9b8fb481871432c9c4" commented="no"><enum>(II)</enum><text>an amount based on a formula determined by the Administrator.</text></subclause></clause></subparagraph><subparagraph id="id21007DA015A74D1C9D81204C558824A9" commented="no"><enum>(B)</enum><header>Reduction</header><text>For purposes of this paragraph, the pandemic-related revenue loss for an eligible entity shall be reduced by any amounts received from a covered loan made under paragraph (36) or (37) of section 7(a) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(a)</external-xref>) in 2020 or 2021.</text></subparagraph></paragraph></section><section id="id7ecd47945f3945409bacdc5ca0f3fa1b" commented="no"><enum>222.</enum><header>Save Minor League Sports Fund</header><subsection id="id2e3a56b1a1f9459e93d12f4b0d6dc4a2" commented="no"><enum>(a)</enum><header>Establishment</header><paragraph id="id3E255CF523D64DB4BDFF734C0A77432D" commented="no"><enum>(1)</enum><header>In general</header><text>There is established within the Restaurant Revitalization Fund established under section 5003 of the American Rescue Plan Act of 2021 (<external-xref legal-doc="usc" parsable-cite="usc/15/9009c">15 U.S.C. 9009c</external-xref>) a fund to be known as the Save Minor League Sports Fund.</text></paragraph><paragraph id="ided60421763d647f0887b74674834d681" commented="no"><enum>(2)</enum><header>Use of funds</header><text>Subject to section 266, the Administrator may use amounts in the Fund only for the purposes described in this subtitle and not for any purpose described in section 5003 of the American Rescue Plan Act of 2021 (<external-xref legal-doc="usc" parsable-cite="usc/15/9009c">15 U.S.C. 9009c</external-xref>). </text></paragraph></subsection><subsection id="id00847ce2bc014487abbda5fada7f7f6c" commented="no"><enum>(b)</enum><header>Appropriations</header><paragraph id="id2680a4613ecc411da9da59b6d2dd53e2" commented="no"><enum>(1)</enum><header>In general</header><text>In addition to amounts otherwise available, there is appropriated to the Fund for fiscal year 2022, out of any money in the Treasury not otherwise appropriated, $500,000,000, to remain available until expended. </text></paragraph></subsection><subsection id="id4ab93ecec0ff4509a470d7de103fbfc1" commented="no"><enum>(c)</enum><header>Use of funds</header><text>The Administrator shall use amounts in the Fund to make covered grants.</text></subsection></section><section id="id095a754431f84d48aab925f31e744177" commented="no"><enum>223.</enum><header>Save minor league sports grants</header><subsection id="id88dc290cc94146d2b10745ea919e8804" commented="no"><enum>(a)</enum><header>In general</header><text>Except as provided in subsection (e)(3), the Administrator shall award covered grants to eligible entities in the order in which applications are received by the Administrator.</text></subsection><subsection id="id75e99e6ee0534e8588b6e456f9a41c4f" commented="no"><enum>(b)</enum><header>Application</header><text>An eligible entity applying for a covered grant shall make a good faith certification that—</text><paragraph id="ida9f6c481186248fba5d62e8f0c7ff49a" commented="no"><enum>(1)</enum><text>the uncertainty of current economic conditions makes necessary the grant request to support the ongoing operations of the eligible entity; </text></paragraph><paragraph id="id0200fb2f1aee4c37922502aa694190f9" commented="no"><enum>(2)</enum><text>the eligible entity does not have a pending application nor has the eligible entity received a grant under— </text><subparagraph id="id12991086222D44AAAC1FC58027AFCDBF" commented="no"><enum>(A)</enum><text>section 324 of the Economic Aid to Hard-Hit Small Businesses, Nonprofits, and Venues Act (<external-xref legal-doc="usc" parsable-cite="usc/15/9009a">15 U.S.C. 9009a</external-xref>); or</text></subparagraph><subparagraph id="ide1ffb7f905ac4b4797f3d4f30725910f" commented="no"><enum>(B)</enum><text>section 5003 of the American Rescue Plan Act of 2021 (<external-xref legal-doc="usc" parsable-cite="usc/15/9009c">15 U.S.C. 9009c</external-xref>); and</text></subparagraph></paragraph><paragraph commented="no" id="idE1379A18B5C4461B89F06FFE8CE431F5"><enum>(3)</enum><text>contains any other information that the Administrator may require.</text></paragraph></subsection><subsection id="idf34eee83ce384fbaaec52ea18efd5062" commented="no"><enum>(c)</enum><header>Verification materials</header><text>Subject to section 221(8)(A), the Administrator shall use tax records, and may, in addition, use other reliable sources such as certified accounting statements, with respect to an applicant for a covered grant to determine—</text><paragraph id="ide62a85d207574d338d178674d6896af6" commented="no"><enum>(1)</enum><text>the eligibility of the applicant for that covered grant; and</text></paragraph><paragraph id="idbaaee29f97484172a7937e63c3a73382" commented="no"><enum>(2)</enum><text>the amount of that covered grant to the applicant. </text></paragraph></subsection><subsection id="id0E554C7E03604FF2BFA1D8C53F7A998F" commented="no"><enum>(d)</enum><header>Limitation on number of grants</header><text>An eligible entity may receive only 1 covered grant.</text></subsection><subsection id="id84a685d7d6a94a7f8531663b99e891ae" commented="no"><enum>(e)</enum><header>Maximum amount</header><paragraph id="id47b882776b1a42e787a00b943de5faf8" commented="no"><enum>(1)</enum><header>Aggregate maximum amount</header><text>The amount of a covered grant made to an eligible entity—</text><subparagraph id="ida03d444f54e54beaa4d2c561aee3c62e" commented="no"><enum>(A)</enum><text>shall not exceed $5,000,000; and</text></subparagraph><subparagraph id="id144ec4e492224b3ab83ae3c6cc973417" commented="no"><enum>(B)</enum><text>shall be limited to—</text><clause id="id4f7acfd7908d453a93aafac930323521"><enum>(i)</enum><text>50 percent of the gross receipts of the eligible entity for calendar year 2019 or the fiscal year ending in 2019;</text></clause><clause id="id22694923ab7b4df9b4dcfb5544d6f402"><enum>(ii)</enum><text>50 percent of the average annual gross receipts of the eligible entity over the 3-year period from calendar year 2016 through calendar year 2018 or the fiscal year ending in 2016 through the fiscal year ending in 2018, if the gross receipts of the eligible entity were negatively impacted by a natural disaster or weather disruption in calendar year 2019 or the fiscal year ending in 2019;</text></clause><clause id="iddc7964dacec6482d9329a9eba0d57da4" commented="no"><enum>(iii)</enum><text>an amount based on a formula determined by the Administrator if the eligible entity was not in operation for the entirety of 2019; or</text></clause><clause id="idc40713b7829b47099827b29e36c5e248" commented="no"><enum>(iv)</enum><text>an amount based on a formula determined by the Administrator if the eligible entity opened during the period beginning on January 1, 2020 and ending on February 29, 2020.</text></clause></subparagraph></paragraph><paragraph id="idBC01806C25784E98B3B984339A5FE76D" commented="no"><enum>(2)</enum><header>Determination of grant amount</header><subparagraph id="idaff1f57849004e9b97a9cfb5cf314a83" commented="no"><enum>(A)</enum><header>In general</header><text>Except as provided in this subsection, the amount of a covered grant made to an eligible entity shall be equal to the difference between—</text><clause id="id3421620a75444056906b922e5015b880" commented="no"><enum>(i)</enum><text>the pandemic-related revenue loss of the eligible entity; and</text></clause><clause id="idae80babc74934e0fb3df487beb3cf607" commented="no"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="idf22f97725f084228829177f8cabe059c"><enum>(I)</enum><text>the amount equal to the product obtained by multiplying 3 by the average monthly gross receipts of the eligible entity in 2019;</text></subclause><subclause id="idea5fac5f6ac64f64a538240242ac02df" indent="up1" commented="no"><enum>(II)</enum><text>for an eligible entity that did not have gross receipts in 2019, because the eligible entity began operating between January 1, 2020 and February 29, 2020, or due to other factors identified by the Administrator, an alternative amount based on a formula to be determined by the Administrator; or</text></subclause><subclause id="idc5e11a3b20c1465caf1d7c6477cc5430" indent="up1" commented="no"><enum>(III)</enum><text>for an eligibility that was negatively impacted by a natural disaster or weather disruption in calendar year 2019 or the fiscal year ending in 2019, the amount equal to the product obtained by multiplying 3 by the average monthly gross receipts of the eligible entity over the 3-year period from calendar year 2016 through calendar year 2018 or the fiscal year ending in 2016 through the fiscal year ending in 2018.</text></subclause></clause></subparagraph><subparagraph id="id261c8a9b2c394ac3b4c9204c4041cbfe" commented="no"><enum>(B)</enum><header>Return of grants</header><clause id="id7598959A70AC46AFBC67A333A28C3A20" commented="no"><enum>(i)</enum><header>Gross receipts</header><text>Any amount of a covered grant made to an eligible entity based on estimated gross receipts that is greater than the actual gross receipts of the eligible entity in 2020 shall be returned to the Administrator, who may use those returned funds to make additional covered grants.</text></clause><clause id="id8f6a61464fac4c30bfab67d70904e75e" commented="no"><enum>(ii)</enum><header>Private equity fund, publicly-traded company, or major league sports team</header><text>The full amount of a covered grant made to an eligible entity shall be returned to the Treasury if, during the 3-year period following receipt of the covered grant, the eligible entity—</text><subclause id="id12e6d03b1b25461da3e597428eeb87d5" commented="no"><enum>(I)</enum><text>becomes more than 50 percent owned by a private equity fund; </text></subclause><subclause id="id9e23b910a4a24fbfaeb64fa5011b300e" commented="no"><enum>(II)</enum><text>becomes or is acquired by a publicly-traded company; or </text></subclause><subclause id="idf1866ffaf3a948daab1e93486f3a36fd" commented="no"><enum>(III)</enum><text>becomes more than 50 percent owned by a major league sports team. </text></subclause></clause></subparagraph></paragraph><paragraph id="id4CC09EEF6B684999B2175ED81C74B933" commented="no"><enum>(3)</enum><header>Insufficient funding</header><subparagraph commented="no" id="idECFF0237A5CD444DB9CBE8C19BCB8699"><enum>(A)</enum><header>In general</header><text>If the Administrator determines that the amounts made available to carry out this subtitle are insufficient to make covered grants to each eligible entity in the amount provided under paragraphs (1) and (2), the Administrator shall—</text><clause id="idd1e2fc64aa0b4e559a0bfcd89d940f7c" commented="no"><enum>(i)</enum><text>make covered grants with the available amounts—</text><subclause id="idFEFBA978C84B4035BB43AD09DE3417A0" commented="no"><enum>(I)</enum><text>such that the amount of the covered grant that each such eligible entity would have otherwise received under those paragraphs is reduced by an equal percentage; </text></subclause><subclause id="idEB896D4E1867421A8F24780A7FDCB6DA" commented="no"><enum>(II)</enum><text>by establishing a maximum amount for a covered grant made under this clause to ensure that smaller eligible entities still receive covered grants in the amounts provided under those paragraphs; or </text></subclause><subclause id="id6A884D6DB2A44C05A90F533E439A705E" commented="no" display-inline="no-display-inline"><enum>(III)</enum><text>by providing covered grants in the amounts provided under those paragraphs below a certain threshold (as the Administrator may establish) and reducing covered grants above that threshold by an equal percentage; and </text></subclause></clause><clause id="id6cc7103d67c8470994162ff7b4c3ed92" commented="no"><enum>(ii)</enum><text>in a manner that complies with clause (i), make covered grants to each eligible entity that submits an application for a covered grant during the 21-day period beginning on the date on which the Administrator begins accepting those applications.</text></clause></subparagraph><subparagraph id="id862B2B5072324805B3EB8F7821C483B1" commented="no"><enum>(B)</enum><header>Reserving funds</header><text>Nothing in subparagraph (A) shall prevent the Administrator from— </text><clause id="id68C77F76697448F39AE556A83C6B50D0" commented="no"><enum>(i)</enum><text>reserving funding for applicants that may be determined to be eligible for a covered grant upon reconsideration; or </text></clause><clause id="idA2BA07653B164D3AA16E301DDE2A913E" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text>making partial awards to eligible entities on a preliminary basis until the amount of funding required to fund covered grants to all eligible entities that submit applications is established, upon the completion of the reconsideration process. </text></clause></subparagraph></paragraph></subsection><subsection id="iddfb7a6da74904de58dbd2badc77ad284" commented="no"><enum>(f)</enum><header>Use of funds</header><paragraph id="idb50eca0e631d49f3ab8d4f98d028a3e4" commented="no"><enum>(1)</enum><header>Timing</header><subparagraph id="ida6e705c9feab4dfa8a52f17800eacb9d" commented="no"><enum>(A)</enum><header>Expenses incurred</header><text>Amounts received under a covered grant may only be used for expenses incurred, including for reimbursements of expenses already paid by the eligible entity, during the period beginning on March 1, 2020, and ending on the date that is 18 months after the date of enactment of this Act.</text></subparagraph><subparagraph id="id5710e9016ff941018c53e35067361893" commented="no"><enum>(B)</enum><header>Expenditure</header><text>An eligible entity shall return to the Treasury any amounts received under a covered grant that are not expended on or before the date that is 18 months after the date of disbursement of the covered grant.</text></subparagraph></paragraph><paragraph id="id4142f312c6ac45cb8e39b6e21630ec3d" commented="no"><enum>(2)</enum><header>Allowable expenses</header><text>An eligible entity may use amounts received under a covered grant for—</text><subparagraph id="idb16ec03b14b646c2b336388a6ec3cdca" commented="no"><enum>(A)</enum><text>payroll costs, not to exceed a total of $100,000 in annual compensation for any individual employee; </text></subparagraph><subparagraph id="idb118d5e0b06249d6a6f5cbc3d87d9ff6" commented="no"><enum>(B)</enum><text>payments on any covered rent obligation or other obligation to a public entity from whom the primary venue of the eligible entity is leased or licensed;</text></subparagraph><subparagraph id="id0759f95381414001b2d8a6b8f774c412" commented="no"><enum>(C)</enum><text>any covered utility payment;</text></subparagraph><subparagraph id="id076a16afc05d43a495e36f1a7c1e0115" commented="no"><enum>(D)</enum><text>payments of interest or principal due on any covered mortgage obligation;</text></subparagraph><subparagraph id="id43d3fae7f82e4bfba16682ca2fcbc832" commented="no"><enum>(E)</enum><text>payments of interest or principal due on any indebtedness or debt instrument incurred in the ordinary course of business that is a liability of the eligible entity and was in place or incurred prior to March 1, 2020, including any subsequent renewals, amendments, or extensions of debt instruments in place as of that date;</text></subparagraph><subparagraph id="id67b6539b61824a1fb7e0d0945f721426" commented="no"><enum>(F)</enum><text>covered worker protection expenditures;</text></subparagraph><subparagraph id="ideb16c6abd31946a580966daa05e8090b" commented="no"><enum>(G)</enum><text>payments made to independent contractors, as reported on Form-1099 MISC, not to exceed a total of $100,000 in annual compensation for any individual employee of an independent contractor; and</text></subparagraph><subparagraph id="id70c2eabc66a045509126a641de9a721c" commented="no"><enum>(H)</enum><text>other ordinary and necessary business expenses, including—</text><clause id="idf66c6231ba0b46c19ffccf7665766d48" commented="no"><enum>(i)</enum><text>maintenance expenses;</text></clause><clause id="id1451337451804d21aa19fd34c5db741c" commented="no"><enum>(ii)</enum><text>administrative costs, including fees and licensing costs;</text></clause><clause id="id21886035efe04f81926bfe66ecdcfa47" commented="no"><enum>(iii)</enum><text>State and local taxes and fees;</text></clause><clause id="idfd01f416492f4b75b26269d23ebcf493" commented="no"><enum>(iv)</enum><text>operating leases in effect as of March 1, 2020;</text></clause><clause id="ida5e2fdf793574e9995235037ac833669" commented="no"><enum>(v)</enum><text>payments required for insurance on any insurance policy;</text></clause><clause id="idd331ebbf4ea240339a9947bd59962ec7" commented="no"><enum>(vi)</enum><text>settling existing debts with vendors; and</text></clause><clause id="idd78a7ae97129433f992e39d381974112" commented="no"><enum>(vii)</enum><text>advertising, production, transportation, and other expenditures relating to the primary venue of the eligible entity or events held at such venue, except that a covered grant may not be used primarily for such expenditures.</text></clause></subparagraph></paragraph><paragraph id="id75faa44b9f5d434da9808094c944a43d" commented="no"><enum>(3)</enum><header>Prohibited expenses</header><text>An eligible entity may not use amounts received under a covered grant—</text><subparagraph id="ida77fa83e50d94e479031f97113e88cd3" commented="no"><enum>(A)</enum><text>to purchase real estate or to make physical improvements to property unrelated to compliance with social distancing guidelines;</text></subparagraph><subparagraph id="idc0befa80e00e4ced8cc0c771baa5ea6f" commented="no"><enum>(B)</enum><text>for payments of interest or principal for loans originated after March 1, 2020;</text></subparagraph><subparagraph id="id1051f99592354fc29e0d043c6ffb765d" commented="no"><enum>(C)</enum><text>to invest or re-lend funds;</text></subparagraph><subparagraph id="id8556fb8ba6bd433baf5b13f1d8bae084" commented="no"><enum>(D)</enum><text>for contributions or expenditures to, or on behalf of, any political party, party committee, or candidate for elective office; or</text></subparagraph><subparagraph id="id43578da9669342078a61af91b73c1a6e" commented="no"><enum>(E)</enum><text>for any other use as may be reasonably prohibited by the Administrator.</text></subparagraph></paragraph></subsection></section></subtitle><subtitle id="id072D2BA1039A4F1BB103EEFD67627CF7" style="OLC" commented="no"><enum>C</enum><header>Support for border businesses affected by border closures</header><section id="id4658a99332d645fe80c0431d4e2a885e" commented="no"><enum>231.</enum><header>Definitions</header><text display-inline="no-display-inline">In this subtitle:</text><paragraph id="id9f1b788f51414d6bb8ad502c7f1deb11" commented="no"><enum>(1)</enum><header>Affiliated business</header><subparagraph id="id0b6affc9084b4f8c9f8988a31e8fd328" commented="no"><enum>(A)</enum><header>In general</header><text>The term <term>affiliated business</term> means a business in which an eligible entity has an equity or right to profit distributions of not less than 50 percent, or in which an eligible entity has the contractual authority to control the direction of the business, provided that such affiliation shall be determined as of any arrangements or agreements in existence as of February 29, 2020.</text></subparagraph><subparagraph id="idb91a03fec6ce4b4684252cd747488310" commented="no"><enum>(B)</enum><header>Regulations</header><text>For purposes of eligibility for covered grants—</text><clause id="id98ffc3df9c864d4a97c44dd6f51732d4" commented="no"><enum>(i)</enum><text>the provisions applicable to affiliations under section 121.301 of title 13, Code of Federal Regulations, or any successor regulation, are waived for any business concern operating as a franchise that is assigned a franchise identifier code by the Administration; and</text></clause><clause id="ida1f7537fdaa24e6c91aa37f3cddefb1e" commented="no"><enum>(ii)</enum><text>the exceptions to affiliation noted in section 121.103(b) of title 13, Code of Federal Regulations, or any successor regulation, shall apply to an affiliated business. </text></clause></subparagraph></paragraph><paragraph id="id4b72f03d3ec446eda02bd7dd4df3f127" commented="no"><enum>(2)</enum><header>Border business</header><text>The term <term>border business</term>— </text><subparagraph id="idAF817EAF5CD8462DB0CCF2BE70FC621B" commented="no"><enum>(A)</enum><text>means an entity—</text><clause id="id805110989971455E9B819F7659D181E9" commented="no"><enum>(i)</enum><text>that is a small business concern (as defined in section 3 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/632">15 U.S.C. 632</external-xref>)); </text></clause><clause id="id7a589195f06b460c804ef735ccc45f57" commented="no"><enum>(ii)</enum><text>the principal office of which is located in the United States;</text></clause><clause id="id46dba94cd3df409fa3eda1e65b5a23c8" commented="no"><enum>(iii)</enum><text>that has—</text><subclause id="id8caf740bfffe4dcaa0489f5280d88329" commented="no"><enum>(I)</enum><text>annual average gross receipts in 2019 in an amount that is not more than $1,000,000; and</text></subclause><subclause id="id63bfe4fce4484798a1ba3417c20389e7" commented="no"><enum>(II)</enum><text>not less than 1 and not more than 25 employees, determined on a full-time equivalency basis; and</text></subclause></clause><clause id="id8ec363179dc54cbdab9c992726821cc0" commented="no"><enum>(iv)</enum><text>that has a physical location within—</text><subclause id="idcf86c344f26c4e6eb4549d621b6db412" commented="no"><enum>(I)</enum><text>an area adjacent to a designated land port of entry, including—</text><item id="id1d3028699f7b4fb4ab4841187f564f8f" commented="no"><enum>(aa)</enum><text>the lands within the external boundaries of a designated land port of entry along the international borders between the United States and Mexico or the United States and Canada;</text></item><item id="id89f515041a00454d90689a0829cea0a8" commented="no"><enum>(bb)</enum><text>the census tract in which the lands described in item (aa) are wholly contained;</text></item><item id="idaec79d30ff244f5ca52043a53f5df697" commented="no"><enum>(cc)</enum><text>a census tract the boundaries of which intersect the lands described in item (aa); and</text></item><item id="idf884f3cc28c74ff89c047fcf3208fe7e" commented="no"><enum>(dd)</enum><text>a census tract— </text><subitem commented="no" id="id6209FFFD4C69420D86DA5F3DB185FDA4"><enum>(AA)</enum><text>the boundaries of which are contiguous to the census tracts described in item (bb) or (cc); and</text></subitem><subitem commented="no" id="id6885C213F33346DC9459ED3EF71F325E"><enum>(BB)</enum><text>which is not more than 50 miles from the international border between the United States and Mexico or the United States and Canada; or</text></subitem></item></subclause><subclause id="ida4cf3e19cbd14eb99f775f3af9f2ca83" commented="no"><enum>(II)</enum><text>a colonia; </text></subclause></clause></subparagraph><subparagraph id="id6cb2ba8fedeb41bd8745c8e7b5bfd7b2" commented="no"><enum>(B)</enum><text>may include—</text><clause id="id09c9f0970fb5476d8730a53b4a56da4b" commented="no"><enum>(i)</enum><text>a for-profit entity; and</text></clause><clause id="id43a80b5f576a4484842af2cc5ca11fcb" commented="no"><enum>(ii)</enum><text>a Tribally-owned concern; and</text></clause></subparagraph><subparagraph id="id932d976fc58c4606a59fb79f6aaa7029" commented="no"><enum>(C)</enum><text>does not include—</text><clause id="id1af79e8dcb15481abd081ffdab2584f9" commented="no"><enum>(i)</enum><text>an entity with pandemic-related revenue losses that are not greater than 25 percent;</text></clause><clause id="idb3882d7c5aab408bac22ff8463397fc3" commented="no"><enum>(ii)</enum><text>an entity described in subparagraph (A) that is a State or local government-operated business;</text></clause><clause id="id10c962f329b6419d8a643a33a7f02250" commented="no"><enum>(iii)</enum><text>a publicly traded company; </text></clause><clause id="id481d05adb3594082b5fb9a64b7f10e3a" commented="no"><enum>(iv)</enum><text>an entity that is owned or operated by a private equity fund; </text></clause><clause id="id1B5AF051E5074F9796EA04A12C9D484B" commented="no"><enum>(v)</enum><text>an entity that was not in operation before March 1, 2020; or</text></clause><clause id="id9cd0a4fb946240a590b1f1a3e681e105" commented="no"><enum>(vi)</enum><text>an entity that is not in operation on, and does not intend to reopen on or before the date that is 180 days after, the date on which the entity applies for a covered grant. </text></clause></subparagraph></paragraph><paragraph id="id4B3113070D394397A7305069BAE73E80" commented="no"><enum>(3)</enum><header>Colonia</header><text>The term <term>colonia</term> has the meaning given the term in section 916(e) of the Cranston-Gonzalez National Affordable Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5306">42 U.S.C. 5306</external-xref> note).</text></paragraph><paragraph id="idBFB2F5B02A6F480C877657EB201AFE07" commented="no"><enum>(4)</enum><header>Covered grant</header><text>The term <term>covered grant</term> means a grant under section 233 made to a border business.</text></paragraph><paragraph id="ide4a2245235714f718b2a1c647c7273ff" commented="no"><enum>(5)</enum><header>Covered period</header><text>The term <term>covered period</term> means the period—</text><subparagraph id="id9a8097b807c546fd895db58f88ac3934" commented="no"><enum>(A)</enum><text>beginning on March 1, 2020; and</text></subparagraph><subparagraph id="id48c7380886bd41659fdbde5d2a132e70" commented="no"><enum>(B)</enum><text>ending on March 31, 2023, or a date to be determined by the Administrator that is not later than 2 years after the date of enactment of this Act.</text></subparagraph></paragraph><paragraph id="id2f931bc208db4585ad8c71355ae96898" commented="no"><enum>(6)</enum><header>Fund</header><text>The term <term>Fund</term> means the Border Closure Recovery Grant Fund established under section 232(a)(1).</text></paragraph><paragraph id="idaf4009642d9441ecb4700a75c63dfde3" commented="no"><enum>(7)</enum><header>Pandemic-related revenue loss</header><subparagraph id="id415cdd6667e64aea934fe5f26e80a8de" commented="no"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B), the term <term>pandemic-related revenue loss</term> means, with respect to a border business—</text><clause id="id8561fc19f2ef4b008f3b4ad64cc522ac" commented="no"><enum>(i)</enum><text>except as provided in clauses (ii) and (iii), the gross receipts, as established using such verification documentation as the Administrator may require, of the border business during 2020 subtracted from the gross receipts of the border business in 2019, if such amount is greater than zero, except that the Administrator may make adjustments to this formula as needed for seasonal businesses, businesses affected by natural disasters, and to address other circumstances identified by the Administrator requiring accommodation;</text></clause><clause id="idad44709df0e14c939984a1539749e870" commented="no"><enum>(ii)</enum><text>if the border business was not in operation for the entirety of 2019—</text><subclause id="idab88df589cb44e8ba39869970f1bee32" commented="no"><enum>(I)</enum><text>the difference between, if greater than zero—</text><item id="id25656ffbacfb4df3858ddb992068cde0" commented="no"><enum>(aa)</enum><text>the product obtained by multiplying the average monthly gross receipts of the border business in 2019 by 12; and</text></item><item id="ide1bc236fa7c2425f85e114d76792f5f9" commented="no"><enum>(bb)</enum><text>the product obtained by multiplying the average monthly gross receipts of the border business in 2020 by 12; or</text></item></subclause><subclause id="ide70a49e301fc4ffd90e9675b0ed9b7e2" commented="no"><enum>(II)</enum><text>an amount based on a formula determined by the Administrator; and</text></subclause></clause><clause id="idfca303f181a543c296cee51a10b59be4" commented="no"><enum>(iii)</enum><text>if the border business opened during the period beginning on January 1, 2020, and ending on February 29, 2020, an amount based on a formula determined by the Administrator.</text></clause></subparagraph><subparagraph id="idc12c84c9581a45e1ac515548ba3c2602" commented="no"><enum>(B)</enum><header>Reduction</header><clause id="idfaba212eec1347098f30f7cbfd2ea1db" commented="no"><enum>(i)</enum><header>In general</header><text>The pandemic-related revenue losses for a border business shall be reduced by—</text><subclause id="idc8ef12e2463b42a881f250f0f41701cf" commented="no"><enum>(I)</enum><text>any amounts received from a covered loan made under paragraph (36) or (37) of section 7(a) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(a)</external-xref>) in 2020 or 2021; and</text></subclause><subclause id="idb7a14212552b4e2b92aaca981dab7044" commented="no"><enum>(II)</enum><text>the amount by which any remunerative payment made to an individual, including any salary paid to an employee, in 2020 exceeds $250,000.</text></subclause></clause><clause id="id1f8b9b842584473d887a0e4866c554f3" commented="no"><enum>(ii)</enum><header>Administrator authority</header><text>The Administrator may determine the types of payments and individuals to which clause (i)(II) applies.</text></clause></subparagraph></paragraph></section><section id="id48c655e0f914490f802075a47f52869b" commented="no"><enum>232.</enum><header>Border closure recovery grant program</header><subsection id="id7cccfeabe6e34b559c9327e5ae68a68e" commented="no"><enum>(a)</enum><header>Establishment</header><paragraph id="idf44416b10ed64452a7da7bd68e2b7047" commented="no"><enum>(1)</enum><header>In general</header><text>There is established within the Restaurant Revitalization Fund established under section 5003 of the American Rescue Plan Act of 2021 (<external-xref legal-doc="usc" parsable-cite="usc/15/9009c">15 U.S.C. 9009c</external-xref>) a fund to be known as the <quote>Border Closure Recovery Grant Fund</quote>.</text></paragraph><paragraph id="idadb181e4c565466d98bec24c74ae87c5" commented="no"><enum>(2)</enum><header>Use of funds</header><text>Subject to section 266, the Administrator may use amounts in the Fund only for the purposes described in this subtitle and not for any purpose described in section 5003 of the American Rescue Plan Act of 2021 (<external-xref legal-doc="usc" parsable-cite="usc/15/9009c">15 U.S.C. 9009c</external-xref>).</text></paragraph></subsection><subsection id="id7b22c17ce49545c8b39ea6a891668e36" commented="no"><enum>(b)</enum><header>Appropriations</header><text>In addition to amounts otherwise available, there is appropriated to the Fund for fiscal year 2022, out of any money in the Treasury not otherwise appropriated, $1,415,000,000, to remain available until expended. </text></subsection></section><section id="id5453c14a0e6b42deb6fe8cc40bbfe99e" commented="no"><enum>233.</enum><header>Grants from Fund</header><subsection id="id18e43e85f17347bd878ac8b324701d56" commented="no"><enum>(a)</enum><header>In general</header><text>Except as provided in subsection (c)(3) and in accordance with subsection (c)(2)(E), the Administrator shall make covered grants in the order in which applications are received by the Administrator.</text></subsection><subsection id="idc0cd19bcc2264cb2b09a32523ed109c1" commented="no"><enum>(b)</enum><header>Applications</header><paragraph id="id90cfc058328c44c08ddab0997acd3045" commented="no"><enum>(1)</enum><header>Certification</header><text>A border business applying for a covered grant shall make a good faith certification that—</text><subparagraph id="id628954dc06fb46ada8c986b6aec68860" commented="no"><enum>(A)</enum><text>the covered grant is necessary to support the operations of the border business, which were adversely affected by the border travel restrictions imposed by the Federal Government in response to the COVID–19 pandemic;</text></subparagraph><subparagraph id="id367743278e424eb5a4ef69ba0250b859" commented="no"><enum>(B)</enum><text>the border business does not have a pending application for, and has not received, a grant under—</text><clause id="idfe83d701846b4fc0aa7866ba93e79405" commented="no"><enum>(i)</enum><text>section 324 of the Economic Aid to Hard-Hit Small Businesses, Nonprofits, and Venues Act (<external-xref legal-doc="usc" parsable-cite="usc/15/9009a">15 U.S.C. 9009a</external-xref>); or</text></clause><clause id="id08a3171cf3214a16815959025ebd73cc" commented="no"><enum>(ii)</enum><text>section 5003 of the American Rescue Plan Act of 2021 (<external-xref legal-doc="usc" parsable-cite="usc/15/9009c">15 U.S.C. 9009c</external-xref>); and</text></clause></subparagraph><subparagraph id="ide87a8bf5396a43cd91da9d27e09167b9" commented="no"><enum>(C)</enum><text>contains any other information that the Administrator may require.</text></subparagraph></paragraph><paragraph id="id9b711a3418394798b2fefde9aab179ff" commented="no"><enum>(2)</enum><header>Verification materials</header><text>Subject to section 231(7)(A)(i), the Administrator shall use tax records, and may, in addition, use other reliable sources such as certified accounting statements, with respect to an applicant for a covered grant to determine—</text><subparagraph id="id6fdca173a24f4dcb9c1f3bc3a1aee716" commented="no"><enum>(A)</enum><text>the eligibility of the applicant for that covered grant; and</text></subparagraph><subparagraph id="id5f43fb4e1a1f49b0814a51ff7088bccd" commented="no"><enum>(B)</enum><text>the amount of that covered grant to the applicant.</text></subparagraph></paragraph><paragraph id="id1edc2955f6c846cf9ec9814acaa9cf53" commented="no"><enum>(3)</enum><header>Acceptance of applications</header><text>Not later than 60 days after the date of enactment of this Act, the Administrator shall begin accepting applications for covered grants.</text></paragraph></subsection><subsection id="idcab26472a02c4f948f09202b776a8e99" commented="no"><enum>(c)</enum><header>Amount of grant</header><paragraph id="idcff342c45bd946debfc367890b7f626a" commented="no"><enum>(1)</enum><header>Aggregate maximum amount</header><text>The aggregate amount of covered grants made to a border business and any affiliated businesses of the border business shall not exceed $350,000.</text></paragraph><paragraph id="idbd8fa81460bc4a8ead5d201007997fe6" commented="no"><enum>(2)</enum><header>Determination of amount of grant</header><subparagraph id="id44D79A56A26642CB85486B9F91D48C48" commented="no"><enum>(A)</enum><header>In general</header><text>Except as provided in this subsection, the amount of a covered grant made to a border business shall be equal to the difference between—</text><clause id="id51829CA136CD4C54A1D93C6A9F840105" commented="no"><enum>(i)</enum><text>the pandemic-related revenue loss of the border business; and</text></clause><clause id="id57E71F2250994C698AFA9DBF2F2E7814" commented="no"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="id1687FA27D7B64073A7D5EFDE9F3F37DD"><enum>(I)</enum><text>the amount equal to the product obtained by multiplying 3 by the average monthly gross receipts of the border business in 2019; or</text></subclause><subclause id="id9C1258B38D704E8EA71DB5E89066033A" indent="up1" commented="no"><enum>(II)</enum><text>for a border business that did not have gross receipts in 2019, because the border business began operating between January 1, 2020 and February 29, 2020 or due to other factors identified by the Administrator, an alternative amount based on a formula to be determined by the Administrator.</text></subclause></clause></subparagraph><subparagraph id="id76F43A6A6D714B04BAA5B834464369AE" commented="no"><enum>(B)</enum><header>Limitation</header><text>A border business may not receive a covered grant in an amount that is greater than—</text><clause id="id42573963FD7746D3A2A1ACF1DA8015D2" commented="no"><enum>(i)</enum><text>the amount equal to the product obtained by multiplying 6 by the average monthly gross receipts of the border business in 2019; or</text></clause><clause id="id0363929D86624EC4929521E221D2F25E" commented="no"><enum>(ii)</enum><text>if the border business was not in operation for the entirety of 2019, if the gross receipts of the border business during 2019 were reduced due to other factors identified by the Administrator, or if the border business opened during the period beginning on January 1, 2020 and ending on February 29, 2020, an amount determined under a formula established by the Administrator.</text></clause></subparagraph><subparagraph id="idD25385BC302040D7969C4180F6711B77" commented="no" display-inline="no-display-inline"><enum>(C)</enum><header>Minimum amount</header><text>The Administrator may establish a minimum amount of a covered grant in an amount that is not more than $10,000.</text></subparagraph><subparagraph id="idef39e0085f4e46ed8ff02833eed990f2" commented="no"><enum>(D)</enum><header>Return to SBA</header><text>Any amount of a covered grant to a border business based on estimated receipts that is greater than the actual gross receipts of the border business in 2020 shall be returned to the Administrator, who may use those returned funds to make additional covered grants.</text></subparagraph><subparagraph id="id599907653fe64f08a33822feb944267a" commented="no"><enum>(E)</enum><header>Minimum allocation</header><text>The Administrator shall ensure that—</text><clause id="idC23AEA5C99B1452CB3DCB19D983E954F" commented="no"><enum>(i)</enum><text>not less than one-third of amounts made available to carry out this subtitle is used to make covered grants to border businesses located along the international border between the United States and Mexico, including colonias; and</text></clause><clause id="id7A5A7EE65306440FBD5A4AC99D258BA9" commented="no"><enum>(ii)</enum><text>not less than one-third of amounts made available to carry out this subtitle is used to make covered grants to border businesses located along the international border between the United States and Canada. </text></clause></subparagraph></paragraph><paragraph id="idbdeee92b592b4eb18d961d78d5f4339a" commented="no"><enum>(3)</enum><header>Insufficient funding</header><subparagraph commented="no" id="id813B50FEB3CA49BD99A336756EAA814F"><enum>(A)</enum><header>In general</header><text>If the Administrator determines that the amounts made available to carry out this subtitle are insufficient to make covered grants to each border business in the amount provided under paragraphs (1) and (2), the Administrator shall, in a manner that maintains the minimum allocation requirements under paragraph (2)(E)—</text><clause id="id6eb847f826ff4471abfcea5e85f7fbe9" commented="no"><enum>(i)</enum><text>make covered grants with the available amounts— </text><subclause id="id07FBB7F4F0374AA1AB7AFC29D76C391E" commented="no"><enum>(I)</enum><text>such that the amount of the covered grant that each border business would have otherwise received under those paragraphs is reduced by an equal percentage; </text></subclause><subclause id="id2E040F1B143748DFB14F598B27744CB6" commented="no"><enum>(II)</enum><text>by establishing a maximum amount for a covered grant made under this clause to ensure that smaller border businesses still receive covered grants in the amounts provided under those paragraphs; or </text></subclause><subclause id="idE39E3C01C9ED4724A506B6F7034C3A39" commented="no" display-inline="no-display-inline"><enum>(III)</enum><text>by providing covered grants in the amounts provided under those paragraphs below a certain threshold (as the Administrator may establish) and reducing covered grants above that threshold by an equal percentage; and </text></subclause></clause><clause id="id702daa8bafe94c91927237e5aca205ad" commented="no"><enum>(ii)</enum><text>in a manner that complies with clause (i), make covered grants to each border business that submits an application for a covered grant during the 21-day period beginning on the date on which the Administrator begins accepting those applications.</text></clause></subparagraph><subparagraph id="idDE109880B40A40F7B77D5A1728CF853E" commented="no"><enum>(B)</enum><header>Reserving funds</header><text>Nothing in subparagraph (A) shall prevent the Administrator from— </text><clause id="idA99134874AAE4DF9AA43ECA62A0DFD74" commented="no"><enum>(i)</enum><text>reserving funding for applicants that may be determined to be eligible for a covered grant upon reconsideration; or </text></clause><clause id="idEA801ECBAF85497AA80A0C6AC2BAE649" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text>making partial awards to border businesses on a preliminary basis until the amount of funding required to fund covered grants to all border businesses that submit applications is established, upon the completion of the reconsideration process. </text></clause></subparagraph></paragraph></subsection><subsection id="idc8620efa2fb34f0f8f4c3a1e08a6cdec" commented="no"><enum>(d)</enum><header>Use of funds</header><text>A border business may use amounts received under a covered grant for the following expenses incurred during the covered period as a direct result of, or during, the COVID–19 pandemic, including logistical expenses associated with border closures:</text><paragraph id="id0691bba5e6f442cba565e222a88db6fc" commented="no"><enum>(1)</enum><text>Payroll costs.</text></paragraph><paragraph id="idbb45b16dc89041d4959075d0a3f0a50c" commented="no"><enum>(2)</enum><text>Payments to independent contractors, as reported on Form 1099-MISC, except that each payment under this paragraph shall be in an amount that is not more than $100,000.</text></paragraph><paragraph id="id4a91e2a05beb40b8bac2bbf3d6cd9d1d" commented="no"><enum>(3)</enum><text>Scheduled payments of interest or principal on any covered mortgage obligation (which may not include any prepayment of principal on a covered mortgage obligation).</text></paragraph><paragraph id="idd909f1e731f940c69d8036611197d8c1" commented="no"><enum>(4)</enum><text>Payments on any covered rent obligation and common area maintenance charges under a lease agreement.</text></paragraph><paragraph id="idfd28135890774a68b5480c4ca07cf303" commented="no"><enum>(5)</enum><text>Covered utility payments.</text></paragraph><paragraph id="id3d391f24a2a2419b986635e795ccbd46" commented="no"><enum>(6)</enum><text>Maintenance expenses.</text></paragraph><paragraph id="ide1f727382bf2473193216c0209ef3971" commented="no"><enum>(7)</enum><text>Covered worker protection expenditures.</text></paragraph><paragraph id="id5c0d20f63a56455db828ed562edf450d" commented="no"><enum>(8)</enum><text>Supplies, including protective equipment and cleaning materials.</text></paragraph><paragraph id="id0fbd399f00e84c989b2c156ad0aa45b4" commented="no"><enum>(9)</enum><text>Expenses that were within the scope of the normal business practice of the border business before the covered period.</text></paragraph><paragraph id="id0436dd57b9034fe9bfb6795f491cfe41" commented="no"><enum>(10)</enum><text>Covered supplier costs.</text></paragraph><paragraph id="id50f56a5c928e41d197d5e38be6a722f8" commented="no"><enum>(11)</enum><text>Operational expenses.</text></paragraph><paragraph id="id23b8c1b22b984eeb94b734cf77b56764" commented="no"><enum>(12)</enum><text>Paid sick leave.</text></paragraph><paragraph id="id32df57d514ee46809fb1e7f26d8627a0" commented="no"><enum>(13)</enum><text>Costs associated with resuming or scaling up business operations after COVID–19 pandemic-related border travel restrictions have been lifted.</text></paragraph><paragraph id="id627643cb59214381b6418a27f4a4b1cb"><enum>(14)</enum><text>Workforce training or retraining expenses. </text></paragraph><paragraph id="id98d5baa7c49049c4b753c7dc4d289dba" commented="no"><enum>(15)</enum><text>Any other expenses that the Administrator determines to be essential to maintaining the border business.</text></paragraph></subsection><subsection id="id64e08290ce4547268ae79a8ea3ee8141" commented="no"><enum>(e)</enum><header>Returning funds</header><text>If a border business that receives a covered grant fails to use all of the amounts received under the covered grant on or before the last day of the covered period or permanently ceases operations on or before the last day of the covered period, the border business shall return to the Treasury any funds that the border business did not use for the allowable expenses under subsection (d).</text></subsection></section><section id="id48aa884d033e4eaf9eddfd720ebb7f7d" commented="no"><enum>234.</enum><header>Outreach</header><subsection id="iddeb8a324b71d473da85ba5a015d044d5" commented="no"><enum>(a)</enum><header>In general</header><text>In carrying out the program under this subtitle, the Administrator shall make grants to, or enter into contracts or cooperative agreements with, not fewer than 6 private nonprofit organizations, resource partners, States, Indian Tribes, or units of local government, including not fewer than 3 adjacent to the international border between the United States and Canada and not fewer than 3 adjacent to the international border between the United States and Mexico, under the authorities of the Community Navigator pilot program established under section 5004 of the American Rescue Plan Act (<external-xref legal-doc="usc" parsable-cite="usc/15/9013">15 U.S.C. 9013</external-xref>) in order to improve access to assistance programs and resources made available by Federal, State, Tribal, and local entities in response to the COVID–19 pandemic, and related border travel restrictions.</text></subsection><subsection id="id04ff1ef41f4e40b5bd28f0775b4694d9"><enum>(b)</enum><header>Funding</header><text>The Administrator shall set aside $10,000,000 from amounts in the Fund to make grants or enter into contracts or cooperative agreements under subsection (a).</text></subsection><subsection id="id16d170663379497a9aab0d4e7e28e089"><enum>(c)</enum><header>Resource partners</header><text>In addition to the activities described in subsection (a), the Administrator shall, in partnership with entities participating in the Community Navigator pilot program established under section 5004 of the American Rescue Plan Act (<external-xref legal-doc="usc" parsable-cite="usc/15/9013">15 U.S.C. 9013</external-xref>), small business development centers (as defined in section 3 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/632">15 U.S.C. 632</external-xref>)), women’s business centers described in section 29 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/15/656">15 U.S.C. 656</external-xref>), Veteran Business Outreach Centers described in section 32 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/15/657b">15 U.S.C. 657b</external-xref>), and the Service Corps of Retired Executives established under section 8(b)(1)(B) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/15/637">15 U.S.C. 637(b)(1)(B)</external-xref>)—</text><paragraph id="idc9904d5c84a94385a84c9ee3a5e873cf" commented="no"><enum>(1)</enum><text>help make border businesses aware of the availability of the program under this subtitle and promote engagement with that program; and</text></paragraph><paragraph id="id0d70cdb832b04d1eb3ac721198d2984a" commented="no"><enum>(2)</enum><text>provide technical assistance to applicants, including instructions on how to participate in the program under this subtitle, assistance in preparing applications for participation in that program, and assistance in complying with any reporting requirements established by the Administrator with respect to that program.</text></paragraph></subsection><subsection id="idf9c3755c1ba2491daeb876638ec6edc1"><enum>(d)</enum><header>Language access</header><text>The Administrator shall ensure that outreach and technical assistance activities described in this section are made available to border businesses in the 10 most commonly spoken languages, other than English, in the States of the United States that border the international boundary with Mexico or that border the international boundary with Canada, including in Spanish and in French. </text></subsection></section></subtitle><subtitle id="id899B07794A3A4F4AAB499DA60675B4CE" style="OLC" commented="no"><enum>D</enum><header>Support for live venue service and support companies</header><section id="idB701156BF70E46639BA7A295E13E066F" commented="no"><enum>241.</enum><header>Definitions</header><text display-inline="no-display-inline">In this subtitle:</text><paragraph id="id40C4E2149C724DAD9EAB0CABDC5740FE" commented="no"><enum>(1)</enum><header>Affiliated business</header><subparagraph id="id029FC444D91245568D7F6EDB3964C5EE" commented="no"><enum>(A)</enum><header>In general</header><text>The term <term>affiliated business</term> means a business in which an eligible entity has an equity or right to profit distributions of not less than 50 percent, or in which an eligible entity has the contractual authority to control the direction of the business, provided that such affiliation shall be determined as of any arrangements or agreements in existence as of February 29, 2020.</text></subparagraph><subparagraph id="id9ED309192CCF433092598E1248C89EC0" commented="no"><enum>(B)</enum><header>Regulations</header><text>For purposes of eligibility for covered grants—</text><clause id="id79213C1579544D269052AC15496BE948" commented="no"><enum>(i)</enum><text>the provisions applicable to affiliations under section 121.301 of title 13, Code of Federal Regulations, or any successor regulation, are waived for any business concern operating as a franchise that is assigned a franchise identifier code by the Administration; and</text></clause><clause id="idf68ba758e1a64cc087a9602e57eb792d" commented="no"><enum>(ii)</enum><text>the exceptions to affiliation noted in section 121.103(b) of title 13, Code of Federal Regulations, or any successor regulation, shall apply to an affiliated business. </text></clause></subparagraph></paragraph><paragraph id="idA62A83C4E3FB4A1CA23C79A2E85C3F6E" commented="no"><enum>(2)</enum><header>Covered grant</header><text>The term <term>covered grant</term> means a grant under section 503 made to an eligible entity. </text></paragraph><paragraph id="id3B94B86A295D416FA854CA3639F3BFF3" commented="no"><enum>(3)</enum><header>Covered period</header><text>The term <term>covered period</term> means the period—</text><subparagraph id="idCBD117C9D46D4E5F83EA604A361D4F32" commented="no"><enum>(A)</enum><text>beginning on March 1, 2020; and</text></subparagraph><subparagraph id="id1F3894837EA442F48A055A8ECCEF20C3" commented="no"><enum>(B)</enum><text>ending on March 31, 2023, or a date to be determined by the Administrator that is not later than 2 years after the date of enactment of this Act.</text></subparagraph></paragraph><paragraph id="id7E82A3A6C3B045A8B2242F54072A6D3D" commented="no"><enum>(4)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term>—</text><subparagraph id="idaa28af50a50848c58b219c26fe3f911a" commented="no"><enum>(A)</enum><text>means an individual or entity—</text><clause id="id79205d59e0ce4f739d241c51dc8fcc8b" commented="no"><enum>(i)</enum><text>that is assigned a North American Industry Classification System code of 532289, 532490, 541410, 541420, 541430, 541490, 561591, 561920, 711190, 711300, or 711320, as appears on the most recent income tax filing or on the application for a loan under paragraph (36) or (37) of section 7(a) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(a)</external-xref>) of the individual or entity, if applicable; and</text></clause><clause id="idc33cfdcf756449c5bcae5fca03158ab9" commented="no"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="idDAB21B7E68C7436EB17AD87502B41EF6"><enum>(I)</enum><item commented="no" display-inline="yes-display-inline" id="id248DE6D62300487689669666D4DD5955"><enum>(aa)</enum><text>that, as the principal business of the individual or entity, provides stages, lighting, sound, casts, or other support for live events; and</text></item><item id="idf56788fa83734122a09b096142a28e49" indent="up2" commented="no"><enum>(bb)</enum><text>for which not less than 65 percent of the earned revenue generated through providing the support described in item (aa) is for live events organized, promoted, produced, managed, or hosted by an eligible person or entity described in section 324(a)(1)(A)(iii) of the Economic Aid to Hard-Hit Small Businesses, Nonprofits, and Venues Act (<external-xref legal-doc="usc" parsable-cite="usc/15/9009a">15 U.S.C. 9009a(a)(1)(A)(iii)</external-xref>); or</text></item></subclause><subclause id="idc9eb0a6017d849afba71fe0a7e4c7fdf" indent="up1" commented="no"><enum>(II)</enum><item commented="no" display-inline="yes-display-inline" id="id24b23a96471e402288493bfef941d47f"><enum>(aa)</enum><text>as the principal business of the individual or entity, showcases performers or pre-packaged productions to potential buyers; and</text></item><item id="id0ab5877a3f2447e780ccae812e547858" indent="up1" commented="no"><enum>(bb)</enum><text>for which not less than 65 percent of the earned revenue generated through showcasing performers or pre-packaged productions described in item (aa) is for live events—</text><subitem id="id66f39c49dd074b07bf126a5f17be4885" commented="no"><enum>(AA)</enum><text>organized, promoted, produced, managed, or hosted by an eligible person or entity described in section 324(a)(1)(A)(iii) of the Economic Aid to Hard-Hit Small Businesses, Nonprofits, and Venues Act (<external-xref legal-doc="usc" parsable-cite="usc/15/9009a">15 U.S.C. 9009a(a)(1)(A)(iii)</external-xref>); or</text></subitem><subitem id="idcaf3c8c75d824ab08789b06922aa6b42" commented="no"><enum>(BB)</enum><text>hosted in a hotel or convention center facility;</text></subitem></item></subclause></clause></subparagraph><subparagraph id="id13c437c22d744d4fae2e5fa4f2b32420" commented="no"><enum>(B)</enum><text>includes an individual or entity described in subparagraph (A) that—</text><clause id="idb598e862ef824a81a478a5d4d99e7015" commented="no"><enum>(i)</enum><text>operates for profit;</text></clause><clause id="id8be5fcbd0c8b4c07beec80f0d396f585" commented="no"><enum>(ii)</enum><text>is a Tribally-owned concern; or</text></clause><clause id="id14f959435de043fc9e0e76ac4dc2f5eb" commented="no"><enum>(iii)</enum><text>is a corporation, limited liability company, or partnership or operated as a sole proprietorship; and</text></clause></subparagraph><subparagraph id="id2a5cd316f497449aac10e6dcc4acb33e" commented="no"><enum>(C)</enum><text>does not include—</text><clause id="id4517a2e137ae49a9a1bce2411113a414" commented="no"><enum>(i)</enum><text>an individual or entity described in subparagraph (A) that—</text><subclause id="id2d34ffed4f9c4f9cb32b51be94fd89de" commented="no"><enum>(I)</enum><text>employs more than 250 employees, determined on a full-time equivalency basis; </text></subclause><subclause id="id1cda70e73d6e476396c7ce2cb12ac26d" commented="no"><enum>(II)</enum><text>is registered outside of the United States; or</text></subclause><subclause id="id8090cc9f9cad4d3f90dea5c1666b3913" commented="no"><enum>(III)</enum><text>has pandemic-related revenue losses that are not greater than 25 percent;</text></subclause></clause><clause id="id39e75c4d36104a97b02a3627d27f2c71" commented="no"><enum>(ii)</enum><text>an entity described in subparagraph (A) that—</text><subclause id="id5bcccf0d029a484dae5fbd1ce958fce6" commented="no"><enum>(I)</enum><text>is a State or local government-operated business;</text></subclause><subclause id="id176c283d66e34ce29526735a8c3aa912" commented="no"><enum>(II)</enum><text>as of February 29, 2020, owns or operates (together with any affiliated business) more than 5 locations, regardless of whether those locations do business under the same or multiple names; or</text></subclause><subclause id="ida833c27fef0745efa89773a0649b4abe" commented="no"><enum>(III)</enum><text>has a pending application for, or has received, a grant under—</text><item id="id68eddb8b5e3a40589b648c517c4da11c" commented="no"><enum>(aa)</enum><text>section 324 of the Economic Aid to Hard Hit Small Businesses, Nonprofits, and Venues Act (<external-xref legal-doc="usc" parsable-cite="usc/15/9009a">15 U.S.C. 9009a</external-xref>); or</text></item><item id="idf0c6d3a86053482a8e57c2e4b98d68d1" commented="no"><enum>(bb)</enum><text>section 5003 of the American Rescue Plan Act of 2021 (<external-xref legal-doc="usc" parsable-cite="usc/15/9009c">15 U.S.C. 9009c</external-xref>);</text></item></subclause></clause><clause id="id04f6b2f361ea48ccaab40db2e9d4c08a" commented="no"><enum>(iii)</enum><text>a publicly-traded company;</text></clause><clause id="id1cf7aa97558e4572a52d71e639a7ad52" commented="no"><enum>(iv)</enum><text>an entity that is owned or operated by a private equity fund;</text></clause><clause id="idae59b48ba1944c0abdd7a8a0197969ea" commented="no"><enum>(v)</enum><text>an entity that was not in operation before March 1, 2020; or</text></clause><clause id="idb852d866ce2d4410accf157274605cc0" commented="no"><enum>(vi)</enum><text>an entity that is not in operation on, and does not intend to reopen on or before the date that is 180 days after, the date on which the entity applies for a covered grant. </text></clause></subparagraph></paragraph><paragraph id="idFD2B8883B5EE4CC886F1E4A6D32F0119" commented="no"><enum>(5)</enum><header>Fund</header><text>The term <term>Fund</term> means the Live Venue Service and Support Business Relief Fund established under section 242(a)(1).</text></paragraph><paragraph id="idC2BC93BA448B402D977A39DD13360BC3" commented="no"><enum>(6)</enum><header>Pandemic-related revenue loss</header><subparagraph id="id7D94F0134B194735B78B0A87878D620D" commented="no"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B), the term <term>pandemic-related revenue loss</term> means, with respect to an eligible entity—</text><clause id="idFB466E32134A4BC79826ED1C7605840C" commented="no"><enum>(i)</enum><text>except as provided in clauses (ii) and (iii), the gross receipts, as established using such verification documentation as the Administrator may require, of the eligible entity during 2020 subtracted from the gross receipts of the eligible entity in 2019, if such amount is greater than zero, except that the Administrator may make adjustments to this formula as needed for seasonal businesses, businesses affected by natural disasters, and to address other circumstances identified by the Administrator requiring accommodation;</text></clause><clause id="idA6AC5C3B668049878086264D185C213C" commented="no"><enum>(ii)</enum><text>if the eligible entity was not in operation for the entirety of 2019—</text><subclause id="id33F0D4E224C44AB780EDB8CC089CCC74" commented="no"><enum>(I)</enum><text>the difference, if greater than zero, between—</text><item id="id607A107300834B1BBC7AEFCBEFE11CAA" commented="no"><enum>(aa)</enum><text>the product obtained by multiplying the average monthly gross receipts of the eligible entity in 2019 by 12; and</text></item><item id="id3F8ABB2ED5674C118097752EFDED2891" commented="no"><enum>(bb)</enum><text>the product obtained by multiplying the average monthly gross receipts of the eligible entity in 2020 by 12; or</text></item></subclause><subclause id="idA02A4AF184014003A58784BBBFCA9FE6" commented="no"><enum>(II)</enum><text>an amount based on a formula determined by the Administrator; and</text></subclause></clause><clause id="idC2C1EFDE172F4786976349B11A61BC5F" commented="no" display-inline="no-display-inline"><enum>(iii)</enum><text>if the eligible entity opened during the period beginning on January 1, 2020 and ending on February 29, 2020, an amount based on a formula determined by the Administrator. </text></clause></subparagraph><subparagraph id="idCCBBBEA27B074C13860BC5913B06978B" commented="no"><enum>(B)</enum><header>Reduction</header><clause id="id627008E7781B44FEA97A3AE394F22AE9" commented="no"><enum>(i)</enum><header>In general</header><text>The pandemic-related revenue losses for an eligible entity shall be reduced by—</text><subclause id="id19561E4C62C04E09AE6BFD6B33E433AA" commented="no"><enum>(I)</enum><text>any amounts received from a covered loan made under paragraph (36) or (37) of section 7(a) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(a)</external-xref>) in 2020 or 2021; and</text></subclause><subclause id="id45530ac2c9ce40f1a94b070b5c4c85ab" commented="no"><enum>(II)</enum><text>the amount by which the total of all remunerative payments made to an individual, including any annual salary paid to an employee, in 2020 exceeds $250,000. </text></subclause></clause><clause id="id3AD3908F5806429EA61570B515269844" commented="no"><enum>(ii)</enum><header>Administrator authority</header><text>The Administrator may determine the types of payments and individuals to which clause (i)(II) applies.</text></clause></subparagraph></paragraph></section><section id="idC378FDF6F1D0491E9574C1F5890DB4A1" commented="no"><enum>242.</enum><header>Live Venue Service and Support Business Relief Fund</header><subsection id="idB967FB12F7BE4456B2872B605B2D8990" commented="no"><enum>(a)</enum><header>Establishment</header><paragraph id="id4A112052C3C9430C82A5B83CFE8E4B6A" commented="no"><enum>(1)</enum><header>In general</header><text>There is established within the Restaurant Revitalization Fund established under section 5003 of the American Rescue Plan Act of 2021 (<external-xref legal-doc="usc" parsable-cite="usc/15/9009c">15 U.S.C. 9009c</external-xref>) a fund to be known as the Live Venue Service and Support Business Relief Fund. </text></paragraph><paragraph id="id93719CA57558497C8994EE7846BEC881" commented="no"><enum>(2)</enum><header>Use of funds</header><text>Subject to section 266, the Administrator may use amounts in the Fund only for the purposes described in this subtitle and not for any purpose described in section 5003 of the American Rescue Plan Act of 2021 (<external-xref legal-doc="usc" parsable-cite="usc/15/9009c">15 U.S.C. 9009c</external-xref>).</text></paragraph></subsection><subsection id="id5E9A49F2CA764F8695E31F1835A1CEDC" commented="no"><enum>(b)</enum><header>Appropriations</header><text>In addition to amounts otherwise available, there is appropriated to the Fund for fiscal year 2022, out of any money in the Treasury not otherwise appropriated, $2,000,000,000, to remain available until expended.</text></subsection></section><section id="idE8956432084843A09C3B369F85C3B064" commented="no"><enum>243.</enum><header>Grants from Fund</header><subsection id="idBBB6627BEB5F4902AE269F22F7F23282" commented="no"><enum>(a)</enum><header>In general</header><text>Except as provided in subsection (c)(3), the Administrator shall make covered grants to eligible entities in the order in which applications are received by the Administrator.</text></subsection><subsection id="id1C2AF4BE47B14AD8AB92D5CF0AFD315A" commented="no"><enum>(b)</enum><header>Applications</header><paragraph id="idD29B82CE5EA143048DE7B967543447C8" commented="no"><enum>(1)</enum><header>Certification</header><text>An eligible entity applying for a covered grant shall make a good faith certification that—</text><subparagraph id="id7D064F859C8743AB9CA3C3AE799EAC5E" commented="no"><enum>(A)</enum><text>the uncertainty of current economic conditions makes necessary the request for the covered grant to support the ongoing operations of the eligible entity;</text></subparagraph><subparagraph id="id983F728C15AE49B5A6C933E0B278238E" commented="no"><enum>(B)</enum><text>the eligible entity does not have a pending application for, and has not received, a grant under— </text><clause id="idD1109F6D4A1B471CB441155D80F19024" commented="no"><enum>(i)</enum><text>section 324 of the Economic Aid to Hard-Hit Small Businesses, Nonprofits, and Venues Act (<external-xref legal-doc="usc" parsable-cite="usc/15/9009a">15 U.S.C. 9009a</external-xref>); or </text></clause><clause id="id3CD87F5DF1884F16826CCC47B1FF87FB" commented="no"><enum>(ii)</enum><text>section 5003 of the American Rescue Plan Act of 2021 (<external-xref legal-doc="usc" parsable-cite="usc/15/9009c">15 U.S.C. 9009c</external-xref>); and</text></clause></subparagraph><subparagraph id="idED9E3AAAE7E14D6883A6A938582C8393" commented="no"><enum>(C)</enum><text>contains any other information that the Administrator may require.</text></subparagraph></paragraph><paragraph id="idAFD7A0DF8C9F41508516954399A4FB19" commented="no"><enum>(2)</enum><header>Verification materials</header><text>Subject to section 241(6)(A)(i), the Administrator shall use tax records, and may, in addition, use other reliable sources such as certified accounting statements, with respect to an applicant for a covered grant to determine—</text><subparagraph id="id70C798172FF74023AA7258FE9B43FB0F" commented="no"><enum>(A)</enum><text>the eligibility of the applicant for that covered grant; and</text></subparagraph><subparagraph id="idA6319047AC0649529BD17ADA775D831E" commented="no"><enum>(B)</enum><text>the amount of that covered grant to the applicant.</text></subparagraph></paragraph><paragraph id="id3DA9155D7E1D444EBAB8D5D19D407A12" commented="no"><enum>(3)</enum><header>Acceptance of applications</header><text>Not later than 60 days after the date of enactment of this Act, the Administrator shall begin accepting applications for covered grants.</text></paragraph></subsection><subsection id="id110880CAD30948D58322C4A57E9FDD52" commented="no"><enum>(c)</enum><header>Amount of grant</header><paragraph id="idDE7D483A1E1B4569ABCA98CB129F9A60" commented="no"><enum>(1)</enum><header>Aggregate maximum amount</header><text>The aggregate amount of covered grants made to an eligible entity and any affiliated businesses of the eligible entity shall not exceed $2,000,000.</text></paragraph><paragraph id="id2AAEAF05B59849A7BD9996B9DDB519D8" commented="no"><enum>(2)</enum><header>Determination of amount of grant</header><subparagraph id="id2FE347B3D8874265A5EC388A6D37BB20" commented="no"><enum>(A)</enum><header>In general</header><text>Except as provided in this subsection, the amount of a covered grant made to an eligible entity shall be equal to the difference between—</text><clause id="id26A9EE21FF2346E795FD21E033AFA1A5" commented="no"><enum>(i)</enum><text>the pandemic-related revenue loss of the eligible entity; and</text></clause><clause id="id4F4916D140A74926BC5015D5B95846C2" commented="no"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="id370A2438BD4242E3A5B9AF36B83E6299"><enum>(I)</enum><text>the amount equal to the product obtained by multiplying 3 by the average monthly gross receipts of the eligible entity in 2019; or</text></subclause><subclause id="idB497809571C744958C1A844D312A4021" indent="up1" commented="no"><enum>(II)</enum><text>for an eligible entity that did not have gross receipts in 2019, because the eligible entity began operating between January 1, 2020 and February 29, 2020 or due to other factors identified by the Administrator, an alternative amount based on a formula to be determined by the Administrator.</text></subclause></clause></subparagraph><subparagraph id="id40FDC4AB16714079806605A5C0C85F38" commented="no"><enum>(B)</enum><header>Limitation</header><text>An eligible entity may not receive a covered grant in an amount that is greater than—</text><clause id="idC850B5440D2D4CFAB7817DE9154D619D" commented="no"><enum>(i)</enum><text>the amount equal to the product obtained by multiplying 6 by the average monthly gross receipts of the eligible entity in 2019; or</text></clause><clause id="id5791F75C6E8D4903AFBCA911AB296E55" commented="no"><enum>(ii)</enum><text>if the eligible entity was not in operation for the entirety of 2019, if the gross receipts of the eligible entity during 2019 were reduced due to other factors identified by the Administrator, or if the eligible entity opened during the period beginning on January 1, 2020 and ending on February 29, 2020, an amount determined under a formula established by the Administrator.</text></clause></subparagraph><subparagraph id="id8AD16668405D47EA9EEB9EA04EB8D8E2" commented="no" display-inline="no-display-inline"><enum>(C)</enum><header>Minimum amount</header><text>The Administrator may establish a minimum amount of a covered grant in an amount that is not more than $10,000.</text></subparagraph><subparagraph id="id7EAA565FF2174A21A2E93B84FF2D994D" commented="no"><enum>(D)</enum><header>Return to SBA</header><text>Any amount of a covered grant to an eligible entity based on estimated receipts that is greater than the actual gross receipts of the eligible entity in 2020 shall be returned to the Administrator, who may use those returned funds to make additional covered grants.</text></subparagraph></paragraph><paragraph id="id3AEA37C7D9D04E968F174E9941279953" commented="no"><enum>(3)</enum><header>Insufficient funding</header><subparagraph commented="no" id="idEED1FFADA7544D0AB917C6C65D6A0E9C"><enum>(A)</enum><header>In general</header><text>If the Administrator determines that the amounts made available to carry out this subtitle are insufficient to make covered grants to each eligible entity in the amount provided under paragraphs (1) and (2), the Administrator shall— </text><clause id="idC1DD911F21464CF880C0488F4C68EA7D" commented="no"><enum>(i)</enum><text>make covered grants with the available amounts—</text><subclause id="idD60F7B3466CF472CB068FC50A86765BE" commented="no"><enum>(I)</enum><text>such that the amount of the covered grant that each such eligible entity would have otherwise received under those paragraphs is reduced by an equal percentage; </text></subclause><subclause id="id0A584E9E55E04264885ADCAE9E7AF080" commented="no"><enum>(II)</enum><text>by establishing a maximum amount for a covered grant made under this clause to ensure that smaller eligible entities still receive covered grants in the amounts provided under those paragraphs; or </text></subclause><subclause id="id8682C1421A8D451186F0323F1F211BCA" commented="no" display-inline="no-display-inline"><enum>(III)</enum><text>by providing covered grants in the amounts provided under those paragraphs below a certain threshold (as the Administrator may establish) and reducing covered grants above that threshold by an equal percentage; and </text></subclause></clause><clause id="id26221B9871F3462BB65778145D5D6B48" commented="no"><enum>(ii)</enum><text>in a manner that complies with clause (i), make covered grants to each eligible entity that submits an application for a covered grant during the 21-day period beginning on the date on which the Administrator begins accepting those applications.</text></clause></subparagraph><subparagraph id="idD8B2F692F30048869907D814F2C1C6F9" commented="no"><enum>(B)</enum><header>Reserving funds</header><text>Nothing in subparagraph (A) shall prevent the Administrator from— </text><clause id="idA825E0A46A1A42D49020D85B9E3BD268" commented="no"><enum>(i)</enum><text>reserving funding for applicants that may be determined to be eligible for a covered grant upon reconsideration; or </text></clause><clause id="idB87ED78845B34022BED4B36C3DE01B00" commented="no" display-inline="no-display-inline"><enum>(ii)</enum><text>making partial awards to eligible entities on a preliminary basis until the amount of funding required to fund covered grants to all eligible entities that submit applications is established, upon the completion of the reconsideration process. </text></clause></subparagraph></paragraph></subsection><subsection id="id314BEB1105834B7686B8C99AEA47D832" commented="no"><enum>(d)</enum><header>Use of funds</header><text>During the covered period, an eligible entity that receives a covered grant may use amounts received under the covered grant for the following expenses incurred as a direct result of, or during, the COVID–19 pandemic:</text><paragraph id="idC123127AB9194AD5B4B9D17DBE45F5D5" commented="no"><enum>(1)</enum><text>Payroll costs. </text></paragraph><paragraph id="idB8B2CDF52204462F8F67353E6D492F6B" commented="no"><enum>(2)</enum><text>Payments to independent contractors, as reported on Form 1099-MISC, except that each payment under this paragraph shall be in an amount that is not more than $100,000.</text></paragraph><paragraph id="idA295CB974F444F43822570817D6796F7" commented="no"><enum>(3)</enum><text>Scheduled payments of interest or principal on any covered mortgage obligation (which may not include any prepayment of principal on a covered mortgage obligation).</text></paragraph><paragraph id="idE34D5A7E07B24C2897019D5C615DD722" commented="no"><enum>(4)</enum><text>Payments on any covered rent obligation and common area maintenance charges under a lease agreement.</text></paragraph><paragraph id="idD0E4DBCA7C3A4208B1EE5461B86F8BB5" commented="no"><enum>(5)</enum><text>Covered utility payments.</text></paragraph><paragraph id="id9E77E35F4C7F46C1AD3FD760F98E9F6E" commented="no"><enum>(6)</enum><text>Maintenance expenses.</text></paragraph><paragraph id="id7D3023D2ABF649D3BB6359F2D8203972" commented="no"><enum>(7)</enum><text>Covered worker protection expenditures.</text></paragraph><paragraph id="idE6F10320066E4B65B19C0E02887F5880" commented="no"><enum>(8)</enum><text>Supplies, including protective equipment and cleaning materials.</text></paragraph><paragraph id="idE0D817F39C194ACA8B9F1FA53F1D37B9" commented="no"><enum>(9)</enum><text>Expenses that were within the scope of the normal business practice of the eligible entity before the covered period.</text></paragraph><paragraph id="id530CB75AFAA34FCE81472EB815C4B654" commented="no"><enum>(10)</enum><text>Covered supplier costs.</text></paragraph><paragraph id="id8EFDC98FF06E4CB185D4A3BF3C3910A9" commented="no"><enum>(11)</enum><text>Operational expenses.</text></paragraph><paragraph id="id59AA464E224F44A59EA96BCED3E1AF78" commented="no"><enum>(12)</enum><text>Paid sick leave.</text></paragraph><paragraph id="id56F14918FE1E47318D4FCD38A1C261B4" commented="no"><enum>(13)</enum><text>Any other expenses that the Administrator determines to be essential to maintaining the eligible entity.</text></paragraph></subsection><subsection id="idD50CA3B284C647F4B68A855AA9B96605" commented="no"><enum>(e)</enum><header>Returning funds</header><text>If an eligible entity that receives a covered grant fails to use all of the amounts received under the covered grant on or before the last day of the covered period or permanently ceases operations on or before the last day of the covered period, the eligible entity shall return to the Treasury any funds that the eligible entity did not use for the allowable expenses under subsection (d).</text></subsection></section></subtitle><subtitle id="id8919E2570A88456F945F9F6C20E95678" style="OLC" commented="no"><enum>E</enum><header>Support for exclave community small businesses</header><section id="idf2a2bf6159374e5291c187dd00c1d969" commented="no"><enum>251.</enum><header>Definitions</header><text display-inline="no-display-inline">In this subtitle:</text><paragraph id="idF8B07119F8FB4D3E8FB6CC13066A164D" commented="no"><enum>(1)</enum><header>Affiliated business</header><subparagraph id="id68CB7FFFB45C46D3A9FDDCCB5B3F22C1" commented="no"><enum>(A)</enum><header>In general</header><text>The term <term>affiliated business</term> means a business in which an eligible entity has an equity or right to profit distributions of not less than 50 percent, or in which an eligible entity has the contractual authority to control the direction of the business, provided that such affiliation shall be determined as of any arrangements or agreements in existence as of February 29, 2020.</text></subparagraph><subparagraph id="id7D413A49001346569D25B91D29CA713A" commented="no"><enum>(B)</enum><header>Regulations</header><text>For purposes of eligibility for covered grants—</text><clause id="id729BC02E27AC4AEEAC93EE7F7E40A7F0" commented="no"><enum>(i)</enum><text>the provisions applicable to affiliations under section 121.301 of title 13, Code of Federal Regulations, or any successor regulation, are waived for any business concern operating as a franchise that is assigned a franchise identifier code by the Administration; and</text></clause><clause id="idF9C2D0F1776B4B3B95225BB912A43975" commented="no"><enum>(ii)</enum><text>the exceptions to affiliation noted in section 121.103(b) of title 13, Code of Federal Regulations, or any successor regulation, shall apply to an affiliated business. </text></clause></subparagraph></paragraph><paragraph id="idEEBDDCEBDD024E66A71D8303FF1F961C" commented="no"><enum>(2)</enum><header>Covered grant</header><text>The term <term>covered grant</term> means a grant under section 253 made to an eligible entity</text></paragraph><paragraph id="id2D14B8D401584D21A0375D8AADE9C0D2" commented="no"><enum>(3)</enum><header>Covered period</header><text>The term <term>covered period</term> means the period—</text><subparagraph id="id59F3CE90F4C44154BD1CAFE43C3BB3E8" commented="no"><enum>(A)</enum><text>beginning on March 1, 2020; and</text></subparagraph><subparagraph id="id1769182C3C944A66AB67A3EA091FDB8C" commented="no"><enum>(B)</enum><text>ending on March 31, 2023, or a date to be determined by the Administrator that is not later than 2 years after the date of enactment of this Act.</text></subparagraph></paragraph><paragraph id="id1159cd46fbd44fa2889bb4b64913fe03" commented="no"><enum>(4)</enum><header>Exclave</header><text>The term <term>exclave</term> means an area that is— </text><subparagraph id="id3692F33F50664AA396175AB70B7D23BD" commented="no"><enum>(A)</enum><text>located in the United States; </text></subparagraph><subparagraph id="id2BE70E2F40634E04812340FC48E1D1DB" commented="no"><enum>(B)</enum><text>within 75 miles of the international border between the United States and Canada; and </text></subparagraph><subparagraph id="idEAEB8C67906547A9AA5900C3044B2C75" commented="no"><enum>(C)</enum><text>only accessible by land via Canada. </text></subparagraph></paragraph><paragraph id="idF924585F401344869B7DFE20AD35A5B4" commented="no"><enum>(5)</enum><header>Eligible entity</header><text>The term <term>eligible entity</term>—</text><subparagraph id="id4324051c82ad45aa9cb42f66e64e80cb" commented="no"><enum>(A)</enum><text>means a small business concern (as defined in section 3 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/632">15 U.S.C. 632</external-xref>)) that—</text><clause id="id263c62e206fd4d99862817950a188588" commented="no"><enum>(i)</enum><text>is located in an exclave; and</text></clause><clause id="idec04daf17b93496c96684a6c7ca02392" commented="no"><enum>(ii)</enum><text>certifies, and, if requested by the Administrator, demonstrates, that the closure of the international border between the United States and Canada—</text><subclause id="id82f05a24fea748a6ae3b310616611711" commented="no"><enum>(I)</enum><text>directly resulted in a reduction in the gross receipts of the eligible entity; or </text></subclause><subclause id="id7594BB698BB14D89AFD8B67D1193338D" commented="no"><enum>(II)</enum><text>restricted the ability of customers to access the location of the small business concern; and </text></subclause></clause></subparagraph><subparagraph id="idb2a10a76a9d1499ab554ad97e43882db" commented="no"><enum>(B)</enum><text>does not include—</text><clause id="id72a7a7549d954488bb4c2bd1a197239c" commented="no"><enum>(i)</enum><text>an entity with pandemic-related revenue losses that are not greater than 25 percent;</text></clause><clause id="id188998284f474d048be5d986bdb97d47" commented="no"><enum>(ii)</enum><text>an entity described in subparagraph (A) that—</text><subclause id="id75802f9aea9242c3b2253478f8303fa4" commented="no"><enum>(I)</enum><text>is a State or local government-operated business;</text></subclause><subclause id="ide660d7106e4145f1b5279472bc5bffdb" commented="no"><enum>(II)</enum><text>as of March 1, 2020, owns or operates (together with any affiliated business) more than 10 locations, regardless of whether those locations do business under the same or multiple names; or</text></subclause><subclause id="id1771f3eedc064b5594083cf8e34366a6" commented="no"><enum>(III)</enum><text>has a pending application for or has received a grant under—</text><item id="idab8699b5f1fe4063969d500aa4cae403" commented="no"><enum>(aa)</enum><text>section 324 of the Economic Aid to Hard Hit Small Businesses, Nonprofits, and Venues Act (<external-xref legal-doc="usc" parsable-cite="usc/15/9009a">15 U.S.C. 9009a</external-xref>); or</text></item><item id="iddff35434684942ba8602f66c81f7c93e" commented="no"><enum>(bb)</enum><text>section 5003 of the American Rescue Plan Act of 2021 (<external-xref legal-doc="usc" parsable-cite="usc/15/9009c">15 U.S.C. 9009c</external-xref>);</text></item></subclause></clause><clause id="id4a89b54d8c8a4189b79deec274e564e1" commented="no"><enum>(iii)</enum><text>a publicly-traded company;</text></clause><clause id="idab7e2d6707a24ef3a3ae27eafa568891" commented="no"><enum>(iv)</enum><text>an entity that is owned or operated by a private equity fund; </text></clause><clause id="id5a938ab78c57470d82c8dba7386d2be3" commented="no"><enum>(v)</enum><text>an entity that was not in operation before March 1, 2020; or</text></clause><clause id="id3ae9104a2ad542e48a012813ea48e2f4" commented="no"><enum>(vi)</enum><text>an entity that is not in operation on, and does not intend to reopen on or before the date that is 180 days after, the date on which the entity applies for a covered grant. </text></clause></subparagraph></paragraph><paragraph id="id1F69D2741ABB4B288AC53CD780F0A08B" commented="no"><enum>(6)</enum><header>Fund</header><text>The term <term>Fund</term> means the Exclave Community Small Business Relief Fund established under section 252(a)(1).</text></paragraph><paragraph id="id164A2125FA5C48B4B3B46C9316C92880" commented="no"><enum>(7)</enum><header>Pandemic-related revenue loss</header><subparagraph id="id4A7619EFFEF64DFABF3AB6D586F13F24" commented="no"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B), the term <term>pandemic-related revenue loss</term> means, with respect to an eligible entity—</text><clause id="id6094466192B1454FAE6EF41B74F11394" commented="no"><enum>(i)</enum><text>except as provided in clauses (ii) and (iii), the gross receipts, as established using such verification documentation as the Administrator may require, of the eligible entity during 2020 subtracted from the gross receipts of the eligible entity in 2019, if such amount is greater than zero, except that the Administrator may make adjustments to this formula as needed for seasonal businesses, businesses affected by natural disasters, and to address other circumstances identified by the Administrator requiring accommodation;</text></clause><clause id="id45BCFE9A9D4349B6BA26E248787CFBA1" commented="no"><enum>(ii)</enum><text>if the eligible entity was not in operation for the entirety of 2019—</text><subclause id="id4F09464903904FBB8738D8B3669274C8" commented="no"><enum>(I)</enum><text>the difference, if greater than zero, between—</text><item id="idD12608327B54441095B4A1F8D98F3506" commented="no"><enum>(aa)</enum><text>the product obtained by multiplying the average monthly gross receipts of the eligible entity in 2019 by 12; and</text></item><item id="id8A0AEF9CAE5044CB9D52D7E7759D13A7" commented="no"><enum>(bb)</enum><text>the product obtained by multiplying the average monthly gross receipts of the eligible entity in 2020 by 12; or</text></item></subclause><subclause id="id794611E3AB15451AB3FF633D5F586EF8" commented="no"><enum>(II)</enum><text>an amount based on a formula determined by the Administrator; and</text></subclause></clause><clause id="id3FA6EBFF1EF34E408B4B13748A0A518D" commented="no"><enum>(iii)</enum><text>if the eligible entity opened during the period beginning on January 1, 2020, and ending on February 29, 2020, an amount based on a formula determined by the Administrator.</text></clause></subparagraph><subparagraph id="idF0047F463A6C497FB7FDA8A12FA5A270" commented="no"><enum>(B)</enum><header>Reduction</header><clause id="id0EFC70B62C9E4C57ADC16C556BA9B091" commented="no"><enum>(i)</enum><header>In general</header><text>The pandemic-related revenue losses for an eligible entity shall be reduced by—</text><subclause id="idCB0DDADCB55349F6BA9FBA454C8826A8" commented="no"><enum>(I)</enum><text>any amounts received from a covered loan made under paragraph (36) or (37) of section 7(a) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(a)</external-xref>) in 2020 or 2021; and</text></subclause><subclause id="id5F624CC4187B499ABBA556CA89C750CC" commented="no"><enum>(II)</enum><text>the amount by which the total of all remunerative payments made to an individual, including any annual salary paid to an employee, in 2020 exceeds $250,000. </text></subclause></clause><clause id="idFC5A2E0F8C5D4126BE6623A683C66D24" commented="no"><enum>(ii)</enum><header>Administrator authority</header><text>The Administrator may determine the types of payments and individuals to which clause (i)(II) applies.</text></clause></subparagraph></paragraph></section><section id="idE76DAAC3F3F04B2EA33E594C3DA98376" commented="no"><enum>252.</enum><header>Exclave Community Small Business Relief Fund</header><subsection id="id03731A8A3BA441B9A624055E2ED92B45" commented="no"><enum>(a)</enum><header>Establishment</header><paragraph id="idFEB5A4D4C9EF45C5A1E56C7AB381A318" commented="no"><enum>(1)</enum><header>In general</header><text>There is established within the Restaurant Revitalization Fund established under section 5003 of the American Rescue Plan Act of 2021 (<external-xref legal-doc="usc" parsable-cite="usc/15/9009c">15 U.S.C. 9009c</external-xref>) a fund to be known as the Exclave Community Small Business Relief Fund. </text></paragraph><paragraph id="id95373705FF6C4DA695A9EF4440AAB0D1" commented="no"><enum>(2)</enum><header>Use of funds</header><text>Subject to section 266, the Administrator may use amounts in the Fund only for the purposes described in this subtitle and not for any purpose described in section 5003 of the American Rescue Plan Act of 2021 (<external-xref legal-doc="usc" parsable-cite="usc/15/9009c">15 U.S.C. 9009c</external-xref>).</text></paragraph></subsection><subsection id="idDF9FCFBB5E65464FBA7B797FAB298F96" commented="no"><enum>(b)</enum><header>Appropriations</header><text>In addition to amounts otherwise available, there is appropriated to the Fund for fiscal year 2022, out of any money in the Treasury not otherwise appropriated, $85,000,000, to remain available until expended, of which $75,000,000 shall be available for eligible entities located in exclaves adjacent to the border between Alaska and Canada and $10,000,000 shall be available to exclaves adjacent to the border between the continental United States and Canada. </text></subsection></section><section id="id03AA3BF782C64D7DA0867FCCF008DB7A" commented="no"><enum>253.</enum><header>Grants from Fund</header><subsection id="idBE82B71605914ED197628548C3868B25" commented="no"><enum>(a)</enum><header>In general</header><text>Except as provided in subsection (c)(3)(B), the Administrator shall make covered grants to eligible entities in the order in which applications are received by the Administrator.</text></subsection><subsection id="id70561B85BFA34CD4B7F61666BF5077F9" commented="no"><enum>(b)</enum><header>Applications</header><paragraph id="id06153AF91D8A44749BC1FDEED2AE6E75" commented="no"><enum>(1)</enum><header>Certification</header><text>An eligible entity applying for a covered grant shall make a good faith certification that—</text><subparagraph id="id8EA61E45DBA544208490BC4174535962" commented="no"><enum>(A)</enum><text>the uncertainty of current economic conditions makes necessary the request for the covered grant to support the ongoing operations of the eligible entity;</text></subparagraph><subparagraph id="id5b199b6e5a63480c8ef882ce14dee075" commented="no"><enum>(B)</enum><text>closure of the international border between the United States and Canada—</text><clause id="id57932451930A4019917779B86945F87E" commented="no"><enum>(i)</enum><text>directly resulted in a reduction in the gross receipts of the eligible entity; or</text></clause><clause id="idC84985754D74477A99FA8061033FDF69" commented="no"><enum>(ii)</enum><text>restricted the ability of customers to access the location of the covered business;</text></clause></subparagraph><subparagraph id="idE1BD05CB8F32453BA3485863ADC05395" commented="no"><enum>(C)</enum><text>the eligible entity does not have a pending application for, and has not received, a grant under— </text><clause id="idC06418437C2E4C098BCA2D70BB9E2B9A" commented="no"><enum>(i)</enum><text>section 324 of the Economic Aid to Hard-Hit Small Businesses, Nonprofits, and Venues Act (<external-xref legal-doc="usc" parsable-cite="usc/15/9009a">15 U.S.C. 9009a</external-xref>); or </text></clause><clause id="id221AFFDBAAF146089C880B4468F24B6E" commented="no"><enum>(ii)</enum><text>section 5003 of the American Rescue Plan Act of 2021 (<external-xref legal-doc="usc" parsable-cite="usc/15/9009c">15 U.S.C. 9009c</external-xref>); and</text></clause></subparagraph><subparagraph id="id16877340F104429FB70FBD23C5BC33FF" commented="no"><enum>(D)</enum><text>contains any other information that the Administrator may require.</text></subparagraph></paragraph><paragraph id="id680F175884094DA699897856C1186974" commented="no"><enum>(2)</enum><header>Verification materials</header><text>Subject to section 251(7)(A)(i), the Administrator shall use tax records, and may, in addition, use other reliable sources such as certified accounting statements, with respect to an applicant for a covered grant to determine—</text><subparagraph id="idD42733D425094408A0204CBBBE51350D" commented="no"><enum>(A)</enum><text>the eligibility of the applicant for that covered grant; and</text></subparagraph><subparagraph id="id3AEEC9D5C85049A08B9BFAAE10A4BB61" commented="no"><enum>(B)</enum><text>the amount of that covered grant to the applicant.</text></subparagraph></paragraph><paragraph id="idFC1953E86EB048FDAA7261B78E53CC4F" commented="no"><enum>(3)</enum><header>Acceptance of applications</header><text>Not later than 60 days after the date of enactment of this Act, the Administrator shall begin accepting applications for covered grants.</text></paragraph></subsection><subsection id="id88BA874D1E94490EAD1A78BE81AFBE05" commented="no"><enum>(c)</enum><header>Amount of grant</header><paragraph id="id4C78756CA08C422C8509FCE287D35525" commented="no"><enum>(1)</enum><header>Aggregate maximum amount</header><text>The aggregate amount of covered grants made to an eligible entity and any affiliated businesses of the eligible entity shall not exceed $3,000,000.</text></paragraph><paragraph id="idBAEF3CFC9A944F5A821DA0620C8E2035" commented="no"><enum>(2)</enum><header>Determination of amount of grant</header><subparagraph id="idEA59F649836745ECB6021A5F00DBAF45" commented="no"><enum>(A)</enum><header>In general</header><text>Except as provided in section 252(b) and in this subsection, the amount of a covered grant made to an eligible entity shall be equal to the difference between—</text><clause id="idBE1C961C93FA43948FC1B6208583AD7B" commented="no"><enum>(i)</enum><text>the pandemic-related revenue loss of the eligible entity; and</text></clause><clause id="id9BAC597DC5B444829106491A92E65CA7" commented="no"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="id409C5EFFB2E34613996B1D67B84FCE45"><enum>(I)</enum><text>the amount equal to the product obtained by multiplying 3 by the average monthly gross receipts of the eligible entity in 2019; or</text></subclause><subclause id="id6996F04BB6254BB9847E729B572141BD" indent="up1" commented="no"><enum>(II)</enum><text>for an eligible entity that did not have gross receipts in 2019, because the eligible entity began operating between January 1, 2020 and February 29, 2020 or due to other factors identified by the Administrator, an alternative amount based on a formula to be determined by the Administrator.</text></subclause></clause></subparagraph><subparagraph id="id36585BE5E9D644FF988889599F686F28" commented="no" display-inline="no-display-inline"><enum>(B)</enum><header>Minimum amount</header><text>The Administrator may establish a minimum amount of a covered grant in an amount that is not more than $10,000.</text></subparagraph><subparagraph id="id418D024CDFE840A2ABB9F0183D481B5E" commented="no"><enum>(C)</enum><header>Return to SBA</header><text>Any amount of a covered grant to an eligible entity based on estimated receipts that is greater than the actual gross receipts of the eligible entity in 2020 shall be returned to the Administrator, who may use those returned funds to make additional covered grants.</text></subparagraph></paragraph><paragraph id="id4B691F4A768A48A1977D70B0344C60AE" commented="no"><enum>(3)</enum><header>Insufficient funding</header><subparagraph commented="no" id="id5EFE047F3C0A4B4D911BC1A29758AA22"><enum>(A)</enum><header>In general</header><text>If the Administrator determines that the amounts made available to carry out this subtitle are insufficient to make covered grants to each eligible entity in the amount provided under paragraphs (1) and (2) and in accordance with the allocations under section 252(b), the Administrator shall—</text><clause id="id8898368B006C40C8A93D49296B0DC51D" commented="no"><enum>(i)</enum><text>make covered grants with the available amounts— </text><subclause id="idB0A38F47EF17419AB09C1E9BAD2D801E" commented="no"><enum>(I)</enum><text>such that the amount of the covered grant that each such eligible entity would have otherwise received under those paragraphs is reduced by an equal percentage; </text></subclause><subclause id="id95EDB2FD020A4B47A8891627AE1C4F2B" commented="no"><enum>(II)</enum><text>by establishing a maximum amount for a covered grant made under this clause to ensure that smaller eligible entities still receive covered grants in the amounts provided under those paragraphs; or </text></subclause><subclause id="id14562BDF8CA4425096A487CC0E629B48" commented="no" display-inline="no-display-inline"><enum>(III)</enum><text>by providing covered grants in the amounts provided under those paragraphs below a certain threshold (as the Administrator may establish) and reducing covered grants above that threshold by an equal percentage; and </text></subclause></clause><clause id="id7D87312F96054640887F7C64482832EF" commented="no"><enum>(ii)</enum><text>in a manner that complies with clause (i), make covered grants to each eligible entity that submits an application for a covered grant during the 21-day period beginning on the date on which the Administrator begins accepting those applications.</text></clause></subparagraph><subparagraph id="id35bf675766954692bce75ce3c35f7708" commented="no"><enum>(B)</enum><header>Reserving funds</header><text>Nothing in subparagraph (A) shall prevent the Administrator from—</text><clause id="id75fbb7e6b792412990dfdcadb6264078" commented="no"><enum>(i)</enum><text>reserving funding for applicants that may be determined to be eligible for a covered grant upon reconsideration; or</text></clause><clause id="id21d2320e363d4ec5ae18d0c446b1b47a" commented="no"><enum>(ii)</enum><text>making partial awards to eligible entities on a preliminary basis until the amount of funding required to fund covered grants to all eligible entities that submit applications is established, upon the completion of the reconsideration process. </text></clause></subparagraph></paragraph></subsection><subsection id="id89D773CA78BD4565B525278E7B14D94E" commented="no"><enum>(d)</enum><header>Use of funds</header><paragraph id="id8A30E8561A41493BB949A53C8FDE56AC" commented="no"><enum>(1)</enum><header>Permitted uses</header><text>During the covered period, an eligible entity that receives a covered grant may use amounts received under the covered grant for the following expenses incurred as a direct result of, or during, the COVID–19 pandemic:</text><subparagraph id="idE87A2B493A344AEB90214A78AE5864BF" commented="no"><enum>(A)</enum><text>Payroll costs. </text></subparagraph><subparagraph id="idB42463007857410B9A172401DBCAE55E" commented="no"><enum>(B)</enum><text>Payments to independent contractors, as reported on Form 1099-MISC, except that each payment under this subparagraph shall be in an amount that is not more than $100,000.</text></subparagraph><subparagraph id="idD96896E05DAB4861A4393BF42A38E975" commented="no"><enum>(C)</enum><text>Scheduled payments of interest or principal on any covered mortgage obligation (which may not include any prepayment of principal on a covered mortgage obligation).</text></subparagraph><subparagraph id="idCAB07B5E9F6848CFBFF701FD526400E7" commented="no"><enum>(D)</enum><text>Payments on any covered rent obligation and common area maintenance charges under a lease agreement.</text></subparagraph><subparagraph id="idF27FE0B0F6C44C70989897C48D3165F7" commented="no"><enum>(E)</enum><text>Covered utility payments.</text></subparagraph><subparagraph id="id088FCDE601FC4E608138D223DA95D1A3" commented="no"><enum>(F)</enum><text>Maintenance expenses.</text></subparagraph><subparagraph id="id31A22C5BC8AD4CC086BDB15B3D2BCD89" commented="no"><enum>(G)</enum><text>Covered worker protection expenditures.</text></subparagraph><subparagraph id="id725D2C21AEA0420AAE012F4EDB5BE8D7" commented="no"><enum>(H)</enum><text>Supplies, including protective equipment and cleaning materials.</text></subparagraph><subparagraph id="id516AF53E3FA34C95879445CD35C8069B" commented="no"><enum>(I)</enum><text>Expenses that were within the scope of the normal business practice of the eligible entity before the covered period.</text></subparagraph><subparagraph id="id8FED43E4BC6B4907B732E80075B01727" commented="no"><enum>(J)</enum><text>Covered supplier costs.</text></subparagraph><subparagraph id="id22F48069F6BE4D739629855CAFD500DE" commented="no"><enum>(K)</enum><text>Operational expenses.</text></subparagraph><subparagraph id="id7239DB32304A4CDFA95800B5EA849373" commented="no"><enum>(L)</enum><text>Paid sick leave.</text></subparagraph><subparagraph id="idC0A1BA2BFC93440E9FACEE924B868C24" commented="no"><enum>(M)</enum><text>Any other expenses that the Administrator determines to be essential to maintaining the eligible entity.</text></subparagraph></paragraph><paragraph id="id3F6B6EEE4E9C495495BF646AF258DDC3" commented="no"><enum>(2)</enum><header>Prohibited uses</header><text>An eligible entity may not use amounts received under a covered grant for expenses incurred by the eligible entity outside the exclave, including those expenses incurred by related or affiliated businesses located outside the exclave.</text></paragraph></subsection><subsection id="idD86EA1DFDD464170AC259C936B2B6958" commented="no"><enum>(e)</enum><header>Returning funds</header><text>If an eligible entity that receives a covered grant fails to use all of the amounts received under the covered grant on or before the last day of the covered period or permanently ceases operations on or before the last day of the covered period, the eligible entity shall return to the Treasury any funds that the eligible entity did not use for the allowable expenses under subsection (d).</text></subsection></section></subtitle><subtitle id="id22281F947D1640A3A8A31F98210640DD" style="OLC" commented="no"><enum>F</enum><header>Administration and implementation of support programs</header><section id="idC578C1784A394D8E8E7A2C3730003EEA" commented="no"><enum>261</enum><header>Definition</header><text display-inline="no-display-inline">In this subtitle, the term <term>covered program</term> means a program for which grants are authorized under this title. </text></section><section id="id7ED6F04F3708435E951AEFBC99A7E818" commented="no"><enum>262.</enum><header>Data transparency and customer service</header><text display-inline="no-display-inline">The Administrator shall—</text><paragraph id="id119D0B6B0D194155AA57377BD751926F" commented="no"><enum>(1)</enum><text>in carrying out each covered program, maintain regular communication during the period during which the covered program is in effect with applicants and their representatives, including by— </text><subparagraph id="idF6C6489EA2104E228720289A8A94827E" commented="no"><enum>(A)</enum><text>hosting regularly scheduled information sessions with applicants and their representatives; and </text></subparagraph><subparagraph id="idA1E53F984DEB46A7BBA40DBD43F847FB" commented="no"><enum>(B)</enum><text>providing opportunities to applicants and their representatives to submit and receive answers to questions regarding covered programs;</text></subparagraph></paragraph><paragraph id="idFF7168C10F8E42BEBB49785E216DDEDA" commented="no"><enum>(2)</enum><text>for each covered program, on a bi-weekly basis until the amounts made available under this title for the covered program are fully expended, publish data that shows, for the period beginning on the date of enactment of this Act and ending on the date on which the information is published—</text><subparagraph id="idC747712D140B4BCDBAD14AFB3EE9A4CD" commented="no"><enum>(A)</enum><text>with respect to applications for grants under each covered program, the number of those applications—</text><clause id="idF33BC2CE841A43B9AEF67A8A688B97CE" commented="no"><enum>(i)</enum><text>that the Administrator has received;</text></clause><clause id="idE7670A7280EF46BAA6643FE6664CDF23" commented="no"><enum>(ii)</enum><text>that the Administrator has reviewed or is in the process of reviewing; and</text></clause><clause id="idDCF763E9D1754977B51EB449F9A4B908" commented="no"><enum>(iii)</enum><text>with respect to which the Administrator has made a decision; and</text></clause></subparagraph><subparagraph id="idC529413BB3E84F008900B5F3D75E3B41" commented="no"><enum>(B)</enum><text>the number and dollar amount of grants under each covered program—</text><clause id="id2B018EB5BC68459ABD356085CF01758F" commented="no"><enum>(i)</enum><text>that are awarded; and</text></clause><clause id="id944B1D688E794CD8BF2B34934C89ABE3" commented="no"><enum>(ii)</enum><text>that are disbursed; </text></clause></subparagraph></paragraph><paragraph id="idC47FD80F0FC842CCBFB2A0DF462A4EB8" commented="no"><enum>(3)</enum><text>for each covered program, on a weekly basis until the amounts made available under this title to carry out the covered program are fully expended, publish, with respect to the period beginning on the date of enactment of this Act and ending on the date on which the information is published—</text><subparagraph id="id42837f87e72a479cbd105409cdb468b6" commented="no"><enum>(A)</enum><text>with respect to each entity to which a grant has been made under the covered program—</text><clause id="ide3d750a1e388492faa02afe551cee40c" commented="no"><enum>(i)</enum><text>the name of the entity, including the name under which the entity does business if that name is different from the name of the entity; </text></clause><clause id="idf14d5d54e1914413aad0209dbb889bfe" commented="no"><enum>(ii)</enum><text>the address of the entity; and</text></clause><clause id="idC6F6CF7D0B9243B58FF0C3D3006A3CDF" commented="no"><enum>(iii)</enum><text>if the physical location for the eligible business listed on the application is different from the address of the entity, the address of such physical location; and</text></clause></subparagraph><subparagraph id="id3828e53cb3ad4ea688b95d5e6ffe59ed" commented="no"><enum>(B)</enum><text>the amount of each grant described in subparagraph (A); and </text></subparagraph></paragraph><paragraph id="idC69F533EEF674BA5A72C4A7B6639EB20" commented="no"><enum>(4)</enum><text>with respect to an applicant that applies for a grant under a covered program and is denied by the Administrator—</text><subparagraph id="idCDF24E2884F84D3AA12DD5D64A7554CE" commented="no"><enum>(A)</enum><text>make available to the applicant a brief explanation identifying the reason why the Administrator denied the application of the applicant, which shall include, where applicable, a citation to the statutory, regulatory, or guidance provision with which the applicant failed to comply and that was the basis for the denial; and</text></subparagraph><subparagraph id="id7B1FC937AF874079AD8C688264753286" commented="no"><enum>(B)</enum><text>establish a reconsideration process through which the applicant may— </text><clause id="id84250EB3D6CE45C1A2EAAD4A14C54D46" commented="no"><enum>(i)</enum><text>submit to the Administrator additional clarifying information the applicant determines to be relevant to whether the applicant is eligible for the grant; </text></clause><clause id="id413AA21573E44F75823C0FE1D9F71620" commented="no"><enum>(ii)</enum><text>challenge the decision of the Administrator; and </text></clause><clause id="id2717D81A708341F4A47D467524026EA4" commented="no" display-inline="no-display-inline"><enum>(iii)</enum><text>receive a second review of the application submitted by the applicant.</text></clause></subparagraph></paragraph></section><section id="id975B221F56CA44428C20C5CC2145CA3E" commented="no"><enum>263.</enum><header>Business identifiers</header><text display-inline="no-display-inline">In accepting applications for grants under a covered program, the Administrator shall prioritize the ability of each applicant to use the existing business identifier of the applicant over requiring other forms of registration or identification that may not be common to the industry of the applicant, which may impose additional burdens on the applicant. </text></section><section id="idB18073B6D3A64CA88B7607D50C7F9BAE" commented="no"><enum>264.</enum><header>Applications</header><subsection id="id21C29DF09ADE487E8D46D0B5BFD7F373" commented="no"><enum>(a)</enum><header>Expedited processing and approval authority</header><paragraph id="idF10BFDB63F4F49B4A587E438F4490A0F" commented="no"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Director of the Office of Management and Budget may, on an emergency basis, and in order to expedite the processing and approval of applications for grants under a covered program, waive the requirements of part 200 of title 2, Code of Federal Regulations, or any successor regulations, with respect to the covered program if—</text><subparagraph id="id15CCAF78CCCF4093815CD8370438DEF3" commented="no"><enum>(A)</enum><text>the Director finds that such a waiver will prevent entities eligible for grants under the covered program from failing or suffering undue hardship; and</text></subparagraph><subparagraph id="id4d0bd73095ef4109bf320786b84bd040"><enum>(B)</enum><text>each entity that receives a grant under the covered program is still required to report to the Administrator on the use by the entity of the amounts received under the grant.</text></subparagraph></paragraph><paragraph id="idc909b6577d894f35adc5979d36717fc2" commented="no"><enum>(2)</enum><header>Continuity</header><text>To the extent practicable, the Director of the Office of Management and Budget shall prioritize administrative continuity for covered programs with the Restaurant Revitalization Fund authorized in section 5003 of the American Rescue Plan Act of 2021 (<external-xref legal-doc="usc" parsable-cite="usc/15/9009c">15 U.S.C. 9009c</external-xref>). </text></paragraph></subsection><subsection id="idA6E8916A23F9407CA45AF556B7D4E9F2" commented="no"><enum>(b)</enum><header>Limitation on denial based on denial for other SBA programs</header><text>The Administrator may not deny an application by an entity for a grant under a covered program solely on the basis that an application by the entity for another program of the Small Business Administration, including the program under section 5003 of the American Rescue Plan Act of 2021 (<external-xref legal-doc="usc" parsable-cite="usc/15/9009c">15 U.S.C. 9009c</external-xref>), was denied.</text></subsection></section><section id="idDA6474123B0F454ABB71EA8A62FCC915" commented="no"><enum>265.</enum><header>Prohibition on participation in multiple programs</header><subsection id="id03F54C378A664BF3AB794E4930441AEB" commented="no"><enum>(a)</enum><header>In general</header><text>An entity may not receive a grant under more than 1 covered program or receive a grant under a covered program and a grant under title IV.</text></subsection><subsection id="idD63AA7C9067C4EB6970B090A46E7ED70" commented="no"><enum>(b)</enum><header>Withdrawal of pending applications</header><paragraph commented="no" id="idB73450BBF6F64D0C86E8D64B7F56B890"><enum>(1)</enum><header>Definition</header><text>In this subsection, the term <term>covered application</term> means an application for a grant under— </text><subparagraph commented="no" id="id52EDA980E8314C649C7F0B4E30BEBB2D"><enum>(A)</enum><text>a covered program; </text></subparagraph><subparagraph commented="no" id="id0D22E9B531A249A0A8ACAF2E0841178D"><enum>(B)</enum><text>the program under section 5003 of the American Rescue Plan Act of 2021 (<external-xref legal-doc="usc" parsable-cite="usc/15/9009c">15 U.S.C. 9009c</external-xref>); or </text></subparagraph><subparagraph commented="no" id="id5DB4F46555894B3F8821813088944902"><enum>(C)</enum><text>the program under section 324 of the Economic Aid to Hard Hit Small Businesses, Nonprofits, and Venues Act (<external-xref legal-doc="usc" parsable-cite="usc/15/9009a">15 U.S.C. 9009a</external-xref>).</text></subparagraph></paragraph><paragraph commented="no" id="id6C54C8EEBEE74BF2A7BAA7DCC23896C2"><enum>(2)</enum><header>Withdrawal</header><text>An entity that has a pending covered application may submit a covered application with respect to another program if, at or before the time that the entity submits the covered application with respect to another program, the entity withdraws the pending covered application.</text></paragraph></subsection></section><section id="idBFA2BFF69CF24094BD4D53B5F1D75C30" commented="no"><enum>266.</enum><header>Transfer of funds</header><subsection id="idF182281F84A641BDBAB2ACD4C37333F1" commented="no"><enum>(a)</enum><header>Authority</header><paragraph commented="no" id="id6A49BBE32CAA41ADBEE399A1046C45ED"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to paragraph (2), on and after the date that is 30 days after the date on which the Administrator begins accepting applications under a covered program, the Administrator may transfer amounts made available under this title for that covered program to the fund established under this title for another covered program.</text></paragraph><paragraph commented="no" id="idA9DA9619B66647E59937D918330866B5"><enum>(2)</enum><header>Limitation</header><text display-inline="yes-display-inline">The Administrator may not transfer amounts made available under this title for a covered program if the Administrator determines that the amounts made available to carry out that covered program are insufficient to make grants to each eligible entity in the amount specified with respect to that covered program.</text></paragraph></subsection><subsection id="idBCB23AB181794E588F683604418A2AEA" commented="no"><enum>(b)</enum><header>Use of transferred funds</header><text>Any amounts transferred under subsection (a) shall be merged with, and available for the same purposes as, other amounts in the fund to which the amounts are transferred. </text></subsection></section><section id="id64BDAA88DEAF408DB0A4186C07AFE611" commented="no"><enum>267.</enum><header>Oversight and audits</header><subsection id="id0DA3982BACE84F85899094D1E1FA6983" commented="no"><enum>(a)</enum><header>In general</header><text>The Administrator shall institute an oversight and audit plan with respect to entities receiving grants under a covered program, which shall include—</text><paragraph id="id8831E639FC4243D0834676AE3786DBC3" commented="no"><enum>(1)</enum><text>documentation requirements that are consistent with the eligibility and other requirements under the applicable covered program, including by requiring an entity that receives a grant under the covered program to retain records that demonstrate compliance with those requirements; and</text></paragraph><paragraph id="idEB2A92F69175459A8FAB91005188B054" commented="no"><enum>(2)</enum><text>reviews of the use by entities of grants made under the applicable covered program to ensure compliance with the requirements under that covered program, which shall include—</text><subparagraph id="idD1D286F374FF46F995AD732EF4DDEAB0" commented="no"><enum>(A)</enum><text>the review and audit, by the Administrator, of grants made under that covered program; and</text></subparagraph><subparagraph id="idEFEB39EA9A454D7D96973DA7F3F8C340" commented="no"><enum>(B)</enum><text>in the case of fraud or other material noncompliance with respect to a grant made under that covered program—</text><clause id="id4A3B8CAA96794F0B8EF11650981D0A7E" commented="no"><enum>(i)</enum><text>a requirement that the applicable entity repay to the Administrator the amount of the misspent funds; or</text></clause><clause id="id216C80BBAC2C41BF814299BDB55C82C6" commented="no"><enum>(ii)</enum><text>the pursuit, by the Administrator, of legal action to collect the misspent funds.</text></clause></subparagraph></paragraph></subsection><subsection id="id4A738EEC0FD74D4EA082E8302FD33E04" commented="no"><enum>(b)</enum><header>Submission of plan</header><text>Not later than 45 days after the date of enactment of this Act, the Administrator shall submit to the Committee on Small Business and Entrepreneurship of the Senate and the Committee on Small Business of the House of Representatives the plan required under subsection (a), which shall describe—</text><paragraph id="idA33ADBC12F2740B78B8949619498D91D" commented="no"><enum>(1)</enum><text>the policies and procedures of the Administrator for conducting oversight and audits of grants made under the covered programs; and</text></paragraph><paragraph id="id81953510D8C44D738DF6571AE4D7BDE5" commented="no"><enum>(2)</enum><text>the metrics that the Administrator will use to determine which grants made under a covered program will be audited under that plan.</text></paragraph></subsection><subsection id="id859A057CA39B4EFA9F537B4E8B1F5DBA" commented="no"><enum>(c)</enum><header>Reports</header><text>Not later than 60 days after the date of enactment of this Act, once every 30 days thereafter until the date that is 180 days after the date on which all amounts made available to carry out covered programs have been fully expended, and upon request thereafter, the Administrator shall submit to the Committee on Small Business and Entrepreneurship of the Senate and the Committee on Small Business of the House of Representatives a report on the oversight and audit activities of the Administrator under this section, which shall include—</text><paragraph id="idCC6FB8A78EC54F3DB08DF69FA3B20E73" commented="no"><enum>(1)</enum><text>the total number of grants approved and disbursed under each covered program;</text></paragraph><paragraph id="idC0E161F0D10B4F0E9FC88BAAEDAD3F6A" commented="no"><enum>(2)</enum><text>the total amount of each grant under each covered program received by each entity that received such a payment; </text></paragraph><paragraph id="id779250B918184B7A83791899567ABD12" commented="no"><enum>(3)</enum><text>the number of active investigations and audits of grants made under each covered program;</text></paragraph><paragraph id="id3E49F86DA9754D848F18A5A6C2E01050" commented="no"><enum>(4)</enum><text>the number of completed reviews and audits of grants made under each covered program, including a description of— </text><subparagraph id="id7BC1C250AFEB4125A68215BD1614F8F3" commented="no"><enum>(A)</enum><text>any findings of fraud or other material noncompliance with the requirements of the applicable covered program; </text></subparagraph><subparagraph id="idE2A09DCC8D364C609EBF34CE1E500B79" commented="no"><enum>(B)</enum><text>questionable costs identified by the Administrator; and</text></subparagraph><subparagraph commented="no" id="id43978557F9DC45328EB5195AD793410E"><enum>(C)</enum><text>the total amount recouped from ineligible recipients; and</text></subparagraph></paragraph><paragraph id="id2DA4B3F063D5417FB107E7B9C9FC996B" commented="no"><enum>(5)</enum><text>a description of any substantial changes made to the plan required under subsection (a).</text></paragraph></subsection></section><section id="id4d6d0eef79ec4da39a1f621c6a160ddb" commented="no" display-inline="no-display-inline"><enum>268.</enum><header>Administrative funding</header><text display-inline="no-display-inline">In addition to amounts otherwise available, there is appropriated to the Administrator for fiscal year 2022, out of any money in the Treasury not otherwise appropriated, to remain available until expended, $150,000,000 for administrative expenses to carry out the covered programs, of which, $20,000,000 shall be for the Inspector General of the Small Business Administration for necessary expenses of the Office of Inspector General.</text></section><section id="idb6c7d5450cbf4a16978b73f22c775e5d" commented="no"><enum>269.</enum><header>Gross receipts</header><text display-inline="no-display-inline">For each covered program, the Administrator may authorize applicants for grants under the covered program to measure annual gross receipts using either the calendar year or fiscal year. </text></section><section id="id8813A9A183DC410BB6CB0915E457C4E6" commented="no" display-inline="no-display-inline"><enum>270.</enum><header>Rules</header><text display-inline="no-display-inline">Not later than 60 days after the date of enactment of this Act, the Administrator shall issue rules to carry out each covered program, without regard to the notice requirements under section 553(b) of title 5, United States Code. </text></section></subtitle></title><title id="idDB25AF1D6CC647A78688C1EC4868C649" style="OLC" commented="no"><enum>III</enum><header>Other SBA program improvements</header><section id="id5c339dae828c4b26a8d4d5f4c937ae61" commented="no"><enum>301.</enum><header>Shuttered venue operators</header><subsection id="idDADF28D2529D4220A33AF269620BE616" commented="no"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 324(d) of title III of division N of the Consolidated Appropriations Act, 2021 (<external-xref legal-doc="usc" parsable-cite="usc/15/9009a">15 U.S.C. 9009a(d)</external-xref>) is amended by striking paragraph (1) and inserting the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="id817cdc915f7444319b099652ef67143b"><paragraph id="id72a8b65a16dc495b8b0155ca30f3183b" commented="no"><enum>(1)</enum><header>Timing</header><subparagraph id="id00dbb68368cf4781a41ea57601636fd8" commented="no"><enum>(A)</enum><header>Expenses incurred</header><text>Amounts received under a grant under this section may be used for costs incurred during the period beginning on March 1, 2020, and ending on March 11, 2023.</text></subparagraph><subparagraph id="id3a9403d075724471b9cc5939ee6f26d5" commented="no"><enum>(B)</enum><header>Expenditure</header><text>An eligible person or entity shall return to the Administrator any amounts received under a grant under this section that are not expended on or before April 15, 2023, with respect to costs incurred during the period described in subparagraph (A).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="id4C8714DE0DB9431182F396FAD85D0D74" commented="no"><enum>(b)</enum><header>Applicability</header><text>The amendment made by subsection (a) shall apply to grants made under section 324 of title III of division N of the Consolidated Appropriations Act, 2021 (<external-xref legal-doc="usc" parsable-cite="usc/15/9009a">15 U.S.C. 9009a</external-xref>) before, on, or after the date of enactment of this Act. </text></subsection></section><section id="id8671865ee5b84f0c99656d4502c36527" commented="no"><enum>302.</enum><header>Treatment of paycheck protection program loan forgiveness of payroll costs under highway and public transportation project cost reimbursement contracts</header><subsection id="idcac48665c9a04a7db67f3c291be3e520" commented="no"><enum>(a)</enum><header>In general</header><text>Notwithstanding section 31.201–5 of title 48, Code of Federal Regulations (or successor regulations), for the purposes of any cost-reimbursement contract awarded in accordance with section 112 of title 23, United States Code, or section 5325 of title 49, United States Code, or any subcontract under such a contract, no cost reduction or cash refund (including through a reduced indirect cost rate) shall be due to the Department of Transportation or to a State transportation department, transit agency, or other recipient of assistance under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/23/1">chapter 1</external-xref> of title 23, United States Code, or <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/53">chapter 53</external-xref> of title 49, United States Code, on the basis of forgiveness of the payroll costs of a covered loan (as those terms are defined in section 7A(a) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636m">15 U.S.C. 636m(a)</external-xref>)) issued under the paycheck protection program under section 7(a)(36) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(a)(36)</external-xref>).</text></subsection><subsection id="id2caedbb33d6643dfb9c61b8979725ebf" commented="no"><enum>(b)</enum><header>Rule of construction</header><text>Nothing in this section shall be construed to amend or exempt the prohibitions and liability under section 3729 of title 31, United States Code, (relating to false claims).</text></subsection><subsection id="idc3361d6c9aaf4d3482594b071aa053e6" commented="no"><enum>(c)</enum><header>Termination</header><text>This section shall cease to have force or effect on June 30, 2025.</text></subsection></section></title><title id="id319500888ACE4EDCBDA80DEC5B2636E5" style="OLC" commented="no"><enum>IV</enum><header>Transportation services</header><section id="id4E1DB370DAE2468783B37CC51711CFF2" commented="no"><enum>401.</enum><header>Additional assistance for eligible providers of transportation services affected by COVID–19</header><subsection id="idAC2ED42216A0447B9E60A8C32B324208" commented="no"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph id="id0B4ECA6A296340878199F26B72ACACA2" commented="no"><enum>(1)</enum><header>CERTS Act</header><text>The term <term>CERTS Act</term> means subtitle B of title IV of division N of the Consolidated Appropriations Act, 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/116/260">Public Law 116–260</external-xref>).</text></paragraph><paragraph id="id990D6CD7AF874624A4CDA4AB031E4ADA" commented="no"><enum>(2)</enum><header>Provider of transportation services</header><text>The term <term>provider of transportation services</term> has the meaning given the term in section 421(a) of the CERTS Act.</text></paragraph><paragraph id="id518718D4B3084674957BB0188B017887" commented="no"><enum>(3)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Treasury.</text></paragraph></subsection><subsection id="id8054A144D4BA4BF5BDFFE2186200910C" commented="no"><enum>(b)</enum><header>Appropriation</header><text>In addition to amounts otherwise made available, there is appropriated for fiscal year 2022, out of any money in the Treasury not otherwise appropriated, $2,000,000,000, to remain available until expended, to provide additional funding for grants under the CERTS Act.</text></subsection><subsection id="id257761c68cf34c7e8a93f33d3f4fbfb3" commented="no"><enum>(c)</enum><header>Payments</header><paragraph id="id2F22F5CC1DAF43D0B9AB3A1B54D5E71D" commented="no"><enum>(1)</enum><header>Eligible entities</header><text>The Secretary shall provide the funds made available by subsection (b) to providers of transportation services that—</text><subparagraph id="id3c9f696ee6a5422fbe58d36c45fb6ff3" commented="no"><enum>(A)</enum><text>as of the date of enactment of this Act—</text><clause id="idF3C149BE86214BC3A57773EE76597465" commented="no"><enum>(i)</enum><text>have been determined to be eligible under the CERTS Act; and</text></clause><clause id="id640DFC7FD0B64D4F85784B5C5A9B1EC0" commented="no"><enum>(ii)</enum><text>are in compliance with the applicable terms and conditions of the CERTS Act; or</text></clause></subparagraph><subparagraph id="idD9B82FF720184BB2A19ED7F9D957452C" commented="no"><enum>(B)</enum><text>on or after the date of enactment of this Act, are determined to be eligible under the terms and conditions described in subparagraph (A)(ii).</text></subparagraph></paragraph><paragraph id="id8017290B17A54A5E8E704618A13D5AEA" commented="no"><enum>(2)</enum><header>Calculation</header><text>A payment provided under this subsection shall be calculated using the same methodology as is used for the distribution of funds under the CERTS Act.</text></paragraph><paragraph id="id40D0AB72CD6D4026B16EF41D63EF5408" commented="no"><enum>(3)</enum><header>Return of unused amounts</header><text>A provider of transportation services shall return to the Secretary any funds provided under this subsection that are not used by the provider of transportation services by the date that is 1 year after the date of receipt of the funds.</text></paragraph></subsection><subsection id="id7894f72f467c4184a68e81b9e7a77c7f" commented="no"><enum>(d)</enum><header>Administration</header><paragraph id="idD71EBD68A15E485BAB0D4CB558A2D813" commented="no"><enum>(1)</enum><header>In general</header><text>The Secretary shall have the authorities provided by the CERTS Act with respect to the funds made available by subsection (b).</text></paragraph><paragraph id="id5D7FE3EC721442B28142AB9BF0B82B72" commented="no"><enum>(2)</enum><header>Administrative expenses</header><text>Of the funds made available by subsection (b), not more than $50,000,000 may be used by the Secretary for the costs of administering this section and the CERTS Act.</text></paragraph></subsection></section></title><title id="id4E3B97F805544E9DBADE81E3AB651FA8" style="OLC"><enum>V</enum><header>Offsets</header><section id="idAF133F574A654EB0963ABCB99A1ED3DF"><enum>501.</enum><header>Offsetting rescissions</header><subsection id="id2325a5190e2d4beb9ad04610e0e18a51"><enum>(a)</enum><header>In general</header><text>Of the unobligated balances from amounts made available under the heading <quote>Small Business Administration—Business Loans Program Account, CARES Act</quote> in section 323(d)(1)(A) of division N of the Consolidated Appropriations Act, 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/116/260">Public Law 116–260</external-xref>; 134 Stat. 2019) for the cost of guaranteed loans as
