Stafford Disaster Relief and Emergency Assistance Act, and public health emergencies under the Public Health Service Act on the premise of climate change, and for other purposes. </official-title></form><legis-body style="OLC" display-enacting-clause="yes-display-enacting-clause" id="H228889CE51034A0DA3FE41D0F0E0666C"><section section-type="section-one" id="H7BD4BF9DBE2F4259A10DA15D2DC1D747"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Real Emergencies Act</short-title></quote>.</text></section><section section-type="subsequent-section" id="HD6C6212E2BE6435B9A68E0E4350FC518"><enum>2.</enum><header>Clarification of executive inability to declare certain national emergencies, major disasters, emergencies, and public health emergencies</header><subsection id="H6CE122E344804D5CA338158551F555DC"><enum>(a)</enum><header>National emergency</header><text display-inline="yes-display-inline">The President may not declare a national emergency under the National Emergencies Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1601">50 U.S.C. 1601 et seq.</external-xref>) on the premise of climate change. </text></subsection><subsection id="H81D1FFD999074C47BE92D609AFDB46B7"><enum>(b)</enum><header>Major disaster; emergency</header><text display-inline="yes-display-inline">The President may not declare a major disaster or emergency under section 401 or 501, respectively, of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170">42 U.S.C. 5170</external-xref>, 5191) on the premise of climate change.</text></subsection><subsection id="H6C4D48EA86B3413CA8E20E0EE765C781"><enum>(c)</enum><header>Public health emergency</header><text display-inline="yes-display-inline">The President may not declare a public health emergency under section 319 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247d">42 U.S.C. 247d</external-xref>) on the premise of climate change.</text></subsection><subsection id="H61949E8170764292ADB76A74EF453481"><enum>(d)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Nothing in this Act shall be construed to imply the authority of the President before the date of enactment of this Act to declare, on the premise of climate change—</text><paragraph id="id8B9F6E89FA4C469E90E494BEB00A0C93"><enum>(1)</enum><text display-inline="yes-display-inline">a national emergency under the National Emergencies Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1601">50 U.S.C. 1601 et seq.</external-xref>);</text></paragraph><paragraph id="id669C560D1F4D46D3A09E902A0055CADA"><enum>(2)</enum><text display-inline="yes-display-inline">a major disaster or emergency under the under section 401 or 501, respectively, of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170">42 U.S.C. 5170</external-xref>, 5191); or</text></paragraph><paragraph id="idAF69980F4CD74821BD1E6E2E53241D8D"><enum>(3)</enum><text display-inline="yes-display-inline">a public health emergency under section 319 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247d">42 U.S.C. 247d</external-xref>).</text></paragraph></subsection></section></legis-body></bill>
